Four of the five potential jurors will return for more questioning at 8:30am on Friday.

Jury selection is being held outside Orlando because of intense pretrial publicity.

The first three days of jury selection were spent narrowing down a pool of 200 possible jurors. Those who weren't dismissed because of personal conflicts or hardships have advanced to this round.

The judge hopes to have a jury in place to begin opening statements in Orlando on Tuesday.

It was Judge Belvin Perry's intention to question 36 people Thursday, but with only two completed at 3 p.m., he sent all but three of the rest home for the day.
The judge apologized to the jury pool, accepting full blame for having them wait for so long.
"Hopefully I will be a better judge of time in the future," said Perry.
In all, four jurors were retained: three men and one woman. The fifth potential juror questioned was excused due to financial hardship.
Court adjourned just after 7:30 p.m.

Considering the tape on mouth, triple bagging, non reporting of her missing, chloroform, driving around with your own child's corpse in the car and Caseys behavior for the 31 days her daughter was missing...it does not look like an accident to me.

Many people have endured abuse of all sorts and did not murder their child. It seems to me Baez had this defense planned from early on and that is why Casey has not seen her parents in so long.

I would like to know what her conversation was was about on that first day she says her daughter was missing. Casey had everyone believe she was at work. What exactly did she do that day? I think about all those phone calls she made. Who does all that calling when they are supposedly at work?

I know we are not supposed to joke around, but I sure have enjoyed some of the lighter moments here to lighten up the mood a bit,  ::MonkeyKiss::

Hi Shell, yeah sometimes a light moment is needed. This is going to be a very aggravating trial. I'm sure I'm not going to like how Jose paints Casey in the poor victim light. Caylee will take the back burner to her Mom, as she did her entire life.

I can't wait for the trial to start and the State pulls out it's big guns and really lets Casey in on how much they have against her. She'll be crying and hyperventilating then!!

It’s not as if the 31 days of men and parties while your daughter is missing were not bad enough …..to me, the worst of it is just what Shell mentioned . Driving that car around for many days with the smell of your own child’s death reeking out of it is just incomprehensible and has to be one of the most cold blooded things I could imagine. How could she not have been completely haunted every time she drove it?

I remember that there was to be a video hearing today.  Remember when the mics were left on yesterday and we could hear JA talking to Simms?  I heard him say something about being able to agree on something..............................I wonder if that is why the phone or video hearing is cancelled?
Perhaps they found a compromise?
 
Also I want to thank the faithful monkeys for the hard work done to help less experienced trial watchers understand the experience.

I won't start naming names as I always forget someone and feel terrible.

As you guys know,  RED has been battling the forces of evil and there is good news and bad. Contrary, to initial MSM reports there was no settlement, although it appears the case might have had a conclusion. That said, the legal case has been costly and Red could use any help that we could offer. Even if they go through 12 today and 12 tomorrow, thats only half the pool in a week.. that leaves all next week to finish.. so the trial will probably start a week late?

Good Morning monkeys, ya, his charming comes off almost more smarmy than his usual snarky, smirking behavior.  He can't hide that smirk, it is his natural disdain for anyone in his way of winning this case. He wants the win for himself, I don't think advocacy for his client has anything to do with it.  It comes through loud and clear every time we have seen him, as Cindy would say...from day one.  He may be fooling one or two potential jurors but in the long run they will all have the same opinion of him and Mason that we have.  It won't take them long for them to show their true colors in front of the whole seated panel.

We are in for another long day! I do have to say Jose was so adamant about not getting a fair trial. They have gone through 5 and of the 5 all have made it minus the one for hardship, so atleast we know that will not be a factor..

I am completely legal illiterate and would like to ask a question.

IF the defense is going to say it was an accidental death or some other excuse, when do they introduce that info?  Why do they not tell the prosecution right up front similar to the sharing of info on the evidence?


As an aside,  KC must hate her court wardrobe....I cannot imagine she owned those items before court.

Good Morning!  I think the defense knows Casey is toast so they are grasping at anything they can - they have no defense against the evidence and they know that.  It is interesting to me that they focus mostly on the sentencing phase.  That tells alot.

I hope JP can get this ball rolling today and get some more jurors.....It's gotta be better than yesterday!

They just began the General Voire Dire phase and yesterday Perry asked the defense and state how long they needed for that part. State said 15 min., defense said 30 min. So he is asking them to keep it to 30 minutes each.

Yeah I noticed that too, that they already seem to know that and they are just trying to save her life. I hope it goes faster today but I still don't know how in the world they are gonna get through all of this by Monday. I wonder when your honor will change the trial date?

When the attorney (man's haircut woman, sorry can't recall her name) was questioning this juror, she said something that makes me go "hmmmm...".
She said that in the penalty phase, it will be emotional when the victim impact statements are given that she can't use emotion to judge for death.  My thoughts were that we don't know of anyone who would actually argue for the death of ICA.  I would assume that the A's would actually be arguing against it.

Pretty cool shes from the area and the lady questioning her too. Had no idea! I'm in Greensburg,, not far from you!

Oh and I agree about Caseys blouse.. I had something similar to that back in the 80's when I was in high school!! Its very out of style!

I guess because if it was an accident then it would not be first degree murder and the jury could find her guilty of a lesser charge. There was no way the state would have agreed to give her a plea for that so they didn't have a choice but to come to trial, and hope that the jury buys her story.

Good grief, do these jurors realize that they do not have to discuss personal info of their families? TMI on her daughter and her financial situation. Damn, why not tell the world, oh she just did.

And just as an aside, how many people have experience with cadaver dogs? Far different than a disability dog.

1980's brother was tried for armed robbery and acquitted.  She feels the system worked well in her brothers case. 

I would assume they will do it in opening statements. Knowing the defense because they want to make it a WOW factor..But I am not too sure, they do not have to give their defense like the state has to give them everything.

I truly do not believe there is anyone that will be qualified to give a victim impact statement.  They have all forgotten that the victim is Caylee.  If any of the Rosebud clan get up to speak they will be begging for and speaking about the accused and not speaking about Caylee.

Yes, not fair to Caylee. She has been lost in all of this. I mean if the Anthony's come up and speak, then the jury has in the back of their minds that they are these horrible abusers. So who will speak for Caylee!

Good catch O4....Either that or it does sound like they are asking each other's questions in order to block any 'excuse-for-cause' dismissal ...in other words they are trying to force each other to use up their 10 excuser/dump/challenge.  Hope that makes some sense...it is still early.

The jurors are not on trial, they have every right to say ... way too much info ... if I need to answer then I will do so at the bench. Folks, you have to remember just how many people are listening to you discuss your life and your family which under every other circumstance would be no one's business. Just an FYI for all those when called to jury duty.

I hadn't thought of that.  I just can't imagine any of them arguing to kill her.  I think it was super strange for her to say it, in this case.  Unless she's just so used to asking it, she included it out of habit.

Based on Baez' questions to this witness, it's fairly obvious that Casey Anthony will be taking the stand in the upcoming trial. Only Casey can testify as to the lies reasons why she didn't tell her family about Caylee's death; describe her counsel-coached symptoms of PTSD; explain how Caylee's death was coldly premeditated murder an accident. Baez wanted to find out what this woman's identifiers for lying were because then Casey could be told to watch out for those tells while testifying.

I wish I was a fly in the same room as the Ants right now.. Does this bus over George plan have Cindy's blessing? It is going to be very tense when he appears in court!

The first person that comes to mind to read a victim impact statement is Jesse Grund.  Remember ICA was jealous of his attention to Caylee and he truly loved that little girl.

I agree!  Casey wants the world to think of her as the victim.  While Cindy seems to think of herself as the victim.  George is certainly gonna be another victim when the duhfense bus rolls over him. 

As others have said, I do hope that Rick or someone else in the family steps forward to speak of Caylee and how very precious she was.  Perhaps a family friend will step forward and speak on Caylee's behalf.  Sad that it seems the whole world is grieving Caylee, while her own family, not so much.

I actually think that this last juror would not be a good juror for the defense. Her background in dealing with sexually abused woman will be enable her to disern whether casey/defense team is lying about abuse.

Also, she has two grandchildren, one close to the age of caylee.

She could influence people in the jury room with her nursing knowledge. Might be interesting, any thoughts folks?

What about alternates? Judge is just talking about the 12 jurors being selected.

I agree. I think that's why Baez was so interested in what are her tells for indentifying lying. However, I think he feels her experience with her brother's trian and the fact that her daughter is on probation outweighs that. What worries me is that this lady might be one of those who tries to say all the right things to get on a jury just to make sure she can vote a certain way, even if it means getting a hung jury. I hope I'm being unduly unfair and paranoid.

I felt like she identified more with LDB, being from the same area.  She was trying to appear very unbiased.  Her background with her brother's trial bothers me.  If I were the State, the first thing I'd do is check into that trial.  She said he was acquitted, I'd want to know why he was charged, and why he was acquitted.  I think she's too intelligent for the stupid theory the Defense intends to present PTSD, she really hesitated on that one. JMO

I have no idea if a non family member could or not.  I think he would ask for LWOP as he did love her.  It is sad that this poor baby has no family that is looking out to make sure the biotch that murdered her isn't going to have to pay.

My thoughts/notes:

She remembers CA saying KC was innocent.
Remembers KC telling LE she worked at Universal.
Believes in DP.
Doesn't believes in all of the labels psych's put out such as PTSD.
She worked w/rape victims..so think she would KNOW how they act..like they don't go kill their children.
Has 4 yr old GD...can relate how precious they are at that age. (Won't be able to comprehend how G&CA have abandoned Caylee)
She is THERE for her children...but appears to not expect to CARRY them for the rest of their lives. (She didn't even mention having to babysit her GC...that's unusal)

FWIW, she wants to be on the jury badly.   She may have knowledge for the medical portions but she has it all wrong as to what a juror is supposed to do.   She also sort of slipped when she said that she could make "the" and then changed it to "a" right decision, which seemed to indicate that her mind was already made up.  She has a few familial personal issues which tends to make me think that she might actually sympathize with the defendant.   I got a mixed signal from her.

Forgot to add to my opinion about the last female PJ.  Her daughter may be similar to ICA, she's been in and out of the home, is on probation for reasons the PJ did not want to disclose publicly (don't blame her).  This could go either way, IMO.  If the Defense crucifies Cindy, then that would make her sympathize with Cindy, if she's had a similar experience. JMO

Doesn't Cindy have another brother besides Rick?  Maybe he will step in for Caylee, like a white knight on a horse.   ::CowboySmiley::

I think Mrs Shirley Pleasa as the great Grandmom could also give a  victim statement, but since she herself was a vic of Casey's check dabbling crimes I don't know if that would fly with the defense.

I'd love to see Shirley step in for Caylee!  She was the first person I thought of, but for the reason you wrote am thinking too that the defense won't go for it.  Is it up to the defense tho?  Seems to me that if left up to them, they wouldn't approve of anyone.  If Mr Pleasa is still alive, he would be another good one to step in, even if all he could do is say Caylee's name.  And I think Shirley has a sister?  The lady she was emailing.  All of these would be the best, in my opinion, if their health permits of course. 

He said tomorrow (when they have 12 prospective jurors who have gone through this round of voire dire) he will swear in those 12 jurors unless the defense or state exercise their right to back strike.

Considering Cindy and all the dynamics of the A family, I can sure understand why Gary would want to remain clear of all that.  Hopefully he can set that aside long enough to do this for Caylee.  Not for any of the other Anthony's, but for Caylee, who didn't have a chance to get herself away from the A's.  It would be easy enough to go back to his former stance of having nuttin to do with the A family after that.  IMO.

I was thinking last night that the only folks that loved Caylee in a natural way that really will miss her are the Grunds.  And they thought for a time that she was their's.  But the Anthony's would have a cow if their allowed to give VIS.

I think the statement AF is making in regards to the LWOP means LWOP in Florida.  I thought it was illegal for the jury to consider what the penalty 'means'.  In other words, in a few of the trials that I have watched on CourtTV aka TruTV...a couple of times they have mentioned that fact..once the jury even sent out a question about that and it was denied.

Maybe it is different in Capitol One Murder.  Anyone know??  TIA

I agree.  I have been on a jury twice.  Both were criminal, one with much local media coverage.  I was asked many of the same questions seen here, in a full court room, this was many years ago-pre televised trials.  It is/was very embarrassing discussing family members legal troubles but you have to answer.  In one of my cases, an armed robbery/assault we found him guilty after 3 days of deliberation.  In the high profile case, attempted kidnapping, he changed his plea mid way thru the trial so we were dismissed.  BTW, in the kidnapping attempt he was thwarted by the neighbors (a small mob) that chased him down and beat the hell out of him.

All in all, jury duty was an interesting experience.  Glad I did it.

Today seems to be going better then yesterday.  I still don't get why Foghorn isn't quesitoning the pj's instead of Baez..he is the one with DP experience..he would be able to do this ..I guess he is feeding the questions to Baez today..since they are more on track.

Very easy in Casey's case.  She is staying in the medical wing, part of the P CO jail, inorder to keep her segrated from the general pop of the jail.

Since she is already in the medical section..it would not be more then a doctor writing her an order for meds.  She is more animated today then yesterday..but not her normal fidgeting self.  She's on meds..the more her body gets used to them..the more she will return to normal.

They have completely confused this guy. My God how obvious is it that he will do what ever the Judge tells him to do.

He is not required to consider mitigating circumstances, he can as an option ... he just needs to say YES!!! But they have completely confused the poor guy. he has never done this before and is obviously a common guy and not all that sophistcated.

I am catching up, sorry in advance if this has already been answered.  Dr G  = Dr. Jan Garavaglia, the lady who did the autopsy on Caylee's remains.  She has her own show called Dr. G .

She could write her victim statement and have the State read it for her.  Sometimes this is the best route because given the time to put pen to paper, people can be much more eloquent in their writing then they are in their speaking.  They can say things in writing they may not feel comfortable saying to the accused facing them in a court of law.  I hope they all write their victim statements and let the State read them..everyone who ever knew Caylee and thought she was adorable..this would also be a way for Lee, George and Cindy to write a vic statement without having to face Casey while reading, speaking.  But I would be surprised if they would write a statement for Caylee..they are going to be witnesses for the defense begging for her life..waste..huge waste.

Sadly, I don't see anyone doing this for Caylee.  There will be nobody to stand there for her and argue for justice.  Unless LE can somehow do it? GA or CA won't, IMO.  Unless they get up there and say Caylee wouldn't want you to kill her mom, even though her mom killed her.  They could even show that little drawing ICA saved where the little girl with the hanged teddy bear asks the question "why do people kill people to show that killing people is bad?"  They all make me ill.
Which, goes back to my original question, what is MissManHaircut asking the question for? Would the juror NOT consider emotional statements begging for the Death Penalty from the victim's family.  What does she know?  What would cause GA or CA or LA to beg for ICA's death.  Nothing that I can see.

I think it may be possible if Cindy, George & Lee refuse - Im not completely sure about that.   Now my personal opinion from the heart is that Cindy, George, Lee have forfeited their right to speak for Caylee since they have not only supported her accused killer but also conspired to cover up the crime/obstruct justice to aid the accused.

She was 22 when she murdered Caylee..she is 25 now..she has been an adult since before Caylee was born.  She was 19 when Caylee was born...isn't 18 the legal age for adult status in Florida.  The only person who was of tender years and not an adult in this murder was the victim Caylee Marie Anthony.

I hope they all do the written ones especially Shirley.  They were all robbed of watching this precious baby grow up and all the milestones she would have had.  I always put myself into this as thinking what I would miss if something happened to my granddaughter who is a few months younger than Caylee was.

I was thinking about what I would say.  In thinking about things..most of us Law Abiding Citizens are geared to follow the LAW...in other words...tell me what the rules are & I will adjust.  We have had lots of practice throughout our lives...such as there are probably lots of people that I would have loved to just gently bumped their bumper....and at least once wanted to put my son when he was very young in a cage so I could sleep in peace for an hour..(he was SUPER HYPER-ACTIVE... stopped taking naps @ 1 month old...by 1 yr...slept only a couple of hours a night..thank God I was very young back then)...and I was tempted to smack someone once in a while.

However, all of those things are Against The Law, which was one of the supreme mitigators for me not to do these things.  So, in other words...if the court would say...forget about all of your opinions...and wipe the slate clean.....I am pretty sure that I could do it.  Actually, I identified with the guy who said he could 'compartmentalized' things.  Most of us would be able to listen and read the instructions...and then render a decision based on the rules IMO.

If the direction they are going in is that a young adult's brain isn't 'fully' developed until they are about 29, then I think they are totally grasping at straws.  (which we do know they are doing anyway).

Finnell added a new mitigation factor today, lack of impulse control.  Then when she was trying to clarify it she said lack of impulse control, brain development.  Had KC not gotten everything she wanted, not been coddled, had her actions covered up, and received gratification when ever she wanted she may have learned impulse control.  IMO it has nothing to do with brain development it has more to do with parental development. I can see the defense blaming the impulse control on the Rosebuds.

I just found out each side is allowed 10 peremptory challenges. In addition to this man, I think the defense will use up another for a man from yesterday. LOL..they are stepping into my field now.  Unless things have changed drastically in the last 24 hours..29 is not the age at which the brain is completely formed.  The info I have always had is 24 years old.  And that part of the brain formation does not deal with knowing right from wrong, the formation of a conscience, etc.  Those things happen at a very young age.  Whoever they place on the stand to say 29 years will be blown out of the water by any other legit doctor.  Casey's brain for all intents and purposes, was fully formed in the areas needed for making decisions based on right and wrong, knowing the difference between a lie and the truth, etc.  Poor impulse control does not excuse murder..and that is more a formation of self control..which we all know some people don't have by the time they are 60...nothing to do with brain development..more to do with character development.  Anne will get annihilated on this in mitigation.

Baez used his first out of ten chances to strike a potential juror. The seventh potential juror was dismissed.

One potential juror was sent home after complaining of stomach pain. That person had not been questioned yet.

Perry said that they will get the 12 jurors they need.

"We will get to that number out of this panel tonight," said Perry.

Perry then said on Saturday they will bring in the potential jurors.

IMHO, the word that comes to mind is DRAMA.  He is getting thru these jurors that already went thru hardship & are now in second phase.   He will get to 12 potentials, ask both sides of they are back striking any of them.   He will then continue on with those that have gone thru hardship phase.  From there he has to decide if he brings in jurors that have not been asked about hardship and continue the process OR decide if they return to OC to begin voir dire there all over again.

I mean I understand that he wants to get this moving, he is known as being fair and honest but this is 3 years in the making. A couple of weeks is not going to hurt anyone. If he rushes this and it is overturned this could effect this case and his career. It is too important of a case to be rushing anything and changing rules in the process.

Does anyone remember how many murder trials JP has presided over?  How many appeals?  I saw it somewhere, don't remember the details.  His jury process seems odd to me, but what do I know, this could be SOP for him.???

I don't put much faith in any of the talking heads at InSession.  They are wanting to add every bit of drama they can to this for ratings.  JP is not infallible, but he knows the law over, under and around every member of the defense team.  I think he's covering his bases.  He knows the State can't afford to try this again and I doubt he cares more about getting this done in a week than he does about causing a mistrial.  Faith, Monkeys, Faith! ::MonkeyAngel::

Interesting that she knows how to bilk the system and get away with it.

KC may be on anti-depressants and/or anti-anxiety meds.  That would require, of course, a doctor's orders.  Do we have anyway of knowing whether or not she has had any physicians's visits prior to her coming to Pinellas County. 

Some anti-d's are actually given to people who suffer from OCD and/or PTSD.  Some seem to work better than others, however, it is not sure why.  Under severe stress, I have PTSD and/or OCD and my doc puts me on a specific med during those times.  Takes awhile for it to be effective, but it does not affect me, or others that I know of, like anti-anxiety meds. 

Your probably right but I just want justice for Caylee. Make sure everything is done right so they have no chance for appeal.

I don't give them any credence whatsoever.  They infuriate me because they aren't there in person and they aren't listening to the entire session..they are busy with commercial breaks and their own opinions .

I love Judge Perry and he knows exactly what he is doing.  He also knows the way the other Chief Justices think and is very aware of that everytime he makes a decision in this case.  He told Baez that earlier in the week regarding the Vass air test motion.  I don't think he has done anything that will derail this trial.....he just wants the train to keep running down the track, not shutting down for alot of nonsense questions and probing by Baez. 

Again..why isn't Foghorn doing this jury questioning?  Foghorn is the one who wrote the questionaire, he is the one that is death qualified..why is he sitting there like a bump on a log?

My friend is on the phone with E-Bay, I'm listening in.  He says no one can type in a name to see what is purchased.  It would take a court order to obtain that info. They could obtain the info through PayPal, but again with a court order.   E-Bay only keeps a person's history for up to 60 days.  So how did they get this info?

i think this pj is in school for some sort of medical career because she said something about looking at youtube videos for school about the heart.

She will be able to comprehend the forensic evidence & guide the jury during deliberations to its weight.

She is a student.  Goes on Youtube to see how the heart works.  My guess is she is studying medical field like Dr or Nurse.  Her studies may be heavy with no time for news. I know when my son was in University he lived under a rock as it was only about school and then working in the summer to pay for school.

Do jurors even discuss amongst themselves what their sentencing recommendation will be?  It's an individual decision so I don't see any reason to discuss this until they have all decided.

Thinking about the latest concerns regarding the jury selection process.....

I have served on jury duty in 3 states over the years, including one death penalty case. In each case, the PJs were in the room together but called individually for voir dire. After each one was questioned, the judge asked if there were objections by either side. At that time the PJs were accepted, excused for cause, or excused by peremptory challenges. In fact, I remember one case where all peremptories were used and the defense had to accept the PJ unless there was a reason for cause. In each case, after the required number were selected, the process stopped and those in the gallery or holding area were excused.

How is what Judge Perry doing any different, other than the PJs do not hear the questioning of others? Does this process vary depending by location or judges?

Why is it called Victim Impact evidence if it can't be considered as evidence? Why do it if it doesn't matter?

At this point, I don't think they are going for anything but the penalty phase questioning because they have decided she will be found guilty. Otherwise the penalty phase would not be so important to them.

I noticed when she said she had done some clinicals she did not mention any rotation through the morgue. They may not even do that any more, but that used to be standard in training for degree nurses. I don't know about diploma nurses which I take it that is what she is working toward since the time is so short for the school.

I think we will start to see challenges then at that point I am guessing.

She needs to go.   The standard in DP cases should be neutral or for but not against.  If one is against its unlikely that they would change their position & then it tilts the jury automatically, IMHO.

She would be a real problem for the state. They need to dismiss her.

Guilty is a unanimous vote and they have to vote guilty beyond a reasonable doubt, but the penalty stage only requires "the greater weight of the evidence" not a reasonable doubt.

The whole death penalty vs LWOP won't come in until penalty phase..and at penalty phase they just need a majority vote for the DP..not unanimous vote.  And I think even if it is a tie 6 to 6 the judge can break the tie towards DP.
