Sex offender charged in Chelsea King case

SAN DIEGO (AP) - A 30-year-old sex offender has been charged with murdering a 17-year-old San Diego County girl who vanished after heading off for a run in a park.

Prosecutors say John Albert Gardner III also faces a special allegation of rape or attempted rape, and a count of assault with intent to commit rape. An attorney entered pleas of not guilty on behalf of Gardner during his brief court appearance Wednesday.

Teenager Chelsea King was last seen alive on Thursday, and her car was found that night at a semirural park in northeastern San Diego. After a huge search, a body was found Tuesday in a grave by a lake, and authorities said they believed it was King, although positive identification is pending.

Gardner pleaded guilty in 2000 to molesting a 13-year-old neighbor girl.

BODY FOUND IN SWAMP BELIEVED TO BE MISSING CHELSEA KING

As thousands mourn, the key suspect in the case of a missing honor student in California, Chelsea King, will be arraigned today after the teen's remains were believed to be found in a shallow grave in a swamp.

The body of pretty teen has not been positively ID-ed but San Diego Sheriff William Gore indicated that it was probably the missing girl.

The grisly discovery was made two days after John Albert Gardner III, a 30 year old registered sex offender, was arrested on suspicion of rape in murder .
Fueled by a Help Find Chelsea King Facebook page with 77,000 fans hundreds helped in the frantic search for the straight-A Poway High School beauty.

Gardner, the suspect, had spent five years in prison after he was convicted a decade ago of during a 13 year old girl to his mother's town house with a promised Patch Adams viewing. After the teen escaped prosecutors locked the sex offender away on charges of molestation and attempted rape.

Chelsea's supposed remains were not far from the townhouse as well.

Gardner is also under investigation for the disappearance of Amber DuBois, 15, who vanished last February while walking to school.  She has not been found.

Brent King, Chelsea's grieving father, thanked the hundreds of supporters when a planned candle lit vigil for Chelsea turned sudden memorial after police broke the sad news.

"One of the nicknames that I've always called my daughter is my Angel," King said.
 "She's my angel forever."

(CNN) -- Carrie McGonigle doesn't want to believe that her missing daughter could be connected to a registered sex offender accused of killing a California teen.

"That would mean that she's dead, and I don't want to think that," said McGonigle, whose 14-year-old daughter, Amber DuBois, was last seen walking alone to school on February 13, 2009.


But authorities say they are looking into whether John Albert Gardner III, who pleaded not guilty Wednesday to raping and murdering Chelsea King, was involved in Amber's disappearance.

"We have been working closely with San Diego Sheriff's Office, and our investigators are working with theirs in case there is a connection," Lt. Robert Benton with the Escondido, California, Police Department said. "We are involved in the daily briefings on the King investigation."

Amber's father, Moe DuBois, attended Gardner's arraignment Wednesday.

"Just the similarities in our case, you know, if there is any connection to Mr. Gardner and our case, I want to be there for his prosecution and soon to be execution I would hope," DuBois told HLN's Nancy Grace.

Amber's family lives in the San Diego, California, suburb of Escondido, less than 10 miles from Poway High School, where King was last seen alive.

The shy, bookish teen was walking to Escondido High when she disappeared. She had a check in her backpack to buy a lamb for a Future Farmers of America project, according to her mother. But she never made it, and since then, investigators have been stymied by a lack of viable leads.

McGonigle says Gardner came up on her radar shortly after Amber disappeared, when she began looking up registered sex offenders in the area.

"One of the first things we did when we couldn't find her was look at the sex offenders in the area because we know that they have a history of repeated offenses," McGonigle said. "I didn't personally visit his home but one of our volunteers did, and we didn't find anything that raised suspicions."

Gardner is on California's sex offender registry for a conviction of lewd or lascivious acts with a child under 14, according to online records. He was also charged Wednesday with assault with intent to commit rape in connection with an attack on a jogger in December 2009.

A call to Gardner's public defender, Michael Popkins, was not immediately returned.

In addition to keeping the search going for her daughter, McGonigle has also become involved in educating parents and children on how to prevent abductions. She also spends time reaching out to parents of other missing children.

As soon as she learned of Chelsea's disappearance, McGonigle says she contacted Chelsea's parents and assisted in search efforts. Chelsea's car, with her cell phone inside, was found at the Rancho Bernardo Community Park, where she was known to go for runs.

"Ever since Amber went missing I've reached out to all the parents I possibly can because once it happens to you, it's going to be with you the rest of your life," she said. "It becomes your life. Supporting families, that's what it's all about. Even when we find Amber, I'll continue because I wouldn't want any other family to go through this."

Searchers found a body Tuesday that they believe to be King's, San Diego County Sheriff William Gore said at a news conference Tuesday. He said he expected a positive identification of the body to come this week.

To some in Amber's family, Chelsea's disappearance has other stinging implications.

"It's heartbreaking in another way because now we know of everything that was available to search for Amber but wasn't used," Sheila Welch said. "There weren't helicopters used with heat sensitivities, there weren't any dogs brought out for Amber, and now to know that's available, it's heartbreaking to think it wasn't used."

But Benton said investigators used all the resources available to them.

"We asked for and received the resources we needed at the time," he said. "As far as law enforcement is concerned, we had outstanding cooperation from local agencies, the FBI, the National Center for Missing and Exploited Children, and we had a significant amount of resources at our disposal."

Amber's mother has her doubts as to whether Gardner could actually be involved.

"I think the guy is too sloppy and that we would've found some evidence if he had taken Amber," she said. "But he never should have been out in public. If he were incarcerated, like he should have been, maybe Chelsea would be alive right now."

He was in court for just minutes, but even the mere sight of the convicted sex offender accused of raping and murdering 17-year-old Chelsea King set off a fresh round of outrage that reached as far as the White House.
John Albert Gardner III, 30, pleaded not guilty Wednesday, but the community obviously has a very different opinion.

In the hours before his court appearance in San Diego, someone spray painted his mother's garage with the words, "Chelsea's blood is on you -- move out." And neighbors screamed at two men who tried to paint over it.

"You're protecting somebody who has killed an innocent girl," one yelled. "Get out of here."
John Walsh, host of "America's Most Wanted," said he met with President Obama Wednesday to discuss child protection laws and funding for the Adam Walsh Act, signed three years ago by President George W. Bush.

The law promised to create a national registry of sex offenders and keep closer track of the most violent of them, but did not come with the money to implement the bill.

"President Obama said yesterday, 'As the father of two girls, John, I will get the Adam Walsh law funded,'" Walsh told "Good Morning America" today.

Walsh, whose 6-year-old son for whom the law is named and who was kidnapped and murdered in 1981, knows firsthand the grief King's parents are suffering.

"They're in the worst place a parent could be," he said. "They look in that courtroom and see a guy who should have never been out on the streets."

King, a well-liked honors student, vanished after heading out for a jog in a semi-rural San Diego County park. Her body was found less than a week later, buried in a shallow grave near the shore of Lake Hodges, about a half-mile from her car.

But the outrage grew with the arrest of Gardner, a known violent sex offender who has since been charged with the December assault and attempted rape of 22-year-old Candice Moncayo in the same park where King's body was found.

"I think everyone asks the same question," Walsh said. "Why was this animal out on the streets?

"The law should be once you offend, you're done, you're toast, you're in the slammer or you are executed," one angry woman said as she stood among protestors outside the courthouse.

Former San Diego County District Attorney Paul Pfingst was slightly more objective.

"I am of the view that people who do harm to teenage girls should go to Gitmo and stay there for the rest of their lives and be waterboarded," he said.

Authorities say Gardner may also be linked to the February 2009 disappearance of 14-year-old Amber DuBois, who vanished on her way to school, not far from where Gardner was living at the time.

"The girls are the exact similar build," Maurice DuBois said of his daughter and King. "Both white girls, both five-five, both 130 pounds."

Detectives across California are now looking into other unsolved cases involving young girls and considering whether there are any more possible links to Gardner.
Gardner pleaded guilty in 2000 to charges of committing lewd and lascivious acts on 13-year-old girl in his parents' home. He served five years of a six-year sentence and was on parole until 2008.

In court Wednesday, Gardner was flanked by two court officers. His head was shaved and his hands were manacled around the waist of his blue prison jumpsuit.

Keeping his eyes down, Gardner, 30, simply answered "yes," to a question by the judge whether he understood the charges.

No bail was set and the prosecutor did not mention any of the details of the alleged crime. Gardner was assigned a public defender for the arraignment, but that lawyer may not represent him at trial.

Prosecutors said the severity of the accusations, including a "special allegation" that a murder was committed during a rape, could carry the death penalty. The decision to seek capital punishment, however, is weeks away.

"The special allegation does make the defendant eligible for the death penalty," Deputy District Attorney Kristen Spieler said at a press conference following the arraignment. "That decision is made by the D.A., typically after the preliminary hearing and before a trial."

If the district attorney does not seek the death penalty, the charges carry a penalty of 25 years to life.
Psychiatrist Tried to Argue Gardner Was 'Continued Danger to Underage Girls'

Gardner's prior record as a convicted sex offender, prosecutors said, would be presented at trial.
Court psychiatrist, Dr. Matthew Carroll, who evaluated Gardner before his release from prison on the 2000 conviction, had pushed for the maximum sentence, as many as 30 years, and said Gardner "would be a continued danger to underage girls in the community."

Dr. Alex Kalish, a colleague, said Carroll was angry that his recommendations were ignored a decade ago.

"Dr. Carroll told the court that [Gardner] showed no insight and expressed no responsibility and that he is a danger. You can't make a stronger statement than that," said Kalish. "The guy is a violent and a predator who shows no remorse.

"There was no effort to consider his report. Apparently the D.A. did what was expedient to get a conviction. It is frustrating that no one considered the psychiatric input. Why ask for it, if you don't consider it," Kalish said.

Somebody on WS said it, and then someone asked about it, but I have not seen anything in an article to show that was his job. It does seem odd that there has been no talk about his job, so I figured that maybe he didn't work.

You are so right Klaas - I saw a few spammers on her FB the other night - it was disgraceful what they were posting - not so much about Chelsea personally but about women in general and how we deserve to be abused and treated the way Chelsea was - it was sick.  I know they were reported them to get them off that page.  Thank you for what you do to prevent that from happening to us here.

 Chavez said when Gardner registered at the Lake Elsinore station, officials took a new photograph of him and collected information such as details about his vehicle and his employment. Gardner said he is a self-employed electrician, Chavez said.

He declined to say whether the vehicle Gardner was driving matched the descriptions of any of the vehicles described in the abduction attempts.
