At today’s arraignment, Adams entered a plea of not guilty to both counts. When Judge C. Creed McGinley asked Adams if he understood the charges against him, Adams responded with "Yes, sir.”

Across the courtroom, the Bobo family, including Holly's mother, Karen; father, Dana; and brother, Clint, sat on the front row. Karen Bobo cried, while Clint rubbed his mother's shoulder.

Holly Bobo's cousin country music singer Whitney Duncan also sat on the front row with the family.

McGinley asked Adams to come before the podium facing the judge. Adams walked up with Jennifer Lynn Thompson, a high-profile Nashville attorney, who represented him at the arraignment.

Thompson said Adams was pleading not guilty to both counts and is still held without bond.

Attorney Steve Farese sat beside the Bobo family during the hearing. After the hearing he told the media that he is representing the Bobo family and has done so for about two years.

Farese said has just been advising the family on what the proceedings would be like and what an investigation such as the one into Holly’s disappearance is like.
Farese said he believes many details about Bobo's disappearance will come out in the next 30 days.

Bobo family pastor Don Franks also spoke to the media. He said the family is doing as best as can be expected at this time, and he asked for continuing prayers for the family.

The man indicted for the aggravated kidnapping and murder of Decatur County woman Holly Bobo somehow acquired meth while in custody the weekend before last.

Tennessee Bureau of Investigation Director Mark Gwyn said in a legistlative hearing in Nashville Tuesday that Zach Adams tried to get meth into jail with him.

TBI spokesperson Illana Tate said Tuesday afternoon that when Adams was transferred to Chester County jail on March 1, he was searched and meth was found on his person.

Tate said Adams was charged with meth possession and having meth in the jail. Tate did not know how Adams acquired the methamphetamine, just that the drug was located during the routine search in Chester County jail.

"It was found in his pocket," she said in an email. Chester County jail has made the charges.

The Tennessee Bureau of Investigation is calling the man charged with murdering and kidnapping Holly Bobo a meth addict. While it's unclear if that had anything to do with her death, Channel 4 News has uncovered 911 calls that shed more light on Zachary Adams' drug problem.

The 911 calls expose what the people who love Adams have been dealing with for many years, as the drug profoundly impacted Adams and those around him.

In May 2012, Adams' grandfather, Dick, called for police help, saying Adams was "wild again."

Moments later, Decatur County dispatch received a second call for help from the same address. This time, it was Zachary Adams on the line.

"Um, yes, I need an officer here at 260 Adams Lane," he said. "Dick, he done choked, put his arms around my neck."

The dispatcher asked who was involved.

"This is Zach and Dick. He's been ranting and raving this morning. He's been choking me this morning. And I ain't trying to hit him. He's just acting a fool," Zachary Adams said.

Ultimately, investigators charged Zachary Adams with domestic assault as well as possession of meth and drug paraphernalia.

"I know what he wants me to do. He wants me to hit him so he can put me in jail. I ain't gonna do that," Zachary Adams said in the 911 call.

It's unclear whether Zachary Adams was on meth at the time of that call in May 2012, but it is clear, at the end of it, he is erratic.

The Adams family tells Channel 4 News they've been pressured by the TBI to not comment on anything.

At this point, they feel stuck between a rock and a hard place.

However, they asked us to remind everyone that they're well aware of Zachary Adams' drug problem and don't condone it.

It's been a long three years since the disappearance of Holly Bobo. And during that time her face became a familiar image for many people in Middle Tennessee and beyond.

But her face might not be shown in the courtroom at all during the potential murder trial of Zachary Adams.

It's up to a judge whether to allow a victim's photo to be shown during murder trials, and that can be a real source of agony for families.

Now, there's a plan that could change everything.

Chris Davis was a security guard at Shoe Carnival when he was murdered by a teenager for a $40 pair of shoes.

Davis' mom wanted the jury to know how her son looked with love at his newborn baby.

"I felt like the jury needed to see that side. They need to know the human being, the father. The children had their father taken away," said Judy Davis.

But the Tennessee Supreme Court upheld an appeals court ruling that said photographs of murder victims, "have the potential to undermine and place in jeopardy the outcome of the entire judicial proceedings."

The man charged in the 2011 kidnapping and murder of Holly Bobo is no stranger to the justice system with a criminal past that dates back years and a rap sheet that is 14 pages long.

As more details emerge, many are wondering why Zachary Adams wasn't in jail to begin with.

In 2011, a woman named Rebecca Earp said in court documents that Adams assaulted her.

Then, in 2004, he shot his own mother, forcing his stepfather to take out an order of protection, saying the family feared for their lives.

A year later, in 2005, Adams' grandparents told police he threatened to shoot them with a shotgun.

Just last month, Adams was arrested for holding a gun to a woman's head.  He also pulled a knife on her and threatened to "gut her," according to documents.  The case is pending.     

Criminal defense attorney Jim Todd previously prosecuted criminal cases in Davidson County.  He isn't involved in the Bobo case but told News 2 Adams wasn't in jail because "that's not the way the criminal justice system works in this country."

"What he has been charged with in the past, none of those charges carried mandatory prison sentences. They were probatable offenses and it looks as if they were reduced and he was offered treatment and rehabilitation programs," Todd explained.

Adams, 29, appeared before a judge in Decatur County Tuesday and entered a plea of not guilty for aggravated kidnapping and first degree murder.  He is next scheduled to appear in court for a status hearing April 9.

In the meantime, he remains in the Chester County jail without bond.

The investigation into Bobo's murder is ongoing. The Tennessee Bureau of Investigation has not indicated her body has been found.

The family of Holly Bobo is speaking out publicly for the first time since a suspect was named in the young nursing student's disappearance and death.
They're not only fighting for justice for Bobo but for murder victims across the state.

The Bobos joined dozens of other families of murder victims to fill a legislative committee room Tuesday, as state lawmakers considered a bill that would allow victims' photos to be shown in their murder trials.

In Tennessee, it's currently up to a judge whether to allow a victim's photo to be shown during murder trials, and that can be a real source of agony for families.

And the Tennessee Supreme Court upheld an appeals court ruling that said photographs of murder victims "have the potential to undermine and place in jeopardy the outcome of the entire judicial proceedings."

Now, there is a strong desire from the grieving families to change that law.

Davidson County District Attorney General candidate Rob McGuire said this is more than an emotional plea. This is legally sound.

"It is absurd to say the pictures of murder victims are irrelevant in their murder trials," he said.

But the two lawyers on the committee think the proposed law change is unconstitutional and would simply lead to convictions being overturned.

In the end, the bill was effectively killed for the session and sent to summer study.

Zachary Adams, the man charged in connection to the murder of missing nursing student Holly Bobo, has been charged with an additional criminal count Tuesday.

Adams, 29, is now charged with a single count of coercion of witness, according to the Tennessee Bureau of Investigation.

Adams, who is being held at the Chester County Jail without bond, pleaded not guilty last month to kidnapping and murder in Bobo's disappearance.

"We will not tolerate any kind of coercion in criminal cases," TBI Director Mark Gywn said in a press release. "But in a case like this, which has attracted so much interest and required so many resources, rest assured we will fight hard to protect the integrity of our work, as we seek justice for the family and friends of Holly Bobo."

The Tennessee Bureau of Investigation said Zachary Adams, the man charged with kidnapping and killing Decatur County woman Holly Bobo, also has coerced a witness in the case.

The agency announced Tuesday that Adams is now also charged in Decatur County with coercion of a witness. The TBI declined to name the witness or to provide details of how or when Adams is accused of coercing the witness.

The announcement follows Adams’ indictment on March 5 by a Decatur County grand jury on the charges of felony first-degree murder and especially aggravated kidnapping of Bobo.

A news release on Tuesday from the TBI said that “in recent weeks” additional information was developed that led agents to secure a warrant on the new charge.

Investigators have said they believe Adams killed Bobo in the perpetration of the kidnapping. The TBI has not commented on whether Bobo’s body has been found, how she was killed, or a motive for the killing. Investigators have said it is possible additional suspects could be charged.

Adams was served with the additional coercion warrant on Tuesday and continues to be held in the Chester County Jail without bond. He has been incarcerated since he was arrested Feb. 28 on a charge of assault against a Camden woman.

TBI officials have said Adams also faces charges for allegedly bringing meth into the Chester County Jail, where authorities said he was transferred because of overcrowding in the Decatur County Jail. Adams was searched during the transfer on March 1, and meth was found on his person, the TBI said.

According to the TBI, Adams sent a threatening note from his Chester County jail cell to his brother’s jail cell in Obion County.
The note reportedly said, “Tell my brother he is the one who started all this s#%t and if he don’t shut his mouth he will be in the hole beside her.”
An inmate reportedly heard what the note said and alerted jailers.

Warrant: Adams tried to threaten his brother not to talk about Holly Bobo case

The witness Zachary Adams is accused of coercing in the Holly Bobo case is Adams’ brother, according to a warrant filed today in Decatur County court.

In the warrant, investigators said Adams told another inmate at the Chester County Jail to pass along a message to his brother, according to a Nashville TV stations WKRN, WSMV and News Channel 5, which obtained a copy of the warrant.

The message Adams allegedly gave the other inmate on March 4 was to threaten harm to Adams’ brother if he talked about Bobo case.

The message was, "Tell my brother he is the one who started all this (expletive) and if he don't shut his mouth he will be in the hole beside her,” according to the warrant.

The inmate Adams allegedly gave the message to was being transferred to the Obion County Jail, where Adams’ brother is being held. The other inmate reported the conversation to the TBI, according to the warrant.

The TBI said Tuesday that Zachary Adams, 29, faces a charge of coercion of a witness in addition to charges of the murder and kidnapping of Bobo. The TBI has declined to make further comment about the new charge.

The man charged with the 2011 kidnapping and murder of nursing student Holly Bobo tried to threaten his brother, according to an arrest warrant for coercion of witness obtained by News 2 Wednesday.

The document, an affidavit of complaint filed Tuesday, April 1, states Zachary Adams tried to get a message to his brother, who is in custody in the Obion County jail, through another inmate and said, "Tell my brother he is the one who started all this s#%t and if he don't shut his mouth he will be in the hole beside her."

The arrest warrant states Adams made the statement to the inmate on March 4.  At the time, Adams thought the inmate was going to be transferred to the Obion County jail.

The inmate reported it the Tennessee Bureau of Investigation and another inmate, who overheard the statement, corroborated it to a special agent with the agency.

The TBI stated in the affidavit that Adams was trying to coerce or influence a witness in the judicial proceeding involving the Holly Bobo case.

Coercion of a witness is a Class D felony.

Adams, 29, pleaded not guilty to charges of first degree murder and especially aggravated kidnapping in the case last month and remains in the Chester County jail without bond.

He is next scheduled to appear in court for a status hearing April 9.

John Dylan Adams is being held in Obion County on federal charges involving a Sept. 16 indictment that charges the younger Adams knowingly “possessed, received, concealed, stored, bartered, sold and disposed of a stolen firearm” on or about July 13, 2013, along with a Jason Kilzer.

The indictment said a .38-caliber revolver was shipped and transported in interstate commerce with knowledge that it was stolen. John Dylan Adams was also charged with receiving and possessing the firearm through interstate commerce with the serial number removed, obliterated or altered.

He was charged with aiding and abetting Kilzer and giving Kilzer the gun after knowing it was illegal for Kilzer to own the gun.

The indictment said John Dylan Adams was an unlawful user of controlled substances or an addict.

John Dylan Adams is being represented in the federal case by M. Diane Smothers, a federal public defender. Prior to the most recent charge of coercion of a witness against Zachary Adams, Smothers told a Jackson Sun reporter in mid-March that she did not wish to comment on the Holly Bobo case and that John Dylan Adam would not be available for an interview.

The Madison County Sheriff’s Department arrested John Dylan Adams in Madison County on Sept. 25 and turned him over to the U.S. Marshals Service after an arrest warrant was issued on Sept. 16.

White said she and Franks came up with the idea for another rally, a “Justice for Holly” rally. The rally will begin at Corinth Baptist Church on Saturday with a noon prayer time, followed by a 1 p.m. community vigil.

At 1:30 p.m., cars, motorcycles and trucks will be decorated for a parade that will leave the church, drive through the community, circle the Decatur County Courthouse and drive back.

White said she is asking the community to come pray for justice for Bobo and the investigation, and then join the parade in support for the Bobo family.

Now, White said, the awareness colors for Bobo will change. New shirts and ribbons that say “Justice for Holly” will be lime green and pink. She said Corporate Image, a custom screen printing and embroidery business in Lexington, has already sold 2,000 shirts.

White said that other than the production costs, all the proceeds from the shirts’ sales have gone to the Bobo family to ease financial struggles that have come from searching for Bobo and to assist with costs that might come from a possible future trial.

White said a “Justice for Holly” fund has been set up at the church.

Franks said Saturday is going to be all about “praying for the family, praying for investigators and praying for justice.”

“We want to make sure the family gets justice and sees closure,” White said.

Holly Bobo Suspect Misses Court, Faces Witness Coercion Charge

The man accused of murdering Tennessee nursing student Holly Bobo still has not retained an attorney, it was revealed Wednesday, even as he faces an additional charge related to threatening to kill his brother.

Zachary Rye Adams, 29, wasn’t required to appear in Decatur County court, prompting Circuit Judge C. Creed McGinley to announce he would force the suspect to attend future status hearings. An attorney represented Adams in court Wednesday, but the convicted felon hasn’t officially retained her, reported The Jackson Sun.

“Until Mr. Adams is present, I am limited in what I can do,” McGinley said.

The state has refused to begin discovery in the case until Adams retains a lawyer, according to NBC affiliate WSMV.

Adams pleaded not guilty last month for the kidnapping and first-degree murder of Bobo, who was 20 when she vanished from her home in western Tennessee on April 13, 2011.

Authorities have not revealed why they believe Adams is a suspect, and have not said whether they have recovered Bobo’s body.   ::snipping3::

DECATURVILLE, Tenn. -- Zach Adams was scheduled to make his next appearance in Decatur County Circuit Court Wednesday morning, however he did not appear.

Judge Creed McGinley said in court Wednesday that he regretted granting Adams' request to waive his appearance and said that he would appear at all further hearings.

"I wish I had not accepted that waiver because the court would like to address him because the onus is on him to secure council," said Judge McGinley.

"He put his foot down and said he will be here," said Bobo Supporter Tammy Ramey. "He should have to face everyone that was in there and not get to sit in his little cell."

Adams has not retained an attorney. Nashville Attorney Jennifer Lynn Thompson told the court an agreement has not been finalized due to financial reasons. Judge McGinley set another hearing for Wednesday April 30 at which time Adams will have a public defender appointed to him if he has still not retained one.

"I'm truly interested in moving this case along as I told you on the front end and I cannot go through a process where we come in every 30 days and we are not doing anything," said Judge McGinley.

Decatur County Public Defender Guy Wilkerson, recused himself from from the case so a public defender from another county will be appointed if Adams is unable to hire an attorney.

Who saw Holly Bobo alive after she disappeared? New details Thursday on NewsChannel 5 at 10 #hollybobo

Bobo disappeared from her home in Parsons, Tenn., about 110 miles southwest of Nashville, in April 2011. Her brother told police he saw a man in camouflage leading her into the woods surrounding the family home.

In announcing the charges against Adams last week, District Attorney General Hansel McCadams said the grand jury felt there was enough evidence to prove that Bobo was "forcefully taken from her home without her consent" and "killed in the perpetration of that kidnapping."
Investigators have not commented on what led to the charges against Adams and they have not revealed whether Bobo's body has been found. A possible motive also has not been named in the case.

DECATUR COUNTY, Tenn. - New details uncovered by NewsChannel 5 shed light on what may have led to the arrest of Zach Adams for the murder of Holly Bobo.

Bobo disappeared three years ago, and earlier this year the Tennessee Bureau of Investigation charged Adams with the crime.  The key to the case could be his brother Dylan Adams.

"The brother is now a witness and a key witness in this prosecution," said NewsChannel 5 legal analyst Nick Leonardo.

The brothers lived with their grandfather, Dick Adams, in separate homes on a piece of property near Decaturville. The TBI searched the property in February, not long before Zach Adams was arrested. So what led authorities to Adams and the property?

In an exclusive interview with NewsChannel 5, the grandfather dropped a bombshell: His grandson Dylan told the TBI he saw Holly Bobo inside his brother Zach's house after she disappeared.

"I believe that Mr. Adams' brother stated that Holly Bobo was seen in the house alive," said Leonardo.

"This is but one piece of the puzzle we are getting but it's all coming together very quickly," said Leonardo.

Not long after the TBI arrested Zach for Bobo's murder they said he threatened his brother sending a message through another inmate: "He's the one who started this s*** and if he don't shut his mouth he will be in the hole beside her."

The "her" may be Holly Bobo.

And NewsChannel 5 has learned the "hole" could refer to one of the water wells on Adams' property. The grandfather confirmed there are two: One is 15 feet down to a shallow spring. The other is much deeper. Both capable of hiding a body.

"Absolutely, especially a well that goes down 80 feet. That's especially a place of interest," said Leonardo.

In fact, the grandfather confirmed the TBI used backhoes to dig up and search both wells. There was no indication they found a body. But several sources close to the investigation said they recovered some type of physical evidence -- possibly bone fragments.  If that's true the question is: Did the fragments come from Holly Bobo?

"Obviously they are waiting to see if there's a forensic match with Holly's DNA that comes back from the lab," said Leonardo.

The Tennessee Bureau of Investigation will hold a news conference Tuesday afternoon to announce new and significant developments in the Holly Bobo case.

The news conference will be held at 4 p.m. at the Decatur County Sheriff’s Office in Decaturville.

Bobo disappeared from her home on Swan Johnson Road outside Parsons on the morning of April 13, 2011.

Zachary Adams was arrested earlier this year and charged with first degree murder and especially aggravated kidnapping in the Bobo case.

The TBI has not indicated Bobo’s body has been found

DECATURVILLE -- A grand jury will meet at 1 p.m. today in Decatur County to consider additional charges in the Holly Bobo case, officials told The Jackson Sun.

Following the grand jury meeting, the Tennessee Bureau of Investigation has said it will announce new and significant developments in the Bobo case at a news conference at 4 p.m. today.

One suspect, Zachary Adams, already has been charged with murder and kidnapping of the 20-year-old Decatur County nursing student.

Zachary Adams appeared in court this morning for a preliminary hearing on a charge of coercion of a witness in the case. Adams is accused of trying to send a message to his brother, John Dylan Adams, threatening him if he talked about the Bobo case.

After hearing testimony today, the judge sent the coercion of a witness charge to the grand jury.

Zachary Adams also is scheduled to appear in Decatur County Court on Wednesday for a status hearing on the murder and kidnapping charges in the Bobo case.

Another unrelated charge of aggravated assault that Zachary Adams had faced has been dismissed after alleged victim Amber Bray requested that he not be prosecuted on that charge, according to court officials

This afternoon, TBI Director Mark Gwyn and District Attorney General Hansel McCadams will discuss the new developments and field questions from members of the media.

The news conference will promptly begin at 4 p.m. at the Decatur County Sheriff’s Office, 138 E. Main St., Decaturville.

Authorities are expected to announce "new and significant developments" in the case of a missing Tennessee nursing student abducted from her family's home three years ago, the Tennessee Bureau of Investigation confirmed to FoxNews.com.

Holly Bobo, a nursing student at the University of Tennessee at Martin, was last seen at her home in Parsons on April 13, 2011, by her older brother, who reported seeing her being taken into the woods by an unidentified man dressed in camouflage.

Maybe to escape the death penalty one of them will divulge where she is so her family can give her a proper burial.  I have chills reading this.  I cannot believe the "good ole boy" network kept people from speaking up earlier.  Especially now knowing there are witnesses who saw her alive AFTER she went missing.  God in heaven.  Sick.

One of Adams' best friends, by all accounts, is Jason Autry, who is currently serving 15 years to life in prison with 26 felonies on his record.

But Autry, while he was in the Decatur County Jail, became a born-again Christian, apologizing and repenting for his sins and transgressions.

And it's interesting to note that Autry has recently been transferred for undisclosed reasons from the Decatur County Jail to the Carroll County Jail.

(Decatur County, TN) Jason Autry has been charged with first degree felony murder, aggravated kidnapping  in relation to the murder of Holly Bobo.

Autry, who is friends with Zach Adams will be in court Wednesday.

According to the TBI there is at least one witness who said they saw Holly Bobo alive with Autry and Adams.

Autry is already behind bars on drug charges.

TBI Director Mark Gwyn confirmed they have not found the body of Holly Bobo yet.

TBI Announces New Charges, Second Subject in Ongoing Holly Bobo Case

DECATURVILLE, TENN.-The Tennessee Bureau of Investigation has obtained new indictments and a second arrest in connection to the disappearance and murder of Holly Bobo.

In recent weeks, TBI Special Agents developed enough evidence and information to prompt the District Attorney General to solicit a special grand jury. This afternoon, at 1:00 PM, the special Decatur County Grand Jury convened to hear the case presentation from a TBI Special Agent. The grand jury subsequently returned indictments for Jason Wayne Autry, 39, of Holladay, charging him with one count of Especially Aggravated Kidnapping and one count of First Degree Felony Murder.

Autry, who has a lengthy criminal history, is currently being held in the Riverbend Maximum Security Institution in Davidson County on an unrelated Aggravated Assault conviction. The District Attorney General for the 24th Judicial District, Hansel McCadams, will prosecute the new charges.

A second man has been arrested in the alleged kidnapping and death of Holly Bobo.

Jason Wayne Autry, 39, of Holladay, Tenn., was indicted by a grand jury on Tuesday afternoon on first-degree murder and especially aggravated kidnapping charges, according to Tennessee Bureau of Investigation director Mark Gwyn.

Gwyn also said Bobo's body has not yet been located, though investigators have physical evidence in the case.

In a statement released this morning, the TBI said the investigation "remains active and ongoing." Additional arrests and indictments could still be issued, Gwyn said.

"Anyone that had anything to do with Holly Bobo's case will by prosecuted," Gwyn said.

Prosecutors plan to indict at least one more person in the Holly Bobo case, according to documents obtained today by The Jackson Sun.

According to the documents, prosecutors plan to indict Shayne Kyle Austin, who previously had been granted immunity in exchange for his cooperation in the investigation.

The state voided the immunity agreement because Austin was not completely truthful and forthcoming, according to an email from Assistant District Attorney General Beth Boswell to Austin’s lawyer, Luke Evans. The email was sent on March 27.

“When we indict your client, I will give you a courtesy call informing you,” Boswell told Evans in the email.

The Jackson Sun went to an address listed for Austin on whitepages.com, but the property was enclosed in a fence, and the driveway was blocked by a locked gate. The listing did not include a telephone number. Evans did not respond to a telephone message left at his office seeking comment.

Austin would be the third person indicted in the abduction and killing of Bobo. Jason Wayne Autry was indicted today on charges of first-degree murder and especially aggravated kidnapping. Zachary Adams was indicted on the same charges in March.

Boswell’s email indicating the intent to indict Austin was included with documents filed by Austin’s lawyer in Decatur County Chancery Court on April 1. The documents seek a restraining order and temporary injunction to keep prosecutors from violating the immunity agreement and indicting Austin.

According to the documents, Austin received immunity in the Bobo investigation in an agreement signed on March 6. The agreement gave Austin immunity from any criminal charges arising from the Bobo case.

More specifically, the agreement said, “In exchange for the total cooperation of Shayne Kyle Austin, the State agrees to grant him immunity for all charges arising out of the disposal, destruction, burial and/or concealment of Holly Bobo’s deceased body, conditioned upon him assisting us in recovering the body of Holly Bobo.”

NASHVILLE, TN (WSMV) -
A third man is about to be arrested in the Holly Bobo murder investigation, according to that man's attorney.

Shayne Kyle Austin, 29, had signed an immunity agreement, according to his lawyer, Luke Evans, but now that agreement may be null and void for untruthfulness.

It is a complicated and unexpected turn in a case that is rapidly developing.

Earlier Tuesday, the Tennessee Bureau of Investigation announced indictments of especially aggravated kidnapping and first-degree felony murder against Jason Wayne Autry, 39, in Bobo's disappearance.

Autry is currently imprisoned at Riverbend State Penitentiary on an assault charge, and he is due for an arraignment Wednesday along with fellow suspect Zachary Adams, who was previously charged with kidnapping and murder in the Bobo case.

As first reported by the Jackson Sun, Evans says Austin signed an agreement to testify against the other accused killers in exchange for immunity from prosecutors, but the district attorney emailed Evans that the deal was off.

In a statement to Channel 4 News late Tuesday, Evans said:

"My client takes issue with the state's assertion that he was untruthful and not forthcoming. My client has remained in full compliance with the agreement he entered into with the state of Tennessee. I expect them to honor his agreement. We're set to have a hearing on my client's request for an injunctive release regarding the state's attempt to breach the immunity agreement next month."

Again, according to Evans, the district attorney's office says the immunity agreement was based on complete truthfulness, and the D.A. believes Austin lied about what happened.

We had bad weather yesterday, tonight I caught all this on the local news.  I wish I could say Im stunned but Im not, disgusted & furious would describe how Im feeling.  When it was announced that Zackary's bro was interrogated we could get the sense that he knew something was going on or worse yet, knows more than he's admitted already.   Why do I say that, because he would have had to see the other two now being charged there as well, as least that is logically what I'm thinking had to have happened.  Zackary's brother had to have known there was no reasonable explanation for Holly to be with them, especially considering the hour she was abducted, nope he had to have seen more than we are aware of so far.  These monsters put this beautiful young woman thru horror, it might just be as gruesome as we have feared.   I hope their "evil boy club" all fry for it.   To me, it doesnt matter who had what part in it at this point...from the moment she was taken from her own home, they all knew what they were doing was with heinous intent.   The fact that there is a reported known family relation involving one of these monsters to the Bobo family only makes her kidnapping, murder, possibly even gang rape even more diabolic.  The fact that Jason self-proclaims himself to be a born again Christian now while already in prison means nothing to me, it doesnt absolve him any less.  Their collective long-term hard drug use also has no bearing to me whatsoever, they still knew what they were doing & their addiction should have no mitigating consideration, IMHO.   If anything, I grow more and more disgusted that our country's society in large part let this revolving door attitude continue with leniency & way too many sympathizers. Its high time that victims & the safety of society as a whole matter more than those who choose to destroy themselves & others around them.   Regardless, when the smoke & mirror of "drug addicts" clears, bottom line Zackary, if not all of them probably are sociopaths & have a propensity toward violence with or without heavy drug use.    I've never been known to mince words, I hope they all get the needle with no reservation on thought.   One more thing, I hope the people that followed this case & kept pointing a finger toward Holly's brother regardless of being told repetitively that he was not involved, reflect hard & offer their regrets for putting the Bobo family thru even more agony than any one family needed to endure.

I do pray one of them finally breaks the silence & finally gives information toward recovering her for her family.    Justice for Holly, prayers as always to her family.

DECATURVILLE, Tenn. - A second person was charged Tuesday with the 2011 kidnapping and murder of nursing student Holly Bobo and more arrests are likely.

Jason Autry, 39, was indicted on charges of especially aggravated kidnapping and first degree felony murder Tuesday afternoon.  He was already behind bars at Riverbend Maximum Security Institution in Nashville on an unrelated aggravated assault conviction. He is now being held without bond.

“As with Mr. [Zach] Adams, my office will evaluate this case as a death penalty qualify case and make a decision once the criteria have been received and evaluated,” District Attorney Hansel McCadams

Tuesday night, The Jackson Sun reported a third man, Shayne Austin, will also be indicted in the case.

The newspaper stated Austin was initially granted immunity in exchange for his cooperation in the investigation but it has since been revoked.

Bobo disappeared from her home on Swan Johnson Road outside Parsons on the morning of April 13, 2011.

Zachary Adams was arrested earlier this year on charges of first degree murder and especially aggravated kidnapping.

Adams is also charged with coercion of a witness.  A grand jury returned an indictment on the charge Tuesday. Adams remains in the Chester County jail without bond.

DECATURVILLE, Tenn. (FOX13) - Jason Autry, 39, has been charged with first-degree murder and especially aggravated kidnapping in the 2011 disappearance of nursing student Holly Bobo, the Tennessee Bureau of Investigation said during a news conference Tuesday in Decaturville.

Autry is the second person charged in the disappearance of the 20-year-old. Zachary Adams was charged in March with kidnapping and murdering Bobo.

"We have sworn statements from witnesses that saw Holly Bobo in the presence of both Zachary Adams and Jason Autry after her disappearance. Alive," said TBI Director Mark Gwyn.

But this is not the first crime Adams and Autry are connected to: Back in 2007 court documents show they were arrested for burglary, evading arrest and theft.

Autry also has an eight page rap sheet dating back to 1998 listing charges including possession of a firearm with intent, aggravated burglary, domestic assault, simple possession and an aggravated assault charge for which he's currently serving three years in Riverbend Maximum Security Prison.

Decatur County District Attorney General Hansel McCadams added, "He also must complete the remainder of a 100 month sentence he is serving from a federal court conviction arising out of a Decatur County .... U.S. Department of Alcohol and Firearms case."

This latest arrest will not be the last according to the TBI.

DECATUR COUNTY, Tenn. - Zach Adams, the man charged with the kidnapping and murder of Holly Bobo, appeared in a Decatur County courtroom Tuesday.

The 29-year-old watched as former inmate Sean Cooper testified against him by detailing a conversation between himself and Adams on March 4.

Both men were scheduled for court and met in a holding cell when the conversation allegedly took place .

Cooper said Tuesday that Adams introduced himself as “the Bobo guy” and then asked him to deliver a message to his brother, Dylan Adams, who was being held in a penal institution in Obion County.

Cooper said he was then asked to tell Adams’ brother to stop talking about the Bobo case.

“He said 'Well, you tell him, you get a message to [give] him. You tell that son of a b*%$! to keep his d*%@ mouth shut because he's the reason I’m in this s*&% and if he don't shut up, he'll be in the hole next to her," Cooper recalled.

He continued, “Yeah, I thought it was odd. Why would somebody even say that? That’s why I’m sitting here telling the truth today. It’s so odd. If she wasn’t in a hole, well how are you [going to] put your brother there, too?”

Adams is charged with coercion of a witness for threatening his own brother, who is a witness in the case.

The judge denied Johnson’s motion to have it thrown out because it happened in Chester County.

(WREG-TV) News Channel 3 has confirmed investigators plan to indict a third suspect in the kidnapping and murder of Holly Bobo.
Shayne Kyle Austin was granted immunity, but investigators say he did not tell them the truth, breaking their agreement.
His lawyer, Luke Evans, tells us that agreement meant Austin would not face any criminal charges, in exchange for total cooperation.

Adam's attorney: To this point, I have received NO information from the state. No even what time she disappeared.

The State is discussing what is necessary regarding discovery, judge urges it to furnished to the defense by 60 days     The judge will NOT allow Zach Adams to waive any appearances to do with his case.   Now the defense attorney wants equal time after receiving said discovery, the judge is giving up to 60 days.

The judge took note that Zach appears to not be paying attention & asks his attorney if he is paying attention then eyeballs him to address him as to the importance of him understanding what is being said in his case.  This judge appears to be on top of things & will take no nonsense.

Zach's attorney claims that he signed land over to his grandfather in order to retain her....hmmmmm

360,000 pages of documents estimated, she's complaining already that his family wont have enough to pay her (I hate her already)

(Decatur County, TN) The two men indicted for the disappearance and presumed murder of  Holly Bobo are in court.

Zach Adams and Jason Autry are both charged with felony first degree murder and aggravated kidnapping.

Autry, who was indicted yesterday, told the judge, “I’m innocent of these charges. Right hand to God I’m innocent”

Autry also told the judge the handcuffs were cutting off blood to his hands and he cannot afford an attorney.

The court entered a ‘not guilty’ plea for Autry, since he seemed unsure about the charges he faces.

Autry said he is not sure his family can afford a private attorney at which time the judge urged him to do his best, “I don’t have to tell you these are very serious charges. I urge you to secure counsel.”

Autry, who is already in jail for drug charges, will be back in court June 4 at 1 p.m.

Zach Adams entered a not guilty plea on a coercion of a witness charge.

Adams reportedly sent a threat to his brother warning him not to talk with investigators.

Adams previously entered a not guilty plea to the murder and kidnapping charges.

An attorney for Adams said he has been in isolation in the Chester County Jail without access to pencil or paper which the attorney said he needs to provide notes to his attorney.

Adams will also be back in court June 4.

We have learned a third man, Shane Kyle Austin, will soon be indicted.

Austin was initially given but prosecutors say he violated the deal but not telling the truth.

The deal was to prevent him for being charged, “In exchange for the total cooperation of Shayne Kyle Austin, the State agrees to grant him immunity for all charges arising out of the disposal, destruction, burial and/or concealment of Holly Bobo’s deceased body, conditioned upon him assisting us in recovering the body of Holly Bobo.”

Adams was arraigned on the newest charge of coercion of a witness, which he entered a not guilty plea. Adams reportedly asked an unnamed inmate to - "Tell my brother he is the one who started this (expletive) and if he don't shut his mouth he will be in the hole beside her."

During the arraignment, his legal counsel brought up multiple concerns, including the fact that her client could not review the evidence in his case. She suggested that she give Adams a computer. The judge that this would be a concern taken up at the next hearing.

Adams is due back in court on June 4, at the same time Autry will appear .

Adams legal counsel also claimed he cannot afford to retain his counsel and was declared indigent. He was also ordered by the judge to appear in each subsequent court appearance.

(WMC) - The two men charged in connection to the 2011 disappearance of nursing student Holly Bobo both appeared in court Wednesday at 1 p.m.

First to appear was Jason W. Autry, who heard the charges against him and entered a plea. The court entered a "not guilty" plea on his behalf. Afterward, Autry told the judge he is innocent of those charges.

More than once, Autry asked the judge to allow someone to uncuff him because his "hands are turning purple" and he hasn't "been able to feel them since he left Nashville."

The judge disregarded Autry's request and continued on with the hearing.

Before leaving the courtroom, Autry declared his innocence once again.

"I want to say again, I'm innocent of these charges," he said to the judge. "Hand before God, I'm innocent, sir."

Autry is due back in court on June 4 at 1 p.m. for a hearing to determine whether he can obtain private counsel.

Zachary Adams appeared in front of the judge after a short recess. This time, he had an attorney with him who entered a "not guilty" plea on his behalf on the coercion of a witness charge.

The prosecutor was asked to furnish "everything she can" to his attorney in 60 days. The judge said he will not take up anything that has to do with Adams' case without him being present in court.

Adams' attorney also suggested providing her client with paper and pencil, or moving him to a facility that allows such resources, so that he can write down his thoughts as she prepares his defense. That matter, along with the other questions she had for the judge, will be addressed in the future.

A third name has emerged in the investigation into Holly Bobo's disappearance. Shayne Austin will be indicted, according to the district attorney, and Austin's attorney has filed suit to block an arrest.
At the same time, a friend of Bobo's says she saw a man who looked a lot like Austin stalking them days before Bobo went missing.

Candace Wood wonders now if she was witness to the beginning of the awful events. Her story is simple and chilling now that we know so much more.

Wood was on a double-date with Bobo, her childhood friend, at the Decatur County coon hunt in 2011.

As you can imagine, it was crowded, but something made Wood look behind her - you know how you feel staring eyes.

"He had this look like he was staring at us. I had never seen this guy before," Wood said. "He just kept staring at us. He had his phone in his ear. He would look down and up, look down and up, and look back four or five times. The fourth or fifth time I got that eerie feeling, that creepy feeling he was looking at me or Holly."

Four days later, Bobo was abducted by a man in camouflage, and that detail stopped Wood cold because of the man she saw at the coon hunt.

"He was wearing camouflage from head to toe," Wood said. "I couldn't shake it off - couldn't sleep. I had to report it to the [Tennessee Bureau of Investigation]."

Wood says she reported what happened at the command station. Keep in mind, this was the day after Bobo disappeared.

"It played back in my mind. Something wasn't right. Something wasn't happening. I couldn't shake the feeling of what was wrong," Wood said.

Two months later, Wood says, the TBI called her back to sit with a sketch artist.

Channel 4 News interviewed Wood last month in connection with our investigation, and she said she is still haunted by the memory.

"I have that guilt every day. I should have protected Holly. I should have told her. I didn't have the courage to do it. I miss her. Everyone misses her," Wood said.

Meanwhile, attorney Luke Evans has filed a multi-count lawsuit against the state of Tennessee on behalf of his client, Shayne Austin, based on the immunity agreement he signed on March 6 - one week after the TBI announced indictments against the first man arrested in the case, Zach Adams.

On Tuesday, the TBI said a second man, Jason Autry, has also been indicted in Bobo's disappearance.

District Attorney General Hansel McCadams said Wednesday he could not comment on whether his office plans to present charges against Shayne Austin to a grand jury in the Holly Bobo case.

The district’s attorney office is seeking dismissal of a complaint Austin’s attorney filed in Decatur County Chancery Court. The complaint states that prosecutors told Austin’s attorney they plan to indict Austin after nullifying an immunity agreement they had offered him in exchange for his cooperation in the investigation of Bobo’s kidnapping and murder.

“The grand jury is a separate body from Chancery Court,” McCadams said on Wednesday. “It is totally separate. When we plan to indict someone, it is a complete secret, and the first to know about it is the grand jury, then the person who is indicted. We are prohibited by law from saying who will be indicted.”

Austin’s attorney, Luke Evans, filed the complaint on April 1 asking the Chancery Court for a restraining order and temporary injunction to keep prosecutors from indicting Austin, according to court documents obtained by The Jackson Sun

A third defendant could face charges in the case after prosecutors revoked an immunity agreement that had been worked out for him.

The March 6 agreement granted Shayne Austin, 29, of Decatur County, immunity from various charges, including "all charges arising out of the disposal, destruction, burial, and/or concealment of Holly Bobo's deceased body," according to documents filed in Decatur County Chancery Court and posted online by The Jackson Sun, which first reported them.

The agreement was dependent on Bobo's body being recovered from the place where Austin said it was buried.

The immunity agreement also includes a provision to grant Austin immunity for drug-related criminal activity "not to include any drugs administered to Holly Lynn Bobo."

Bobo disappeared from her family's home near Parsons on the morning of April 13, 2011. Her brother told police that he saw a man dressed in camouflage leading her away into the woods. Since then, investigators and volunteers have scoured the woods and fields of the town of about 2,400 for clues. Investigators said Tuesday that they have not yet recovered Bobo's body.

Documents show Austin met with Tennessee Bureau of Investigation agents the same day the agreement was signed. Later that evening, Assistant District Attorney General Beth Boswell sent an email to Austin's attorney, Luke Evans, saying that Austin was not "truthful, candid, forthcoming or cooperative" and therefore "not compliant with the immunity agreement."

Austin filed a lawsuit on April 1 to force the state to grant him immunity. The lawsuit contends that he has complied with the terms of the agreement and that Austin waived his constitutional protections, including the right not to incriminate himself, to get immunity. It claims the government is in breach of contract for reneging on its obligations under the agreement.

A hearing date is set for May 27.

MURFREESBORO, Tenn. - Exclusive video highlights the checkered past of a man now at the center of the Holly Bobo murder case. Newschannel 5 obtained police car video showing the arrest of Shayne Austin during a traffic stop in Murfreesboro in 2009.

"He was stopped for DUI and it was his third violation," said Kyle Evans with the Murfreesboro Police Dept.

At the time he was a student at MTSU. A year later he was arrested again for wandering down a city street at 3:15 a.m. with a loaded 12-gauge shotgun.

"During his time here in Murfreesboro Austin had several run-ins with law enforcement," said Evans, who said it's no surprise to learn he may be involved now in the Holly Bobo case.

So far Zach Adams and Jason Autry are both charged with Bobo's murder. Austin-- believed to be childhood friends with the two suspects -- had been granted immunity if he could lead the TBI to Bobo's body. In fact, sources tell Newschannel5 a tip from Austin helped lead to a massive search of Adams' property back in February. No body was found. The immunity was revoked. And Austin could now face charges.

Defense Team Chosen For Second Suspect Charged In Bobo Case

NASHVILLE, Tenn. – The second suspect charged in connection with the kidnapping and murder of Holly Bobo has chosen his legal team.

Attorney Fletcher Long said Friday that he, along with his Clarksville-based law partner John Herbison, will join Mike Flanagan in defending Jason Wayne Autry in the Holly Bobo trial.

“It’s our case, we are thrilled to have it, and we are going to give this man every penny of the defense for which he has paid,” he said.

Autry, age 39, appeared in a Decatur County courtroom Friday, where he pleaded not guilty to charges of aggravated kidnapping and first degree murder. During his appearance, he repeatedly stated he had been wrongly accused in the case.

Long said when he spoke to his client, he again expressed the same feelings.

“The more I'm exposed to him, the more impressed I am as to how very innocent he is and how he has been caught up with something that has nothing to do with him,” he said.

Long and Flanagan met with Autry Friday, at the Riverbend Maximum Security Prison, where he has been in custody since May of 2013 for an unrelated case.

Shayne Austin, 29, identified as suspect by a prosecutor in an email, may be indicted alongside Jason Wayne Autry and Zachary Adams, who have both been charged with first-degree murder and especially aggravated kidnapping in the Bobo case.

Bobo, a nursing student, disappeared after she was seen being led away from her West Tennessee home by a man in Darden in April 2011.

Austin previously had been granted immunity in exchange for his cooperation in the investigation, but investigators told The Jackson Sun Austin was not completely truthful and forthcoming.

He was arrested twice in three months in Rutherford County, according to records from the Murfreesboro Police Department.

On Nov. 20, 2009, Austin was pulled over on Middle Tennessee Boulevard in front of the Murphy Center at Middle Tennessee State University, according to an arrest report. On video footage taken from a dashboard camera mounted in the patrol car, Austin can be seen stumbling and nearly toppling multiple times during a field sobriety test.

Austin was charged with the third DUI on his record and with violating state implied-consent laws, as he refused to submit to a blood test when he was booked, according to the arrest report.

On Jan. 4, 2010, a police officer saw Austin walking across a gas station parking lot wielding a shotgun, according to another arrest report.

The gas station, which was a Mapco at the time, was on Middle Tennessee Boulevard just down the road from where he was previously arrested. When the officer approached Austin, according to the report, Austin placed the Remington 870 12 gauge shotgun on the ground.

Austin was arrested for possessing a weapon with intent to go armed, according to the arrest report.

State law says that "it is an offense for any person to possess or carry, whether openly or concealed, with the intent to go armed, any (prohibited) weapon" in public. Exceptions are made for people who carry a handgun with the appropriate permit.

Austin's criminal record in Decatur County includes 10 charges against him, all misdemeanors, according to The Jackson Sun.

"I don't want to speculate and make a rumor of what happened to the girl," Autry said.

Autry said Dylan, who is in jail on gun charges, lied to investigators.

"He's been lying his way all this time. You know he got himself in a little trouble and he's down there in Obion County and he don't want to do his time and he's making stuff up to get out of it," Autry stated.

Autry said Dylan can't stand his brother.

"They hate each other's guts and that's a way to get back at him," added Autry, who said he and Zach are friends.

"Me and Zach go back several years you know. On and off," said Autry. "He'd come around. Me and him smoked, drank a little bit, did some dope and hung out together. Zach didn't have a whole lot of friends."

Autrey conceded he and Zach had several run-ins with the law over the years. And, Autry said while he was serving time on one arrest in 2012 TBI agents paid him the first of many visits to press him on the Bobo case.

"It was a try to be a forced move to get me to be a false witness against Zach Adams," said Autry.

But Autry said he told the TBI he knew nothing -- no link between Adams and Bobo. If he did, Autry insisted he would have taken the TBI up on their offer of reduced jail time and the reward money.

"I would have taken five years and $280,000 for my freedom. If I knew, I would tell them,"  Autry concluded.

"I don't think they have any idea who committed a crime or that a crime was committed at all," said Autry's attorney Fletcher Long. 

Long wonders if the TBI has anything other than an informant's word as evidence against his client. No body has been recovered in the Bobo case.

"I think first you have to prove there is a killer and that she is dead," said Long.

Autry said whatever happened to Holly Bobo, he was not involved.

"I want to let them know they have an innocent man right here," said Autry.

The TBI declined to comment about what Autry has said about the investigation.

And why in the world is his lawyer allowing to give interviews?  Seems like if he is innocent, his lawyer would advise him to be quiet.  JMO

Shayne Austin, the man who was given an immunity deal (which was later reneged by the DA) has also given information.  What, if anything, did he have to say about Jason Autry? 

Dylan would not dredge up the wrath of three spiteful and violent men to acquire an early release IMO.  That would be a huge risk as there would be no guarantee they would be tried and convicted only to come after him after being released.

Investigators appear confident they have the perps which certainly gives the appearance they have evidence ample to convict.

Autry can sit in his cell and keep blowing smoke... and wishing he had come out sooner and set the others up for the fall so he could be free and walked away with the $280k reward fund.  I know he's thinking it, "Why didn't I set them up and take that dang money?".

I believe it was a Shayne Austin offered immunity.  All the "A"s are confusing.

"No sir. Right hand before God. The Father, Son and Holy Ghost. I didn't bother that girl in no form or no fashion and I don't know who did," said Autry from his cell at Riverbend Maximum Security Prison.

Autry said he never personally knew Bobo, though he did know of her.

"I didn't now nothing about her other than her dad and my dad and some of our kin knew each other. I went to school with her mother as my school teacher growing up," said Autry.

But, he said he doesn't even know the location of Bobo's home where she was abducted.

"I never went to the house. I never hung out with her on the town. I never, none of that," said Autry.

Autry said he does know his co-defendant Adams as a friend.

But he denied rumors that Autry, Adams and another friend, Shayne Austin, formed a gang known as the A-Train that terrorized the locals in Decatur County for years.

"Some people portray us as big dope dealers and gang members and that's not the case. This is a community that's real small. It was just a few dopeheaded boys just hanging out," said Autry. "Our relationship is what you might call drug-based. The only time we hung out was when we was getting high."

Autry denies that he was involved in some type of drug-induced, crazy plot to kidnap and kill Bobo.

"It never dawned on me that someday I was going to be falsely accused of this," said Autry.

"Jason Autry has been in trouble with the law before," said his attorney Fletcher Long.

But he said there is nothing to link Autry to Bobo's disappearance, much less murder. The TBI has looked, but has yet to find a body.

"You can prosecute without a body, but you better have some pretty convincing circumstantial evidence on death and I don't think they have that here," said Long.

Even if the TBI does have some physical evidence -- perhaps bone fragments or clothing -- it may not matter for Autry.

Long dropped this bombshell: "We may have a strong alibi defense."

Long has indicated that Autry will be able to prove he was far away -- in another county -- when the TBI issued the alert for Holly Bobo.

The TBI has declined to comment on what Autry has said about the investigation.

NASHVILLE, Tenn. - Attorneys for Holly Bobo murder suspect Jason Autry are complaining to the judge in the case that they are not being given private access to their client at Riverbend Maximum Security Prison.

"I'm looking for justice for my client," said attorney Fletcher Long. "This is unacceptable." 

Long and John Herbison are filing a motion with the court stating: Prison officials have so far refused to permit in-person contact between defense counsel and the accused.

Long said during his visits to Riverbend he's been restricted to speaking to Autry through glass and with guards present. 

The Tennessee Department of Corrections issued the following statement Tuesday:

Mr. Autry is in segregation. Inmates in segregation are allowed confidential meetings with their attorneys. The presence of a glass barrier does not infringe upon attorney client privilege or confidentiality. Fletcher Long has not been denied or otherwise had access to his client limited. Mr. Long was granted a video conference with his client, but, unfortunately, Mr. Long chose to squander his time when he circumvented TDOC policy by allowing a member of the media to conduct an unapproved interview with an inmate. TDOC will continue to apply its policies in a consistent manner for all inmates and their attorneys.

NASHVILLE, Tenn. - The war of words has escalated, and it could jeopardize the case against one of the Holly Bobo murder suspects.

The attorney for suspect Jason Autry said he may ask the judge to dismiss the indictment, claiming Riverbend Maximum Security Prison is hindering Autry's right to a legal defense.

Autry has been charged with the kidnapping and murder of Holly Bobo. He talked to NewsChannel 5 by closed circuit TV from Riverbend Maximum Security Prison. But Autry's attorney Fletcher Long wants better access.

"They're just messing with me and they can do it at their peril," said Long.

This past week, Long complained that Riverbend has not allowed him face-to-face, private meetings with Autry, who is in segregation.

"We are either interviewing him at his cell or through very thick glass through which I'm not able to hear," Long stated.

"If I can't get access to my client I will ask the court to dismiss the indictment for him being denied effective assistance of counsel," Long concluded.

The state response also read: "Mr. Long was granted a video conference with his client, but, unfortunately, Mr. Long chose to squander his time when he circumvented TDOC policy by allowing a member of the media to conduct an unapproved interview with an inmate."

This referred to him allowing NewsChannel 5 to interview Autry.

"That's my call. That's not Riverbend's call," said Long, who granted the interview so Autry could have his say.

"I think it's fair that if the TBI can have a press conference to call him guilty, then it's fair for him to try the case with public just as they have done," said Long.

The issue will be addressed at Autry's arraignment next Wednesday.

Is Autry's attorney Long  interested in representing his client and helping him have a fair trial and defend him, or is he trying to scratch up enough dust with the media to make a name for himself?  I cannot for the life of me think why an attorney would allow an interview like that.  It certainly wouldn't be in the defendant's best interest imo.  Maybe Long see's himself as a Tennessee version of Jose Baez?  Autry might want to see about getting a different attorney.  Another thought I have is, maybe the attorney doesn't see much of a defense for his client Autry and is trying to set it up so the case goes to mistrial for incompetent representation...  ::MonkeyNoNo::

(WBKO)-- --Two men facing charges in the disappearance and murder of Holly Bobo have been scheduled to appear in court this week.

Shayne Austin will be in court at 10 Tuesday morning. Prosecutors originally gave Austin immunity in exchange for his cooperation in the investigation. The Assistant District Attorney General recently voided that agreement after the state said Austin was not completely truthful and forthcoming.

Wednesday, Jason Autry will also be in court..

Autry was charged along with Zachary Adams with first degree-murder and especially aggravated kidnapping charges.

A judge has ruled that a lawsuit filed by a suspect offered immunity for his testimony against suspects in the disappearance and murder of Holly Bobo will be heard in circuit court.

Decatur County Chancellor Carma D. McGee ruled Tuesday that Shayne Austin's lawsuit against prosecutors over their plans to revoke his immunity agreement should be heard in circuit court.

According to Austin's attorney, prosecutors are trying to indict Austin even though they say he's held up his end of the deal.

"Where is the case? There is no pending criminal case. There is not a criminal case against Shayne Kyle Austin," said Luke Evans during court.

The state was seeking to have the lawsuit dismissed.

News that the state was seeking to revoke the offer of immunity of Austin, 29, was learned on the same day that authorities announced the indictment of Jason Wayne Autry, 39, for kidnapping and the murder of Bobo.

DECATURVILLE — A judge ruled today that Decatur County Chancery Court does not have jurisdiction over a lawsuit that claims state prosecutors violated an immunity agreement in the criminal case surrounding the kidnapping and killing of Holly Bobo.

Assistant District Attorney General Scott Sutherland and Luke Evans, the attorney for Shayne Austin, argued in Chancery Court today as to whether the court had the jurisdiction to rule on an immunity contract violation involving a criminal case.
obo was abducted from her home in Darden in April 2011. Her body has not been found, but in the past three months the Tennessee Bureau of Investigation has charged two men with her murder and kidnapping. According to court records obtained by The Jackson Sun, prosecutors told Evans they planned to also indict Austin, who previously had been granted immunity in exchange for his cooperation in the Bobo investigation.

According to documents filed in Decatur County Chancery Court, Austin received immunity in the Bobo investigation in an agreement signed on March 6. The documents say Austin was given immunity from any criminal charges arising from the Bobo case. In the lawsuit, Evans was seeking a restraining order and temporary injunction to keep prosecutors from indicting Austin.

At one point during today’s hearing, Holly Bobo’s mother, Karen Bobo, approached the benches were the media were sitting.

“I want to remind people not to forget about Holly’s rights and justice for Holly and to ignore the sideshow the attorneys are having about (their clients’) rights,” she said.

During the hearing, Sutherland argued, “This court does have jurisdiction over a breach of contract, but not in a criminal case. The end result of those charges is for another day, another court.”

Evans, on the other hand, argued that the Chancery Court is the only place Austin had to file his grievance because Austin has not yet been criminally charged.

“The state bargained for a benefit. Mr. Shayne Austin bargained for a benefit,” Evans said. “Immunity agreements are great things. They help effectuate justice.”

DECATURVILLE, Tenn. (FOX13) - A motion for gag order has been sent to Jason Autry's attorney in the Holly Bobo case.

The Decatur County District Attorney's Office has requested that the court issue a gag order preventing all trial participants from speaking with the media.

The move comes after a news station in Nashville was able to sneak a camera into the Tennessee Department of Corrections for an interview with Autrey.

I remember it. 

Don't have time to look now, but it seems like it may have been stated later that the video was not actually from that day?  I could be wrong, but it seems like I remember something about that.  It was after the Bobo family had that investigative group come in and they did those shows about the case, and then the TBI spoke out against them later iirc?

What the heck is going on with Autry? Where is his attorney and what is he doing?  Is he advising Autry?  Is Autry listening and taking his advice?  Where did this note come from? 

According to the tweets, Autry tried to pass a note to the media before it was confiscated. 

Why in the world is Autry making any comments to the media?  In Sarah's tweet above, she says she asked him where Holly was and he said "good question".  He should just be quiet.  Again, jmho.

DECATURVILLE — An attorney who represents Jason Autry said Autry is “bewildered” as to how he came to be charged in the abduction and killing of Holly Bobo.

Autry, who is charged with first-degree murder and aggravated kidnapping, is scheduled to be in Decatur County Circuit Court at 1 p.m. today.

The hearing is expected to be an update for Autry to inform the court that he has obtained lawyers.

Autry was indicted on the charges on April 29. A second suspect, Zachary Adams, was indicted on the same charges on March 5.

Attorney John Herbison, of Clarksville, said he will represent Autry along with attorney Fletcher Long, also of Clarksville, and attorney Mike Flanagan, of Nashville.

Herbison told reporters Tuesday that he expected today’s hearing to be straightforward, with the main proceeding being that the attorneys will present themselves to Judge Charles Creed McGinley as Autry’s counsel of record.

He said that once the court recognizes the attorneys as Autry’s counsel, they will proceed to other matters involving Autry’s defense. Autry is currently serving a 100-month sentence after he was convicted in August 2012 of aggravated assault on an officer and was in possession of a firearm.

Prosecutors request gag order in Holly Bobo case

As part of a gag order motion filed in Decatur County Criminal Court, prosecutors are seeking to keep Jason Autry or anyone else involved in the case from speaking about the case to ensure the suspect receives a fair trail.

Autry was indicted by a grand jury in the alleged kidnapping and murder of Holly Bobo on April 29. He will be in court on Wednesday as part of a previously scheduled hearing.

If the gag order motion is allowed, all parties involved in the case would be held in contempt if they commented outside of court about the case or its documents or evidence.

The motion comes a week after an interview with the suspect aired on WTVF NewsChannel 5. In the interview, Autry discussed his relationship with other suspects in the case and with Bobo, who disappeared from her family’s Parsons home in April 2011.

Prosecutors allege that the news station violated Tennessee Department of Correction policy when it interviewed Autry through a video conferencing system that should have only been used for Davidson County attorneys to talk with their clients in prison.

Autrey’s attorney Fletcher Long requested use of the videoconferencing system and then told a Department of Correction worker that he needed a “ ‘private’ cameraman to record sessions with his client.”

“When Fletcher Long showed up for the meeting, he used deception to allow Channel 5 News, both a reporter and cameraman, to enter the video room for the purposes of an interview,” the filing said.

Prosecutors allege WTVF violated TDOC policy by securing the interview in that way. Corrections officials later told the news station about this and asked them not to air the interview, the filing said.

Holly Bobo Murder Suspect Jason Autry In Decatur County Court Tuesday

DECATUR COUNTY, Tenn. – One of the two men charged in the murder and kidnapping of Holly Bobo has been scheduled to be in court Wednesday afternoon.

Jason Autry’s attorneys have filed several motions in connection with the case, including one that claims Riverbend Maximum Security Prison is hindering Autry's right to a legal defense. Fletcher Long complained that Riverbend has not allowed him face-to-face, private meetings with Autry, who is in segregation.

Another issue that could be addressed is a gag order that prosecutors are seeking in the case. Prosecutors filed the motion Tuesday in response to a NewsChannel 5 exclusive interview with Autry.

The state objected to the broad content of that interview and claimed the comments made by Autry and his attorney, Fletcher Long, could intentionally or unintentionally pose a substantial likelihood of prejudicing a fair trial because of the publicity.

Attorney General Beth Boswell claimed Long inappropriately allowed NewChannel 5 to interview his client while he was being held in segregation at Riverbend Maximum Security Prison.

Inmates in segregation are not allowed to do interviews in the prison. Our interview was conducted by way of video conferencing.

The NewsChannel 5 crew was not at the prison.

Fletcher Long said he did nothing wrong. He said it's his decision how best to defend his client, and if an interview with him in the prison was prohibited he sought other options – either by telephone or, in this case, by video conferencing.

The court hearing is set to start at 1 p.m. Wednesday in Decatur County.

Autry and Zachary Adams have been charged with aggravated kidnapping and murder in connection with Holly Bobo’s death. Autry said in his exclusive interview that he was innocent and had no involvement in Bobo’s kidnapping or death.

On Tuesday, another hearing was held in chancery court to discuss a dispute over an immunity agreement for Shayne Austin, another man said to be involved in the case.

Decatur County Chancery Court Judge Carma D. McGee decided Tuesday that only a criminal court can decide whether prosecutors can revoke an immunity agreement reached with Austin.

A March 6 agreement granted Austin immunity from various charges, including "all charges arising out of the disposal, destruction, burial, and/or concealment of Holly Bobo's deceased body."

Prosecutors later revoked the agreement, saying Austin wasn't truthful with them. Austin's lawyer then sued in chancery court for breach of contract.

DECATUR COUNTY, Tenn. – A Decatur County judge has declined to issue a gag order in the case against one of the two men charged in the murder and kidnapping of Holly Bobo.

Circuit Court Judge Charles Creed McGinley said Wednesday he would not be issuing the order "at this time" in the case of 39-year-old Jason Autry.

A gag order would bar those involved in the case from speaking publicly about it. McGinley said he has not granted a gag order in 26 years as a judge. However, the judge also advised the defendant to "exercise his right to remain silent."

The request was filed by prosecutors after Autry gave an exclusive interview to NewsChannel 5 from jail. McGinley advised everyone involved in the case to "try the case in the court and not in the media."

Investigators said a key witness -- thought to be Zach Adams' younger brother Dylan -- reported seeing Bobo alive in Zach's home after she disappeared and that she was there with Zach and Autry.

Autry said Dylan, who is in jail on gun charges, lied to investigators.

"He's been lying his way all this time. You know he got himself in a little trouble and he's down there in Obion County and he don't want to do his time and he's making stuff up to get out of it," Autry stated.

Autry said Dylan can't stand his brother.

"They hate each other's guts and that's a way to get back at him," added Autry, who said he and Zach are friends.

"Me and Zach go back several years you know. On and off," said Autry. "He'd come around. Me and him smoked, drank a little bit, did some dope and hung out together. Zach didn't have a whole lot of friends."

Autrey conceded he and Zach had several run-ins with the law over the years. And, Autry said while he was serving time on one arrest in 2012 TBI agents paid him the first of many visits to press him on the Bobo case.

"It was a try to be a forced move to get me to be a false witness against Zach Adams," said Autry.

But Autry said he told the TBI he knew nothing -- no link between Adams and Bobo. If he did, Autry insisted he would have taken the TBI up on their offer of reduced jail time and the reward money.

"I would have taken five years and $280,000 for my freedom. If I knew, I would tell them,"  Autry concluded.

"I don't think they have any idea who committed a crime or that a crime was committed at all," said Autry's attorney Fletcher Long. 

Long wonders if the TBI has anything other than an informant's word as evidence against his client. No body has been recovered in the Bobo case.

"I think first you have to prove there is a killer and that she is dead," said Long

"Jason Autry has been in trouble with the law before," said his attorney Fletcher Long.

But he said there is nothing to link Autry to Bobo's disappearance, much less murder. The TBI has looked, but has yet to find a body.

"You can prosecute without a body, but you better have some pretty convincing circumstantial evidence on death and I don't think they have that here," said Long.

Even if the TBI does have some physical evidence -- perhaps bone fragments or clothing -- it may not matter for Autry.

 Long dropped this bombshell: "We may have a strong alibi defense."

Long has indicated that Autry will be able to prove he was far away -- in another county -- when the TBI issued the alert for Holly Bobo.

The TBI has declined to comment on what Autry has said about the investigation.

DECATURVILLE — Judge Charles Creed McGinley ruled today that there will be no gag order in the cases involving two men charged with the first-degree murder and aggravated kidnapping of Decatur County woman Holly Bobo.

State prosecutors made a motion requesting the gag order on Tuesday.

McGinley announced his decision today during a status update hearing for defendant Jason Autry, who faces the murder and kidnapping charges along with Holladay resident Zachary Rye Adams.

McGinley acknowledged the state’s motion for a gag order and said that he will not grant one at this time.

Assistant District Attorney General Beth Hall argued that Jason Autry’s interview with a Nashville television station and his effort to pass a note to news reporters standing outside the courtroom before today’s hearing were examples of how Autry’s efforts to contact the media could unfairly influence the outcome of a trial.

McGinley said that it would be a rare decision for him to issue such a gag order.

The motion filed by prosecutors Tuesday requested the court to order “all trial participants, including lawyers, parties, and witnesses, to refrain from commenting about this trial as those comments, whether intentionally or unintentionally, pose a substantial likelihood of prejudicing a fair trial because of the publicity of the proceedings.”

McGinley said that he would not grant the gag order, but that it “behooves everyone involved to try the case in court and not in the media.”

During Autry’s last court appearance, McGinley asked whether Autry had obtained an attorney. Autry said he might need two months.

McGinley said that shortly afterward a motion was filed notifying the court that Autry had obtained John Herbison, of Clarksville, Fletcher Long, of Clarksville, and Mike Flanagan, of Nashville, as his counsel.

McGinley repeated again in court today that he intended to keep the proceedings involving Autry and Adams moving as quickly as possible while maintaining fairness to both sides.

A request by Autry’s attorneys asking if they could have face-to-face meetings with their client, who is in segregation at Riverbend Maximum Security Institution in Nashville, was also denied despite the lawyers stating they could only speak to the 39-year-old through his cell door, making it difficult to communicate in a confidential manner.

Janet, let's be clear & not get it twisted... Autry has NOT been denied contact with his attorney whatsoever, rather there has been legal use of restriction as to how they communicate which is done in many instances, in many states.  Interestingly, while they complain that they cannot communicate without a glass partition between, they still managed to arrange for Autry to do an extremely ill-advised media interview while in jail facing felony charges.  As evidenced, Autry & his attorney are trying to create a circus to divert attention from his involvement (be it complicity/conspiring after the fact or an actual participating act) in the abduction/murder of Holly.  This is a completely transparent attempt to point a finger at law enforcement and/or prosecution in the hope it will work in the defendant's favor...meanwhile, the more they act like fools, the more guilty Autry looks.  Autry trying to pass a note to the media before his court appearance, only proves this point & also exhibits the total lack of respect they have for the justice system & the victim in this case.   This attorney representing Autry is an embarrassment to the profession & is bordering, if not already committed misconduct.  Also, in regards to the immunity revocation, the State contends they do indeed have legitimate cause that would allow his immunity agreement to be revoked which will be determined by a circuit court.  It is rather obvious that the State would not seek to revoke his immunity without cause.

I don't know enough to have an opinion of whether he's guilty or not, but I'm not really feeling any sympathy for Autry here.  If I understand correctly he was already serving time in this prison before the charges against him in Holly's case.  Wondering if his attorney/client privileges in the prison were any different with his prior case/attorney?  Has he always been in segregation, or did his status change in any way with the charges in Holly's case?

This isn't his first time around the block.  He knows the rules.

And whining to the judge about his handcuffs...when he was there being charged with murder; just wasn't impressive.

This past week, Long complained that Riverbend has not allowed him face-to-face, private meetings with Autry, who is in segregation.

"We are either interviewing him at his cell or through very thick glass through which I'm not able to hear," Long stated.

The Tennessee Department of Corrections issued a response last week which reads in part: "The presence of a glass barrier does not infringe upon attorney client privilege... Fletcher Long has not been denied or otherwise had access to his client limited. TDOC will continue to apply it's policies..."

"Well, I think that's disingenuous," said Long, who added that Riverbend does not provide private meetings away from guards and other inmates.

"If I can't get access to my client I will ask the court to dismiss the indictment for him being denied effective assistance of counsel," Long concluded.

 The state response also read: "Mr. Long was granted a video conference with his client, but, unfortunately, Mr. Long chose to squander his time when he circumvented TDOC policy by allowing a member of the media to conduct an unapproved interview with an inmate."

This referred to him allowing NewsChannel 5 to interview Autry.

"That's my call. That's not Riverbend's call," said Long, who granted the interview so Autry could have his say.

"I think it's fair that if the TBI can have a press conference to call him guilty, then it's fair for him to try the case with public just as they have done," said Long

Judge denies request for gag order in Holly Bobo case, sets scheduling order for Jason Autry's trial

“I am fully cognizant that there is voluminous discovery that is out of the ordinary for a criminal case,” he said. “So I have made a scheduling order that is a bit more liberal than I would normally use.”

McGinley said he wanted the prosecution to furnish both defendants in the case with discovery — the prosecution’s evidence against them — in 90 days. After which, he said, the defense would have 60 days to make pretrial motions, to which the state would then have 30 more days to respond.

He said there would then be 30 days for judicial review.

If a plea agreement is not reached by Jan. 14, then a trial date will be set.

McGinley said that he encourages a rush put on all forensic evidence that is outstanding. He said he has seen previous cases hampered when forensic evidence was not received in an expedient fashion.

McGinley said he expects to issue an identical scheduling order for Adams during Adams’ status update hearing on June 4, although the defendants will currently be tried separately.

The judge said he would have to issue a decision if a request were made to join the two trials together.

McGinley said that after a three-year investigation it appears the prosecution has “mountains of materials.”

The prosecution said the defense is providing the state with several external hard drives on which to place much of the discovery materials that have been recorded in a digital format.

Autry’s defense also requested a bill of particulars that would state the charges against Autry more specifically than what criminal offenses were outlined in the indictment. The judge said this would be granted as well.

Autry’s defense attorneys also requested that the judge grant them “unfettered” access to Autry, as most recently the attorneys have only been able to talk to Autry through a glass window. Autry is currently serving a prison sentence on unrelated charges.

Hall argued that the means by which the attorneys have been able to access Autry are in accordance with state corrections department standards. McGinley said that he has a problem with the word “unfettered” and urged the attorneys to come to an agreement on a means for Autry’s defense to communicate with him that would comply with state regulations and work.

Toward the end of the hearing, Flanagan requested that at some point in the near future the prosecution give some notice of what punishment they would request for Autry. Hall said the state had talked with an attorney, and mentioned the death penalty.

When this was mentioned, Autry pursed his lips, turned his head, looked back at his mother Shirley King and winked.

DECATURVILLE, Tenn -- Jason Autry, one of the men linked to kidnapping and killing Holly Bobo, appeared before a judge for a status hearing, Wednesday.

On his way into the courtroom, Autry tossed a small white piece of paper to the ground, saying he has a message for the media. The police quickly confiscated it.

Once Autry arrived in the courtroom, Judge Creed McGinley advised Autry not to pull an act like that again.

"I suggest to defendant that he has afforded many constitutional rights, one of which is a right to remain silent," Judge McGinley said.

"Perhaps if we could meet with him face to face and he could pass us papers personally he wouldn't be dropping them on the ground outside court appearances," Fletcher Long, Autry's attorney, said.

Long asked Judge McGinley for a chance to meet with his client face to face, which was denied.

The judge discussed future hearings before his trial begins in December. He also told the courtroom he knows of "mountains of materials" obtained from Autry in the state lab being DNA tested.

I am troubled by this TDOC policy regarding ANY segregated prisoner and his/her defence attorney not being afforded the right to a "face to face" to assure confidentiality.  However ... Tennessee law upholds this policy or there would have been a different ruling yesterday in regards to the challenge by the attorney of Jason Autry.

If a client is housed in a local jail, it is best not to discuss anything of substance when the client calls. Instead, make plans to update them in person.

If a personal visit is not possible, other means to preserve the privilege in a phone call may exist, but they are not foolproof. For example, some larger jurisdictions have the capacity to block recording of attorneys’ phone numbers. In order to achieve a privileged call, check with the chief jailer and confirm in writing that calls to your phone number are privileged. Even then, it is not the best option. Some “solutions” are that the calls are still recorded, but segregated and supposedly not reviewed. So if you can visit, you should.

Many Nashville attorneys were recently surprised to learn that the recordings of calls between their firms and their clients had been turned over in discovery in a federal prosecution.[4] This happened despite a written policy against listening to privileged communications.[5]

Many times, it is very difficult to tell whether a call is privileged. It has often been held that the client knows a call is not privileged because there is a recording at the beginning of the call saying it is subject to monitoring. The problem for lawyers is that we do not hear that portion of the call. For years, many of us have assumed that calls to lawyers are privileged and not monitored. Unfortunately, that is not necessarily the case.

What is there to be "troubled" about?  Autry is already serving time in prison for crimes he's been convicted of.  Autry is also illustrating that he acts out & is unwilling to respect rules time after time.  There are reasons prisoners are segregated, not the least of which is mainly for safety precautions.  There is no doubt in my mind that given an opportunity Autry or someone like him would strike out or attempt to break out judging by his behavior in his recent court appearances & criminal history.   You are talking about convicted felons, not upstanding citizens here, so quite frankly this woman has no sympathy whatsoever for them....I doubt highly too many disagree with my sentiments either.

The former boyfriend of the missing Holly Bobo has been arrested in Decatur County.

Authorities said Blake Barnett was arrested early Thursday morning on charges of domestic assault and kidnapping.

Details about the charges are not available.

A spokesman for the Tennessee Bureau of Investigation said Barnett's arrest was not related to Bobo's disappearance in April 2011.

A Bobo family friend told Channel 4 News that Bobo and Barnett broke up before the nursing student disappeared and the split was not amicable.

(WMC) - The ex-boyfriend of a missing Tenn. nursing student, who has been at the center of a murder investigation, has been arrested.

The Decatur County Sheriff's Department booked Blake Aaron Barnett into jail on one count of domestic related assault and one count of kidnapping.

Bobo disappeared from her Darden home in 2011. Zachary Adams and Jason Autry are charged with especially aggravated kidnapping and first-degree felony murder in her disappearance.

Sources tell WMC Action News 5 Barnett is Bobo's ex-boyfriend.

According to the TBI, Barnett's arrest has nothing to do with the Holly Bobo case. The TBI says Barnett's arrest is not their investigation.

Long talked about accusations by the prosecution that defense lawyers were deceptive in setting up a interview between Autry and News Channel 5 of Nashville.

According to a motion for a gag order filed by the prosecution, Long used an iPad in the Riverbend Maximum Security Institution to set up a video interview with the television station.

“(The Defendant’s attorneys) requested to enter the facility with an iPad to take notes during an interview,” the motion said. “As the Court is aware, an iPad can be used as a medium to connect an inmate with unauthorized persons other than legal counsel. The attorneys were instructed that electronics are not allowed to be brought into TDOC facilities.”

Long said he and other members of Autry’s defense team acted reasonably and within their rights as his attorneys.

“I feel like that if I want to have my client on camera to gauge how he answers questions, what affect he adopts when answering questions, to kind of simulate the pressure that is gleaned from being interviewed by (the media), I think … that that’s our call,” he said.

Zachary Adams' attorney asks for jail visitation, phone privileges for suspect in Holly Bobo case
June 4, 2014

DECATURVILLE — The attorney for Zachary Adams, one of the men accused of kidnapping and killing Holly Bobo, has filed a motion in Circuit Court for the judge to consider granting Adams “standard access to jail visitation” including jail telephone privileges, and access to pencil, paper, postage and “basic mail services.”

Adams is currently in custody at the Chester County Jail.

He’s due back in Decatur County Court today at 1 p.m. for a status hearing in the case.

The motion, which was filed today, said Adams has only limited access to the front desk telephone to talk to his attorney. Adams has only been able to visit with family at the request of his attorney, Jennifer Lynn Thompson.

Chester County Sheriff Blair Weaver said, according to the motion, that Adams has been held under the rules of the Tennessee Bureau of Investigation, which has been investigating Bobo’s disappearance since she went missing in April 2011.

A motion has also been filed by Thompson requesting the state to provide her and Adams with any discovery of evidence that the state intends to use during his criminal trial.

Thompson has also filed an order asking that the court “partially unseal all sealed materials in the court file, including search warrants, affidavits in support of search warrants, and filed copies of executed search warrants so as to allow Ms. Thompson to review and copy the items.”

According to the order, the court found that Thompson does need access to those items.

All the items requested by Thompson were unsealed for only her viewing.

DECATUR COUNTY, TN - (WMC) - Zachary Adams, one of the men charged in Holly Bobo's disappearance and murder, appeared in front of a judge Wednesday afternoon in Decatur County.

At a previous hearing, Decatur County Judge Charles Creed McGinley said he will not take up anything that has to do with Adams' case without him being present in court.

At the last hearing,  Jennifer Lynn Thompson, Adam's defense attorney, asked for her client to have paper and pencil in jail and even asked that Adams be transferred to a facility that allows such resources, so that he can write down his thoughts as she prepares his defense. That request was not taken up during Wednesday's hearing.

The hearing served as a type of status hearing to see where the prosecution and defense are at when it comes to sharing evidence collected during the investigation with one another.

"I've been fairly liberal in this order because I'm aware that there's a lot of discovery to take place. This is a case of unusual complexity because of the length of time that the investigation has gone on," said Judge McGinley.

Like at the last hearing, the judge emphasized that he wants to keep this case moving forward. He also added that he does not want to see Adams be treated any differently than other inmates at Chester County Jail.

"What I don't want, is simply because of the nature of this charge [coercion of a witness] for him to be treated differently than any other person at that holding facility [Chester County Jail]," added McGinley.
Zachary Adams and Jason Autry, who are longtime friends, are both charged with especially aggravated kidnapping and first-degree felony murder. Adams faces an additional charge of coercion of a witness. He pleaded not guilty to the charges against him.

Jason Autry to be in court tomorrow in Holly Bobo case

According to attorney John Herbison, of Clarksville, he will represent Autry along with attorney Fletcher Long, also of Clarksville, and attorney Mike Flannigan, of Nashville.

Herbison told reporters in court Tuesday that he expected the hearing to be straightforward, with the main proceeding being that the attorneys will present themselves to Judge Charles Creed McGinley as Autry's counsel of record.

He said that once the court recognizes the attorneys as Autry's counsel, they will proceed to other matters involving Autry's defense.

"We have not been permitted personal visitation," Herbison said. "We have been able to talk with (Austry) through a glass window with a guard present."

Herbison said that as of now, Autry and Zach Adams have been charged separately, and Autry's defense team hopes to keep it this way.

"Consolidation would require a motion that the affected defendants would have an opportunity to respond to," he said. "We would resist consolidation."

Although, he said, this does not mean that useful information would not be shared between the defense attorneys representing Adams and Autry.

Herbison said Autry is "bewildered" as to how he came to be charged. Herbison said he and Autry's other defense attorneys plan to seek the prosecution's discovery materials against Autry as soon as possible.

During the appearance, the judge explained if Zachary Adams, 29, is offered a plea deal he must accept it before December, or go to trial or plead guilty to all charges. 

Adams also had his attorney file a motion that will allow him standard jail visitation, access to pencil and paper, postage and telephone privileges.

Adams' attorney Jennifer Thompson argued during his last court appearance that she was having difficulty building his defense case because Adams is in segregation without access to pencil, paper or consistent phone access.

The judge told state prosecutors Adams should be treated like any other defendant in the Chester County jail.

Also, Thompson has asked the state to turn over all the evidence they have against Adams.

The discovery motion is part of the typical process of defending a client.

The state has fought a portion of a motion asking them to unseal parts of the investigation because the prosecutors said the investigation is ongoing.

Judge Creed McGinley entered a scheduling order, which will lays out dates and deadlines for the case against Adams to proceed. It will be the same scheduling order he entered in the case against Adams' co-defendant, Jason Autry.

Both men are charged with first degree murder and especially aggravated kidnapping in Bobo's April 2011 disappearance.

Also, the defense request for privileges is no different than Autry...the judge made it clear that the jail rules apply as to what they can and cannot do under the terms of their imprisonment

I noticed a page or two back that the defense in their motion wants the mental health records of witnesses...seems to me they should be more concerned with the fact they are defending scum.    Nothing for nothing, if a defendant's medical records are sealed than it should be no different for a witness.   I mention this because if I read that right, then we can see where this defense is going (deflection & attacking witnesses)

I was busy today so I didnt see the hearing but I will be watching the playback

Judge Creed McGinley said during the status hearing he did not want Adams, 28, to be treated any differently in the Chester County Jail than other inmates.

This comes after Adams' attorney asks that Adams be taken out of solitary confinement.

Chester County Sheriff Blair Weaver, who is in charge of Adams' housing at the jail, says Adams will stay in solitary confinement unless ordered otherwise.

DECATURVILLE — Judge Charles Creed McGinley said Wednesday that he expects Zachary Adams to be treated like any other inmate in the Chester County Jail.

Adams, who was not wearing a bullet-proof vest as he had for other hearings, was in Decatur County Circuit Court for a status hearing Wednesday.

The judge also heard motions filed by Adams’ attorney, Jennifer Lynn Thompson, who asked for the judge to consider granting Adams “standard access to jail visitation” including jail telephone privileges, and access to a pencil, paper, postage and “basic mail services.”

The motion said Adams has had only limited access to the front desk telephone to talk to his attorney. Adams, who is being held without bond, also has only been able to visit with family at the request of his attorney, Thompson said in her motion.

Chester County Sheriff Blair Weaver said, according to the motion, that Adams has been held under the rules of the Tennessee Bureau of Investigation, which has been investigating Bobo’s disappearance since she was abducted in April 2011.

“I don’t want him treated any differently,” McGinley said during Wednesday’s hearing.

Prosecutors argued that Adams should not have the requested privileges in part because he has been charged with trying to coerce a witness in the case. Prosecutors allege Adams communicated a message to his brother to keep quiet about the Bobo case or “he will be in the hole beside her.”

Josh DeVine, spokesman for the TBI, said, “The District Attorney’s office requested, through TBI, that the sheriff not allow phone or mail privileges (for Adams).”

McGinley clarified after the hearing that he didn’t rule one way or another, just that Adams should be treated the same as the other inmates in regard to phone, visitation and other privileges.

“I don’t know what the rules are” at the Chester County Jail, McGinley said. “He just needs to be treated like any other inmate.”

Weaver could not be reached for comment Wednesday.

Adams has been placed in solitary confinement since his arrest. Weaver previously said this was to ensure Adams’ own safety.

The judge also ruled that Adams’ attorney will no longer be required to be present when his family visits him at the jail.

Thompson explained after court that being present for every visit is not only a burden for her, but if any comments were made that could incriminate Adams, she would then have to be a witness and couldn’t be his attorney, too.

Thompson also filed motions asking McGinley to make prosecutors give her any favorable evidence that pertains to her client’s guilt or innocence, including witness statements and search warrants. Thompson also wants the state to tell her what punishment may be imposed if Adams is found guilty at trial. Prosecutors have not ruled out the death penalty.

Prosecutor Beth Boswell said she is working to assemble the evidence, and she will disclose all that she must under the law.

Schedule
McGinley set a case schedule for Adams on Wednesday.

The same schedule was given last week to Jason Autry, 39, who is also charged with aggravated kidnapping and felony first-degree murder in Bobo’s disappearance. Autry also has pleaded not guilty.

McGinley reminded the court that Adams and Autry are not co-defendants and will be tried separately, as of now.

McGinley said he wanted the prosecution to give both defendants the prosecution’s evidence within 90 days.

The defense will then have 60 days to make pretrial motions, and the state will have 30 more days to respond.

He said there will then be 30 days for judicial review.

McGinley said this is a longer schedule than normal due to the “unusual complexity” and length of the investigation.

McGinley also told prosecutors not to wait until the end of a court-ordered 90-day period to hand over evidence they have already gathered.

Prosecutors and the TBI has released few details about their investigation. Bobo’s body has not been found, but TBI investigators have said they believe Adams and Autry were involved in kidnapping and killing her. The TBI has said it has witnesses who saw Bobo alive with the two men after she was abducted from outside her home in Darden.

Authorities Not Commenting On Possible New Holly Bobo Evidence

LEXINGTON, Tenn. - Officials with the Tennessee Bureau of Investigation are not commenting on the possible existence of a video that could possible be connected to the kidnapping of nursing student Holly Bobo.

Court documents obtained by NewsChannel 5 from Henderson County showed that on May 29, Jeffrey Kurt Pearcy was arrested and charged with Tampering with Evidence and Accessory After the Fact.

The affidavit said that Jeffrey Pearcy has a video on an electronic device, "that will prove to be beneficial in the prosecution of a current on-going investigation being conducted by the Tennessee Bureau of Investigation."

On Monday, Officials would not say to which case that video was connected.

Jeffrey Kurt Pearcy was currently being held in Henderson County without bond.

NewsChannel 5 also obtained court documents from Decatur County, which suggested another man, Mark Lynn Pearcy, may have also appeared in that video.

Mark Pearcy was arrested on May 29 and also charged with Accessory After the Fact and Tampering with evidence. Those documents showed that, according to a witness, Mark Pearcy was identified as being in that video when it was recorded but officials will not comment on the content of the video.

The Tennessee Bureau of Investigation has said two more men have been arrested and charged as accessories in connection with the kidnapping and murder of Holly Bobo.

The brothers were arrested on May 29.

Mark Pearcy and Jeffrey Kurt Pearcy have been charged with tampering with evidence and accessory after the fact, according to TBI spokesperson Josh DeVine.

DeVine wouldn’t comment further on what the evidence is or the circumstances around the charges.

Investigators believe that Jeffrey Pearcy has possession or has knowledge of where the video is, according to the affidavit.

The affidavit states that Jeffrey Pearcy is an “accessory after the fact due to his conduct concerning the concealment of evidence into the investigation.”

Tampering with evidence is a Class C Felony and accessory after the fact is a Class E Felony.

Jeffrey Pearcy, 42, is currently being held in Henderson County without bond.

Mark Pearcy was transferred from Decatur County to Carroll County last week and is also being held without bond.

Mark Pearcy is not being represented by Baker.

According to online records, Mark Pearcy registered as a sex offender in 2000 for statutory rape.

Both men are expected to be in court tomorrow morning for their arraignments.
