Hi Mgo, I don't know the answer if the SA is "obligated" but IMO if they have enough evidence to put the DP back on the table that if she pleads guilty it will be for all charges (remember that she is facing other charges besides Murder) and will face concurrent sentences never to see the beautiful Florida sunshine that Caylee will never see again.

Thanks. Maybe I'm being a "spiteful bi..." but I want to see her in court having to listen to the prosecutors offer up all of the evidence against her. Having said that, I do understand why a deal might be offered.

There is NO way that Casey will ever take the stand. The Prosecution could destroy her in minutes.   No Attorney is going to let her get up there!  She is guilty and they know it!!

You and I must be watching a different person. I have never found her to be brilliantly persuasive- not in the least. I observe her to be a compulsive liar. Clever? Hardly,her lies can be disproved easily.  How is she going to explain all the forensic evidence?  No way!
Baez has her taking the 5th over a civil case, can you imagine him being willing to let her answer a question re the Criminal Case.....   no way.

Never mind, I give up, it was a bad idea anyway. I was hoping her family would read this and tell her that going on the stand would be a great idea. Oh well, thanks for shattering my dreams

NO and LE already did offer her a plea deal before Caylee's body was found and she turned it down.  My bet is LE is going to put the death penalty back on the table and NO plea deal.

I think alleged perp'd do a deal--probably saying it accidental death or whatev.  But given what I consider the machinations of her pea brain, she's prob thinking she did what she had to do--from the killing through the cover up. 

But whoever it was on Valdez-Mitchell said dp might come back on the table.  Sorry, but I couldn't concentrate on the show at the time. 

Anyhow, if a conviction is a slam dunk, State may not be willing to deal. 

I keep coming back to someone who said a long time ago that "we" don't normally put dp on the table for kid killin' mothers.  Hmm...  [/b]

Orlando defense attorney Richard Hornsby said the duct tape evidence brings the possibility of the death penalty back in to play. Hornsby said it may force Anthony’s defense attorney, Jose Baez, to "put Casey on the stand" or "consider a plea bargain."

Here is my timeframe for JB.....Friday 13th...receive documents with duct tape info. Realizes Casey has lied to him, dp might be put back on table so he can't be the main attorney on case and that messes up his big trial he had planned but most important it really puts the nail in the coffin because all the spinning and smoke screens the defense has worked on for months is now worthless. Duh duh....got stress related illness. Now it is time to do a plea deal to save face because he doesn't want to give up his title as attorney for Casey Anthony.

You might be right. I just don't see him letting this go if he can avoid it.  I personally don't want to see the DP put back in it because there are some people who cannot sentence someone to death in good conscience. I don't know if Florida is like this state, but if they do go for the DP, and the jury cannot do it, the jury can give LWOP.  If Florida doesn't have that, then they are taking a big chance that everyone could sign on to a DP. (many say they can, but when the rubber meets the road, they can't)
