Defense Winds Down Its Case In Casey Murder Trial

ORANGE COUNTY, Fla. -- Casey Anthony’s murder trial could bring several new developments on Wednesday as the defense is on the verge of wrapping up its case.

Wednesday marks day 42, including jury selection, of Casey's trial. Casey's accused of killing her 2-year-old daughter, Caylee Marie Anthony.

There are only a handful of witnesses left to call, and on Wednesday we may find out whether Casey will be one of them.

Before testimony on Wednesday, Casey’s attorneys are expected to argue that the whole trial should be thrown out and started over with a different jury.

The court will hear defense arguments about a new death penalty ruling that will happen with a member of the defense team on the record by phone. The defense says this new appeals case out of south Florida means the current jury should be re-seated.

The defense is expected to call a grief expert to the witness stand on Wednesday.

On Tuesday, Casey’s defense team said they have only a half dozen witnesses left to call.

Casey Anthony's first-degree murder trial could begin this morning with the defense team arguing for a mistrial because of a recent federal ruling faulting Florida's death-penalty laws.

The defense team filed the motion earlier this week.

They want Chief Judge Belvin Perry to declare a mistrial because the federal court in South Florida found the death-penalty statute unconstitutional. The motion also asks Perry to select a new jury that is not death-qualified, which was a requirement of Anthony's current jury.

The defense continued to hammer away at forensics evidence at the heart of the prosecution's case against 25-year-old Casey Anthony, who has pleaded not guilty in her daughter's death. The prosecution says Caylee's remains were in the woods for some six months after she was killed when they were recovered in December 2008.

The defense is trying to prove that they could have been there for much less time to try to cast doubt on prosecution experts who said the body had been decomposing for several months.

I'm bringing over this article from yesterday's thread in case it gets missed.  WOW is all I can say.  Michael looks like a young Lee!!  It's always been said that Casey puts a little bit of truth into her lies.  There are the TN and NC references we heard about when Caylee went missing and the death by car accident. The mention of adoption, even tho this was well after Caylee's birth, if I'm reading the article correctly.  Hmmmm

I don't understand Lippman's comments except it sounds like something Cindy would say. She will always want to keep this woman far, far away, no matter if she is Caylee's paternal grandmother or not.  One comforting thought....Caylee may actually be with her real father now.  I hope we find out one way or the other if this is true.

what amazes me is when cindy was on the stand and they asked her whether she sent hoover and casey into the woods and had we not already known the answer and knew that she was lying she was believeable so thank goodness Lee got on the stand and showed the jury what a liar she is and that she will stoop at nothing to get what she wants, i really think she should be slapped with perjury when this is all over. I do think casey will take the stand i mean if Yuri couldnt break her she wont break i dont think under cross by Ashton i hope she is not believeable to the jury, also thank goodness they heard her lies so i kinda think that no matter what she says they wont believe a word she says.

My husband - who 1.) has not been watching the trial; and 2.) loves to play Devil's Advocate (or seemingly go against anything I believe it  ::MonkeyDevil:: ) - thinks that this is all a ploy by the defense to confuse the jurors, who will be so sick of them by the time this is over that they shrug their shoulders and say the state has no real evidence proving a murder took place, thus they'll let her off.  He kept asking me what real evidence the state has to prove there was a murder.. if they can't prove that basic fact, then how can they convict her of anything but behaving badly?

I just looked at him and said "how can you say that??"  ::MonkeyShocked::  but since we won't ever know the minds of the jury unless they decided to speak after trial, who knows what the heck they think about the defense.. or about how bad they are.  ::boxingjeffbaez::

Jesse it's almost like a setup to me.
IF it is(don't know how anyone can prove it) the whole family, defense team should have something slammed at them.

Interesting. I did catch at the end of the day when the judge told the attorneys that it was Casey's decision - and hers alone - whether or not she would testify.. but this report states that the judge actually wants to hear from Casey herself about whether or not she wants to (or will) testify.

Good morning, Monkeys!  Is it just me or was Casey uber anxious to talk this morning?  I realize not having her attorneys right there was a little unsettling, but boy, she was eager to jump up and have her say.  This is why I think she will demand to testify..Getting her way one last time will certainly put a nail in her coffin. ::MonkeyShovel::

8:30am Wed June 29, 2011 Court is in Session

Ann Finnell is on the phone line with a Motion to Reconsider.

She is citing Case law recently made in a Florida Supreme Court.  She is asking for a remedy of a mistrial.
Mason, Baez and Simms are not present.  Casey is agreeing with Ms Finnell.  This is against the fact that jurors get to pick which aggravates exist and if there is a majority needed for the death penalty.

Jeff is up citing law about this death penalty case that was recently in news.

Judge is citing law.  Citing a Ring issue.  Ring V Arizona was brought up again and again and executions were held.  All of the cases he is reading right in front of Casey and they were all executed.  The court will reserve ruling on the mistrial unless such an issue is brought up in this case.

I didn't understand most of this but looks like it doesn't even apply to this case, at least not yet and not until it goes to Death Penalty Sentencing phase.

She cant even shake her over abundant tail feather well enough & she's in a dilemma because evidently her brain dropped & got stuck there

yes but they wouldn't file something else on this exact issue.  I may have heard wrong but i thought that this was a hearing on her motion to RECONSIDER her motion for mistrial.  which if it was then the judge had decided this before but this was her motion for him to reconsider and probably why she was there via phone to argue it.

For all those that are worried and screaming reasonable doubt in the MSM ... let me just say I cannot wait until the State's rebuttal case. They have not only owned the Defense witnesses on cross and got them to agree with their time lines, they have shown them to either not understand the case or even turned defense witnesses into ones for the State.

The Gentiva witnesses will all but prove that Cindy lied ... an IT gut, RUT-ROH.

Every piece of the Defense's lame presentation will be shredded by Ashton, et al.

That is going to be a thing of beauty and curtains for Casey Anthony.

It was very hard to understand, it was all case law.  All I really heard was Judge Perry saying they were EXECUTED over and over again.

yeah apparently the appeals of those executed didn't go so well for them.  Didn't seem to phase Casey, she was on! I bet she is so excited to tell her attys about her big debut.  You should have seen me, Im gonna be so good when i testify!!

I think the judge insinuated the last time Bozo cried mistrial, that the judge could rule on that at any time up until they hand the case over to the jury (or something like that), thus there was no reason for the defense to keep asking for one.

Zoo, while no one can read tea leaves & nothing is absolute all I can say is it is doubtful that any of the motions the defense has presented regarding the DP will succeed.

I have asked this but may have missed the answer, after the state's rebuttal, does the duffense get to do anything like cross each witness or put on their own rebuttal witnesses?

I would think that many mothers could tell you that their sons and daughters were curious about each other.. that doesn't mean sexual abuse of any sort took place. Kids are curious from an early age.. some more than others.

Why ask Cindy about abuse?  DT has never asked either Lee or George.  I say put Casey on the stand and lets hear if from her, then ask Lee and George.  DT thinks they are casting doubt, I just don't see it the way they are handling this issue.

I know I'm being cynical, but what if this testimony is to help prove Baez' assertion that George is trying to throw Casey under the bus? It wouldn't affect public opinion with George, but it might affect the jury. At least Baez might think so. Because he is a Bozo and a lousy incompetent attorney.

You expressed that this was a new theory, the latest story is that Caylee drowned in the pool?  It wasn't a new theory it was the media's thought on that day.  A month earlier you told the LE that the ladder was attached to the pool?  Yes. I tried to cooperate with LE but I also had a daughter in jail as a father concerned for his grand daughter.  Were you undercover for LE?  No.  She wanted to get bonded out and you wouldn't put your house up as collateral?  Objection..sidebar..sidebar over.  Sustained.  You said that you were 100 percent sure that you smelled human decomp in that car?  Yes, I am not going to lie about that. Did you take a depot Aug 5, 2009?  Yes.  Same oath you took today?  Question:  Did you believe the smell was human decomp?  Not human decomp, I knew it was decomp there, It took my breath away it really did, it took my breath away.  I remember opening the driver's door and it wouldn't start and I said maybe it is out of gas.  The attendant said, it really stinks here..George says let me stop you for a second.  Did it come into your mind that the decomp might come from your daughter or grand daughter.  I said ya the smell is bad, it's a lil bit tough.  I saw my grand daughters car seat and the car was messy.  As I went to the back of the car I prayed please don't let it be my daughter or my grand daughter, etc, etc.  The attendant got rid of the pizza bag and said this is your smell, it had maggots in it.  the attendant threw it out.  George says he could smell it 3 feet away, it smelled like human decomposition.  When you relive it over and over again you remember what happened.  It was not the garbage that was in it, it was human decomposition.  Neither my daughter or my daughter were in that trunk and I am grateful for that.  George says that he smelled human decomposition.  In my knowledge in LE, he knew it was human decomp.  You then called 911 then and there?  No.  Then you went to work, did you not?  Sir, after I knew it wasn't my daughter or my grand daughter, i was relieved, I was also concerned. I know exactly what I did, I have tried to be honest with everyone.  Mr Anthony when you made the statement in your depot you were on a media blitz? Did you go on multiple media outlets and advocate the innocence of your daughter?  I did not want to believe that my daughter could take the life of my grand daughter.  In Jan 2009, you attempted to commit suicide?  Yes, sir, I did.  You even left a suicide note and you expressed some guilt?  Sustained.  George may really be crying, hard to tell, Casey is stone faced, like he is just another person up there.  Were you hospitalized shortly after?  Yes.  Did you then make more media appearances?  I think so.  Were you advocating the innocence of your daughter?  I don't know.  Were you on 48 hours and were you paid 25k for that appearance.  Mr Baez what we have gotten out of the media appearances and any money we did it for Caylee and for other missing kids.  I did everything I could possibly do to tell them what Caylee meant to me and everyone in my family.  Was the focus on Caylee or Casey?  Unfortunately, the focus would turn on Casey.  Did you make an appearance on the Early Show?  I don't know.  All of these appearances stopped when the charges of abuse came up?  That was started by you sir.

grandma...I am not having a lot of sympathy for him either.....if he had not been accused of molesting KC I think he would still be screaming her innocence and lying for her....so I don't feel like he is now standing up solely for Caylee...mostly for himself...like you, I might feel differently later...but right now....not so much!! I do think his testimony is very damning to the defense and I am glad....no matter what brought it on.....I am glad it's happening!!
