Gov. wants sex offenders' parole records retained

SACRAMENTO, Calif. (AP) - Gov. Arnold Schwarzenegger on Tuesday ordered California corrections officials to keep sex offenders' parole records indefinitely after he learned the files of a man now charged with killing a 17-year-old girl had been destroyed.
The Department of Corrections and Rehabilitation disclosed the documents on John Albert Gardner III had been destroyed in a response Friday to a records request by The Associated Press.
Gardner pleaded guilty in 2000 to committing lewd and lascivious acts on a 13-year-old girl. Officials said his parole file was destroyed last fall, just a year after he completed three years of parole supervision.
Schwarzenegger called the practice unacceptable. He also told the department to make as much information available to the public as legally possible.
Department spokesman Oscar Hidalgo said 10,000 ex-convicts each month are placed on or released from parole. The system would be overwhelmed by paper records if it didn't destroy field notes kept by agents, he said.
However, he also disclosed Monday that portions of parole files, including those of Gardner, are transferred to central files and retained for 30 years.
Release of information from those files is governed by privacy laws, and in Gardner's case by an ongoing investigation and a gag order imposed by a San Diego County judge.
The department is reviewing what portions of Gardner's central file can be made public, Hidalgo said.
Schwarzenegger's order came hours after Assemblyman Nathan Fletcher, R-San Diego, asked the department's inspector general to investigate whether records were improperly destroyed.
Fletcher praised the governor for acting swiftly to correct what he called an irresponsible policy.
Fletcher said he'll work with San Diego-area law enforcement officials, lawmakers, victims' rights groups and experts to review California sex offender laws to find any gaps. The King family released a statement at Fletcher's news conference supporting the review.
Gardner has pleaded not guilty to murdering Chelsea King in San Diego County and to the attempted rape of another woman.

I would like to say to the family and friends and all who have come to know and care about Amber. My family is grieving with you, we feel as though we have lost a member of our family. Rest in Peace , Amber

“I wish I could talk to you guys because you’ve been there for us since the beginning,” he said. “But we’re on a gag order.”
Amber’s parents have sought publicity throughout their 13-month ordeal in hopes that one reader or television viewer might be prompted to call police with a tip that could solve the case. Dubois said he was eating dinner at a restaurant Saturday night when he was called and asked to come to Escondido police headquarters, where he and McGonigle were told the news.
“Everything is going to change now for us,” Dubois said. “It’s going to be much different.”
The remains were found west of Pala Temecula Road, about three miles north of the historic Pala Mission and the Pala Casino.
There is a single-lane asphalted road that leads up a steep mountain and then over a hill. The grave appears to be out of sight over the hill.
Two law enforcement officers guarded the entrance to the road Monday morning to keep people out, and “no parking” signs were posted along the few turnouts within a half-mile either north or south of the road.
Amber, a student at Escondido High School, was last seen Feb. 13, 2009, as she walked toward the campus an hour before class.
Dubois said he understands law enforcement’s desire to keep facts quiet while the investigation continues.
“They don’t want to jeopardize the investigation and we don’t want that to happen either,” he said.
A candlelight vigil is planned for 6:30 p.m. Monday in front of Escondido High School.
Karyl O’Brien, a spokeswoman for the school district, said the event will be held under the archway near the school’s main entrance, at 1535 N. Broadway.

thanks NR.......... this states the 'grave'? Do we know if in fact there was a grave? And now it looks like this ahole doesn't know what he's talking about....do I understand this correctly, that with this statement retracted/changed, we have no clue what really let to Amber's discovery??
This is the first article that uses the word "grave". On twitter last night one of the reporters on the scene said Amber was in a shallow grave as well.
You are correct, we have no clue what lead them to Amber and Garcia needs to shut his pie hole.
With the unexpected court for Gardner today I am betting he will be charged with Amber's death.
Last nite on NG, I think perhaps it was Nancy, but someone used the term "buried" when referring to Amber. I looked at my husband and said I had not heard that before....

Today I went to a book fair at my childrens school and donated 2 books to their library in honor of Amber's memory and her love for reading. One was about Wolves and had a beautiful wolf on the front cover and the other was a young readers book about spring which had a little cute lamb on the front. Inside the front cover the librarian put on a lable that read, in memory of Amber Dubios. Now Ambers love of reading will maybe inspire another child.
It is funny how someone that you have never met can have such an inpact on your life as Amber has on mine.

It bothers that Michelle Bart has been involved in this case because of her track record in the Caylee Anthony case. She really down played the use of dogs in that case..and now she seems to be saying something different then the actual handler
in this case too.
She is no expert on the dogs and should refer all questions or comments to the handlers.
ITA. Michelle Bart is still broadcasting to cast doubt on the Anthony case and what she is trying to convince all as bad science and cast doubt in favour of the Anthony's she now has done a 180 for Amber. Her speaking for this case unfortunately creates a credibility loss to anyone that has followed Caylee's case.

Thanks again Monkeys for all the updates, insights and research encompassing the Amber and Chelsea cases. There are a few distactions taking place in my life right now ... nice distractions but distractions nevertheless.
Anyways ... a long time neighbour couple will be here shortly to join hubby and I in a game of something. Yatzee? Scrabble? Rummy?

UNIDENTIFIED MALE: Investigators found those remains buried in the Pala Indian reservation. That`s in northern San Diego County.
This was from NG show last night.

Did Gardner Use Running Club To Target Women?
SAN DIEGO -- 10News received information that may indicate accused killer John Gardner used a social gathering that included his parents to allegedly target women to attack.
Photos obtained by 10News place Gardner's mother, Catherine Osborn, a nurse, and his stepfather, Kevin O'Reilly, a photographer, at an event at the Rancho Bernardo Community Park on Dec. 27 -- the same day he is accused of attacking a jogger.
The event was hosted by a local chapter of the Hash House Harriers, a popular group that is part drinking club, part running club. The group encourages members to adopt sexually explicit nicknames.
On Dec. 27, about 50 members met at Rancho Bernardo Community Park for a run scheduled for 2 p.m. Photos taken at the event showed Gardner's parents helping with the registration. 10News is still trying to confirm if Gardner had helped with the run's set up or participated in the run.
Hours before, in the park, a 22-year-old woman was jogging on the park trails. In a recent interview with 10News, the woman's mother said her daughter jogged past a man who then bodyslammed her to the ground. She said her daughter threw an elbow at her attacker and was able to get away. The jogger identified Gardner as her attacker.
Legal experts like defense attorney Jan Ronis expect prosecutors to take a close look at the Dec. 27 incident.
"Just to be able to place him in the general area within a general time is a significant point from the prosecution point of view," said Ronis.
When told of 10News' information, an aunt of the jogger said, "It's sick and wrong if he used his family's event to look for victims … but if having family nearby prevented him from chasing down my niece, that's good."
Officers of the running club declined to comment, but did say they don't recall ever seeing Gardner at any of the runs.
