43 year old Sherry Arnold has been missing in Sidney, Montana since Saturday morning, January 7, 2012, when she went for a jog. She was last seen at about 6:30 a.m. on Saturday when she was leaving home for her usual early morning jog. She never returned and has not been seen or head from since.Police have reported that they found one of Arnold’s running shoes near a truck route in a roadside ditch that is a part of Sherry Arnold’s normal jogging route.

SIDNEY- The FBI has now joined the search for a missing Eastern Montana teacher. An FBI spokesperson says because of the potential of kidnapping and the proximity of North Dakota, agents are now on the ground in Sidney.

Three canine units from the Border Patrol, Roosevelt County Sheriff's office, and Miles City, Montana Police Department are in town searching for Arnold. In addition to local law enforcement and firefighters, 40 members of the Montana National Guard are assisting officers by searching the rural areas of town. Also locals are searching with ATV's, horses and on foot. Locals also have planes in the air, along with a helicopter to help in the effort.

 

Arnold is a well known math teacher and coach, and is loved by all in the small community. Locals are shocked and stunned by the disappearance, and it has brought the town to a complete stand still.

On Monday, search crews broadened their grid in Richland County walking fields, searching trailer parks, ditches and canals. They found other items of clothing, but none -- apart from the shoe -- have been identified as belonging to Arnold.

No solid evidence has emerged to indicate that she was kidnapped, authorities said.

"It's just been grueling," said Arnold's father, Ron Whited, who runs a ranch outside of Sidney. "When you can't find someone and you do find a shoe and you know that's where she was running, something obviously wasn't right. I can tell you I would never believe I would be looking for my daughter."

Sherry and her husband, Gary Arnold, had five children from previous marriages, including two still living at home and attending Sidney High School, Whited said. Colleagues described her as a devoted teacher.

Her disappearance comes amid a lot of change in the town of more than 6,000. A boom in the nearby Bakken oil fields of eastern Montana and western North Dakota has brought in newcomers, up more than 1,000 from several years ago.

In his years at the police department, DiFonzo said this is the first time he can remember investigating such a sudden disappearance.

"This is the first issue where we had someone go missing without some sort of background issue," he said. "It's just so sudden."

DiFonzo said he can feel the growing pains in Sidney — a town of about 5,000 only 10 miles from the border with North Dakota — as people pour in from out of town, chasing the money brought by the Bakken oil boom.

He's seen it before — the last time there was an oil boom in the 1980s.

"We have a lot of activity now at this part of the state," DiFonzo said. "A lot of out-of-state people are here to work, and locals don't know them or recognize them."

The influx has increased crime, and DiFonzo said officers are responding to more bar fights, domestic violence and drunken driving.

"We are just seeing the tip of the iceberg," he said.

Law Enforcement Officials in Sidney have received three separate reports of a mountain lion being sighted in the area of Fifth Avenue S.W. near Johnson Park (the old tennis courts). Each report was of a solitary animal which was seen crossing Fifth Street S.W. between the well house adjacent to Johnson Park and Lone Tree Creek. Two of the reported sightings were at approximately 6 p.m. and 10 p.m. in the evening and the third report was at approximately 6:30 a.m. in the early morning.

The local Fish, Wildlife and Parks Officer along with tracking dogs and an experienced handler have searched and will continue to search the area in and around where the sightings have occurred. Thus far, however, the animal has not been located, although signs of a possible large male were found.

The public is advised to use extreme caution if you will be walking or traveling in this area and are asked to report immediately to Law Enforcement if you should see or come into contact with any animal you suspect could possibly be a mountain lion. The public is cautioned not to take any action or attempt to capture this animal and should immediately contact Law Enforcement at 9-1-1 or 433-2210. Quick notification to Law Enforcement can lead to prompt location and possible capture of the animal.

Again, the public is cautioned when traveling or walking in this area to be extremely careful and alert.

I don't think they have released any info about the evidence collected, kittymom.  It's such a hard thing to think about, isn't it?
I was just thinking through what 'stuff' might have been found on her shoe.  Mud and grass would be expected on a running shoe.  If its blood, I'd expect it to be her own.  What else could it be out there along a roadway?  Maybe drool from an animal?  Fur?

It's been five days since Sidney teacher Sherry Arnold went missing after a morning jog, and no new clues have been uncovered.

Now the Sidney Herald newspaper is reporting that the search has concluded for the time being.

The Herald reports that the Federal Bureau of Investigation is taking over the case and is looking into the possibility of abduction, and says that a search will resume if investigators find other evidence.

So far the only piece of evidence that has been found is one of Arnold's running shoes.

A tipline has been set up for anyone that may have information about the whereabouts of Sherry; the number is 406-433-4027.

In addition, a "Help Find Sherry Arnold" page on Facebook page now has more than 6,100 members.

JVM (Issues/HLN) has her husband Gary Arnold on right now. She is an Algebra teacher at Sidney High. The husband sounds exhausted and distraught as can be expected. Male population 2800. (41 registered sexual violent offenders, 4 times the national average.)
Almost all SO live within a 1/4 mile of Sherry's home. JVM received anonymous email says ever since oil industry came to town there has been an increase of transients, truck drivers, crime and a suspected drug ring according to the emailer who doesn't want to be identified. Size of Sidney only 15 blocks X 22 blocks.

Missing Montana mother and teacher Sherry Arnold is dead, according to a post on her school district's website. The FBI announced today that they have one person in custody and another being questioned.

Arnold, 43, disappeared around 6:30 a.m. on Dec. 7 when she went out for an early morning run near her home in Sidney, Mont. A single running shoe was the only trace of Arnold left behind.

"Based on a tip from the public, law enforcement took one adult male into custody, and another adult male is being questioned by police," FBI spokeswoman Debbie Dujanovic Bertram said in a statement. "The investigation to determine what happened to Ms. Arnold continues."

The FBI reports that one man is in custody at this time, and another man is being questioned by police.

The school district in Sidney made the following announcement on its website on Friday morning.

The school district was notified around 9:30 AM today of Sherry Arnold's death following notification of the family. In response to this news, the District will be in session until 2:00 PM. All route busses will operate at 2:00 PM. Additional counselors are on hand this morning in all buildings and parents, if needed, may check their students out from each building. Friday games are cancelled.

A press conference will be held at 3 p.m. at the Law & Justice Center in Sidney.

The FBI released the following statement:

Based on a tip from the public, law enforcement took one adult male into custody, and another adult male is being questioned by police. The investigation to determine what happened to Ms. Arnold continues.

Arnold left for a run at around 6:30 a.m. Saturday, January 7, and never returned home. One of her running shoes was later found.

Investigators had received "dozens and dozens" of calls about Arnold, FBI spokeswoman Deborah Bertram said Thursday by e-mail.

the world is not safe anymore..women who jog  in the early mornings or later evening all alone always give me an anxious moment when I see them..I see it all the time..going into wooded areas where there bike paths are, country roads out where we live...I just want to tell them to be careful! None of us are safe anymore at our malls, the parks, even in our own homes..

RIP Sherry..I am sure that the scum that took your life had nothing to add to society while you had so much to give to the world..

Two men have been arraigned on charges of aggravated kidnapping in connection with the death of Sidney, Mont., High School teacher Sherry Arnold and are being held in Williston, Sidney Police Chief Frank DiFonzo said Saturday morning.

Investigators in North Dakota are continuing to search the area and gather evidence in the case. DiFonzo called the rumors circulated Friday night that Arnold may have been killed in a hit and run type accident "all kinds of speculation."

DiFonzo said he expects the two men will be extradited to Sidney from Willston at some point. He didn't want to speculate on a timeline because it was a federal case.

SIDNEY- The news of missing Sidney, Montana teacher Sherry Arnold's death sent shockwaves across the close knit community and prompted many of them to come together to grieve the loss of a beloved teacher.

Friday night, hundreds of people gathered at Sidney High School where 10 local spiritual leaders led a memorial at the school. Those leaders said they wanted to help the community come together and grieve, but also they wanted to send a strong message that they will rise around the fear and this tragedy.

The community became especially emotional during the memorial when they sang "Amazing Grace" and held hands during "The Lords Prayer."

Missing Montana mother and teacher Sherry Arnold is dead, according to a post on her school district's website. The FBI announced today that they have one person in custody and another being questioned.

Arnold, 43, disappeared around 6:30 a.m. on Dec. 7 when she went out for an early morning run near her home in Sidney, Mont. A single running shoe was the only trace of Arnold left behind.

"Based on a tip from the public, law enforcement took one adult male into custody, and another adult male is being questioned by police," FBI spokeswoman Debbie Dujanovic Bertram said in a statement. "The investigation to determine what happened to Ms. Arnold continues."

I wouldn't think this is going to turn out to be a hit and run with two folks arrested and no body having been found yet.  I would think with a hit and run, they'd have just driven off and left the body.

in reading all of the articles on Sherry, I did not realize that her body had not been found yet! am I 'blonde' or are the articles a bit misleading or did I just assume that she was found since they are announcing that she is dead? I reread the articles again...still not clear...

I read through the thread and found this article  dated 1/13 that says Sherry is confirmed dead, but there's no mention of a body found.  There's also a video at the link that is titled "Sidney Public School's Website Confirms the Death of Sidney Arnold".    I've just reread the one you've referenced Cookie, and it mentions "reported death" but says the FBI hasn't confirmed her death.  So I just don't know either.  Color us both confused  ::MonkeyNoNo::

If they dumped her body and actually returned to Colorado, she could be anywhere.....ugh so sad for the family. I found one person with the last name of "Spell" in Parachute, CO but not this one. The one I found also has ties to Louisiana, could be related. I am guessing Parachute, CO is not very big. I imagine if they want to save their butts (if it was just an accident/panic situation) they will give LE the location of the body.

just read that article on Daily Mail...
We heard that these guys were arrested based on a tip. probably a good tip that the LE believe that she is dead. Maybe the perps have not revealed where the body is yet to get a better 'deal' on their jail sentence? also, I think that killers have learned from Casey Anthony trial that the longer a body lies in the elements and evidence is destroyed, the easier it is to 'confuse' a jury....and possibly be set free or get a lesser charge..However, what are the chances of there ever being a more ignorant jury that the one in the Casey trial...

Land owners in Montana and North Dakota are searching their properties, looking for the body of missing Montana teacher Sherry Arnold.

The farmers and ranchers in these remote areas were asked by the FBI to check for disturbed soil or grass near vacant farms.

Investigators are saying that Arnold could be buried in a "shelter belt," rows of trees planted alongside farmland to protect the soil from wind.

"Property owners who discover something unusual are asked not to disturb the site and immediately contact the Williams County Law Enforcement Center," the FBI said in a statement.

Conflicting information has been posted, with a few articles having said her body was found.  There was some discussion about this up thread.  The recent articles we've been seeing are asking farmers and landowners to check their properties, so I guess she hasn't been found.  I've changed the subject line on the first post in this thread (header) from "(Body Found)" to "Presumed dead".  Hopefully Sherry's remains can be recovered soon.  This has to be so awful for her family.

Authorities believe that Arnold has been killed and is buried in the area. They are asking landowners in Williams, McKenzie and Mountrail counties, as well as those living in the northeast corner of Montana, to check their property for any sign of recent activity. The mayor of the small Montana town where a beloved teacher has been declared dead has blamed the influx of oil workers for the crime.
Violent crime in Sidney, population 5,000, has mushroomed thanks to an influx oil field workers following the Bakken oil boom in North Dakota.
Although there is no suggestion that oil workers were involved in Mrs Arnold's disappearance authorities believe they have brought a transient dangerous element to the small town, where everyone used to know each other.

'We own the day,' Brett Smelser told ABCNews.

he can say whatever he wants to say...He did not have to go along with taking Sherry and helping in her murder....no matter what...He could have gone to the police.

The two men are currently being held in Williston. They want an extradition hearing before they can be sent to Montana to face aggravated kidnapping charges in the Jan. 7 disappearance of math teacher Sherry Arnold of Sidney.

According to court documents, Waters and Spell are being charged in Richland County, Mont., with aggravated kidnapping for "without lawful authority restraining Sherry Arnold." Nevermind. I think I figured it out what the article was trying to explain. The article is not very explanatory. It looks as though he received permission from Colorado (due to his 2009 charges in CO) to go to Texas because he claimed his brother in Texas was in a car accident. So CO courts granted him an emergency leave to go to TEXAS, but he went to Montana.

Currently, Montana has sole jurisdiction over the aggravated kidnapping charges, since Montana is where the case began. If the investigation results in other crimes committed then the location those crimes were committed would establish who has jurisdiction over those.

As of Thursday, police had not recovered Arnold’s body but had reason to believe it’s in North Dakota. If that’s the case, then depending on the evidence the prosecutors have, the state of North Dakota could have jurisdiction over whatever crimes were committed in their jurisdiction.

And in a twist, if crimes were committed while crossing a state line the federal government may also have jurisdiction.

It is possible that Montana and North Dakota could pursue trials on the charges committed in their jurisdictions and the federal government could step in and pursue charges also. When it comes to the double jeopardy clause and the states, that is another story.

It is also possible federal attorneys request that the states drop their charges and only they take over court proceedings.

The FBI is asking property owners to check for disturbed soil and matted grass on vacant farmsteads or along shelter belts, which are lines of trees that protect farmland from wind.

The agency says Arnold's body may be buried in a shelter belt with mature or rotted trees.

Two men charged in Montana with aggravated kidnapping in the case are being held in Williston, N.D. Extradition hearings are scheduled next month.

Body found in ND, may be missing Montana teacher Sherry Arnold

Federal and multi-state law enforcement officers have recovered a body believed to be that of missing Sidney, Montana, teacher Sherry Arnold.

The body was found east of Williston, North Dakota, on Tuesday, more than two months after Arnold was reported missing.

On Wednesday morning, the body was flown to the State Medical Examiner's Office in Montana, where it will be be examined and positively identified.

Arnold was reported missing on January 7th after she failed to return from a Saturday morning run.

The FBI says a body found in North Dakota has been identified as a missing Montana teacher kidnapped in January.

The identification was made Thursday after the body of 43-year-old Sherry Arnold was taken to the Montana State Crime Lab in Missoula.

BILLINGS, Mont. –  A body found buried in North Dakota was identified Thursday as a Montana high school teacher who was abducted while jogging more than two months ago, the FBI said.

The remains of 43-year-old Sherry Arnold were recovered Wednesday near Williston, N.D., about 50 miles northeast of Sidney, the Montana town where she worked.

Family members and those who knew Arnold have been anxious for her body to be found to bring the case to some resolution.

Arnold's sister, Rhonda Whited-Rupp, said the family was being comforted and supported by friends and others in Sidney who were affected by the loss of a popular teacher and well-known member of the community.

"That's the only thing that gets anybody through. We're all in this together," Whited-Rupp said. "We just kind of hang on to one another and keep praying."

Suspects Michael Spell, 22, and Lester Van Waters Jr., 48, have pleaded not guilty to aggravated kidnapping in the case and await trial.

The FBI declined to disclose details on where the body was found or what led them to the site. Authorities previously said one of the suspects tried to lead FBI agents to the site in past weeks but failed.

Michael Spell had found past work in the oil fields near Parachute and on a fire damage cleanup crew but was unable to keep the jobs "because he didn't quite understand what to do," Harry Spell said. Harry Spell has said his son has an education less than a kindergartner.

Spell said in a February court appearance that he was illiterate and that his court-appointed attorneys had to read him the documents in which he was charged with kidnapping.

Waters is originally from Florida, where he has a lengthy criminal background and served time in state prison. Spell's relatives say the younger man fell under Waters' influence after the older man helped Spell and some of his associates get work as roofers.

I can only imagine how horrific it is for the family to read about Sherry's last minutes.  Many prayers for her family.

Just last Friday, the Richland County Attorney amended the charges in the case. The suspects, Lester Waters and Michael Spell, both face murder charges. If found guilty of murder, the men could face the death penalty.

Montana News Station's Amanda Venegas spoke with former U.S. Attorney for Montana Bill Mercer about the case.

Although there is evidence and confessions that the suspects crossed state lines, it doesn't mean the case automatically becomes a federal case. For now, the case is in Richland County court, but Mercer says the door is still open for the case to become a federal one.

The new affidavit gives conflicting statements from the suspects about who killed Sherry. Mercer says it's significant that law enforcement was able to recover Sherry's body to see which side measures up.

As far as a trial goes, Mercer says it is highly unlikely that a trial would be this year. He believes it could take about a year and a half.

KX News out of Bismarck, North Dakota reports that Michael Spell and Lester Waters, Jr will appear in court to enter their pleas to the murder charge.

The prosecutor in the case has filed official paperwork that the state intends to seek the death penalty.

Hearings scheduled Tuesday

Arraignment hearings have been scheduled Tuesday for the two men alleged to have kidnapped and murdered Sidney teacher Sherry Arnold.

The hearing for Michael Spell will start at 1 p.m., and the hearing for Lester Vann Waters Jr. is scheduled to begin at 1:30 p.m.

The hearing is for the defendants to officially hear the new charges of deliberate homicide and attempted kidnapping, which were filed April 27.

Originally, Lester Waters and Michael Spell had been charged with aggravated kidnapping while volunteers and landowners searched for Arnold`s body. She was found on March 21, and prosecutors decided to change the charges that the two men faced.

"Previously you appeared on the charge of aggravated kidnapping. Since that time the state has filed a motion to amend the information to the charges against you. I`ve reviewed that affidavit and found there is probable cause to authorize the filing of reprimanded information," said Simonton.

The two appeared in separate hearings. After hearing the charges presented against them, both Waters and Spell were given the option to submit new pleas. Both have pleaded not guilty.

Lester Van Waters Jr. and Michael Keith Spell pleaded not guilty to deliberate homicide and attempted kidnapping charges during their arraignment hearings in Seventh Judicial District Court Tuesday afternoon.

During the hearing for Spell, District Judge Richard Simonton asked the standard questions of if Spell was currently under the influence of alcohol or drugs and if he suffered from any emotional problems. His attorney Randi Hood said there are some issues concering Spell’s competency, but she had explained to Spell what was going to happen during this proceedings.

“I believe he is able to go forward with being able to enter a not guilty plea,” Hord said.

Because it’s a capital punishment case, by law Spell needs to have two lawyers with capital case backgrounds. Steven Scott will serve as Spell’s second lawyer.

Waters’ representation consists of Cynthia Thornton and Gregory Jackson.

Omnibus hearings have been scheduled for July 17 at 2 p.m. for Spell and July 17 at 2:30 p.m. for Waters.

Attorneys for Waters and Spell agreed to have waivers for a speedy trial signed.

Hood said she doesn’t expect the trial to end until late winter or early spring.

The deliberate homicide charge pertains to causing the death of Arnold by either choking her or holding her face in mud or water until she was dead. Potential sentences are death or life imprisonment or imprisonment in the state prison of not less than 10 years or more than 100 years.

The attempted kidnapping charge alleges Waters attempted to restrain Sidney teacher Sherry Arnold by either secreting or holding her in a place of isolation and committed an act of furtherance by operating a green Ford Explorer when Spell grabbed Arnold and forced her into the vehicle. Sentences can be a term of not less than two years or more than 10 years and a fine of not more than $50,000.

Richland County Attorney Mike Weber filed a “notice of intent to seek the death penalty” on each defendant. The notice provides intent of seeking the death penalty upon a conviction.

You're welcome.  The really sad part is, even after the trial and if guilty verdicts are handed down, there will probably be the appeals process.  For the families and friends of victims, it seems to never end.   ::MonkeyNoNo::

North Dakota schools donate plaque in memory of teacher

In a tender display of admiration for the dedicated teaching of Sherry Arnold along with a show of support for local students, 22 North Dakota schools put funds together to donate a plaque in honor of the deceased teacher and also raised an additional $773 to help first-year teachers pay for their Montana teacher’s license.

“It’s to let students know they aren’t alone, even though we are two different states,” Shawn Kuntz, elementary principal in Wishek, N.D., said while presenting the plaque to Sidney’s school officials.

Gary Arnold thanked all the schools involved from the family.

School officials will decide at a later date where to place the plaque so the public can view it at Sidney High School.

The plaque reads, “Grant me the serenity to accept the things I cannot change, Courage to change the things I can, And wisdom to know the difference.”
