(sarcasm alert)  Oh my! I'm soooooo surprised! I'm really beginning to wonder if my hinky meter isn't very reliable in this case.

IMO that SOB just wants the notebook back so he can re-live the "glory" of his actions, cw618. I agree with you! He'd like nothing better than to muse that notebook, while the victims families are burying their loved ones.

DENVER -- The former graduate student accused in the deadly Colorado movie theater shooting was being treated by a psychiatrist at the university where he studied, a revelation that adds to suspicions that his life was in turmoil in the year before the rampage.

Attorneys for James Holmes, 24, made the disclosure in a court motion Friday as they sought to discover the source of leaks to news media outlets that he sent the psychiatrist a package containing a notebook with descriptions of an attack.

The motion said the leak jeopardized Holmes' right to a fair trial and violated a judge's gag order.

The lawyers added that the package contained communications between Holmes and his psychiatrist that should be shielded from public view. The document describes Holmes as a "psychiatric patient" of Dr. Lynne Fenton.

The motion did not reveal when Holmes began seeing Fenton or whether he was being treated for a mental illness. Legal analysts said they expect Holmes' attorneys to use an insanity defense at trial. Holmes is to be arraigned Monday.

Doctor of Colorado suspect had been disciplined by medical board

AURORA, Colo. -- Dr. Lynne Fenton, the University of Colorado psychiatrist who was treating James E. Holmes, according to a court filing by his attorneys, was been disciplined by the Colorado Medical Board in 2005.

State records show Fenton was reprimanded by the Colorado Board of Medical Examiners, received a letter of admonition and was required to take a documentation course. Records detailing the discipline were not immediately available Saturday. Neither Fenton nor Colorado medical board staff could be reached for comment Saturday.

A University of Colorado spokeswoman said she could not comment on personnel matters, but noted that the discipline would have predated Fenton's tenure at the university. Fenton completed a residency in psychiatry at the university in 2008 before becoming an assistant professor and medical director of the student mental health service at the university's Anschutz Medical Campus in Aurora.

Experts said there are two levels of insanity defenses.

Holmes' public defenders could argue he is not mentally competent to stand trial, which is the argument by lawyers for Jared Loughner, who is accused of killing six people in 2011 in Tucson, Ariz., and wounding several others, including Rep. Loughner, who has pleaded not guilty to 49 charges, has been diagnosed with schizophrenia and is undergoing treatment at a Missouri prison facility in a bid to make him mentally fit to stand trial.

The psychiatrist who treated suspected movie-theater shooter James Holmes made contact with a University of Colorado police officer to express concerns about her patient's behavior several weeks before Holmes' alleged rampage, sources told ABC News.

The sources did not know what the officer approached by Dr. Lynne Fenton did with the information she passed along. They said, however, that the officer was recently interviewed, with an attorney present, by the Aurora Police Department as a part of the ongoing investigation of the shooting.

Fenton would have had to have serious concerns to break confidentiality with her patient to reach out to the police officer or others, the sources said. Under Colorado law, a psychiatrist can legally breach a pledge of confidentiality with a patient if he or she becomes aware of a serious and imminent threat that their patient might cause harm to others. Psychiatrists can also breach confidentiality if a court has ordered them to do so.


"For any physician to break doctor-patient confidentiality there would have to be an extremely good reason," said Dr. Carol Bernstein, a psychiatrist at NYU Langone Medical Center and past president of the American Psychiatric Association. ::snipping2::

(Reuters) - A Colorado judge on Monday ordered that the bulk of key documents detailing the case against accused movie theater gunman James Holmes remain sealed, largely rejecting a request by news organizations to lift the so-called gag order.

Arapahoe County District Judge William Sylvester did allow for the release of 34 documents, mostly relating to media motions and procedural issues.

But he ordered that the documents media members most wanted to see - affidavits of probable cause, subpoenas, arrest warrants, search warrants, and requests for or court orders for production of records - all be kept under seal.

Prosecutors have charged Holmes with 24 counts of first degree murder and 116 counts of attempted murder in the July shootings at a midnight screening of the Batman film "The Dark Knight Rises" in Aurora, Colorado. Twelve people were killed and 58 were wounded.

CENTENNIAL, Colo. (AP) — The suspect in the Aurora movie shooting showed no emotion in court Thursday as a lawyer discussed a charity's efforts to distributed $4 million it raised for the victims.

James Holmes attended the brief procedural hearing in which the prosecution sought the judge's permission to release contact information on the 12 people killed and 58 injured. The group Giving First raised the money, but another nonprofit would give it out. Most documents in the case have been sealed, so even that step required Judge William Sylvester's approval.

"People have been incapacitated or lost family members and are in dire financial straits," prosecutor Rich Orman said.

Holmes was wide-eyed but didn't show any reaction. He mostly looked ahead but glanced at Orman a few times.

AURORA —  Police spent nearly 26 percent of the year's law enforcement budget for overtime pay in responding to the July 20 mass shooting in a movie theater.

The city so far has spent $462,600 on overtime costs for police officers and civilian employees following the midnight movie killings at the Century Aurora 16 theater and has applied for a federal grant to help cover the costs. The costs include investigators and responders on the morning of the shooting, security at a large vigil held later and protection for visiting dignitaries.

On average, Aurora spends $1.8 million a year on police overtime. Fire department overtime totals have not yet been released.

I understand (at some level because I cannot truly understand) her anger and sorrow...however...suing the theater is not right.  How on earth were they suppose to know that this would happen...or that this needed to be prevented. This is not something that happens. Are we going to have to go through security to go and watch a movie?  No.  Are we suppose to have our bags or purses checked prior to getting into a theater?  No. The issue lies with many people.  Society is not educated on mental illness and still allows a stigma to be attached. Families are not educated on what to look for or they ignore the signs and just call them "crazy."  Doctors are so overbooked that they do not spend enough time with each patient and simply prescribe some medication in hopes that they will return for follow up visits and often times they do not (that is part of the disease, thinking they don't need medication). And so on...going around suing people IS NOT THE SOLUTION!  Forcing the higher ups to take mental illness more seriously...forcing insurance companies to take mental illness more seriously...educating society on mental illness...and treating it like any other disease (because it is...it is a cancer...it is diabetes...it can kill too) THAT IS THE SOLUTION! So big headed Baez you do NOT need to take advantage of these grieving families...you need to tell them YES there is a problem...so let's fix it...you CAN be a TOOL...you can be a part of the SOLUTION!
