Court recessed early on Monday with the state calling only a pair of FBI forensics experts. The reason for the early dismissal was because the prosecution’s next witness isn’t scheduled to arrive in town until early Tuesday afternoon. State attorneys say they’re ahead of schedule and the defense could be able to call its first witness Wednesday.

Proceedings ended early Monday because the state announced its next witnesses weren't available until this afternoon.

It's unclear who the state intends to call today, but many speculate it will be forensic analysts. Court will begin at 1 p.m.

Orange-Osceola Chief Judge Belvin Perry told jurors Monday that the state may wrap up its case by Wednesday, which means the defense could begin calling its witnesses Thursday.

And jurors are hearing surprising testimony about the hair and duct tape found on Caylee Anthony's skull. The prosecution is hours away from resting. What's the defense going to do, put on evidence? Or is the defense also going to rest? Our legal panel is here as this murder trial enters week number four.

But first, jurors in the Casey Anthony murder trial are hearing new testimony about that duct tape which prosecutors claim Casey used to suffocate 2-year-old Caylee. No fingerprints were found on the three strips of tape, but an FBI examiner testified today that she saw something very strange.

Have I somehow missed Jesse Grund's testimony or have they not called him?  With the trial winding down, I wonder if some of the ones we expected to be called will not be called?  (I've pretty much convinced myself the Prosecution won't call Kronk.)

When they gave their list of potential witnesses for trial, did they have to include their "possibles" for the penalty stage at that same time?  I'm wondering if perhaps that's where some of the ones we haven't seen will come in.

Also, have I missed the introduction of the nursing home video or do you suppose it will be used in their closing argument?  I think it is powerful in personalizing Caylee.

If Casey was convicted of the manslaughter charge, how many years would she have to serve?

I am a little amazed that so many here find the tattoo to be significant.

The state did an excellent job of laying out the indisputable fact that Casey was on a ME-ME-ME-LIES-LIES-LIES-PARTY-SHOP-SCREW-STEAL-PARTY-SHOP-SCREW-BORROW-PARTY-SHOP-SCREW-LAZE ABOUT-LIE-LIE-LIE-LIE-LIE tour for the entire 31 days.

The tattoo is a double-edged sword.
"Bella vita" can be interpreted and ARGUED BY THE LAWYERS to mean 2 diametrically opposed things:

Yes. One could argue that it signified her newfound freedom, in a "Screw Caylee! I'm living the GOOD LIFE now that the 'little snot' is finally out of my hair!" kind of way.

But yes, someone else could argue that it signified a troubled, grieving mother's TRIBUTE to her Caylee, a beautiful life. (And Casey saw to that FOR them when Lee questioned her about it during one of the jail house video visits.)

A skillful prosecutor will not open the door to that argument.
They don't need to prove she got a tattoo to prove the elements of ANY of the charges against her.
So, not only is it IRRELEVANT to their burden of proof, but it opens a can of worms for the jury to argue about what it meant. (You'd be surprised how a jury dispute over some vague and non-essential matter could end up hanging the jury on the real issues in the case.)

They obviously decided that the "HOT BODY CONTEST" Casey entered on the 20th was far more potent at getting the message to the jurors.

And think about it: there was no way for the defense to twist "HOT BODY CONTEST" around on them and insinuate to the jurors that she participated in that contest as some sort of alleged "tribute" to Caylee.

How many times did the jurors hear that Casey entered into a "HOT BODY CONTEST" just 4 days after even SHE now admits that Caylee was STONE, COLD DEAD.

That is what I would call prosecution-editorial GENIUS.

I think they are waiting on an out-of-town witness to arrive.  Court is at 1 pm today.

Death Watch cells:   A Death Row cell is 6 x 9 x 9.5 feet high. Florida State Prison also has Death Watch cells to incarcerate inmates awaiting execution after the Governor signs a death warrant for them. A Death Watch cell is 12 x 7 x 8.5 feet high.

Men on Death Row are housed at Florida State Prison in Starke, FL, and Union Correctional Institution in Raiford, FL. The women on Death Row are housed at Lowell Correctional Institution Annex in Lowell, FL.

Meals:  Death Row inmates are served meals three times a day: at 5:00 am, from 10:30 am to 11:00 am and from 4:00 pm to 4:30 pm. Members of the news media may request Death Row inmate interviews through the Department of Corrections Public Affairs Office at (850) 488-0420. The inmate must agree to the interview and the interview will be non-contact.

Showers: The inmates may shower every other day.

Security:     Death Row inmates are counted at least once an hour. They are escorted in handcuffs and wear them everywhere except in their cells, the exercise yard and the shower. When a death warrant is signed the inmate is put under Death Watch status and is allowed a legal and social phone call.

Folks-
This trial is NOT OVER YET!
Try to reserve judgment about whether or not the STATE has met its burden of proof until:
You have heard ALL of the evidence; AND
You have carefully listened to the CLOSING ARGUMENTS; and
You pay attention to the jury instructions as delivered by Judge Perry, which set forth the LAW the jurors are tasked with following to reach their verdict.

This case is not yet "ripe" for a verdict.

And even when it is, be prepared for others to have different OPINIONS than your own.

If someone offers an opinion based on matters which were NOT IN EVIDENCE, it is easy to discount said opinion. For example, it is fine to disregard arguments about Casey's mental state --which is NOT a defense here, because the defense is not offering any "insanity" or "mental defect" defense. The defense is that Caylee's death was "accidental" and ergo, not a HOMICIDE. All of the alleged sexual abuse/family dysfunction is NOT a defense. The jury will NOT be instructed on any form of "insanity" or "mental defect" defense. In other words, they will not have an option to find her "not guilty by reason of insanity or mental defect". It will NOT APPEAR on their Verdict Form.

However, be prepared to accept that others may disagree about the STRENGTH of the state's case on the issue of PREMEDITATION.

She is charged with 1st Degree Murder.
But she is also, ALTERNATIVELY, charged with Aggravated Manslaughter.
There is a REASON for this.
If jurors cannot agree that the state proved she INTENTIONALLY KILLED her daughter, they may still agree that the state proved she recklessly (or even negligently) committed an act that resulted in the death of her daughter.

Murder and Aggravated Manslaughter are simply different classes of criminal HOMICIDE, but they are both FELONY KILLINGS nonetheless.

I googled and got many sites....Just from what I read ranging from 10-25 years WITHOUT any prior convictions.  Each state is different thou.
Kc has 6 prior convictions, plus facing other charges in this trial.  Look at page one of this thread.
So we just have to wait and see what she's going to get after the trial has ended.

Agreed. As long as she's locked up for the majority of her life I'll be satisfied. I'd prefer the DP though. Shoot, as long as they find her guilty of murder I'll be satisfied. I want her to wear that Scarlett letter for the rest of her pathetic life

I cannot imagine that they wouldn't....what parent, no matter what their child has done, would want to face the thought of attending (someday) their child's execution?

I think she will be convicted but I don't want the death penalty. I want justice and that would be to put her in general population and see how long she will last. She is in seclusion now and IF there are any truths in some of her jail letters she is scared there at times. I think her being with the population might prove to be her "hell on earth".

Yes....she must be old, wrinkly, ugly and in very poor health if she ever gets out.Also I would want for all of her relatives to have long passed from this life so that she truly would have no one. She wanted to be free of them, well, let her be free of them!

Hey Kat!!! I am hoping for LWOP as well. Not against the DP, just had my mind changed about it a couple of years ago and now realize that with DP they at least have something to look forward to to get them out of that prison. With LWOP they have to wake up everyday and realize that they are never leaving that place because of their actions...Just wish they could paper his cell walls with pics of precious little Caylee....If a miracle happened and she did get DP, however, for me that would just be lagniappe!!!

The state's final two witnesses will take the stand when court resumes at 1:00 p.m.
Prosecutors called two FBI investigators to testify on key evidence in the case on Monday.

WFTV’s legal analyst Bill Sheaffer said he thinks the defense could have an even bigger challenge ahead as it begins to lay out its case.

“He has to deliver his case. He has shifted the burden. The jurors are waiting to see what are you going to prove,” said Sheaffer. “Promising so much to the jury and thus far delivering nothing.”

He said he does not believe Casey will testify and tell the jury she was abused by her father George, as her attorney claimed during opening statements.

If she took the stand, prosecutors could ask her about her felony check convictions, and Baez's admission that she is a liar.

At the end of testimony on Monday, Chief Judge Belvin Perry said he thinks all evidence will be presented to the jury by the end of next week, and jury deliberations could begin next Saturday, or the following Monday.

Casey is charged with first-degree murder in the death of Caylee. She faces a death sentence if convicted.

Prosecutors contend Anthony suffocated Caylee with duct tape. The defense says Caylee drowned in her grandparents' pool.

I think that if Casey did get the DP it would play right into her twisted sense of her celebrity....there is something glamourous about the dramatic gesture of being put to death and the notoriety that comes along with that that someone with Casey's degree of narcissism may find exciting or titillating.

No...LWOP is the way to go for this one.  Sitting in a cold, gray cell day after day with her long life stretching out in front of her.  No lights, no cameras, no more being the center of attention.  Just her and her thoughts and her regrets and those demons in her head. Endless rounds of appeals that go nowhere.....total hopelessness.

Let her life be long so she can have alot of time to chew on what she's done.  She doesn't deserve to be relieved of her misery...death would be too easy of a way out for her.

Why was the issue of the alleged confrontation between Casey and Cindy on the evening of June 15th not addressed when Cindy and Lee were on the stand.  Cindy's claim of a special evening of bonding with Casey and Caylee went unchallenged by the prosecutor.

I believe if this confrontation did occur ... the substance may go a long way towards establishing Casey state of mind .... estabishing a motive.

What's scary is that there are many men and women who find inmates desirable and strike up a pen pal relationship with inmates and eventually the inmate (since it's the only connection to the outside world) gets so en-wrapped in the letter and end up falling in love with the person sending it to them. Scott Peterson was getting hundreds of letters a day from admirers wanting to marry him (gag) and I can see that happening with Casey eventually. When the hype from this case dies down and no one is that interested in her anymore (took Peterson what 2 years) I guarantee some weird, lonely man that followed the case and thinks he knows her from TV will write to her and maybe she'll take the bait with one.

That can't happen on DW but if she gets LWOP I wonder if she could have regular visits from strangers? I KNOW there aren't conjugal visits for murderers thank goodness. Can you imagine Casey having another baby behind bars?? Ew.

The only thing about the tattoo "Bella Vita" not being brought up first by the prosecution is that the defense would take the first jab at what they want to make it out to mean with a nauseating sympathy for their defendant since she was a (choking on the words) "loving, good mother."   The State would then be attacking that concept on cross.  The jury also has to be wondering how Casey is paying for things when they have the information that she hadnt worked since April 2006, I hope a door is opened to allow in Casey's economic convictions & the fact that during this time she stole money & committed fraud with Amy's checks.   Casey was also driving Amy's car that week.

IMHO, the significance of Casey telling the shop guy that she was going to return after her early July tattoo with Caylee should come out by the State.  Casey already knew Caylee was dead when she said that.  She murdered her child & knew it OR if one is ridiculous enough to believe the defense's "accidental drowning" assertion she also knew in those circumstances that Caylee was dead & was lying about it with no upset whatsoever during that "31 days."   Even IF the defense's story included that her father told her he would "take care of it" as Jennifer Barringer put forward on Judge Jeanine, it meant Casey wasnt upset or cared that Caylee was dead but began her "bella vita" without flinching.   There is NO way during that "31 days" that any mother wouldnt have broke down or been seen as visibly depressed during that time, not would they embellish that they were bringing a live child to a tattoo shop to watch mommy get a tattoo...no PTSD or other mental breakdown would explain her conduct during this time.

That being said, there is NO way this slore would have been "protecting" her father over an accident upon eventually facing the death penalty.   Her attorneys could have EASILY put forward the "accidental drowning" story even given the horrid way Caylee was disposed 3 years ago & Casey probably would have already served her time & getting out of jail now.  Snit,  there has been thousands to millions of much tougher scumbuckets that have ratted out a conspirator to save their own skin over the years.   The entire story is lubricious!!

Im a bit stunned that there hasnt been one pundit, legal commentary or other talkhead that I head yesterday mentioning that the State will have a rebuttal after the defense puts on their case farce.

I don't have that anymore and the links I try are all no good....but in that doc towards the end is where LE concludes the A's are lying ..and it mentions Mark Fuhrman and what he told LE per what the A's told him..about the ladder, the date, when it was put away and the day it was back up.

Meant to add..LE didn't think the A's lied to Mark...at that point the A's told Mark the correct dates and times with the ladder, but to LE Cindy atleast had said she couldn't remember the exact date..but she had given it to Mark.

Even if the defense wants to stick to the drowning death it doesn't matter. The scientific evidence proves the body was put in the car while already decomposing, it was dumped in late June or early July and Casey could have cared less in the 31 days her daughter was "missing". If there was a drowning story at the time she wrote her jail letters to Robyn she would have hinted towards that so it would be on paper. They knew they might get caught with those notes so in my opinion a lot of Casey's rambling was self-motivated especially her story verbatim of her not knowing she was pg until June '05 and just thought is it was bloating matches Cindy's. I don't believe it for a minute. I can tell in the pics she was pg. Bozo is not worried about them but she does mention he is going to try to sneak her puzzle books in and one of the other lawyers some kind of food. Also she mentions she missed her "daddy" but later was mad at him for what he told the FBI.

Bozo admits she is a liar but the jury is suppose to believe what his client told him really happened if he sticks with any of what his opening statement was? Right!

Since the jury does not hear the judges remarks at all during sidebar it makes no impact on the jury's decidion of guilt or innocence..nor how they themselves view the defense.  No impact.

Does every appeal case end up in court to be heard...no.

There is an appeal panel that decides if the appeal even has merit before it would go to trial....no merit here because the jury did not hear the comment anymore then they hear prooffers or any other info that is not for their ears or eyes.

I am really beginning to believe that Casey was on drugs or is just plain stupid.  It appears she set the scenario for several different versions of Caylee's death.

The pool ladder would denote drowning , as in accident.  Although I always thought Casey washed herself off..hands etc in the pool after moving Caylee's body.

The car abandoning, the duct tape would have lead somewhat into kidnapping.

But combine all the factors and you get homicide by Casey.  Why she did all these things is as much of a puzzle as why Baez threw everything but the kitchen sink into his defense opening statement.

It's all overkill...too fantastical for any reasonable person to believe.

This is why the State has been very careful to keep it simple, in calendar order, precise and to the point.  All the extras are unneeded.  The jury is already presented with an abundance of evidence that is scientific, reasonable and conclusive.

Today I think we will begin to hear testimony that goes to motive..or maybe not.  Motive really does not have to be there for a jury to ponder guilt.  The State really doesn't have to give a direct motive..they only have to prove beyond a reasonable doubt that Casey did the deed. 

Beyond reasonable doubt..does anyone here have any reason to doubt Casey did murder her daughter?

Nope..didn't think so..there is no reasonable doubt in this case. 

The defense will offer a different version..but it will not be reasonable any more then their opening statement was reasonable.

Why?   There is no reason for it to go "poof," whether the defense likes it or not that is what was said.   The only repercussions that I see is what it means in the way of Bozo, probably Mason too will be answering to bar complaints.

To me the exchange was very simple and the judge called Mason's bluff.

The judge is trying to tell the jury what timeframe and what to expect in the next portion of the trial.

The judge says x number of days, the State today and tomorrow.  Possible the defense starts tomorrow and will probably take x number of days for their evidence, whatever.

Mason objects to the judge's use of the word evidence in the same breath as defense because he says he doesn't have to show any evidence.   He is knitpicking and at this point.

The judge then says well then you lied to me ..meaning the defense told him they were going to be presenting evidence.

The Mason quickly backs off with well we are going to be showing evidence....so what was Mason's point? 

The judge is simply calling Mason's bluff..rather you lied to me before when you said you were going to present evidence or you are lying to me now by saying you are not ?  If they are going to show evidence..then Mason needed to sit down and stop protesting things that he already told the judge.

Mason told Perry that the defense is not legally obligated to present any evidence at all and they may or may not, but Perry set that expectation with the jurors.

"Then y'all lied to me," Perry responded.

"No," Mason said.

"Yes the hell you did," Perry said.

According to Perry, Mason's co-counsel repeatedly told the judge that the defense would be presenting evidence and Mason eventually admitted to Perry that the defense was indeed going to do that.

"I will take it that I cannot trust one thing your side says anymore," Perry told Mason.

Local 6 legal analyst Mark O'Mara said a lawyer should never hear from a judge that they are not trusted.

"This is not good to hear at all. I'm sure it was out of frustration and I bet if Judge Perry could take that sentence back, he would, just to not have it on the record, but he is evidently frustrated with the defense," O'Mara said.

I just listened to this and I think CJBP said this out of frustration and the jury didn't hear it so I'm sure it will be alright.  The DUFENSE is looking for a quick way to try to get a mistrial or anything to get this case over.  If a mistrial then doesn't ICA get a public defender?

Why wasn't this brought up
After contacting Corp. Melich on the phone I went on Casey's myspace and facebook pages and found the following: On facebook Casey Anthony had deleted upwards of 200+ photographs of her, and her w/Caylee. On myspace, she had at one point, over 10 pages of photos of Caylee, now reduced to 4 pages. Casey's personal hobby is photograhy and has had upwards of 300+ photos of Caylee posted online, at any given time.

 During my conversation w/Inv. Analyst McBride, I additionally realled that between the week of 6/22/08 - 7/6/08, I had two odd contacts from Casey Anthony: In that time period, Casey called me to ask if she could use my shower, since she was not staying w/her parents and Tony (her boyfriend) was out of town. The call occured at 10 a.m. but unsure of the specific date. I allowed Casey to use the shower, and when she came over, nothing appeared out of the ordinary. On 7/3/08, Casey texted me "if JG my mom or dad try to call you, don't answer. I will explain it later, but for right now just stay out of it." on 7/4/08, I called her to try and get an explanation but she told

 me, "It was a long story and I will probably call you when I get drunk to tell you."

 I swear and affirm, the above is true and correct to the best of my knowledge. I will testify.

She also tried to set Jesse up by taking that syringe out of his trash

Honestly, Casey acts likes she a paralegal/lawyer the way she shuffles those files and writes in them.  I have never, ever seen a defendant do that.  I used to work in criminal court, too.

The jury reaches the verdict, not the judge.  Basically, the judge accepts the verdict or within the law makes the determination on sentencing, in a DP case if the majority of the verdict reaches the recommendation for death he can accept it as is or render the sentence within what the law permits, in the case of a tie he can break the tie either way.

Let's hope it's waterproof and she isn't able to muster enough crocodile tears to make it run...which will only emphasize her lack of tears to the jury!

I don't know about anyone else, but the stickers have always been a particularly chilling detail for me. I know how excited little girls get about stickers, and I cannot fathom why Casey would do something so bizarre as to duct tape her daughter's mouth and then put stickers on top of the duct tape. It's disturbing, and if I were a juror this one little detail would be a very big deal to me.

ORANGE COUNTY, Fla. -- It's the duct tape that could strengthen the link between Casey Anthony and her daughter's body and it was discovered only by Eyewitness News.

Eyewitness News found the same rare  type of tape that was found on Caylee's skull being used by the Anthony family on a Caylee Anthony poster.

You can't buy the tape from Home Depot. It is industrial-grade duct tape that hasn't been sold in years.
