Sizing up Penn State's liability in abuse scandal
University says it will reach out to Sandusky victims to resolve claims
June 23, 2012
The Jerry Sandusky trial was loaded with details of the child sex abuse a jury has now convicted the one-time Penn State assistant football coach of carrying out over 15 years, but it revealed little about the university's potential liability in the scandal.
That is likely to change in a related prosecution of two university officials: Athletic Director Tim Curley and now-retired Vice President Gary Schultz.
Both have been charged with perjury and failing to alert authorities to one act of sexual abuse by Sandusky in a scandal that tarnished Penn State University's name and led to the departure of its president and Coach Joe Paterno.
"Their trial will be much more an indictment of Penn State," said Max Kennerly, a Philadelphia lawyer who is not involved in the case.
A trial date has not been set.
Late Friday, the jury in Sandusky's criminal trial found him guilty on 45 out of the 48 charges against him after about 21 hours of deliberation over two days. He faces hundreds of years in prison.
Now, attention will turn to compensating the victims.

What's next?
• The Jerry Sandusky trial is over, but not the drama surrounding him and Penn State University.
• Sandusky faces sentencing, but also plans to appeal.
• Sandusky, his The Second Mile charity and Penn State could face civil suits. Some have been filed.
• Sandusky's interstate travel with some accusers could prompt federal action.
• Two Penn State executives, Athletic Director Tim Curley (who is on leave) and retired Vice President Gary Schultz, face perjury charges.
• Former FBI chief Louis Freeh is conducting an investigation at Penn State into its reaction to abuse allegations.

I wonder if Jer has any health issues? I can see the shock of jail causing a weak heart to stop.
BTW, love the cartoon of 'Mutha' the Tickle Monster. That is probably exactly what those poor kids thought when Jer was molesting them.

Jerry Sandusky case: Victim 4 had 'sixth sense' about adopted son's alleged abuse
By SARA GANIM, The Patriot-News
June 23, 2012
The attorney representing Victim 4 said today that he believes his client's testimony on the stand was the reason that Matt Sandusky went to authorities, telling them for the first time that he is a victim of his adoptive father, Jerry Sandusky.
Now one of the most notorious and well-known pedophiles in the nation, Sandusky is in protective custody at the Centre County jail, awaiting sentencing in about 90 days that could keep him behind bars for the rest of his life.
His victims were all at-risk boys he met through his charity, The Second Mile. Many of them knew each other from spending time at the Sandusky home. But none said they knew any of the others were being abused, too.

Donaldson: Although Sandusky case nears end, Penn State likely to be on the hook

::snipping2::
So the first phase of this surreal case is over. I felt Joe Amendola, Sandusky's lead attorney, went overboard in complimenting the prosecution, judge and jury.
Next, there will be an assessment to make a formal determination whether Sandusky will be classified as a "sexually violent predator" under Pennsylvania law, and the victims will have another opportunity to be heard at Sandusky's sentencing on the 45 crimes he was convicted.
After sentencing, the clock starts ticking for appeals.

Sandusky is one of 272 inmates at the Centre County Correctional Facility, 7 miles from the Penn State campus, and was kept under watch overnight. Rominger said he planned to visit Sandusky today
Like other inmates at the jail, Sandusky was allowed to take a small number of items in with him. The options include six pairs of white underwear, white socks and white undershirts, prescription glasses or contact lenses, a wedding band, religious prayer book, no more than 10 personal photographs and 10 letters and no more than 4 inches of legal documents or materials.
Sandusky will be allowed to shower daily and can get visits from his family, friends and lawyers.
The jail did not say whether anyone had gone to see him Saturday. At his home, his wife and three of their adopted children remained inside after returning there Friday night. The window blinds and curtains were drawn.

Jail Inmates Serenaded Sandusky With "Hey, Teacher, Leave Those Kids Alone"
June 24 '12
Convicted child molester Jerry Sandusky had a surprise waiting for him when he was sent to jail the first time, reports Andrew Strickler of The Daily.
As soon as the lights went out at night, Sandusky's fellow inmates at the Centre County Correctional Facility serenaded him with a chorus from Pink Floyd's "The Wall":
"Hey, teacher, leave those kids alone!"
Similar humiliations are expected to continue now that Sandusky is back in jail having been convicted of the crimes.
Jerry Sandusky is currently on suicide watch. He'll be sentenced in 90 days.

quote snipped :
Jer's lawyer was on CNN yesterday. Jer has sleep apnea. The jail, the last time wouldn't let him have the machine he uses at night. So, he had to sleep sitting up in a chair previously.
My guess is they will file motions / motions to the point of motion sickness to get Jer sent to a special medical facility where he can have the machine. I asked someone here who used to work in a jail , pre sentencing, a no bail place and no special equipment is allowed.
After all Jer is special and has money ( right now ! ) for lawyers and they will want Jer to be comfortable in his golden retirement years.

Penn State Tries To Move Focus Back To Football
June 24, 2012 2:41 PM

After seven wrenching months of utter turmoil, shock and sadness, Penn State is looking toward the future and trying to change the subject.
This is upsetting to me. After 7 months, Penn State is ready to move on. Sorry but just how many decades did Penn State 'move on' with this horror happening right in the gym. Give those harmed by the PS failed to do the right thing the time they need to heal. Frankly, PS needs to take a break from football and learn how to empathize and recognize. Focus on what's really important here. And it isn't a football team.
For the victims. Those who stepped forward and those who are still hiding. May your healing be complete.

Penn State May Have to Compensate Victims as Sandusky Convicted
June 24, 2012, 2:21 p.m. PDT
Pennsylvania State University, its reputation damaged by the trial of former assistant football coach Jerry Sandusky, may have to compensate his victims after his conviction on 45 counts in the child-sex abuse case.
"Penn State is likely to have to pay these victims a great deal of money to compensate them for the awful things that happened to them, most of which might not have occurred had Penn State officials put the safety of children above the reputation of their institution," said Lisa Friel, former chief of the Manhattan District Attorney's sex crimes unit and now vice president of sexual misconduct consulting for T&M Protection Resources, a security and investigations company.
Jurors in Bellefonte, Pa., deliberated about 20 hours over two days before convicting Sandusky of charges, including engaging in involuntary deviate sexual intercourse with someone under 16 and aggravated indecent assault over his abuse of 10 boys over a 15-year-period.
The 68-year-old Sandusky, who was led away in handcuffs by police after the June 22 verdict, faces a maximum sentence of 20 years on each of the most serious charges, meaning he could spend the rest of his life in prison after he is sentenced by Judge John M. Cleland. Sandusky's lawyer said the former coach would appeal his conviction.
Sandusky, who had been under house arrest since waiving a preliminary hearing in December, was being held at the Centre County Correctional Facility, according to the jail's website. The former defensive coordinator for Penn State's Nittany Lions football squad had been charged with 52 criminal counts related to the alleged abuse of 10 boys he met through a charity he founded for needy children. Cleland dismissed some of the counts before the jury began deliberations.
Penn State said it would establish a forum to help address the concerns of Sandusky's victims and compensate them for claims related to the university.
"No verdict can undo the pain and suffering caused by Mr. Sandusky but we hope this judgment helps the victims and their families along their path to healing," university officials said in an e-mailed statement after the verdict.
"Counsel to the university plan to reach out to counsel to the victims of Mr. Sandusky's abuse in the near future with additional details," the officials said.
Sandusky played and coached under Joe Paterno, Penn State's head football coach, for more than 30 years before retiring in 1999. Paterno, who died in January, and former university President Graham Spanier were fired amid criticism they didn't do enough to stop Sandusky's alleged abuse.
Two Penn State officials, athletic director Timothy Curley and former Vice President Gary Schultz, were charged with perjury and failing to report allegations of sex abuse of boys Sandusky befriended. Curley and Schultz have denied wrongdoing.
Paterno coached the team to 409 wins, a record at college football's highest level. The victories included two national championships and a record 24 bowl victories in 46 seasons as head coach at one of college football's most prestigious programs.
The Paterno family, according to a statement e-mailed on its behalf by Mara Vandlik at McGinn & Co., said the community owes gratitude to jurors for their service.
"Although we understand the task of healing is just beginning, today's verdict is an important milestone," according to the June 22 statement. "Our thoughts and prayers continue to be with the victims and their families."
After the verdict, Joseph Amendola, Sandusky's lead defense attorney, said in an interview that the ex-coach's family was disappointed. Still, they knew he faced "a tidal wave of public opinion against him," he said.
"We have some appeal issues we'll pursue," Amendola said.
Pennsylvania Attorney General Linda Kelly praised Sandusky's victims for stepping forward and telling jurors about the crimes he perpetrated against them.
"Most of us cannot possibly comprehend what" Sandusky's victims endured by reliving their abuse while testifying in court, Kelly said in an interview.
Sandusky was initially accused in November of abusing eight boys. Prosecutors added more counts the following month when two new accusers came forward.
During the two-week trial, prosecutors portrayed Sandusky as a serial child molester who used the Second Mile, the charity he founded, to recruit his victims, befriending them and "grooming" them with gifts, trips to Penn State football games and money.
Amendola argued throughout the trial that the coach was innocent of the charges, which were the product of overzealous investigators. Sandusky didn't testify.
Many of the incidents allegedly took place in a locker room in the Lasch Football Building on Penn State's campus. Assistant football coach Mike McQueary told jurors about witnessing a late-night assault in the locker room shower when he was a graduate assistant.
Some of Sandusky's victims took the witness stand to recount their dealings with the coach, both at his home and on campus.
A 28-year-old man who met Sandusky through Second Mile testified that the ex-coach began touching him inappropriately in 1997. He was identified in court papers as "Victim 4."
The man said Sandusky invited him to play racquetball at Penn State when he was a 14-year-old student at a local high school. Afterward, Sandusky would touch his genitals as the two "soaped up" in the shower, the victim testified.
Sandusky enticed him into a long-term relationship by giving him sideline passes to Penn State football games, taking him to golf outings and inviting him to family picnics, the man said.
The abuse progressed to the point that Sandusky began forcing him to perform oral sex, the man said. That occurred more than 40 times during the five-year relationship, he said.
The man said as he matured, he distanced himself from Sandusky and the coach would sometimes come over to his house looking for him.
"Sometimes if I got home I would look outside and he'd be there and I'd grab the phone and hide in the closet, just hoping he wouldn't find me," the man told jurors.
Second Mile served children with physical, emotional and academic needs, according to its website. The charity said in May that it would close and transfer its assets to a Houston- based nonprofit.
Those assets more than tripled from 2002 through 2009, according to Internal Revenue Service filings. Second Mile had revenue of $2.7 million and net assets of $9 million, according to its 2010 annual report. Sandusky was the group's primary fundraiser.
Throughout the trial, Amendola sought to convince jurors that state police troopers who investigated the cases against Sandusky coached witnesses into making the sexual abuse claims. He also produced other retired Penn State football coaches to testify about Sandusky's sterling reputation in the community.
Dottie Sandusky, the defendant's wife, told jurors she never had any indication that her husband abused boys he befriended over the years.
After jury deliberations began, lawyers for one of Jerry Sandusky's adopted children, Matt Sandusky, said he had been abused by the former coach and had offered to testify in the case, his lawyers said.
Andrew Shubin and Justine Andronici, Matt Sandusky's lawyers, said in a statement that they arranged a meeting between him and prosecutors and investigators at their client's request. They gave no details and didn't say why prosecutors didn't call Matt Sandusky to testify.
Advocates for sexual abuse victims hailed Sandusky's conviction as evidence that juries are willing to hold abusers accountable regardless of their status in communities.
"This verdict shows the country that when allegations of such abuse are brought to light, they will be taken seriously and that a just outcome is possible," Scott Berkowitz, founder and president Rape, Abuse & Incest National Network, said in an e-mailed statement.
The case is Commonwealth of Pennsylvania vs. Sandusky, CP-14-2422-2011, Court of Common Pleas, Centre County, Pennsylvania (Bellefonte).

Sandusky lawyers may use NBC tape error in appeal
June 24, 2012
Lawyers for Jerry Sandusky sought a mistrial before his conviction for child sex abuse on the grounds that prosecutors showed jurors an inaccurate version of a bombshell NBC News interview with the former football coach, and the mistake may now form part of the basis for an appeal.
In response to a subpoena, NBC News turned over three versions of Bob Costas' NBC News interview with Sandusky, which aired last November on different NBC shows.
One of those versions, which was broadcast on the 'Today' show, contained an erroneous repetition of a key question and answer - about whether Sandusky was sexually attracted to young boys, Nils Frederiksen, a spokesman for the Pennsylvania attorney general said on Sunday.
The repetition, Sandusky's lawyers contend, made it appear to jurors that he was stonewalling.
"It wasn't noticed by, it wasn't noticed by us, but it became obvious when it played in court," Frederiksen told Reuters.
NBC News spokeswoman Amy Lynn confirmed this account on Sunday.

Sandusky’s lawyers weigh options for appeal

Bellefonte - Lawyers for Jerry Sandusky sought a mistrial before his conviction for child sex abuse on the grounds that prosecutors showed jurors an inaccurate version of a bombshell NBC News interview with the former football coach - and the mistake may now form part of the basis for an appeal.
In response to a subpoena, NBC News turned over three versions of Bob Costas's NBC News interview with Sandusky, which aired last November on different NBC shows.
One of those versions, which was broadcast on the Today show, contained an erroneous repetition of a key question and answer - about whether Sandusky was sexually attracted to young boys, Nils Frederiksen, a spokesperson for the Pennsylvania attorney general said on Sunday.
The repetition, Sandusky's lawyers contend, made it appear to jurors that he was stonewalling.
“It wasn't noticed by NBC News, it wasn't noticed by us, but it became obvious when it played in court,” Frederiksen told Reuters.
NBC News spokesperson Amy Lynn confirmed this account on Sunday.

A source on the prosecution team acknowledged that prosecutors played the Today version, which contained the error, without reviewing it carefully beforehand.
“Was it embarrassing?” the source asked. “It was certainly embarrassing. Was it a mistake? It was clearly a mistake.” The source also said NBC News executives expressed regret to the court.
“Did they say, 'I'm sorry?' I can't recall those exact words,'' the source said. “Were they apologetic? Yes.”
In the incident in April, Today aired a misleadingly edited tape of a call to police from George Zimmerman, the neighbourhood watch volunteer who shot Trayvon Martin. That edit made it appear that Zimmerman told police that Martin was black without being prompted. In fact, Zimmerman did so only when responding to a question posed by a dispatcher.
Several Today staffers were disciplined over that incident, NBC News president Steve Capus said at the time. Network sources told Reuters a Miami-based Today producer was fired.
