Affidavit: Missing Richardson girl was put outside for not drinking her milk
October 8, 2017

RICHARDSON, TEXAS - The 3-year-old Richardson girl at the center of an Amber Alert issued Saturday was put outside in the middle of the night as punishment for not drinking milk, according to an arrest warrant affidavit.

Wesley Mathews took his daughter, Sherin Mathews, outside at 3 a.m. Saturday to discipline her, the affidavit states. According to the affidavit, he told her to stand near a large tree in the back yard. When he went outside 15 minutes later, his daughter was gone.

Wesley Mathews told police that coyotes had been spotted in the alley where he left his daughter. The house in the 900 block of Sunningdale also backs up to railroad tracks.


Police weren't called to the home until some five hours after the child was last seen, according to Sgt. Kevin Perlich.

Her whereabouts were still unknown. An Amber Alert was issued for the girl Saturday afternoon and continued Sunday afternoon. Police were canvassing the area Sunday evening while neighbors were posting new fliers around the neighborhood.

Wesley Mathews was arrested on Saturday and charged with Abandoning or Endangering a Child. On Sunday, he was arraigned on the endangerment charge and a judge set his bond at $250,000.

Perlich said search teams used dogs and went door-to-door in the family's neighborhood Saturday morning and into the afternoon but so far had no leads on the girl's location.

“We’re trying to pick up any type of scent, or items of clothing, or anything like that, that might give us a clue she was there," said Perlich.

Late Saturday, investigators towed two SUV's and a minivan from the home as part of a search for "any potential evidence."

Sherin was last seen wearing a pink top and black pajama bottoms.

The girl has developmental issues and limited verbal communication skills, police said.

Members of the family's church gathered outside of the home Saturday afternoon and said the girl's parents were being interviewed at police headquarters

The father of a missing Richardson toddler sent the girl out to an alley where coyotes had been seen to punish her for not drinking her milk, police said. 
Sherin Mathews, 3, is thought to be in grave and immediate danger. Officials issued an Amber Alert for the girl Saturday.  She was last seen about 3 a.m. Saturday in the family's back yard in the 900 block of Sunningdale.
Her father Wesley Mathews, 37, has been arrested and charged with abandoning or endangering the girl, who police continued to search for Sunday.
Mathews told police he put Sherin outside and told her to stand next to a large tree about 3 a.m. Saturday morning, an arrest affidavit said. The tree was behind the fence, about 100 feet south and across an alley.  Mathews admitted to police that he knew coyotes had been seen in the alley where he left her, the affidavit said.
The Humane Society of the United States says coyote attacks are rare and has recorded only two human fatalities since the 1980s.
Mathews told police he checked on Sherin about 3:15 a.m. and she was gone, the affidavit said. Police reportedly weren't alerted to her disappearance until hours later.
"Why was the last sighting at 3 o'clock and the parents not call us until after 8 a.m., that's the question we want answered as well," Richardson police spokesman Kevin Perlich told KXAS-TV (NBC5). "As far as why she was out there, how long she was out there, that's the questions we have for the parents."

Police went door to door in the neighborhood and used search dogs to look for Sherin on Saturday. The family's vehicles were towed to look for "any potential evidence," police told WFAA-TV (Channel 8).
Jose Cherian and others from Emmanuel Bible Chapel, the church that Mathews and his family attend, helped search a field and other areas near the family's home.
Cherian told NBC5 that Mathews and his wife are good parents. 
"The parents are also loving. They loved Sherin very much," he said. "They take care of her very much."

Sherin, who has development issues and limited verbal communication skills, is described as Asian, about 3 feet tall and 22 pounds with black hair and brown eyes. She was last seen wearing a pink top, black pajama bottoms and pink flip-flops.

This looks extremely dire TM.  The first time I read the story, it sounded doubtful.  I could be very wrong and there are times I surely am, but the story of how Sherin was put outside at 3 a.m. sounds concocted.  Maybe there are some that would be so mean or stupid to do something like that to a tiny girl, but I really think what happened was even more evil.  I suspect her Dad did something to her and is using the story to cover her disappearance.  Who would put a child outside at 3 a.m., and for (sarcasm alert) for punishment for not drinking her milk?  Sounds pretty much like there was abuse going on prior to this day, just by this line of thinking alone.  And then, who would wait five hours to report her missing?  Not to mention, he left her out there to stand under a tree for what he says is 15 minutes in the dark with wild animals in the area.  I think there's a good chance she's already gone from this earth, and it was by the hands of dad.  I don't think he's telling the truth about what happened. Mom seems pretty quiet.  Does she know anything?   It's good LE took in the family's cars for a look see.  I believe in miracles, and I hope there is one in Sherin's case and she's found today alive and well.

(Bolded by Me)  Sherin would have been perhaps a year old from a foreign adoption when the Mathews adopted her.   I wonder if her developmental delays weren't apparent at the time?  This is sounding worse and worse.  What Mr. Mathews allegedly did as punishment to Sherin would be inappropriate abusive for any child of any age, let alone a child so young and with special needs.   ::MonkeyNoNo:: ::MonkeyTears::

3-Year-Old Richardson Girl Missing Since Saturday
October 9, 2017

Volunteers and Richardson police officers searched the area near the home where a 3-year-old girl went missing early Saturday Morning.
Sherin Mathews was reportedly last seen by her father, 37-year-old Wesley Mathews, at about 3 a.m. in the 900 block of Sunningdale in Richardson.
As of Monday morning, the girl is still missing.
Police arrested her father Saturday evening. He is charged with abandoning or endangering a child. Bond has been set at $250,000.

Police are trying to figure out why they waited five hours to report the toddler missing.
Three vehicles at the family's house were towed away Saturday evening. Police said they would likely be finished processing Monday.
Meanwhile, members of Emmanuel Bible Chapel in Irving, where Sherin and her parents are also members, printed fliers with the girl's description and posted them in and around the Richland Meadows neighborhood.

Joanna Cherian walked around to any post she could find and taped fliers one at a time.
“I can’t believe I have to do this right now,” she said in disbelief. “I never thought this day would come that the cutest baby in our church has gone missing.”
Church elder Jose Cherian was asked about the allegations surrounding the girl's father.

I can’t say anything about that,” he responded.
Cherian did speak about the girl’s mother, who police say is not facing any charges at this time.
“She’s very much worried and depressed,” he said.

Cherian made a public plea in case someone has the girl.
“If anyone have in possession baby Sherin, please bring back and report to police, to Richardson police. Those who, any of you who brings the baby God will bless you. God will reward you,” he said.

The article below notes "the family had had contact with CPS previously..."  Hmmm...  It's a prudent thing to remove Sherin's four year old sister from the home, under the circumstances, imo.  Mr. Mathew's was released on bond for child endangerment charges in relation to Sherin.  I wonder if the sister was subject to such ridiculously harsh punishment abuse as Sherin?  Sometimes it's only one child, sometimes it's more than one, sometimes it's all.  I hope the FBI can get to the bottom of this and find Sherin.

CPS Removes Sister From Home Of Missing Richardson 3-Year-Old

RICHARDSON (CBSDFW.COM) – A three-year-old Richardson girl is still missing and police believe her disappearance may have started when her father tried to punish her.

As it stands, city, county and state law enforcement are all working with the FBI to try and find little Sherin Mathews.

Accoring to Texas Child Protective Services (CPS) spokeswoman Marissa Gonzales, the family has had contact with CPS previously, but by law she could not give details about the incident/incidents. Sherin’s 4-year-old sister was removed from the home Monday morning and placed in foster care. (Bolded by me)  The Mathews Family adopted Sherin,  a malnourished child from India, which could be considered an act of goodness or charity.  Yet this same child is "punished" for not drinking her milk by being left outside at 3 a.m.  It's been noted Sherin had developmental problems.  Did this come into play with the severe punishment meted out?  And yes, putting a little 3 year old out at 3 a.m. is severe, imo.  And 15 minutes? A three minute time (inside the home) out might not have even been appropriate for Sherin if she did do something. 
But why would you punish a child for not drinking milk?!   ::MonkeyEek::  I see a lot of mean in this story.   ::MonkeyTears::

RICHARDSON, Texas –  Authorities were searching Monday for a 3-year-old suburban Dallas girl who went missing over the weekend when her father allegedly made her stand outside in the middle of the night as punishment for not drinking her milk.

Wesley Mathews, 37, ordered Sherin Mathews to stand next to a tree behind the fence at their Richardson home at around 3 a.m. Saturday, according to an arrest affidavit. The tree is across an alley from the home.

The father didn't notify police that his daughter was missing until about five hours later, said police Sgt. Kevin Perlich, who added that the delay in reporting the matter "is certainly concerning to us."

"That does not seem like a normal response that one would do if you have a missing child," Perlich said.

Mathews was arrested Saturday on a charge of abandoning or endangering a child. He posted bond late Sunday, according to Perlich. A working phone number for Mathews could not be found and it's not clear if he's hired an attorney to speak on his behalf.

Mathews at one point told investigators that coyotes have been seen in the alley, but investigators say there's no indication one may have dragged the girl away.

Investigators have seized three vehicles, cellphones and laptops from the family in an effort to find out what became of Sherin, Perlich said. Footage from surveillance cameras in the area also is being reviewed.

State Child Protective Services removed a 4-year-old child from the home early Monday, he said. A CPS spokeswoman, Marissa Gonzales, said the agency has had dealings with the family before, but she declined to release additional information.

Perlich said Mathews and his wife adopted Sherin, who was malnourished when the couple took her in. Mathews told investigators it wasn't unusual for the girl to wake up late at night to eat so that her weight would increase, Perlich said. That may explain why she was punished at 3 a.m., he said. He said authorities are casting a broad net in determining what happened to the girl.

"We don't have any other indication or evidence that she was forcibly abducted from that area," he said.

(Bolded by me)  I wonder if Mrs. Mathews has been a victim of domestic violence?  She was in the home at the time the alleged incident happened but says she was unaware of it.  So.  Out of the blue, one time, Mr. Mathews is up with Sherin at 3:00 a.m. and since she refused to drink her milk, he puts her outside by a tree and leaves her there for at least 15 minutes till he gets back and finds she's not there.  Again, I could be wrong, but I'm wondering if there was more abuse in this home than is being said.  I think this isn't the first time Sherin's been "punished" inappropriately.  I wonder if Mrs. Mathews is very afraid.  How did this escalate to the point of putting little one out there?  Or did that ever happen?  What really happened to her?  I'm still praying for a miracle for Sherin.

The Amber Alert for a missing Richardson toddler sent to an alley as punishment for not drinking her milk was discontinued Monday afternoon, but authorities are still searching for the girl.

Sherin Mathews, 3, was last seen about 3 a.m. Saturday in her family's backyard in the 900 block of Sunningdale.
Officials issued an Amber Alert for the girl Saturday and were continuing to look for her Monday. Richardson police say the alert was discontinued because there were not enough tips.
"We need to have a specific vehicle or a suspect, and we lack that," police spokesman Kevin Perlich said. He said the Amber Alert could be reissued if authorities develop new leads.

The girl's mother does not face any charges. She was in the house at the time, but was unaware of what Wesley Mathews was doing, Perlich said.
Sherin's parents are no longer speaking with attorneys and have since retained attorneys, he said.

Investigators will be processing all the items they've collected, including security footage, electronics and items in the family's vehicles that were towed from the home Saturday, Perlich said.
On Monday, police retrieved an item from near the tree where Sherin was left and placed it in a bag. It was unclear what the object was. It remains to be seen whether the item was of any "evidentiary value," he said.

(Bolded by me)  According to the article below, Mr. Mathews put Sherin outside at 3 in the morning to punish her for not drinking her milk, left her there 15 minutes and when he couldn't find her at the same spot, he went back in the house to do laundry until she came by on her own.  So, a developmentally disabled 3 year old will of course come back to the house after having been outside for a while at three in the morning after her punishment is through and her Dad will do laundry in the mean time.  There's so much wrong with this.  I can't even...   ::MonkeyNoNo:: ::MonkeyTears::

It’s a narrative that has the community buzzing with questions. In Dallas-area coffee shops, in nearby workplaces and on social media, people mulled over the details of Sherin’s disappearance — such as why Mathews waited so long to call the police, or why there are so few clues as to where she might have gone.

“It’s just a very sad thing, and there’s still so much question,” said Bob Morse, 66, who lives a few houses down from Sherin’s parents. “A lot of the story doesn’t make sense.”

He happened to be awake and outside at 4 a.m. Saturday, less than an hour after she reportedly disappeared, lighting his grill so that he could cook a brisket later in the day.

“At 4 a.m. in the morning, it was quiet. If a child four houses away cried out, I would hear it,” Morse said. “If a car drove by, I would know.”

RICHARDSON, Texas -- Law enforcement executed a search warrant at the home of a missing girl.
Three-year-old Sherin Mathews disappeared at about 3 a.m. Saturday. An Amber Alert was issued, but it has been discontinued due to a shortage of leads and information, police say.

My thoughts keep coming back to Mr. Mathews mentioning during his interview about how he saw coyotes in the alley where he allegedly left Sherin and he also mentioned the house backed to railroad tracks.  Did he really fear either of these two things could have resulted in his daughter having gone missing, or was he trying to suggest to LE those were a possibility to deflect and/or throw blame as to what he may have done to her himself?  If he was so concerned about her safety and he knew there were coyotes and he knew  his house backed to railroad tracks, why in the world would he put his developmentally disabled three year old at risk by placing her and leaving her exposed to them at 3 in the morning?  And allegedly after 15 minutes he went to check on her and couldn't find her, so he went back inside and did laundry, thinking she would come back on her own, or in another five or so hours it would be daylight and he could search for her better.   ::MonkeyNoNo::

I'm wondering if his wife really was awake or aware of what was going on at the alleged time of Sherin's punishment/disappearance?  The story so far says she was asleep and unaware.  Does that mean Mr. Mathews didn't go in and wake his wife up at 3:15 and alert her that Sherin was missing?  Was Mrs. Mathews asleep all the five or so hours before LE was notified?  There are a number of things in this case that just plain stink.  They both need to come clean.  Mrs. Mathews may or may not have had a hand in Sherin's disappearance, but I wonder if she is telling all she knows.  Not everyone thinks alike, but for myself, if my DH had put our little girl outside at 3 a.m., I'm pretty sure I wouldn't be in the same house for much longer, especially when we had a four year old too.  Was something like that the norm for them or what?  Or was this such a one off, she's just stunned?  My feeling is there is a history of abuse.

One more thing...

I live in an area with coyotes. One can be spotted from time to time, and we can hear them howlingat times.    Every now and then, someone may lose an older dog to them, with the remains found a day or two later.  I haven't heard of any children attacked here, but then thank goodness my neighbors don't seem to stand their little kids outside at three in the morning that I've ever heard of. 

If the coyotes had gotten Sherin, wouldn't the tracking dogs have found some sort of evidence? 

One other thing...

There are railroad tracks behind the Mathews house.  Did any trains pass in the time?  Was that a known area for homeless folks or transients?  Was it a teen hangout?

It would appear we here in Texas and the US aren't the only ones wanting answers about Sherin's whereabouts. n the afternoon, an attorney from McKinney identified as Gregg Gibbs, spent close to an hour at the home. The attorney had no comment on who he was representing or whether he was representing anyone.

Shortly after 6:30 p.m. Tuesday, officers executed another search warrant. It started with a few Richardson officers walking in and out of the front door.

Sherin's father, Wesley Mathews, who adopted Sherin last summer, was the last person to see her. He faces charges of child endangerment and has since bonded out. A friend of the family says Wesley and his wife were not in the home.

Just before 7 p.m. FBI agents had arrived. More than a dozen members of the Evidence Response Team met on the front lawn. For the first time in four days, crime tape surrounded the home, including a portion of the alley behind their home.

One FBI Evidence team moved inside the home and another team stayed outside. They canvassed the front yard thoroughly. Agents walked side by side looking down on the front lawn.

Richardson police called Tuesday's executed search warrant a "natural progression of the investigation." The search was over by Wednesday, and police and FBI agents will now focus on combing through evidence collected.

I've come across another possible theory while scanning the news and comments in various places:  Mr. Mathews may be covering up for his wife.


I hope folks don't believe I'm victim blaming.  Sherin is the victim here, not so much her parents imo.  It's difficult to be sympathetic with her parents, because it's all just not adding up.  If her dad did in fact put her outside in the middle of the night, he's not a victim, he's potentially a big part of the cause of her disappearance. And was her Mom asleep all that time?  It just smells of abuse.   I could be all wrong, but someone isn't saying all they know.  It's Sherin's life.  Come forward and tell what you know.

A lot of people have asked why the little girl was drinking milk at 3 a.m. Mathews told police Sherin was malnourished when they adopted her from India. They were doing feedings throughout the day and night.

“So part of the feeding thing was to build some mass and put some weight on her so it wasn't uncommon for her to have to be fed on a consistent schedule or as frequently as they could,” Sgt. Perlich said.

Police said the little girl also has disabilities that make it hard for her to communicate.

The moment Saraswati's nani arrived, she used to run and embrace her," Babita recalled.
Babita came to know that the girl was missing only while talking to this reporter. She also said that the child had a deformity in one eye.

Babita said that the girl was only one-and-a-half years old when she was rescued by Bal Kalyan Samiti of Gaya district after being abandoned by her family and was later handed over to the NGO on February 14, 2015.
"During her initial days, Saraswati used to remain quiet but gradually she opened up at the centre," she said .

Saturday marks one week since 3-year-old Sherin Mathews disappeared in Richardson.
Her father, Wesley Mathews, says he sent her to stand by a tree early Saturday morning and hasn't seen her since.
As investigators search frantically to find Sherin, a community came together to pray.
Dozens of people from different faiths and walks of life attended a prayer service by the tree where Sherin reportedly disappeared.

"It's heartbreaking. This is a 3-year-old little girl. We don't know where she is, where she could be," said Gauthami Vemula, a child welfare consultant and aunt to a one- and four-year -old.
Candles, stuffed animals and handwritten notes now mark the spot where Sherin's father says he last saw her.
It is steps away from the Mathews home. Her parents have yet to make a public plea for help finding Sherin.

It's the reason so many felt compelled to attend Friday's prayer, to give a voice to the voiceless and to stand shoulder-to-shoulder for Sharin.
Investigators are focusing on a 15-mile radius surrounding the family home as they search for Sherin. It is located in the 900 block of Sunningdale Drive.
Police are urging anyone with surveillance cameras to check for video of the family's 2013 maroon Acura MDX.


Police received some video already and said in a Facebook post Friday they are "diligently working our way through all of the material."
One recording came from a neighbor who says the FBI has been to his home five times to review video his camera captured the night Sherin disappeared.
"I don't know the details of what's on my camera as far as what they're looking for, but I hope there's something on there that can definitely help them out," said Obaid Jabbar.

Jabbar said he's been asked to not reveal specifics about what is on the tapes.
Police are hoping more people will come forward with video.
Meanwhile, Sherin's father, Wesley Mathews, is still out on bond, but wearing an ankle monitor.

The father of a missing Richardson girl was arrested Monday night for injury to a child.

Wesley Mathews was taken into custody on Monday night on the new charge, which is a first degree felony.

Authorities discovered the body of a child on Sunday in a culvert in Richardson. Police believe the body is that of missing child Sherin Mathews, 3, but the medical examiner has not yet confirmed the identity. The culvert is about half a mile from the family's home, directly down the railroad tracks from where her father said he left her for punishment at 3 a.m. on Oct. 7, because she wouldn't drink her milk.

Richardson PD said Wesley Mathews showed up at the police station voluntarily with his lawyer on Monday afternoon and asked to speak with detectives.

"He provided an alternate statement of events from those which he had given previously, regarding the disappearance of Sherin," police said in a statement.

Wesley and Sini Mathews are the adoptive parents of Sherin Mathews, the toddler who has been missing for more than two weeks. The couple went before a judge, along with officials from Texas Child Protective Services (CPS), concerning the custody of their 4-year-old biological child. CPS removed the little girl from the home and placed her in foster care just days after Sherin disappeared.

Through an attorney, Wesley Mathews asked for more time in the case so that he could get a civil attorney to represent him in the custody hearing – he currently only has a criminal lawyer. The judge granted an extension and scheduled a new custody hearing for November 13, but said the 4-year-old would remain in foster care until then.

The judge said the extension would also allow time for CPS to conduct a home study in Fort Bend County, about 40 miles southwest of Houston, to determine if relatives or family friends there could take custody of the 4-year-old if necessary.

The Mathews’, who went into the courtroom separately, didn’t make any comments but Kent Starr, the attorney representing Sini Mathews, did say his client was, “…participating with the police department to identify whether or not the body that was discovered in Richardson, Texas is that of Sherin Mathews.”

DALLAS (CBSDFW.COM) – Police have again arrested the father of a missing Richardson girl. Wesley Mathews is back behind bars and again the action was taken after he sat down and talked with investigators.

Wesley Mathews, the adoptive father of missing toddler Sherin Mathews, was arrested and booked into the Richardson City Jail Monday and is expected to be transferred to the Dallas County Jail sometime today.

Mathews was out on bond after being charged for Endangering a Child, but after speaking with detectives on Monday and apparently changing his account of what happened in the early morning hours of October 7, the day Sherin went missing, police again took him into custody. He is now also facing a charge of Injury to a Child, a first-degree felony with a maximum punishment of life in prison.

According to police, Mathews and his attorney voluntarily met with detectives following a Child Protective Services hearing regarding the custody of his 4-year-old biological daughter.

Investigators say Mathews changed his story regarding the circumstances around Sherin’s disappearance. Originally, Mathews told police he left his 3-year-old daughter outside at 3 a.m. as punishment for not drinking her milk.

“I can’t go into the exact details of what he told us, but what I can tell you is that it was contrary to what we were initially told when she was first reported missing,” explained Richardson police Sergeant Kevin Perlich.

Police say the investigation is far from over, especially since the Dallas County Medical Examiner is still working to identify the body of a child found on Sunday, about a mile from the Mathews’ home.

Investigators say they are piecing things together and there could be more action taken in the case. “You might see additional arrests or even a modification of charges as we progress,” said Perlich.

According to investigators, Sherin’s adoptive mother, Sini Mathews, has helped with the identification of the body discovered over the weekend, in a culvert near East Spring Valley Road and South Bowser Road. But police said her cooperation ends there.

RICHARDSON, Texas - The father of a missing 3-year-old Richardson girl who was later found dead has changed his story of what happened to her.

Wesley Mathews was taken into custody on Monday night for injury to a child, a first-degree felony. His bond was set at $1 million.

Mathews was previously charged with child endangerment. He told police his daughter Sherin disappeared after he left her by a tree around 3 a.m. on Oct. 7 because she wouldn’t drink her milk.

A body that is believed to be the little girl’s was found Sunday in a culvert about a half a mile from the family’s home.

According to an arrest warrant affidavit, Mathews showed up at the Richardson Police Department with his lawyer Monday afternoon and asked to speak to detectives.

"He provided an alternate statement of events from those which he had given previously, regarding the disappearance of Sherin," police said in a statement.

Mathews told detectives Sherin choked and died while he was trying to get her to drink her milk.

“Wesley Mathews said she wouldn’t listen to him. Eventually, the 3-year-old girl began to drink her milk. Wesley Mathews then physically assisted the 3-year-old girl in drinking the milk,” the affidavit states.

It goes on to say Sherin began to choke and her breathing slowed. Mathews told detectives she had no pulse and he believed she was dead.

He admitted to removing her body from the home, the affidavit states.


Richardson authorities said the charges against Mathews could be upgraded or modified depending on what is revealed in the medical examiner’s report.  Charges could also be filed against another person, police said.

DALLAS (CBSDFW.COM) – Did now confirmed dead Richardson toddler Sherin Mathews choke while drinking a glass of milk? There are more questions than answers today after an announcement from the medical examiner and new details from the arrest affidavit of Sherin’s adoptive father, Wesley Mathews.

Police arrested Mathews for a second time on Monday afternoon after he voluntarily went to the Richardson Police Department, with his lawyer, and asked to talk to investigators. It was then that Mathews changed his account of what happened in the early morning hours of October 7, the day he claimed Sherin went missing.

Originally, Mathews had told police that he was punishing Sherin for not drinking her milk and that at 3 a.m. he ordered outside to stand by a tree about 100 feet outside their backyard. He said he left the little girl there and when he returned 15 minutes later discovered she was gone.

The affidavit obtained by KRLD detailed how after being advised of his rights on Monday Mathews now said that the incident involving Sherin happened in the garage of the family home.

Mathews new claim is that he was trying to get the little girl to drink her milk, but that she wouldn’t listen to him. He said at some point when Sherin finally complied he “physically assisted the 3-year-old girl in drinking the milk.” It was then that Mathews said the toddler began to choke and that after coughing for a while her breathing slowed.

The 37-year old said that when he could no longer feel Sherin’s pulse he “believed she had died” and removed the body from the house.

Richardson police Sergeant Kevin Perlich said that basically Mathews new story is, “… contrary to what we were initially told when she was first reported missing.”

Wesley Mathews was arrested again and booked into the Richardson City Jail. He is expected to be transferred to the Dallas County Jail sometime today.

Just before lunchtime Tuesday, the Dallas County Medical Examiner confirmed that the body of the child found on Sunday, about a mile from the Mathews’ home, is Sherin. Officials said they used dental records to confirm the little girl’s identity, but still have not determined how she died.

RICHARDSON –  Sherin Mathews’ breathing slowed and her pulse stopped, but in the account that her father gave police, he never woke his wife, a registered nurse who works at Dallas Children’s Medical Center.

Court records released Tuesday show that Wesley Mathews gave police an alternate version of how his 3-year-old daughter ended up dead in a Richardson ditch. But his wife, Sini Mathews, has remained silent.
 
Wesley Mathews told police that Sherin died from choking after he “physically assisted” her with drinking milk in the garage at 3 a.m Oct. 7 and that he removed her body from their Richardson home. He had previously said she went missing after he put her outside as punishment for not drinking her milk. He waited hours to call police.

Wesley Mathews, 37, was arrested Monday on a charge of injury to a child. He previously posted bond after being arrested on a charge of child endangerment the day Sherin went missing.

Sherin's body was positively identified Tuesday, two days after being found a mile from their home. Sini Mathews, police said, has yet to answer their questions about what happened the day the girl went missing.

It is unclear whether authorities believe Wesley Mathews’ new account. Autopsy results that will determine Sherin's cause of death are pending. 

Richardson police Sgt. Kevin Perlich said officers spoke with Sini Mathews on Monday about identifying clothing on Sherin’s body. She told police the clothing, which Perlich did not detail, could have been something her daughter wore. She also provided police with dental records, which were used to identify Sherin.

Her attorney, Mitch Nolte, said they do not plan to provide any comment or interviews to police at this time.

HOUSTON: People in the US city of Richardson are mourning and angry over the tragic death of 3-year-old Indian-American girl Sherin Mathews, with many asking why her foster father did not wake his nurse wife when he knew that the toddler was chocking on milk and struggling to breathe.

Meanwhile, Richardson police are sharing new details into their ongoing investigation into the disappearance and death of Sherin.

Richardson Police Department sergeant Kevin Perlich told reporters that they had previously searched the area near the culvert where Mathews' body was found on Sunday but had come up empty-handed.

After heavy rainfall overnight Saturday, police returned to the area near East Spring Valley and South Bowser roads with cadaver dogs Sunday morning, knowing that rain tends to help intensify smells. An investigator and search team said the little girl's clothed body was then found "a ways into the culvert," according to Perlich.

Yesterday, Richardson police made a plea for Sini to agree to speak with the police. She has reportedly not cooperated with the police since the weekend of October 7.

Her attorney Kent Starr said she is "distraught" over the loss of her daughter and that she is trying to regain custody of her four-year-old biological daughter who was placed in foster care after her sister's disappearance.

Starr told NBC 5 yesterday that he has withdrawn and is no longer Sini's criminal defence attorney.

DALLAS (CBS11) – The Richardson father who confessed to disposing of his daughter’s body after he says she choked on milk is now on suicide watch at the Dallas County Jail.

Around 10:30 a.m. Wednesday, Wesley Mathews arrived at the jail in Dallas from Richardson.

A spokeswoman for the jail said he underwent a mental health evaluation. His answers “raised red flags.” Combined with the high-profile nature of his case, she says a decision was made to place him on suicide watch.

During that time, he will be in a single-person cell, isolated from other inmates and under constant surveillance. The suicide watch will last 24 hours. Then, he will be re-evaluated by a psychiatrist.

Wesley Mathews is charged with a first degree felony charge of injury to a child.

Sunday, his missing daughter’s body was found in a culvert, less than a mile from their Richardson home.

Sherin’s official cause of death has yet to be released by the medical examiner’s office.

Wesley Mathews’ bond is set for $1 million.

Late Wednesday afternoon, the attorney for Sherin’s mother, Sini Mathews released a statement about her cooperation with police during the investigation but is not willing “to endure further police interrogation.”

The statement said Sini had nothing to do with Sherin’s death or the removal of her body from their home.

The body of 3-year-old Sherin Mathews was found in suburban Dallas on Sunday. Police have said Wesley Mathews told them the girl was malnourished and needed to eat at odd hours.

The orphanage owner, Babitha Kumari, told WFAA the girl had no problems eating or drinking milk when she was adopted last year.

When the more than two-week search for 3-year-old Sherin Mathews ended on Sunday morning, the teams working to find her believe they were able to bring the little girl home.

"I started doing this a long time ago in the military, and there was always a sense of bringing somebody home was something good," said Jerry Seevers, one of the K-9 handers on the scene Sunday when Sherin's body was discovered.

Seevers and 15 other handlers help make up the team at the nonprofit MARK9 Search & Rescue. The team is made up entirely of volunteers who are specially trained to help law enforcement and first responders in search and rescue operations.

MARK9 assisted Richardson police in several prior searches for Sherin Mathews as police looked in wooded areas near the Mathews family home, helping police rule out certain spots and refocus on others.

Sunday, five pairs of volunteers and dogs from MARK9 responded to another request from Richardson police to search for Sherin again. Searchers say the weather conditions were ideal. Overnight rain along with a breezy and humid morning helped dogs pick up the scent.

One K-9 led her handler to a field north of the Mathews home and eventually to the culvert where investigators found the small child's body.

"She started doing it from a long way off, and it wasn't an area she was supposed to be looking in, but that's how it concluded," said Seevers, of the K-9's path. "She found her way there. One of the things we have to do is we have to believe in them and she took us there."

Wednesday, October 25, saw a simple but poignant prayer ceremony take place in a children's home in Nalanda, a small town southeast of Patna, Bihar.

On a table, covered with a bright red and white floral cloth, a photograph of a toddler was placed and a mala (garland) of marigolds was draped over the picture.

Two plastic-wrapped teddy bears, one of them electric pink and the other saffron, flanked the photo.

Seven or eight people paid their respects with more flowers, agarbatti and a diya.

The baby girl in the picture had short black curls, twinkling eyes. She wore a bright pink top and a beautiful little smile.

Remembers Babita Kumari wistfully, who speaks Hindi with a sharp north Bihari accent and had once took care of this child, "Bahut pyari ladki thi (She was a very lovable child).
 
Three-year-old Sherin Mathew, who died, tragically, far, far away from her hometown, across the world in Richardson, Texas, spent six months of her early life as Saraswati in Nalanda, before she was sent for adoption to the United States of America.

Saraswati/Sherin's short life was haunted by sadness right from the start, it would seem. She was found "khoyee huee (gone astray)" in Gaya, 72 km from Nalanda on February 15, 2015.

Saraswati was just a few months old at the time. "She was judged to be six months because she was able to sit and halka phulka khattee thi (she could eat light food)," recalls Kumari.

It was also quite apparent that Saraswati was abandoned. Not lost.

Kumari has no details of what the girl was wearing or if she had any bangles, threads on her wrists or religious markers on her little person when Gaya's local child-line services found her.

Within a few days the child-line staff -- and the Bal Kalyan Samiti who took Saraswati in temporarily -- figured out that the baby now no longer belonged to anyone.

When a child gets lost, Kumari explains, there are usually enquiries for her/him at local police stations or the missing's child photographs are circulated.

But no one seemed to be looking for Saraswati.

The forsaken child was sent later that month in 2015 to Nalanda and to Kumari's Nalanda Mother Teresa Anath Seva Ashram, the nearest agency for housing orphans, to join 15 other parent-less children.

The Nalanda ashram has been in existence since 2003. Kumari, who adores kids, had a wish to care for destitute children ever since she saw an infant being brutally taken away by a stray dog when she was younger.

An admirer of the legendary Calcutta nun, the Nalanda social worker started up the ashram 14 years ago and named her facility after Mother Teresa.

In 2009 she received a license from the local government and in 2011 she started receiving funding to take care of "lawarais bachche (orphaned children)."

Saraswati, who received her new name from the child welfare department personnel who found her in Gaya, spent from February to November 2015 in Kumari' custody.

"She left at around Chhath in 2015," recalls Kumari.

"She made lovely tutli (baby talk). She was not a quiet child. Bahut chanchal lakdi thi. Hasti, khelti, daurti thi (She was a lively child. She laughed, played and ran about)," remembers Kumari fondly.

The child appeared totally normal except for the fact that her left eye was mildly smaller than the right, says Kumari.

Saraswati, shortly after she arrived in Nalanda, as per government procedure, was put up for adoption and her details circulated online.

Her tiny defect made her eligible for international adoption. Children with even barely imperceptible disabilities, explains Kumari, are given wider possibilities for adoption so they are not "left on the shelf".

This complex process finally threw up Sini and Wesley Mathew -- she a nurse and he a techie -- as possible candidates for parents.

The Mathews were looking to adopt a child as a sibling to their elder natural born daughter.

While the Mathews, who hailed from Kerala, could have adopted a child from their home state, the process doesn't work that way, points out Kumari, because adoptive parents have to choose from the pool of children available at any given time and that brought the Mathews all the way to this sleepy town in north Bihar.

Kumari remembers that Wesley was in touch with her first. Sini and Wesley came to see Saraswati in mid 2015. "The father and mother came to Nalanda to see Saraswati. Bahut acche the (They were very nice). They seemed like decent people."

"The mother could not speak Hindi and only spoke English, but the father communicated with me. They seemed like a good family."

After they left, and the adoption was still being finalised, Wesley would call and ask Kumari to put Saraswati on the phone so he could hear her charming baby talk.

Later in 2015 the Mathews took Saraswati to America, where the one year old began a new life as Sherin Mathew in Texas.

Kumari heard nothing more of Saraswati. Not how she was faring in America. Or with her brand new family till a heartbreaking call came in October 2017 from the Central Adoption Resource Authority, New Delhi. to say that the tot had gone missing from the porch of her home on October 7.

"On October 12 I got a call from CARA that bachchi miss kar gayee (that the child has gone missing)."

Wonders Kumari, "What kind of system is this that a parent would leave a child outside the house at 3 am! I then heard more details from (a reporter from) the Times of India. I requested that someone should put me in touch with the parents. But I did not hear anything."

Mitchell Nolte and Gregg Gibbs, lawyers representing the Mathews family, released a statement Tuesday on the family's behalf saying the child was laid to rest in a small, private ceremony that was conducted according to the religious beliefs and cultural heritage of the family.

"Because of the intense press and social media attention in this case, the family chose to keep the ceremony private so the focus could be on Sherin’s future in Heaven and not on her tragic death on earth. Because of personal security concerns and threats of grave desecration, they have chosen to keep the burial location private as well. Sherin deserves that assurance of peace," the family's lawyers said in a statement.

Someone in attendance told NBC 5 Sherin's casket was covered in flowers and stuffed animals.

"Sherin’s family and friends recognize that many people around the world have become emotionally involved in her heartbreaking death. While they cannot express their gratitude to everyone personally, please know they do appreciate the outpouring of love for Sherin and thank everyone for their kindness and prayers," the lawyers said.

The mother of a Richardson 3-year-old who was reported missing and later found dead was arrested on Thursday.

Sini Mathews was arrested by Richardson police Thursday afternoon on a child endangerment charge related to the death of 3-year-old Sherin Mathews.

According to an arrest affidavit, Sini and Wesley Mathews, Sherin's adoptive parents, left the 3-year-old alone for an hour and a half while they went out to dinner at a North Garland restaurant on Oct. 6 with their biological 4-year-old daughter.

The affidavit says Wesley told police he grew impatient when Sherin refused to drink her milk and decided to leave her at the home alone while he went out to dinner. He says he told Sini to come with him, and she voluntarily went to dinner with him, knowing Sherin would be left alone.

Sherin was reported missing by Wesley on Oct. 7. Her body was later found in a culvert just north of the family's home on Oct. 22.

Initially, Wesley told investigators Sherin went missing after he left her outside as punishment for not drinking her milk. Later, he admitted to police that she was never missing at all. He claims Sherin choked and died when he physically helped her drink her milk. He admitted to moving her body.

Wesley is currently in jail on felony charges.

The biological child of the Richardson parents charged in connection with the disappearance and death of a 3-year-old will live with relatives.

Child Protective Services on Monday announced the four-year-old daughter of Wesley and Sini Mathews is with family members in Houston and no longer in foster care.

CPS took custody of the couple’s 4-year-old daughter when Wesley first reported that 3-year-old Sherin was missing. He eventually admitted to moving her body. He told investigators she chocked and died after he forced her to drink her milk.

Because of the questionable circumstances surrounding Sherin’s death and possible additional criminal charges, the state did not want to offer any type of reunification services.

DALLAS - The mother of 3-year-old Sherin Mathews may get out of jail after having her bond reduced.

Sini Mathews showed no emotion on Monday when the judge lowered her bond from $250,000 to $100,000. She was arrested and charged with endangering a child after police determined she left her adopted daughter home alone on the night before she was reported missing.

During the hearing, prosecutors called her a flight risk and strongly argued against the reduction. The lead detective in the case testified she asked her pediatrician for shot records so she and her biological 4-year-old daughter could go to India.

But Mathews’ attorney said that was a mistake. He said although she did inquire about shot records, she did not make any arrangements to leave the country and has already surrendered her passport.

In the end, the judge did not agree and decided to reduce Mathews' bond by more than half the amount. Her attorney said they were still discussing whether she would bond out, even with the massive reduction.

"We're happy the judge reduced the bond, we hoped it would be a little less. It's reasonable," Nolte said.

The judge will require her to be under house arrest with an ankle monitor.

Wesley Mathews remains in jail charged with injury to a child.

The couple's 4-year-old daughter is now living with relatives near Houston. Prosecutors are working to take away Sini's visitation rights for the child. That could happen at a hearing later this week.

A physician said she notified Child Protective Services in March after she found several bone fractures on Sherin Mathews, a 3-year-old girl adopted from India who was found dead in suburban Dallas last month.

Dr. Suzanne Dakil testified on Wednesday in a custody hearing in which the girl’s adoptive parents, Wesley and Sini Mathews, were seeking to recover their biological child, 3, from state custody. Their daughter, originally placed in foster care, has been staying with relatives, Dallas News reported.

The testimony revealed that Sherin had a bone fracture in September 2016, after her family said the little girl was pushed off a couch by her sister, Dallas News reported. In January, a physician referred Mathews to Dakil because the toddler was underweight.

The little girl was hospitalized for a skin infection and possible joint and muscle infections.

Dakil said that after looking at X-rays, she determined that the girls's legs were fractured. Sini told Dakil that Sherin had brittle bones as a result of the poor diet she had in India. However, the doctor determined that the injuries had occurred after she moved away from India.

"At that point, I had no explanation other than this child had been physically abused," Dakil said.

The Mathewses, who face criminal charges arising from Sherin’s death, invoked their Fifth Amendment protection against self-incrimination and refused to answer questions on Wednesday.

State failed 3-year-old Sherin Mathews, head of Child Protective Services says

Texas Child Protective Services Commissioner Hank Whitman is disappointed in his agency's handling of Sherin Mathews' case, according to an interview with WFAA-TV (Channel 8 ).

Whitman, who declined to talk about any specifics of the case, said the agency will figure out how Sherin's case "slipped through."

"I'm gonna tell you right now, it is my mission, it is my passion that we get better at this," he said.

In March, a doctor found that the 3-year-old Richardson girl had suffered injuries to her upper-arm bones and fractures in her leg bones that were in various stages of healing, according to testimony Wednesday.

The doctor, Suzanne Dakil of the Referral and Evaluation of At Risk Children Clinic, reported the injuries to CPS, suspecting that Sherin had been injured at the hands of her parents.

"I had no explanation other than this child had been physically abused," Dakil said.

Farmer said Wesley Mathews told him that he got up in the middle of the night and asked his daughter, who slept in a crib in her parents bedroom, if she was awake. She said that she was, so her father asked her is she wanted to finish her milk, which she hadn't finished earlier that night, according to the detective.

Wesley Mathews then took his daughter to the garage to finish her milk, he told the detective. According to an arrest warrant affidavit, Sherin Mathews' father said the girl began to choke as she was drinking. Her breathing slowed, and Mathews "believed she was dead," he told the detective.

After Sherin Mathews died, Farmer said Tuesday, Wesley Mathews put her in the back of his car with a "couple of bags of trash" and dumped her in a nearby culvert. Wesley Mathews intended to return to get the body later, he told Farmer.

Sini Mathews told Farmer that she woke up at 5 a.m. and saw a "weird look" on her husband's face after Wesley Mathews got rid of the body. The couple then went to the kitchen table and prayed for three hours before Wesley Mathews called the city of Richardson's non emergency line to report his daughter missing at about 8 a.m. Oct. 7.

DALLAS - Medical examiners found evidence of homicidal violence when they performed an autopsy on 3-year-old Sherin Mathews’ body, according to a newly released report.

The Dallas County Medical Examiner’s Office said that while Sherin’s manner of death was homicidal violence, her exact cause of death could not be determined because of extensive decomposition.

Sherin was falsely reported missing by her father back in October. When her body was later found in a drainage ditch, police said he changed his story and said she died while drinking milk.

Both of the 3-year-old’s parents were arrested and remain in jail. Wesley Mathews was charged with injury to a child and Sini Mathews was charged with child endangerment.

Mitch Nolte, an attorney for Sini, said he has seen a copy of the full autopsy report. In his opinion, it shows his client had nothing to do with Sherin's death.

Child Protective Services is seeking to terminate the couple's parental rights for their 4-year-old biological child. A judge on Wednesday set a trial date for Jan. 26.

In a custody hearing Friday morning, Wesley and Sini Mathews stood in shackles before a judge and agreed to relinquish their parental rights — an irrevocable decision.

Last month, a Dallas judge blocked Sherin Mathews' parents from having contact with their surviving child after prosecutors argued that they failed to protect Sherin. The judge's ruling meant that Child Protective Services didn't have to work with the Richardson couple to reunite them with the 4-year-old girl. When the agency removes children from their homes, it typically offers the parents services such as parenting classes and counseling to help them regain custody of their kids.

CPS has custody of Sherin's sister, who has been temporarily placed with relatives in the Houston area.

Those relatives, who went through extensive background checks and home studies, plan to adopt the girl, said Marissa Gonzales, a spokeswoman for the Texas Department of Family Protective Services.

Counsel General of India in Houston, Anupam Ray said India is cancelling the OCI cards of Wesley Mathews his wife Sini and the couple's some relatives and close associates as public opinion in India on this issue is inflamed and travel of these people to India is not in public interest.

Manoj N Abraham and Nissy T Abraham, friends of the Mathews family, were among the first to receive a notice of cancellation of the OCI, which they have challenged in Delhi High Court.

Wesley's parents are also in the list.

"India has not forgotten this little child and in public interest, the Consulate will recommend their names for insertion in the 'Blacklist' maintained by the Government of India at the earliest,“ the Counsel General of India said.

After Houston Consulates extensive research on this case, "It has come to the knowledge of the Consulate through diplomatic and privileged sources that Manoj Abraham and Nissy T Abraham have been in close contact with the adoptive parents of Sherin Mathews before, during and after the murder," Mr Ray said.

"We would have found out more about the circumstances of this heartless murder if Abraham had cooperated in providing information."

"The case is developing in Delhi, but our position on providing visa is unchanged," Mr Ray confirmed.

Tthree-year-old Sherin's decomposed body was found in a culvert close to her home last year in October 22, two weeks after her Indian-American foster parents reported her missing.

An autopsy concluded Sherin died of homicidal violence, but how she died could not be determined due to the decomposition of the body.

Her adoptive father, Wesley originally told police he had left Sherin outside the home at 3 am to punish her for not drinking her milk. Then he changed his statement and said Sherin had choked on her milk while he tried to feed her in the garage.

He also admitted the family had gone out to dinner that night and left Sherin home alone.

The couple from Kerala had adopted Sherin from an orphanage in Bihar in 2016.

While Wesley was indicted on charges of capital murder and tampering with evidence, his wife Sini was indicted on a charge of abandoning a child.

Meanwhile, the attorney representing the mother of Sherin has withdrawn as her counsel Friday over non-payment.

Attorney Mitchell Nolte filed a motion in Dallas County and the motion was accepted.

Nolte has represented Sini, currently being held in the Dallas county jail on USD 250,000 bond, since she was arrested on a charge of child endangerment/abandoning.

According to court documents, Mathews "failed to comply with the terms of the employment agreement and has been unable to make further financial arrangements."

Earlier in August a Dallas county judge reduced the bond on three charges for Wesley.

DALLAS — Richardson mother, Sini Mathews, accused of abandoning her 3-year-old adoptive daughter, Sherin Mathews could potentially have her bail reduced for a second time.

Sini Mathews has been in the Dallas County Jail since Nov. 16, 2017 when she turned herself in. Bail was originally set to $250,000 and reduced to $100,000 despite questions of flight risk.

Her court setting for the bond reduction is slated for 8:30 a.m. No word on whether or not she will be making an appearance in court.
Her husband, Wesley Mathews faces charges of capital murder, injury to a child and tampering with evidence. His bond was reduced from $1 million to $500,000 on the capital murder and injury to a child charges and from $250,000 $100,000 on the tampering charge.

Sherin died of "homicidal violence" after she went missing from their family home on Oct. 7.
After extensive searches took place, her body was found in a culvert a short distance from the family home on Oct. 22.

The couple adopted Sherin from India in June 2016. She was abandoned by her biological parents in Gaya, India and was taken to a local orphanage in Nalanda. It was there where The Mathews family adopted her and brought her back to Richardson.

Wesley Mathews' murder trial is scheduled for May according to Dallas County Court records.

Sini Mathews has petitioned to have her trial separated from her estranged husband, Wesley Mathews, who is accused of capital murder in the girl's death. The state said both should be tried together because they are accused in the same "criminal episode" and that the witnesses and evidence to be presented are nearly identicial.

A decision on the separation of trials is expected on Feb. 4.

DALLAS - Prosecutors want the court to consider more wrongful acts when the father 3-year-old Sherin Mathews goes on trial.

Wesley Mathews is charged with capital murder for his adoptive daughter’s death. She was reported missing in October of 2017 and found a week later in a drainage culvert near her Richardson home.

After her body was found, police said Wesley admitted to moving her body. He claimed she died when he forced her to drink her milk.
An autopsy found Sherin died of homicidal violence but the specific circumstances were not revealed and the weapon is described as unknown.

Wesley’s wife, Sini Mathews, was originally charged for child abandonment in connection to Sherin’s death. In March, the Dallas County District Attorney’s Office dismissed its case against her due to lack of evidence.

But the DA’s office believes Wesley committed a number of additional criminal actions. Prosecutors filed a supplemental notice of extraneous offenses to be presented during the trial.

According to the court document, Wesley “alone or with Sini Mathews” fractured Sherin’s leg and failed to disclose the injury for at least a week.

He and Sini “failed to provide adequate nutrition to Sherin Mathews from Sept. 1, 2016 until the time of her death,” the document states.

Wesley also cancelled 19 of Sherin’s physical therapy appointments, canceled 8 speech therapy appointment and didn’t show up for several more. He also didn’t show up for a Failure to Thrive Clinic appointment for the toddler.

Prosecutors claim Wesley lied to Richardson police about Sherin’s whereabouts after she was reported missing. He allegedly deleted messages between himself and his wife from his cellphone, deleted a file named “Sherin log” on his computer and deleted all internet history on his computer from Oct. 6-7, 2017, the document states.

He terminated his parental rights to his biological daughter and has never once mentioned Sherin in any letters he has written while in the Dallas County jail, prosecutors said.

Wesley remains behind bars with a bond of $1 million. His next court hearing is scheduled for June 7.

Jurors will also not hear that approximately eight speech therapy appointments were cancelled by the Mathews between February and August of 2017.

Wesley Mathews' defense attorneys successfully argued that it was Sini Mathews who took the toddler to therapy while Wesley was working.

A charge of child abandonment against Sini Mathews was dropped and she was released from jail.

Wesley Mathews' capital murder trial is set for June 24.

If convicted, he faces life in prison.

A Richardson man who is accused of killing his adopted daughter and dumping her body in a culvert  pleaded guilty Monday to injury to a child by omission.

His plea came as his trial on a capital murder charge was set to begin.

If  Wesley Mathews, 39, had been found guilty on the murder charge, he would have faced an automatic life sentence without parole for the 2017 death of 3-year-old Sherin Mathews.

Even after pleading to the lesser charge, he could face life in prison. But a jury could decide on a lighter sentence during the punishment phase, which got underway Monday after his guilty plea.

Updated at 4:40 p.m. Tuesday with Wesley Mathews' testimony.

Wesley Mathews didn't call 911 after his 3-year-old daughter died because he "was not ready to give up on my child," he testified Tuesday.

Mathews said he refused to believe his daughter, Sherin Mathews, was fully dead when he wrapped her tiny body in a blue plastic bag and hid it in a culvert near the family's Richardson home.

"I refused to believe that my child had completely gone from the world," Mathews testified Tuesday.

He said he believed if he "prayed hard and strong enough" Sherin Mathews might be resurrected, like Lazarus.

The father reported Sherin missing after he put her outside Oct. 7, 2017, because she wouldn't drink her milk. Her badly decomposed body was found 15 days later in a culvert.

Mathews, 39, pleaded guilty Monday to a lesser charge of injury to a child by omission in Sherin's death in October 2017. He was originally charged with capital murder.

A jury of four women and eight men will decided Mathews' fate. He faces up to life in prison. 

Mathews said he regrets his actions the night his daughter died and realizes he could have done more to help her.

"It's just not fair that my heart still beats like my child's heart is not," he said.

Dumped in a culvert
Prosecutors showed jurors photos on Tuesday of Sherin's body dumped in the culvert.

Several jurors were visibly upset seeing the photos during the second day of the sentencing trial.

"I know I wanted do something honorable, do something nice," Mathews told police of wrapping his daughter's body in a garbage bag before stowing her in the cargo area of his car.

Jurors watched recorded videos of the father describing trying to make Sherin drink milk in the hours before she died.

Wesley Mathews described leaving Sherin alone while he took his wife and biological daughter to dinner. He told investigators they had not left the girl alone before.

Once the family was home, Mathews put the girl in the garage so she would drink her milk.

He said he also threatened to put the girl outside with coyotes "to build the fear factor in her."

Sherin took a large gulp of milk and then started choking, Wesley Mathews told investigators during the recorded interview.

Then the child went silent and the father felt her body go cold and stiff.

Mathews testified he didn't wake up his wife, Sini Mathews, after their adopted daughter choked on milk, because he was trying to save Sherin.

Though Sini Mathews is a registered nurse, Wesley Mathews testified he believed there wasn't time to get her for help.

"In a very quick time, my child had gone from me," Wesley Mathews testified.

That's when he wrapped her in a bag and dumped her body blocks from the family home.

He said he didn't want his wife to see Sherin's lifeless body, and he wanted his daughter's body to remain somewhere close to him.

"I wanted it to be somewhere I could see by my house," Mathews said.

Surveillance video outside a house shows Mathews' vehicle leave his home at 4:19 a.m. and return 4:53 a.m.

Mathews told police he believed his daughter was alive but missing.

"Is Sherin alive?" an investigator asks in one of the videos jurors watched.

"Yes. Let's look for her," Mathews responds.

"She's not in the trees," the investigator says.

"We're not looking good enough... She's alive, sir. She's alive," Mathews said.

The couple adopted Sherin in the summer of 2016. Prior to her adoption, Sherin was abandoned by her biological parents in Gaya, India, and taken to a local orphanage in Nalanda.

"We get a girl with genetic conditions," Mathews told police. "We were upset. The agency was blindsided too."

Sherin was undernourished and had food aversions.

Mathews testified he wanted Sherin to drink her milk because he was afraid Child Protective Services would be called if Sherin didn't get enough to eat.

And once the child was dead, he was afraid CPS would tear his family apart.

"If I had applied common sense, my child would be with me," he testified.

He said he would still have Sherin and his biological daughter together.

"I failed my Sherin, and I failed my family," he said.

Testimony will resume in the sentencing trial Wednesday morning.

Jurors spent about three hours deliberating the punishment of Wesley Mathews, who was originally charged with capital murder in the October 2017 death of Sherin Mathews.

They were unanimous in their decision, which elicited little reaction from the 39-year-old defendant. Mathews stared straight ahead as the verdict was read and did not look at jurors.

His wife, Sini Mathews, quickly left the courthouse without commenting on the verdict. Originally charged with child abandonment, the registered nurse had her case dismissed by prosecutors who said they couldn't prove it beyond a reasonable doubt.

The defense attorney for Wesley Mathews is expected to file a legal challenge on Friday after Mathews was sentenced to life in prison for his daughter's death in 2017, NBC 5 has learned.

Mathews pleaded guilty to the lesser charge he faced at the time of felony injury to a child the day his trial began in late June and admitted to not calling 911 and instead disposing of his daughter's body after he said she choked on milk in the family's Richardson garage.

In a motion for a new trial, Wesley's appeal attorney, Brook Busbee, states Mathews should be granted a new trial because the "photographs of the remains of the decedent, both where her body was discovered and in the autopsy suite" were so prejudicial as to deny Mathews a fair trial.

At least two jurors were visibly affected when shown the graphic images.
The images were not shown to the audience in the courtroom.

Busbee also states that jurors were shown evidence that Sherin suffered "fractures from before she died. There was no evidence" that linked Mathews to the injuries and "introduction of that evidence unfairly prejudiced the jury."

The move to file an appeal or a motion for a new trial is standard, according to a source close to the case.

A Richardson father has been transferred to state prison to begin his life sentence in connection with the death of his 3-year-old adopted daughter.

Wesley Mathews, 39, was taken from the Dallas County Jail on Thursday to the Texas Department of Criminal Justice in Huntsville so he can be assigned to a prison unit, according to the Dallas County Sheriff's Department.

Mathews' attorneys have requested a new trial for their client. In a motion filed last week, they argued prosecutors showed graphic photos to the jury that were prejudicial and prevented Mathews from receiving a fair trial.

His attorneys also argued the state lacked evidence to show Mathews was responsible for broken bones Sherin sustained while she was in his care. Mathews and his wife, Sini Mathews, adopted the child from India in 2016.

A hearing on the motion for a new trial is scheduled for Aug. 2, according to court records.

DALLAS - The man sentenced to life in prison in connection to his adopted daughter's death wants a retrial.

Wesley Mathews and his attorneys were in court again Monday morning claiming he did not get a fair trial when jurors were shown pictures of his daughter’s remains.


Mathews pleaded guilty to a reduced charge of injury to a child by omission and was given a life sentence in June for his daughter Sherin's 2017 death.

He maintains that the 3-year-old died after choking on her milk. He admitted to dumping her body in a culvert near their home and then reported her missing the next day.

Richardson police searched for the little girl for several weeks before finding her body. It was so badly decomposed the medical examiner could not determine her cause of death.

The judge on Monday heard the motion by the defense and also heard from the state. She said she will make a decision on Sept. 5.

Mathews' defense claimed the jury in the June trial should never have been shown photographs of the child's dead body, or photos that detailed a history of injuries prior to her death.

The defense team for the Richardson father filed a motion for a new trial last month, arguing that "photographs of the remains of the decedent, both where her body was discovered and in the autopsy suite" were so prejudicial as to deny Mathews a fair trial.

Based on the above, Mathews' defense filed a motion for a new trial. That motion was denied Thursday and now his team is expected to file an appeal.
