Casey Anthony Murder Trial Enters Week 5

ORANGE COUNTY, Fla. -- Week five of Casey Anthony's murder trial will begin on Monday, and when testimony resumes, an expert witness for the defense who was sent away by the judge on Saturday will return to the stand.

Monday marks day 34, including jury selection, in Casey's trial. She's accused of killing her 2-year-old daughter, Caylee.
The circumstances surrounding this witness could get Casey’s lead attorney Jose Baez in trouble with the state bar.

Dr. William Rodriguez was turned away at the witness stand after prosecutors complained that Baez planned to question him in a way he had not disclosed in court, which is in violation of Judge Belvin Perry's pre-trial order.

Rodriguez was sent out of court on Saturday, after Baez questioned him about something prosecutors didn't know about. Perry then threatened to hold Baez in contempt of court.

Body Farm

The Body Farm is more correctly known as the University of Tennessee Forensic Anthropology Research Facility. It was established in 1980 by the pioneering forensic anthropologist William Bass and is dedicated to the study of the rate of decomposition of the human corpse under various conditions that are relevant to crime investigation. Many hallmark scientific papers have come out of the research at the Body Farm and this new knowledge has been crucial in driving forensic investigation into unsolved deaths.

The facility began as a piece of waste ground close to the University of Tennessee in Knoxville. From 1980, Bass and his team began to prepare the site and, in 1981, received their first body for examination.

Researchers who have worked at the Body Farm have begun to contribute information that aids in determining time of death with precision. For example, the role of insects in corpse decomposition has been investigated by Bill Rodriquez. His observations back in the early days of the Body Farm showed that blowflies come to a body within minutes of death and feed on bloody areas, where wounds have been inflicted, or on moist areas like the mouth. After this, they go through their life cycle, feeding on the body, and producing eggs and maggots. This kind of evidence can be used in a forensic investigation, but had not been much researched before the advent of the Body Farm. A paper on this work published by Rodriguez in the Journal of Forensic Sciences in 1982, went on to become one of the most cited articles in the field.

This judge patiently is trying to protect the record & not show that he flew off the handle & that his sanctions and admonishments are proper.   He doesnt want error or a mistrial if he can help it, if it was left to him not to be concerned over these matters he'd impose more without hesitation.

9:00am Mon, June 20, 2011 Court is in session.

Judge Perry not happy right from the first, Mason has a matter to be taken up at side bar and he said he wants those done at 8:30am from now on.

Jeff Ashton up........

You indicated that a sanctions package may be needed.  He did take a Depot for Dr Rodriguez.  He wants to review it again and not have him called first.  He took a 3 hour depot.  The witness has an opinion not written in his report.  He wants to say that you can't tell a human decomp from another odor.  He also said that Mr Eichenbloom showed up outside on Sat and then showed up at his office but he had no report.  He got a report and a 24 power point slide, yesterday, he believes it is another discovery violation.  He wants to prepare a sanctions package for this witness too.  This witness want to show negative DNA evidence.  He wants Dr Rodriguez not to testify till he can review his depot and not have Mr. Eichenbloom testify till he can look at what he was given yesterday.

Baez is up............

The defense gave the state the names of these witness and they could depose them.  He got them to do a an opinion of what they thought they would testify to but the state is intentionally not taking depositions.  Baez thinks that the court had made it clear that this is not a game and this is a clear show of gamesmanship by Jeff Ashton.  He is a skilled prosecutor and he did not take depositions and he had a court order that he could use as both a sword and a shield.  As it pertains to Dr Rodriguez the state gave him a depot and he is ready to give his opinion.  Duct tape does not stay in the same place after death and decomp, it is common sense.
We want Dr. Eichenbloom to talk about low copy DNA, lack of DNA.  The state wants to say that there is no DNA on the items because of the environment, we think there should still be able to get DNA, degraded or otherwise.  We will be wishing to exercise all of our depositions and we sent Mr. Eichenbloom to Jeff Ashton on Sat and he sent him away.  I then told him to prepare a report and any demonstrative aids and send it to Jeff Ashton.  All this does is merely explain DNA, Mr Ashton should know all of this stuff already.  As to Mr Ashton now wants to have these witness delayed, he could of taken these depositions all this time and now he wants to during trial.  That is not fair to our time, the court's time and the juror's time.  Mr Ashton was not taking depots on purpose.  He was trying to use the order of reports as a sword and a shield.  We did not want to try to disobey this order intentionally, it disturbs me to think that anyone would say this about me.  I have labored day and night for this case and would do nothing wrong.  We don't have to make experts issue reports although this court has made us do that.  This prosecutor has decided on his own not to do the tools afforded to use him he is trying to get me sanctioned.  He is just not going after Casey's life, he is going after her attorney too.  He should not be allowed at the strike of twelve to say ok, now I want to utilize something that is done in a manner that is unreasonable.  My experts have obvious opinions and Jeff Ashton knows it.

Judge Perry asks them to look at the clock and tell him what time it is.  Jeff says 9:25, Baez says 9:26. The judge says that shows that you can't agree on even the simplest of matters. The jury has been there already for an hour according to the deputy.  From now on all attorneys will be here at 8:30am, if there is nothing to be heard we will start at 9:00am.  We will work a full day this Saturday.  The rules of discovery allows him to set whatever timelines are necessary.  He is reading one of his orders to them.  It is dated Dec 20, 2010.  When experts have not prepared reports both have to file the experts CV, the summary of the experts opinions and grounds for each opinions.  That was done because there was a couple of reports that contained nothing.  The court thought that order cleared up the situation, it did not.  Another order granting sanctions and orders of motions to compel. The judge is reading these orders.  It is basically saying each side had to submit reports of the opinions of what each expert was going to say.  The court in those 2 orders required both the state and the defense give all opinions of experts.  The purpose of depositions is for the expert to expound on those depositions.  It is never the intent of this court's order to alleviate the reports with a deposition.  The order was clear.  This court does not make threats, it makes rules.  When the court was given a state exhibit that was not given to the defense it was excluded.  The court was put in a proverbial corner on Sat.  The exclusion law, does not want to exclude testimony because it hurts the defendant.  Despite the due process, that is the final ultimate sanction.  There has never been a case that has been excluded and upheld but now we have someone that is violating a court's order where the ultimate order of exclusion would be proper.  Yes, there has been gamesmanship in this case.  It is quite evident that there is a friction between attorneys.  That is something that the Florida Bar will deal with and at the end of this trial, this court will deal with violations.  It is not proper to deal with it now.  As to the request to the state to defer the testimony of Mr. Rodriguez, I grant that.  We are going to have a short day on Wednesday and that is because of me and I have explained the reasons behind it.  If I was the state or the defense, I would go through the reports of all my experts and make sure that their opinions are in their reports or depositions.  Somethings will come up but all opinions must be stated.  Enough is enough. Both side are forewarned that exclusion even at the price of having to do it all over again, even though I don't think I will have to do it all over again because of it happening over and over again.  Exclusion will be an option.  He asked Mr Baez who is the next witness, he said it was going to be Mr. Eichlenbloom but since this happened we are waiting for our next witness.  He tells the deputy to let the jury go to 10:15.  We may be starting the trial at 8:30am every day from now on.  If you don't want to be professional, I will work you very full days, including reducing the lunch hour.  All of this is going to stop or you are going to be working some very fierce days.  Be prepared to work some very full days.  The judge is not a happy man.  He is very worried about his sequestered jury.

Court is in recess until 10:25am.

Jeff Ashton wants more time to review the deposition he took from Rod. on Saturday.  The next witness, Eichenbloom (sp?) hasn't been deposed by the state yet nor did he offer a report.  So he can't be called.  I'm thinking he may not make it at all.  Not sure on that.  So now we're waiting for the next witness, who Bayass said is 30 minutes away.

I know how you feel.  It typically isn't too difficult for me to watch a trial, but this one makes me MAD/sad.  I am so afraid that she is going to get away with it or is going to hold off from getting what she deserves because they will have to go through the trial all over again.  I know that the justice system/court process has a certain order and reasons for rules...but this one just SCREAMS out guilt...yet, there is a tiny bit of room for reasonable doubt because it took sooooo long to get to little Caylee and ALL of the lies and the parents trying to protect their daughter caused issues...AND this attorneys dirty tricks...anyhow, it just bothers me that there is even a slight possibility that she could go free or Caylee's justice could be prolonged!

It wouldnt shock me if the defense is trying to force a mistrial by angering the State to request it or the judge ordering it so they can attach jeopardy as Bill Schaeffer was discussing on WFTV http://www.wftv.com/caseytriallive1/index.html.   They know she's guilty, they know they are screwed.

GDD, I have no insiders info..when he first came on board I did some research on him and some of the cases he has handled. I still can't understand why he seems to be so well respected within SOME in the legal community. I also worked for a good ole boy attorney in Houston who used to laugh at some of the 'tricks' he pulled. In fact he reminds me so much of the attorney I worked for, it is scary at times. I also asked an judge friend in Houston if he would make a couple calls as I knew he has friend within the legal community in FL. He told me not to under estimate CM..he has practiced law long enough to know EVERY trick and when to use them. AND used them!! He said he was told CM likes to break up the flow of the trial when it is going bad for the defense. This was shortly after CM joined the defense.......at that time many thought the defense would rest without calling witnesses.  I happened to chat with my friend this weekend and he said  so far it looks like the defense should have rested and not called witnesses.    As the lead attorney the win or lose will be JB's...not CM's.   

Good morning Monkeys---- The judge said he doesn't make threats.  Excuse me, Your Honor, but you have done so repeatedly, giving Baez extraordinary leeway to disregard the Court's orders and established procedure.  Some might say the judge wishes to avoid an appeal.  However, any of the judge's rulings might be appealed in any case, and probably will be.   Being appealed does not mean winning an appeal.  If Casey Anthony is convicted and sentenced to death, she receives an automatic appeal anyway.  IMO only, it is time for the judge to stop issuing empty threats and carry through with whatever sanctions are appropriate and lawful.  It is time to stop worrying about protecting his own record.  IMO there are three sides in this trial where there should be only two.  The judge, who fails to sanction Baez in order to preserve his own record, the State's which is admonished regularly when they have done nothing wrong, as in this instance, and the defense, which regularly flaunts the law and the Court's orders with impunity.

so the defense must be running out of witnesses already if there isn't anyone waiting the wings...perhaps Casey is going to be up there soon??

I think it would be worse if JP sanctioned Bozo during the trial. He is the murderer lead attorney. What is he holds him in contempt and sentences him to jail time what happpens with the trial? For goodness sakes, they have had 3 years to prepare! I hope the next item the Judge will forbid is texting. Baez texting means person, an unknown entity, not sworn in, to the Court is texting and exchanging information that is helping the defense in real time with  background information, or questions to ask or strategy or only things only God knows. This IMO is an unilateral breach of ethics that I have never seen. Defense attorneys always seem to be the butt of jokes, but this is a disgrace to the profession!

The way Baez keeps throwing JP's the sword and the shield comment back at the judge must really be making him more and more angry.  Anyone knows that when you are chastised by a person in power, you never use their words back at them, it shows an utter lack of disrespect.  He has thrown that in JP's face in a court of law twice today and I don't know how many other times.  How many times would of any of you repeat your parents admonishments back to them, to argue your point?  Baez is so out of his league that if this wasn't a murder case, any judge would deal with him immediately and in a severe manner.  The judge is the only one at this point looking out for you Casey and you better be aware of it.  Such a mess that our whole nation is again seeing the work of a defense attorney make such a mockery of our court system and the memory of a darling Caylee Marie who will always be almost three........... ::MonkeyNoNo::

Another thing that makes me so mad, when the prosecution was giving it's case in chief, they had witness upon witness waiting in the hallway.  They had people from LE that needed to be working, just waiting for days and days.  The defense can't have more than 2 at a time?  Why didn't Judge Perry tell them to have a whole roster of witnesses waiting for just this kind of mess?  I know the judge has to make sure Casey gets a fair trial but I am tired of him saying he is going to deal with matters and then never deal with it.  Even a child learns that if a mommy says you better not do that again and they do and nothing happens, they will do it over and over again.  I love Judge Perry but I hope he starts making good each threat he makes.

Orlando (CNN) -- Clearly irritated with what he termed continued "gamesmanship" among attorneys in Casey Anthony's capital murder trial, Judge Belvin Perry on Monday threatened longer workdays and suggested any further shenanigans could result in the exclusion of critical evidence from the case.

"If y'all don't want to act professional, I will work you real full days," Perry said at the outset of Monday's session following complaints from both the prosecutors and the defense attorneys about each others' conduct.

Perry is supervising the trial of Anthony, the 25-year-old Orlando woman accused of killing her 2-year-old daughter, Caylee, in 2008.

Judge Perry listened for almost 25 minutes Monday morning before asking prosecutor Jeff Ashton and defense attorney Jose Baez to look at the clock and tell him the time. Ashton said 9:25, while Baez responded 9:26. That prompted Perry to say, "that shows the two of you will never agree on anything."

Ashton asked the judge that defense witness, Dr. Rodriguez, not to be called first because he wanted to read over his deposition again. Baez asked the judge for sanctions against the state and said he feels they are unreasonable.

Rodriguez was turned away at the witness stand after prosecutors complained that Baez planned to question him in a way he had not disclosed in court, which is in violation of Perry's pre-trial order. Perry then threatened to hold Baez in contempt of court.

Perry admonished the lawyers for wasting the jury's time with legal matters that should have been taken up before court began. He also said they will work a full day on Saturday. He ruled that they will be required to arrive at court at 8:30am everyday.

Perry ruled that testimony from Rodriguez will be delayed, per the prosecution's request. Perry then called a 45 minute recess, waiting for the defense's next witness to arrive.

Casey had to have been reading the transcriptions from what went down in chambers.  Maybe that was the reason for her panic moment.

Good morning Magic Eyes.  Thanks again for volunteering to do a job which must be difficult and which you do so well.

IMO The justice system of this country must be upheld. In order for the people to respect this system, it must be shown to be as Caesar's wife, above reproach.  How can it be when judges make idle threats and tell attorneys, "you'd better not do that again?"  They do it again and are told, "You'd better not do that again." Ad infinitum.
I believe the system is more important than this case or any one case.  In fact, I am coming to the belief that because of what in my opinion is ineffectual counsel, any conviction will be overturned anyway.  I believe it's time for the judge to bite the bullet.  He needs to stop the idle threats and find Baez in contempt, any punishment to be delayed until after the trial. But punishment there should be. I do not think Casey Anthony has received adequate counsel and while she deserves nothing, she is, under our system, entitled to a fair trial with appropriate counsel.

Why would a the court reporter and a deputy go into the jury room?  Anyone?

I know the judge has to appear "fair" to both sides but I can't recall one thing that the prosecution has done that would be called "gamesmanship".  They had one whole exhibit excluded and just went along with it and had the witness testify without it.  I do not remember anything, other than a little courtroom bickering between Jeff and Baez.  Can anyone else think of anything that we know of that the prosecution has done to be grouped with the defense, every time the judge gets mad?  ::boxingbaez2:: ::boxingbaez2:: ::boxingbaez2::

I don't understand what just happened and I was watching it live.  Imagine if you were a juror and being "held" all that time only to be told it was over for the day.  My guess is that the judge and court reporter went to the jury so that how it is explained will become part of the record.  Otherwise, I'm sure Baez and his people would at least try to throw some kind of temper tantrum over the disclosure to the jury.  Judge Perry is doing his utmost to preserve the dignity and procedure, I think.

From what I just heard about possible jeopardy being attached if a mistrial is declared, I hope this doesn't happen!  I do personally think that Baez had better be prepared for sanctions from the bar when this is over and I think whatever Judge Perry does in terms of contempt charges will be mild compared to the bar.  Baez is tainting the public's view of Florida's attorneys and I think they will not look at this lightly especially since he has had other allegations of misconduct already in this case.  Of course, all of this is just my opinion...

Unreasonable, obviously irregular, or oppressive subpoenas, injunctions, indictments, and orders can be quashed by a court. For example, if jurors have been selected improperly, the court can quash the proceedings.

In criminal cases, if an indictment is defective to such a degree that no judgment could be made if the defendant were to be convicted, the court typically will quash the indictment. In criminal cases, a motion made by the prosecution to quash an indictment is much more likely to succeed than one made by the defense, whose motion would appear self-serving.

I think they are going for ineffective counsel. Mason is going to say that bozo did not know what he was doing and would not take advice from the more experienced attorneys so he screwed up the defense. If the other attorneys agree that bozo would not listen to them (which I think may be true) they could get an ineffective counsel ruling. Having all these qualified attorneys prevent that UNLESS bozo won't let them do anything or won't listen to them.

Can, Hi! the only thing I can think of is that someone on the jury has done something they aren't supposed to do. In Sr. moment so can't remember the legal term for it. I don't think it's "breach of trust", some other term. Am sure our indepth Monkeys here know the term.

I agree with you on that. I think Perry doesn't want to look one-sided on it to the court. Maybe even the state doesn't mind being added to that since they don't want any mistrial. He tippy toes so everything is covered and this gets a conclusion.

Also, I think one hr is plenty for everyone to eat and prepare what they need. That 30 min would add to things getting done.

Unless there is a "Johnny Cochran moment" forthcoming from a defence witness that jury members will buy ... I suspect the Baez may request a plea deal in a desperate attempt to spare his client from a death penalty/LWOP verdict.

grrrr we cancelled a playdate for this.  Isn't it amazing how this trial is effecting so many of our lives?  I hope that precious baby in heaven knows she is loved by many even if her monster mommy didn't.

So Baez lied to the judge about the witness who was only 30 minutes away.  Is that possible?
And is it ok to just like to the court?
If not, did the judge need the court reporter to be sure the lie is part of public record?
Am I way afield in my thinking on this?

Janet, I'd be surprised at a plea deal. This is as much about Baez as it is about kc.....to HIM. As he just said in his pity pot whine session .blah,blah..."it's the State of Fl against casey's lawyer" or some such nonsense.
He's got a huge chip on his shoulder and never backs down.  That's the thing, he could have pled this out years ago he didn't, he could have almost assured her a minimum or time served sentence had he opted to defend this as a straight accident without the soap opera twists.

I don't think he ever had a career to begin with. From what I can find on his cases he did not even do enough business to support a flea. This was his "big break" as he saw it and it has become a nightmare. He is really too stupid to be an effective lawyer. Taking his law license like the bar is going to do after this is over will not be a surprise at all to him. He knows he is not a real attorney.

A minuscule amount of cases have ever been successful on appeal for ineffective counsel in Florida, number one.   Two, she has an entire team with TWO DP qualified attorneys presently on staff.   Its extremely doubtful that despite the obvious that it would succeed.

I said butterbaez out loud & was laughing.  My 2 year old is running around the house saying butterbeds - so I'm still laughing at your funny!

On HLN they are playing parts of Saturday's coverage now and they are saying that the judge scolded both sides and are talking about it. 
I think the Baez is so unprofessional and JA is so passionate about justice for Caylee that is the reason he gets so upset.  I think JA is right in being angry but I do think he needs to lower his voice and try to be calm while presenting his objections/cross as to make Baez look more ridiculous. 

I thought JB was going to call the CSI photographer, Jennifer whatever her last name was.  On Twitter, they said she was in the halls Saturday while Spittle was accusing her of manipulating the evidence.   ::piggy::

Maybe Casey will finally get it!!! Maybe the realization will hit Casey that Baez' ego that promised her that she could beat the charges and walk was playing Russian Roulette with her life to gain him fame.  Maybe it will be Casey who will demand a plea deal.

Nevertheless ... something tells me IF there is no a defence witness who will provide a "Johnny Cochrane" moment that will support the allegations in Jose Baez' opening statement ... a desperate attempt will be made in regards to a request for a plea deal.

JP should have told Baez, "IF you intend to call either George or Cindy, then you have a witness right here in the courtroom, and this jury WILL here testimony today. Unless you can provide another witness, right now, put them on the stand. However, if you choose not to do that, then you cannot call either of them during your case, so it's your call, Mr. Baez."  The defense has had plenty of time to prepare for their case, they should be ready to question the Ants and the jury would not have wasted the day.

On In Sessions they said the defense said they were going to call their witness and going to get her. There was a very elderly lady in the witness section but all of sudden it was over. They do not know who she is.

This is an article about a cold case from 1985. The victim's mother wants the Eikelenbooms to use touch DNA to help find the killer, but at the time of the article, August, 2009, the Eikelenbooms had not yet received the necessary certification in order to do the testing. I think this is the whole problem (besides the out of country thing) that the State has with these people.

The defense today also questioned its forensic botanist, Dr. Jane Bock, who is being used to dispute Hall's findings.

Bock said she is not aware from any of the botany literature of plant-root growth estimates based on the measured diameters of unknown plants. "I'm not aware any such information at all," said Bock, who added that she spent time trying to track down such research.

As with the other witnesses today, Bock testified remotely and was not in the courtroom.

Bock finished testifying just before 3 p.m. Assistant State Attorney Jeff Ashton did not ask her a single question.

I bet that there are more than a couple remaining expert witnesses that need to be re-deposed . Kind of looks like Baez did decide to take his chances with the ambush ploys and incomplete reports.
Baez probably knows that because it's a DP trial, he'll get leeway but did he really think JP would just stop the testimony and tell him to get it together? He must have thought he could steamroll the judge....hahaha..didn't work.

Interesting............ On InSessions just now, they are discussing a valid point, IMO.

If the Defense was going to put out a "surprise" theory that Caylee drown in the backyard swimming pool, the State should have been made aware so that they had the chance to tease out disputing opinion from their own experts prior to putting them on the stand in their case.
