Cole County authorities serve warrant on slain girl's neighbor

JEFFERSON CITY — Authorities in mid-Missouri say a warrant served at a home in the neighborhood where a 9-year-old girl was found dead this past week was unrelated to the killing.

The Cole County Sheriff's Department served the warrant Friday night just hours after the body of Elizabeth Olten was discovered. The department said Tuesday the warrant was related to a traffic stop, not to the girl's death.

A court hearing is scheduled Wednesday on whether a 15-year-old charged in the killing should continue to be detained.

Juvenile Court Administrator Michael Couty said the teen won't be in the courtroom but will take part by videoconference.

Court officials brief press on juvenile trial case

COLE COUNTY -- The Cole County juvenile court sets hearing dates for the suspect in the Elizabeth Olten’s murder.

The teenager suspected has been in the custody of Cole County juvenile officials since her arrest Friday.

A judge tomorrow will decide whether she remains there until a Nov. 18 hearing on whether she will be tried as an adult

Juvenile Court Administrator Michael Couty told reporters the family of murder victim Elizabeth Olten has been briefed on the case against the 15-year-old suspected in Elizabeth's death. The next step is a detention hearing.

"In the juvenile setting, we do not have bail,” Couty said. “So this is to determine if we're going to detain within our detention facility or release somewhere else.”

Couty would not discuss the demeanor of the suspect in custody, saying only that her rights are assured. "To meet with their attorney, to meet with their family, and to be protected,” Couty said.

On Nov. 18, family court Judge Jon Beetem will decide whether the teenager will stand trial as an adult.   Couty said the juvenile court staff needs the three weeks until then to evaluate the suspect against the ten criteria dictated by statute and will present their recommendation to the court on Nov. 18.

If tried as an adult, the teenager could still become eligible for treatment through the state division of youth services.

"You'd have to have a certification and you'd have to have a finding of guilt and conviction in the adult courts for dual jurisdiction,” Legal Counsel Samantha Green said.

Green will act as the prosecutor if the case remains in juvenile court.

"She is very capable of dealing with these particular issues,” Couty said. “We will be ready for court on Nov. 18.”

Recent changes in state law have opened up the hearings for juvenile suspects to the public unless the judge specifically orders they be closed.

Juvenile Authority Director Michael Couty listed 10 criteria that are considered during the certification process. The judge will ultimately decide whether to charge the suspect as a juvenile or adult.

List of criteria considered during a certification hearing:

Seriousness of offense and consider the safety of the public if suspect should be transferred to general jurisdiction
Whether the offense involved vicious force and violence
Whether the offense was against a person or property, with greater weight given to offenses against a person, especially if personal injury resulted.
Was the offense was part of a repetitive pattern of offenses, where the child may be beyond rehabilitation under the juvenile code.
The record and history of the child in juvenile system and other courts will be considered
The sophistication and maturity of the child as determined by considering home, other environmental and emotional conditions and pattern of living.
Age of the child
Consider the programs available to the juvenile system.
Whether or not the child will benefit from treatment or rehabilitation programs available to the court.
Racial disparity and certification.

How do you rehabilitate a 15 yr old who murders a 9 yr old? What kind of program would that be, pray tell? Are there juvenile services for this?
