Casey Anthony asking that murder charge be dropped

ORLANDO, Fla. (AP) -- A judge has dismissed a request to throw out the most serious criminal charges against a Florida mother accused of killing her 2-year-old daughter.

Circuit Judge Stan Strickled ruled Friday that a motion filed by Casey Anthony's attorneys did not meet the requirements needed for a dismissal of the first-degree murder and aggravated child abuse charges.

In an earlier filing, Anthony's attorneys had said the charges were based on "circumstantial and speculative" evidence.

During a brief hearing Friday, prosecutor Linda Drane Burdick said the defense attorneys' motion was insufficient and riddled with errors.

Anthony has pleaded not guilty and says a baby sitter kidnapped Caylee. The toddler's remains were found in December 2008, months after she was reported missing.

I just need to vent..still reading the depo's released yesterday.  Ashton keeps asking ?'s using Caylee by name, and george keeps answering "the child, or grand daughter".  Talk about disconnect!! Pi$$es me off. Tens of thousands of oppertunities he has had over the past year to say her name, and just refuses to.

It is beyond frustrating, and I just don't get it, the two of them just go about and have no shame, I will never understand this. I read some of the depos and just got to disgusted to go on  I just can't believe that something didn't happen in that home sooner, I'm shocked at some of the things said.

I'm not a healthy gal these days so I can only handle a certain amount of this stuff or I'll pay for it dearly. Plus Nick will tan my behind. I have a friend that is the most patient person I know and a lot of it makes her so upset. These people keep on making the picture more and more disgusting and just don't care. It's beyond heinous.

They can't say Caylee's sweet name and make it more personal...they can't make that connection and get close to the guilt and shame.

I can't believe something didn't happen in that home sooner either.

ORLANDO, Fla. -- A judge has ruled to dismiss a request to throw out the most serious criminal charges against Casey Anthony, who is charged with murder in the death of her daughter, Caylee.
Anthony's attorneys had asked that first-degree murder and aggravated child abuse charges against Anthony be thrown out, claiming they were based on "circumstantial and speculative" evidence.

During a brief hearing Friday morning, the prosecution argued that the motion filed by Casey Anthony's attorneys was riddled with errors and insufficient.

"While the lengthy motion is both thoughtful and interesting, it does not meet the requirements of Florida Rule of Criminal Procedure 3.190(c)(4), which allows a defendant to move for dismissal alleging that there are no material disputed facts...while certain facts are undisputed, the bulk of the material facts are disputed," Judge Stan Strickland wrote in his ruling.

Anthony has pleaded not guilty and says a baby sitter kidnapped Caylee.

More than 1,000 pages of transcribed depositions with members of Anthony's family were released Thursday night.

Casey Anthony's mother, Cindy Anthony, and brother, Lee Anthony, were also questioned under oath by the prosecution. The depositions took place several months ago.

Judge won't dismiss charges against Casey Anthony

ORANGE COUNTY, FL -- Casey Anthony was back in court Friday morning for a hearing in her first-degree murder case.
The 23-year-old mother is accused of murdering her 2-year-old daughter, Caylee.

The courtroom was packed for the hearing. Casey, wearing a turquoise outfit, smiled at her parents as she entered the room.

Orange County Circuit Judge Stan Strickland dismissed a defense request to throw out the most serious criminal charges against Casey.

He ruled the motion did not meet the requirements needed for a dismissal of the first-degree murder and aggravated child abuse charges.

In an earlier filing, Casey's attorneys said the charges were based on "circumstantial and speculative" evidence.

During the brief hearing, prosecutor Linda Drane Burdick said the defense attorneys' motion was insufficient and riddled with errors.

Strickland also granted a request by prosecutors that defense attorneys turn over evidence they found in their own investigation. They have until February 1 to do so or explain why they can't.

Previously, one defense attorney said Casey's lawyers have evidence that can prove their client is innocent.

Last week, prosecutors released more evidence in the case, including pictures of a tattoo on Anthony's back and duct tape, which was located on her daughter Caylee Anthony's body.

Caylee Anthony's remains were found in December 2008, months after she was reported missing.

Casey has pleaded not guilty. She says a baby sitter kidnapped Caylee.

The state wants the death penalty for Casey, who remains in the Orange County Jail.

In Session was just talking about if this case has become less visible and the reporter in Orlando Rosie Franco stated that George has been very visible and open about his contempt and disdain for LE and that Cindy and her Lawyer have be actively shopping a book deal.

Yes, when I walked into the courtroom, there were no seats open to the right. Gosh darn, I had to sit next to Holly Bristow. Brad came in moments later and parked next to me. During the hearing, we exchanged a few pleasantries and I offered a professional opinion on a possible solution to shipping a CD of images, which include autopsy photos. After the hearing, I was held back by 2 bailiffs, but I got Brad’s card. I have something confidential to give him and darn if I didn’t leave it in the car. He was a nice guy.

There is so much more I want to say, but it will have to wait until I gather my thoughts and write it down in a post. I will say that, yes, the judge called me up to speak to me after the hearing. That is an absolute fact. I must be very articulate when I write about that meeting.

I read a lot of books.  For instance, Mark Fuhrman's book arrived today.  I will read soup can labels, I will read anything except fiction.  But if anyone connected to the murderer in this case writes a book, that is one book I will never buy or read.  I will  not donate money to their blood money fund.

I saw that on TV. My first thought was, "It's too bad Caylee can no longer giggle like that."

It upset me. Casey should never be able to enjoy a moment again.
