A new trial has been ordered for a Markham man convicted of attempted murder and sentenced to life in prison for the 1998 shooting of Harvey police officer John Marcano.

Police arrested Cory Safford less than a day after the murder and charged him with pulling the trigger.

The case, which took eight years to bring to trial, was clouded by issues ranging from a Harvey police commander's admitted attempt to sabotage the investigation to allegations that a prosecution witness was threatened.

But a state appellate court focused on only one issue in its recent ruling, finding that a fingerprint expert was improperly allowed to testify about what may have been the most important piece of physical evidence in the case--the identity of the person who left a fingerprint on the hood of Marcano's squad car.

"It was what swung the jury," said DePaul University law professor Andrea Lyon, who is handling Safford's appeal. "Without the fingerprint, they either would've either acquitted or hung."

A Cook County state's attorney's spokesman said prosecutors plan to appeal the appellate court decision to the state supreme court. The supreme court's decision on whether it will hear the case isn't expected until the fall.

Marcano was on patrol on a cold, wet January morning when he spotted Antoine Pate, who was wanted on a robbery charge, standing at 154th Street and Marshfield Avenue with another man shortly after midnight.

Both men were ordered to put their hands on Marcano's squad car. As Marcano checked Pate's identification, the second man opened fire, striking the officer in shoulder and causing him to fall to the ground.

The man then stood over Marcano and shot him in the face. Marcano played dead and survived.

Brent Cutro, an Illinois State Police fingerprint expert, testified at trial that one of 45 prints found on Marcano's squad car belonged to Safford. He testified he looks at three levels of detail when examining prints, but does not record the process by which he determines whether one is a match.

The First District Appellate Court, in a 2-1 decision written by Justice Rodolfo Garcia, found that the trial judge wrongly allowed Cutro to testify without providing an "evidentiary basis" for his expert opinion.

"To allow scientific evidence to be admitted without revealing its underlying scientific basis is to risk admitting such evidence without any scientific standards," the court wrote. "That is a risk we find unacceptable."

Fingerprint evidence was apparently crucial to the trial jury, who sent a note asking for a magnifying glass--which they didn't receive--and another indicating they were deadlocked.

But Jamie Bush, secretary of the International Association for Identification's latent print certification board, said it's not uncommon for experts not to take exhaustive notes about a process that is part "skill and art." He said it appeared Cutro followed the proper guidelines in identifying the print.

"If you made notes of all the minutiae, that would be volumes and volumes and most examiners know that's not necessary," said Bush, also a fingerprint expert at the Mississippi state crime lab.

Pate pleaded guilty to aggravated battery with great bodily harm in 1999 and was sentenced to four years in prison.

Attempts to reach Marcano for comment Tuesday were unsuccessful. He left the Harvey Police Department before the 2006 trial.

I'm having a difficult day today.  I had one of those coffee creamers explode in my drink holder in my car and apparently I didn't get it cleaned out good enough.  I smelled a strange smell and narrowed it down to that.  It's been chilly here, high of 70 and no where near the 90+ of June/July in FL.  How could KC possibly driven that car around? 

Every time I see these beautiful pictures of Caylee that you all are posting, I want to see a happy little girl who is enjoying everything in life at that moment because that's what 2-3 year olds do.  Life is a learning experience to them and they can't soak it in fast enough.  But all I see today when I look at these pictures are Caylee's little skull sitting in a garbage bag in the elements on Suburban Drive.

Not looking for sympathy or support.  I just needed a place to express my pain.  This "mother of the year" can't get on death row soon enough to suit me.

Lovin we all have days like that.  I thought today was Thursday for some reason so I feel like I have lost a full day.  Justice for Caylee will come, all good things take time and I am sure that it will take time.  Right now the entire Ant camp is quiet as if they have been engulfed in a huge cone of silence.  This is unsettling as most times in the past when they have surfaced after a silent spell their actions are infuriating.  They are probably basking in the MJ death taking the spotlight off them for a while.  The only news we have so far is that Bobo was seen in PR with his buddy WHoraldo, Malory is looking after the dogs and the Milsteads have a motorbike. They will surface, they always do and the justice process will move on albeit slowly.
