Arias Judge Bars Public From Witness' Testimony

The judge in the Jodi Arias trial took the highly unusual step Thursday of barring the public from watching the first witness called by the convicted murderer's legal team as she fights to be spared the death penalty.
The day began with dramatic statements from the victim's family members about the emotional and physical trauma they have suffered since Travis Alexander was murdered by Arias in 2008.
Maricopa County Superior Court Judge Sherry Stephens and lawyers then met behind closed doors about the start of Arias' case. They made a decision to keep the public out of the courtroom because a skittish defense witness wanted to testify in private.
An attorney for the Arizona Republic objected, but the judge closed the courtroom anyway.
"This was not an easy decision," said Stephens, who declined to reveal the witness' identity.
The public and reporters were then asked to leave and the trial continued behind closed doors.
The judge said her decision to close the courtroom and seal the witness' testimony until the sentencing trial's conclusion is necessary for "the administration of justice." Stephens allowed the family of victim Travis Alexander to remain in the courtroom.
Chris Moeser, an attorney for the Arizona Republic, argued that the First Amendment allows reporters to attend the hearing and demanded a transcript of the testimony and to identify the witness. The judge refused. Media lawyers are considering additional legal action in response to the judge's actions.
Arias was convicted of murder last year in Alexander's death, but jurors deadlocked on whether she should be sentenced to life in prison or death. A new jury has been picked to decide her sentence.
The case has been marked by secrecy ever since the conclusion of the first trial, which turned in to a media circus as salacious and violent details about Arias and Alexander were broadcast live for people around the world.
Since then, the judge has held one secret hearing after another and barred the broadcast of footage from the sentencing retrial until after a verdict is reached. Arias' lawyers had argued that daily broadcasts of the trial would lead to defense witnesses backing out for fear of being harassed or threatened.
In addition, prosecutors have refused to provide details about what it has cost to twice put Arias on trial, saying the judge forbids them from discussing the case outside court. County officials, however, have reported that Arias' defense bill has topped $2.5 million, all being paid for by taxpayers.

A defense witness in the Jodi Arias murder trial was taken to the emergency room after a wave of online attacks.
The social media floodgates opened after domestic violence expert Alyce LaViolette testified that Arias stabbed her ex-boyfriend nearly 30 times, shot and stabbed him in self defense.
The Arizona Republic reports:
The tweets and other social-media posts began appearing the next week. “You can show your disgust with LaViolette,” they began, and they posted her office phone number and her website, and they suggested that people write negative reviews of her best-selling book on Amazon.com.

The panel granted a stay to the media, which means that Judge Sherry Stephens
cannot exclude the public and the media from testimony until the Court of Appeals rules
on a special action filed by the media. A special action is an expedited appeal.

Unless, someone is in danger, which we kind of are by all that sex talk LOL
but anyhoo, they can't keep the public/media out of the courtroom. We have the right
to know what is going on by the first amendment. All these closed doors are illegal I believe, think figure whatever.

The attorneys in the Jodi Arias murder sentencing retrial met briefly Tuesday to discuss the implications of Monday's Arizona Court of Appeals ruling barring secret testimony until an appeal by the media is decided by the higher court.
The upshot of the hearing, which the jury did not attend, is that there will be no testimony at all until next Wednesday at the earliest.
Last Thursday, Maricopa County Superior Court Judge Sherry Stephens cleared the courtroom as the first of Arias' witnesses took the stand.

After the ruling Monday afternoon, Stephens huddled with prosecutor Juan Martinez and defense attorneys Kirk Nurmi and Jennifer Willmott and then announced that they had a difference of opinion. On Tuesday morning, they discussed the "difference" in Stephens' courtroom.
Nurmi said the "media interference thrust upon" Arias was unconstitutional. He told Stephens that he did not want to call any witnesses until the matter was decided by the Court of Appeals.
Martinez asked that the trial go on. Stephens suggested that Nurmi could either call back the secret witness and continue that testimony in open court or he could call another witness out of the planned order.
But no decision was made.
Stephens said there will be no witnesses today (although there will be a court hearing of some sort) or Thursday. Monday and Tuesday the courts are closed.

Appeals court lifts cone of silence on Jodi Arias trial
The Arizona Court of Appeals today barred Maricopa County Superior Court Judge Sherry Stephens from holding any more secret testimony in the trial to determine whether Jodi Arias should live or die.
The panel granted an injunction at the request of The Arizona Republic, 12News and other media outlets. This, after Stephens last week unceremoniously kicked the public and the press out of her courtroom

Court grants media's request in Jodi Arias case
) - Just a few days after Judge Sherry Stephens kicked out the media and the public from the Jodi Arias sentencing retrial, a state appeals court overruled her and opened the courtroom doors once again.
That decision came down this afternoon after a dramatic legal battle Monday morning before a three judge panel.
The judge booted the media and the public out of the Jodi Arias sentencing retrial last Thursday without explanation; leaving a mystery witness on the stand in a trial shrouded in secrecy.
The attorney representing the media told the appeals panel that holding a trial out of
public view behind closed doors and shrouded in secrecy is
something that hadn't been a part of the anglo-American legal tradition since the days of the Norman Conquest of England. That was way back in 1066, nearly 1,000 years ago.
His message to the three judge appeals panel; let folks back in, and journalists too, to see what is going on.
But Jodi Arias's attorney countered that he needs a private trial,
he can't get his witnesses to testify because they fear for their reputations, livelihoods, even their lives if they defend Jodi in public court.
"We have just heard the risk of being kept in perpetual confusion, and darkness looms in this case unless the court steps in and enforces the first amendment rights of the press and public," said David Bodney, the attorney for the media.
"All mitigation witnesses; to the point where no viable case can be put forward, were threatened to the point they would not come forward and testify, and all defense witnesses were threatened," said Kirk Nurmi.
The courtroom opened up this afternoon but ended soon after that.
Court is back in session Tuesday afternoon for a hearing and the media and public will be able to attend in person.
