ORLANDO, Fla. -- Judge Belvin Perry has denied a standard defense motion asking for Casey Anthony's case to be thrown out on Wednesday. Casey is charged with first-degree murder in the death of her daughter, Caylee Anthony.

 

Judge Perry denied the defense motion asking for the case to be thrown out. The defense has claimed that Caylee was not slain but instead drowned in her grandparents' pool.

Over several weeks of testimony, prosecutors have laid out their case that Caylee was suffocated with duct tape, though a medical examiner testified the cause of death was undetermined. Only the "manner of death" was ruled to be homicide.

Prosecutors have built their mostly circumstantial case on 25-year-old Casey's conduct and the lies she told about her daughter's whereabouts.

They also have relied on forensics experts. They've talked about smells of human decomposition in Casey's car, searches on her computer, including for chloroform several times, and duct tape found on the girl's skull. ::snipping2::

(CNN) -- After prosecutors rested their case in Casey Anthony's capital murder trial Wednesday, the judge rejected a defense request for a judgment of acquittal, saying the jury must decide what to make of the evidence.

The ruling means that Anthony's defense will begin presenting its case Thursday. The prosecution rested after more than three weeks of testimony in a Florida, courtroom.

The defense filing in court documents says Vasco Thompson is a 'recently discovered witness through the ongoing efforts of defense investigators'

On the same day Chief Judge Belvin Perry denied a defense motion for acquittal, Casey Anthony's team introduced a new person to the murder case — an Orlando felon with a violent past.

Anthony's defense amended witness list includes the name Vasco Thompson of Orlando.

The defense filing in court documents says Thompson is a "recently discovered witness through the ongoing efforts of defense investigators."

Thompson, according to the filing, "was connected to George Anthony through his cell phone records."

The document goes on to say "Thompson has a violent criminal history and has served a ten year prison sentence for kidnapping."

Thompson refused interview attempts by the defense and called law enforcement when questioned, the document says.

Due to the recently discovered and unexplained relationship between George Anthony and Thompson, their cell phone contact , including four calls on July 14, 2008, and Thompson's "violent criminal history," the defense claims "good cause is shown for the late disclosure of this witness."

The defense has to "depose Mr. Vasco Thompson to determine the existence of relevant admissible evidence in this trial," wrote defense attorney Cheney Mason.

It's unclear exactly how Thompson might play into the defense strategy.

The defense is expected to call its first witness in the central Florida murder trial of Casey Anthony, who's accused of killing her 2-year-old daughter in 2008.

The prosecution has presented all its evidence and Thursday jurors will look towards Casey's attorneys to begin delivering on several promises they made at the outset to explain why the 25-year-old's child is dead.

George Anthony's cell phone records show he had contact with Vasco Thompson days before Caylee was reported missing, defense says
.

Lawyers representing Orlando felon Vasco Thompson, the latest defense witness in the Casey Anthony trial, cancelled a news conference that was scheduled for this afternoon.

A secretary at attorney Richard Hale's office confirmed the 4 p.m. conference was cancelled because Thompson had found another attorney. Hale's offices said there was no need to hold the conference.

ORLANDO, Fla. -- George Anthony called the Orange County Sheriff's Office Wednesday night because the bounty hunter that repeatedly bailed his daughter out of jail was in front of his house with a news crew.
According to the Sheriff's Office call log, Anthony believed he had an order to keep bounty hunter Leonard Padilla away from his home and after contacting his attorney, he called 911 to report that Padilla was in front of his home on Hopespring Drive.

Baez is expected to call more of the prosecution's forensic witnesses to the stand Friday after questioning several crime scene investigators and FBI evidence analysts on Thursday about the evidence they collected and examined.

The defense has spent time trying to discredit the state's evidence, instead of backing up their own theory.

As the defense began presenting its case, Baez questioned an FBI DNA analyst about whether investigators believed Casey and her brother, Lee Anthony, had a sexual relationship.

Baez didn't get far with that line of questioning. He also focused on evidence from where Caylee's remains were found.

In a misstep he asked about a blanket that's not in evidence, “My apologies, the blanket that was just described is not in evidence. I move to strike,” said Baez.

WFTV’s legal analyst Bill Sheaffer said those kind of mistakes hurt the defense's case.

“That kind of mistake is sloppy and it undercuts in the jurors' minds his authority and credibility,” he said.

Baez spent the entire day on Thursday attacking prosecutors' evidence. It's unclear where his witness list will go from there, but Sheaffer said Baez will have to move along much quicker, or he can expect Judge Belvin Perry to intervene.

Anthony defense team may lose potential witness

CNN) -- As the defense case for accused daughter-killer Casey Anthony enters its third day Saturday, attorneys for the Florida woman may be scrambling to recover from the potential loss of a witness who publicly denied having any relevance to the trial.

Anthony's attorneys had sought to question convicted felon Vasco Thompson about his relationship with the defendant's father, George Anthony. It is not clear how the 52-year-old convicted kidnapper may have fit into the defense team strategy.

ORANGE COUNTY, Fla. -- Week five of Casey Anthony's murder trial will begin on Monday, and when testimony resumes, an expert witness for the defense who was sent away by the judge on Saturday will return to the stand.


Monday marks day 34, including jury selection, in Casey's trial. She's accused of killing her 2-year-old daughter, Caylee.
The circumstances surrounding this witness could get Casey’s lead attorney Jose Baez in trouble with the state bar.

Dr. William Rodriguez was turned away at the witness stand after prosecutors complained that Baez planned to question him in a way he had not disclosed in court, which is in violation of Judge Belvin Perry's pre-trial order.

Rodriguez was sent out of court on Saturday, after Baez questioned him about something prosecutors didn't know about. Perry then threatened to hold Baez in contempt of court.

Orlando (CNN) -- Clearly irritated with what he termed continued "gamesmanship" among attorneys in Casey Anthony's capital murder trial, Judge Belvin Perry on Monday threatened longer workdays and suggested any further shenanigans could result in the exclusion of critical evidence from the case.

"If y'all don't want to act professional, I will work you real full days," Perry said at the outset of Monday's session following complaints from both the prosecutors and the defense attorneys about each others' conduct.

Perry is supervising the trial of Anthony, the 25-year-old Orlando woman accused of killing her 2-year-old daughter, Caylee, in 2008. ::snipping2::

Judge Perry listened for almost 25 minutes Monday morning before asking prosecutor Jeff Ashton and defense attorney Jose Baez to look at the clock and tell him the time. Ashton said 9:25, while Baez responded 9:26. That prompted Perry to say, "that shows the two of you will never agree on anything."

Ashton asked the judge that defense witness, Dr. Rodriguez, not to be called first because he wanted to read over his deposition again. Baez asked the judge for sanctions against the state and said he feels they are unreasonable.

Rodriguez was turned away at the witness stand after prosecutors complained that Baez planned to question him in a way he had not disclosed in court, which is in violation of Perry's pre-trial order. Perry then threatened to hold Baez in contempt of court.

Perry admonished the lawyers for wasting the jury's time with legal matters that should have been taken up before court began. He also said they will work a full day on Saturday. He ruled that they will be required to arrive at court at 8:30am everyday.

Perry ruled that testimony from Rodriguez will be delayed, per the prosecution's request. Perry then called a 45 minute recess, waiting for the defense's next witness to arrive. ::snipping2::
