If John Q. Kelly and/or Beth Holloway had been given a heads-up in June when the filing of the petition took place ... the playing field would have been level ... allowing for possible negotions ... allowing respective attorneys equal time to rearrange schedules to accomodate hearings ... allowing repective attorneys to prepare their arguments pro and con.

Two weeks notice pertaining to the hearing that was afforded Beth was so unfair.  Under the circumstances ... I cannot comprehend why the judge denied the request of the mother of Natalee a thirty day delay in proceedings.

Judge to decide soon whether to proceed with declaring Mountain Brook's Natalee Holloway dead

The petition to have Natalee officially declared dead was filed in June by her father, Dave Holloway. The father has continued to pay his daughter's insurance and other expenses and wants to transfer to Natalee's brother, Matt, some $2,000 Dave Holloway had set aside for his daughter's college education.

A lawyer for Beth Holloway, Natalee's mother, asked Probate Judge Alan King for a continuance on the initial hearing set for today on the father's petition. King denied the request for a 30-day delay.

Kelly and the girl's mother, Beth Holloway, did not attend a court hearing today on a petition brought by Natalee's father Dave Holloway to have her declared dead. Beth Holloway and Kelly had previously scheduled travel plans.

"We had made an application for an adjournment so we could have Beth there to testify and to prepare proper opposition for evidence for the court hearing," Kelly said.

Judge rejects delay in Natalee Holloway case

(AP)  BIRMINGHAM, Ala. — A judge has refused to delay a court hearing on a request by Natalee Holloway's father to have her declared dead six years after she disappeared in Aruba.

An attorney for Holloway's mother, Beth Holloway, sought the delay Friday because she could not attend the hearing. She was giving a speech in California. But probate Judge Alan King said she had more than two weeks' notice about the hearing.

I think he was just puttin' on when he got on the stand squalling.  He has been on
television a handred times and I have never seen him cry.
I don't get the $2000 either.  That is a strange amount.  I am sure Beth would give
Matt any money he "needs"
There is more to this that Dave is telling.  IMO.

If Natalee is declared dead, does her life insurance policy payout?  I'm assuming of course that Dave carried life insurance on the kids along with the health insurance.  I'd be curious to know the dollar amt on the policy.  My hubby and I took into consideration funeral expenses and counseling costs for remaining children.  I try to be practical that way.  Anyhoooo, we decided on a considerable amt for each child.

Could it be that Probate Judge Alan King will reconsider his denial of Beth's attorney's request for a for a thirty day delay in proceedings to allow sufficient time for an opposition presentation to be prepared?  In other words ... will the judge afford the mother of Natalee Holloway a level playing field?

Judge to decide soon whether to proceed with declaring Mountain Brook's Natalee Holloway dead

BIRMINGHAM, Alabama -- A Jefferson County judge said he would decide later today or early next week if a petition to officially declare Natalee Holloway dead should proceed, after the father tearfully described efforts to find his missing daughter.

<snipped>

If King allows the case to proceed, notices will be published seeking proof that Natalee is still alive, and a hearing to review that information will be held, probably in early 2012.

It appears that the judge has already rule that Dave's petition to have Natalee declared legally deceased can move forward.

Judge moves toward declaring Natalee Holloway dead

BIRMINGHAM, Ala. -- A judge ruled Friday that Natalee Holloway's father has met the legal presumption of her death and now it's up to someone to prove she did not die six years ago on a high school graduation trip to Aruba.

Jefferson County's probate judge rejected a request by Dave Holloway's ex-wife, Beth Holloway, not to proceed with steps to declare their oldest child dead. The judge's ruling Friday afternoon is the first of two rulings necessary for a declaration of death. The second could come in early 2012.

An Appeal?

Consider Beth only had two weeks notice of Dave's intentions ... could it be that an appeal of the judge's denial for a delay in proceedings be forthcoming?

BINGO!!

Kermit ... you should be an attorney!  If the 30 day delay requested by Beth had not been denied by the judge ... Joran's "Selling of Natalee" confession would have afforded the a perfect challenge to the petitioning of the court to have Natalee declared deceased.

Is it possible that the Judge's denial could be appealed?  Think about it.  Natalee's mother was provided only two weeks notice regarding yesterday's hearing.  Considering the petition was filed by Dave in June ... the playing  field was far from even.  Dave had the advantage in regards to preparation time.

Thank you. Other people have made that same statement to me about being an attorney.
Appeal would be my thinking as it is an unfair & biased court that has taken place.

When it comes to courts/judges it is usually what is reasonable and in this case, as you pointed out, it's unfair & unreasonable to not give the mother time to prepare a defense as to why the declaration should move forward.

Then add into the mix John Q. Kelly (Anna's dream man)  and you'll have a WINNER!!!!

It's just going to cost $$$$$ once again for Beth to defend her daughter.

Such a shame when all Dave had to do was pick up the dern phone.

But psychologically speaking from the photo, Dave is holding in a lot of emotion. That is the problem. Plus, in my opinion, he always listened and trusted the wrong people. And that's all I'm going to elaborate on that subject.

It is what it is eh.

I agree.

Joran van der Sloot admits murder in police video
Monday 26 September 2011

Dutchman Joran van der Sloot, currently in jail accused of murdering a young Peruvian woman last year, confesses to the murder in a police video released on Monday, say press reports.

He tells police he hit and strangled Stephany Flores after she read an email on his computer that 'caused me pain'.

It is thought the email referred to the disappearance of American schoolgirl Natalee Holloway on the Caribbean island of Aruba six years ago. Van der Sloot has twice been arrested and released on suspicion of involvement.

In the video, broadcast by the Peruvian news station RPP Noticias, Van der Sloot says Stephany hit him after reading the email. He reacted by hitting her several times and then strangling her.

When a police agent asks him: 'Did you murder Stephany Flores?, Van der Sloot replies: 'Yes'.

 ::snipping2::

So um Joran had emails about Natalee to/from who?
Just sitting on his computer?
Hardly unlikely would he have his email account open on his bed. What was he doing reading his emails after they entered the room and then he what jumps up and runs into the bathroom and she takes his laptop and reads the emails?

I don't believe this story either Joran you crack head.

What I find odd is he had just FB some guy and told him he was in another country and that he had a job. And he FB someone else that he needed money to send him money. So I believe that he was drugged up, killed Stephany for her money. If it was about sex, he could have raped her and taken off for another country, but he didn't. He could have stolen her car, but he didn't.  Freebirds had a couple of people in Joran's FB for some time and he even wanted one of them to join his Mafia Wars. I was trying to tell them how to play Mafia Wars so they could join Joran's Mafia. LOL  Mostly Joran sat on FB and played Farmville & Mafia wars. I think I posted some of the screenshots I took. Mostly it was all given to Beth. Not Dave because he's a tool who has disrespected his daughter and the mother of his daughter. So, yes, kermit ain't happy bout that.

Thanks Grace

Something akin to all his "confessions" encompassing the Natalee Holloway case ... Joran will claim the "confession" implicating himself in the murder of Stephany Flores case was a lie.

Thank goodness for security cameras.  Joran van der Sloot was busted!

Joran van der Sloot Laptop Lie? Peru police say computer exposes lie in Stephany Flores killing

CBS/AP) LIMA, Peru - A study of Joran van der Sloot's laptop shows he is lying when he says he killed a young Peruvian woman in a fit of rage after she discovered his connection to Natalee Holloway's disappearance while using the computer, a senior Peruvian police official said Friday.

Stephany Flores did not view any such information on the laptop after accompanying Van der Sloot to the Lima hotel room where she was killed on May 30, the technology chief of Peru's police, Col. Oscar Gonzales, told The Associated Press.

"She didn't view anything about Holloway. It's a lie that she tried to ask him about (the case)," Gonzales said.
