I thought the motion was the one that was filed late yesterday that Mumbles denied any knowledge of until JP pointed out it came from Mumbles office.  At which point JP asked what was different about this motion other then Finnell signing it from the last time they filed the same  motion and Mumbles had no idea.

She is definitely a psychopath. She meets some of the criteria for sociopath but not all.

According to the DSM-IV  anti-social personality disorder sociopathy also referred to as psychopathy are one in the same, there are some in the psychiatric community that seem to indicate there are differences and some that do not.

This is the same info I'm finding. The psychiatric community is pretty much equally divided when it come to the differentiation of the 2 pathos. This is where a neurology specialist comes into play. Then they take it from there for proper diagnosis. No esteemed doctor would ever diagnose based on an observance from tv or audio. The diagnosis would be done over a progression of time and would include technical medical testing. Baez specifically stated Casey was competent, didn't he? So how the he'll can he be attempting to make her appear to have a pathy or psychosis? Didn't he already take the psychologists off his list or something of the sort? Cappy, I really believe Baez is establishing a mental defense case for appeal after she's found guilty during this trial. Also, even if Baez gets disbarred after this case, the SOB will become uber wealthy by writing books & sitting on panels, etc. Despicable.

You cannot raise a mental defense of anti-social personality disorder as insanity, it does not meet the legal criteria for "insane."

ITA Capp they wont use this as a defense or that would hve been the opening statement hands down.

However I do beleive that Titch is right in her thuoghts on Casey and her personality disorder..and they will use it..just  not as a defense..but as a mitigating factor.

They were trying to show..notice were because I don't think it worked for the jury..that she was damaged goods from the incest within the family. 

There was, imo, no incest..none at all.

During mitigation they want the jury to believe that she has this personality disorder sociopathy, or whatever theory one might espouse to, due to abuse and therefore should not be put to death ..

Fine with me..I would love to see her do LWOP...she will be in Hell on Earth at Lowell Correctional Institution..

They can file appeals until the cows come home, but getting a new trial is a whole different story. To win an appeal there has to be an error in the procedures of law. With her having all the other attorneys although bozo might be disbarred, her overall trial was not put in jeopardy.

My brother saw a few minutes of the tapes and he said bozo evidently had never seen the tapes prior because there was so much he could have had redacted in the tapes if he had filed with the court.
