I think her description of him in 2005 was pretty dang accurate. He wasn't all over the media then.
Makes me mad when they victimize the victim again with these ridiculous insinuations.

Jesse Matthew pleads not guilty in 2005 Virginia attack
FAIRFAX, Va. (AP) — Jesse Matthew, who could eventually face a death penalty in the slaying of University of Virginia student Hannah Graham, pleaded not guilty Monday in a separate prosecution that could send him to prison for life.
Trial began Monday for Matthew, 33, of Charlottesville, in Fairfax, where he is charged with attempted capital murder, abduction and sexual assault in connection with a 2005 attack.
Matthew, wearing a dress shirt and yellow tie, entered his plea on all three counts in a soft-spoken voice.
Matthew was charged in the long-unsolved Fairfax case last year after his arrest in connection with Graham's disappearance yielded a hit on DNA evidence.

Day 1: The First Trial of Jesse Matthew
Collisions
Thirty-five years ago, my father was driving from Smithfield, North Carolina, to Raleigh, in a terrible thick unusual winter fog enveloping the highway. He had slowed to 45 mph, but an 18-wheeler in front of him was much slower, and my father's car smashed into the rear of the huge truck. Somehow, the impact broke his driver's seat, and my father was cast immediately backward into a flat position, as though he were on a stretcher. The top of his car, as his car slid and lodged under the truck, was sheered off. When a rescue machine lifted the back of the 18-wheeler, my father walked out unharmed.
In the Fairfax courtroom today, at three minutes before 5 p.m., the survivor of the 2005 sexual marauder was excused from the stand, and she walked out of the courtroom unharmed.
Collisions screeched in that room all day.
Some of the collisions were silent, internal: Dan Harrington seeing Jesse Matthew for the first time. Dan and Gil first seeing the victim, RG, for the first time, who has flown from India to testify bravely, a decade after her assault.
One little crash was proximal. Separated by twelve inches, Gil Harrington and Jesse Matthew's mother, for the first time, made eye contact. Gil nodded, and the mother of the accused said "hello."
Other collisions hissed and clattered like oil fires and pan lids. These impacts were procedural: a photograph shown of RG's bloodied clothes; the admission that she had been a virgin, and that, until today, she had been too ashamed to say that yes, after his hand had penetrated her, so did his penis.
I believe that the three most jarring collisions in the courtroom have left many of us, though we watched from a distance today, aching.
1. The Defense attempted to counter the irrefutable fact that RG scratched the attacker and had his DNA under her fingernail with the hocus pocus possibility that it was just "touch DNA." Maybe Jesse and RG had just happened to pick up, for example, the same bag of potato chips that day, and an infinitesimal little DNA strand from Jesse Matthew leapt like an eager cricket from the chips to lodge right under RG's fingernail. That gymnast DNA, wow, was just coincidentally in the microscopic mood to do a Cirque du Soleil move.
This is the collision of beyond a reasonable doubt with fantasy.
2. The details of RG's assault were exposed for the first time, and none of us who care to invest in the work of Help Save the Next Girl can ever be prepared for the actual cinematic description of a sexual predator's attack. The man who attacked her picked her up as one would pick up an infant. He threw her onto the curb. He beat and beat and bloodied her. He strangled her. He was as violent as a man in a fight for his life, and as vicious and frenzied as the wildest things in our worst nightmares. She was covered in blood and nearly dead. This is the collision of coolly knowing a phrase, such as "attempted capital murder," and being viscerally empathetically sickened.
3. Dan and Gil Harrington sat through RG's testimony, hearing about this rampage of a furious predator. Jesse Matthew's parents heard the same story. Both sets of parents were approximately equidistant from the small, articulate woman testifying about what she survived and remembered well, and how she helped police know his face. This is the collision of the past and the present; of what we must know and what we must do.
Thanks to all of you who support the victims, their families, and this great and positive movement to refuse silence or non-participation and instead to steadfastly commit to Help Save the Next Girl.

Victim takes the stand at Jesse Matthew Fairfax trial
FAIRFAX, Va. (WUSA9) -- The victim in a 2005 Jesse Matthew case took the stand in the first day of trial Monday afternoon. Prosecutors say she was sexually assaulted by Matthew.
Matthew is charged with attempted capital murder, abduction and sexual assault stemming from a 2005 attack along Jermantown Road. The victim in the attack flew back from India to testify against him.
WUSA9's Peggy Fox reported that the victim told the Commonwealth's attorney she remembered something new: that the suspect put his penis inside her vagina.
Morrogh described the attack by saying he choked the victim until she was unconscious and car lights stopped the attack. Morrogh said in court that the victim scratched the attacker and DNA was left under her nails. WUSA9's Peggy Fox reported that Morrogh said that the DNA matched Jesse Matthew.
Mark Raul Castro, the man who happened to drive into the parking lot and stopped the attack with his car lights, said in court that when he found the victim she looked nearly dead and was screaming her lungs out, WUSA9's Peggy Fox reported.
On the stand, Peggy Fox reported that the victim said on Sept. 24, 2005, she had gone to Borders Book store, then Giant, around 8:30 p.m. and was walking home when the incident occurred.
The victim said the man dropped her, picked her up again and took her to a grassy field by a pool. Then he put her on the ground, sat on her legs and banged her head on the ground.
WUSA9's Peggy Fox reported that the victim continued by saying the man began choking her until she became unconscious and at some point, he pulled her pants down.
Matthew appeared in court wearing a light yellow dress shirt with his hair still in dreads. He pleaded not guilty to the charges.
Judge David Schell Fairfax asked Matthew basic questions on Monday morning. When asked "Are you ready for trial today?" Matthew replied in a soft voice, "No." Matthew's attorney later reiterated that Matthew and his legal counsel were not ready for trial but Judge Schell responded, "You've had plenty of time."
Judge David Schell estimates that the trial could take nine days -- until Friday June 19, with Friday, June 12th off.

Jesse Matthew trial turns from victim to DNA evidence

FAIRFAX, Va. (AP) — The attempted murder trial of Jesse Matthew has resumed with testimony from the police officer who first responded to an alleged assault in 2005.
Matthew is on trial in Fairfax for attempted murder and sexual assault on a woman. He is also charged in a separate case with capital murder in the abduction and death last year of University of Virginia student Hannah Graham.
Fairfax City Police Lt. Joseph Trahey (TRAY'-hee) said Tuesday the woman attacked in 2005 was covered in blood and appeared to be in shock afterward.

Jesse Matthew enters plea in 2005 sex assault, abduction case

(CNN)Jesse Matthew, who was charged with killing University of Virginia student Hannah Graham, on Wednesday ceded that prosecutors have enough evidence to convict him of abduction, sexual assault and attempted murder in a different, decade-old crime, a Virginia prosecutor said.
In a Fairfax, Virginia, courtroom,
Matthew entered an Alford plea in connection with the 2005 case, which means he does not admit to a criminal act but acknowledges the prosecution has enough evidence to win the case.
Fairfax County Commonwealth's Attorney Raymond Morrogh said he considers Matthew's action equal to a guilty plea. Morrogh said the prosecution couldn't have stopped Matthew from entering an Alford plea and no deal was made with the defense to secure a lesser punishment.
"The defendant pled guilty to all of the charges, which means he faces the full range of punishment," he said.
While it happened nine years earlier and 100 miles away, this case is inseparable from that of Hannah Graham -- the University of Virginia sophomore who disappeared last fall and was later found dead.
A Fairfax County grand jury indicted Matthew in the sexual assault case two days after authorities found what turned out to be Graham's skull and bones on an abandoned property 8 miles from where she was last seen.
The 18-year-old went missing before dawn on September 13 after a night out in Charlottesville. Matthew was taken into custody 11 days later about 1,300 miles away on a beach in Galveston County, Texas.
In February, prosecutors said Matthew would be charged with first-degree murder. Last month, he was served with a new indictment charging him with capital murder after Albemarle County Commonwealth's Attorney Denise Lunsford presented new forensic evidence to the grand jury.
Matthew has yet to stand trial in Graham's case. If convicted, he could be sentenced to death on the capital murder charge.
A law enforcement has said DNA evidence has also linked Matthew to the death of Morgan Harrington, a Virginia Tech student who disappeared in 2009.
Harrington's mother, Gil, attended Wednesday's court proceedings in Fairfax which she said left her reeling. She expressed gratitude for the 2005 victim for speaking up, saying "I'm sure she didn't feel like the lucky one, but thank God" she came forward.

"I certainly want a day in court for my daughter," Gil Harrington told reporters. "But I am happy that it is very unlikely that this criminal will hurt anyone again."

Just two days after his attempted murder trial began, Jesse Matthew Jr. changed his plea before his defense team could fully present their case.
Matthew, 33, of Charlottesville, Virginia, is charged with attempted capital murder, abduction and sexual assault in connection with a violent 2005 attack. He had pleaded not guilty on Monday.
But on Wednesday, after consulting with his lawyers, Matthew entered an Alford plea for the three charges, which acknowledges that prosecutors have enough evidence to convict him without the defendant having to admit to the crime, the Associated Press reports. By entering an Alford plea, he gives up his right to a trial by jury and to defend himself in court.
He still faces life in prison if convicted of all three charges. Judge David Schell is scheduled to sentence him on Oct. 2.
Prosecutor Ray Morrogh said Matthew entered the plea without any deal with the prosecution, according to the AP.

Judge accepts Jesse Matthew's Alford Plea in Fairfax sexual assault case
Matthew was convicted of sexually assaulting RG on September 24, 2005

A judge accepted Matthew's Alford Plea for the 2005 attack. An Alford Plea is when a defendant acknowledges there is enough evidence for a conviction, but does not admit to committing the criminal act. Click here for more information on an Alford Plea.
Matthew, 33, is not entitled to a trial by jury and cannot withdraw the plea. He is now convicted of attempted capital murder, abduction, and sexual assault. He could be sentenced to life in prison on each charge.
In Fairfax County court, he answered the judge's questions in a soft voice. Matthew waived to his family when he was escorted out of the courtroom.
Matthew will be sentenced at 2 p.m. October 2. He will be held without bond, and will also have to register as a sex offender.
The victim, RG, requested to testify in front of the judge about the impact the attack had on her life. Her testimony will happen at 2 p.m. June 18.
Fairfax County Commonwealth's Attorney Ray Morrogh said he was surprised by the Alford Plea and was hoping the case went to the jury. He said the victim was very grateful for the work investigators put into this case ever since the attack on September 24, 2005.
"She was really moved by the fact that people from so far away would work so hard for so many years to bring her justice," Morrogh said.
Separately, Matthew is charged with capital murder in connection to the disappearance and death of Hannah Graham last year in Charlottesville. Investigators have also said that Morgan Harrington's murder in 2009 is forensically linked to the Fairfax sexual assault case. Matthew has not been charged in the Harrington case.
Even though Matthew did not admit to the crime in Fairfax, Morrogh said the conviction could still impact other cases.
"Now he’s convicted of about the most serious crimes you can be convicted of," Morrogh said. "That might put a little hitch in his giddy-up at the next trial. But who is to say?"
During the trial, no one was allowed to mention previous or pending charges against Matthew. Morrogh said it was a concern during the proceedings.
"It wasn’t difficult for me but it was a fear of ours throughout the trial. If something came up and a mistrial was declared, we would have had difficulty bringing the victim back from a great distance," Morrogh said. "And it could have posed some problems for us."

A Fairfax County judge on Wednesday convicted Jesse L. Matthew Jr. in a brutal 2005 sex assault after he surprised prosecutors by giving up on his defense, bringing a dramatic end to the high-profile case.
The 33-year-old Charlottesville man also faces a capital murder charge in the 2014 disappearance and death of University of Virginia student Hannah Graham. Police say that Matthew also has been linked forensically to the investigation into the killing of Virginia Tech student Morgan Harrington. No charges have been filed in that case.
The abrupt turnaround by Matthew came on the third day of the trial and soon after an expert testified that DNA found under one of the victim’s fingernails was highly likely to belong to Matthew.
Speaking softly and standing before a judge, Matthew did not admit guilt. Instead, he entered an Alford plea, conceding only that prosecutors had enough evidence to convict him for the attack that left a young woman battered and bloody.
Fairfax County Commonwealth’s Attorney Raymond F. Morrogh said the convictions brought some comfort to a woman who had waited a decade to see her attacker brought to court. Soon after the plea, he called the woman, who had traveled from her native India to testify against Matthew.
“She said she was deeply moved and very grateful,” Morrogh said. “She was really moved by the fact that people from so far away would work so hard for so many years to bring her justice.”

A Fairfax County judge on Wednesday convicted Jesse L. Matthew Jr. in a brutal 2005 sex assault after he surprised prosecutors by giving up on his defense, bringing a dramatic end to the high-profile case.
The 33-year-old Charlottesville man also faces a capital murder charge in the 2014 disappearance and death of University of Virginia student Hannah Graham. Police say that Matthew also has been linked forensically to the investigation into the killing of Virginia Tech student Morgan Harrington. No charges have been filed in that case.
The abrupt turnaround by Matthew came on the third day of the trial and soon after an expert testified that DNA found under one of the victim’s fingernails was highly likely to belong to Matthew.
Speaking softly and standing before a judge, Matthew did not admit guilt. Instead, he entered an Alford plea, conceding only that prosecutors had enough evidence to convict him for the attack that left a young woman battered and bloody.
Fairfax County Commonwealth’s Attorney Raymond F. Morrogh said the convictions brought some comfort to a woman who had waited a decade to see her attacker brought to court. Soon after the plea, he called the woman, who had traveled from her native India to testify against Matthew.
“She said she was deeply moved and very grateful,” Morrogh said. “She was really moved by the fact that people from so far away would work so hard for so many years to bring her justice.”
She is a hero.

CHARLOTTESVILLE, VA (NEWSPLEX) -- Newly released court documents in the Hannah Graham case reveal there was no blood found in Jesse Matthew's car when it was searched after the UVa student went missing.
According to CBS6 in Richmond, the court documents list a number of warrants and orders the defense wanted to recuse from the case.
Court documents also revealed Matthew's and Graham's cell phone activity from that night, along with another unknown third party.

Matthew, who’s accused of killing University of Virginia student Hannah Graham and could face the death penalty, now says the judge who’s been tapped to decide his fate has a conflict of interest.
In a motion filed this week, Matthew’s attorney said Judge Cheryl Higgins should recuse herself from the case because of her previous involvement with the case and her family’s connection to Graham.
Higgins has an immediate family member who attended a vigil for Graham, attorney Douglas Ramseur said, and her daughter attends the University of Virginia. In addition, the defense attorney argues that because the judge was involved in securing search warrants for authorities against Matthew, that will cause a conflict of interest.
“The defense anticipates there will be significant and extensive litigation over the use of search warrants in this case,” he said. “Judge Higgins is naturally predisposed to uphold the validity of the warrants due to her personal involvement.”
Matthew is “on trial for his life,” Ramseur said, and “when a defendant’s life is at stake, a court must be particularly sensitive to ensure every safeguard is observed.”
Higgins did not immediately respond to a request for comment from CNN.
In court papers filed last month in response to questions from Matthew’s attorney, she acknowledged that she’d signed search warrants in the case but said she did not recall the details. She also acknowledged that a family member had attended a vigil for Graham, but added that the vigil occurred before Graham’s body was found and before authorities knew she was dead.

We now know when Jesse Matthew will stand trial in the death of University of Virginia student Hannah Graham.
The four-week trial is scheduled to be held July 5, 2016 to July 29, 2016
. Albemarle County Circuit Judge Cheryl Higgins set the trial date at a hearing Thursday.
Higgins did not recuse herself from the trial. Higgins said her daughter attended a candlelight vigil for Graham, but her daughter did not know her or who the vigil was for.
Higgins said if there are any motions to suppress search warrants that she signed off on, another judge will hear those motions.
The defense and commonwealth agreed to have eight pre-trial motions before the trial begins.

Jesse Matthew’s defense team filed a slew of new motions in his capital murder case. He's accused of murdering UVA student Hannah Graham last year.
Jesse Matthew’s defense team filed 12 motions in the case late Wednesday afternoon in Albemarle Circuit Court. Thursday is the deadline for filing motions ahead of a pretrial motions hearing next month. The motions filed Wednesday deal with evidence leading up to the trial and what the defense wants at trial.
Experts say the latest motions are routine. The 12 motions filed include:
Motion invoking Matthew's 4th, 5th and 6th amendment rights specifically not to speak to law enforcement, the prosecutor, the attorney general's office and other government agencies.
Motion for Matthew to be present at every hearing.
Motion asking for Matthew to not be shackled in public and appear in his personal attire during the trial.
Motion to bar tokens or insignia of support for either side during trial.
Motion to appoint judge to hear expert funding requests.
Motion to preserve all evidence, including biological evidence, physical evidence collected from crime scene and alleged weapons among others.
Motion to preserve law enforcement notes.
Motion to stop any additional state evidence testing or examination without notifying the defense for approval.
Motion to have notice of parts of Jesse Matthew's criminal past planned for use during any sentencing hearing.
Motion for particulars on statutory aggravators the commonwealth would use at a capital sentencing.
Motion to examine evidence without the prosecutor or investigators present.
Motion to prohibit extrajudicial statements including any talk of a guilty plea and other matters by lawyers.
The commonwealth's attorney has two weeks to reply to the new motions. A 1:30 p.m. motions hearing is set for August 20 at Albemarle County Circuit Court.
