Casey Anthony Awaits Grand Jury Decision On Possible Charges

ORANGE COUNTY, Fla. -- Monday night could be Casey Anthony's last night of freedom. Eyewitness News is digging into the case against Casey and has obtained new inside information about Tuesday's grand jury testimony and how soon she could be re-arrested.

Tuesday's grand jury testimony will be behind closed doors, but sources are revealing more information to Eyewitness News about what will happen.

Casey Anthony's mother Monday accused prosecutors of playing politics and rushing the case to the grand jury before the November election, but Eyewitness News was told there are more important deadlines, legal ones, steering the strategy.

Casey could've pleaded guilty to child neglect to try to close the case before more serious charges were filed. Taking it to the grand jury stops that.

"Are you nervous about the grand jury?" WFTV reporter Kathi Belich asked Casey Anthony on Monday.

Casey didn't answer as she rushed to her weekly jail. She was not wearing her big white stolen sunglasses, either.

Casey's father George, a former sheriff's deputy in Ohio, will be one of the key witnesses against her Tuesday before the grand jury.

Casey's mother came to the jail Monday, as well, complaining that investigators are no longer accepting tips about Caylee.

"I'm worried for my granddaughter. Casey is gonna be able to defend whatever is out there right now, because it's just purely circumstantial evidence. I'm worried for Caylee. I found out they are no longer taking tips on my granddaughter," Cindy Anthony told Eyewitness News

Eyewitness News has learned the grand jury will hear from half a dozen witnesses Tuesday, investigators from the Orange County Sheriff's Office and the FBI, FBI lab specialists and Casey's father. The grand jury will hear how investigators found high levels of the potentially toxic chemical chloroform in the trunk where they say Caylee's body had been.

If the grand jury indicts Casey for murdering her daughter Caylee, prosecutors would very likely drop the child neglect charge against her, because she couldn't be charged with neglecting Caylee by not reporting her missing if she had already killed her.

Depending on what the grand jury does Tuesday, Casey's visit to her lawyer's office Monday could be one of her last and Monday night could be the last night she spends at her parents' house.

But what about the other post concerning the person that had an exclusive on the dress photo?  That said they were not a member of TES...so which is it?  I don't think Tim would have said yes if it wasn't one of his group.  Then again, if it was a volunteer you can't always get reputable searchers...that would not be Tim's fault.  It was the despicable person that did the deed.

Some people will do anything for attention....I feel badly that Tim has been put in this position... I love that man!

ORLANDO, Fla. (WOFL FOX 35) -- An Orange County grand jury is expected to look at evidence in the Casey Anthony case on Tuesday.  They will decide if there is enough to charge her in the death of her daughter, Caylee Anthony. 

It is unknown whether or not the grand jury will take up the case in the morning or the afternoon.  FOX 35 will carry breaking news if and when a decision is released.  It is our plan to carry court action and news conferences live on the air and streaming through MyFoxOrlando.com.

The State does have some damning evidence, but investigators still have not located a body.  While prosecutors feel confident that they can indict Casey, her attorney,  Jose Baez, believes the missing toddler is alive.  The State only has to prove that there is probable cause in the murder of Caylee. Ultimately, it will be up to fifteen people to decide.

VIDEO: How the grand jury process works

The grand jury is expected to hear from several key people, including Casey's father George, who will testify to what he told investigators about the smell of death in the trunk of Casey's white Pontiac.

"We got into a little verbal thing.  She didn't want me to go into the car," George said of Casey in an earlier interview.

The grand jury will hear about the air samples taken from the Pontiac which indicated human decomposition.  They will also hear about evidence of chloroform discovered during the investigation.   Reports from lab technicians will shed light on hair samples and stains found in the trunk of the car.

Sources close to the investigation tell FOX 35 that several representatives from the Orange County Sheriff's Office are also expected to go in front of the grand jury.

Baez released a prepared statement to the media when pressed for Casey's state of mind leading up to the grand jury's ruling.

"Casey Anthony has been prepared for the worst, but has always been hoping for the best. Although she would be naturally nervous and very upset about going back into confinement, she is prepared and has been for that if it happens."


New lead attorney for Casey?

Should Casey face a homicide charge, she could be going to trial with a new lead counsel.  FOX 35 has learned from the president of the Criminal Defense Attorney's Association that Baez might not be permitted to represent Anthony in a first degree murder trial.

Richard Hornsby said Baez does not meet the standards set forth by attorneys in capital cases.  To be lead counsel you must:

have had five years experience as an attorney
served as co-counsel on two death penalty cases
demonstrated proficiency and commitment which exemplify quality representation in capital cases
However, Baez could still be part of a legal team.   Todd Black, spokesperson for Baez, offered this response on Monday:

"It will not change the commitment of the Baez Law Firm and they are fully prepared if an indictment is handed down to represent Ms. Anthony to the fullest."


FOX 35 interviews Cindy Anthony

In an exclusive sit-down interview, FOX 35 reporter Holly Bristow asked Cindy Anthony, mother of Casey,  what she planned to do while the grand jury met on Tuesday.   "I'm going to be wherever Casey is," she said.  "I want to make sure if she's re-arrested, that I'm able to give her one last hug, in case I can't do that for a while."

When asked circumstantial evidence which could be presented to the grand jury, she responded,  "George is not concerned. I am not concerned.  We're just gonna pray that people have the right sense tomorrow to listen to what they have," she added. 

When asked if she ever had any doubts about her daughter's innocence, Cindy responded emphatically, "No!"

But Nancy, we`ve got to understand one thing. There`s been several articles of clothing found during this search effort. Many of them were sent off to a lab for analysis, and this one is being sent off also. So...

GRACE: OK, Tim Miller, let me ask you a couple of questions. Was the article of clothing a dress?

MILLER: Yes.

GRACE: OK. Was Caylee Anthony known to have a similar dress at one time?

MILLER: Yes.

GRACE: Was it a child`s size 6?

MILLER: Yes.

GRACE: Would a child size 6 be the size a 2 to 3-year-old girl would wear?

MILLER: I don`t think so. I`ve got my doubts on this. But you know, law enforcement`s doing their job...

GRACE: Well, according to our research, the answer is, in fact, yes. A child 2 to 3 years old would wear a child size 6, but it really depends on Caylee`s height and size. Tim Miller, where was the dress discovered?

MILLER: Well, it was alongside a road. It was a wooded area. It was laying in the bushes and...

GRACE: Was it near the Orlando airport?

MILLER: It was in an area where the -- of interest, where cell tower activity was happening.

I couldn't sleep i thought of this and wanted to share it with you..Remember lp saying that casey went back to the area by the airport after calling jcp? Well maybe she put the body there on the night of the 26th. Then she was feeling guilty about the way she left caylee and called jcp's to get a dress that she loved caylee in but in a bigger size..She went back and couldn't find the body to put the dress on and disposed of the dress..Had to share so i can sleep

Alright.. I'll post one more comment 

I was actually thinking of this myself.. although I still say a size 6 dress sounds a bit large for a 2 1/2 yr old child, maybe (IF this is related to Caylee) she bought a larger size because the body would maybe have bloated a bit..  OR it would be easier to get a larger size dress on a dead child? I don't know..  I really don't. But it could make sense.  (although wouldn't it be easier just to go to JCP and buy it there?  )

My granddaughter turned 8 last June and just now wears a size 6 but she's very petite.   But can you even imagine trying to put a dress of any size on your child's dead ?  If she did that, that's got to be beyond evil.  I keep trying to figure out where the line is between being evil (sociopath/psychopath) and being insane.  Seems like they cross to me.  And everything Casey did seems insane & from an altered reality.
