Judge wants a narrow focus on here say.  Jar wanted the State to be schooled on here say.  I think they already have that under control.  The state isn't likely to call, hmmmm, say Joy Wray or somethin' like somebody else might...

I'm just not sure on this, there would be no reason to bus jurors if the trial would be in another county.

ORLANDO -- Chief Judge Belivin Perry said he will grant the change of venue motion at the appropriate time.

Updates from the courtroom:

9:50 a.m. - Perry will defer a decision on the photos until no later than March 31, 2011.

9:39 a.m. -- Perry moves on to the motion to exclude Casey's party photos from case.

9:34 a.m. -- Judge Perry says he will grant the change of venue motion at the appropriate time.

9:28 a.m. -- George and Cindy Anthony arrive at the courtroom.

9:20 a.m. -- Defense plays compilation of media reports showing how he says the media has unfairly showcased his client.

9:17 a.m. -- Judge Perry said he'll most likely grant a change of venue. Once the judge picks a location, he will tell the attorneys and then place a gag order on them.

Several counties will be considered, and comments from the defense and state will be taken when selecting a site.

Perry said the jury will be sequestered, brought back to Orange County and kept an undisclosed location. They will then be transportated back and forth to whatever county they reside in to spend the night.

After the attorneys are notified about the change, a gag order will be issued.

Defense Attorney Jose Baez wants to send the case to South Florida – in either Miami-Dade or Broward counties.

He said there's been far too much publicity surrounding the case and that it'd be hard to find a jury that hasn't already heard about Anthony, much less developed their own opinion about her.

That would mean moving some 200 witnesses, a judge and court personnel and dozens of investigators for possibly a month.

Legal experts said that could cost tens of thousands of dollars.

Perry has already said it'd be cheaper to hold it here and bring in potential jurors from outside the county.

They would then be sequestered, which legal analyst Richard Hornsby said would hurt the defense.

"Once you start telling people that you are going to have to live in a hotel for three months, people who might want to be on your trial and be more defense friendly will say ‘I can't put my life on hold,'" Hornsby said.

Defense attorneys believe the story has gotten considerably less air time in South Florida.
Perry will also look at other motions this week, like defense objections to the death penalty, which Anthony faces after being charged with killing her daughter.

Her trial is still set for May 9, 2011.

Casey Anthony's attorneys do not think their client can receive a fair trial in Central Florida. Her case has attracted intense media coverage since her initial arrest in July 2008.

"The Orlando community's involvement in this case and its hostility towards Miss Anthony create an environment in which it would be difficult for a juror to render a verdict based solely on the evidence presented at trial," Baez wrote in a motion filed in September.

Perry earlier told the attorneys if he grants the change of venue that he and the lawyers will travel to another Florida county to pick a 12-member jury plus alternates.

The jury will leave their families and come to Orange County where the trial, which is expected to last four to seven weeks, will be held.

Perry said today he will grant the motion at a later date and will be issuing a gag order so the attorneys cannot discuss the matter publicly.

I think His Honor mis-spoke when he said "venue" ... The way I understand it is the jury will be from out of town, trial in Orlando, sequestered jury.

I think what he will rule on later is where the jury will be brought to Orlando from.

ORLANDO, Fla. -- Jurors in the trial of a Florida mother charged with killing her 2-year-old daughter will be picked from outside Orlando after attorneys argued residents there were tainted by negative media reports.

Chief Judge Belvin Perry ruled at a hearing Monday that the 12 potential jurors and six potential alternates in Casey Anthony's trial will be chosen from somewhere in Florida outside Orlando.

The judge says he will tell attorneys when he decides where to hold the trial, but that information will be kept secret until just before the trial begins.

Anthony has pleaded not guilty to murdering her daughter, Caylee, and said a baby sitter kidnapped the toddler. Her trial is set to start in May 2011.

Casey Anthony is in court today as her attorneys and prosecutors hash out a string of legal motions — some of which have been lingering in the court file for months.

Orange-Osceola Chief Judge Belvin Perry cleared his calendar for today and Tuesday to hear arguments on various topics, such as from where the jury will be selected to whether the death penalty is unconstitutional.

This is part of the judge's effort to keep the case on track for trial in May 2011.

Casey Anthony, 24, is charged with first-degree murder in the death of her 2-year-old daughter, Caylee Marie. She is in court this morning with defense attorneys Jose Baez and Cheney Mason. Casey Anthony's parents, George Anthony and Cindy Anthony, are also at the hearing.

It hasn't been the typical murder case. It started out as a missing-child case after the toddler was reported missing in July 2008.

In October — with no body found — a grand jury indicted Casey Anthony on first-degree murder. At that point, the state elected not to seek the death penalty.

Two months later in December, Caylee's skeletal remains were found less than a mile from her family home in east Orange County. A medical examiner ruled her death a homicide but could not say how the child died.

By April, prosecutors changed their minds, announcing they were going to seek the death penalty against Casey Anthony.

Experts say death cases are different. It involves more of everything —more trial preparation, more expenses and more motions filed.
Today, Perry has seven motions on various topics set to be argued. Tuesday's hearing will focus on death-penalty motions.

Here's today's line-up:

• Change of Venue

Casey Anthony's attorneys do not think their client can receive a fair trial in Central Florida. Her case has attracted intense media coverage since her initial arrest in July 2008.

"The Orlando community's involvement in this case and its hostility towards Miss Anthony create an environment in which it would be difficult for a juror to render a verdict based solely on the evidence presented at trial," Baez wrote in a motion filed in September.

Perry said the jurors will be brought back to Orange County and be kept in an undisclosed location.

He also predicted that the media will start inquiring with other counties to see if Perry has called those circuits to gather information. Perry said he will instruct the court administrators in other circuits to not discuss the matter with reporters.
Casey Anthony's defense wants people who live in Miami-Dade County to be chosen for the jury. Baez argued that South Florida residents haven't been exposed to as much "inflammatory" media as other parts of the state. He doesn't want jurors from north Florida, such as Duval County and Pensacola, because of similar murdered children cases and he said, the demographics don't match.

Prosecutors argued that jurors should come from any county that has similar demographics as Orange County. Assistant State Attorney Linda Drane Burdick provided information on various counties, such as Hillsborough, Leon, Duval and Miami-Dade counties.

•Jail logs

Casey Anthony's attorneys want the judge to keep the list of names of people who visit her in jail private. Visitation logs are public record unless sealed by a judge.

Her legal team claims the media is "constantly aware of any visits that the defendant has." The identity of certain defense experts who see her in jail can spawn "unfounded speculation." That hampers the defense's preparation for trial.

Today, Mason told Perry this motion will need to be argued at a later date.

•Party Pictures

After Casey Anthony's arrest, dozens of pictures taken from various online social-networking sites have emerged and portray her as a "party girl." The photos show the young mother partying with friends in local nightclubs, bars and wild house parties. Most of the pictures were taken before Caylee disappeared.

Her defense fears if the prosecution presents these photos to a jury it "would serve no purpose other than to further inflame the jury against Miss Anthony." Her attorneys call these photos irrelevant to the case and want prosecutors — if they have plans to use them — to show why they are material.

Perry did not rule on the motion today, but said the matter will have to be addressed before trial.

The judge said the state and defense will have to determine which party photos will be used by the end of March. Perry said that's when he will hear arguments about the pictures and rule.

"I have some concerns about some of the photographs," Perry said. "It's hard to rule on these in a vacuum without hearing both sides."

Baez argued that the photos of Casey Anthony at parties is not relevant to the case.

"They prove absolutely nothing as it related to charges against Miss Anthony," Baez said.

He said it's not fair to use the photos to prove whether she was a good mother or not.

"It's clearly to paint Miss Anthony in a bad light," he said.

Meanwhile, Burdick argued that prosecutors plan to use the photos taken after June 15 to show what and where Anthony was after her daughter was last seen.

Prosecutors divided the photos from picture taken before June 15, 2008 and after that date.
Burdick said if the defense tries to argue at trial that Anthony was a good mother, the state may use some pictures to address that issue.

•Gossip and Innuendo

Her legal team want to keep out dozens of statements about Anthony and her family made by friends and family — statements the defense contends are hearsay. Her attorneys also don't want prosecutors questioning Anthony's friends and acquaintances on the stand about her truthfulness and motives.

•Other people's opinions

As part of the case, investigators have questioned dozens of people who know Casey Anthony. These friends and acquaintances offered their opinions of Casey Anthony's character, motives and undisclosed intentions and character of truthfulness. These opinions should not be admissible in court, her attorneys argue.

There were two motions related to lay-opinion testimony and hearsay evidence.

Perry said the issue will be addressed later. He asked the defense to narrow the focus to the hearsay items that gives them greatest concern.

He also is going to reserve ruling on issue of 911 calls made by Anthony's mother, Cindy Anthony.

•Toss indictment

Her attorneys argue in a motion that Casey Anthony was indicted on several charges, including premeditated murder and criminal neglect of her daughter. But they say there is so little information on the indictment that the legal team can't possibly defend her.

Casey Anthony's legal team has continued to ask for various records, including documents from various forensic labs, communications between law enforcement officials and those labs.

It's unclear what information they are seeking in this legal request.

So there will be a change of venue....it was very confusing the way it was worded.........and he will place a gag order on the attorneys.........this surprises me....

I never saw IKEA photos, but, Casey and Caylee went with some guy, darn it can't remember his name, they went it IKEA and had lunch somewhere after. It is a fleeting memory, and I don't know where to look. Waters, or Walters the guys last name?

July 5 Casey returned to Will Waters apartment at about noon and they spent the afternoon together, had lunch and did some shopping at IKEA, a furniture store. He said she talked about Caylee as if she were alive. Will’s version of events do not match with Casey’s cell phone record. According to the records, Casey and Tony talk on and off during the party (this is when Tony was telling her he may not come back to Orlando, etc, to “get a rise out of her”. Stupid junior-high school stuff.) They talk for the last time on July 5 early am between 1:51am and 2:16am. She then exchanges text with Will until 2:55am, then no activity until 6:39am when she texts both Will and Tony in the same minute. From 5:00pm to 6:20pm she talked to Will on the phone right up to the airport gate, where she was to pick up Tony.

Things I noticed:

As KC was leaving (you couldn't see her face) but you could tell that she looked at Mom and said something...you have to really be paying attention because it happens very quickly.

KC and George and Cindy ALL look very sedate, somber.  VERY different from the last time they were all in court together and KC was fidgeting with herself and Cindy was fidgeting with her cell phone.

George looked in a bad mood to me...the body language expert said that George looks so defeated...to the point that you can't be more defeated without crying.  She also said Cindy looked very defeated.

Put that together with how quiet KC's become...I'm beginning to wonder what big event happened just before or just as Judge Perry took over.  Is it that they got Perry for their new judge or did something new come to light for the defense team?  EVERYONE's demeanor has vastly changed.

After court, Conway was asked why Cindy & George wasn't at the last court appearance.  He made a VERY WEAK comment about it was only and administrative thing and C&G can't always make it to court.  HELLO?!?!

Something was going on...I'm wondering if George isn't having more problems and because of that they couldn't make it last time....and that KC knows about it....the reason why she acknowledged her parents in court for the first time in a year and a half!!!

I predict now that Andrea Lyon will NOT be hovering around and hugging on KC tomorrow in court. 

I don't know how to put it into words, but I think something...almost something grave...has happened lately and that's the reason for all the somberness.  Because George looks the worst, I tend to wonder if it doesn't have to do with him...his health.

Yes, they do and they've helped orchestrate what they'd like the answers to be, too. At this point, I don't honestly know if they care as much about what happens to Casey as they do about making a good living for the rest of their lives by inserting themselves in this lucrative drama!

They certainly don't mind going a long time without seeing her, but get word to them that a camera is being turned on, and wild horses couldn't keep them away!

ORANGE COUNTY, FL -- When Casey Anthony's murder trial finally begins next year, the jury hearing the case won't be from Orange County.

At a hearing Monday Chief Judge Belvin Perry said jurors will be picked from outside Orlando and then brought back to Orange County for the trial.

“The jury will be sequestered. They will be brought back to Orange County. They will be kept at an undisclosed location," Perry said.  "I will be entering a gag order. I will be doing that at a sufficient time."

Casey's attorneys had argued that Orlando-area residents had been tainted by negative media exposure.

Perry said once he chooses a location, he will let attorneys in the case know and then seal the information until right before the trial.

Casey is accused of murdering her 2-year-old daughter, Caylee Anthony, in 2008.  The toddler's remains were found almost six months after she went missing.
Judge Perry deferred ruling on a defense request to have pictures of Casey partying around the time Caylee vanished.

“The state and the defense, since you are required to exchange photos with each other, I’m going to give you till March 2011 which photos you are intending to use. We shall have a hearing no later than the 31st of March to go over those photographs and hear any other arguments you might have, Perry said.                       

Casey has pleaded not guilty to the first degree murder charge.  She said a baby sitter kidnapped the girl.

Her trial is set to start in May 2011.

The attorneys better get their stamina built up.  The jury will be sequestered. Perry ruled last time that court will be 5 1/2 days a week.  The judge let us know today that they are to get all issues settled before trial date so as to not be making arguments while the jury sits in another room waiting on the attorneys.

Oh...and...wasn't it delicious when Perry told Mason that he will NOT be having any mini trials!!   ::MonkeyTongue::

I'm at work and haven't neen able to watch the video.
From the pics I have seen, Georgette looks really pissed (not defeated).
I don't know what more truth the A's need. George knows the truth and has only known.
I think he's angry that he went along with the propaganda and it's eating him up inside.
He most likely can't tolerate the sight of Cindy and is probably now disgusted with his crazy spawn who accused him of molesting her.
The truth is biting these people in the arse and they still don't see it.

Just because a case goes to trial, doesn't mean the truth will come out.
I don't think Cindy will lie during trial. Don't ask me why. I just don't think she will. She knows enough know tho just answer the question she's asked and not to expound on it. She wasn't afraid of Morgan, but in judge Perry's courtroom, I think all her bravado will be gone.

I now wonder even more where they were last hearing. Conman is a liar, liar pants on fire.

Just returned from the hearing. The line to get in the courthouse was out the door this morning which may explain why the Anthonys were late. Couldn't believe my eyes when I saw KC acknowledge her parents. There were probably 30 empty seats in the courtroom. In my opinion, the jury could be picked in Orlando. Public interest in Orlando is practically nil. It may be in the newspaper and on the news, but people don't talk about it and as evidenced by the empty seats, not many care one way or the other about KC and her problems.  FROM WS   and I agree curly, George looks pizzed just like his daughter.

Thanks for that!!  It's clear now.  First she & Amy help him get ready for his party by going to Target for a few things on the 4th; Then she talks with Tony during his party on the 5th.  Then he & she eat at Zaxby's, go to Target again for bubblegum & coffee, and then on to IKEA, as he wants new stuff for his apt. and she pretends she's going to need stuff as she & Amy are going to be living together and will be buying new stuff.  [ What a con ]... All the while she is pretending to Waters that Caylee is with  Good Ship Lollipop Nanny.

He really had a big time crush on her- she knows how to mentally seduce;  IMO, she thought she was going to lose Tony, and as is most likely her style, imo, she lines up a spare guy to have waiting in the wings. just for this possiblity ---  and, I wonder who "Na-Naw" could be?

Casey Anthony stared straight forward and showed no emotion as her attorney, Jose Baez, told judge Belvin Perry Jr. that racy party pictures should be withheld from the jury.
Just because she's drinking a beer doesn't mean that her child is not well taken care of," he said.

Defense attorneys and prosecutors have divided the pictures into two categories, those taken before Caylee went missing(June 15, 2008) and those taken after.

The defense said neither group of pictures should be allowed in the murder trial.

"They prove absolutely nothing," Baez said.

But state attorney Linda Drane Burdick said both photo groups could be used in court.  She said the photos taken before June 15 could be used to dispute claims that Casey was a good mother.   The second group could show what Casey was doing during the time that her daughter was missing

"She has made statements to law enforcement that she went to clubs during the time frame... looking for her daughter," Burdick said.  "The photographs clearly disprove that assertion."

Judge Perry will decide which pictures jurors will see when it gets closer to the trial date now set for May 9, 2010.
Other motions

Perry granted a defense motion for a change of venue, saying he'll pick jurors from another county and sequester them in Orlando for the trial.  The defense had asked to move the trial to south Florida.

Motion to dismiss grand jury indictment was denied.

In a hearing Monday, Judge Belvin Perry decided to order a jury be selected elsewhere and brought to Orange County for Casey Anthony's murder trial.

"The defendant's motion for change of venue will be granted at the appropriate time. I will enter an order prior to us proceeding to somewhere in the state of Florida to select a jury. I will review and take into consideration the comments by the defense and the state in selecting a site," Perry said.

Perry also explained that there would be a gag order regarding the location of the trial.

Anthony's attorney, Jose Baez, has said he doesn't feel his client could get a fair trial in Orlando because of the media attention the case has drawn. The hearing began by Baez making an argument to move the trial to Miami-Dade County in South Florida. Baez finished by showing a two-minute video presentation of emotional media coverage of the case.
Baez then argued the second motion in which the defense wants pictures of Anthony partying, supposedly during the time that Caylee was missing, to be sealed. Baez said that his absurd to suggest that a person who goes to a night club or a party is a bad mother or does not love their child.

Perry deferred a decision on that motion, asking both parties to work together on which photos they intend to use.

Regarding dismissing the defective indictment, Perry denied the motion.

Anthony is being held on no bond at the Orange County jail charged with murder in the death of her daughter, Caylee.

Caylee's remains were found in a wooded area near the Anthony family home in December 2008.

Anthony maintains a nanny by the name of Zenaida Gonzalez kidnapped Caylee, then 2 years old.

Anthony's trial is set to start in May 2011.

Hi Monkeys----Thanks to all who gave a brief synopsis of what was going in court.  I wasn't able to watch it due to other things I had to do.  I appreciate the succinct comments.

A couple of things I noticed while reading after the fact and watching the videos.  In the video of Baez' comments after court, it appears that he has a black spot on his left cheek.  It looks like it might be melanoma.  I'd have it checked if I were he.  I also noticed for the first time that in profile, he appears to have a very week chin.  Kind of like a rat.

Cindy is much too old to wear the sleeveless dress she wore in court, not to mention it wasn't appropriate to the occasion.  She has saggy things under her arms as we all get as we get older (Except maybe Madonna) and either she should look in a mirror or George should tell her.  She seems to think she has become a glamorous celebrity.  Uh-huh.  No how, no way.  She's the mother of a notorious murderer and a notorious liar herself. 

The comment that Conway made about they are waiting for the trial to know what happened:  They know what happened and have known since July 15, 2008.  And as someone mentioned above they can visit Casey at any time during visiting hours, if she will allow it.  I don't think it would hurt for them to visit and tell her that they love her and have it released to the public.  In fact, IMO, it might make them and Casey more human.

I like Judge Perry a lot and have confidence he will make the correct rulings.

I had a hard time hearing it the screen froze but the voice carried on in low volume

I saw the note passing, but I didn't think it was something to be passed to JB....the guard looked over at the other guard and put her hand up to indicate what to me is a signal for a phone call......she then put the note in her pocket part of the note stuck out...it didn't look to me as though she were trying to conceal it.  JMO

The female guard that received the note read something on it (looked like an envelope IMO), stuck it in her pocket, and then made the sign "phone call" with her right hand to her ear. Maybe the note was to her, that she got a call, or someone else because she craned her neck and looked across the room right away after she read it. Maybe she was trying to get the attention of a superior so she could take the call or let that person aware of a call. It didn't seem to be KC related, but that's just my opinion. That said,it did look like the male guard pointed to Mason questioning if the note(or phone call message) was for him, although he could have meant KC, and then she pointed with her pen towards defense table. I couldn't tell who it was that wrote and passed the note.....was it media or one of the defense goons?

Anthony has been declared indigent, allowing public money to pay for expert witnesses and other costs but not attorney fees.

Nothing about issuing a gag order to ALL parties?  Most notably Goerge and Cindy.  I can just see them high tailing to the jurisdiction the Jury will come from and doing news interviews.  ::MonkeyMad::

Hi Tevye--I understand what you mean and why you feel that way, but I have a different perspective.  I believe that the month to which Cindy refers means that she has been trying to get Casey to let her speak to and/or see Caylee or bring her home and Casey refused.  The reason I believe this is because IMO had Cindy known that Casey murdered Caylee prior to July 15th she would never have called the police, they would explain Caylee's absence to friends and relatives as Casey had her adopted, or she was with her father, etc. and no one would have been the wiser.  Hence, no charges, no trial, no death penalty.  Then Cindy and George could have gone on their ways, bone-idle George and Nurse Cindy, Lee would go on doing whatever Nerds do and Casey would be living her skanky life.  No Caylee, no worries.

Anthony's murder trial is set to begin on May 9, 2011. All depositions of witnesses are to be completed by October 31, 2010. She remains jailed on a charge of first-degree murder in the death of her daughter Caylee who was last seen in June of 2008, but she was not reported missing until a month later. Her remains were found in woods near the family's home on December 11, 2008. Investigators say the toddler's body was found with duct tape over her mouth.

I looked carefully at the end of the hearing, because so many people have said that Casey acknowledged her parents for the first time.  Although I couldn't see what she said, (her back was turned to the camera I saw,) I observed Baez talk to her right before, it looked like he was coaching her, and she turned towards him as if to say, "Now?".  Then she walked forward and paused as if she were communicating.  All I can say, is too little, too late, if they are trying to rehabilitate her public image.  She appears cold, calculating and uncaring. 
I'm also of the opinion that something is happening in the Anthony household.  Perhaps Cindy's parents are ill.  I'm not sure but they seem awfully subdued and George looks dead eyed to me.

ORANGE COUNTY, Fla. (WOFL FOX 35) - Chief Judge Belvin Perry ruled that the 12 potential jurors and six potential alternates in  Casey Anthony's  trial will be chosen from somewhere in Florida outside Orlando, brought back to central Florida and then sequestered during the trial.

The judge said he will tell attorneys when he decides where to hold the trial, but that information will be kept secret until just before the trial begins.

The change of venue decision in the Casey Anthony case was the top story on noon newscasts.

“Casey Anthony will stand trial in Orange County, but the jury will come from somewhere else,” WFTV-Channel 9 anchor Barbara West said. “However, it will be a while before we know where. Chief Judge Belvin Perry said today he wants to keep it a secret as long as possible.”

Anthony is charged with first-degree murder in the death of her daughter, Caylee.

WKMG-Channel 6’s Mike DeForest noted that Anthony made eye contact with her mother, Cindy Anthony, when leaving the courtroom. “Casey Anthony smiled at her mom and said, ‘Happy Mother’s Day,’ ” DeForest said. “That’s one of the very first times we’ve ever seen Casey Anthony try to communicate with her parents in court.”

WESH-Channel 2’s Bob Kealing said that Cindy and George Anthony arrived at the 90-minute hearing about 30 minutes late. “At the end of the hearing, their daughter told her mother, Cindy, ‘Happy Mother’s Day and I love you,’ ” Kealing said.

DeForest noted that the most significant development in court was Perry’s announcement that he would grant the defense’s motion for a change of venue.  “Normally, that would mean holding the trial elsewhere, out of town,” DeForest said. “But the judge said it would be cheaper to move 18 jurors here than move several hundred witnesses, attorneys and court personnel to another city.”

WESH’s Kealing reported that the jurors will be picked elsewhere, brought to Orange County and sequestered for as long as the trial goes.

What’s next? A hearing on the death penalty Tuesday morning. Kealing highlighted that Andrea Lyon will argue for the defense.

“Casey Anthony’s defense team [will be] arguing that the death penalty is unconstitutional, it’s being unfairly applied in this case, it’s unfair to women,” WKMG’s DeForest said.

I found this statement rather interesting from the above article.

OK, I just got off the phone with Kathi Belich, she said she will be looking into it. She has received several emails. I figured if anyone would check it out, Kathi would be the right person for the job. Hope it's OK to post this. I did just get off the phone with her.

Last week that same assistant sat in CM's chair while he was at a sidebar discussion and while Casey wrote on her legal pad, that girl had her cellphone and looked like she was relaying to someone whatever it was Casey was writing. When CM came back to the desk, Casey mouthed thank you to her.  Makes you wonder...

I just watched the hearing and either I'm completely blind and/or I missed any note passing. I'll watch part 1 again later after I take my aggression out in Mafia Wars.

I thought Bozo sounded semi-intelligent today. Atticus Finch my arse! Lol! I loved the way Perry cut him off when he was describing the protesters.
What he fails to realize is that the looneys that were protesting were doing so because Casey was out on bond.

The 911 call is coming in as far as I'm concerned. Cindy can spin it any way she wants, but she was definitely frightened and on the verge of a breakdown when she found out that Caylee was really "missing".

I wish I could have seen Casey acknowledging her parents. Only 1 report so far says that she told Cindy she loved her.

Can't wait to see who's the first to spill which jurisdiction gets the case. I doubt it'll be Dade county only because the state objected to letting Bozo chose which one he wanted. I don't see how the demographics are similar anyway...old Jewish folks and Latinos.

What about importing a jury for the Casey Anthony murder trial?

It won’t be a mission impossible, attorney Jeff Deen told WESH-Channel 2 tonight.

“The fact that someone is generally aware of it isn’t going to be the reason that they’re cut [from the jury],” Deen told WESH’s Dave McDaniel. “Timothy McVeigh got a jury. O.J. Simpson got a jury.”

Judge Belvin Perry announced today that he would bring in a jury from another county for the murder trial here. Anthony is charged with first-degree murder in the death of her daughter, Caylee.

Where will the jury come from?

“You want someplace big enough that they’re going to absorb that news and not make it something special,” Deen said. “More people so there’s more chance that somebody in the world hasn’t been reading about this every day.”

WFTV-Channel 9’s Kathi Belich highlighted that Anthony’s defense team raised the possibility of protesters in Orange County. But Judge Perry said the county could deal with protesters.

Belich turned to the issue of provocative Anthony photographs and contrasted them with the defendant’s current look.

“Today she was prim and proper, not at all dressed like the party girl we’ve seen in photos taken the month before and just days after Caylee disappeared,” Belich said. “Casey came in second in a hot-body contest when she claimed she was looking for her daughter.”

The defense hopes to keep those photos out, and Belich no ted that a hearing on what photos will be introduced has been set for March.

WOFL-Channel 35’s Holly Bristow also studied Anthony’s look today — a khaki-colored blouse, hair pulled back.

It’s “a far different look than what we’ve seen in these revealing [party] pictures that her attorneys are fighting to keep a jury from seeing,” Bristow said.

The defense argues the party pictures are irrelevant; the prosecution says photographs demonstrate a person’s demeanor.

On Tuesday morning, Perry will hear motions on the death penalty.

One typical low ball antic I noticed,  in the hearing when bozo was droning on about the publicity and the montage of clips and protesters and all..... one section had Nejame speaking in it.  That had to be deliberate. It's such a petty thing, out of hundreds of choices of video clips , they put Nejame's face in there. A little subliminal message that he's part of the 'enemy'.  Bozo is all about the payback, revenge. Didn't work so well regarding J Strickland but bozo is always true to his vile nature so I wouldn't expect him to learn any lessons.  Interesting, that's how the A's are too, in the very end clips of them leaving court, georgie is chewing gum. Slow, spaced out chews but gum in his mouth. Nobody but nobody tells them what to do.  Jerks, every last one.

Imagine that, George still chewing gum. I did not see Cindy chewing, but I would not put it past her. Once, I thought she was looking down at a cell phone though. Maybe she was, maybe she wasn't.

Am just curious if these points were covered in court today, and what, if anything, the judge had to say about this. 

Am also thinking that it's a sad day when the defense has to ask that statements made by the defendant's family, friends and acquaintances not be allowed in court.  If anyone knows the character of Casey the best, it would be these people.  To 'not allow' these statements is basically the defense saying they don't want 'the truth' about Casey being told to the court, as the truth about her true character would hurt her defense.  IMO.

I saw it as it was happening on Court TV / Tru TV.  Conway was very calm.  The part that surprised me was when he was questioned about Chindy's 911 call...the 3rd one...when she said "It smells like there's been a dead body in the damn car!".  Basically, Conway said that Cindy said what she thought at the time and that won't change.  That's how she felt at that time.

Whoa!  Something's VERY different today with the A's...and them not showing up at the last hearing and showing up 30 min. late for this hearing...gonna' watch them closely tomorrow  ::MonkeyTongue::

The before photos should be allowed, it shows a normal 20 something getting out and doing what they do. Baez wants to paint the "SA" as saying they are trying show a bad mom, but what i see is Casey was allowed time away from Caylee to go out and stretch her wings she wasnt cooped up 24/7 with Caylee. But the dufence wants us to believe she was cooped up , freaked out and only had fun because she was coping ugly!

Good points Mtmom.  Guess their plan is to delay as long as they can and rewrite history. all the things that people said was taken out of context, when Cindy was telling others kc was a sociopath it was just a joke. They knew all about all the sleep overs and were just fine with it. When kc told all the lies about where she 'worked', it was cause she felt pressure and was scared. The stolen money was all a mistake. KC really told them everything . The abuse allegations was just kc trying to fit in jail. Etc, etc, etc

I cant wait to see the do over too! It obvious she hates her family to the core. The abuse allegations may of been made up to help her mom and dad get divorced. Casey is a player of them all. Thinking recently of Caseys tattoo, I believe the 3 stars are the 3 CMA's. The star with no sparkle represents Caylee, she no longer can shine. The bella vita - beautiful life was supposed to be the 3 CMA's living together but when George came back to the family that ended but I think Casey continued to dream of that life. Cold ,calculated . vindictive thats what i see of Casey in the courtroom.

I’m thankful for everyone who’s here to pay tribute to a beautiful little girl who not only meant the world to me but meant the world to my family and so many of you who never got the chance to actually hug her, or smell her hair, smell the sweet sweat when she came in from outside. To hear her call me JoJo, sure I was Grand Pa but I was JoJo to her. Some days when I wouldn’t maybe just pay attn to her for just a second, she would get right in my face JoJo, Grand Pa, Grandpa JoJo, (imitating Caylee) George, she knew me, she knew how to push me to smile at her and hug her.  I miss that kiss on the cheek, that special hug. I tell everyone its so great to get a hug from someone but to get a hug from a small child- that gives me energy like you cannot imagine.

I’m still fortunate to live in a house w/3 very determined women in my life. Sure Caylee might be in God’s heaven right now but her presence is still at home w/me everyday. I can close my eyes and I can see her coming from her bedroom, w/her silly little glasses on or her beads whatever it might be to make me laugh. She was a comedian to me.



I’m not going to say how much I’m going to miss things that I won’t be able to do w/her bc someday I’ll be able to hold her hand again in God’s heaven, I’ll be able to take her on wagon rides, I’ll be able to kiss her, I’ll be able to smell her again.

Im back from Jersey & catching up on the late side.   My take on your question Ono is the defense reads that the public is noticing her NOT acknowledging her parents, so she was told to do so.   This is all in line with their fight to keep their mitigation counselor that has been working on the case & during trial attempting to pass Casey off in a better light.   Casey looked absolutely stewed today & she had many reasons why, being forced to acknowledge her parents being one & the fact that it is slowly dawning on her that she is not going to get away with murder.   She is not going to have her trial "at the beach."

As far as the change of venue is concerned, if you look way back CJBP did exactly what I thought would and should happen in this case.   He granted a change of venue to the extent that he & the attorneys will travel to an undisclosed county to conduct voir dire (jury selection), when selected they will be bused to Orange County to be sequestered & a gag order for the attorneys will go in Order.  The trial itself being held in Orange County - mainly due to cost & the tremendous amount of witnesses, attorneys along with staff, etc. having to go to another county would be way too costly, as if it isnt going to be a hefty cost to Flordia taxpayers as is...then again this defense insisted on having Casey deemed indigent, yup be careful what you ask for.   Bozo flat out lied in court today about not being recognized in Miami/Dade& I can prove it, that was exactly why he pandered to the Hispanic news network, why he went to Miami several times (he has friends there) and not only that but he did an interview from Miami with Whoraldo.   His entire argument regarding him not being recognized was so self-serving & off the mark anyways.   He also said on local news & national news previously that he was looking for a specific demographic & let's not forget his ridiculous statement about being the first Hispanic lead attorney blah blah blah.  There are thousands of high profile cases heard all the time with high profile attorneys (actually worth their law degree) that are nationwide recognized & that NEVER is the consideration that carries the day on a change of venue.  1`

O yea, Casey was instructed to tell her mother Happy Mother's Day and I love you, the same woman she adamantly spoke of despising often & resented her relationship to Caylee - guess what defense team we're not buying it neither will the jury.  Casey established her true feelings about her parents & it is part of the record, what she does in court now will be transparent to all.

Today's hearing in the Casey Anthony case will be devoted to death-penalty issues.

Starting at 9 a.m., her legal team will argue various motions on why the 24-year-old should not face capital punishment as a potential sentence if she is convicted.

Casey Anthony is charged with first-degree murder in the death of her daughter, Caylee Marie. A grand jury indicted her in October 2008 — three months before Caylee's remains were found in woods close to her family home.

The medical examiner ruled her death a homicide but could not determine how the girl died.

Initially, prosecutors decided not to seek the death penalty. They changed their minds after the girl's remains were found, announcing their plans to seek the ultimate punishment in April 2009.

The trial is set for May 2011.

Defense attorney Andrea Lyon, a DePaul University law-school professor and nationally-known death penalty expert, joined Anthony's legal team last year. She will handle a bulk of the motions today.

Today's hearing is scheduled to cover these issues:

•Gender-biased motives in seeking death
Anthony's legal team argues the state is unfairly seeking the death penalty against their client. The defense claims there is "inherent bias" against women who are accused of violent crimes, especially those accused of killing their children.

The defense points out how the state fails to seek the death penalty against many men accused of killing children.

"Societal biases against women provide the state with a way of deflecting attention away from the insufficiency of the evidence in Miss Anthony's case," according to defense motion.

•Automatic appeal of death sentence

A defendant who is sentenced to death automatically gets a direct appeal to the Florida Supreme Court. The defense claims the state's top court can't meaningfully review the case without a report written by a "capital jury," which is not required by law.

•Legal details on why state is seeking death

Casey Anthony's attorneys want prosecutors to give the legal reasons — called "statutory aggravators" — why the state seeks to execute their client.

The law requires a jury to weigh certain factors, such as the victim is younger than 12 and the murder is premeditated, that make a defendant eligible for the death penalty.

The defense wants to know what "aggravating circumstances" the state will try to prove during sentencing. This will allow her defense to fully prepare their side.
• No info revealed related to a potential penalty phase of trial

If someone is convicted of murder, the case moves to the penalty phase. That's when the defense tells a jury reasons why the defendant should not get the death penalty but be sentenced to life in prison.

Casey Anthony's attorneys want Perry to issue an order protecting Anthony from having to "reveal any information relating to any potential penalty phase proceeding to the state prior to the time she is actually convicted of first-degree murder."

• Prosecutors' motives to seek death

The state initially announced it wasn't going to seek capital punishment. Four months after Caylee's remains were found, prosecutors changed their minds and stated they would seek death.

Her defense questions their motives.

Death cases are different —they require death-penalty qualified attorneys, they cost more money and take longer to go to trial. Casey Anthony had to hire another attorney because her retained lawyer, Jose Baez, was not qualified to be lead attorney.

"The prosecution knew this would financially break the defense," the defense wrote in the motion.

ORANGE COUNTY, Fla. (WOFL FOX 35) - Casey Anthony is expected to be back in front of an Orange County judge today.

Today we could learn whether her attorneys can turn the judge away from the death penalty in her case.

Anthony's attorneys say the law is unconstitutional in this case and not-applicable.

The defense claims there is only circumstantial evidence linking Casey to Caylee's murder.

Her attorneys want the court to make the prosecution prove it has enough evidence to warrant the possibility of the death penalty.

Before Caylee's remains were found prosecutors had taken the death penalty off the table. But after that fateful day in December of 2008, the State Attorney's Office changed their mind.
 

During yesterday's hearing, it was decided that jurors in the trial will be picked from outside Orlando and then brought back to Central Florida for the trial.
Chief Judge Belivin Perry said he will grant a change of venue motion at the appropriate time. Once the judge picks a location, he will tell the attorneys and then place a gag order on them.

Anthony's attorney Jose Baez had argued that Orlando-area residents had been tainted by negative media exposure.

Baez then argued for pictures of Anthony partying, supposedly during the time that Caylee was missing, to be sealed.  Judge Perry deferred a decision on that motion, asking both parties to work together on which photos they intend to use.

Near the conclusion of the hearing, Baez played a video which included clips from several television outlets in the Orlando area as well as individual video blogs, coverage he described as a media "frenzy."  There were some technical difficulties during the playback of the video and the video appeared pixelated at times.
Last week Judge Belvin Perry denied a request from Anthony's attorney to seal all records related to the public funding of her defense.

Judge Perry said Anthony's attorney failed to prove that releasing the information would jeopardize her right to a fair trial. Jose Baez had argued that making the records public could reveal strategy and the type of expert witnesses the defense is hiring.

Anthony has been declared indigent, allowing public money to pay for expert witnesses and other costs but not attorney fees.
Anthony's murder trial is set to begin on May 9, 2011. All depositions of witnesses are to be completed by October 31, 2010. She remains jailed on a charge of first-degree murder in the death of her daughter Caylee who was last seen in June of 2008, but she was not reported missing until a month later. Her remains were found in woods near the family's home on December 11, 2008. Investigators say the toddler's body was found with duct tape over her mouth.

Prosecutors in case against Casey Anthony will argue the death penalty in a hearing Tuesday morning.

At the top of their list of reasons, prosecutors cite that Anthony is charged with first-degree murder in the death of her daughter, Caylee.

They also say Anthony should face the death penalty because the crime committed involved aggravated child abuse.

Anthony's defense has filed several anti-death penalty motions. They believe prosecutors are seeking the death penalty because it would drain Anthony's defense fund.
Attorney Jeff Dowdy has defended a number of high-profile death penalty cases. He said they are costly.

"The whole case in its entirety cost $1.1 million," Dowdy said.

In March of last year, Anthony's defense team revealed behind closed doors how much money she had and where it came from.

Since then, Anthony has successfully petitioned the court to be declared indigent.

Dowdy said her defense is being paid by taxpayers, so money should not be an issue.

Tuesday's hearing starts at 9 a.m. at the Orange County courthouse.

Anthony is being held on no bond at the Orange County jail charged with murder in the death of her daughter, Caylee.

Caylee's remains were found in a wooded area near the Anthony family home in December 2008.

Anthony maintains a nanny by the name of Zenaida Gonzalez kidnapped Caylee, then 2 years old.

Anthony's trial is set to start in May 2011.

After seeing it for myself I noticed at the end of the hearing Cindy telling Holly Bristow (6) what Casey said to her & then smiled, Holly patted Cindy on the shoulder...gag me.  It was clear that Bozo & Casey exchanged words as to when or what to say to Cindy & it came off as unnatural.  I also noticed that the Anthonys did not wheel their attorney out like they have been repetitively, Cindy gave a hug & George exchanged a few pleasantries but they left him to wheel himself which he has been perfectly capable of doing all along.

The tape that Bozo provided in his argument stupidly included a few glimpses of the Anthonys fighting with protesters which doesnt paint them in a decent light as just "victims."   Other than that the video was worthless & LB responded as usual professionally & on point.   Bozo did not disappoint being an embarrassment to the legal community, good God my dog could have presented a more succinct argument!   When Bozo argued that the "party pics" paint Casey in a bad light, he is skimming over the fact that they are being considered to exhibit that  Casey was NOT looking for a missing child nor cared to.  Wait until the prosecution plays the surveillance video of Casey at Blockbuster with Tony on the evening of 6/16 or questions via the tattoo parlor employees why in the world a frantic, worried mother would be taking the time to get a tattoo 7/2, especially considering what it states.  ""Quite frankly," Jose Baez is a dolt!  ::MonkeyNoNo::

Bozo yet again was too broad in what he wanted & from whom, obviously he has little to no idea what he is missing specifically nor does he seem to understand like it or not what is discoverable & what isnt, that motion is getting way old.    CJBP took him to task & will continue to do so, I can tell he's already fed up with this clown.   It is rather appalling that a co-counsel for the defense has to stand up and stipulate something the State prosecution is offering regarding discovery & its rules while mentioning that he realizes what they are aware of & yet the "author" of the motion did not...flippin ridiculous!

Casey's Defense Poised To Fight Death Penalty

ORANGE COUNTY, Fla. -- Casey Anthony is expected back in an Orange County courtroom for a second consecutive day as her attorneys argue that she should not face the death penalty if she is convicted.

Casey's lawyers say the death penalty is unconstitutional, but previous presiding judge Stan Strickland refused to take it off the table.

The defense also believes the prosecutors in this case are pursuing the death penalty in order to force Casey to accept a plea.
On Monday, Casey's attorney Jose Baez did not want to bet on his chances that new presiding judge Belvin Perry will take the death penalty off the table.

"I'm not Las Vegas, or anything like that. I'm not a bookie, I couldn't' tell you," said Baez.

Tuesday morning, Baez will have to step aside because he is not qualified to try death penalty cases alone. Chicago-based attorney Andrea Lyon will once again fight to keep Casey from serving the death penalty if she is found guilty of murdering her daughter, Caylee.

"I completely and totally trust on her and her position," said Baez.

The defense's position is that Casey should not be put to death because prosecutors cannot prove she killed her daughter in a cold, calculated and premeditated manner.

However, prosecutors argue Caylee Anthony's killer had to use physical force or chemicals to subdue the child because otherwise she would have been able to remove the three pieces of duct tape found covering her nose and mouth.

The defense says, all that aside, the death penalty in Florida is flawed, but Casey's attorneys did not offer up specific reasons why.

"There are some serious problems with it. Obviously, the death penalty here doesn't work," said Baez.
Casey's defense team believes that jurors hearing death penalty cases are more likely to convict. However, to this point there has not been any mention of specific Florida cases that would back up that notion.

Hey, I had an idea about how George and Cindy could have shined up their pathetic image and thrown CASEY under the bus!  If they had requested visits over and over, and been turned away, instead of blaming the media, they could have blamed Casey herself, or her overprotective attorney.  Remember when Casey refused to see Lee?  Cindy wanted to use the media to get Caylee's picture out there, and thought she could manipulate the public, instead she did exactly the opposite.  The media is generally hostile towards the A's.  Could these people be any more ineffectual?

Good Morning Monkies---It was such a pleasure to see Judge Perry render his decision immedicately, as I though he would.  He has had time to go over the cases, decisions, laws, etc. and is always prepared to do the appropriate thing.  No hemming and hawing here.  Judge Perry knows the law, as most of us don't, and doesn't delay his ruling when he has the information he needs.

I was not impressed with Ms. Lyon.  Her argument was, IMO, quite farfetched.  The media's opinion of "Ms. Anthony" is not relevant to the imposition of the death penalty.  A jury of her peers will do that.  I doubt that she has 12 peers though, I don't think there are 12 other people who are as amoral as she. If there is a bias in whether or not a woman gets the deathpenalty, and IMO there is, the bias is against men.  Few women are condemned and even fewer receive the death penalty.

No. she didnt just incite the prosecution with "the only motion the prosecution saw fit"  She is really pushing buttons a thousand ways to Sunday.   CJBP is NOT going to overturn JS nor interfere with the prosecution's sought verdict, he will leave for a jury to decide & has the law to back him up.

ORLANDO -- Judge Belvin Perry has denied the motion to preclude the death penalty in Casey Anthony case. State prosecutors can still pursue death.

A hearing is under way at the Orange County Courthouse.
Updates From Court

10:17 a.m. -- Cindy walked in and told Casey "I love you" as she was discussing things with her attorneys. Casey started crying, as Jose Baez and Andrea Cheney hover over her.

10:09 a.m. -- Perry takes 10 minute recess.

10:08 a.m. -- Judge Perry denies motion to preclude the death penalty. State prosecutors can still pursue death.

9:45 a.m. -- The professor's testimony concludes.

9:23 a.m. -- State is fighting tooth and nail. Every question defensse asks, the state objects to the professor, saying media pays huge attention to white middle class women accused of killing their child.

9:15 a.m. -- Cindy Anthony is in court with a friend. George Anthony is not present.

9:13 a.m. -- The professor takes the stand.

9:11 a.m. -- The legal professor who traveled here from New Mexico will be allowed to testify. If the state wants more time to cross examine, they will have 30 days and then will do it via video conference.

9:07 a.m. -- Defense plans to call witness regarding motion concerning gender bias. The state says they did not have enough notice (sufficient time) to depose and are objecting to her testifying.

Although prosecutors are seeking the death penalty, Anthony's lawyers say it is unconstitutional.

This could also be a strategic move by the State Attorney's Office.

Anthony's defense team believes this is an attempt to break her financially.

She has already been declared indigent, so the state will be picking up the tab on today’s hearing.

The defense could argue that added expense of a death penalty case could be more of a burden on taxpayers.

"I'm a little bit biased to that fact,” said Anthony’s attorney Jose Baez. “We think there's some serious issues with it. The Florida Death Penalty is unique to other states. There's some serious problems with it. Obviously, the death penalty in our position doesn't work. So you're probably going to hear all those arguments and more."

Those arguments are not likely to come from Baez, but from co-council Andrea Lyon.

Lyon filed the motion saying, "The prosecution knew this would financially break the defense."
