Casey Anthony trial: State wants to discuss Casey Anthony's fraud, theft convictions

Lawyers in the first-degree murder case against Casey Anthony are slated to argue this morning about her prior felony convictions in a check-fraud case.

The state wants to be able to tell jurors about the convictions, which occurred in January 2010 when Casey pleaded guilty to 13 charges. Orange County Circuit Court Judge Stan Strickland -- the judge who formerly presided over the murder case -- found Anthony guilty on six of the charges: one count of grand theft, four counts of check forgery, and fraudulent use of personal identification

Strickland withheld adjudication for the remaining seven counts.

Anthony, now 25, was sentenced to time-served. At that point, she had already served 412 days in jail. Strickland also ordered her to one year of probation and ordered her to pay the court and investigative costs associated with the check-fraud case.

Anthony was charged with stealing hundreds of dollars from a friend, Amy Huizenga, in July 2008. Investigators have said Anthony used Huizenga's checks to buy more than $400 worth of clothes and groceries at area Target and Winn-Dixie stores.

After watching this monster I'm starting to sway - the dp is too good for her.  I want her to suffer for the rest of her life.

If she is found guilty (please oh please) and gets life without parole would she be in the general population?  I've seen alot of stuff on television where they don't like baby killers!   Which would be worse for her?  being housed with inmates that hate baby killers or solitary confinement with no one to lie to?

Good morning monkeys.  Let me say I am so sorry for every bad thing I have said about cindy

my 2 yr old got a piece of packing tape stuck in her hair yesterday - it was a mess.

I'm convinced that there is NO way that anyone would purposely put duct tape around a little girl's head & in her hair and PLAN to eventually take it off.  You'd have to cut the hair - have to!  I don't buy the theory that ICA used chloroform & put the tape on in case Caylee woke up - it was all an accident.  No way.  If she put that duct tape on while Caylee was alive she planned on it staying put!!!

I hope and pray today is going to be a good day. Justice for Caylee. I'll be at work but catch up later in the evening. Thanks for all the monkey help.

They keep playing the scenes of yesterday where Cindy is so emotional and Casey is cold..the talking heads are all talking about it as well..does not paint a good picture of Casey to the jury..

NOTE BY VALHALL - I'm beginning this thread with a comment by Attorney Silverspnr posted last evening in the proceedings thread that explains the legal issues behind the argument that will take place first thing this morning concerning whether Casey's prior felony convictions will be allowed into the trial for the purpose of impeaching Casey.

In the Huggins case, the defendant did not take the stand. His defense attorney, over the hearsay objection of the State, elicited testimony from a prison guard about whether the defendant had SHAVED HIS PUBIC REGION DUE TO A LICE OUTBREAK--as the defendant would have claimed had he taken the stand,-- thereby exposing him to having his credibility attacked with evidence of his prior convictions on crimes involving dishonesty.

The purpose of his lawyer eliciting this testimony was to show that the defendant did NOT shave his pubic region in order to avoid having a pubic hair sample collected, and to specifically contradict the State's claim that he shaved his pubic region in order to avoid being INCULPATED by the evidence it would have rendered.

The short of it is that if HE had testified to what he did, he would have been subject to impeachment via his prior convictions pursuant to Section 90.601.

So...In an attempt to avoid putting him on the stand and subjecting him to 90.601 impeachment, his attorney got his out of court ASSERTION as to what he did and why he did it into evidence THROUGH ANOTHER WITNESS.

But UH-OH.
Rule 90.806 says that if he gets that HEARSAY EVIDENCE before the jury through another witness... the State can then move to admit the PRIOR CONVICTIONS even though he hasn't taken the stand.

Remember (from my long ago post), "HEARSAY" (in the LEGAL realm) isn't defined as "something someone else said".
HEARSAY is an "OUT-OF-COURT ASSERTION that is OFFERED for the PURPOSE of proving the TRUTH OF THE MATTER ASSERTED THEREIN".


So... it is not what laypersons think it is, and it is understandably quite confusing, even to many lawyers and judges, so don't lose sleep over the details unless you are preparing to represent yourself in court sometime soon.


For instance, an "ASSERTION" can be an ACTION someone took (shaving his pubic hair, for example), and so long as it is being offered to prove the TRUTH of why the assertion (either a statement of an action) was made, (as opposed to some OTHER, NON-HEARSAY REASON), it is subject to the hearsay rules of evidence.

And it is the PURPOSE for which the OUT-OF-COURT "assertion" is being OFFERED that makes all the difference.
(You will hear one side object to a question by stating, "Objection-calls for hearsay"; and you might hear the other side say, "Judge, we are not offering it for its TRUTH. We are offering it to show STATE OF MIND" or "CONSCIOUSNESS OF GUILT" or for some NON-HEARSAY purpose.)

Now-
As I pointed out in the prior lengthy explanatory post, there are NUMEROUS EXCEPTIONS to the hearsay rule. (And I mean anywhere from 18-26, depending on the jurisdiction).
Yes, it is a complex area of evidence law.
And yes, a lawyer can get into trouble (or create trouble for his client) if he is not well versed in the rules or simply fails to comprehend them, or simply makes an error.

A good example of one of the widely accepted exceptions to the hearsay rule is an "EXCITED UTTERANCE".
For example: "Something's WRONG...I found my daughter's car today... and it smells like there's been a DEAD BODY in the DAMN CAR!" is an "excited utterance" and therefore is admissible pursuant to a specific exception to the rule.
Why? Because it is an assertion (either a statement or an action) made by the witness when he or she was speaking or acting under the stress/excitement of the moment/circumstances such that there is such an inherent indicia of reliability in the assertion so that we accept it as being truthful on its face.

In other words, we EXCEPT from the rule an assertion that was made where the person making it did not have time to reflect on the situation in order to fabricate it.

Another example of an exception which takes the circumstances under which the statement is made into account is the "DYING DECLARATION", which is an assertion made by a person who is operating under the stress of the belief that they are, in fact, dying at that moment. (This is how we can get a deceased crime victim's statement that "X SHOT ME" into evidence after they have passed away, so long as the statement was made under the appropriate circumstances indicating the required indicia of reliability, i.e. they really were dying --or believed that they were dying--at the time they made the statement.)

In any event...
You can read Huggins v. State, 889 So.2d 743 (2004). (GOOGLE IT).

As you will see, there is a dissenting opinion which disagreed with the majority's affirmation of the trial court's admission of this evidence.
The dissenting opinion discusses that even if the prior convictions are proper to admit pursuant to Section 90.806, the trial court should still engage in a "403" analysis.

Rule 403 (in Federal Court, and in the States where I practice) has a similar counterpart in the Florida Evidence Code: Section 90.403.
All deal with the admissibility (or, the inadmissibility) of evidence whose probative value is substantially outweighed by the danger of its prejudicial effect, etc.

Here is the Florida version:
90.403 Exclusion on grounds of prejudice or confusion.—Relevant evidence is inadmissible if its probative value is substantially outweighed by the danger of unfair prejudice, confusion of issues, misleading the jury, or needless presentation of cumulative evidence.

So... expect Baez to argue that a) the prior convictions are inadmissible, improper impeachment, or b) that even if the court finds they are proper impeachment (due to his opening the door), the court should still exclude them under a "403" analysis...and wait to see how Perry rules=)

Geraldo is pond scum.  He claims the prosecution has been "trickling out" bit & pieces of damning information.  He needs to be told it's call the Sunshine Law and the only "leaks" have been the appearances of Baez, Miss Piggy and the rest of the scheme team.  In reality, the "slutification" of Casey was her doing and started a long time ago.  I gguess they keep him online just for hurricane seasons.  He does make a great wind sock.

If Only..... Cindy and George had not covered up what Casey had done this would have been over a long time ago, while i feel sorry for Cindy that of course they lost a grandchild that they adored i still feel they are at fault for not coming forward and trying to protect Casey. i will be interested to see what Lee has to say

I am confident that on cross examination today, Amy will not waver in helping to accomplish justice for Caylee.  I've had "friends" steal from me before, and nothing burns my bottom like feeling stupid because someone I thought was my friend has actually behaved like an enemy.  I'm sure Amy also wonders what the world thinks of anyone who had claimed Casey as a friend in the past, maybe she even worries that people may think she's crazy too.  IMHO, she has been the most honest and forthcoming about Casey's true behavior out of all the witnesses so far....maybe because she's once bitten twice shy by Casey, but I would be as well.  Justice for Caylee is on its way, monkeys! And we will get to witness all of it!

Baez looks so incompetent! this is the second time that the judge has had issue with him over files. He gave them a place to store them... you know the door casey goes in and out of. what is he afraid casey will steal them lol.

the thing that is most awful to me about Casey (besides the obvious of Caylee being hurt) is that it was all pointless.  There are always options if you don't want a child.  In her case, she had parents who were already supporting Caylee and adored her.  Same for the money issue, she stole money for her friends to buy pointless things. She wasn't stealing for any reason other than she apparently wanted to go shopping with everyone and buy pretty bras for herself.  I think she is a very dangerous person with zero conscious.  Her defense strategy alone shows she'll do anything to protect herself.

I cannot get over the difference between the reactions of momster and Cindy during the playing of the 911 tapes.  My heart was breaking for Cindy and her pain was palatable.  However, I am still waiting for the other shoe to drop with this clan.  I still do not trust them one iota.  I hope I am mistaken and they will continue to do the right things, I just honestly doubt it.

while watching Cindy on the stand yesterday bawling her eyes out, I felt guilty for participating as a spectator. I thought to myself, when someone is in that state, they deserve privacy.  It would kill me to see my mother like that, absolutely kill me.  and I am not saint.

They dropped their motion for now.  No idea why though.

Well, this was a huge letdown.  I got up early to get stuff done so that I could watch Jose be embarrassed and spanked again. 

I only heard the last 3-5 minutes, Jeff Ashton was already stating something about imaginary people by the time I had the livestream up.

The statute that the Judge just read makes it sound like any hearsay statements brought out in testimony by the defense in regards to Casey would allow her credibility to be attacked with her prior convictions.  It sounded like the state didn't think it would apply in this instance b/c the defense had not offered the hearsay of Casey for the truth of the matter asserted, but rather to show her continuing lies. 

Interesting.  It sounds like the defense had def. better not try to introduce any hearsay testimony by Casey when trying to argue she told the truth about something regarding what happened to Caylee.  That shouldn't be a problem for them!  ::MonkeyHaHa::

When court was announced it was in recess until 8 AM, Casey turned to Mason, smiling (haven't seen Baez yet this morning.)

Judge has taken the bench, Mr Ashton is arguing Huggins v State:
Punitive father of Ms Caylee?  Is proof that Ms Casey is not truthful.  Judge says we are dealing with more imaginary people?  Also dealing with all of the dealings with Jeff Hopkins and Mr Baker, is any of this true? Is Mr in fact the father of Caylee?  The defense is saying they are not saying any of this is true or exculpatory at this time.  Judge is giving them case law. Again the Huggins Case.  Wereley was written by District Court of Appeals Judge Poston, who now sits on the Florida Supreme Court, Judge wants them to be very careful of it.  The matter is now over for the day, the State will bring it up again later if need be.

The Judge thanks the court staff for working late with the state and the defense over this matter, the last email was at 10:30pm last night.

Seems as though Casey has everyone, including the judge, the state her own defense and the REST OF THE WORLD, confused with her imaginary people.  ::MonkeyEek::

Which tells me that she is perfectly capable of understanding what is going on around her, she acts on cue & knows the difference between real people and her fake friends.   Her attempts at crying or even when she does cry for herself are convenient and she recoops from them spontaneously rather than one would do with upset & not be able to get it back together as easy as she does on cue to what is going on around her....her mother yesterday being a prime example of that point.

The site that published that image said this was when Cindy was having her meltdown yesterday on the stand.

Oh, yeah.  Let's hope he's his usual self and he'll open the can of worms on the stolen checks.  lol

Seems as though that whole morning fiasco and all of that late night court staff could of been avoided.  All the defense has to do is make out a list of real people and a list of imaginary people.  Then the judge and the state can decide who is actually going to be able to testify or add to the truth to the matter.  If not they are going to have to keep finding someone, like Cindy, George, Lee, Mallory, Amy on and on and etc, etc. to testify to lies that have been told by Casey.  No one is ever going to appeal this case unless they can find Santa Claus the Easter Bunny or the Tooth Fairy to hear it.  ::MonkeyDevil:: ::MonkeyDevil:: ::MonkeyDevil::

True.  You can't testify intelligently about Casey and her mother's relationship?  It was one sided, you can only know what one person is telling you.  You only knew her for 5 months?  Yes but I knew some of my best friends for that length of time.  You knew her for 5 months but there is only 1 text about the smell of her car?  Yes.  You were drinking quite heavily during that time?  No, not anymore than anyone else my age.  You would drink?  Yes.  When you crashed your car where you drinking and driving?  No, I had stopped drinking 3 hrs before I drove, I nodded off on the way home from work.  Is that the only time you crashed?  From falling asleep yes.  He is being mean to Amy, she is being sweet.  He is having her look at certain a text message.  He is asking her about a text that says something about her driving, the state objects and they go to sidebar.
Baez is trying to make Amy such a party girl that whatever she says is no better than Casey's non-existent people.  The test message has to deal with her hitting a guard rail and not getting a DUI.  The defense is going to paint everyone is wrong in this case besides Casey, who is just a poor little girl who fell down a rabbit hole.  This just gets curiouser and curiouser..........

Recess is over:   Baez is questioning Amy.  During that accident you totaled your car?  The air bag blew up?  Yes.  Did you send out a text message to call you in case you passed out?  I don't know, did I?  Amy looks at page and says she doesn't know if she hit her head or not.  Is that because you didn't have your bearings straight?  No, I just never hit an air bag before.  Did that cause you memory problems?  No.  You never saw a Dr? No.  You said Casey dated Ricardo and moved in with Ricardo?  Yes.  You met Jesse Grund later?  Yes  Did you go out with Jesse Grund later?  No, we met up to discuss this case.  Can you tell anything to this jury to help them find out what happened to Caylee?  No. Baez also tried to get Amy to say that she told Jesse, she had always wanted to meet a good Christian boy.  Amy said she did say that, he then asked her if she had been intimate with any other of Casey's boyfriends?  That was sustained and he gave up. Amy wants to say something and they all went to sidebar.

Baez tried to make Amy seem like a drunk with a possible head injury and a boyfriend stealer.  So imo Baez was being his usual smarmy self.  Amy held her own ground and came off as a young woman that partied but seemed to still have an education, a job and a life.  Something that Casey has never had, except in her head.

I like that they keep referring to what he prev said. He looks so uncomfortable.
Not going to be easy to drag anything out of him and eveything that he does give to the prosecution is going to be done in spite of what he feels.

I am worried about this too.  I know that Mr George can do a good job at times but I would feel so much better, if Linda or Jeff were questioning Lee.  I do not think at this point, that Lee is trying to cooperate with the state any more than he has to.  Very disappointing so far, can't wait to see what he needed immunity for.  ::rhino::

It will be awful if Lee admits (whether true or not) to molesting Casey.  I think if he admits it, the jury will be inclined to believe that George did it.  Whether they will buy the accident theory is questionable but I would hate for them to believe that George and her brother molested her.

I went to school with KC and let me say say she didn't have many girlfriends she use to talk to the guys more as she was always fighting with the girls, she had only one female friend an she was very much like KC a compulsive lier, what i can say is that KC didn't like her friends meeting her parents as she would worry her lies that she told friends would come undone. They could always ask for him to be treated as a hostile witness during the questioning.  That would allow them to lead him.  I don't think they would want to ask for that in front of the jury unless they have to though.

I hope.  I thought Cindy did well and was being more truthful than not.  I think some of Cindy's most damning testimony to Casey was her nonverbal actions on the stand. She acted the way I imagine a mother who lost a child (accident or not) would act.

Like I said last week, and a few times, I feel Mr. George just does his job.  He does not emote to me that any of this matters.  I am sure it does, and that an acquittal would be horrible, but I sense no urgency, no feelings, no emotions, when he is questioning people.  Nothing upsets him, it seems.  You can tell when Linda or Jeff have had enough.  You can tell when they sense BS.  I believe they want justice for Caylee.  There is never any inflection to his tone of voice.  Maybe that is just his style, but this case, we need more than that.  We need the jury to believe that Caylee is the victim, and not KC.  I did see a bit of neck twitching today when he was shot down the few times by the Duffense.  Let me just say, I hate Simms for a passion for protecting a baby killer.  I hope she has no children.

Interesting..  my son has Autism- high functioning.  I haven't given Aspergers much thought when it comes to Lee - actually, it never occurred to me - but maybe?  My experience with kids with Aspergers/HFA is that they have very good memories.  Now there may be trouble with expressing what it is that he wants to say, or his translation of what is being asked of him..

i think Mr. Lippman and the state prob told Lee that if he has any small doubt in his mind that he might not remember everything in the depo that he just says "i don't recall" rather than trying to say something that the defense could possibly trip him up on.

I think he is nervous too, but a few times I have had to look around when he about to answer so see if my video stopped.

I have never watch a trial that has a sidebar after after few questions.  How is the jury suppose to keep the information in their heads when a few questions are asked then they go to a side bar?  I'm having a hard time remember the questions the lawyers keep asking.  Ths is crazy.

Have often wondered why Lee and Mallory haven't married yet myself.
Expect it would be hard to leave a guy, and his family when the family itself is so in tatters.
Mallory said on the stand she has a close relationship with Cindy, and I don't doubt it wouldn't be comforting to Cindy to have a young woman care for her when her own daughter sits in jail and refuses to see her.

I just turned on the television to Mr. George questioning Lee.  OMG!  He just doesn't have the same style as JA or LDB and it's so frustrating.  He doesn't seem assertive and confident as the other two are.  He seems lost!  I wish he would just take a back set in this trial.   Have faith in the state, have faith in the state!

Lee testifies that Casey told him she saw Caylee last at Sawgrass Apts, she was at Tony's.   This goes more to Casey's lies and does NOT bolster the defense allegation that George was aware of an accident and/or assisted in any manner.

I didnt see him as uncooperative, just nervous & typical awkwardness of Lee.  You can tell by Casey's reactions that she senses he is not on "her side."

I honestly think Lee is trying his best.  He reminds me of my brother...even the way he talks.  Not a very high IQ.  If he has Asperger's then that is definitely why he is acting the way he is.  He is also obviously nervous.  Plus we know he has received immunity from something.  I'm sure the defense will be bringing that up as well.  JMO

Simms is annoying & its not helping Casey's defense by objecting this much - it comes off as objecting to statements they dont want the jury to hear that are not favorable to their client.

Hard to believe that Mr George is the supervisor.  Jr. partner is what I had been thinking.  As tho they have been letting him practice.  Astounds me that he is their supervisor!  Am guessing then that Linda and Jeff can't do much about his screwing up?  Could be as frustrating for them as it is for us. 

Yeah, methinks it would take KC awhile to download a virus last minute or damage the screen. I think it's more likely that Lee (who knows more about computers) tampered with it.

My nephew has that.  He is younger, but he is a whiz on computers, but forget anything else.  He takes everything literally too.  You could tell him you ate his toy, and he would believe I ate his toy.  I don't see the facial mannerisms of my nephew in Lee.  My nephew barely smiled.  There was never a change in the tone of his voice either (extremely loud).  He never got a joke either.

Lee is back on stand.  Mr George is questioning him.  The jury is coming in.
Mr Anthony do you recall asking your sister, why won't you let us see Caylee?  I don't recall, along the lines that she was asleep, we will get her tomorrow.  Mr George is showing Lee a statement with LE.  Lee doesn't seem to be remembering anything, I am really beginning to wonder what is going  on.  Lee seems very flaky, imo.  They are taking a sidebar.......
When you asked your sister, why won't you allow us to see Caylee?  What did you tell Det Edwards?  BECAUSE MAYBE I AM A SPITEFUL BITCH!! 
When your mom was away from the room did you try to reason with your sister?  Yes.  Did you ask her what was going on, what was happening?  At one point she said that Caylee was missing, someone had kidnapped her.  We will get to that, initially when you were talking to Casey did she say anything about your mom?  I can't recall.  Mr George is refreshing his memory with a statement.  I would like to refresh it with Cindy's hammer.
What did you tell Det Edwards?  When my mom would leave, Casey would express that my mom would say.........Objection, hearsay.  Sustained.

They are showing Casey wiping tears...she knows that Lee is trying to still help her, once again...she thinks her big brother will come to her rescue.  They just said that Lee has not made eye contact with Casey though, so that gives me a little hope.  Maybe that is why she is crying.  They really need to figure out the right way to ask him questions, to get this all in.  He is saying that he can't remember a thing.

Mr George has given Lee something to read.  Do you recall the statement that you just read?  Can you tell the jury what you just read?  What did you exactly tell Det Edwards Casey said?  What did your sister say, when you asked her what is going on?  What is the deal?  I can't recall.  Mr George is approaching Lee.  Mr George doesn't seem to know what he is doing, JBP is trying to help him get this testimony.  What did your sister tell you.  She told me that my mother, numerous times that she had thrown it in my sister's face that I am an unfit mother for Caylee and maybe I am.  I went on to say that Casey was a mistake but the best mistake that Casey had ever made.  Where you get frustrating with your sister.  Very, yes, nothing was making sense to me, why couldn't we just go get Caylee and bring her home, there was no reason not to just bring her home for mom.  Do you recall what your sister told you?  No, I don't.  Side bar again...............

Sidebar over.........Mr George asks, where you aware of a police call being made?  My mom said she was gonna call the police and at one point I remember my mom making a phone call.  Did you try to get your sister to talk to you so your mom wouldn't call the police?  Yes, I role played with her, humor me for a second.  The LE is gonna show up and say, hey Ms Anthony how are you doing?  Where is your daughter?  She is with the nanny and the cops will say OK, let's go get her.  What did Casey say to you?  She just stared at me and said that she had not seen Caylee in 31 days, that she had been kidnapped and that the nanny took her.  At that time were you given the name of the Nanny.  Zenaida Fernandez-Gonzales.  Have you ever heard that name before?  No.  Did your mom hear this?  No, she could just tell that I was no longer in the doorway and that we were talking about something while she wasn't there.  What did your mom say?  She said, WHAT DID YOU DO?  WE COULD OF FOUND HER?  Objection, sustained, lol, ya try to unring that bell.  What did your sister say next, where she last saw Caylee.  Saw Grass Apts.  She was staying with Tony L., she was trying to find Caylee herself, she camped out at the Saw Grass Apts, watching the place.  Did she tell you how long she did this?  A couple days.  Did she tell you where else she searched?  Stores, a park, normal places.  When did your sister say that she last talked to Caylee?  That same day, July 15, 2008.  What happened with that phone call?  The only other person on the phone was Caylee, I don't know what Caylee said but Casey told her to put an adult on the phone.  Did you ask her at that moment, why she hadn't told anybody?  I don't believe I did.  Upon hearing this news, what did you do?  That Caylee was missing?  Yes.  I went into search mode, I found out where her bf, Tony L. lived and made arrangements to go see him at his apt.  While you were at his apt did you tell Tony L what was going on?  Yes.  Did you take any items from Tony's apt?  Yes, a laptop, a duffel bag, a backpack and a bag with knick knacks.  When you saw the laptop, what did you notice?  The laptop had a Blue Screen.  What did that mean to you?  A virus, I attempted to reboot it but it still had a blue screen.  What did you do with it then?  I just took it with me.
