ORLANDO, Fla. -- Casey Anthony could be ordered to return to Orange County to serve a year of probation after all. It's a very real possibility that Anthony could be forced out of hiding.
In another twist Friday afternoon, the Department of Corrections told WESH 2 News that if Judge Stan Strickland were to issue an order clarifying his original intent, it would begin proceedings to supervise Anthony's probation.

That would mean Anthony would return to Orange County where she would be put into the probation system.

Have you all seen this, I think he may have a good chance at having Baez and Mason disbarred this time, he makes several good points! Remember Baez serving the Mall with papers to obtain the Mall video when there was a Caylee "sighting". He surely discussed this with his client the skank, and it was supposedly a drowning and cover up.And that's just a start to this statement! Maybe this time the Bar will take their licences!

To Whom It May Concern:
 
Below are facts that I believe will lead you to conclude that the aforementioned attorneys have engaged in egregious misconduct. If you require any additional information please feel free to drop me a line.

 
Part II:  Facts/Allegations re:
              Re: Violations of Rule 3-4 Rules of Professional Conduct
                 
The following facts deal with the conduct of attorneys Baez and Mason relative to the recently concluded trail of Casey Anthony. That conduct would I believe include the following:
 
a)     Assisting or permitting a witness to testify falsely
b)     Offering testimony or other proof lawyer reasonably believes is false
c)      Conduct aimed at deceiving the triers (jury) of fact
d)     Conduct involving fraud, deceit and/or misrepresentation
 
First and foremost it should be understood that this ethics complaint has absolutely nothing to do with my opinion as to correctness and/or incorrectness of the acquittal of Casey Anthony. Put simply, the jury’s verdict is irrelevant to the misconduct of Baez and Mason.
 
False testimony of Cindy Anthony
 
During opening statements, the Prosecution claimed that Casey Anthony had looked up chloroform and how to make chloroform at least 84 times. On June 8, and in order to prove this fact, the Prosecutor put forth the testimony of John Bradley who develops software for computer investigations. Bradley testified that he recovered deleted searches on the Anthony family desktop computer and that someone searched the website Sci-spot.com for the word “chloroform” 84 times.
 
As you well know, this testimony was devastating to the defense since prosecution witnesses testified that they discovered chloroform in Casey Anthony’s trunk where the baby was claimed to have been stored for a short period of time after her death.
 
On June 23, fifteen (15) days after Bradley’s testimony, Baez and Mason called Cindy Anthony to testify for the defense. During her sworn testimony, Cindy claimed it was she that carried out the multiple chloroform searches on the family computer at her home.
 
Subsequently, Cindy’s testimony was proven false when testimony from her employer proved she was at work when the chloroform searches were performed.
 
Did Baez and Mason suborn Cindy Anthony’s Perjured Testimony?
 
It cannot be disputed that Baez and Mason had 15 days to discover whether Cindy’s testimony that she performed the chloroform searches was believable or a fabrication. Clearly Baez and Mason absolutely knew that Cindy was employed as a nurse at a local hospital. Therefore, prior to calling her to testify on June 23 all they needed to do was to call her the hospital to determine if she was actually working when the chloroform searches took place.
 
Any reasonably competent and/or ethical criminal defense attorney would surely have made the call to Cindy’s employer before being duped into eliciting false testimony from her. If either of them had done so they would have immediately recognized that her anticipated testimony would be fabricated.
 
Did Baez and Mason act reasonable re: Cindy Anthony’s testimony?
 
The Code of Conduct provides the following definitions:
 

    Reasonable: …denotes the conduct of a reasonably prudent and competent lawyer
    Reasonable belief: …denotes that the lawyer believes the matter in question and that the circumstances are such that the belief is reasonable

 
Would any reasonably prudent and competent attorney have the chutzpah to assert that he/she had no duty to determine if a potential witness was about to give perjured testimony. This is especially true when all that was required was a single phone call to the hospital where Cindy Anthony was employed. To argue otherwise wouldn’t pass the involuntary laugh test!
 
On his website, attorney Mason promotes himself by making the following claims:
 
1)     Board Certified Criminal Trial Lawyer
2)     News media, on all levels often invite him to produce expert commentary on legal issues involving criminal law…
3)     Publisher of numerous legal articles
4)     Teaches trial techniques to Prosecutors/Public Defenders at Univ. of Florida
 
Mason obtained his law license forty (40) years ago in 1971. He was board certified in criminal law 24-years ago in 1987. It would be frivolous to the nth degree for Mason to claim incompetence in failing to perform a modicum of due diligence (calling the hospital) before putting Cindy Anthony on trial.
 
It can safely be assumed that a first year law student would have determined if Cindy was actually at home or work when the chloroform searches were performed. In fact, anyone with an I.Q. just a tad north of the legal speed limit in a school zone would have so acted.
 
What is truly distressing is the fact that 15-days passed before Baez and Mason called Cindy to the witness stand for the sole purpose of destroying the prosecution’s evidence that it was Casey who did the chloroform searches. Yet, these self-proclaimed stalwarts of the defense bar were so incompetent that they never did so.
 
Conclusion
 
Sadly, it appears that Baez and Mason were more concerned with self-promotion in defending a high-profile case then they were in conducting themselves in accordance with their oaths as Officers of the Court.
 
I’m not suggesting that Baez and Mason were obligated to spill the beans on Cindy regarding what turned out to be her false testimony. However, the Rules of Conduct clearly prohibited them from placing her on the stand when they had to know her testimony would be patently false. Any claim by Baez and Mason to the contrary should be treated with the same contempt they displayed for complying with the Professional Rules of Conduct.
 
Something must be done to reign in this “win at all cost” mentality that is much too prevalent among some members of the bar. Is it any wonder that the vast majority of Americans have absolutely no respect for the legal profession?
 
Clearly these are self-inflicted wounds by unethical members of the Florida Bar. If the Bar gives Baez and Mason the proverbial wink and a nod, then they are merely inviting even more egregious misconduct in the future.
 
Please provide me with a copy of any responses to this complaint that you receive from Mr. Baez and/or Mr. Mason.

General Probation Rules
The Florida state government website includes general probation rules as part of the 2009 Florida statutes.

These include reporting to a probation officer as directed and allowing the officer to visit you.

The probationer also must work at "suitable employment insofar as may be possible" and remain within a specified living place, known to the probation officer.

 To avoid a violation, a probationer must support dependents to the best of his ability, not associate with people engaging in criminal activity, submit to and pass random drug testing, not possess a firearm and not use intoxicants in "excess." All probationers must pay monthly fees to their supervising court. In addition, any new charge of a criminal offense is grounds for a violation.

Okay, stupid question (actually have several, but I'll hit you all up slowly lol). Since the taxpayers paid for her duhfence, and "it was an accidental" a "fact" known by said skank et al. pretrial, why can't there be a Class Action for said duhfence costs passed onto the taxpayers of Florida?

No, no babysitters. All it means is that she has to check in with her probation officer, sometimes by phone, sometimes in person. The cool thing, however, is that if anyone sees her violating the terms of her probation, they can report it. Then she's in front of a judge again. Tevye, wouldn't she have to pay a fine to see the probation officer? I know that is how it works down here, you pay your court fine and then you pay each time you see a probation officer. Do felons see separate probation officers than misdemenor offendors? In Texas you can't leave any adjacent counties or go out of the country without your probation officer giving you paperwork from a judge, not sure if that is how it is in Florida. Obviously the clerk lost the import of what the judge was trying to say and the judge signed it without picking up on the omission,” said WFTV legal analyst Bill Sheaffer.

He says no judge can do anything about it.

“She's already served her time and we do not think that the government can come back and make her serve it again,” said Randy Means, a state attorney's spokesman.

“It's like adding salt to an open wound because so many people believe justice was denied in the murder case. They want justice in any form,” said Sheaffer.

Even if Casey were on probation, she could have gotten permission to serve that year out of state, and even if she violated the terms, it wouldn't necessarily result in her going to prison.

I want to see Casey do this probation..I really do.  Hell..I wanted to see Casey do life without parole....

I am glad Judge Strickland is telling the dept of corrections they messed up..but is it going to come down to then someone should have brought this up in the last year while she was serving that probation in prison?  I just see a lot of posturing and finger poininting next..again..in this case between the judges, the state and corrections and then don't forget the defense team.

I would love to see her do probation now..in Florida..but I don't think it will happen.  I think the department of corrections will say she served her time..and the defense will back that up.  I am still amazed that any prisoner in any state can do probation while in prison..that just doesn't make any kind of sense.  And she was not the model prisoner..in fact a prison guard who let her pass notes and have conversations with inmates was repremanded for that..huh..wasn't it also the inmates fault for not following proceedure..oh right the inmate was Casey.

How the hell did such and ugly white trash woman get so many priviledges along the way?  And evidently they are still coming.  I hope she reads this..and the defense....she is the lowest form of common white trash there is..she slept with anything that moved, she had a baby out of wedlock and didn't know the father, she ripped off her family and friends, she was too dumb to even get her GED, she lied and not too well at that, and to top it all off when the going got tough for her she murdered her own child of less then 3 years. 

Yeah..now there is the type of person that is not worth a tv show, a movie, a book or even a mention on the nightly news....she is common white trash and she deserves to be thrown away the way she did her daughter.  Ignore the bitch..ignore her attorneys..ignore her family that created her and defended her with their own lies.

Let the ugly bitch rot in her own feces..no one wants an interview..no one wants to watch an interview..and no one really gives a damn if she lives or dies tomorrow.

Playing devils advocate here, lets say media is right, she already served her probation while in prison. She's therefore in breach of her probation, on many levels, lets return her to jail. Here's the Florida law in part:
(f) Make reparation or restitution to the aggrieved party for the damage or loss caused by his or her offense in an amount to be determined by the court. The court shall make such reparation or restitution a condition of probation, unless it determines that clear and compelling reasons exist to the contrary. If the court does not order restitution, or orders restitution of only a portion of the damages, as provided in s. 775.089, it shall state on the record in detail the reasons therefor.

Also:

(g) Effective July 1, 1994, and applicable for offenses committed on or after that date, make payment of the debt due and owing to a county or municipal detention facility under s. 951.032 for medical care, treatment, hospitalization, or transportation received by the felony probationer while in that detention facility. The court, in determining whether to order such repayment and the amount of the repayment, shall consider the amount of the debt, whether there was any fault of the institution for the medical expenses incurred, the financial resources of the felony probationer, the present and potential future financial needs and earning ability of the probationer, and dependents, and other appropriate factors.

What about her letter writting with the ex-con friend:
(k) Not associate with persons engaged in criminal activities.

They can't have it both ways. Either she already served her probation whilst awaiting trial, which btw, IF they considered her on probation, there were certain things that they had to do, eg, post her pic etc. If so, then she was in breach of said probation, and she should go back to jail for same. If she hasn't served it, btw, I don't remember anyone judge stating in court they were placing her on probation at any time, then it's time she serve it now!

Yes, there's a supervisory fee, usually it's monthly. In our courts, it's not the degree of the crime (felony or misdemeanor) but rather the court system that sentenced you...circuit court or district court. You don't have to get permission to leave your county, but you can't leave the state without approval. These are Michigan rules.

My hope is she gets probation, and gets some tough old broad as her officer. Then, she sneaks across the county line, has a beer and a toke, and someone gets a picture!!! Woo hoo! revoke the probation....do a little more time!   ::boxingcasey2:: ::boxingcasey2:: ::boxingcasey2::

In addition to my previous post about not having it both ways, I believe Judge Strickland had ordered her probation to start if/when she was released from jail/prison, not while she was awaiting trial on the murder charges. Judge Stan Strickland sentenced her to $5,517.75 in court costs and also ordered her to serve a year of probation in Orange County upon her release from jail.


Finally, it is worth pointing out that the fundamental reasoning behind this line of cases is that “the underlying concept of probation is rehabilitation rather than punishment and presupposes the fact that probationer is not in prison confinement. "Hatton v. State, 689 So. 2d 1195 (Fla. 4th DCA 1997)

This is because Florida law is very clear that Ms. Anthony’s probationary period was tolled while she was incarcerated awaiting trial on that serious case we discussed earlier. See Bradley v. State, 721 So. 2d 775 (Fla. 5th DCA 1998) (Finding the defendant’s “term of state supervision was tolled during period defendant was incarcerated on an unrelated case.”); See also Brooks v. State, 762 So. 2d 1011 (Fla. 5th DCA 2000) (Defendant “erroneously contends that he completed his split sentence while incarcerated before he began his probation. He cannot have successfully completed a split sentence if he never served the probationary part, even when the sentence is a “true split” sentence. Additionally, because he was incarcerated on another offense at the time he was released from the custodial portion of his sentence in this case, defendant’s probation was tolled until he was paroled in his other case.”) See also Schurman v. State, 847 So. 2d 569 (Fla. 1st DCA 2003) (“Although the incarcerative portion of his sentence in Case No. 93-202 may have expired prior to his release from prison in May 1998, the probationary portion of that sentence was tolled while he remained in prison on other sentences, and it did not begin to run until appellant was released in May 1998. Therefore, his probationary sentence in Case No. 93-202 was [still] in effect upon his release.”)

not holding my breath that Casey Ho will end up doing probation...too many disappointments in this case...Judge Perry is not going to admit that he made a mistake, not that it is needed, but do we really think that Judge Stickland will go against what Perry has already deemed to be...Casey is free to walk? In a nut shell it means that the person has done something to violate their probation "rules". If this is found to be true, they can revoke (take back the opportunity for probation).  the probation and the person would be sent to jail.

The hearing of course, is to determine the facts.

This is an older book..published back in Nov of 2009.  She released this because I think the author wanted something out there pretrial..never realizing it would take until 2011 to go to trial and that Casey would be found not guilty on all charges except the lying.  I haven't read it..but it has been out there for almost 2 years now.

Oh yes, I realize that, it also says you can read/preview some parts which, and includes verbated interviews. Sometimes "monday morning quarterbacking" helps, and I was wondering if there'd be anything the A's said/did that would help us with where we stand now. Eg. the part I read concerned when George picked up the sunfire. He called Cindy saying he couldn't stand the smell, and could only put the windows down a little as it was raining. How George heaved up his meal at the stench with Simon watching.

IMO another attempt at sideswiping the coming depo, however, can someone answer this hypothetical. I know about patient/doctor confidentiality, however, lets suppose a psychiatrist becomes aware of a crime committed. Does the patient/doctor priviledge still stand? Lets say, (I know way out there, but) suppose Skank "accidentally" killed Caylee through drugging, drowning, whatever, and daddy or mommy dearest helped cover up the crime, is said doctor under law required to report said "accident" and coverup? I know if they become aware of a crime which is planned, or threatened, to happen, this they must report to police. What about after the crime has been committed, which involved people who've not been charged eg mommy or daddy dearest cover up?

Angie, usually what that kind of hearing means is that if the judge and probation dept. feel the probationer is not living up to his end of the bargain, the person spends the rest of their probation in jail.

ANOTHER VERY IMPORTANT THING TO CONSIDER ABOUT PROBATION:
Part of the reason for probation is to help the criminal adjust to society. That's why they have to maintain a job (and the officer visits to verify) and keep "clean". It's like babysitting/therapy, but with enough rope to hang themselves. Hmmm, if I'm not mistaken...this is how the Menendez boys were finally caught/convicted. One of the brothers (Erick, the youngest, I believe) told something to his Doc (Dr.Ozell) about  the killing of the parents and the info was passed to authorities by his associate/lover.  All of this is from memory, so forgive me if I have parts wrong.  What I am basically trying to say is...yes it can and has happened.

I doubt Casey will ever confess/tell anyone what really happened. Disgusting slore that she is, I can't figure out how she manages to slide out of everything. I have to believe as do others, that a higher being will judge her and give her due punishment.

Most doctors say that Sociopaths cannot be helped.  They are just born that way and there is no treatment to cure them.  They are expert liars and con artists, manipulating people to get what they want.  They only care about themselves and are very narcissistic.  They live a parasitic lifestyle, conning others into supporting them and if they can't get that, they will steal from others.  Sociopaths can't hold down jobs and don't really want to work.  They will seek out people they can con, often leaving their victim broke or bankrupt when they move on to their next victim.  They also will not take responsibility for their own actions and will blame others, even when it is obvious they are to blame.  Drug and alcohol abuse is very common and they are usually very promiscuous.  They feel no guilt nor remorse and have no conscience.  Sound familiar?

If Casey is going to get any kind of treatment, it will probably just be for show to try and improve her image so she can make more money from interviews in a couple of months.  But it will all be an act.  JMHO

That brings the estimated investigative and prosecution costs attributed to the case to more than half a million dollars. It also brings the documented cost in public dollars spent on the Casey Anthony case overall to more than $822,470.

This lady spells it out so simply...her frustration comes through her words. I have read several of these articles now and each time I shake my head.
Is it possible that the foreman convinced all of them that they had to look at the evidence as proof beyond any doubt?  Is that what he did?  Did the other juror members go along with him because they looked to him as superior in intellect or the law?

We expect better from Belvin Perry. This past week the Orange-Osceola chief judge, who skillfully presided over the Casey Anthony trial, took aim at Florida's cherished right of public access to court records.

Perry's broadside was part of a court order that withheld the names of the Anthony trial jurors from the public until October. Such an order defies the normal and transparent practice in Florida trials of disclosing jurors' names after they have delivered their verdicts. It mocks the state's constitutional guarantee of open government.

Unfortunately, this is only the latest in a series of moves by Perry that could end up being cited by other judges to choke off the flow of information in future court cases to the press and public alike.

Most alarming of all, he proposed an examination of whether public records laws "are too broad and whether the release of certain information is causing more harm or whether the public's and media's right to know outweighs that harm."

Such a proposal from a judge of Perry's stature could be a lethal weapon in Tallahassee. The Legislature, as a whole, has been hostile to government in the sunshine. Many members would jump at the chance to attack it under political cover from a respected judge.

I got a notice recently from the Osceola County clerk of courts with a bill for $16.80 for an unpaid traffic ticket.....   say whaaaat - I don't even know where Osceola county is- they asked for personal information online and the case # they gave came up blank, so I figured it was a scam of some sort and called the Clerk's office.I told her there had to be some mistake as I had never heard of Osceola county...    she tapped on her computer-  searched -  tapped again - apologized for taking so long- kept searching-  finally she asks me "Looks like you have a 'not paying attention' ticket from Kissimmee"  Oooooh, I said, I drove to Disney MANY years ago and on the first day I was at the tail end of a series of cars that slammed their brakes on when an idiot crossed four lanes to cut in front of us and we all collided, but no one was hurt.
"Well,she says - you got a ticket ( this was 1993) and we need the money.... Florida is broke".
Now I have been in the same house with the same name and phone numer since this and no one ever wrote me before- It's the first I heard of a ticket.... but whatever.
So if they don't at least TRY to collect from Casey I shall be pizzed.
They tracked me down for $16.80!!!

After I posted my comment, I thougth for a minute and figured it out.  Thanks.  Brain is not at 100% functioning yet.  I have a hard time thinking of anything but the slore being free while Caylee is still dead.

It is hard for me even to look at the pictures of Jeff and team.  My heart hurts for them for all their hard work and the slore walking.  I cannot help but feel Jeff retired because he cannot go on prosecuting cases knowing the skenky one won. 

My heart goes out to the prosecutors as well. I think they did a great job.

I also think Jeff's retirement was planned in advance and had nothing to do with the verdict in the case.

Mr. Ashton is so precious,  I fell in love with his smile, it shines through his eyes very seldom do you see this. My grandmother use to say when you see or meet a person whose smiles comes out in their eyes you have met an angel here on earth I honestly believe that.

I have read and have this book, it is basically all the events to what happened to Caylee as everyone told it. From George and Cindy getting notice in mail about car to slore being in jail. I think this is a very accurate account on things that happened.

Through out the stated events of what happened was like rereading the book for most of it.

I hope this link works for y'all.  When she gets on probation you can put in her last name, white, female, first name and search.  Don't add anymore or less cause this system searches and brings back lots and lots of alias'.  Less is more here.  I haven't read all the way back and can't now but about FL Probation, she won't be asked, required or told to get a GED, depending on how Strickland wrote her order she may not even have to be employed caused I believe she's has paid the check charges, right? Beginning in November 2010, Gainesville forensic psychologist Harry Krop visited Casey Anthony in jail about half a dozen times and interviewed her at length as he prepared to testify should a sentencing hearing be necessary. Krop was hired by and paid by the defense — at about one-third his usual fee.

Following her acquittal, Anthony, 25, signed a release form allowing Krop to talk to the media about all but one issue: the allegations that she was sexually abused by her father, George Anthony, and her brother, Lee Anthony.

“Casey chose not to testify,” Krop said. “Whether she will talk in the future about issues brought up in opening statements, I don't know. It depends on whether she and her family want to try and reconcile their differences.”

Krop said he tested Casey's IQ, which resulted in a score of 107 — average intelligence.

That inaction is unacceptable and should carry penalties under the law.

The Casey Anthony trial has shined a bright light on the gap in many state’s laws, including Tennessee’s, regarding the reporting of a missing child. 

Florida law does not provide any penalties for this inaction.

Some of the people angry over the outcome of the Casey Anthony trial have vented their frustration with demands for new laws. Others are looking at the sensational case and proposing ways to perfect justice by curbing First Amendment rights or limiting public access to information about the workings of the justice system.

In the wake of the death of 2-year-old Caylee Anthony, many people wanted to do something to better protect innocent children. The problem is, new laws setting a time frame for reporting missing children may not help. It would be sadly ironic if an emotional overreaction to the acquittal of Casey Anthony inspired ill-conceived laws that resulted in the imprisonment of honest caregivers.

It would be equally ironic if the high level of public interest in the Casey Anthony case provided the spark for legislation that infringes on the First Amendment. The trial had circus-like elements, and some of the media coverage fell well below the standards of good journalism, but it's undeniable that millions of Americans were interested in following Casey Anthony's encounter with the justice system.

As for probation..if she lived in N.Carolina she would have to report to Probation officer 1x a month and they come to your house 1x a month, your randomly tested for drugs. Have to get G.E.D. or work, can not own or have guns in home and can not be around any other felons.. You can go anywhere in your state but to leave your state you have to have permission from P.O. moving from county to county isn't really a big deal basically you let the P.O. know a week ahead of your moving with an address and phone number if you have one and they transfer your case there.

Been thinking a lot about Perry bashing the press. 'The press' brought out once more his affair.  Sure he did not appreciate that. Bash the press.
There have been 'press' articles about the options he did not take in overriding the jury in their decision. Had he questioned the jury about that verdict before reading it, things might have been different also. Bash the press.
A few days after that verdict I wondered what must be going through Perry's mind about his own handling of this case. Many of you have discussed his behaviors that seemed to favor the DT throughout the trial.
I do not think the good judge's motivation in writing that bashing are transparent.  But maybe they should be to some of us.??
Methinks he might actually have a conscience.  Methinks also that honesty on his part would have better served the world and 'the press.'
What has gone through Perry's mind this eternity of the last many days?

Of course George and Cindy Anthony say they do not want to profit from the sale of the car and the money would be donated to their newest foundation in memory of Caylee Anthony. However this statement should be taken with a grain of salt considering they have already profited on several occasions from the death of their granddaughter.

IMO if we were content to leave the punishment of criminals to a "Higher power," we would have no courts, judges, police, army, etc;  In fact, no laws governing human behaviour at all.   We would be secure in the knowledge that a "Higher power," would eventually take care of the wrongdoer.  And while I believe that a "Higher power" might eventually take care of Casey and others like her, I am not content to wait for that.  That's why I am disgusted by the verdicts of the Anthony jury.  Our system of justice is touted as being the "Best in the world," and it may well be.  But is it as good as it could be?  Not if murderers like Casey Anthony go free, it isn't.  A system of justice is only as good as the people who are in charge of it.  In this case, I believe Judge Perry wasn't very good.  IMO he was looking to his own reputation and to secure his position as chief judge by favoring the defense, thus assuring no appeal.  Had Casey Anthony been convicted of murder, there would have been an automatic appeal, which might very well have been successful.  If it were not, there could be appeals for the next twenty years. And if, by chance one of these appeals were to be successful, it would reflect badly on Judge Perry's record.  And it is my considered opinion that every judgement Perry made he made with his own record in mind, not whether or not his rulings served justice.  And, IMO, they did not.  They were skewed toward the defense and the prosecution cannot appeal a not guilty verdict, which of course Perry knows.

And then we found out that Perry is just another skirt-chaser, human after all, and like many others in high office. Maybe he thought Casey was too pretty to go to jail, as did the prosecuter in the Debra LaFave case. 

I don't know what was going on in his court, but I am absolutely certain that justice wasn't going on, and it was Perry's doing. So While I am not content to wait for this "Higher power," I see no alternative.  Maybe we should just abolish courts and laws altogether and wait......and be content.   

I have a little more to say and it's about protecting the names of the so-called jury.  In this country, we do not have secret juries or secret trials, that is, except in the case of Judge Perry's court.  If I were to be on a jury and if I had participated in an unpopular opinion, (And were I on the Anthony jury, we would still be deliberating, as I would not bow to the judge's wishes nor would I be bullied by the other members of the jury.) I hope and believe that I would be sure enough of my vcerdict to stand up and say so, and not hide like a sniveling coward, or make assinine statements as have the foreman, or the silly woman who lied that she lived with her parents.  We later found out that even her boyfriend didn't like what she did and kicked her out.  That's sort of a serious, but IMO deserved, consequence.

Florida law requires that the names of the jurors be released, except in rare cases.  Judge Perry decided this was a rare case.  Judge Perry seems to be God.  Is it possible that the judge is afraid that the jury or one of its members might say they voted the way they thought the judge wanted them to?  IMO it certainly appeared that the verdict was what Perry wanted, in order to preserve his pristine record. 

For some time I have been disturbed by judges who legislate from the bench, making new laws rather than interpreting and upholding laws already on the books.  Perry. IMO, is just another example of this recent change in the judiciary.  Do we now have a combined Legislative branch? Jurists-Legislative and Executive?  Or has it all meshed into just one, Executive.  Sometimes it appears that way to me.

On July 5, 2011, at 1:15 pm Central Standard Time, Casey Anthony was found not guilty of first degree murder in the death of her daughter Caylee Anthony. The only charges she now faces are four counts of falsifying police reports, each of which only carries a 1 year prison term. As of today it has been ruled that she will be released on Wednesday, July 13th.

Within our Judicial system, the State of Florida is no longer able to try Casey Anthony for the murder of Caylee Anthony as this will be considered Double Jeopardy, but within the Separate Sovereigns rule The U.S. Federal Government is. First Degree murder is a federal offense and, from the moment Casey Anthony lied to the FBI she was in violation of The Martha Stewart Law which comes with a year sentence for each count. I beseech you, do not let this crime go unpunished.

Since the ruling of this case it has been confirmed that as many as 5 jurors have been offered everything from interviews to book deals, with juror number 6 being offered a reported 5 figures to do a media interview. Juror number 3 has gone on record to state that the decision given has made her sick to her stomach and she did not feel Casey Anthony was truly not guilty. It has also been confirmed that the jury for the 11 hours they were in the deliberation room did not deliberate at all but were said to be playing cards, leaving their notes on their chairs in the courtroom. Throughout the entirety of this case right down to the verdict, it has bared a shocking resemblance to the trial of O.J. Simpson. There was a reason that after the O.J. Simpson trial was over the law was enacted to stop jurors from being able to sell their story for 90 days, and I would hate to think that this beautiful child was not given the justice she deserved for the opportunity of wealth.

This case has touched hearts all over the world and on July 5th when it was announced a verdict had been reached everyone watched and waited. It would be a understatement to say that the verdict was anything but shocking. With the evidence that the State of Florida provided it's hard to believe anyone with a sound state of mind would have ruled this case not guilty on every count. This was not justice for Caylee Anthony and many people the world over have lost faith in our Judicial System. I still want to believe that we as a nation have the best Judicial System in the world but it only works when everyone involved is honest in the search for justice.

The case of Caylee Anthony was tragic, and I do not want this to be misconstrued as a "witch hunt", but justice was not given. The jury was not honest in their search for justice. I beseech you, bring this case before the Federal Court, give Caylee another chance at the justice she deserves.

I thought Jeff was supposed to retire in January but stayed on to do the KC trial. 
O/T  My son in law got home on Friday from Afghanistan and my granddaughter/daughter are now at their house and my granddaughter missed us last night and sat and cried.  I tried to talk to her on the phone but she wouldn't talk.  They came over today and she is slowing getting used to being back at her house.  I just don't understand the behaviors of anyone in the Anthony family.

Excellent post.   IMO  In a civilized society the Justice System is responsible for punishment of a horrible murder perpetrated on one of the most defenseless citizens, a child.  There is no dispute about who committed this crime,  even the DT admit that she was aware of and had something to do with it.  In the aftermath of the ridiculous, outrageous verdict it has become even more obvious that no other person could have been responsible.  Justice for Caylee should not be left to a "Higher Power"    I hope that everyone who is outraged will continue to voice their disgust and boycott everything Casey.  The federal government should take over and put this killer in prison where she belongs.  Killers should be allowed the same rights as upstanding citizens.   I know, I know, in the end if nothing else works, a "Higher Power" will send her away into the darkness.............forever..........

This probation battle is not over yet. We need to implore the Honorable Judge Strickland to impose the probation he intended - AFTER her release! He is adamant about his order. I certainly agree, but would like to clarify my request.  "Do everyone a favor, jump off a cliff, but make sure it is a high enough cliff so that there is no way you will survive."

Was reading a story today on a man who killed his GF cause she left him.  Then, when cops tried to arrest him for that murder, he tried to kill himself and failed.  He blew his face off but lived.  Now, the world will have to pay his medical bills forever.  He was found guilty of 2nd degree murder and will likely serve 25-45 years, and we will foot the bill of his medical bills for all that time.  Supposedly, he had jail paid for surgery to make his face look somewhat like a face.  I have looked everywhere I can, all articles on him being found guilty and not one has his picture.  I find that disgusting, especially if media was told not to take his picture because he has a disability and he would be embarrassed.  The jury even asked during deliberations to explain the degrees of murder/manslaughter, and the judge reminded them that his attorney has already admitted that he shot and killed the lady, so he had to be guilty of something.  Then, they wanted to know what happened if they could not come to a 12/12 vote of guilty, and the judge told them they are not near that yet.  It is like this jury was trying to find a way to find him not guilty of anything because they felt bad because he blew his face off.  Makes me sick some of these juries. 

I do not want to have to pay the wenches medical bills for the rest of her stupid life if she were to survive that jump off a cliff. 

Ditto, except I'll go one further & up you a legislature bid. I'm wondering if JBP has higher aspirations than just judge... Could Casey's walking help to promote new legislature? Behind most new legislature are wealthy advocates. With the right backing, a person could land into a very lucrative elected position.

I'm not even gonna go back to the previous thread to see what I missed. I have a bunch of links saved that I thought were interesting. The DT used more than one social networking tracking programs to follow what would work in her defense vs what wouldn't. It looks like they triple proxied to safely chat while covering their tracks to prevent tracing. With the proper financial backing & a little bit of brains paired with a higher agenda, it makes for both sides of the justice system happy by getting their palms greased & put into positions that they may have been overlooked for previously. Afterall, look at Obama, if he didn't have the proper powers to be with the lucrative financial backers, he'd never have gotten elected. He came out of nowhere, literally. I'm not knocking him, as I believe our president should always be respected, he's the leader of our great country. But it's true that if he didn't have those groups pushing a higher agenda to support him & make his face known, then he'd never have been elected.

Orange Circuit Judge Stan Strickland just signed amended court documents this morning that he says will have the effect of requiring Casey Anthony to serve one year of supervised probation as he originally intended back when he sentenced her in her check fraud case.

"From my reading of this, she should be reporting to probation in Orlando probably within 72 hours," Strickland said. "I suspect she's going to be required to report to probation."

Confusion lingered Friday over whether Casey Anthony should have to serve a year of probation in her check-fraud case now that she is out of jail.

Strickland said on Thursday that his intention in sentencing Anthony last year was that she should go on supervised probation if released from custody. But state Department of Corrections officials interpreted Strickland's order as meaning that Casey Anthony could serve her probation while still in jail awaiting trial in connection with the 2008 death of her daughter Caylee Marie.

Ya know, probation, through court order, could make it mandatory she receive psychological counselling. It sure would be nice to make her do it instead of giving her a choice to plan to do it! The state attorney's office spokesman said the Department of Corrections policy allows defendants to serve probation while still in jail and not under sentence.

"I read the order," said state attorney's spokesman Randy Means. "The order said she was supposed to begin when she was released from her sentence."

Strickland's office told WESH 2 News on Friday afternoon that it was his intent that Anthony serve a year of probation after her release from jail.

Officials with the Orange County clerk's office told WESH they are processing the paperwork to amend Anthony's probation status. Strickland is expected to sign the clarification order Monday.

The order then goes to the Department of Corrections, which will begin the process of setting up supervised probation.

"There's nothing illegal about it," said defense attorney Richard Hornsby. "You were supposed to be on probation. You better report to probation within a few hours of this order coming down."

Eaton said Anthony's attorneys can ask the Department of Corrections to allow her to serve probation in another county or even in another state.

I don't think Blowhole can fight her probation.....Judge Strickland ordered it well over a year ago. Not to mention, KC plead guilty to the check fraud charges, and even if she could appeal the sentence it would have to be within 30 days of that sentence.
I hope he stipulated she must serve her probation in Orange County, but even if he didn't, her address will be available to the public for the next 365 days. LOL

That document was amended and Strickland signed it today.

It's likely Casey Anthony's defense team will challenge this turn of events, and say that Anthony should not serve probation because she already did that while in jail. An argument claiming "double jeopardy" is expected.

Case Notes provided by the DOC through its Probation & Parole Services, show that Casey Anthony was contacted by probation officials while she was awaiting trial in the Orange County Jail. The one-page document shows 23 "contacts" involving Anthony's probation case.

Several of those contacts were listed as "residence verification."

"Offender has remained in OCJ pending trial on murder charges her entire period of supervision," one entry in the case notes states. "Case could not be tolled as additional charges have not been disposed."

Re: the jumping off a cliff remarks etc. I'd rather she live through that and here's why. IMO, she'll be milking the system just like her sperm donor ma and pa, whether it be welfare, disability whatever. So, you'll be paying for her lifetime either way. I'd like to see her jump BUT live. Completely paralyzed from the neck down, on a ventilator for the rest of her life, in a poorly run state home being placed there because ma and pa can't afford a better place. I'd like the caretakers to know who she is, so they're too busy to change her diapers, or come running when the alarms go off because her vent tube is clogged up. They'd come in the room, just in time, after she was panicked, unable to move or breath, but then they've cleared it so she's still laying there, staring at the ceiling, thinking of the bella vita she's missing for the rest of her life. Afraid of whether she'll choke again in the next 1/2 hour, 24/7, laying there in the smell of her own chit and urine. No one comes to see her. She's alone, all alone, can't move to alleviate the bed sores, can't eat or drink, all she can do is stare at that damn ceiling, and think. Let her live like this for the next 60 years. I remember Christopher Reeves describing times like this being the hardest. That's why I imagine her jumping off a cliff and living. An assistant in Judge Stan Strickland's office said the judge signed an amended court order Monday.

Anthony's whereabouts are currently unknown. She was released from the Orange County Jail on July 15 after being found not guilty of murder on July 5 in the death of her daughter, Caylee. She served additional time to complete a four-year sentence for four misdemeanor convictions of lying to police.

Strickland tried to make the probation run after Anthony was released from jail, but, last week the state said that would likely be an illegal sentence.

The state Department of Corrections interpreted Strickland's sentence so that Anthony could serve the probation while she was in jail awaiting her murder trial, but the judge says he intended the probation to be served after her release.

On Thursday, the state attorney's office said there's nothing that can be done because the the Department of Corrections terminated Anthony's probation after one year.

Just woke up to the best news in a long time!  I love you Judge Strickland!

Casey Anthony's Parents Go on Vacation -- What's the Porpoise?!

Just 4 days after Casey Anthony was released from jail ... her parents were kickin' it in the Bahamas ... and went swimming with dolphins -- and for once, there's hard evidence to back up the story. George and Cindy Anthony went swimming at Dolphin Cay at the Atlantis resort on July 21 ... and spent all sorts of quality time smiling and making kissy faces with a dolphin named Hercules. As for Casey ... we're told she was not part of the tropical vacation -- but as TMZ first reported, she did enjoy a Corona minutes after she was released from the pokey. Life after a murder trial sure is relaxing.

Hornsby tweeted that Verbal Orders TRUMP (translated by court reporter incorrectly) written orders....all the court reporter had to do was listen to the audio of JS's sentencing orders in the hearing. He clearly ordered probation after her release from jail.

Kinda made my day. The probation. Almost meaningless, but the photo ops are FREE.
If she is a no show, can they issue an arrest warrant ?

Morning everyone, well this is really good news for a change just can't believe it was allowed to go her way in the first place, I mean who the heck would think you're allowed to do probation while already in jail? craziest thing I ever heard. I'm proud of Strickland for coming back and saying wait a minute and just goes to show JP is not a stand up man, was just gonna let her slide and hope no one noticed. ::MonkeyMad::

Ya know what kills me Trimm? I was supposed to spend July in Disney for the month of July, then my recently turned 9 y/o had that seizure at Nationals, so after his 2nd test we cut it back to 2 weeks the end of July so he'd be ready to go for his follow up MRI in August. Then the crazy verdict in Casey's case & ABC giving a couple jurors left a sour taste in my throat...so we cancelled our vaca. I told my husband to take us to Atlantis instead but I looked into it - 1week would cost the same as staying in Disney for 2 weeks, if not more, bc every single thing you do there costs $$$. For instance, a cup of coffee is $7! That's just an example.

So Disney is back on again but not until Christmas. The kids gave no idea, we're putting their passes & a $100 bill in their stockings, then wrapping new clothes & games for the trip.

I'm so confused.......how many charges were there here that she was sentenced to 412 days for? It looks like more than one, then we have the charges for lying to LE, what did she get for those? Looks to me she should still be in jail but I don't understand what I'm reading. But heck, she won't make it long, 1st thing on list says she must give "truthful" statements to probation officer, haha! She can drink but not get drunk so won't last long there either lol.

IDK, but just like everything else, I have a feeling Casey will get out of this.  For the life of me, I can't figure out how probation could be served while in jail, especially solitary confinement.  Does the DOC have to provide any type of paperwork on their "resident visits", or at least upon completion of probation, to JSS?  I would think judges would need to know if their orders were fulfilled.

If there is an emergecy hearing and BP rules for the defense and goes against Srickland, he'll pay ! How, I odn't know, but there will be fallout.

George should be worrying about how fat Cindy is now since he was so worried about KC getting fat while she was in jail. He was worried enough to write a letter about it maybe he should cut back his own hog's food.

I think the hearing would have to come before Strickland. JP's "reign of terror" is over for this case.

Perry still has time to sanction Baez and clean up his act a little.  I thought he was smart....hmmm?

Well, that sucks. I wanted some of the stink of the untrial to stick to him. He cut Baez way too much legal slack. The crazy teapot magical thinking lady was added as a witness after the trial had begun. Not that she provided anything but a hoot or two, but adding a witness after the time limits ? The DT had three years. There were other things also, I did not record the trial and I tossed out all of my printouts becasue I was mad.

the slore got 413 days for 6 out of 13 check fraud charges + 1 year probation , then 4 yrs minus good behavior for lying to LE. Somehow that equals 3 years including the ~2months out on bail.

Anyone want to bet that Perry will find a way to overrule Judge
Strickland and invalidate the probation order?  Perry was on the defense side from the beginning and I will be surprised if he allows the probation order to stand.  Either that, or he will allow her to serve probation elsewhere than Orange County. I wonder if we will ever know what really happened inside Perry's head and inside the jury's deliberation.  Something did, and it wasn't good for justice for Caylee Marie. Judge Perry makes me sick.  So upright on the surface and slimey on the inside. Yuk.

Don't get me wrong about Atlantis - it looks like a ton of fun...just not something we can do on a whim. Hubby said we can use income tax next year to go. When we go on vaca, we like to go all out, do everything. We spoil ourselves & our kids, but we only do that sort of vacation once a year. We have premium annual passes that we renew every year for Disney bc we go twice annually, sometimes more if we can afford extended weekend flights, but this year was different bc of tge case against Casey Anthony. Atlantis is something we'll have to save for bc my estimate is about $7000 for 5 of us. My husband's ex doesn't want their 2 in the Bahamas until they're out of school. I'm more lenient. If all 7 of us went, it would be $10,000-$11,000 for a week...no exaggeration.

To me that's alot of money. I have a son ready to graduate & start college next year and another son going into 10th grade but already taking college classes at Rowan. Plus all 3 of my biological children play sports, football & wrestling, which is expensive in itself. Can't afford Atlantis right now, wish we could. Cindy & George are lucky to be given such a gift. I wonder how Caylee feels about that...

Also, KC herself "knows" what her sentence was by Judge Strickland.  I'm sure she's been snickering to herself about how she beat out Orange County for a year's probation.

Did you notice on the "list" of things she must do to be in compliance with her probation that one of the items is to pay the county $20 a month?  hee, hee

I am a huge believer in cruises with kids. We like either a 7 day or 10 day. They have so much fun because they have things for all ages to do all the time. My kids have always preferred cruises over Disney when given a choice. Most of the ships have pre-teen and teen dance clubs and so many activities for them. The great thing about cruises is everything is included except adult drinks. I usually buy a "coke" pass ($15.00)  as soft drinks are rather pricey if you get them one at a time but there are all kinds of juices, and other beverages that are free. I am partial to Princess Cruise Lines, but all of them a good. Kids like Carnival (and it is cheaper) but it is a little tacky for my taste. You might want to check into a cruise if you have a varied age group.

I've wanted to go on an Alaskan cruise for years...but not with the kids lol! My 2 oldest, 14 (almost 15) & 17, have been on  a Carribbean cruise & a cruise past Spain, but now that they're older they fight too much. I'd be too petrified one would throw the other overboard! Jkjkjk. If they were older I'd go for it, but I wouldn't be able to enjoy myself at this point, constantly looking over my shoulder, need eyes in tge back of my head. My 17 y/o has already tried drinking twice! Oh, & those are only the times we caught him, who knows how many more times there are. Omg I try to remember when I was a kid & laugh it off after I ground him but it takes sooo much out of me not to throw him through the damn wall sometimes!  ::MonkeyDevil::

Also, anyone else notice there were 2 particular things in his probation order that are interesting

1. The Court retains jurisdiction to place you in the Probation and Restitution Center upon recommendation of your Probation Officer WITHOUT FINDING OF VIOLATION OF PROBATION.

2. YOU ARE HEREBY PLACED ON NOTICE THAT THE COURT MAY AT ANY TIME rescind or modify any of the conditions or may extend the period of probation etc.

She also has to submit to urine, blood and hair folicle, without notice or warning tests hehehe (IMO this'll send her back to prison for her full sentence. Wouldn't that be 13 years?

She also has to repay Amy the $5,517.+ what 4 years probation right?

If you are a gambler and will set up your line of credit they did have junkets where everything is comped. Air, room, food, etc. You might want to give them a call & check into that if you really want to go.

I don't see how there could have been any confusion according to this, plus Casey didn't have a probation officer to my knowledge.

Hmmm, I thought since BP was the presiding judge who pronounced her free to leave, he would be the one that would have to hear the emergency hearing. But otoh, maybe it would be conflict of interest, and a new, impartial judge would have to determine if Strickland stands, and Perry/court made a legal error in releasing her without probation enforcement after release or vice versa. Me thinks there's a legal fight coming

(CNN) -- A Florida judge on Monday signed amended court documents mandating that Casey Anthony return to Orlando to serve a year of probation stemming from her check fraud conviction.

"From my reading of this, she should be reporting to probation in Orlando probably within 72 hours," Orange County Circuit Judge Stan Strickland said in signing the documents, according to the Orlando Sentinel.

But wait a sec... People have their probation transferred all the time. I live in NJ & a good friend of mine got s DUI some years back. He had to take classes & serve probation. He works in DE still. He never even had an unexcused absence from work as the court worked with him. His probation & classes never kept him from his job.

Having said that, what about if Casey's offered a job in Cali? He probation would probably be twice a month. What about if she's offered transportation to meet her probation officer or otherwise have it transferred? The probation is over check fraud, only about $1000 that she stole from Amy, excluding the fine penalty. From what I remember, that money was reimbursed to Amy already.

For some reason I just rained on my own parade. I have a feeling they can't make her live here, if the probation even sticks as it is. Omg let me go jump in traffic! Jeesh.

The juror got Disny World from ABC..the A's got the Bahamas (at the Atlantis no less) from TMZ.  Why are these people treated like celebs..they are stupid..the juror..and criminals ..the A's for lying and obstructing justice..yet they get this preferential treatment..the world has gone crazy in the type of behavior it rewards.

Isn't JP[ the Cheif Justice over Strickland..which is why Perry took over the case from Stan when he dropped off.  I am thinking that Strickland has a pretty good idea already rather or not this will fly with Perry. 

Didn't I read somewhere thugh that she was being seen in the jail atleast once per month by probation dept to check on her address, etc..which I thught was really a stupid thing then..I mean they could just place a call right.

Thanks shutterblog! It's still rubbing me the wrong way, though. I mean, for all intents & purposes this shoulda been an open & shut case. It was intentionally made into a media sensation. Intentionally being the key word. Why is that? Could it be that there's a political person that has a brother who's a lobbyist and thinks passing laws that have to do with Csylee will help him move up in politics faster? Last I looked JBP signed off on Caylee's Law, too. Could this political guy that's already moving up fast have aspirations to be president someday?
