A devastating 32-page court filing not only blames defense attorney Joel Brodsky for single-handedly blowing Drew Peterson's murder trial, but paints the lawyer as a delusional, petty, fame-hungry liar.

"Attorney Brodsky expected that Drew Peterson would be his ticket to the legal elite," says the memorandum filed late Thursday. "Regrettably, he was poorly equipped to try a case of this magnitude, resulting in hornbook errors and a smorgasbord of ethical violations."

The memorandum says "Brodsky single-handedly deprived Drew of his right to effective assistance" and claims Brodsky "lied to Peterson, misrepresenting his qualifications, going so far as to tell Peterson that he, Brodsky had successfully tried murder cases and other serious felonies."

Brodsky's motivation for lying was to "elevate his own profile," says the filing, which was penned by defense attorney Steve Greenberg.

While a significant portion of the memorandum is devoted to Brodsky's supposed missteps prior to Peterson's murder trial, it goes on to claim that Brodsky's decision to call Savio's divorce attorney, Harry Smith, to the witness stand was tantamount to "torpedoing" the case.

To win an ineffective counsel claim, Peterson must show that Brodsky’s representation fell below acceptable standards and that the outcome might have been different because of it. It will be an uphill battle, however, given that he had five other attorneys on the trial team, and that courts rarely overturn motions based on legal strategies.

The battle between Drew Peterson’s attorneys escalated Monday as Joel Brodsky claimed his co-counsel Steve Greenberg suffered from mental illness and had an “intimate relationship” with a TV reporter to draw more attention to himself.
 
Brodsky hurled those accusations and others in a court filing responding to a memorandum filed last week by Greenberg that charged that Brodsky botched the Peterson trial by spending too much time chasing publicity for himself and their client and that Brodsky committed a “smorgasbord of ethical violations.”

Greenberg is hoping to overturn Peterson’s conviction for the murder of his third wife, Kathleen Savio, on the grounds of incompetent counsel.
 
Brodsky’s biting rebuttal alleged that Greenberg did his share of chasing the media by leaking sealed documents to a newspaper reporter, and that Greenberg suffered “from a severe mental illness known as pathological narcissism.”
 
Brodsky also accused Greenberg of conducting an “intimate relationship” with a cable TV reporter “which he developed during the trial to get more attention for himself.”

Brodsky’s charges were made in a motion to withdraw from defending Peterson against a wrongful death lawsuit that Kathleen Savio’s relatives filed against Peterson.

Now police have gotten involved in the nasty spat between Drew Peterson’s lawyers.
 
Former lead attorney Joel Brodsky filed a report with Chicago Police after receiving what he called a threatening email Wednesday from his one-time co-counsel, Steve Greenberg.

According to the police report, Greenberg wrote that if Brodsky didn’t withdraw “false allegations” made earlier in a legal filing, “your failure to retract will have consequences.”
 
“This is clearly meant to threaten me, so I notified authorities,” Brodsky said Friday, describing Greenberg as “unstable.”
 
Brodsky, however, hasn’t sought an order of protection against Greenberg.
 
For his part, Greenberg denied anything in his email was a threat, though he hinted at legal action against Brodsky, who has withdrawn from Peterson’s defense team.

Drew Peterson is expected to appear in court Thursday along with his attorney’s for scheduling of post trial motions.
 
Judge Edward Burmila had initially set the January date for Peterson sentencing, but was forced to postponed the matter due to turmoil among members of the defense team.

Peterson judge sets hearings for new trial motion, sentencing

A Will County judge is scheduled to hear Drew Peterson’s motion for a new trial on Feb. 19 and the next day has been set aside for a sentencing hearing at which prosecutors will put on evidence that he also murdered his fourth wife, Stacy.

The judge set the dates this morning during a hearing in Joliet.

The lawyer representing Drew Peterson the longest before his unceremonious departure from the case is trying to keep his financial records out of the public eye.

Attorney Joel Brodsky filed court papers to head off a subpoena for records of his financial dealings with Peterson.

The lawyers still representing Peterson claim Brodsky blew what would have been a successful defense against charges Peterson murdered his third wife, Kathleen Savio. Brodsky did such a bad job, Peterson's attorneys contend, that the convicted wife-killer should get a new trial.

Peterson's attorneys are trying to get their hands on Brodsky's financial records in hopes of showing Brodsky put his interest in making money in the media and entertainment industries ahead of his client's welfare.

According to court papers filed Friday morning, Peterson was "paraded around as a meal ticket" by Brodsky, "not as part of any intelligent, reasonable, well thought out competent legal strategy. He was a prop in support of (Brodsky's) efforts to enhance his own profile."

Judge Edward Burmila gave Brodsky one more week to comply with the subpoena. One of the attorneys still representing Peterson, David Peilet, was optimistic that Brodsky would cough up the records.

The attorney accused by a former colleague of blowing the Drew Peterson murder trial has surrendered his financial records, but lawyers for the convicted wife-killer want even more.

Attorney Joel Brodsky at first resisted a subpoena for his financial records but eventually complied, to an extent. Attorney Steve Greenberg—who still represents Peterson and is fighting to get him a new trial—wants additional documents from Brodsky

"There's still more records," Greenberg said after a Friday morning hearing before Will County Judge Edward Burmila. "Hopefully we'll get them and that will be that."

If Brodsky doesn't cough up the records, Burmila will convene a hearing Wednesday. The judge ordered that Peterson—who has been locked up at the county jail since his May 2009 arrest—be present for the hearing.

CHICAGO (CBS) — Drew Peterson’s former lawyer, Joel Brodsky, thinks he’s found a reason for Peterson to get a new trial.

It concerns attorney Harry Smith, who testified that Stacy Peterson asked him whether she could get more money in a divorce if she threatened to use what she knew about how Peterson killed his third wife Kathleen Savio.

WBBM’s Mike Krauser reports, it was explosive testimony that didn’t go the way Peterson’s lawyers intended.

Smith testified he didn’t warn Stacy Peterson she’d be committing extortion, only concealment of a homicide.

But in an interview with the DuPage County Bar Association, he contradicts his testimony and mentions extortion.

Brodsky caught it and thinks it’s grounds for a new trial.

“I read that article and I almost fell off my chair when I read that quote, literally. It was amazing.”

He’s turned the information over to the current defense team.

The rift between members of convicted wife killer Drew Peterson’s defense team deepened Wednesday with attorney Joel Brodsky filing a defamation lawsuit not only against his one-time co-counsel in the case but also two news outlets, including the Chicago Tribune.
 
Brodsky filed the suit in Cook County Circuit Court against Steven A. Greenberg for writing and circulating a letter alleging, among other things, that Brodsky “single-handedly” lost Peterson’s murder trial.

Brodsky’s lawsuit accuses Greenberg of distributing the 15-page “substantially false” letter, as well as a memo that Greenberg filed after Peterson’s conviction that questioned Brodsky’s effectiveness as counsel in Peterson’s trial for the murder of third wife Kathleen Savio.
 
The lawsuit alleges that Greenberg filed the post-trial memo “to cover up his poor performance during the Savio Murder Trial,” as an attempt to position himself as a media commentator on legal issues.
 
“We haven’t seen the lawsuit, but thinking back to my law school days I believe truth is a defense,” Greenberg said when reached Wednesday afternoon.
 
“You can add that he’s starting to annoy me,” the attorney said.

CHICAGO (AP) - The Chicago Tribune says it'll fight a defamation lawsuit filed against it and others by Drew Peterson's former lead attorney.

In a Thursday statement, Tribune Editor Gerould Kern says the newspaper stands by its reporting. He adds the newspaper, in his words, intends "to defend this suit vigorously."

Patch says it doesn't comment on pending litigation.

The lawsuit states that Patch's coverage contained "false and misleading" information. The lawsuit references Patch Local Editor Joe Hosey's 2008 book Fatal Vows: The Tragic Wives of Drew Peterson, which was later made into the Lifetime movie Drew Peterson: Untouchable starring Rob Lowe.

The lawsuit states that Hosey's coverage for Patch was motivated by a desire to hype the book and film and that he practiced "yellow journalism."
