Mason says he is concerned that the FBI is not cooperating with the defense. He says they are now saying they will not testify without permission from the US Atty's Ofc

here's a summary from WS for those that missed the mess hearing this morning

 
Summary (as posted in order) by GABE @ WESH:

1. Michelle Medina bringing up the video conf motion

3. Medina says hourly rate of video conf vary depending on location of expert

4. But there's no established rate, she says

5. Court reporting offices are used for the video conf.

6. Some cost $125/hr. Others are 140 she says.

7. JP wondering how much plane tickets are

8. They can't reserve video conf until there is an order

9. JAC says there is a statewide rate of $100/hr

10. JP wonders if JAC looked at intrastate rate. The 100 is based on in state

41. LDB is wondering why one of the people is testifying about the K9 issues.

42. Says she was surprised that he was included

43. LDB has no obj to moving the motion to end of March.

44. Dr. Furton (sp?) will write a report on the cadaver dog issue, says JB

45. Perry says he will look at depos and summarize them.

46. He also has the expert reports.

47. If they start to testify to something that no one has mentions, he will likely strike that testimony

48. This is being recorded by a pool camera. Video will be available later.

49. This is just scheduling

50. Ashton wanted his motions to strike heard next week

51. JB says it makes more sense to hear the actual motions and the motions to strike at the same time, at the Frye hearings

52. Ashton suggests in the motion that the two pieces of evidence are not relevant for Frye hearings.

53. He's saying the motion itself from defense doesn't meet Frye

54. That's why he wants motions to strike heard first, before the Frye hearing.

55. Frye hearings are 23-25, I believe.

56. JB says-- Is this opinion? Or opinion based on scientific value?

57. I looked earlier this week sunshine, they are. I'll look again later.

58. Perry says he will hear the motions to strike next week.

Why would there be mitigating things, if she is found guilty, if they say she is innocent????  If she were innocent, they would just say we do not agree with the verdict, but how do they go from her being innocent, to conceding the verdict and giving reasons she may have comitted this crime and so she should get leniancy?

The Justice Administrative Commission has already paid out $41,654.69 for Anthony's defense.

Chief Judge Belvin Perry this morning approved additional payments to help defend accused killer Casey Anthony.

During a brief hearing, Perry approved $4,500 for mitigation-expert costs and videoconferencing for expert witnesses.

Anthony, 24, is charged with first-degree murder in the death of her 2-year-old daughter, Caylee Marie in 2008.

The child's remains were found in a heavily wooded area off Suburban Drive in late 2008 months after the child was reported missing.

Anthony's trial is scheduled for May. She faces the death penalty if convicted.

Also Friday, court officials revealed several details about the trial at a hearing for the media.

Court officials said that while there will be public seating available at the trial, there will be a ticketing process. Details on the ticketing process were not released.

Officials also said that if Anthony is found guilty, Perry does not intend to take a long break before a penalty phase, if there is a break at all.

Anthony was not present at Friday's hearing.

The case heads back to court on March 2 for a status hearing. WESH.com will stream the hearing live.

Perry said Friday he would hear two motions to strike at the hearing from the prosecution regarding two pieces of evidence -- chloroform and root growth around the area where Caylee Anthony's remains were discovered in December 2008.

Jury selection for the trial is scheduled to begin May 9.

ORLANDO, Fla. -- The judge in the Casey Anthony murder case on Friday approved more money for her defense team.

Judge Belvin Perry said video conferencing would be a cheaper alternative to flying in experts to testify and approved an hourly rate averaging of $100 to $200 per hour.

Perry also granted an additional $4,500 for a mental-health expert to conduct additional interviews with family members. Anthony's defense attorney, Jose Baez, said the defense is near its $2,500 cap and needed more money.

The funds will be used to explore "mitigating factors" if Anthony is convicted and faces a possible death sentence.

Ashton made it clear to CJBP that the FBI is not being obstructive, they were just served a week ago.   Mason attempted to make it sound like they are refusing to be cooperative.   CJBP said if he cant make rulings he might have to suppress statements.
