AG blamed for Joe Paterno's downfall

An attorney for former Penn State assistant coach Jerry Sandusky blamed the attorney general's "embellished" rhetoric for setting off the furious public outcry that led to the downfall of longtime coach Joe Paterno.
Karl Rominger said in an interview with abc27 News of Harrisburg, Pa., on Wednesday night that Paterno was the victim of an unwarranted media storm fueled by the attorney general's office and blamed prosecutors for making November's grand jury presentment against Sandusky so graphic it helped hound Paterno out of his job.
"We believe that the report was embellished, embellished for effect," Rominger told the TV station. "In other words designed to hurt Mister Sandusky publicly to whip up public foment against him and that Joe Paterno became collateral damage of that."

The attorney general's spokesman dismissed Rominger's comments Wednesday night as not meriting a response.
State prosecutors requested Tuesday that Sandusky's trial be heard by jurors brought in from another Pennsylvania county because of pretrial publicity and Penn State's prominent role in its local community.

Committee sends child abuse reporting bill to Virginia House, response to Penn State scandal
February 2, 2012
RICHMOND, Va. — Legislation that spells out the duties and deadlines of college coaches and other professions to report evidence of child abuse and increases punishment for those who don’t received a House committee’s unanimous blessing Thursday.
The three bills are Virginia’s response to child abuse allegations that rocked Penn State’s mighty football program and forced the November firing of its legendary head coach, Joe Paterno.
Together, they place statutory requirements on coaches, recreation specialists, youth volunteers and others to report suspected child abuse to law enforcement and other authorities. The legislation also shortens the deadline from 72 hours to just 24.

Penn State’s insurer wants a judge to determine if it has to provide coverage or pay for defense costs in a lawsuit over alleged child sex abuse by former football coach Jerry Sandusky, a newspaper reported Wednesday.
The complaint filed by the Pennsylvania Manufacturers’ Association Insurance Co. in a Philadelphia court claims its coverage for abuse or molestation only pertains to a limited time period, the Legal Intelligencer reported.

It's implausible that any responsible lawyer, let alone one as experienced as Baldwin, would fail to make clear whom she represents and whom she does not. I believe she was instructed by Spanier to represent the three of them as Penn State employees. It's especially interesting that Joe Paterno brought his own counsel. He either spotted the obvious conflict of interest, realized that Old Main's objective would be to get people's stories straight (putting him at risk of perjury or conspiracy charges), and/or was (wisely) wary of being thrown under the bus by Spanier and those working at the President's behest.
As soon as Spanier issued his statement of "unconditional support" for Curley and Schultz, it occurred to me that he was trying to keep them on the ranch and have them "take one for the team." That hasty statement of support made no sense to me otherwise. It looked like the product of an anxiety attack from a very worried man. My opinion on this was further solidified when the University quickly agreed to pay Curley and Schultz's legal fees and allowed them gracious non-exits. "The team" in this case was probably sold to them by Spanier as good ol' State, but he was looking out for his own interests. They were on the stand, using that weird old man "horsing around" language they got from Jerry, because someone convinced them it was in PSU's best interests to get their stories straight and tell a tale that made the actual whistleblowers look like villains who downplayed the seriousness of the matter.
This scenario is further suggested by the statements made by the BOT about Spanier and Baldwin's minimization of the real risk to the University when Sarah's original Sandusky story appeared in the P-N as well as the CDT. In the frantic first days of unpreparedness following the arrests, Spanier was busy doctoring/softening the BOT's press release to suit his own interests, per several trustees. Garban, meanwhile, was inexplicably uninterested in reading the GJ report...why? Because he already knew what it said from Spanier?
Spanier is a so-so washboard player, but dude is truly some kind of magician. He's almost wholly disappeared from the Sandusky story, he likely engaged in machinations after the arrest to ensure that the BOT viewed Paterno as the bigger problem, and he somehow conned three professionals in his administration into taking actions that were not in any of their own best interests.
And now we're to believe that Baldwin somehow overlooked the one ethical lesson that is drilled into every attorney's head? Wasn't she in a large law firm where new clients are not accepted until a review is conducted to ensure there are no conflicts of interest? Seems a little difficult to believe she'd be so slipshod, especially because her hiring had to be for reasons other than the fact that some "external review" showed that PSU was highly unusual compared to its peer institutions because it didn't have in-house counsel. Why was she hired then, and not at an earlier or much later date? (The absence of in-house counsel would be an obvious oddity to anyone who spent time in any other major university setting. The complexities of a large university, including compliance with state and federal laws, make it extremely difficult for even a stellar outside firm to fully appreciate and advise on the day-to-day issues that crop up at a university.)
Yet in-house counsel (good ones) are pesky, always insisting that things be done on the up-and-up. I would not be surprised if Spanier deliberately avoided modernizing PSU's legal representation so as not to have his grand plans spoiled or delayed by annoying issues of compliance. No leader who truly cared about his/her institution (and not just his/her own ego) would subject such a well-regarded university to the level of risk that Spanier and the willfully ignorant BOT did. His reasons for doing so might have been similar to the reasons he lobbied for an exemption from typical Right to Know requirements for public institutions.
Why was Baldwin brought on board? Maybe Spanier knew this stuff was coming down, and needed to put a moat in around Old Main. Certainly, however, you'd think she'd get a strong head's up about the pending matter: "Oh, by the way, looks like your first big job will be to get us out of a mess involving our alleged complicity in allowing a pedophile to use our campus and the allure of PSU to entrap his young victims."
Unfortunately for Baldwin, however, the price of stepping up and filling that role on an emergency basis is that she now, along with Curley and Schultz, will take one for the team while the real culprit(s) play racquetball and pull rabbits out of hats (or whatever the hell it is he/they are doing these days). Maybe she was under Graham's magical spell, too, but why would this prominent lawyer in the later stages of her career agree to let Lanny Davis make her sound like an incompetent cardboard cutout of a lawyer?
Heck if I know, but I bet it's related to another mystery for our times--how it could be that a coach who allegedly "ran" all of PSU was told to dial a number to collect a "very special message" about the end of his career.
Great work identifying the real issues that tie the Sandusky mess to PSU, Sarah.

HARRISBURG - With Gov. Corbett set to announce his budget proposal next week, a key state Senate committee chairman has raised eyebrows by taking the unusual step of canceling hearings on state funding for courts and colleges, including Pennsylvania State University.
Appropriations Chairman Jake Corman (R., Centre) said he opted not to hold the traditional February budget hearings for the state college system and so-called state-related schools such as Penn State because hearings were held last fall at locations across the state.
Corman said he canceled a scheduled Feb. 23 appearance by state judiciary officials before his committee for a different reason: to give the state's highest court more time to resolve controversy over legislative redistricting. Corman said he planned to reschedule that hearing.
The moves left Senate Democrats angry that Corman pulled the plug on hearings when budget cuts are anticipated and questions linger over Penn State's child sex-abuse scandal.

25 states consider 'Penn State' bills

In the wake of the child sexual abuse scandal at Penn State University that rocked the nation, lawmakers in dozens of states across the country have introduced bills to increase the reporting of child abuse and neglect.
Measures have been put forward in 25 states already during the 2012 legislative sessions, according to the National Conference of State Legislatures.

In Pennsylvania, at least five bills on reporting child abuse have been introduced, including one that adds school staff members, faculty and coaches to the list of people required to report suspected child abuse, and another that mandates individuals with knowledge of a child being sexually abused to report the case to law enforcement officials and protects those reporters from being reprimanded at the workplace as a result.

Lawmaker questions PSU insurance in Sandusky case

State Sen. Mike Stack wants to know exactly how Penn State will pay for any costs created by the Jerry Sandusky scandal — and will issue legislative subpoenas if necessary.
The Philadelphia Democrat sent a letter to Penn State president Rodney Erickson this week asking the university to detail its insurance policies, who is covered by them and what would happen if potential lawsuits and legal fees exceed the policy payouts.
Stack will introduce legislation that would prevent Penn State from using any taxpayer money to cover lawsuits. He wants to further discuss how the university will pay for things like the $360,000 it said it spent on crisis communication in November.

Just as car insurance rates rise after a crash, Penn State’s liability premiums could increase if there are a series of successful lawsuits, even if it is buying initial coverage from Nittany Insurance, Stevens said. That’s part of being regulated, he said.
Stack wants to see all of those details.
There is already a dispute over a policy written before Nittany Insurance was created.
According to The Philadelphia Inquirer, the Pennsylvania Manufacturers’ Association Insurance Co. said Penn State made a claim in November for coverage and defense of a lawsuit by a plaintiff who said Sandusky sexually abused him between 1992 and 1996.
PMA said it issued Penn State three policies, according to the Inquirer. The one in dispute was effective in 1991 and 1992.
If the university is found to have engaged in "intentional conduct" that led to the abuse, the Inquirer reported, PMA is claiming it does not have to pay out.
"We’re obviously going to contest that vigorously," Powers said. "We believe we’re covered by insurance."
She added that PMA has done business with the university for more than 60 years.

HARRISBURG -- The United States Postal Inspection Service is investigating The Second Mile, the charity founded by alleged child predator and former Penn State assistant football coach Jerry Sandusky, reports CBS 21 News Sports Director Jason Bristol.
A person with direct knowledge of the investigation or inquiry spoke to Bristol on condition of anonymity.
The U.S. Postal Inspectors’ website says it enforces more than 200 federal laws, including ones related to child exploitation. Among them: coercion and enticement; activities relating to material involving the sexual exploitation of minors; and transportation of minors with intent to engage in illicit sexual conduct.

Sandusky lawyer: Evidence is being withheld

Jerry Sandusky's lawyer says prosecutors have redacted or withheld hundreds of pages of evidence in the child sex-abuse case against the former football coach, including records that could help show Sandusky's accusers colluded against him.
In a motion filed in Centre County, lawyer Joseph Amendola asked a judge to order the state attorney general's office to turn over or release more details on dozens of police reports, psychiatric evaluations, interview notes and other material gathered during the three-year investigation.
The request wasn't unusual: Defense lawyers routinely clash with prosecutors over what evidence they get and how quickly they get it.
But the 37-page motion, made public on Tuesday, offered an unusual glimpse of the scope of the investigation against Sandusky, the longtime defensive coordinator to Joe Paterno at Pennsylvania State University.

In a motion filed in Centre County Common Pleas Court, attorney Joe Amendola asked the court to compel the state attorney general's office to provide him with a variety of outstanding discovery materials, including the phone numbers of the 10 alleged victims in the case.
"The defendant believes the accusers may have collaborated with each other in making these false accusations," Mr. Amendola wrote.

Without obtaining phone numbers, the defense will be unable to get necessary phone records to determine if the witnesses had contact with each other "at critical times during the commonwealth's investigation and prosecution in his cases."
Senior Judge John M. Cleland, who is presiding over the case, has scheduled the matter to be argued on Friday, along with previously filed motions by the government asking for a jury from outside Centre County to be brought in to hear the case, and a motion by Mr. Sandusky asking that his bail be modified so that he may visit with his grandchildren.

Prosecutors want the conditions of Jerry Sandusky's bail to be modified to prevent the former Penn State assistant coach from leaving the walls of his house unless it is to receive medical treatment.
Court papers filed Tuesday by the attorney general's office say neighbors have expressed concern after observing Sandusky outside the confines of his house, which borders a school playground.
Sandusky is under electronic monitoring pending trial on 52 counts of felony and misdemeanor sexual offenses against children. He has denied the charges that he systematically abused children, using his Second Mile charity to groom potential victims.
In court papers, prosecutors say individuals from the elementary school have expressed concerns for the safety of children at the school and in Sandusky's neighborhood.
Sandusky was observed by a teacher and a student intern to be on the rear deck of his house watching children during recess on a recent warm day, according to the papers.

Prosecutors also objected to a defense request to modify his bail conditions to permit Sandusky to have visitation rights with his grandchildren at his home, arguing that his alleged victims were all children he shared a close relationship with and that some of the victims say they were molested in his house while Sandusky's wife was home.

Prosecutors also say Sandusky should not be allowed to have visits from adult friends, or be permitted to leave his house in the company of his defense team to assist his attorneys and private investigators in preparation for trial.
They argue Sandusky was "fortunate" to be granted electronic monitoring under house arrest considering his charges and believe he should be in jail awaiting trial.

Eshbach wrote that prosecutors are not aware whether Sandusky's grandchildren have expressed sadness at not being able to see their grandfather and don't know if the former defensive coordinator's children want his grandchildren to have contact with him.
However, prosecutors say they are aware that the ex-wife of Sandusky's son, Matthew Sandusky, objects to her three children having any contact with their grandfather and say a psychologist has said the children need counseling as a result of contact with Sandusky.

Suzanne Collins, chief of staff for state Sen. Nancy Jacobs, got a taste of the power of organized alumni after she sent out a news release inviting the media to cover a rally in favor of what she called Jacobs' "Penn State bill" providing criminal penalties for people who are required to report information about known or suspected child abuse but who do not.
The bill was inspired by the case of former Penn State footbal defensive coordinator Jerry Sandusky, who was charged last year with multiple sex offenses against boys and whose case led to the firing of the late Joe Paterno as Penn State coach. Former university officials have been criticized for failing to ensure a vigorous investigation after a member of Paterno's staff allegedly witnessed what he described as a sex act involving Sandusky and a boy.
Joe McCann, a Penn State alumnus and Maryland-licensed real estate broker from Elkins Park, Pa., fired off a protest aginst the Harford County Republican's use of the Penn State name to describe her bill.
"The 90,000 students and 700,000 alums of Penn State are outraged by the name of this bill. Why is the University’s name being slandered for cheap political attention?" McCann wrote in an email to the senator's office that he also circulated among Penn Staters who live in Maryland.
It didn't take long for Collins to back down. On Tuesday morning, she sen out an email to Maryland media outlets.
"I have referenced Penn State in relation to the bill that adds penalties for not reporting child abuse. This has upset some Penn State alumni," Collins wrote. "I apologize for that and will not be referring to it that way anymore. Instead I am referring to SB 140 as Child Abuse Reporting Penalties bill."

Sandusky Asking for More Freedom in Court Friday

Jerry Sandusky takes his fight to see his grandchildren to Centre County court on Friday. He wants a judge to grant him more lenient bail conditions.
Prosecutors are arguing just the opposite, that he deserves even more restrictions.

He wants more freedom while on bail. Prosecutors said after what he has been up to recently, he deserves even more restrictions.
Sandusky is asking a judge for permission to see his grandchildren with supervision by one of their parents. He is also asking to be allowed to travel around the county with his attornies to work on his defense.
Prosecutors don't even want Sandusky allowed on his own back porch. It overlooks a playground outside an elementary school.
The attorney general notified the judge there have been complaints about Sandusky standing outside watching kids play.
"If he is doing that, watching the kids from his deck, that is a little disturbing considering the details of this case," said neighbor of the school Casey McNeil.
His lawyer Joe Amednola said it just so happens that kids come out for recess when Sandusky is outside.

In court papers, prosecutors said Sandusky belongs in jail. A judge put him on house arrest after he posted bail. Conditions of that allow him outside his house, but he can't leave the property except for medical reasons.
Prosecutors wrote in court filings, "house arrest is not meant to be a house party."
They want his house in State College to be like a jail cell, with him stuck inside.
His attornies disagree.
"He's on pretrial release, in fact there are people with DUI's pending who are out driving their cars around while their DUI's are pending," said Sandusky's attorney Karl Rominger.
Prosecutors said this isn't even close to a DUI. The former Penn State coach is charged with sexually assaulting young boys.

At the hearing, a judge will also hear arguments about whether to have a Centre County jury hear the case.
Prosecutors want a jury from another county chosen because of all the publicity. The defense wants jurors from Centre County.
But Sandusky's attornies suggest delaying the trial a bit, hoping media attention dies down and makes it easier to pick a fair jury.
