well   IMO.....it is gonna be murder just not premeditated, but with child endangerment.....child neglect......drug charges and whatever else they can come up with..

I think they will charge her big time 
if they have the evidence  they will slap her and when Jose gets slapped upside the head with it
He will be foreced to sit this littel rotten squirrel down and tell her you better talk or you will
spend the better part of your life in jail... If they have the DNA conclusive and other forensics
they will nail her and Jose to a wall to talk..  and they want her remain they will plea for that
