Attorney Seeks Ruling In Zenaida Gonzalez Lawsuit

ORLANDO, Fla. -- An attorney for Casey Anthony's parents has filed a motion to prevent them from giving depositions in the Zenaida Gonzalez civil suit.

The lawyer for George and Cindy Anthony, Brad Conway, said in the motion Tuesday that forcing them to give depositions in the suit is nothing more than an attempt to annoy and embarrass them.

The motion will be heard Wednesday at 2:15 p.m.

Gonzalez is suing their daughter for defamation after Casey Anthony claimed a baby sitter named Zenaida Gonzalez kidnapped her daughter Caylee.

Casey Anthony eventually was charged with first-degree murder in connection with Caylee's death. She is in Orange County Jail awaiting trial later this year.

In his motion, Conway points out that George Anthony recently tried to commit suicide. He also acknowledged that both he and Cindy Anthony are getting professional help to deal with the grief of losing their granddaughter.

Conway argues that the Anthonys don't know Gonzalez. Conway is asking that the Anthonys' depositions be put off until after the judge decides in May whether the civil suit will even continue.

Conway said Gonzalez' lawyers are asking for punitive money damages. But the family has no money for her to win. The Anthonys are scheduled to give depositions Thursday.

The whole thing is a joke!! If they can get out of it because of that, then so should every person who has to show up and testify in court for whatever reason. It's probably embarrassing and inconvenient for anyone, sorry but they are not special!!

IMO - no one ever said that law suits must be gentle and kind.  The way I look at this is that it's a deposition...it's not taking the stand in front of jurors (with respect to being too emotional, on meds, etc., etc.)

As ZFG's attorney said:  there's only a couple of questions that have to be answered...like...have you ever seen Zenaida the babysitter, have you every talked to Z. the babysitter, have you ever met ZFG?

This talk about waiting until the criminal trial is nothing but bs....what does that have to do with the fact that Z. has been destroyed and can't get a job to support her kids? 

I hope this judge sees it the way I do....

I agree QM.

This guy is dumb as a brick.  Zenaida is not suing George and Cindy so it doesn't matter if they have any money or not.  She is suing Casey, who I suspect has a secret source of funds to pay all of those high-powered experts.  Probably got it from selling pics of Caylee. 

I had to give a deposition several months ago right after I had given birth to my son, via C-section, for one of clients.  The defense was trying to attack my professional judgment.  I got no free pass just because I was inconvenienced and my then condition.  On top of that, the defense attorneys made me wait two hours past my scheduled depo time!  The A's have no valid excuse.

Lee will respond to the deposition because he didn't know anything about ZFG and that's what he'll say and, if any question that is asked puts him in an awkard position, Lee will plead the 5th.

However, the A's have a more difficult time, especially Cindy, because she's been all over the airwaves spouting Zenaida's name.

Janetruth:  You do not even come near to that category I was talking about.  I was talking about the peope who have kids, then claim abuse, then leave the kids with the abuser, then start yet another family with someone else. Meanwhile, the dad starts another family with another girl, and then has an entirely different girl babysitting his other two kids so he can work.  That seems to be the rule, no comittment to each other or the kids.

Conway has turned out to be a different version of Bozo, with his version of distorting the truth and protecting the ones that should have protected Caylee.

I am surprised that the A's were never charged with failure to protect a child since they knew of KC's reckless regard for Caylee.  They need to be held accountable.

I just moved from there, and do miss it somewhat.  Very easy going, little traffic, friendlier, much more laid back than Lincoln.  Most folks there go to the same church!   ::MonkeyHaHa::  Going to Norfolk from California was a definite culture shock.  Bank tellers there remembered my first name and used it when I went in.  And even the folks at Runza, a hamburger place, remembered my fav order every time.  It's a different world there for sure!  Kind of like living in Mayberry.   ::MonkeyWink::

We left there in 03.  Were you there when the bank shootings happened.  It seemed the place changed (for my family anyway).  My hubs and I worked at the hospital.  I am sure that we may have even crossed paths at some time!

I really didn't think the judge would be sypathetic to the Anthonys.  This is so wrong.  Why didn't Mitnik bring up Satsuma?  The Anthonys will have doctor's who will support them on this.

Getting a psychologist to say they are unable to give depo's will be easy.  This is a injustice for ZG and Caylee!  This judge needs to be suspended.  The Ant's are not normal people but how in the he## does not make them exempt from the legal system.  ZG is an American citizen and she is having the right to a fair and equal justice system taken from her!

We moved there in '01, so it's very likely we crossed paths!!  Did you ever eat at BKing on 13th?  If you did, my youngest son probably cooked your food at least once.  He started his career in food there, was kitchen manager at 16 yrs old, is now a chef at a fancy shmancy restaurant in Lincoln.

I think that the Anthony's chose Conway for the "pitty" that Cindy (more than likely) thinks he must get being in a wheelchair.  I KNOW that not all people in wheelchairs receive pitty or favor, but I am just thinking out loud here....WTF is up with this Judge and WTH is wrong with these people??!!

May not be at the back of the bus, but what about the short bus?  (Not meaning that in a funny way, but seriously)  He is a Defense attorney, he is paid to be scum, he is going to wallow in it if he can in order to squeeze his clients out of the tight situations.  I seriously believe that his disability was a prime reason as to why Cindy picked him.  Even though society as a whole would like to say that they do not give special treatment or attention to those who are handicap, its a load of crap, they most certainly do, its an automatic response, its in our psychy (sp?).
I do not think that even the Pope would render this much pitty from a Judicial system.

IMO Conway showed up in court with no psych docs because he would have to submit them and they would become public docs and we'd eventually get to read them; Conway, by doing it this way, was able to get the judge to tell him he had to produce the docs and that they would be "under seal".

No it wont affect them testifying in Casey's case...we are no less than 8 months away from trial, my instincts say we will not be at trial until the earliest mid fall of this year possibly later.   Their "grief" only goes so far - many millions have had to testify in enormous positions at trial while grieving the loss of a loved one.   Their mental health will also only go so far in this civil mater - it wont be their shield forever.    Showing George in Satsuma & on Whoraldo with Brad indicates he is capable of appearing in public & commenting on cases involving victimized children - too bad he doesnt have the "palenes" (Italian for two body parts he evidently lacks) to speak up about his granddaughter's murder by his daughter & his wife's campaign to save her monster!

Well, I once had a client. The fam sent letters to the judge about me so I would be removed from the case.  (they did not like me because I was acting in the interest of my client (the victim).  they wrote letters to the judge, but the judical assistant returned them to the family.  Stated judge was not allowed to read letters.

i know everyone is super peeved about the judges decision to postpone c&gs depositions in the civil case but no worries my friends. civil cases are notorious for moving at a snails pace, and theyre even slower when related to an ongoing criminal matter. they will be deposed no matter what, and theres not a snowballs chance in hell that any of the anthonys will get out of testifying in the murder trial. you can take that to the bank.

I called Morgan's office and talked to his legal assistant directly, he is in a meeting right now but I left the pertinent info with her & on his direct voice mail that she put me on to give him the info & stated that if he needed to call me back that he couldnt get the links himself that I have it set aside for him.  I made it clear that Brad Conway lied today in court & that there is indeed proof that BOTH the Anthonys are fit enough to be on camera & appearing in public, in addition to what I feel is relevant to assist him in compelling them to deposition.

Usually when a person is emotionally fragile, they tend to keep to themselves, maybe not want to leave the house, shun food, look unkept, etc. Now everyone is different but injecting ones self into a missing child's case seems like something one probably wouldn't do.

Judge delays questioning of parents in defamation case against Casey Anthony

The lawyers representing Zenaida Fernandez-Gonzalez -- the woman suing Casey Anthony in a defamation case -- will have to wait to question George and Cindy Anthony under oath.

Orange Circuit Court Judge Jose R. Rodriguez postponed the depositions, which were scheduled for Thursday, until media outlets could submit documents on why they should be allowed to attend the interviews.

Depositions in civil cases are public proceedings but can be closed under a court order. The media have 20 days to respond.

The Anthonys' attorney, Brad Conway, argued that the Anthonys are seeing counselors to help cope with their granddaughter's death and their daughter's arrest. The stress of taking depositions in front of the media may prove too much for them, he said.

Rodriguez asked to see psychological reports from the Anthonys' doctors about the issue. He will review them under seal, which means the documents are not public record.

George and Cindy Anthony do not have to give depositions Thursday in a defamation suit against their daughter, a judge ruled Wednesday.

The latest development was a top story on 4 p.m. newscasts of WESH-Channel 2 and WKMG-Channel 6.

WESH's Bob Kealing said that the judge "with some hesitation" delayed the depositions for 20 days. During that time, the Anthonys will be allowed to present evidence that they're still grieving over granddaughter Caylee's loss. The Anthonys' daughter, Casey, is charged with Caylee's murder.

George and Cindy Anthony had been scheduled to give depositions on Thursday to lawyers for Zenaida Fernandez-Gonzalez. Fernandez-Gonzalez is suing Casey Anthony for defamation for linking her to Caylee's disappearance.

"I don't care about anybody else's' problems but my client, and it's frustrating," Fernandez-Gonzalez attorney Keith Mitnick told WESH. "We're going to get these depositions. People are going to have to go under oath. ... One thing I promise you: It's coming."

Kealing teased to a 5 p.m. report that will explain why the lawyers especially want Cindy Anthony's deposition.

Fernandez-Gonzalez's attorneys, who include John Morgan, have invited the media to cover the depositions. The judge questioned whether the media have a legal right to be there, WKMG anchor Jacqueline London said. During the 20-day delay, the media will have a chance to argue why they should be there.

Being charged with "contempt of court" is no laughing matter... you can be put in jail and/or given a fine.  Generally speaking:

Also, if George is so fragile, then why did he go back for a second time to Satsuma?  If the first visit had upset him then he wouldn't have gone back.  Those are only two incidences we know of. He might have been there more than twice.  The only thing George looked like he couldn't handle was when Geraldo asked him about testifying to the GJ about Casey.  He wouldn't answer but I don't think that was due to being fragile.  He just didn't want to say something in public that might bite him in the butt later.   ::MonkeyWaa::

  I can't pull the quote but the article also quoted Conway as saying that George wanted to use his "notoriety" to bring attention to Haleigh's case.

If GA is secure enough to use his notoriety in a national arena, then it stands to reason that he is more than ready to take the stand to try and bring justice to another person, ZFG.  This really smacks of bait n switch. I hope that Zenaida's attorneys pay particular attention to the dates on any psychological reports presented to the court to prove the Anthonys' disability.  Since Conway said that they were presently under treatment, the dates when they were first seen will be very interesting.  I don't think any mental health professional will backdate his/her records, but then with George and Cindy, people bend over backwards to support them even to the extent of lying in court.  So, who knows?
