Attorneys Battling It Out At Casey Hearing

ORANGE COUNTY, Fla. -- The case against Casey Anthony headed back to an Orange County court Friday morning where her defense team tried to convince the judge to dismiss her murder charge.

The defense filed a motion claiming the prosecutors refused them access to the crime scene, but it was actually prosecutors who asked for the hearing.

In the motions set to be heard Friday, the two sides accuse each other of everything from lying to the court to posing for inappropriate pictures at the crime scene where Caylee's body was found.

Prosecutors say the defense team is withholding trial and hearing witnesses from a required list.

Out of six experts the defense had at the crime scene where Caylee's body was found, only one, forensic expert Dr. Henry Lee, has been listed as a witness to date.

The state also claims the defense has refused to give up information they say proves Caylee's body was dumped after Casey was already in jail.

In August, the defense claimed to have "substantial evidence" of that timeline, but prosecutors say they have not disclosed that evidence. Defense attorneys say it is already in the court file, but will not say where.

Meanwhile, Casey's attorneys will level some heavy allegations against prosecutors Friday, insisting that the state intentionally misled the court and prevented the defense team from inspecting the crime scene where Caylee's body was found in December of 2008.

Defense lawyers argue that now they cannot effectively challenge prosecutors. For that the defense wants the judge to dismiss the charges against Casey.

Prosecutors claim that motion is legally flawed and should be thrown out.

How hard is it for Baez to transmit these photos using a secure server? There's a whole world of critical information being transmitted every day without being hacked. How long is this now he has had those photos? He could have driven them to the experts by now. What's wrong with Registered Mail....  it is as safe as anything out there. What an idiot.

Casey Anthony, the 23-year-old mother accused of killing her daughter, is court this morning.

The courtroom is packed with media as the hearing began shortly after 9:30 a.m. Casey Anthony smile at her parents, George and Cindy Anthony, as she walked into the courtroom.

The attorneys will not discuss the defense's motion to stop video taping Casey Anthony's jail visits.

Prosecutor Linda Drane Burdick said the defense suggested at a previous hearing that they are doing their own investigation and collected certain pieces of evidence that proves Casey Anthony is innocent. She is asking for them to turn over that evidence.

Casey Anthony's defense attorney, Jose Baez, said their case is based primarily on evidence provided by the state. And, he said, the defense is not obligated to show its hand to the state.

Her defense team has discovered evidence that Caylee's body was but in the woods - where her remains were later found - while Casey Anthony was in jail, Baez said.

Orange Circuit Court Judge Stan Strickland ordered the defense to turn over the information by Feb. 1 or explain why they can't.

Prosecutors also argued that the defense's motion to dismiss the first-degree murder and aggravated child abuse charges is not legally sufficient. Burdick said that Casey Anthony – who signed an affidavit in the motion – did not swear to any of the material facts of the case.

Defense attorney Andrea Lyon said Casey Anthony cannot swear to things she is not present for and the facts provided are backed up by documents from sworn law enforcement officers.

The judge may rule on the issue later today.

Strickland did grant the defense's request to get copies of photos from the crime scene. The attorneys had agreed to set up a computer server so defense experts could have access to the information.

Authorities feared the photos would be leaked to the public.

But the experts had trouble getting access to the server. That's why the defense is asking for copies of the photos, which will not be made public.

Late Thursday, prosecutors filed transcripts of depositions that have taken while preparing for trial.

Interviews with Casey Anthony's parents, George and Cindy Anthony, were made public, as was one with Anthony's brother, Lee Anthony.

The transcripts total more than 1,300 pages.

Anthony is accused of killing her 2-year-old daughter, Caylee Marie. The toddler was reported missing in July 2008 -- although Anthony told investigators that she had not seen her child since she left her with a babysitter mid-June. Investigators determined the nanny never existed.

In December, a meter reader found the girl's remains scattered in woods less than a mile from her family home in east Orange County.

The state is seeking the death penalty against Anthony, who remains in the Orange County Jail. Anthony is expected to attend today's hearing.

ORLANDO, Fla. -- A hearing was held Friday in the murder case against Casey Anthony, who is charged with murdering her daughter, Caylee.
A judge will consider motions to have criminal charges against her thrown out. Anthony, 23, is expected to attend the hearing.

Last week prosecutors released more evidence in their murder case, including pictures of a tattoo on Anthony's back and duct tape, which was located on Caylee's body.

Casey Anthony is charged with first-degree murder in Caylee's death. The toddler's remains were found in December 2008, months after she was reported missing.

Anthony has pleaded not guilty. She says a baby sitter kidnapped Caylee, who was 2 years old when she disappeared last summer.

The state is seeking the death penalty against Anthony, who remains in the Orange County Jail.

All I heard was the beginning about Bozo having to produce his proof (body put in woods after Casey was in jail) by Feb 1, something about the defense witness list...lost internet - came back to them whining about crime scene photos which should have been resolved over a half a year ago
