it kills me to watch Dr Baden and Kobalinsky say their thoughts on the case when they are clearly in the camp of the defense...they said her skull was on its side during the decomp but yet it was found straight up so that must prove that it was moved, when they clearly know that Kronk said he kicked the bag and the skull came out that is why it was not laying in the same position...geeez they look like fools on tv.

Casey Anthony trial on Saturday focused on bugs, bugs and bugs that were found at the site where Caylee's body was dumped as well as in the trunk of Casey’s car.

On Saturday, forensic entomologist Dr. Neal Haskell took the witness stand. He testified that Caylee's body was placed in the wood near Casey's house since about June or early July in 2008, according to the type of bugs found.
Haskell suggested that Caylee’s body was moved twice and not once as supposed earlier. Before the body was put in the trunk of Casey’s car, Caylee’s body had experienced a short, intial stage of decomposition, Haskell said.

Haskell draw the conclusion, basing on the types of bugs or maggots found in a trash bag in the trunk of Casey's car, a Pontiac Sunfire. Haskell said he found only a single leg from the type of fly - a blowfly - that feasts on a fresh dead body. But he found hundreds of eggs and adult specimens of another type of gnat-like bugs called phorid flies, which are found in the next stage of decomposition.

Haskell said the bugs were found on Caylee's remains that were found in a wooded area, on paper towels as well as inside a vacuum cleaner that were used to clean the trunk of the car.

Turbo, what do you think Casey did with her car if she was using the empty house?  I would think neighbors would have seen it at the house, or at least coming and going from the house.  I really think Casey just drove around, went to the parks, shopped, etc. until it was clear of her parents to go back home.  I also have no doubts that LE checked this all out, thoroughly.  If not from reading here or other forums, but most certainly after the Dominic Casey video.  I really want to believe that Caylee was not left alone. 

I have to take my fur-baby to the vet this am.....So I'm really going to be looking forward to Magiceyes recap and all posts from you great Monkeys!!

I haven't posted in a few days, but I have to say..  I went grocery shopping on Friday, during Dr. G's testimony.  I knew it would be riveting, so I took my phone with me and listening to her testimony while walking around the store.  That's terrible, but that was something I just couldn't miss.   She did such a wonderful job! Especially when cross examined.  ::MonkeyCheer4::

I don't know.  This could go badly for the state, especially since they did not show the jury the actual Q12 hair, to look for comparisons.

I feel the same way, about this evidence.. it's too confusing, I believe.  There are different characteristics of hair banding, or hair that is from a decomposed body but with no banding.. I wonder if the jury might ask how they know that the hair in the trunk was really displaying decomposition..  or the banding the state originally said was there.. when it's not always there, from what this guy seems to be showing. What he's saying leaving me going :HUH?!     I think you may have said it better, ZooMom.      Plus, he and the other people mentioned came up with different conclusions, from what he said.

It will still resonate with them longer because they are aware that the defense has objected - when they do hear testimony they will realize it was objected to strongly.   They arent naive as to why they are being asked to be removed.   They must be back there saying "what is that clown objecting to now."  ::MonkeyWink::

Oh I do too.  But, IMO, they could go in areas more easier to see for the jury or much clearer than this hair banding stuff.  Most of the appaent decomp hairs look the same to me as the ones with hair banding.  Some are more obvious than others, though.  We shall see.  On cross, they are going to ask if children were studies, etc., what environmental conditions were present and the witness does not know.

Another example of bozo not being prepared as they were available to the defense at the FBI office and Ms. Simms went there on a weekend to view all of it.

So... Baez is saying they didn't get anything about a power point, and Simms says yes they did, just not color copies.   Wow, they're all screwed up.

Written portion was Fed Ex'd to the State more recently, Paula Wolf informed in March - emailed in color

Ms Wolf from FBI is in the court room
Sims was afforded another opportunity to examine photographs
Ashton not aware that defense received something in black & white versus color

Sims wrote down on the 9th, last week
Ashton - defense asked for 4 additional copies, Ashton put it on the defense table

Sims is animated in her argument - she's giving another version, also stating that she was not permitted to copy

It is not - Im sick of these drama queens, the fact that most of them are attorneys makes their theatrics even more pathetic.   The witness can still testify to the study, just without visual aid.  If the defense does its regular stupidity they will open the door for the power presentation to come in on Redirect.

I am sure that Baez will open that door and the judge will be lenient with the door opening. Any mention of the photos will get them in I do believe.

I have to say that I don't feel that the State needed the powerpoint anyway.  I think this issue is a waste of time.  I think it is confusing.  It has already been addressed that there are no ways to produce a death-band, that are known.  To me it is now better to leave it alone.

The FBI withheld the power point, so yeah Id say so.   Bill Schaeffer thinks its certainly not fatal.   CJBP denying the power point is exactly why he has never been revered on his previous 8 DP cases.

Stephen Shaw is Hair and Fiber Examiner for the FBI.  He has been employed as this for 6 years.  He has 2 degrees in hair and textile.  He has had additional training as a hair and fiber examiner for one year at the FBI including ID tests, matching tests, oral boards and final tests.  He has previously testified as an expert in court 12 times, Florida, NY, CA, other  states.  The judge makes him an Hair and Fiber Identification expert.

In Dec 2008, he became involved with a hair in the case of Caylee Anthony.  It was the part of the quality assurance procedure.  They have another examiner perform the same tests to make sure the first one was correct.  It confirmed the apparent decomp and microscopic similar from the sample hair to the hair brush.  He was given a hair mass to examine it was submitted by OC Sheriff's office.  He examined the hair mass, hairs microscopically and compared it to the hair from the trunk of the vehicle.  He found decomp on a hair in the hair mass, it was at a later stage of decomp.  It had the band and the root but it had a brushed like appearance related to later decomp.  All of the hairs were microscopically similar.  This hair and the hair mass were consistent to each other and the hair found in the trunk.  He has done research in the FBI for decomp found in hair.  The preliminary results are from 600 hairs from living persons, stored in different locations, indoors in water, out doors in sunlight cars and car trunks in different climates and in different locations.....time periods varied....he then examined the root ends of the hairs, none had root banding.  Known deceased hairs he tested confirmed post-banded hairs. Examiners did make mistakes on two of the hairs, they eventually compared these hairs and confirmed they were not death banded. Side bar.........Side bar is over.  Baez wants a proffer over the power point demonstration.  Baez says he had no knowledge, lol.  Of the power point demo.  Baez wants things to be done in a just way.........Oh brother, lol.  Ashton says that everything in the power point has been provided to the defense.  Baez is still going on and on and says he only got the photos and they are black and white photos, color is different.  If it is going in living color, there is a difference.  Now he is worried about living,,,,,,,geesh.  The only one he is worried about living is his beloved Casey.  Yuck.....

Looking at photos on the monitor, they are hairs used in the study he performed.  Hairs from living people before and after they were studied. Baez wants to know if the dark area in the living samples, show decomp and he says no.  It is not apparent decomp.  It is something natural in someones hair.  Next photo is hair stored in the trunk of the vehicle they are from a living person, more photos from living people, none had the band.  The darkening in the root area is not a band.  When you refer to the banding what do you mean?  Band has to be above the root bulb and it has to be opaque of a certain thickness, in a known dead person's hair.  The decomp in living hair is not the same. The testimony can be confusing antemortem means from a living person and postmortem means from a dead person. Prior to this case was this banding known?  Yes.  Showing more slides of hair in the tests. These are postmortem hairs.  Baez is just going on and on asking about the test done on Hair-Banding by the FBI.  Jurors are not in the court during this proffering.  Baez asks if the climate is the number one factor in decomp?  Yes, in the rate of decomp.  He said hairs in warmer climates will produce bands faster, lol. Baez is done, done, done and I bet he wished he never asked that question, lol. Are there are differences in hair from adults and children?  No, we don't can't tell if a hair came from a child or a an adult.  A hair from a young child can be thinner.  There were two children in the test, there were no difference in the findings.  Were any of these hairs exposed to trash or garbage?  No, not that I am aware of.  Mr Baez is done, he says they may be cumulative and the power point says it is improper bolstering and improper climates.  He says we are talking apples and oranges.  Also 403, an unfair prejudice, we were given this at the last possible second and we can't do a similar study.  Judge says it is not a 403, it is a 6th amendment right.  Baez says it is both.  The power point is just not fair.  Judge is asking when this study was done?  March, 2011.  They told the state and the defense then that it was done.  The judge wants to know when and what was told to the state and the defense of this study.  Ms Lowe told the state and the defense of this study in Mar 2011.  It was provided to the state in color photos and the fact the study had been done in May.  They were emailed in color.  Jeff Ashton says the state and defense were told by a teleconference that the study was done.  Arrangements were made over numerous photos.  The photos were requested and sent to the local FBI in color.  They have been provided in color many times.  The state has them in color, Jeff did not know that the defense printed them out in black and white.  The state emailed them in color.  He is not responsible for the defense printing them out in color.  Ms Simms says some were sent last week.  Jeff says they were not aware they had black and white photos that were not acceptable.  Ms Simms is complaining about when she got the photos and the day she got them.  She has not been able to cross examine in deposition all of this experiment.  She requested but she was not given color copies or make her own.  The FBI says it could not release it because it was currently research material.  Jeff Ashton is addressing the improper bolstering argument.  This does not come under improper bolstering.  Baez has a concern of finding himself in the middle of trial and he can't do a thing about this power-point.  He has done every single thing they can and the FBI has been wonderful, however it is still unfair.......just unfair.  He has never done anything about this unfortunately but Ms Simms has.  This test began after the depo was taken after Mr Shaw was deposed.  Ashton says that the FBI offered to have this examined in person and the defense did not do it.  This study was contemplated before this case.  This case spurred him on but it had already been contemplated.  Judge now says what Casey is charged with......the state has indicated that they seek the Death Penalty.  Rule 3.220 says the state must provide certain things to the defendant, it is not the FBI's responsibility to provide it, it is the state.  He goes on to say that he finds it troubling that the state in the 9th hour provides a power-point in color that was not provided to the defense.  The power-point is denied.  However, the the expert has testified and it will stay as is.  It is the state of Florida not the FBI responsibility for this power-point, it will not be shown to the jury.  The FBI expert can testify about it but the photo's from the power point can not be used.  The defense could open the door to the power point if it asks anything about the photos.  Recess for five minutes. 10:15

I was beyond surprised to learn here yesterday that Casey has not been medicated throughout this process. Having watched her carefully these last SO many days, I was convinced that frozen look had to be the result of daily medication.  Am still trying to rearrange my brain cells (wrap my head around) to process how she can sit like that. I am doubting I will ever understand that stone cold face of hers.

I believe at the beginning of his testimony he said there had been banding on the hairs in the hair mat, but said that the changes were much more further along in the decompensation process than the one in the trunk.

I cannot follow Baez at all.  Every time he gets up to question a witness I get confused.  And every witness will ask Baez to clearify what he's asking.  I think if I'm confused with Baez, the jurors are gonna be.  I follow the state just fine.

Any slight progress Baez may have made---is fast fading due to his [ hairy ] questioning.  He is the most confusing person.

No, his 2 examiners, picked out 1 hair (but different one) each on their review of these hairs, that they identified as having hair banding, but were not, and realized their mistake and excluded those hairs, and the 1 hair each did come form live people, and were then left in the elements to see what would happen.  I think is what I got anyway.

She is clear, concise, intelligent, and also very likable and easy to understand.

Most of she is believable..it is her word about the sticker residue and shape being left on the duct tape.

This is so important because the jury will conclude only one person would have placed that heart sticker there, a female who had all those heart stickers plastered around pictures and mats on pics...that would be Casey.  No way are they going to believe George would stop wrapping the body for disposal to run in the house and get a heart sticker for the final kiss off..no way.

I waited for this for a hard long time..and I was hoping someone straight forward and precise would give the testimony..and this is exactly what she did.  This is a heart tug at the jury when they go to deliberate this..

Stephen Shaw told jurors on Monday that he analyzed hair found in Casey's truck and samples taken from 2-year-old Caylee's skull, which was found in a wooded area near the Anthony home.

Shaw testified that he saw further evidence of decomposition on the hairs taken from the child's skull than on the hair found in Casey's trunk.

However, Shaw said, "I cannot say that a hair did originate from a person. I don't know the source of those hairs."

Prosecutors have kicked off what could be its final week of testimony in the Casey Anthony trial by calling a hair and fiber investigator for the FBI.
Monday marks Day 17 of testimony, and the beginning of Week 4 in the 25-year-old's murder trial.

The tattoo artist needs to testify, IMO, but that's a two edged sword for them in a way. Yep, she got the tattoo and yep, it says "Beautiful life", but he says adamently that she had been in there multiole times and was a very attentive, loving Mother.

I think they are smart not putting every single person up there.  You run the risk of confusing the jury.  We have had 3 years to absorb all the craziness of this case, but the jury has not.  It could appear to be, oh what is the word, bullying or badgering, too much information, etc.

I know the state has a lot more evidence they could present and many more witnesses they could call to testify...why aren't they? I'm not sure the state has presented enough evidence and testimony for the jury to render a "guilty" verdict at this point. I'm hoping the state will slam this all home in their closing statements, but I wish they would do more now to avoid a mistrial, an innocent verdict, or a retrial. I know Bozo is an idjit and I'm sure he will flub up during the defense phase of the trial, but jeesh, for the first time since Caylee was "officially" missing, I'm worried the BHW will walk! Anybody else feel the same way?

So many of the witnesses would just be rehashing what has been presented already and I don't think the state wants to totally overwhelm the jurors with repetitious testimony. I think the state's cross will be exciting.

I cannot think of anything they left out.  Just me though.  And, again, I am glad they are going to wrap this up soon, so the jury does not have to remember everything for forever and because at some point the jury is going to get angry with them if it goes too much longer. 

There is NO proof, just Casey's lies...if she testifies we have Tony's proffer that can come in.   It also doesnt matter one bit what hired expert may "speculate" as that is not proof it occurred.    It is a huge defense error to mimick the Menendez brothers defense by their attorney, Leslie Abramson.

First state witness is Steven Shaw.

Jeff Ashton is up.............

Stephen Shaw is Hair and Fiber Examiner for the FBI.  He has been employed as this for 6 years.  He has 2 degrees in hair and textile.  He has had additional training as a hair and fiber examiner for one year at the FBI including ID tests, matching tests, oral boards and final tests.  He has previously testified as an expert in court 12 times, Florida, NY, CA, other  states.  The judge makes him an Hair and Fiber Identification expert.

In Dec 2008, he became involved with a hair in the case of Caylee Anthony.  It was the part of the quality assurance procedure.  They have another examiner perform the same tests to make sure the first one was correct.  It confirmed the apparent decomp and microscopic is similar to the sample hair to the hair brush.  He was given a hair mass to examine it was submitted by OC Sheriff's office.  He examined the hair mass, hairs microscopically and compared it to the hair from the trunk of the vehicle.  He found decomp on a hair in the hair mass, it was at a later stage of decomp.  It had the band and the root but it had a brushed like appearance related to later decomp.  All of the hairs were microscopically similar.  This hair and the hair mass were consistent to each other and the hair found in the trunk.  He has done research in the FBI for decomp found in hair.  The preliminary results are from 600 hairs from living persons, stored in different locations, indoors in water, out doors in sunlight cars and car trunks in different climates and in different locations.....time periods varied....he then examined the root ends of the hairs, none had root banding.  Known deceased hairs he tested confirmed post-banded hairs. Examiners did make mistakes on two of the hairs, they eventually compared these hairs and confirmed they were not death banded. Side bar.........Side bar is over.  Baez wants a proffer over the power point demonstration.  Baez says he had no knowledge, lol, of the power point demo.  Baez wants things to be done in a just way.........Oh brother, lol.  Ashton says that everything in the power point has been provided to the defense.  Baez is still going on and on and says he only got the photos and they are black and white photos, color is different.  If it is going in living color, there is a difference.  Now he is worried about living,,,,,,,geesh.  The only one he is worried about living is his beloved Casey.  Yuck.....

Looking at photos on the monitor, they are hairs used in the study he performed.  Hairs from living people before and after they were studied. Baez wants to know if the dark area in the living samples, show decomp and he says no.  It is not apparent decomp.  It is something natural in someone's hair.  Next photo is hair stored in the trunk of the vehicle they are from a living person, more photos from living people, none had the band.  The darkening in the root area is not a band.  When you refer to the banding what do you mean?  Band has to be above the root bulb and it has to be opaque of a certain thickness, in a known dead person's hair.  The decomp in living hair is not the same. The testimony can be confusing antemortem means from a living person and postmortem means from a dead person. Prior to this case was this banding known?  Yes.  Showing more slides of hair in the tests. These are postmortem hairs.  Baez is just going on and on asking about the test done on hair-banding by the FBI.  Jurors are not in the court during this proffering.  Baez asks if the climate is the number one factor in decomp?  Yes, in the rate of decomp.  He said hairs in warmer climates will produce bands faster, lol. Baez is done, done, done and I bet he wished he never asked that question, lol. Are there are differences in hair from adults and children?  No, we don't can't tell if a hair came from a child or a an adult.  A hair from a young child can be thinner.  There were two children in the test, there were no difference in the findings.  Were any of these hairs exposed to trash or garbage?  No, not that I am aware of.  Mr Baez is done, he says they may be cumulative and the power point says it is improper bolstering and improper climates.  He says we are talking apples and oranges.  Also 403, an unfair prejudice, we were given this at the last possible second and we can't do a similar study.  Judge says it is not a 403, it is a 6th amendment right.  Baez says it is both.  The power point is just not fair.  Judge is asking when this study was done?  March, 2011.  They told the state and the defense then that it was done.  The judge wants to know when and what was told to the state and the defense of this study.  Ms Lowe told the state and the defense of this study in Mar 2011.  It was provided to the state in color photos and the fact the study had been done in May.  They were emailed in color.  Jeff Ashton says the state and defense were told by a teleconference that the study was done.  Arrangements were made over numerous photos.  The photos were requested and sent to the local FBI in color.  They have been provided in color many times.  The state has them in color, Jeff did not know that the defense printed them out in black and white.  The state emailed them in color.  He is not responsible for the defense printing them out in color.  Ms Simms says some were sent last week.  Jeff says they were not aware they had black and white photos that were not acceptable.  Ms Simms is complaining about when she got the photos and the day she got them.  She has not been able to cross examine in deposition all of this experiment.  She requested but she was not given color copies or allowed to make her own.  The FBI says it could not release it because it was currently research material.  Jeff Ashton is addressing the improper bolstering argument.  This does not come under improper bolstering.  Baez has a concern of finding himself in the middle of trial and he can't do a thing about this power-point.  He has done every single thing they can and the FBI has been wonderful, however it is still unfair.......just unfair.  He has never done anything about this unfortunately but Ms Simms has.  This test began after the depo was taken after Mr Shaw was deposed.  Ashton says that the FBI offered to have this examined in person and the defense did not do it.  This study was contemplated before this case.  This case spurred him on but it had already been contemplated.  Judge now says what Casey is charged with......the state has indicated that they seek the Death Penalty.  Rule 3.220 says the state must provide certain things to the defendant, it is not the FBI's responsibility to provide it, it is the state.  He goes on to say that he finds it troubling that the state in the 9th hour provides a power-point in color that was not provided to the defense.  The power-point is denied.  However, the the expert has testified and it will stay as is.  It is the state of Florida not the FBI responsibility for this power-point, it will not be shown to the jury.  The FBI expert can testify about it but the photo's from the power point can not be used.  The defense could open the door to the power point if it asks anything about the photos.  Recess for five minutes.

I do not understand at all what is missing.  They have put in everything, that I remember, other than a few witnesses.  They had over 300 people on their witness list.  They cannot call them all.  They also have to think about what the Dumfense will do to these witnesses on cross, and make decisions about what is most important. 

They got the hair banding in.
They got the decomp in trunk in.
They got the air tests in.
They got the sticker in.
They got all those videos in jail in.
They got her shopping on video in.
They got the duct tape in.
They got a simulated video of Caylee decomposing in.
They got her not looking for her daughter and partying for 31 days.
They got her lies in.
They got the dog evidence in.
...And I am sure there are a trillion other things they successfully got in.

What are they missing?

As cleverly as the State has presented their case thus far, I am confident they know what they are doing.  Depending on what bozo tries to pull, they have an opportunity for rebuttal witnesses, which knowing how bozo is all over the place, should open many doors for them.
I remain confident the State will leave no "paver" unturned in seeking justice for Caylee.

11:15am Monday, June 13, 2011 Court is in session.

Next state witness is Elisabeth Fontaine, FBI

She is a forensic latent print examiner for the FBI. She has a masters degree in Forensic Science and a masters degree in chemistry and training at the FBI.  She completed an 18month training latent prints and other prints.  She has processed 75 thousand prints.  She successfully completed the FBI certification in fingerprinting.  She had a supervisor at first then worked on her own but still had her work looked over by someone else.  That is normal protocol.

She did work on the Caylee Marie Anthony.  It was on 3 piece of duct tape in the case.  He handed her a piece of evidence, she identified it as the bag that the duct tape was  in.  Did you separate the 3 pieces or were they already separated?  She is referring to her notes.  One item was separate, 2 were stacked or stuck together, she examined them stuck together and separated.  Q62, Q63 were approx. 6 inches in length.  The glue was almost gone and the duct tape was no longer sticky, it had migrated and formed a glob of fibers and glue.  She examined Q62 and Q63 for fingerprints, she was told that the duct tape was found on remains and in an area that could be flooded.  She had no expectations that there would be latent prints.  Because latent prints are very fragile and consist of oil, etc.  She still processed them the same for latent prints.  She found no latent fingerprints.  She did however find something she did see.  On Q63 she saw an outline of a heart shape that appeared on the edge of the duct tape.  She was using an alternate light source after super glue to analyze items.  That is used to raise otherwise invisible prints.  The outline was approx the size of the dime.  She compared it to the outline of a band-aid that you would wear for an extended period of time.  At the time, she didn't know that it would be important, she called over a supervisor to view it as well.  She came over and viewed it as well.  She did not photograph it because it was not her job, she notes it and continues on.  The FBI does not expect her to photograph the item, she went on to process it, she later tried to photograph it but it was gone.  She had already used solvents and performed other tests on the duct tape which removed the heart shaped residue.  She used a RAM dye stain.  She also used black powder and alternate black powder.  When she went back to take a photo of the heart shape residue, it was gone.  It was the size of a dime in the shape of a heart.  Jeff is done........

Baez is up..........

He is pleasing the court.  Who is the first person to get these items?  It went to evidence control then went to trace evidence, it is not detailed in her records.  She does not know the travel path of these 3 pieces of duct tape.  The FBI receives it and decides who is going to see it.  Evidence control got it and was sent to trace evidence and then to her.  Trace evidence contacted her to see if anything needed to be photographed, visible prints.  They were looking for hair, fibers?  Yes.  What is the first thing you did?  I don't remember what I did, I think I started with the one not stuck together.  When you got Q62 what is the first process you did. When I got the 3 pieces of duct tape, I looked at them to see if I could see any prints, it is the first step.  The second step is a laser to detect latent prints.  This allows you to see any items on the evidence?  Yes, we look at items with a laser for prints.  The 3rd step is ultra violet.  This helps you pick up fingerprints you could have missed? Yes.  What is step four? It goes to back to trace evidence for fibers, etc.  She then got the 3 pieces of duct tape they were now all separate.  Next step is super glue, all 3 pieces of duct tape were super glued to add moisture to the air, the air is attracted to the moisture and lets the super glue harden over the prints.  The next step is the Ruvis system.  It is an ultra violet light that is done through a camera, you look at not the object but at the monitor, it takes away any 3d effect on that item, debris...etc. The object is enlarged on the monitor.  The next step is the RAM dye stain that is used on super glue.  It gives the super glue a orange glow.  After the RAM, she uses alternate black powder.  The final step is the traditional black powder.  To test for oil left by latent prints.  Then you went on to Q63?  Yes.  When you saw this small item, it was something that you just visibly saw?  After processing the item it was no longer visible.  You saw this after you had gotten it back from the trace evidence twice?  Yes. After you received this you did a report and you said that they had no finger prints at all?  Yes.  You are aware that after you examine it, it goes on to another FBI examiner?  Yes.  And you are aware it was later contaminated?  Objection.......side bar.....side bar is over. 

9:00am Objection sustained.  Baez is still up.

You filled out a report?  Yes.  After doing a complete and total workup you were not able to find any fingerprints on any duct tape? No.  Baez is done.

Was Q63 on top of Q64?  Yes.

Jeff Ashton says his next witness will not be here until tomorrow afternoon. 

Judge is talking to the jury.  He says the state will end their presentation Wed and the defense hopes to start then.  We are ahead of schedule.  We may probably be done by the end of next week with all of the evidence.  We may get you to deliberating the 25th or the 27th of June.  Side bar......Side bar is over. CJP is recessing till tomorrow afternoon at 1pm.  Court is adjourned for the day.

 

The tatoo artist, as some  have said above, would testify to the tatoo he gave her, but also that she was a loving mother and had seen KC with Caylee many times.  So, I feel they left that out rather than giving Bozo a chance to have her lovingness brought up again.

The fight, they would have to bring up George and Lee and Cinday again, to discuss this fight, that would open up their testiomy as untruthful (different back then to now), and could give an opening to Bozo to get the sexual crap in. 

They made decisions, IMO, after looking at the whole picture. 

One thing I would like to see is the bottle of chloroform and what was in the needle, but maybe it was not clear enough to present. 

All the jury really is wanting by this point is to go home and be done I think. I believe the state has covered enough that the defense is really going to have to work hard and appear smarter than they have been to save her.  If the defense runs it longer than a week they will lose the jury in some ways.

What about the tattoo guy?  His testimony would tell that she came there, got a tattoo, while Caylee was missing.  What about what Lee got immunity for, I haven't heard him testify to anything we didn't already know and they had to pull teeth, to get him to remember anything.  I am in shock right now, I know I will think of things later, that I think the state left out.  The talking heads on In Session are driving me crazy about reversible error by allowing the Caylee and Casey video to come in.  They say that it was bad that Casey was smiling while Caylee was turning into a skull with duct tape.  I don't know what to think.  I am one confused monkey.  ::MonkeyNoNo::

Am I right that for an acquittal to happen all 12 jurors have to agree, right?

There is zero chance that all 12 jurors will agree she is not guilty. 

So, IMO, the only outcomes possible are guilty, guilty of a lesser charge, or a hung jury.

It only takes one to say she is not guilty and she walks. I think the prosecution decides to try the case again after hearing how the jurors voted. So lets say 11 voted guilty one voted not guilty they would definitely retry it. But if it's split they may decide not to or may decide to go with a lesser charge. The judge could let her out on bail awaiting the decision of the state.. Man I hope that does not happen

I think the only real problem would be one lone juror with no sense. I was on a jury many years ago where a man tied his girlfriend to a chair and beat & tortured her for hours before finally letting her go. It was a classic "open and shut" case where there was absolutely no doubt. But there was one lady on the jury who kept saying, "Well, I just think she must've done something to provoke him." Holy cow! We finally convinced her to just stick with the facts of the case, but it a long time for her to come around to a simple guilty verdict. Hope she's not on this jury! ;-)

I hear ya! I guess there are a lot of legal rules in trial that we don't understand. I know when I was at my best friend's murder trial you wanted to scream in court to let the jury know all the things that were not allowed in trial. MOO but a lot of things that are not allowed in trial seem to protect the defense, and not the victim ::MonkeyNoNo::

My concerns are the farmville lady and the teacher who said he will use this case to bring in front of his students.

How is it possible it takes all 12 to say she is guilty, but only 1 to say not guilty.  That makes no sense to me.  I believe 1 not guilty would be a hung jury, but not an acquittal and the state would retry it. 

For those that are wondering if enough was presented by the State & are concerned, FWIW wait until the State's rebuttal before worrying significantly.   I also anticipate that whatever the defense puts on the State is much more prepared to cross their witnesses effectively.

The State has put on a very detailed, very precise case that was laid out as a timeline and as to her character.

There has been most of the evidence presented, backed by the testimony of expert witnesses and their judgement of this evidence as to what they see, what they find, when they see these things occurring, and what that means in this case.

We have had family and friends denote what she was doing and what her demeanor was leading up to June 15th and then again during the 31 days.

We have had LE present how they came to be involved in this case, their interaction with the family and Casey, the lies they experienced, the outs they gave her for the accident theory while talking with her and the evidence they found that this was not simply a kidnapped child.

It is a clear synopsis of what has happened in the time leading to June 15-July 15th.

Undisclosed bombshells are not allowed and would be probably not allowed in by the judge.  But it works the other way too, the dumbfense cannot have any undisclosed bombshelles either. 

I agree with you CBB, one juror disagreeing causes a hung jury and I feel 110% certain they would re-try this case ASAP and she would stay in the pokey until the next trial, all jurors would have to believe she is not guilty for an aquittal.

OOPS, almost forgot if one juor votes for a lesser included and the rest vote for 1st degree murder does that also hang a jury?

Oh wait your right so in order to be an acquittal or convicted everyone has to agree that she is guilty or not guilty. If one votes not guilty than it would be a mistrial and then can be retried if the state chooses to Right?  I do not think that all 12 could say not guilty I wouldn't think anyway

I think the State is very methodical in presenting thier case and only brought in what they could prove.  There's a lot of other stuff that could bog down the jury and give the defense room to provide doubt.  Once the defense brings in their witnesses, I'm sure the state will tear them apart and then it will end with the defense looking stupid (because stupid is as stupid does) and the state will win. 

Don't fret over what you cannot change.  Justice for Caylee is coming.

I can not see even 1 person saying she is completely not guilty..remember there are lesser charges as well..but I do think she is going to get full guilty verdict and sentenced to LWOP.

Samarie, my boyfriend works for the Sheriff's dept here in FL..and he said the same thing. He said they did not present enough evidence to point to KC, he agreed common sense would say guilty, but legally he can not see her getting the DP...

I hope so. We all know she is guilty but the law is so precise and they have to meet certain burdens. I just hope it falls under the law.

It is a hung jury, an acquittal is a not guilty verdict which in this case would have to be all 12.

This is stupid, but in Florida, it has to be a unanimous 12 juror vote for either guilty or not guilty in the guilt phase, but in the penalty phase, the majority rules, and if a tie, the judge can break the tie.

No there are lesser charges..2nd degree manslaughter is one thing the judge mentioned at the beginning when he was giving the laundry list of her charges.

There is no way someone is going to sit through this and say she was a great mother and did not cause any harm or allow any harm to come to her daughter and some other dude did it.

Remember even the charges of child neglect for a child of tender years are on there 2x.

I am so far behind and have tried to follow along.  I hopefully will be able to go back and watch the videos eventually. 

As much as I did see of the State of FL vs Casey Anthony one thing sticks out in my mind and it is the excellent, efficient layout of the case by the SAO.  I also think back to December 11, 2008 when the defense filed a motion to wave ICA's rights to a speedy trial and on that day the Lord brought Caylee's little earthly body to light.  Karma is really something.  I wonder if ICA and the dufense ever regret that filing.  If the state had less time to prepare, I don't think their case would have been as wonderfully presented.

Yes, and that would cause the judge to issue a misstrial and then the state would have to decide if they want to retry her.  This case has cost a huge boatload of money.  I am not sure what they would do.  I would hope they would retry it.  I know my faith in our justice system is already shot to heck but that would further skew my view of our justice system.

It may have supported the defense's claim that Caylee died accidently in the pool and that KC, because she is emotionally and intellectually immature, ie "brain development," did not react as a "normal" person would under the circumstances. Of course calls to George does NOT support the defense claims that he found a lifeless Caylee....beats me. I stated a few pages ago that I am thoroughly confused at this point.....

Well she does not get 1st degree. Does that mean she won't get charged for a lesser charge and found guilty for aggravated manslaughter and the counts for lieing to the police. I am so confused. Are you saying that if they say not guilty is over and she is out of jail and that's that?

In court at the Casey Anthony murder trial on Monday morning, Elizabeth Fontaine, a physical scientist and forensic examiner, testified that there was heart-shaped residue on the duct tape that had been over the mouth of the 2-year-old.

"It was approximately the size of a dime," Fontaine testified. "If you were to wear a band aid for an extended period of time, and then take it off, there would be glue residue and debris. That's what this looked like, but in the shape of a heart."

The state plans to introduce evidence that similar heart-shaped stickers were found in the Anthony home.

But my gut says Casey's own words are what is going to get her the guilty verdict:

1. "Maybe I am just a spiteful bitch."  Who gives their brother that explanation to help finding their missing daughter and get to the bottom of what happened while waiting for the LE to arrive..a person who is unconcerned with finding her daughter and knows exactly what happened. 

2. Her lies to LE the minute her mouth opened on the  third 911 call her Mom placed she started lying and to this day has not stopped..which means she has changed her story numerous times..and the jury has heard all the versions of those lies.

3. LE gave her the chance at Universal to admit to an accident..and she never has...until Baez opening statement.  If that statement was true..why didn't Baez plea her out to an accident earlier ?

The 31 missing days will have an impact..no one believes she had her own investigation..and the jury won't either.

As I look at this I think she will never attended her first day of kindergarten or go to her first prom, or experience her first kiss.....I also wonder if she ever went to a birthday party for another child, or went trick or treating, or went to an Easter Egg hunt other than in her back yard or had another child to play in her playhouse or sand box with?  I think not and that really saddens me...I think she was a lonely little girl

Casey Anthony's jailhouse pen pal has been booked into the Orange County Jail from Tallahassee, and is waiting to testify.

Robyn Adams has been placed in protective custody in a separate section of the jail, so she will be unable to cross paths with Casey until she is called into Courtroom 23.

I think they will have her testifying to the argument..once they have had Mrs Pleasa on the stand to say the discussion she had with Cindy on June 15 about the stolen money from Grandpa's account to be used for the nursing home..and I hope they include that part..not just say  stolen money..then Cindy can testify to argument and what it was about withuot the stolen money being considered hearsay.

I think the Stte will go back to where they started and tie this up with a bow.  Can't wait to hear their closing.
