Judge Rules Casey Anthony's Jail Logs Will Not Be Sealed

Excellent news Trimm!! Now everyone will be watching her visitor log!

Isn't that the truth BooMonkey. If they dumb butts hadn't tried so hard to seal them most everyone would have just read the names every now and then. Now they are going to be watching them like hawks. Makes you wonder about the smarts of the defense. (monkey laugh)

Judge Belvin Perry has ruled that the list of Casey Anthony’s jail visitors won’t be kept secret, Central Florida News 13 reports.

On Monday, Perry “denied a defense request to seal the names of people who visit  Anthony at the Orange County Jail,” anchor Lisa Bell reported this morning. “Her lawyers do not want prosecutors to know which experts are visiting their client.”

Anthony is charged with first-degree murder in the death of her daughter, 2-year-old Caylee.

Overall, Monday wasn’t a good for the defense.

Bell added, “The judge also shot down other motions from the defense regarding the death penalty and forensic evidence.”


Totally expected.

Prosecutors say a 911 call made by Cindy Anthony on July 15, 2008, will show a jury the web of stories Casey Anthony told about the disappearance of her daughter.

Prosecutors want the call heard in court and said the calls could be a key piece of evidence in Anthony's trial.

Anthony is being held at the Orange County Jail on a first-degree murder charge in connection with the death of her daughter, Caylee Marie Anthony. She is being held without bond in connection with the toddler's death and faces the death penalty if convicted.

Anthony's defense team has also filed documents claiming that the 911 call, and other evidence, should not be used during the trial. Defense attorney's said the call is heresy and should not be heard in court.
Caylee's remains were found in December, 2008.

ORLANDO -- Prosecutors in the case against Casey Anthony want jurors in her upcoming trial to hear the now infamous 911 calls made reporting 2-year-old Caylee missing a month after she was last seen alive.

Just days after Judge Belvin Perry denied a series of motions filed by the defense, Casey and her attorneys face the possibility that more incriminating material could be allowed in her murder trial.

It’s just the latest blow to Casey’s defense as they try to keep what they said they consider hearsay out of court.

Prosecutors Wednesday filed documents laying out their arguments for why the jury should be able to hear 911 calls made by Casey’s mother, Cindy Anthony, in July 2008.

Casey’s lawyers have been trying to keep those calls from her mother excluded from the upcoming trial, but according to published reports, prosecutors want those calls allowed as evidence.

The state said it shows a progression of stories Casey told to explain her daughter’s sudden disappearance.

“There’s something wrong. I found my daughter’s car today, and it smells like there’s been a dead body in the damn car,” Cindy said during one of the calls.

Prosecutors said the series of calls Cindy made to 911 lays out a timeline of how Casey created a kidnapping story to cover up her daughter’s disappearance after initially denying that Caylee was missing.

Still, the defense argued the calls should excluded because they are testimonial and hearsay.

It remains unclear when Judge Perry will rule on the motions.

Casey’s murder trial is scheduled to begin in May 2011.

Will the jury at Casey Anthony’s murder trial hear some dramatic 911 calls from July 2008?

Prosecutors want those familiar tapes to be heard by the jury, and that development was a top story on newscasts this morning. No date has been set when Judge Belvin Perry will hear the prosecution’s motions, WESH-Channel 2’s Todd Wilson reported.

Anthony is charged with first-degree murder in the death of her daughter, Caylee. Cindy Anthony, mother of Casey and grandmother of Caylee, is frantic on the 911 calls. The murder trial is scheduled for next year.

“Prosecutors argue that those tapes are critical in the time line of events in the case,” Janelle Jordan of Central Florida News 13 said. “But the defense argues that they should just be considered hearsay.”

Jordan observed that listeners “can certainly tell the difference in tone of voice and intensity as Cindy Anthony continues to make those calls.”

WESH’s Wilson reported, “Prosecutors say that the 911 calls are vital to their case while Casey’s defense team says it’s all hearsay, so let’s exclude them.”

Why are Cindy Anthony’s 911 calls so important to the Casey Anthony case? And why does the prosecution want jurors to hear them?

“Prosecutors say they help show the progression of stories that Casey Anthony told to explain the disappearance of her daughter Caylee,” WFTV-Channel 9 anchor Vanessa Echols said at noon today.

Casey Anthony is charged with first-degree murder in the death of her daughter.

“The state wants to use it [the calls] at trial,” WKMG-Channel 6 anchor Laura Diaz said. “The defense wants it tossed out. Their argument is that jurors are  only allowed to hear testimony under oath. But in papers filed late last night, prosecutors point out statements made by someone under stress can be allowed.”

WKMG played Casey Anthony telling a 911 dispatcher that a nanny had taken the toddler. Diaz quoted prosecutors’ contention that the calls “demonstrate the defendant’s lies about the fate of her daughter” and “demonstrate  consciousness of guilt.”

WESH-Channel 2’s Todd Wilson highlighted that prosecutors say “the calls show the web of stories Casey Anthony told to explain the disappearance of her daughter.”

Wilson reported that no date has been set for the prosecution’s motions on the 911 calls to be heard. WKMG and WFTV noted that Judge Belvin Perry will decide the matter. The murder trial is scheduled to begin in May.

Prosecutors in the Casey Anthony case argued Wednesday that the jury should hear 911 calls made by Anthony’s mother in July 2008.

In a nine-page filing, the prosecutor argues that the 911 calls made by Cindy Anthony help show the progression of stories Casey Anthony told to explain the disappearance of her daughter Caylee.

However, Anthony’s legal team contends that the 911 calls amount to hearsay and should be kept out of her the trial that is scheduled for 2011.

Cindy Anthony’s first 911 call took place on July 15, 2008.  She reported her daughter for a stolen car.  In the second call she states that her grandchild has been missing for a month.

During the third call, Cindy breaks down to tears.  “I found my daughter’s car today and it smells like there’s been a dead body in the damn car.”

The calls show how "the defendant 'created' the kidnapping story after denying there was any problem locating Caylee Marie Anthony," Assistant State Attorney Linda Drane Burdick states. "These fabrications demonstrate consciousness of guilt on the part of the defendant.”

Anthony’s defense team argued that the 911 calls should be excluded because they are “testimonial” and because it is a capital case, “unreliable hearsay evidence must be excluded.”

Anthony has pleaded not guilty against the charges of killing her 2-year-old, whose remains were found in woods in December 2008, months after her disappearance and the 911 calls.

Chief Judge Belvin Perry Jr. said he would rule on the hearsay issue later on in the case.

Will the jury in the Casey Anthony case hear 911 calls made in the Summer of 2008?
The calls were placed on July 15, 2008 when Cindy Anthony finally located her daughter, Casey, and found out her granddaughter was missing.

"There's something wrong," Cindy Anthony said in the call.  "I found my daughter's car today, and it smells like there's been a dead body in the car."

The defense argues the calls are hear-say, but a motion filed Wednesday by prosecutors says they can be used to show Casey made up the nanny kidnapping story.

"She's been my nanny for a year and a half, almost two years," Casey says to the operator.

Prosecutors say Casey never had a nanny and made up the story to cover up the truth: that she killed her daughter Caylee.

There are three calls in all.  The state is asking judge Belvin Perry Jr. to allow jurors to hear the two that were made in presence of Casey Anthony.

ORANGE COUNTY, Fla. -- Prosecutors in the case against Casey Anthony say that 911 calls made by Casey’s mother, Cindy, should be heard during her murder trial.
"There's something wrong. I found my daughter's car today and it smells like there's been a dead body in the damn car," Cindy Anthony said in the 911 call (hear it).

Prosecutors filed a motion Wednesday (read it) to include the calls, saying they help show the progression of stories Casey Anthony told to explain the disappearance of her daughter Caylee. But the defense team says the calls should be excluded because they're "testimonial."

Chief Judge Belvin Perry says he will decide on the issue later on in the case.

The hearing originally scheduled for June 17 has been rescheduled for July 15 at 2:00pm. Also, a status hearing is scheduled for June 21 at 1:30pm. Casey will not be attending the status hearing.

Of course the jury i going to hear the 911 calls.
The defense is crazy calling these calls hearsay.
Why not just throw out all evidence that points to Casey? That seems to be their objective.
She'd still be found guilty....31 days.....

ORLANDO, Fla. (WOFL FOX 35) - Could 911 calls placed by Cindy Anthony in the early days of her granddaughter's disappearance be significant in the proving the guilt or innocence of Casey Anthony? Prosecutors in Casey Anthony's murder trial believe they are and have filed a motion that would allow jurors to hear three of the calls placed in July 2008.
The calls were all placed on July 15, approximately one month after Casey Anthony said her daughter was kidnapped by a babysitter. In the first call, Casey's mother, Cindy, calls to report that Casey has stolen a car and money and hints at first signs of Caylee's disappearance.

"My car was stolen. We retrieved it today. We found out where it was at, retrieved it. I've got that, and I've got afidavits for my banking account. I want to bring her (Casey) in. I want to press charges," Cindy tells an Orlando Police dispatcher.

In that same call, Cindy is heard speaking to Casey saying, "... because my next thing will be down to a child thing, and we'll have a court order to get her. If that's what you want to play, then we'll do it, and you'll never ..." at which time Casey interrupts, "Well that's not the way I want to do it."

In a second, more detailed call, Cindy first reports to authorities that Caylee has been missing for a month. "Casey's there right now?" asks the 911 dispatcher. "Yes, I got her. I finally found her after a month. She's been missing for a month," Cindy responds. " I found her, but we can't find my granddaughter."
About an hour after the second call, Cindy calls back and this time she is frantic and crying. "I found out my granddaughter has been taken. She has been missing for a month. Her, her mother finally admitted that she's been missing."

It is in this third call that a distressed Cindy tells the dispatcher, "There's something wrong. I found my daughter's car today and it smells like there's been a dead body in the damn car!"
Casey Anthony's defense team has argued that the 911 calls should not be admissible, because they amount to testimony or hearsay.
