Judge Holds Off On Ruling On Casey Witness List

ORLANDO, Fla. -- Casey Anthony was in court Monday afternoon where her lawyers fought to keep the witness list in the death penalty phase of the trial from being made public.

Casey walked in about 10 minutes before the 1:30pm scheduled hearing wearing a long-sleeve, button-down white collar shirt with blue pinstripes. A camera inside the courtroom showed her mother, Cindy, was in attendance.

After about 15 minutes of each side stating their case, including an attorney with the Orlando Sentinel, Judge Belvin Perry said he was reserving ruling for a later time.

The defense previously failed to get Judge Perry to seal its death penalty witness list by order, so Monday Casey's lawyers tried to make convincing arguments to keep that list secret from the public.

The defense says some of Casey's relatives in Ohio and others, who have known her and her family since she was a child, don't want to help her stay off death row if she's convicted of murdering her daughter, Caylee Anthony, because they don't want to be contacted or covered by the media.

The defense says it has 50 witnesses who it plans to call on her behalf if she's convicted. Prosecutors have the list and will get the chance to depose the witnesses. But the defense wants to keep them and the information they would provide secret from the public, unless it becomes necessary if Casey's found guilty.
Prosecutors have listed what the law calls "aggravators," or legal reasons why Casey should be sentenced to death if she's convicted of murdering Caylee. The defense would argue what the law calls "mitigators," or legal reasons why she should not be sentenced to death, and would call its witnesses to underscore those arguments.

Mitigating circumstances could include: no significant criminal history, age, mental or emotional disturbance, extreme duress, or any other factors in the defendant's background that would mitigate against a death sentence.

Judge Perry did not say when he would rule on the defense's motion to keep the list secret. Casey waved to her mom when she entered and exited the courtroom.

I think it is necessary so the state can do their depositions.  May is quickly approaching.

Thanks. I guess I never realized that it would be needed until after she was found guilty. But that makes sense. It just seems like putting the cart before the horse.

The State does have to depose witnesses & prep which they do have time for these witnesses, agreed but interestingly it does not go unnoticed that the defense has been strongly focused on the DP phase more than the case-in-chief for some time now, to me its telling.   It says a lot that relatives do not want to testify on her behalf, or for that matter to support her shamefully horrific parents & brother.

Instead of Bozo having a cow over the press taking a pic of his client jotting down notes, he should be more concerned about how the State is going to be successful in proving their case against his client.   He is so trivial and arrogant, so much so that I think he actually sees someone else in his mind when he looks in the mirror, ironically, or not, its amazing how many personality traits he shares with his skank client.

Yes, that is what the Duffense says-  I wonder if they can prove that?  I don't know of any of Casey's relatives that have been hounded by the press or any media. All the name of her friends and relatives have been 'out there' since the beginning of this case and as far as I can see they are not being followed by reporters or paparazzi-  just another BS Duffense story.

WFTV-Channel 9 tonight explored that possibility that forensic expert Dr. Henry Lee might leave the Casey Anthony case.

“It’s all because of money problems,” anchor Martie Salt said in introducing the story at the top of the 5 p.m. newscast. Anthony is charged with first-degree murder in the death of her daughter, Caylee Marie.

Lee, who lives in Connecticut, wants reimbursement for his travel expenses as well as $7,500 for work last summer, WFTV’s Kathi Belich explained.

“Prosecutors can’t even  get Dr. Lee to commit to a deposition, which would have to be done before he would testify at Casey’s murder trial in May,”  Belich reported. “The defense claimed Dr. Lee helped  investigators find hairs in Casey’s car. If Lee drops out of the case, so could that defense claim that investigators weren’t thorough enough.”

WFTV legal analyst Bill Sheaffer called Lee “a very powerful tool to raise reasonable doubt.” Lee is best known for his work in the O.J. Simpson murder case.

At a hearing today, Judge Belvin Perry wondered if Lee was going to testify.  Belich highlighted that the state’s rules for indigent defendants, such as Anthony, require the use of Florida experts. 

WESH-Channel 2 and WOFL-Channel 35 focused on the defense’s push to keep sealed temporarily its list of witnesses in the death penalty phase of the case. The Orlando Sentinel argued that the list should be made public and that its publication wouldn’t jeopardize Anthony’s right to an impartial jury. The judge made no decision today.

I think he HAS to consider it. That doesn't mean he'll give them what they want. If he does, it will be because he doesn't want them to have anything to force a new trial down the road. He's not a Chief Justice for nothing, IMO.

Thats exactly right, he's a highly regarded Chief Justice & knows precisely what he is doing & the law is pretty much written in the palm of his hand.    That being said, the reason he reserved ruling was because the defense motion was a) too broad b) did not meet the threshold for consideration at this time.

Casey looked like jail is wearing on her at last. She looked so unkempt today and her expressions went from annoyed, haughty to downright worried and fearful. The look she gave Mason today when she was leaving was downright scary.  I saw she smiled and waved at Spindy. She must need some money put in her commissary account.

I'm assuming the people in Ohio may be George's family. Maybe they don't want to agree to throw George under the bus as a child abuser, or whatever the defense is trying to portray him as, in order for mitigation in the death penalty phase.

I tend to agree with you. The defense team is running out of time. Things must be taken care of and as each deadline approaches, something goes by the wayside. I believe they attempted to plant hair (slight of hand trick Lee is becoming more famous for than his legitimate skills as a forensic expert was long ago).  I agree that Lee is running scared yet again his misdeeds will be brought out more than he is worried about getting paid.

ORLANDO, Fla. -- A judge will decide in the coming days whether to make public a list of witnesses who may testify for the defense during a penalty phase of Casey Anthony's trial for the death of her 2-year-old daughter.

Judge Belvin Perry heard arguments on Monday over whether a defense witness list should be made public if Anthony is convicted and there is a penalty phase.

Defense attorney Ann Finnell says the media has no constitutional right to the witness list. She says Anthony's attorneys are concerned that witnesses may be harassed by reporters and reluctant to testify if the list is made public.

Anthony is charged with first-degree murder. Her daughter, Caylee, disappeared in June 2008 and her remains were found the following December.

Anthony has pleaded not guilty and says a baby sitter kidnapped Caylee.

So, watching the court events of today, now, and I got to say, Ann Finell (is that her name, and is she really a she?) drones on and on and is so boring, she would be a good tool to induce hypnosis.

So, did KC's comb/brush break and they do not have any new ones in the commissary or maybe buying out the pork rinds has left her broke?   She is such an ugly inmate.  She is so horse-faced and cold looking and those faces she makes when she is trying to look interested, I am sure, will not pass over the jury at all.  They will see right thorough her.

BP's faces are classic.  He has the look as if somebody is telling him a big BS story.

Poor Bozo's client is being photographed writing notes.  Oh noes!!!!!!!  That note writing is just disgusting.  I wonder which photographer was taking the pictures, LOL.  he should just leave the camera focused on her at all times just to piss Bozo off.

Casey Anthony Loses Dr.Henry Lee?

Yes, but I didn't hear him tell them to narrow it, unless I missed that part.
I thought Ann Finell disagreed that it was too broad.

Nope you are correct, he did not offer that. Imo, he is simply going to have his JA or para's research the case law and interpret it in his ruling.

He will deny the motion, imo, without prejudice as long as the defense files a motion to seal with specificity and particulars, justifying a possible in camera inspection by the judge, but they will not get a carte blanche "let's hide them all under the blanket" ruling.

Atty Finnell should consult with Mr. Baez if she feels that pre-trial publicity has already prejudiced her client, he fought a gag order and her client got paid a fat sum she would not have if he did not.

The way I understood it, even though I was having a hard time staying focused due to boredom, the judge did not do anything.  He just said he would give his ruling later.  He did not tell the Duhfense to be more clear on who they want sealed, but I imagine Bozo will now file another motion doing just that, but it will be for all 50 people on their list, one motion at a time.  What a putz.  The putz is so stupid that he will file 50 motions.  Watch!!!

I really wish that the judge would stop Bozo's chit.  And I wish he would tell them to stop passing notes like school children during a test.  What he does not get to talk to her enough?  What could she possibly be contributing?  She is prob just beotching about how she don't like this one or that one, and the judge hates me, waaaahhhhhh carp.  I bet those notes said something about her clothes being wrinkled, and her not being able to do up her doo to her liking. 

I cannot wait till May and she fries, but then my problem will be, where will I direct all my hate then?  She will be convicted, probably get life, and somebody in gen pop will fix her.  I will have to move on, sigh. 

Isn't Scott Peterson's appeal under way yet?  I could rage on him for a while I guess.  There is always Hayleigh's murderer if she/he is ever found, or Baby Gabriel's (insert profanity here) mother egg donor.  The choices are endless.  Nobody does me like this one though.  I seeth when I see her.

This is the first time I realized the hairs (except for one) Dr Lee found were in the garbage bag and not in the trunk. Most of them were found in the bag by CSI Boise after Wee left.

George Anthony Responds To Allegations
Statement Comes After Friday's Release Of Documents

ORLANDO, Fla. -- The father of Casey Anthony has responded to allegations made in a release of documents on Friday.
In the documents, a woman known as both River Cruz and Krystal Holloway said she became a close confidante of George Anthony.

The documents indicated that Cruz told investigators that George Anthony told her he believed Casey Anthony killed his granddaughter, Caylee Anthony.

A statement released by George Anthony's attorneys said, "At no time did George Anthony become 'more than friends' with Holloway/Cruz."

The statement also said, "At no time did George Anthony grab Casey Anthony around the neck or throw her against a wall," and, "At no time did George Anthony confide any of his opinions or thoughts to Holloway/Cruz regarding this case."

It’s off the air for the last two weeks of the year. “Normally, there’s little court activity,” an “In Session” spokeswoman said.

It’s a standard procedure with truTV taking over programming the “In Session” time slot the final weeks of the year.

Motions Seek To Prevent Mention Of Knife, Shovel, Map And Sexual History

ORLANDO, Fla. -- Attorneys for accused child-killer Casey Anthony filed six motions Tuesday seeking to prevent a jury from ever hearing about several items and alleged incidents uncovered by Orange County sheriff’s investigators.

# Among the possible evidence and testimony Anthony wants excluded from her trial in the death of her daughter, Caylee:

      Her borrowing a shovel from neighbor Brian Burner in the days just after Caylee disappeared in June 2008.

      A table knife recovered from the car she was driving in the weeks after the disappearance.

      An encounter her father George had with Texas Equusearch founder Tim Miller, during which Miller claims Casey Anthony was “about to mark on a map where the body was” but failed to respond to a request that she do so.

      Assertions by Anthony family members that Casey has “a history of lying and/or stealing.”

      Sexual relationships Casey Anthony may have had with two men, including her last boyfriend, Anthony Lazzaro.

The motions ask Judge Belvin Perry to order the state to respond and set a date to hear arguments on whether the information should be excluded from the trial.

Each of the six motions details the defense’s arguments:

The Shovel
ust days after Caylee disappeared in June 2008, next-door neighbor Brian Burner recalls Casey Anthony borrowing his shovel and returning it within hours. The defense argues this information should be excluded because it, “has not been linked by witness to any forensic evidence whatsoever to any aspect of this case.”

If Burner’s testimony is admitted, it could prove damaging to the defense if jurors wonder why a mother -- whose 2-year-old daughter is missing-- would seek to borrow a shovel from a neighbor to, “dig up a bamboo root that she’s been tripping over,” as the neighbor recalls Casey saying.

Cadaver-sniffing dogs later alerted in the backyard of the Anthony home on Hopespring Drive, according to sheriff’s reports. The prosecution may argue that indicates Caylee’s body was placed in that backyard prior to being dumped around the corner of the home along Suburban Drive, where it was found nearly six months later in December 2008.

“Whether or not Ms. Anthony borrowed a shovel from Mr. Burner does not in any way make the charged offense more or less probable,” the defense motions states. “There is no evidence that Ms. Anthony used or intended to use the borrowed shovel to facilitate the commission of any of the charged crimes.”

The Knife

A table knife recovered by Cindy Anthony from the car her daughter was using, “is utterly irrelevant to the case at hand,” the defense argues. “Forensic testing on the table knife revealed no connection between the table knife and duct tape, the victim or any DNA.”

The knife was tested to determine if it was used to cut the duct tape that was found partially wrapped around Caylee’s skull, and no connection was noted in FBI lab reports.

The Map Scenario

Texas Equusearch founder Tim Miller claims that during a meeting with the Anthony family before Caylee’s body was found, he believed Casey was “about to mark on a map where the body was.” But, instead, Casey did not respond to the offer, Miller claims.
Such speculation is totally unfounded, irrelevant and immaterial, and should in no way be admitted or testified to by any witness,” the defense argues in its motion.

History Of Lying

Members of the Anthony family have told investigators she has a history of lying and stealing, but the defense says "there are no allegations that character history of the defendant had anything to do with the charged offenses. ... Such improper character evidence" would be so prejudicial, it would outweigh any potential benefit it might have in leading a jury to a just verdict.

Sexual History

Two of the defense motions seek to block any mention of Casey Anthony’s sexual history with two men: Anthony Lazzaro and Anthony Rusciano.

Rusciano, a former boyfriend, and Lazzaro, her last boyfriend, were quizzed about their sexual history by detectives -- interviews the defense argues “are not relevant or material to any issue in this case and, further, are scandalous.”

The state attorney’s office will not comment on pending motions, but if ordered, they will have to reveal to Judge Perry whether they think any of the testimony should be allowed into evidence and, if so, why.

Casey Anthony defense attorneys filed a series of motions late today designed to keep statements they claim may prejudice the client out of the upcoming first-degree murder trial.

Among the statements they want blocked from entering the trial: Casey Anthony's sexual relations with Anthony Lazaro and Anthony Rosciano.

One motion filed today complains about detectives who interviewed Rosciano "regarding his alleged sexual relationship" with Casey Anthony.

Defense attorneys Cheney Mason and Jose Baez call the questioning improper and "not relevant or material to any issue in this case." It goes on to say the questions and responses are "scandalous and incompetent and should not be allowed in any aspects of this case."

The defense particularly takes issue with detective Yuri Melich asking, "How was she when she had sex? Was she one of those people that would be real clingy, or was it just matter of factly (sic), or was it just okay, we're done, I'm going home?"
Casey Anthony, 24, is charged with first-degree murder in the death of her 2-year-old Caylee Marie. Her trial is scheduled to begin in May.

Casey Anthony’s attorneys are arguing that some evidence, including her sexual history, is irrelevant to her murder case and could prejudice a jury, WKMG-Channel 6 reported tonight.

“According to court records, Casey Anthony once had numerous sex partners,” Mike DeForest reported. “Tonight Anthony’s attorneys are trying to prevent jurors from hearing details about her intimate relationships.”

DeForest also highlighted that Anthony’s attorneys: 

***Want Anthony’s prior thefts and lies kept from the jury, arguing, “There are no allegations that the character history of the defendant had anything to do with the charged offenses.”

***Don’t want jurors to see a shovel that Anthony borrowed from a neighbor after her daughter, Caylee, disappeared. Anthony is charged with first-degree murder in the death of Caylee. DeForest added, “The defense accurately points out that there is no evidence which links the shovel to the commission of any of the charges.”

Judge Belvin Perry will rule on whether the evidence will be allowed before the trial starts in May, DeForest explained.

Anchor Lauren Rowe wanted odds on whether the defense team would be successful. “It’s certainly possible the prosecutors may look at this and say, ‘Hey, we weren’t going to use that evidence at trial anyway,’ ” DeForest said. ”But others, there may be a big courtroom battle over it.”

Also tonight, WESH-Channel 2 shared a statement from George Anthony’s attorneys. The statement came in response to comments by Krystal Holloway — also known as River Cruz — who says she became a confidante of George Anthony. In documents released this week, Holloway said that George Anthony confided to her that he believed Casey had killed Caylee and that he had tried to choke his daughter.
he statement from Lippman Law Offices reads, “At no time did George Anthony become ‘more than friends’ with Holloway/Cruz. At no time did George Anthony confide any of his opinions or thoughts to Holloway/Cruz regarding this case. At no time did George Anthony grab Casey Anthony around the neck or throw her against a wall.”

More motions were filed in the Casey Anthony case late Tuesday. Her defense team is trying to keep certain evidence and statements out of court when the case goes to trial in May.

Anthony, 24, is charged with first-degree murder in the 2008 death of her 2-year-old daughter, Caylee Marie. She has pleaded not guilty, claiming a babysitter kidnapped her toddler. Caylee was last seen in June of 2008, but she was not reported missing until a month later. Her remains were found in woods near the family's home in December 2008.

Casey's lawyer, Cheney Mason, wants to keep out all mention of a table knife that was apparently found in the trunk of Casey's car where investigators say Caylee's remains were at one time.
Another item the defense wants kept from court is the interview with Casey's neighbor who claimed he loaned her a shovel. Police processed that shovel for evidence of Caylee's murder but nothing was found on it.

No word on when the judge will rule on these motions.

Among the statements they want blocked from entering the trial: Casey Anthony's sexual relations with Anthony Lazzaro and Anthony Rusciano.

One motion filed today complains about detectives who interviewed Rusciano "regarding his alleged sexual relationship" with Casey Anthony.

The motion regarding Lazzaro includes similar language and arguments. Including testimony about their sexual relationship "would create a danger of unfair prejudice" and failing to exclude it "would seriously and irreparably undermine Ms. Anthony's right to a fair trial."

Casey Anthony, 24, is charged with first-degree murder in the death of her 2-year-old Caylee Marie. Her trial is scheduled to begin in May. The child's remains were found in a heavily wooded area not far from the Anthony home in east Orange in December 2008.

The defense team filed six motions late today, seeking to block certain testimony from several witnesses, including her father.

The defense wants to block statements from George Anthony, asserting that Casey Anthony has "a history of lying and/or has a history of stealing."

Again, the defense argues such statements are not relevant and would unfairly prejudice their client.

"Ms. Anthony has been charged with capital first degree murder, aggravated child abuse, and four counts of providing false information to a law enforcement officer," the motion states. "Evidence that there was a history of lying or stealing does not tend to prove any element of the offenses for which she is charged and, thus, is inadmissible as irrelevant."

The defense also wants the court to prohibit the prosecution from introducing a "table knife" found in Casey Anthony's case and testimony related to the knife.

"There is no witness, scientific, or forensic, evidence to link this table knife to any issue in this case," that motion states.
Yet another motion seeks to block the testimony of neighbor Brian Burner, regarding Casey Anthony's borrowing a shovel.

"The shovel has not been linked by witness or any forensic evidence whatsoever to any aspect of this case and, accordingly, is irrelevant and immaterial," the defense motion argues.

Burner told a detective in mid-July 2008 that during the week of June 16, 2008, Casey Anthony asked for a shovel to "dig up…um…a bamboo root that she's been tripping over…and I agree. I said, 'Yeah I have a shovel that you can use.'"

The defense motion states, "Evidence that Ms. Anthony borrowed a shovel from her neighbor does not tend to prove any element of the offenses for which she is charged and, thus, is inadmissible as irrelevant."

Finally, in a sixth motion, the defense wants to prohibit testimony from Texas EquuSearch President Tim Miller and his "opinion" to a detective and others that Casey Anthony on certain occasions was "about to mark on a map where the body was."

Anthony's attorneys say discovery provided by the prosecution indicated their client was questioned at home about Caylee Marie and shown a map. "She was asked to mark where [the] body would be found," the motion says. "She did not respond."

Any reference to the map and the request must be excluded from the trial to protect her right to a fair trial, the defense argues.

For each of the motions filed Tuesday, the defense is asking for a response from the state and hearing on the issues. The defense said it also reserves the right to renew the motions at trial.

Late Tuesday, Casey's lead defense attorney, Jose Baez, filed six motions asking Chief Judge Belvin Perry to exclude key evidence and testimony in the murder case. The attorneys said certain pieces of evidence are "irrelevant and scandalous."

The evidence includes Casey's sexual history, and testimony from her ex-boyfriend Tony Lazzaro.

WFTV's legal analyst Bill Sheaffer said it will be a hard sell for the defense team.

"It's very important to show at the time that Caylee went missing that Casey's conduct was inconsistent with a mother whose child had gone missing," Sheaffer said.

Casey's parents have made statements stating that their daughter has a history of lying and stealing. But attorneys say Casey's character history has nothing to do with the allegations that she murdered her daughter, Caylee.

The defense also wants to keep the jury from hearing about a table knife found in Casey's car, and speculation that she almost told Texas Equusearch founder, Tim Miller, where Caylee's body was located.

Bill Sheaffer, says certain statements from Casey's parents about her past are irrelevant along with that table knife since Caylee wasn't stabbed.

Defense attorneys also don't want the jury to hear about the shovel Casey borrowed from a neighbor, after Caylee disappeared. The defense says the shovel has not been linked to a crime by her neighbor or forensic evidence.

"The shovel will probably come in. The reason being is that circumstantially that's consistent with the cadaver dogs having hit on Caylee's body in the back yard," Sheaffer said.

The defense is asking for prosecutors to respond to the motions and for a hearing.

If state prosecutors are forced to respond to the motions in writing and open court, the defense will learn more about their strategy in this case.

A hearing date to take up these motions has not been set.

Anywho, back on topic.  Wish the judge could put in a blanket "DENIED" order that will cover any and all of Bozo's stupid motions.   

With the spirit of Xmas within me today (huge shock cause I hate Xmas), I cannot think of a warmer fuzzier thought than BF (Beotchface ICA) being locked up in her cell while the rest of the world shares the holiday with each other. Maybe the jail is nice and puts up a little tree and maybe she will get special food. 

I love that it has been how long ICA is in the pokey now.  It will get her used to that stinky life sentence she is going to get.  Maybe she will get some commisary items for Xmas, if she has money in there.  I am sure it is  ::monkeywine2:: for ICA.   At least her daughter has the last laugh while she is surrounded by angels laughing at her sorry excuse for a mother.

IMO, the statements about Casey lying to and stealing from people show that through her life, she showed little regard for others.  She didn't care who she stole from or who she lied to as long as she benefited. She doesn't care that she stole Caylee's life and has told the most outrageous lies to cover it up. I think this needs to be allowed.  She is a convicted felon for stealing while her daughter was lying in the swampy woods....this just has to come into play during the trial, I would think.

Casey Anthony’s defense team filed six new motions Tuesday, all aimed at keeping possible evidence out of the courtroom.

Anthony’s attorneys said they are focused on testimony about her sexual relationships.

Detectives interviewed two men who claimed to have had sexual relations with Casey, asking them questions like “How was she?”

Defense attorneys said that line of questioning is irrelevant to the case, and could create unfair prejudice against their client, who is accused of killing her 2-year-old daughter, Caylee.

The defense said it also wants to block testimony from Casey’s father, George Anthony, who at one point said his daughter had a history of lying and stealing.

Those statements, according to Casey’s lawyers, are also not relevant to the case against her.

Other evidence the defense said is irrelevant include a table knife found in Casey’s car, and a shovel she borrowed from a neighbor while Caylee was still missing.

There has been no forensic evidence that the knife was used to kill Caylee or cut the duct tape found on her remains.

As for the shovel, Casey had told her neighbor she needed to dig up a bamboo root that she had tripped over in her backyard.

Cadaver dogs eventually picked up a scent in the backyard, but the defense said there was no evidence that she used or intended to use the shovel to commit a crime.

The defense team has asked for a hearing and response from the state of Florida on their six motions, and could even renew them when the trial starts in May 2011.

ORLANDO, Fla. -- Attorneys for Casey Anthony want a judge to prohibit testimony about her sex life with a witness during her murder trial next year.

Anthony's attorneys filed a motion Wednesday asking that sex-related questions from an interview detectives had with Anthony Rosciano not be allowed during trial.

Detectives asked Rosciano whether Anthony was "clingy" when she had sex, whether they used protection, whether Anthony had any sexually transmitted diseases and where they had sex. Defense attorneys say the questions are irrelevant.

Anthony is charged with first-degree murder for the death of her 2-year-old daughter. She has pleaded not guilty and says a baby sitter kidnapped Caylee.

Anthony's trial is scheduled to begin in May.

Well, yeah.  Her behaviour is scandalous.  I think a persons character (what are they capable of?) is definitely germane to whether they are possibly guilty or not guilty.    So scandalous yes, irrelevant, not so much.

I think it is relevant too. I am sure when Casey is presented in court, we will not recognize her as the person we all know. She will be dressed demurely and the defense will speak of her as an innocent damsel who is still virginal (except she had Caylee) and never did a thing wrong in her life...... ORLANDO, Fla. -- Six motions were filed on Tuesday that attorneys for Casey Anthony said will protect their client's right to a fair trial.

The motions seek to prevent a jury from hearing statements provided to detectives regarding Anthony's sexual relationships with Anthony Rusciano and Anthony Lazarro.

Attorneys Jose Baez and Cheney Mason say the inquiries are improper.
"Previous sexual relationship between Mr. Lazarro and Miss Anthony is wholly irrelevant and a violation of Miss Anthony's right to privacy," Baez said.

Baez and Mason said it's the same case with statements from Rusciano.

In another motion, defense attorneys want to prohibit a table knife from being discussed at trial. Investigators said they found such a knife in Anthony's car.

"There is no evidence which links the knife to the commission of any of the charges," the motion stated.

Anthony was charged with first-degree murder involving the death of her 2-year-old daughter, Caylee Anthony.

Caylee's remains were found in a wooded area not far from the Anthonys' home in December 2008.

Prosecutors call for sanctions against the Casey Anthony defense

A prosecutor in the Casey Anthony case is calling for legal sanctions against the defense for failing to follow a court order and provide detailed information about the pending testimony of expert witnesses.

In a newly filed motion, Assistant State Attorney Jeff Ashton argues, "the state would contend that the defendant is in deliberate non-compliance with the court's order as to certain of their listed experts and that sanctions to address the non-compliance are necessary."

Ashton notes that the defense has said expert Dr. Henry Lee "will render opinions on…crime scene analysis, collection and preservation as well as recovery."

But he says the defense team's inability to summarize so-called "false claims" by crime scene investigators that Lee will rebut "is disingenuous and just plain laughable."
If Dr. Lee has no opinions that would impeach the testimony of any witness, then compliance with this court's order would require a statement to that effect," Ashton argued. "If he has relevant opinions, the court's order requires that they be listed and the facts supporting them be clearly stated."

Ashton also questions what opinions Dr. Werner Spitz would offer and whether they differ from those of Orange-Osceola Chief Medical Examiner Jan Garavaglia.

Likewise, Ashton questions what defense experts Kathy Reichs and William Rodriguez will state to "'rebut false claims raised by the State's forensic anthropologists,' which cannot be known until they testify. Again a disingenuous and laughable claim."

"The intent of the defense to defy the authority of this court to issue orders of discovery is crystal clear," Ashton wrote.

The motion also questions the testimony of DNA expert Richard Eikelenboom.

"Once again, it is impossible to determine which of the over thirty experts and a dozen crime scene technicians that the witness will allegedly rebut," Ashton says. "The excuse provided is laughable and indicative of the deliberate attempt to flaunt the rules and intent of discovery and this court's order."

Casey Anthony is accused of killing her 2-year-old daughter in 2008. Anthony is charged with first-degree murder in Caylee Marie's death. She remains held without bail at the Orange County Jail. Her trial is scheduled for May.

So Spindy washed this knife.  Did she then put it in her dish drainer to dry, or was it dishwasher washed?  Then, how would she know which knife out of all her knives it was.  I bet it was not even the knife that was in the car that is in evidence now.  That would be something she would do in a heartbeat.

Also, all those prior judge's ruling that he re-motioned to new judge, probably getting time to resubmit those again. 

I am expecting the written motion on ordering the photographers to not photograph his client writing notes.

Reporters and analysts today continued to explore six motions that Casey Anthony’s defense team filed late yesterday to exclude evidence from the murder trial and ensure their client receives a fair trial. Anthony is charged with first-degree murder in the death of her daughter, Caylee.

WFTV-Channel 9 focused on the defense’s attempt to block information about Anthony’s sex life with two men. WFTV legal analyst Bill Sheaffer explained that is a hard sell for the defense. “It’s very important for the state to show that at the time Caylee went missing that Casey’s  conduct was inconsistent with a mother whose child had gone missing,” Sheaffer said.

The defense also wants to keep out information about a shovel that Casey borrowed from a neighbor after Caylee disappeared. Sheaffer predicted the shovel will be part of the trial because “that’s circumstantially consistent with the cadaver dogs hitting on Caylee’s body in the back yard.”

WESH-Channel 2 highlighted a motion to block discussion about a table knife found in Anthony’s car. The defense says there is no evidence that links the knife to the commission of any of the charges.

WESH’s Gail Paschall-Brown described a motion to block testimony from Texas EquuSearch founder Tim Miller. He said that Casey seemed ready to mark on a map where her daughter’s body was. The defense calls Miller’s comment “speculation” that is “unfounded, irrelevant and immaterial.”

Central Florida News 13 highlighted that the defense wants to block testimony from George Anthony, who said his daughter has a history of stealing.

Judge Belvin Perry has scheduled a hearing on the motions for 1:30 p.m. Jan. 3.

I am thrilled to see JA take this hard line approach on the matter after doing nothing but attempting to gain compliance on simple reciprocal information due the state.  This is not some parlor slight of hand trick, it is a murder trial of a 34 month old baby he is playing fast and loose with.

I doubt he'll get disbarred, although we can always hope.
They'll say he's new to all this, and the best we can hope for are some sanctions against him and Foghorn.

If the theory is put out there that Casey killed Caylee because she wanted to persue her own pleasures without the burden of a child, then her sex life is relevent. If self absorbtion is motive, then the prosecution is going to have to establish a picture of who Casey is. They have a lot of help that we already know about when you consider the party pictures, and the picture that emerges is really damning. I don't think the court will exclude sexual behavior.

I'm thinking the defense is probably going to hit hard Casey as "victim" to Cindy's control and the sexual history and party photos makes it hard to paint her in brush strokes of "innocent, poor thing". I really don't think they have a clear strategy, but are playing with Caylee dying accidently and Casey too fearful of Mom to admit it so she disposed of the body. One thing's for sure....... they will not continue with the Zanny story; that's impossible to do with a straight face.

I think it was a calculated move and she capitalized on LE dragging their feet to gather the evidence from the car. She was quick to flaunt that the evidence had been there and if LE had wanted it, they should have gotten it. There's a little truth in that, but IMO, Cindy was anxiously watching the clock ready to jump as soon as she dared, to clean up after her daughter. JMO.

ORANGE COUNTY, Fla. -- The man who found Caylee Anthony's body in the woods is back to being a hero in the case. It looks like the defense abandoned its claims that Roy Kronk should be a suspect instead.

More than a year ago, Casey Anthony's defense team attacked one of the key prosecution witnesses, Roy Kronk, the Orange County meter reader who found Caylee's remains in December 2008, but also reported finding them four months earlier in the same wooded area near the Anthonys' home.

Kronk's earlier report was not fully investigated by a patrol deputy, who was later fired. In an attempt to cast doubt on Kronk's damaging testimony, the defense said he should be a suspect and got people in Kronk's past to make disturbing accusations against him.

The defense had until December 23 to ask Chief Judge Belvin Perry to bring those accusations against Kronk into the trial so a jury could hear them. It didn't happen.

"The defense was floating balloons to see how this shift of focus from Casey to Kronk would play out. It did not play out well at all. It backfired," WFTV legal analyst Bill Sheaffer said.
Kronk has told WFTV he was horrified over the defense team's accusations and has denied being involved in her murder.

Thursday, Kronk's attorney said this validates what they've said all along, "that the Anthony defense's attacks on Roy were not only false, unfair and designed to deflect attention from Casey Anthony, but also a losing strategy."

Anthony’s attorneys have dropped plans to suggest that Roy Kronk is a suspect in Caylee Anthony’s murder, WFTV-Channel 9 reported tonight.

Kronk was the meter reader who found the toddler’s remains two years ago. Casey Anthony is charged with first-degree murder in the death of her daughter. Her trial begins in May.

Defense lawyers Baez and Jonathan Kasen said they intend to attack the state's case by assailing detective Dan Conlee for zeroing in too quickly on Diaz, by criticizing the work of a medical examiner and by accusing the young mother. They pointed an accusing finger Tuesday at the slain toddler's mother, saying she had treated the 2-year-old like "an animal."


In his closing remarks, Diaz's lawyer, Jose Baez, attacked prosecutors, sheriff's Detective Dan Conlee, the state's medical experts and the child's mother, suggesting they all distorted the truth in their pursuit of Diaz, the lone suspect in the toddler's death.

A jury of eight women and four men deliberated more than seven hours before deciding Nilton Diaz, 30, was guilty of manslaughter and child abuse. Diaz, who had been charged with first-degree murder and aggravated child abuse, seemed stunned by the verdict. He looked to his lawyer for an explanation.


Defense lawyer Jose Baez asked Circuit Judge Mark Nacke to set aside the verdicts, arguing they were based on undependable, controversial and conflicting medical evidence. Baez said the prosecution's case was filled with reasonable doubts.

"We all know something happened to this child, but we still don't know what," Baez said. "What it basically boils down to is pure speculation."

"This simply can't stand," Baez said. He argued the jury's verdicts were inconsistent. Baez said child abuse is an intentional act, while manslaughter is a death resulting from an unintentional act. He said an appeal would raise that issue.

Nacke refused to overturn the verdicts.


In documents seeking a new trial and other post-conviction relief, Diaz says he lost his freedom because of Baez's trial performance, strategy and failure to disclose evidence to prosecutors, a tactical decision that prevented jurors from viewing a defense video. Diaz said “…Mr. Baez wanted to surprise the prosecution, and the surprise blew up in the defense’s face.”

Baez, was not allowed to show jurors computer animation that depicted Silva injuring the child, accused the state's medical experts of "recklessly giving opinions." The defense has portrayed Silva as a lying child abuser and a bad mother.

The video, created by a biomechanical expert, would have shown the jury how the toddler's skull fracture could have been an accident, according to new court filings.


Nilton Diaz, filed a motion for a new trial, claiming he was convicted due to the “defectiveness” of his defense attorney, Jose Baez.

Baez called it a common post-conviction strategy that often cites defense mistakes to win a new trial.

Okay, so reading these motions, the first one anyway.  I read the first line and I am blond and stuff, and I am no legal expert, and granted, I probably should shut my piehole, and I just spent 6 hours in the stores Xmas shopping for my miscreant children who will take 2 seconds to unwrap and then maybe a week to break/lose what I spent probably a whole month's pay on, so I am tired, but.............................

Regarding Christine Balland, who is supposed to "testify as to the creation of a video superimposition involving a photograph of Caylee Anthony in life, a photograph of her skull (according to Cindy, her skull is still very much on her head and being used) and a photograph of the duct tape found with her skull.  She will testify that the photograph appear (yes bozo left off the s, putz) in 1 to 1 ratio in the superimposition based upon measurement and comparisons of dentition ........."  Okay , so herein lies my issue.  This is bozo's expert, and in my mind that above quote reads that yes, when you superimpose her photo over the skull, its a match............ and the duct tape lines up with where the state said it was.  Right?  Isn't that what 1 to 1 means, or scale, or a match?  What good is this witness? 

Maybe I am the putz.  I had to type it cause I could not cut and past for some reason.  I think I got it all there.

See, I am the putz, it was the States list and her information was missing on the original documentation provided to the Duhfense.  No wonder why she was a good witness for the state.  Gonna go get some sleep now.  Hey, I own my putzness when I need to.   ::MonkeyAngel::

Must they start every motion I have ever read with "COMES NOW."  Why not say, Regarding or something else?  Do they have like motion forms they use?  Such weirdness to me.

I love Ashton.  He has a loud voice, and when he is arguing his case, he is so polite, and almost innocent looking, stands there holding his hands together, but you know what he is saying, he gets my attention.  Plus, he is much nicer to look at than oh Bozo, jug-head, that other woman who has now left, and this new one.  The whole state's team is so professional and nice looking, prepared, etc. 

In comparison, we have a putz trying to do what he has no business doing and it shows.  What exactly is jug-head there for?  I have seen him do nothing lately, but get denied on a few motions a few months back.   He sits, dozes off, checks his tie, and is a slob.  He dresses a lot nicer than the Angel of DP did though.

What is the name of the Lady State Lawyer, who I also find to be very professional, and I enjoy watching her too. 

If I were the State, I would have a very hard time not rolling my eyes at Bozo or laughing all the time, but they hold themselves very professionally.  I can bet, when ICA is convicted, the state will be going out for a night on the town to let all the frustration of holding in all the stuff they have had to hold in for so long.

Not so, WKMG-Channel 6 reports. “Anthony’s attorney Jose Baez tells Local 6 that reports he is backing off the meter reader are ‘100 percent false,’ ” anchor Jessica Sanchez said this morning.

Kronk was the meter reader who found the toddler’s remains two years ago. Casey Anthony is charged with first-degree murder in the death of her daughter. Her trial begins in May.

WKMG noted that the defense was required to call for a court hearing on the Kronk matter by Thursday. “The hearing never occurred,” Sanchez said.

WFTV-Channel 9 speculated that the defense was dropping the Kronk-as-suspect strategy because of that deadline. “The defense had until today to ask Chief Judge Belvin Perry to bring those accusations against Kronk into the trial so a jury could hear them. It did not happen,” WFTV’s Kathi Belich reported last night.

WFTV evidently hadn’t talked to Baez, but based its story on the deadline. Or maybe Baez wouldn’t talk  to WFTV; he has shown disdain for the station’s reporting.

The friction between Baez and WFTV adds a fascinating wrinkle to the coverage.

On the Local 6 news tonight there was a segment on KC and the Kronk motion. Baez told the reporter the Kronk issue is still very much alive and he doesn't know why people say it isn't. They are still pursueing that avenue. PErsonally, I believe it's just more BS hype from the moron.

Well, considering this skank was too busy screwing quite a few light bulbs, so to speak, instead of looking for her not reported "alleged" missing child she gave birth to (pains me to refer to this monster as a mother, I avoid it whenever possible) it will indicate what she was doing prior to & during the period of time Caylee was not accounted for & what she was rather focused on instead.   For that matter, even prior to Caylee's senseless and heinous murder Orlando's infamous skank was too busy making plans to commence with yet more screwing another one of her "bulbs" & referred to Caylee as " a little snotface."   The eve of what is believed to be Caylee's murder, this skank was too busy canoodling with her "boo of the month" at Blockbuster, renting of all things murder movies to take home for another night of bumping uglies.  Funny thing is the defense may use that Casey "reportedly" had a miscarriage during the period of time immediately prior to Caylee's murder which, again reportedly, Casey was upset about...kinda goes to prove by her own defense that she was indeed recklessly sexually active instead of being a loving parent & responsible adult with a job!  Yea, its very relevant as it not only goes to her character & but goes to show what she was doing during the pertinent time frame instead of caring for the well-being of Caylee.

If Casey was so concerned about her image, her myspace & facebook certainly disprove that theory...there is overwhelming evidence that Casey made her choices & flaunted them publicly of her own doing.

ORANGE COUNTY, Fla. -- A deposition is scheduled for Tuesday in the case against Casey Anthony via Skype with forensic entomologist Dr. Tim Huntington.

The board certified entomologist is also a biology professor at Concordia University in Nebraska.

Entomology deals with the study of insects. As WFTV has reported, investigators found coffin flies and maggots in the trunk of Casey's car.

Documents say Huntington could give counter-testimony from the state's expert entomologist at Casey's trial next year.

Meanwhile, Casey is scheduled to be in court on Monday, January 3rd for another hearing.

An insect expert said he found "coffin flies" in a bag of trash found in the trunk of Anthony's car.

Entomologist Tim Huntington is expected to rebut some claims made by the state's bug expert, Neal Haskell.
WESH 2 News interviewed Haskell in Indiana in November. (http://www.wesh.com/caseyanthony/25828004/detail.html ) Haskell teaches a formula that uses temperature and environment to predict a window of time when someone died.

In 2008, Haskell identified microscopic flies, or coffin flies, he said were feeding on decompositional fluids in the trunk of Anthony's car.

Haskell's report is key to the prosecution's claim that Anthony drove around with her dead daughter's body in the trunk.

Haskell said he trained Huntington.

The defense hopes Huntington's testimony may create a different timeline for Caylee Anthony's death.
Anthony defense attorney Cheney Mason said in November that defense experts claim there were no coffin flies in the trunk at all.

Anthony's murder trial is expected to begin in May.

Lawyers in the case will head back to court on Jan. 3 for another hearing. WESH.com will provide live coverage.

Dumb defense move, an "expert" witness trained by the very entomologist that trained him is who they chose to rebut State evidence  ::MonkeyEek::  This man is going to be viewed as Haskell's student, someone hired by the defense for a fee to give an opposing view, quite possibly with an axe to grind or need to one up someone he otherwise should be grateful to that assisted them to get where they are presently.    Yet another example that there will be too many egos in the room.

IMHO, Mason is playing on words with his claims as to where coffin flies were or were not found & the jury will not be confused with this tomfoolery.   I anticipate that this along with every other defense attempt will blow up in their faces & demonstrate them to be the pompous fools they are.

Basically, there are guidelines set forth how far a defense attorney can go in labeling someone a suspect outside the courtroom or in legal documents.  There is something else I find more unethical that is pertinent here & that is Bozo's law firm eliciting the fabricated & libellous accusations they did from Kronk's ex & son, of which was not even in a sworn statement but what was made public by them.   Snit, even law enforcement all across this country have been advised NOT to label a person a suspect recklessly & without probable cause/evidence, they refer to people as "person of interest" until such is established & charges are imminent.   Secondly, there is absolutely zero evidence that links Kronk to an abduction prior to July 15th, 2008 or murder of Caylee, zilch!  The mere fact that his office put forward to the public an allegation by his ex that cannot be substantiated whatsoever has damaged this man's reputation & caused undue harm.   He sent a PI to a very embittered ex & son to say things to accomplish just that, again IMHO he crossed the line, to what degree The Baez Law Firm would be legally admonished or found libel remains to be heard.   

That being said, attempting to make Kronk a suspect in a murder is foolish since there is no way to link the rare duct tape to him but was found at the recovery crime scene, in the Anthony house & directly linked to Casey, later used by her family on false claim posters of a missing child!   The defense also has yet to explain how Kronk would have acquired very known personal items of Caylee's that were found with her remains or the fact that Casey's locked abandoned car had no evidence whatsoever that it was tampered with in order to gain access either to the interior or trunk.

I see this a bit differently, and I do not think it will work, but I feel strongly that this case and the jury verdict will be deliberated as the "battle of forensics".

Conversely, as I have met him, Dr, Haskell is, as previously described by Baez, the "A-rod" of entymologists.

A trainee of his, imo, would carry a great deal of weight, if the jury responded favorably to Dr. Haskell, which I firmly believe they will.

What is bizarre to me, is that according to the defense, they maintain Dr. Huntington and Dr. Haskell agree on the insect types and that they believe Caylee's **graphic warning** decompositional event occurred somewhere other than the bog her Mother tossed her in.

To date, the soil samples from under/near the playhouse, where the Cadaver k9's both hit, test results have not been publicly released.

But not up and over Dr Haskell, and certainly an even higher hurdle to BS around since Dr Haskell is referred to as the "A-rod" of entymolighsts by anyone, that's the point.   I agree, it is bizarre they agree on the insect types & belief were the above mentioned occurred, its not exactly a great starting point for the defense.    This trial will largely come down to two major things of which one you mentioned 1)  battle of forensics  2)  Casey's lies & conduct prior to her arrest.

ORLANDO, Fla. -- An investigator for Casey Anthony's defense team may be wasting time and taxpayer money, a new court filing suggests.
In a new 80-page filing, the Justice Administrative Commission said the investigator is already over his budgeted hours even after being allocated another 100 by Judge Belvin Perry just two weeks ago.

The JAC doles out taxpayer money to indigent clients, like Anthony, who was declared indigent in March.

Records show Florida taxpayers have already spent more than $18,000 funding an investigator for Anthony's defense.

JAC said in the new filing that investigator Jeremy Lyons has billed for 471 hours of work. He has only been budgeted 470 so far.

The JAC said the investigator is spending time on tasks that could be performed by a paralegal or secretary.

What could that connection mean? “This could make Huntington’s job more treacherous in Anthony’s murder trial,” WESH’s Bob Kealing speculated.

Anthony is charged with first-degree murder in the death of her daughter, Caylee. As WESH has reported, Haskell has formulated that Caylee’s remains were dumped near the Anthony family home in June or July 2008.

Kealing explained that Huntington will be there to support the defense view that the toddler’s remains were dropped there later — after Casey Anthony was jailed.

Orlando attorney Richard Hornsby, who offers analysis for WESH, sized up the entomologist battle this way: “Why should you believe the trainee over the trainer?” Hornsby saw this challenge: If Huntington discredits Haskell, Huntington will discredit himself.

Totally agree, something happened the eve of the 15th into the 16th of June 08' & Cindy literally saw or had enough knowledge to know something horrible did or would happen to Caylee...7/3 myspace entry, frantic phone calls to Casey's friends & demands to find where Casey was prior to 7/15 positively demonstrate that.   From the very first evening that Cindy put that scowling bulldog face of hers in our living rooms with a "tude" to match it became very obvious she was defensive, hiding the truth & attempting to save her monster, NOT looking for a missing child.   I am of the belief that at some point Caylee was in that backyard after her murder, more likely to wrap her up for what Casey ended up doing with or without one of her family members assistance.  I never want to hear Casey speak ever again in this lifetime with one exception, if she finally tells the truth if any of her family helped her after the fact.  As this year approaches that we finally bring justice in Caylee's name, I can only hope that her fudged up evil family meet in H E double hockey sticks along with Casey in the most painful & slow manner possible.   I have never nor ever will be amongst those that feel any empathy for the Anthonys, their maladjustment & dysfunction got the ball rolling, their own lies & dirty deeds to save Casey is unforgivable...they forsake their own blood to save a monster, no mercy here for any of them.

In a motion filed late Tuesday, defense attorneys asked a judge to exclude the "phantom" evidence, claiming it violates Anthony's constitutional rights, including due process.

Anthony, 24, is accused of killing her 2-year-old daughter Caylee Marie in the summer of 2008. Caylee's remains were found in December 2008 in woods just blocks away from her family's east Orange County home.

The toddler's death was ruled a homicide, but the medical examiner couldn't determine how she was killed.

Orange County Sheriff's Office investigative documents earlier released said a piece of silver duct tape was placed over Caylee's mouth area.

Detective Yuri Melich wrote that when the tape was processed at a FBI lab, a technician noticed residue in the shape of a heart. It appeared to be consistent with a heart-shaped sticker, Melich wrote. He also noted investigators found a heart-shaped sticker similar in size to the residue in the search area.

"It appears that the sticker was put on the duct tape intentionally, Melich wrote.

But other investigative reports publicly released said the residue couldn't be detected after the FBI processed the evidence for fingerprints. No one took a picture of the residue before it was destroyed.

In his motion, defense attorney Jose Baez said the fingerprint examiner, Elizabeth Fontaine, only saw what she perceived as residue when she performed a procedure called "super glue fuming."

Fontaine said she wasn't certain exactly what she saw and did not authorize law-enforcement to "allege otherwise, the story of the 'heart sticker.'"

Baez stated that when the examiner was questioned under oath, she could not "conclude with any degree of scientific certainty what the image was that she saw, or whether she actually even saw anything to begin with."

"In her deposition, Miss Fontaine explicitly stated she could draw no conclusions about what she believed she saw, or even that she saw anything at all. Specifically, Miss Fontaine stated that she 'could not scientifically or never would jump to the conclusion that what [she] saw was a sticker.'"

The defense motion stated, "The alleged existence of this phantom image was only seen for a fleeting moment by two fingerprint examiners who did nothing to preserve it or even photograph it so it could be seen by others."

Baez stated there is no way to determine, what, if anything, the image was.

"Law enforcement has been instrumental in manufacturing a story where there clearly was none," Baez wrote.

"Despite their complete lack of basis in fact, these reckless and patently untrue statements have exploded in the media and quickly spiraled out of control. There is now a common public perception, contrary to fact, that actual residue of a sticker was found on the duct tape."

Baez's motion said defendants have the right to examine tangible evidence, and when evidence is destroyed, it can't be used against the defendant at trial and must be excluded.

The defense asked Chief Circuit Judge Belvin Perry that a hearing date be set to argue the matter.

Anthony remains at the Orange County Jail. Her trial is scheduled for May.

Unbelievable... Baez and Co have been the biggest story manufacturers, still are and they have the nerve.....just unbelievable!

I have been asking for a long time where the reports were on the soil samples they took from around the pool and the playhouse. No one seemed to have read them and to my knowledge they have not been released yet which is very suspect. I felt from the beginning that Calyee was stuck somewhere in that back yard prior to being dumped down the street. I will always believe that is why the dogs hit on those places in the yard. My guess was she was in a garbage bag and when she was put in the trunk of the car some of the fluids leaked out of that bag so she was double bagged at that point. 

When KC slipped back home that day (as she had been doing for months)  after she killed her she had to put her somewhere her parents would not find her in case she got caught there. George had the keys to her trunk, so that was not an option. My guess from the beginning was she put her under the playhouse. I think she tried to stick her under the pool but could not dig the hole. (remember how she told the neighbor she was moving a plant that bugged her in her excuse for borrowing the shovel. IIRC Cindy also made up some cock and bull story on TV about moving that bush & I think that was because they had figured out she killed her and before the police came they had to have an excuse for freshly dug up ground. I also think that is why the new concrete was poured to cover the "SCENT" of the body.

When I went back and looked at some old google maps when this first started, the bush was exactly where it was when CA told Greta she had just moved it.

They are either trying to talk in some type of Anthony family code or they are all certifiably INSANE.

In his motion, defense attorney Jose Baez said the fingerprint examiner, Elizabeth Fontaine, only saw what she perceived as residue when she performed a procedure called "super glue fuming."

Fontaine said she wasn't certain exactly what she saw and did not authorize law-enforcement to "allege otherwise, the story of the 'heart sticker.'"

Baez stated that when the examiner was questioned under oath, she could not "conclude with any degree of scientific certainty what the image was that she saw, or whether she actually even saw anything to begin with."

"In her deposition, Miss Fontaine explicitly stated she could draw no conclusions about what she believed she saw, or even that she saw anything at all. Specifically, Miss Fontaine stated that she 'could not scientifically or never would jump to the conclusion that what [she] saw was a sticker.'"

The defense motion stated, "The alleged existence of this phantom image was only seen for a fleeting moment by two fingerprint examiners who did nothing to preserve it or even photograph it so it could be seen by others."
Baez stated there is no way to determine, what, if anything, the image was.

"Law enforcement has been instrumental in manufacturing a story where there clearly was none," Baez wrote.

"Despite their complete lack of basis in fact, these reckless and patently untrue statements have exploded in the media and quickly spiraled out of control. There is now a common public perception, contrary to fact, that actual residue of a sticker was found on the duct tape."

Baez's motion said defendants have the right to examine tangible evidence, and when evidence is destroyed, it can't be used against the defendant at trial and must be excluded.

The defense asked Chief Circuit Judge Belvin Perry that a hearing date be set to argue the matter.

Anthony remains at the Orange County Jail. Her trial is scheduled for May.

Entomologist Deposed In Case Against Casey

ORANGE COUNTY, Fla. -- An expert working for Casey Anthony's defense team was questioned under oath Tuesday. Dr. Tim Huntington is an entomologist, which is a bug expert.

Dr. Huntington may have tried to convince jurors there were no coffin flies in the trunk of Casey's car. According to court documents filed by Casey Anthony's defense, that's one thing he planned to say.

The case could hinge on this because with so much circumstantial evidence, her defense needs to poke holes in the forensic evidence that will be presented at trial.

Prosecutors conducted a Skype video deposition with Dr. Huntington, who is a board certified entomologist from Nebraska.

"That's paramount to the case," said WFTV legal analyst Bill Sheaffer.

Sheaffer said Dr. Huntington was expected to attack evidence found in the trunk of Casey's car.

An entomologist for prosecutors, Dr. Neal Haskell, has said test results from the trunk show evidence of coffin flies on paper towels, which indicates the presence of a dead human in the trunk days after Caylee was last seen alive.

One of the keys for Dr. Huntington during the Skype deposition, and eventually at trial, will be to refute any testimony from the prosecutor's expert that places Caylee Anthony's body in Casey's car.

"If Caylee's remains are associated with either Casey's automobile or residence, [it's] certainly is a strong indication Casey was responsible for Caylee's death," Sheaffer said.
Huntington is said to be one of just 15 board certified entomologists and has worked as a consultant with law enforcement on several death investigations.

Sheaffer said Huntington's role will be to discredit scientific methods used by experts for the prosecution. Defense attorneys will hope it casts doubt in the minds of jurors that Casey killed her daughter.

Sheaffer said even if the forensic experts cancel each other out, defense attorneys will have an uphill battle because of all the circumstantial evidence pointing to Casey.

Meanwhile, Casey is scheduled to be in court on Monday, January 3 for another hearing.

And they did find one that perfectly matched the impression.

That's my recall too Fanny Mae......after seeing the heart impression on the duct tape, they searched for the actual heart sticker.....which they did find.

Even if Bozo wins this one, it won't affect the outcome of the case.
If it's true that the image was not preserved, then I agree that it shouldn't be brought into the trial.

The fact that the child had duct tape over her mouth (with or without a heart sticker) is what he needs to be worried about!

Casey Defense Files Motion To Keep Sticker Evidence Out
Evidence that could link Casey Anthony to her daughter's murder could be thrown out of court. Casey's defense team filed a new motion Wednesday to try to keep jurors from hearing evidence regarding a heart-shaped sticker.
The sticker was found with Caylee Anthony's remains and similar stickers were found at the Anthonys' home on Suburban Drive.

Casey's defense says the evidence of residue from the sticker on the duct tape was destroyed in FBI testing and hasn't been recovered. Since they say the evidence doesn't exist, allowing it in court would prejudice the jury against Casey.

In the murder of Caylee Anthony, the small heart-shaped sticker is one of the most memorable pieces of evidence.

The evidence was found with Caylee's remains and later, an FBI investigator found residue in the same shape of the heart on duct tape that was wrapped around her mouth.

"Yes, that's going to be an emotional issue with the jury," WFTV legal analyst Bill Sheaffer said.

Sheaffer said it is key since it could connect Casey to the murder because similar stickers and sticker backings were later found in the Anthony home.

The defense even calls it "phantom heart sticker evidence." An FBI fingerprint examiner found the residue on that duct tape, using a technique called super glue fuming.

But testing destroyed that evidence. The defense quoted the investigator as not being able to confirm the residue was from a sticker, saying, "What I saw could be a sticker. It could be anything."
The defense team argues it shouldn't be allowed since the evidence no longer exists and its experts can't examine it.

However, Sheaffer believes it will likely be allowed.

"My opinion, this is a matter of weight and credibility, not so much a matter of admissibility," he said.

If admitted, he expects the defense will tell the jury the evidence shouldn't be given any credibility since it can't be reproduced. But if it's not allowed, it won't make or break the case because there it's just one piece in a whole chain of circumstantial evidence.

Meanwhile, Casey is scheduled to be in court on Monday, January 3 for another hearing.

ORLANDO, Fla. -- Before Casey Anthony's trial in the murder of her daughter begins in May, several key battles of evidence in the case will have to be fought.

Anthony's defense claims there is nothing to support an FBI analyst's speculation that residue of a heart-shaped sticker was on the duct tape prosecutors believe was used to murder Caylee Anthony.

The defense team wants the sticker thrown out as evidence.
 
"I think this is something the judge will find in the defense's favor," said Orlando criminal defense attorney Richard Hornsby, who is not affiliated with the case.
Anthony's defense successfully argued to have a jailhouse video sealed of Anthony's emotional reaction to news coverage on the day that her daughter's remains were found.
Sources confirm there's been no ruling on whether it can be introduced by prosecutors as proof that Anthony knew the remains were her daughter's before they were identified.
"Until the defense comes forward with a motion, it's fair game for the state to try to introduce it in the trial itself," Hornsby said.
Also remaining, the question of whether Anthony's defense will try to have evidence admitted at the trial of Roy Kronk's alleged "prior bad acts." Kronk found the remains off of Suburban Drive in 2008.
"The Kronk stuff has been the elephant in the room," Hornsby said. "If you're going for an innocence argument you have to have someone to point the finger at."
Hornsby said the defense can still try to introduce the Kronk evidence at trial, but there's no guarantee that Judge Belvin Perry will allow it.

Will Casey Anthony’s defense team be successful in keeping any mention of a heart-shaped sticker out of her murder trial? Stations offered starkly different speculation tonight.

On WESH-Channel 2, Orlando attorney Richard Hornsby predicted that Chief Judge Belvin Perry will find in the defense’s favor. “I wouldn’t be surprised if the prosecution simply conceded on this specific issue,” Hornsby said.

ORLANDO, Fla. - Casey Anthony's defense team wants a piece of evidence that could tie their client to her daughter's death thrown out of court.

On Wednesday, Casey's lawyers filed a motion that would keep the jury from hearing about a heart-shaped sticker that was found with Caylee Anthony's remains.

Similar stickers were found at the Anthony's home near Orlando.

Investigators say a piece of silver duct tape had been placed over Caylee's mouth. When the duct tape was processed, investigators say, residue in the shape of a heart was discovered.

It appeared to be consistent with a heart-shaped sticker found at the crime scene.

Residue evidence from the sticker was destroyed during FBI processing for fingerprints and no photographs of the residue were ever taken.

The defense contends that since the evidence does not exist, allowing it in court would be prejudicial against Casey calling it "phantom heart sticker evidence."

The sticker was a highly publicized piece of evidence during the criminal investigation.

"Yes, that's going to be an emotional issue with the jury," legal analyst Bill Sheaffer told Orlando station WFTV. "My opinion, this is a matter of weight and credibility, not so much a matter of admissibility."

Sheaffer believes the sticker evidence will likely be allowed.

Caylee's remains were found near the Anthony home in December 2008. She had been missing for almost six months.

Casey's next court hearing is set for January 3. Her first-degree murder trial is scheduled for May.

Here's what's hinky......Bozo WAS obviously CERTAIN, that the remains found on Suburban Dr. were in fact Caylee's, otherwise why would all his co-clown experts immediately fly down to Orlando to the crime scene.

When LP "allegedly" found bones, or whatever at J Blanchard Park, Bozo didn't show up, or any of his other idiots, nor did KC get upset when she saw the media coverage.

Why?? Cause she knew Caylee wasn't dumped at JBP, and she knew d@mn well she was on Suburban Dr.

So true!! I believe Dom (d!ck) Casey found Caylee's remains in November before Kronk. But, her remains were not contained in the bags because they had been scattered. I also believe Dom freaked when he actually found her.
He may have removed other evidence that could have linked Casey to the crime scene.....he just "forgot" a few items, or was just too freaked out to make sure he got everything. I doubt we will ever know the whole truth of Dom's poking adventure and what he found or did with any evidence. I don't know how he sleeps at night, or any of the Anthony's for that matter.

A new motion filed in the Casey Anthony case is aimed at suppressing evidence about how the murder suspect reacted when her daughter's remains were found, WESH.com is reporting.

An official has said Anthony was taken to a medical area of the Orange County Jail while a television aired coverage of the discovery of her daughter's remains in 2008.

Anthony doubled over and began breathing rapidly, that official has said.

Anthony's team wants such statements kept out of the murder trial, set to begin in May.

I just read the rest of the just above posted article & it dawned on me upon reading this:

"During a news conference Thursday evening, Baez confirmed that Casey Anthony was upset when she found out about the remains and requested a sedative at the jail. Sources described Casey Anthony's reaction as an anxiety attack."

Here's my legal argument, Bozo opened the door himself regarding discussing his client's reaction in jail to the remains of precious Caylee being found.

Tim Huntington can't say much about the most interesting case he's ever participated in.

The Concordia University assistant professor will say this: He doesn't know how public figures handle the media attention.

"I don't know how celebrities deal with the paparazzi," he said.

Admittedly, Huntington's role as an expert witness for the Casey Anthony defense team in Orlando isn't as high profile as those of Anthony or her attorneys. But at least one legal expert has called the forensic evidence -- particularly that which deals with bugs -- crucial in the state's efforts to convict the young mother accused of killing her 2-year-old daughter.

According to Orlando legal analyst Bill Sheaffer, that's because the state's evidence against Anthony is largely circumstantial, other than some forensic evidence linking her daughter's body to her car's trunk.

Huntington -- who, at 31, says he's the youngest of the country's 15 board-certified forensic entomologists -- did a deposition Tuesday via Skype. He gave testimony under oath in support of Casey Anthony, who is charged with first-degree murder of her daughter. Caylee Anthony's remains were found in a wooded area near her Orange County, Fla., home in December 2008.

While Huntington wouldn't characterize his testimony, he was expected to refute evidence presented by the state's forensic entomologist, Neal Haskell, who has presented test results from Casey Anthony's trunk. Those test results, Haskell has said, show evidence of coffin flies, which point to the presence of a dead human in the trunk days after Caylee disappeared.

Huntington can talk about his work generally and offers a rather simple, if somewhat jarring, explanation of forensic entomology.

"When we die, we get eaten," he said. "When you know how old the bugs are, you can find out when a person died.

"Not exactly glamorous work, but it is interesting."

Interesting -- and important -- to a case like that against Casey Anthony as prosecutors and defense attorneys spar over questions such as time of death and location of evidence.

Where Huntington's expertise fails him is in handling public attention and criticism. Since joining Casey Anthony's defense team in late 2008, he has appeared on "Good Morning America" and truTV and has met longtime TV news celebrity Geraldo Rivera. Huntington said what has been most difficult has been studying evidence under the piercing eyes of Florida's aggressive media and being chastised on news websites for defending Casey Anthony.

"The public response is probably something that I didn't really expect," he said.

Away from the media frenzy in his Concordia classroom, Huntington teaches biology, entomology, anatomy, zoology and other courses. He has been a consultant for law enforcement agencies on more than 50 death investigations, including the case of Amber Harris, the 12-year-old Omaha girl who disappeared in 2005 and whose remains were found in 2006.
He also conducts workshops for law enforcement agencies and is a reserve Seward County deputy. Seward County Sheriff Joe Yocum said a workshop Huntington did for a posse of county volunteers in November provided valuable information on evidence location and recovery.

"His knowledge of forensics and the training he's receiving as a deputy sheriff makes him an even greater resource in the event we have a major crime/homicide occur again in our area," Yocum said.

ORLANDO, Fla. -- Casey Anthony's defense team doesn't want a jury to hear about or see Anthony's reaction to news reports when her daughter's remains were found.

Anthony's lawyers filed new paperwork asking that any such evidence be suppressed when the murder trial begins in May.

On Dec. 11, 2008, former meter reader Roy Kronk discovered remains off of Suburban Drive. The medical examiner did not positively identify the remains as Caylee Anthony's until Dec. 19.

At the time the remains were found, Anthony was in the Orange County Jail. She was indicted in October of that year in connection with her daughter's disappearance.

Anthony's attorneys contend that once the news broke that remains were discovered, authorities set up a situation at the jail to record and monitor her response to the news.

That day, Anthony was taken out of her cell and into the jail's medical area to watch the events unfold on television.

Defense attorneys claim that the Orange County Sheriff's Office made arrangements with the jail to place Anthony in a location monitored by cameras. Lawyers say Anthony was told she was being taken there for medical purposes, but in fact never received treatment.

Anthony attorney Jose Baez said that he arrived at the jail that day but was denied access to his client.
The new court filing claims that the situation was set up in order to "circumvent Anthony's Sixth Amendment right to council."

Defense attorneys contend that authorities hoped the situation would illicit a response that would incriminate herself.

The filing also asks that accounts of her response be suppressed, as well as the video.

Lt. Tammi Unser noted in a previously released account that she took Anthony to the female medical area to watch the events unfold on television.

Upon entering the office, Unser wrote that Anthony looked at the television and immediately fell into the chair, doubled over and began breathing rapidly.

Several minutes later, Unser said that she lifted her head up with her eyes still closed and muttered, "Oh no," upon hearing the location of the remains.

"She was set up and this is the exact kind of activity the courts frown upon," Orlando defense attorney Richard Hornsby recently told WESH 2 News. Hornsby is not affiliated with the Anthony case.
Hornsby compares the account to fruit from a poison tree, saying that Anthony should not have been placed in a position to potentially incriminate herself.
"It's no different from an interrogation done after someone invoked their right to an attorney. That's why it's inadmissible," Hornsby said.

"You have to be in custody and being interrogated," said Jeff Deen. "People make spontaneous statements to the police all the time who are in custody and they're used against them every day."

Anthony's reaction occurred before Unser asked her if she wanted to see a mental health counselor.

Legal experts disagree on whether her apparently spontaneous reactions before she was questioned will be introduced to the jury.

Anthony's defense claims the video and accounts are not relevant to her guilt or innocence and that showing such video at trial would only be prejudicial.

Defense lawyers also filed paperwork asking that decompositional odor analysis of Anthony's car be excluded from the trial.

Lawyers Want Casey's Reaction To Remains Found Suppressed

ORANGE COUNTY, Fla. -- Casey Anthony's lawyers don't want a jury to see her reaction to Caylee Anthony's remains being found, according to a motion WFTV obtained Thursday. Her reaction was caught on camera from inside the Orange County jail.

Caylee's remains were discovered in December of 2008. Casey was watching coverage about the discovery and became visibility upset, according to officers.

Her lawyers filed a motion late Wednesday to suppress the video. They say her reaction is not relevant and that cameras were rolling as part of a set up.

Casey Anthony is expected in court on Monday. At that time, the judge will hear a request by prosecutors to bring sanctions against Casey's defense team.

Prosecutors say the defense has ignored the judge's order to provide specific information about defense witnesses' testimony.

The hearing is scheduled for Monday afternoon at 1:30.

Did JP not "Spank " Bobo when he stood up in court last time complaining about a photographer looking at Casey writting?  Did JP not shut him and then the other lawyer down in under 30 seconds with a DENIED?  Now he puts it in a motion which to me seems akin to yelling at a deaf man to try to get them to hear you better.  Only difference is that JP is not deaf and Bobo has been told no already more than once.   I hope JP puts him in the time out corner this time.  I am starting to feel that Bobo is writing all these motions to get himself in trouble and get himself get thrown off the case as it has not turned out like he first thought it would be and he can not just withdraw.

WESH-Channel 2 looked back at the top developments in the Casey Anthony case in the past year. Here were reporter Bob Kealing’s choices:

1. Anthony became indigent.

2. Changes in her defense team.

3. A new judge entered the case.

Do you agree with those choices?

Kealing opened his concise recap with footage of Anthony falling in an Orange County Courthouse elevator. “It’s been that kind of a rocky 2010,” he said. She is charged with first-degree murder in the death of her daughter, Caylee Marie.

Judge Stan Strickland was replaced by Chief Judge Belvin Perry. Brad Conway, former attorney for George and Cindy Anthony, told WESH that Perry has the luxury of moving the case along faster than Strickland did.

Anthony attorneys Linda Kenney Baden and Andrea Lyon left the case, and Cheney Mason and Ann Finnell came aboard. Orlando attorney Richard Hornsby, who provides legal analysis for WESH, wondered if people had left because there wasn’t as much celebrity interest in the case.

But Kealing said the most controversial development was Anthony’s being declared indigent after her $275,000 defense fund ran out. “We’ve all got to wonder where it went,” Conway said.

I’d say that’s a good choice as the top development, based on the response I get from the public.
In Anthony news today, WESH and WFTV-Channel 9 reported that the defense team filed a motion to suppress a jail tape of Anthony’s reaction to TV reports of the discovery of a child’s remains.

“Casey was watching coverage about the discovery and became visibly upset,” WFTV anchor Vanessa Welch said. “Her lawyers filed a motion late yesterday to suppress that video. They say her reaction is not relevant and that camera were running as part of a setup.”

WESH anchor Martha Sugalski described Anthony’s “extreme emotional reaction” on the tape and said that Anthony attorney Jose Baez in the motion called the tape part of a setup because a sheriff’s commander wanted to get incriminating information from Anthony.

Kealing said: “The judge has already ruled against making this video public, and this motion would keep it out of the trial entirely.”

The trial is scheduled to start in May.

WESH also highlighted that another defense motion asks Judge Perry to toss sniff tests on air in Anthony’s car. Baez argues that “the courtroom is no place for an untested and experimental  piece of science,” Kealing said.

The next hearing in the case will be at 1:30 p.m. Monday.

Question......weren't these motions to be filed by last week so the CJBP could hear them due to the fact that he was not going to be in the court house this week?  I know that Baez said the 31st was the initial date given.  So is it possible that JP will not even hear these motions and if so does this not give Casey grounds for firing her defense team, thus causing this entire case to begin anew?   ::MonkeyShocked::

About the possibility of a plea deal.....I can't stand that the defense team is wasting Fla taxpayers money but I hope the State does not offer a plea deal (at the request of the defense/Casey) to save the state money. That money spent would be well worth it to me.

Bozo knew what the deadline was TO BE HEARD (not filed as he sheepishly attempted to get away with) & he pushed the envelope.  Thus he got a stern clarification & instruction that the judge would not hear anything due to his scheduled vaca, that was on the Kronk issue.  Now, Bozo out of pure spite is flooding the court with a barrage of menacing motions, of which I'd say 99% will be denied or put aside due to lack of meeting the threshold for consideration at this juncture.   Yes, he's been told more than once that certain things will not be excluded, he's as dense as he is arrogant.

Just like Casey's defense with multiple "suspects" and a litany of designs diversions, they are throwing everything at the wall, hoping against hope that something will stick.   While it is not abnormal for a defense attorney to actively attempt to get evidence against their client thrown out, it is highly abnormal for a defense attorney to defy the court & push issues that have already been ruled on with merit repetitively.    I dont think he's purposely trying to get thrown off the case, snit its probably practically the only significant one he has in his law office at this point...no, he wants the limelight of this case & doesnt give a dang about his client.   Nope, he's throwing a Hail's Mary hoping that he might walk away considered to have won this case....there is a fool born every minute, unfortunately.

I don't rely much on what Richard Hornsby "thinks" as he has been wrong many times throughout this fiasco. Actually I think the monkeys here have been right much more than he has.

I agree with Cappuccino that they are flat out of defense ideas and are now throwing everything against the wall with HOPES something sticks. I don't believe they have a defense at all. All this blow hard crap about expert witnesses is going nowhere and will be even more foolish looking in court.

The one thing which bothers me is how long is the judge going to let this never ending motion machine go on? He give them deadlines, they ignore them and then come back with some irrelevant motion citing nothing in case law. IMO the court should have thrown out all motions which did not have case law cited from the beginning and this would not be an issue now.

What is funny to me is CA is out there having fun this holiday and KC is sitting in a jail cell. I wonder how KC feels about all her friends out partying for New Years and her family out there while she rots in that cell and no one even cares.

Her mother hates her, her father is terrified that she is going to call him a child molester and her "not quite right" brother is parking cars at the the stadium for the football game.

I just hope next year that Cindy has herself a nice cozy cell in that jail with KC.

Just wait until he gets into court and starts fumbling around like he always does with all those papers. He reminds me of some guy just out of rehab who is still shaking from withdrawal symptoms and mental inclusion. He has no coherent chain of thought anytime he speaks and is never prepared. I honestly thought he had a mental disorder like ADD or something the first few times I watched him in court with all the fumbling and inability to speak coherently.

Don't tell them but that method has been used more times than they have ANY idea. I can't wait to see their face in court when they find out how accurate it is.

IIRC, Baez is the one who did not want a gag order on his client's case.  The State is not speaking out to the Media on Casey's case.  I wonder if this is Baez's way for him to taint a jury.  He tells people, on air, what he wants to about the case.  This way the State's side will never be heard about any "mistruths" the defense may have told.

If the motions get heard (death is different) and they are turned down, do you think Baez will then use the excuse that the motions were denied because Judge Perry was angry at him because Baez's office sent them in during Judge Perry's vacation?

The Defense looks to me to use the  ______________ is against me card, more than I have ever seen before.  (Enter in Judge, LE. etc.)

I think Baez has even shocked his client with his assertions (saying his client is unlikeable, IIRC, etc. as excuses for the reasons people think she is guilty).  I have seen her give her attorneys a double-take more than one time when they talk about her character.  I wonder if we will recognize Casey on the stand in her Nun outfit.

Yes, Casey can dump him at any time, she has a team in place so it would be interesting to see just how that would benefit her.  IMHO, if he was her sole attorney needless to say the trial would be delayed for a new attorney to get up to speed & formulate what the best defense would be.   As far as after her trial, if she then claims ineffective counsel I doubt she would prevail, again due to the fact that she has had the benefit of a team of attorneys versus one.

You recalled correctly, both Bozo & the Anthonys fought the gag order...heaven forbid they would have been stifled from appearing on every talk show that would have them.  Bozo had done nothing but attempt to taint the jury pool.

Extremely doubtful that Bozo can win an argument that he and/or is client were denied due to a judge's angst with him...CJBP has been methodical & judicially sound in his rulings thus far, also he has indeed given Casey's defense some leeway with time & allowing them to get their ducks in a row.  If CJBP has admonished him and/or denied one of his motions it was with merit.   While that may not prevent Bozo from whining relentlessly & attempting to file such a claim, CJBP is not going to make the same lapse in judgment that Judge Strickland did regarding that blognutter & sufficient grounds will never be ruled by a higher appellate court.

I think the reason Casey likes him is because she likes the idea of someone who pushes the envelope and defies authority, it reminds her of someone, and if she had a mirror, she would know just who that someone is.

Defense Wants Casey's Myspace Postings Tossed Out

ORANGE COUNTY, Fla -- Casey Anthony’s defense team filed motions, late Thursday, to keep the jury from hearing key evidence that was collected before her daughter, Caylee's body was found.

WFTV reporters reviewed more than 100 pages Thursday night.

In the documents, Casey’s attorney's J. Cheney Mason and Jose Baez requested to have nearly two dozen items tossed out.

One of those items is the tattoo Casey got two weeks after Caylee disappeared, which reads "bella vita" which is Italian for "beautiful life."

The defense also doesn't think the shovel Casey borrowed from a neighbor, traces of chloroform found in the trunk of Casey's car, and a stain found there are relevant.

Baez is also asking the judge to exclude any and all cadaver dog search results, during the time the dogs were looking for Caylee's remains.

Casey's lawyers also want to get the judge to limit or exclude evidence taken from Casey and her mother Cindy's Myspace pages.

Cindy posted a message on the social networking site titled, "My Caylee is Missing," twelve days before she alerted the Orange County Sheriff's Office.

She went on to say "jealousy" took her granddaughter away, and her daughter, Casey, betrayed her and stole her money.

The defense is also trying to keep jurors from hearing about a message that Casey wrote -- stating "Everyone lies, everyone dies and life is never easy."
Eyewitness News legal analyst, Bill Sheaffer, said the defense isn't doing anything surprising.

Sheaffer said the defense is doing what it is supposed to be doing and trying to weaken the case as a whole.

The next hearing is set for Monday, January 3rd.

A slew of court motions filed by Casey Anthony's defense over the last two weeks seek to keep key evidence out of the coming trial.   
The latest motion, filed in court Wednesday, seeks to block statements Casey made at the jail infirmary the day she learned human remains had been found near her parent's home.

"She wanted to talk about football," explained corrections officer Tammy Uncer during an interview with detectives.

Channel 9 Eyewitness News legal analyst Bill Shafer says the motions are part of a larger struggle to determine what evidence the jury sees.

Earlier this week the defense filed motions to suppress evidence found with Caylee's body and tests showing decomposition in Casey's car.

"Every piece of evidence is a link in this circumstantial evidence case," Shafer said.

Hearings on whether the evidence will be allow in trial will be held in the first few months of the new year.

The requests were mostly pieces of evidence that could be seen as damaging to the defense, but lawyers have argued that it's all evidence that is not relevant to the case of Casey's murdered 2-year-old daughter, Caylee.

The evidence in question includes some procedural items, and then one that's a little strange.

Included in the thousands of pieces of evidence prosecutors have released in the case was a video created on the website JibJab that Casey's defense wants to make sure jurors never see.

In the motion filed by the defense, attorneys said they can only reasonably assume that the cartoon was "created and then released by the state as evidence in an effort to embarrass the defense."

As for the other motions, the defense said it does not want the state to point out a stain in the trunk of Casey's car, or show video from December 2008 of her reacting to the news that her daughter's remains had been found.

Lawyers also asked for statements made by Casey to her family, a jail guard and jail pen pals to be excluded.

Some of the other requests get a little more off topic, including a motion to exclude the Anthony family's posts on Facebook, or the fact that Casey has a tattoo.

Finally, the defense voiced there concerns about the media, filing a motion to prevent cameras from zooming in on notes Casey passes to her lawyers, or overhear what they are discussing with one another.

A ruling on any of the motions is not expected until after the New Year.

Casey Anthony's trial is scheduled to start in May.

ORLANDO, Fla. -- The Casey Anthony defense team has filed a motion that seeks to keep jurors in her upcoming murder trial from seeing how she reacted when she learned her daughter's body had been discovered.

Anthony, 24, is jailed on first-degree murder charges in the death of her daughter, Caylee, whose remains were found in December 2008. Caylee was 2 years old when she was reported missing in July 2008, about a month after she was last seen alive.

Anthony, who was in custody at the Orange County Jail in 2008, was caught on camera while watching news of the discovery on television.

In the motion, Anthony's attorneys said she did not know she was being recorded and investigators set her up so they could get her reaction on camera.

Judge Belvin Perry has not yet set a date to rule on the motion.

Anthony has pleaded not guilty. Her trial is scheduled to begin in May.

Wife Of Panama City School Board Shooting Suspect Now Represented By Conway

ORLANDO, Fla. -- The man who once gained notoriety as the attorney for Casey Anthony's parents has picked up another high-profile client.
Orlando attorney Brad Conway's new client is the wife of a suspect who shot at members of the Panama City School Board before a security guard shot him. The wounded man then shot and killed himself.

In an exclusive interview with WESH 2 News, Conway said Clay Duke's wife, Rebecca, has had her life opened up to police.
She has become the subject of public scorn, Conway said, even though she's not accused of any crime.
Police said Clay Duke was bipolar and blamed the board for laying off his wife.
"She along with everybody else had no idea her husband was going to do such a horrendous thing," Conway said.
Conway said he became Rebecca Duke's attorney last week.
Even though she's accused of no crime, police served a search warrant on her home.
Conway said he is serving in an advisory role for Duke, much like he did for George and Cindy Anthony.
"She does not have a lot of sympathy. She's still trying to grieve. People see a horrific video of a guy shooting at innocent people and not the guy she knew," Conway said.
Conway said that there is no indication at this point that Rebecca Duke will face criminal charges in the future. He said he plans on continuing to be her go-between between with police and the media.
