Today's proceedings will be abbreviated because Chief Judge Belvin Perry has other matters, unrelated to the case, to tend to.
Court is expected to be held 8:30 a.m. to noon. Perry earlier this week told attorneys to start arriving at 8:30 so they can take up matters before the jury is brought in at 9 a.m.

Beaz has had the computer Casey used for years, but he told the judge that he never bothered to analyze what she might have been doing on the computer the same afternoon Caylee allegedly drowned.

"The computer activity, as well as instant messages that were also sent in discovery years ago, negate that time line,” said Drane-Burdick.

But now Baez wants the state banned from using the computer evidence they provided on a disk to the defense this week. The disk is just part of an entire hard drive of computer data Baez has had for three years.

"It's not new evidence. I don't know how something can be new evidence when it was given to you,” said Judge Belvin Perry.
WFTV’s legal analyst Bill Sheaffer said Baez has botched enough of the case that the question is whether Casey will get a new trial on appeal, not whether the jury will believe the drowning theory.

"The jury already suspects that this is not a valid defense. This will be the death knell to that defense,” said Sheaffer. “The minute they put on one piece of testimony in that regard, these computer searches and the activities will come into evidence.

Casey is charged with first-degree murder, aggravated child abuse, aggravated manslaughter of a child and four counts of lying to law enforcement. She has pleaded not guilty and faces the death penalty if convicted.

Good morning.  It's amazing how Greta dumped this case long ago for politics and now that it's a ratings cash cow she gets on it again.  She doesn't seem to know too much about the case.  Tennis is a bit off too.  "Give the defense a break"?????  The defense has had more breaks that Evil Knievel!!

Good morning Monkeys. This "new trial" theory b/c Baez is doing a crappy job is really bothering me.
The girl is now penniless, already spent big money on Baez, has had dozens of good lawyers with reputations at her beck and call, has had a chance to fire Baez a million times, but said no and she might get a new trial? The state of Florida has already spent more on her defense than most, why should she get one?

I understand the appeal thing, everyone convicted can have one, but for ineffective council I say too bad! She had her shot. Why should the people pay for more when it was her choice to retain him?

I hope if she gets a new trial the defense team gets a trial too.  It must be illegal to just "throw" a trial!

IMO they've done more than just try to throw a trial....The events around April 2010 now make sense!! The Robyn, Casey, Maya, Sky, River, Baez and GA connection is clear to anyone who wants to see it for what it really is. I’m amazed at the degree of devious and underhanded manipulation put forth by that defense with the consent and involvement of the Ant’s.
If I can figure it out, I have no doubt the State knows as well. My only question is how is the State going to handle it.

That's exactly it! It appears they are trying to throw the trial!!!  Baez was always just in it for the media deals and doesn't give a rat's azz if she's convicted, in fact, it would make it all the better!  I hope the State gets every dime he attempts to make off this trial.

The defense will spend their afternoon taking the deposition of a man convicted of kidnapping. They claim Vasco Thompson may have a connection to the Anthony family.

In a recent news conference held outside the Orange County Courthouse, Thompson denied the defense's claims.

Casey Anthony's defense attorneys said they found phone records that show George Anthony called a number currently used by Thompson during the time of Caylee Anthony's disappearance.

WFTV obtained the Department of Children and Families report about that 2007 Christmas day drowning. Whalen's son drowned in an above ground pool, and the boy's grandfather found his body, then called 911.

Some are suggesting that she heard about this girl's story in prison, and decided to use that as her defense..  BUT, this other child died before Caylee, so it's very plausible that Casey had this story in the back of her mind before being arrested.

I think everybody associated with the defense and Casey would still be arguing Caylee was alive if her body hadn't been found. 

April was in jail june or july of 2009...it was said by jankasaurus (sp) lol that April did talk about it in jail but not sure she talked to Casey....

If I am not mistaken in beginning Baez was also spewing off about Zanny and "possible homicide" unfortunately no one but Baez and Casey knows when they concocted this assinine mess they have come out with now...their "Zanny" story fell apart on them so they had to come up with something else...

She did do searches on missing kids' cases.  I hope LE has someone checking that hard drive to see if she looked at the news stories of April Whalen's child.  They need proof that she knew about that situation before the trial.

I am trying to decide which mistake the defense has made (so far) that has been most damaging to Casey.  I think that it may have been not arguing the editing of the jail video tapes.  Prior to seeing those, the jury could have given Casey the benefit of the doubt about her bizarre behavior after Caylee died but those videos show she had no remorse or grief and the jury got to see her in her natural state -  selfish and mean.

Her face looks exactly the same to me in most screen shots. I'd like to see a side-by-side comparison... cos honestly, and maybe I just haven't studied her enough, she has the same (forced and unnatural) blank expression most of the time.

i can't imagine that she'll testify to anything more than the absence of a match of anything.  I think the state would have called her if there was any match or even a match that wasn't consistent with their theory.

She is oatmeal without salt ..... Maybe Baez's tactic is to mind-numb the jury?

It just dawned on me, maybe KC didn't wear her own shoes.  Maybe she borrowed a pair from someone else in the house.

The shorts were probably in her car for months or she purposely used old shorts to make it look like "Zanny" had them from an earlier time, 2 plastic bags & a canvas laundry bag.

I am not sure about the shorts. I think that is a red herring bozo put out there because when I looked at the shorts in the evidence pictures they were size 3T. I think he made up the 24 months size he used.

to me this testimony would be the equivalant to the state calling all sorts of experts and having them testify to the absence of any evidence of drowning even though after 6 months there wouldn't be any.  It is deperate.

Too bad the "junk science" of "Radionics" isn't main stream yet, they could have found it. It is the measurement of frequences of illness, drugs, et al from hair, saliva, or a human person standing there. Radionics would answer all these questions no matter the time. I have used this for my own health a long time ago and should go looking for my 1971 machine.

Good Morning! The size of Caylee's shorts are meaningless to me, 24 months is size 2, Caylee was 2 almost 3. Anyone with kids knows that depending on how things are made and the child's size they can wear any size within reason. Both of my grandchildren have worn sizes way behind their age esp. if the waist is elastic! Sizes are not exact in kids clothing anyway! Both my girls wore 24 months shorts til they were 4!

Cholorform dissipates quickly and, therefore, doesn't last long enough in the system to be present in growing hair.  That's why they don't do lab studies for chloroform in the hair.

I really think the defense strategy is to bore the jury into a not guilty verdict by reason of boredom.

The defense is trying to take Dr Vass and make him out to be "The Nutty Professor," but they are sorely mistaken.  They didnt succeed in discrediting Vass on cross so now they are taking a few more shots at it....failing miserably

And can i add, you are always buying your kids new clothes, as they grow, but if you have a smaller size in the drawer & they can still get them on, then you let them wear them. The size is a non issue for me, any juror with kids will know this!

The litttle shorts were in better condition..waistband still in tact and they were 24 month size..which proves nothing other then they were an older pair of shorts of Caylee's that still fit her..I don't know why Baez makes an issue of them.

The witness explained quite clearly yesterday why there was no purpose of taking a quantitative measure.

9:00am Wed, June 22, 2011 Court is in session, the jury is not present.

Court and attorneys are at sidebar before court begins. Jury is being returned.

Defense witness is Maureen Bottrell.

Baez is up.........

Works for the FBI as a Geologist Forensic Examiner.  Takes soil analysis.  Has lots of education and has lectured and taught her subject. Deals with soils and minerals and glass, rocks, gem stones and cements.  She has testified 40 times in Federal and State Courts.

She has been declared an expert witness in geology.

She had items sent to her in this case, she examined them for geological evidence.  Baez is referring her to her report of March 2009.  She received items from Casey's car.  Debris from the trunk and around the car, and the shovel from Brian Burner.  She also received 22 pairs of shoes from the Anthony home.  She also received soil samples from evidence markers from the remains site off Suburban.  The soil samples received were after the top layer was removed. 2 samples from the car were insufficient and the rest were mixed samples and she couldn't do a good study.  With the shovel, the testing was stopped because the body was found.  They were looking at the shovel to determine where the body may have been buried.  They never tested the shovel again.  The shoes either had no material on them or was very limited.  3 pairs of the shoes were tested and were different from the crime remains scene.  She also tested a transport bag, which is the bag the shoes came in and it had insufficient material in it to be tested.

Did you determine the shoes you did examine were never at Suburban Drive?  No. There are many reasons she gave for this, they could of been at the scene and she would not of found it on the shoes.  She could not find the presence or absence of evidence to say that Casey was either at or not at Suburban Drive.

Baez is up.........

You cannot say that Casey was at Suburban Drive?  No, I cannot.  I would have to speculate to say whether or not she was at the scene compared to the evidence found on her shoes.  Witness is excused.

9:20am, next defense witness is Madeline Montgomery. 

Baez is up......


She is a Forensic Toxicologist for the FBI in Quantico, VA.  She had lots of education and training. She analyzes blood, urine and hair for drugs and poisons. She has published peer reviewed papers.  She has testified in court 11 times.  She is declared an expert witness in Forensic Chemistry and Toxicology.

She received the hair mat belonging to Caylee Marie Anthony.  She tested the hair by first breaking off part of the hair and making it into dust then into solvent and then tested that in a instrument and tested for Xanax and Klonopin, she was asked to test for those.  The tests for those 2 drugs were negative.  She also tested for those again and 9 other drugs in the same family, Valium, roofies, Ketamine and others.  All the results were negative.  She used a new technique that was 10 times more powerful than the normal test.  She tested for no other items.  She doesn't know how much exposure to these drugs it would take for it to show up in the hair.

The negative result is forensically meaningless?  It means I didn't find the drug and it didn't show up.  It could of been given and not show up in the hair?  Yes.  If someone were exposed to something and died immediately it would not of shown up in the hair?  No, it would not.  You can not test for chloroform can you?  No, I can not. You could not test the hair to see if this child drowned?  No.

What other meaningless kind of work do you do at the FBI.  I don't believe any of my work is meaningless. You had a sample you did a test and the results came back negative?  Yes.

9:40am Next defense witness is Dr. Michael Sigman.

Mason is up.........

He is a faculty member at the University of Central Florida.  He is a forensic scientist.  He has a PhD and lots of other education.  He worked at Oakridge Natl. Lab he knew Dr. Arpad Vass at Oakridge. He has 64 peer reviewed publications.  He has lectured over 40 times.  He is declared an expert in the field of chemistry

He became involved in this case July 2008, he was asked to take air samples from the trunk of the Pontiac Sun Fire.  Dr Vass was not available to take those samples, so he was asked to go to the OC Sheriff's Office and take samples.  He called Dr Vass and asked him what kind of samples he wanted him to use.  They discussed using a tedlar bag, it is a plastic bag, it is commonly used for collecting air samples.  He and his associate Doug Clark went to OC Sheriff's Vehicle bay and took air samples from the Pontiac.  They used a syringe to pull air from the trunk an inch, extracted the air and placed it into the tedlar bag.  He took 2 samples into 2 tedlar bags.  He left both samples in custody with the OC Sheriff's Dept.  The large bag was sent to Dr Vass and the smaller bag was sent to the Central Florida University, where they tested it.  They used a an oven like machine called the massed spectrometer.  The first test found trace amounts of volatile components, similar to what you would find in gasoline.  They did another test and found more concentrations of gasoline.  They were not able to do any quantitative analysis.  They were able to identify from the second sample, components from gasoline.  They knew they could use a different method that would work better.  On July 22, 2008 they returned to the OC Sheriff's bay and took new tests.  They took them to the Natl Center for Forensic Science.  On July 23, 2008 they took more samples that were left for periods of hours.  The results of all samples, was primarily that of gasoline and chloroform and others.  They were not subjected to quantitative analysis.  Tetrachoralethylene was also found, it is normally found in dry cleaning materials and spot removers.  Chloroform is a solvent that is used in degreasing applications and is formed in natural settings with bleach and other materials found in decomposition as well.  He has not done decomposition studies on human remains but Dr Vass and others have found these and other compounds are found in human decomp.  Dr. Stethalopoulous has also found these compounds in decomposing bodies, 11 were in common with Dr. Vass.  Do you have an opinion now whether or not there was human remains in that trunk?  There were 3 compounds found at low levels, based solely on our tests, I can not say that human remains were in that trunk.  I was aware that garbage was found in the trunk. How many air samples did you take?  6, 2 tedlar bags, and 4 others.  All of those samples was the primary finding gasoline?  Could be attributed to gasoline.  The solid phase contained the other 3 compounds.  Mason is done.....

He's done now.  I hope someone taped it and we can find it later.  He commented on how the juror is closed (arms crossed, no note taking) while the pros is up and then starts paying close attention and taking notes when the defense is up.  He thinks she may be the one juror that hangs the jury.  He also said that he thought the pros had a good reason for dismissing her (she can't judge people).  He didn't feel that it had anything to do with her race.  He said other things but can't remember.

You took your air samples July 21, 2008?  Yes.  You opened the trunk and drew out the air sample?  Yes, we opened the trunk about an inch and inserted an 8 inch needle.  You did not look in the trunk and see that the liner and the spare tire cover had been removed?  No, I did not.  Took a tiny amount of air and injected into a tedlar bag and a CSI from OC Sheriff's office brought it to his university.  Dr Vass wanted you to use a triple sorbent trap but he didn't have any. Correct. The two methods you used is still not as good as a triple sorbent trap?  Yes.  Even with the methods you were able to use and even with the trunk liner and the spare tire cover gone, you were able to find chloroform and 2 other substance that are consistent with the research that are out there that compare to human decomposition.  You said that chloroform can come from a reaction from bleach and certain other substance?  That comes from people that swims in pools?  Yes.  Hazardous amounts or minor amounts.  Very minor amounts, not hazardous amounts.  Would there have to be other compounds there to form chloroform.  He said a lot but he is basically saying yes, I think, lol.  The reaction if that would occur would create more than just chloroform if it occurred?  Yes.  Can chlorine gas be caused by a bathing suit be thrown in the trunk of the car. No it would become something else or dissipate.  Did you find anything in your sample that this chlorine came from pool chlorine or chlorine bleach?  There is nothing in our research to suggest that, we simply know they are there, we do not know there source.  You do not study human decomp?  No. Did you detect an odor coming from the trunk? Yes I did.

In this case especially, I agree that LWOP is just as severe a punishment as death.  The thought of ICA languishing in a jail for decades without being able to have her "Bella Vita" is the perfect option for me.  And with juror 4, I am afraid that LWOP is the BEST we can hope for.  I fear a hung jury, followed by a plea deal for a lesser charge that the prosecution will be forced to take because of the exorbitant cost of this trial.

It would have been so easy to do it correctly and he just seems to screw up everything he touches in this case. I am never ceased to be amazed at how really stupid he is. Someone said on TV it might be an act - this is not an act but pure ignorance of the law.
