"The Modesto police did not immediately identify Peterson as a prime suspect, largely because Laci's family and friends maintained their faith in his innocence during the initial month after Laci's disappearance."

In 2005, Peterson was sentenced to death by lethal injection. He remains on death row in San Quentin State Prison while his case is on appeal to the Supreme Court of California. He maintains his innocence.

Then some of the old boys at the marina told us the story of how horrible the weather was that day for anyhing .. The weather was terrible and he would have no buisness catching fish on that day..

Even after all of that .. his family STILL thought he was innocent..

Peterson was arrested by Detective Taylor Burlingame on April 18, 2003 in La Jolla, California, in the parking lot of the Torrey Pines Golf Course, where he said he was meeting his father, brother, and Zak O'Regan for a game of golf. At the time of his arrest, Peterson was in possession of the following non-golf specific items: approximately $15,000 in cash; four cell phones; multiple credit cards belonging to various members of his family; an array of camping equipment, including knives, implements for warming food, tents and tarpaulins and also a water purifier; a dozen pairs of shoes; several changes of clothing; a t-handled double-edged dagger; a MapQuest map to Frey's workplace (printed the previous day); a shovel; rope; 24 blister packs of sleeping pills; Viagra; and his brother's driver's license.[15] His hair and goatee had been dyed blond, although he claimed the lighter hair color was the result of chlorine from swimming in a friend's pool. (The pool's owner later testified that, to his knowledge, Peterson had never swum in his pool, or made use of his hot tub.) [16]

And that was 11 days after Susan disappeared, with much higher temps.  The week of her disappearance, the lows were between 4 - 10 degrees, and the highs were in the teens.

So by the time of this report, the temps had warmed, and the lake was still frozen from the week before (and prior to that).

WEST VALLEY CITY, Utah (ABC 4 NEWS) - Josh Powell was busy packing up his home Thursday while Susan's family and friends got word a body was discovered about 40 miles west of Wendover wrapped in plastic and duct taped. They waited anxiously for an identity. To their relief it wasn't Susan.

The body discovered in a remote area west of Wendover is a hispanic male. The body is a person between 5 feet 4 inches and 5 feet 6 inches tall . Police can't confirm how he died or how long he's been there.

When news broke Susan's family and say they experienced a wide range of emotions. Friend Kiirsi Hellewell immediately broke into tears fearing the worst. Others said they were upset but we hoping for some closure and answers in Susan's disappearance.

Cox family spokesperson Shelby Gifford says Susan's parents are very relieved it wasn't He. Gifford says, "after everything that's gone on their hearts are pretty tender".

Chuck Cox posted on the Friends and Family of Susan Powell's Facebook page that, "The WVPD is doing a great job. The Press is as anxious as we are to have Susan found, unfortunately due to time lines, competition, and the needs of those investigating to build a legal case, the press is forced to speculate. We want to keep this page focused on finding Susan. We appreciate all of your prayers and... support. I will be sure that any verified news is posted here as soon as possible for all of you wonderful friends".

When it comes to friends Kiirsi Hellewell says Josh Powell doesn't feel like he has many at this point, he doesn't have a job and he said that's why he wants to sell the home and move to Washington. Hellewell said, "My husband will be helping him and we'll do anything we can to help him because he's still our friend, nothings been proven. He's still our friend".

Others are saying they aren't willing to help based off of Josh's behavior and refusal to cooperate with police. Still some are trying to stay neutral. Betty Trujillo lives next door and says she wishes Josh would stay and help. Trujillo said, "I don't know how I feel, I'm praying for the both of them. I'm praying she'll be found and come back and I'm praying for him come up with the truth.

Police are also hoping to get the truth from Josh. They say the 72-hour media blitz generated some positive leads. They are still asking Josh to come in and cooperate and answer additional questions. West Valley Police are saying that there will be some resolution to the case soon.

ABC 4 saw people packing things up at the Powell home last night. The moving truck is expected to arrive tomorrow. The invitation has gone out the Church member to help but friends say it will be interesting to see who actually show's up.

 A month after a former Puyallup woman was reported missing in Utah, her husband began packing for a permanent move to Washington.

Joshua Powell, the husband of Susan Powell, returned to Utah from Puyallup to retrieve his belongings, say friends and a spokeswoman for Susan Powell’s parents. He and the couple’s two young sons, Charlie, 4, and Braden, 2, had been staying with Joshua Powell’s father in Puyallup since Christmas.

Friends of the Powells have said Joshua Powell was fired from his job as a computer programmer for a trucking and warehousing company and now plans to sell the family’s home.

Joshua Powell remains the only person of interest investigators have identified in his wife’s case. He gave police a DNA sample but has not spoken with investigators in detail about his wife’s disappearance since hiring an attorney to represent him.

Police in West Valley City, Utah, still are awaiting state crime lab reports on the DNA tests and fiber evidence taken from the Powell home.

“We are not at a standstill by any means,” police Capt. Tom McLachlan said, noting the DNA results generally take four to eight weeks to process. “At this point, with the information we’ve got and the resources we’ve got, we’re feeling the situation will be resolved.”

Last month, police took fingerprint evidence off the front door of the Powell home and collected several items, including a bedspread and a carpet cleaner, according to neighbors.

Police have confirmed they found a large wet spot in the home with fans aimed at it to dry on the day Susan Powell was reported missing.

McLachlan said police are not concerned about the possible sale of the Powell home as evidence has already been gathered. But Joshua Powell’s limited responses during police interviews have hampered the investigation, he said. “What we’ve tried to do is verify what he’s told us in the limited interviews that he’s given,” McLachlan said. “Without his cooperation, it does seem a little bit at odds. It doesn’t help move the investigation forward.”

Friends and family members of Susan Powell, including parents Chuck and Judy Cox, have detailed the couple’s financial and marital problems.

Kiirsi Hellewell, a close friend of Susan's, said Josh has asked members of his LDS ward to help him move on Saturday. Hellewell said before Susan disappeared, Josh had started attending their ward again and has reportedly been attending church in Washington.

Susan Powell, 28, has been missing since Dec. 7. Josh told police he went camping in a remote area of Tooele County about 12:30 a.m. that day with his two boys. When he returned, his wife was gone. Thursday, a body wrapped in duct-taped plastic was discovered about 40 miles outside West Wendover, Nev., creating high speculation that Powell's body may have been found. Investigators determined quickly, however, the body was not Powell.

The family sent an update on the twitter page for Susan, expressing their condolences for the family of the victim, who detectives from the Elko County Sheriff's Office in Nevada said is that of a Hispanic male about 5 feet 5 inches tall. The body was discovered about noon Thursday in the Pilot Valley area, said Elko Undersheriff Doug Gailey.

Initial reports of the body led to speculation that it might be the remains of Susan Powell.

Hellewell said she was crying and shaking out of fear the body would be identified as Susan, which would have dashed any hope that she would be found alive.

"I'm pretty shaky — at the time, it was really horrendous," Hellewell said. "We are extremely relieved it's not her, but at the same time, it was like, let this be over. The waiting is the worst part."

With their hope of possibly finding Susan restored after a nerve-wracking couple of hours, Hellewell said friends and family devoted to finding her plan to work "harder than ever" by passing out more fliers and ribbons to spur efforts.

Without generated tips from a public awarenes regarding the description/mages of the vehicles which Josh Powell drove in that crucial time frame ... I cannot comprehend where a search for Susan's remains would be focused.

All the red flags direct at Josh Powell dictates that the locating of Susan Powell should have been LE's primary focus in the week following her disappearance.  However ... the vehicles were not used as tools immediately following the disappearance of this 28 year old mother ... the vehicles have yet to be used as tools in a search for her remains ...

There is Josh's van which was driven throughout the night and day of December 7th but ... there was also the rental vehical driven by this guy two days later ... accumulating hundreds of miles.  Was he dotting the i's and crossing the t's in regards to covering up his wrongdoing.

The YouTube of Josh's images that you are suggesting should also contain as much information as possible regarding the vehicles.

If investigators had done all this at the getgo ... when time had not deminished recollections ... maybe ... just maybe ... justice would be taking its course right now for Susan Powell.

In my opinion ... this young mom was betrayed by the Utah justice system.  The red flags directed at Josh Powell were all there to justify such action when time had not deminished recollections.  Maybe ... just maybe ... justice would currently  be taking it course.

Police ask why Powell drove so far in rental car

WEST VALLEY CITY — A car rented by Josh Powell two days after his wife was reported missing was returned just 24 hours later with a lot of miles on it, according to police.

"It looks like there were several hundred miles driven," West Valley Police Capt. Tom McLachlan told the Deseret News.

Investigators do not know where the car was taken or where Josh Powell was during that 24-hour period. There was no GPS data stored in that rental car, said McLachlan, who declined Monday to say from where the vehicle was rented.

Powell reportedly rented the car after police seized his minivan — his only vehicle — to be processed for evidence in connection with the disappearance of his wife, Susan Powell. The van has since been returned to Josh Powell.

Questions surrounding the rental car are just a few of many to which West Valley police would like Josh Powell to provide detailed answers. But as of Monday, they say, he continues to be non-forthcoming and has not accepted their open invitation to return to police headquarters for another interview.

Recovered body identified; American Fork man arrested in slaying

AMERICAN FORK — An American Fork man has been arrested in the shooting death of a Lehi man, and police believe he wrapped the body in plastic garbage bags and duct tape and dumped it in Elko County, Nev.

The body of Jesus Landin, 46, was discovered Thursday in the remote Pilot Springs area of Nevada near West Wendover, said American Fork Police Lt. Sam Liddiard. Ramon Alfredo Somoza, 29, was arrested for investigation of murder and obstruction of justice in connection with Landin's death.


Before the body was identified, speculation ran rampant Thursday afternoon that the victim was missing West Valley City mother Susan Powell.


American Fork detectives were already investigating Somoza before Landin's body was found. In fact, Liddiard said, Somoza was being interviewed by police Thursday afternoon when news broke about the body in Nevada. Police were able to use that discovery to add pressure to their interview, he said.

On Dec. 28, Landin told a friend he was leaving his home in Lehi to confront a previous employer about money owed to him, Liddiard said.

He went to the Apollo Dance Hall in American Fork where Somoza works, and Landin was not heard from again.


Landin calls his wife and other family members in Mexico several times every day, Liddiard said. When he failed to call for a couple of days, friends became concerned and contacted police Dec. 31 to make a missing-person report.

Going through his cell phone records, investigators determined Landin had last made a call Dec. 28 near the dance hall. Detectives later went through a Dumpster on the property of the dance hall. In it, they found pieces of carpet, padding, a sheet that appeared to have blood spatters on it and had a hole that appeared to be from a gunshot, as well as gunshot residue, Liddiard said.

The police work, combined with the timing of the body being found at the same time Somoza was being interviewed, resulted in a confession that the shooting had happened in a basement apartment of the dance hall, Liddiard said.

A photo was sent to investigators on the scene in Elko to confirm the identity of the body.

Late Thursday, American Fork police, with help from Tooele police, served a search warrant on the apartment to collect additional forensic evidence, including more blood, Liddiard said.

The vehicle used to transport the body to Nevada was found, as well as a gun inside. Landin's vehicle was discovered to have been taken away from the dance hall by a towing company.

Somoza was being held Friday in the Utah County Jail on $500,000 bail.
