Her bond is already lower than it should be for someone accused of murder.  This one should've been put under a jail years ago.

Durham, N.C. — The Durham woman who falsely accused three Duke University lacrosse players of rape in 2006 will remain in jail while awaiting trial for murder.

Superior Court Judge Osmond Smith maintained Crystal Mangum's bond at $200,000 on Friday, declining a defense request to cut it in half.

Defense attorney Chris Shella told Smith that Mangum has been in jail for 11 months, and her family and friends could put together $100,000 for a bond to get her out.

”This is a case where there are two people alone in an apartment. No one sees what happens. My client is alleging self-defense,” Shella said.

Assistant Durham County District Attorney Charlene Coggins-Franks said authorities prefer Mangum not be allowed any bond, given her prior criminal history.

"She does have a history of domestic violence, your honor. She does have an assault history,” Coggins-Franks said.

Mangum was convicted in December 2010 on several charges stemming from a domestic dispute with a former boyfriend.

Durham, N.C. — Three motions in a pending murder case against the Durham woman who falsely accused three Duke University lacrosse players of rape in 2006 were filed Thursday without her knowledge or consent, her lawyer said.

The motions state that Mangum isn't happy with the work of her court-appointed lawyer, Chris Shella, and that she was filing them herself with the assistance of a supporter who isn't an attorney.

A dismissal motion alleges that Mangum was defending herself against a drunken Daye when the stabbing occurred. It also alleges that the stab wound didn't kill Daye, who died more than a week later at Duke University Hospital, suggesting instead that he suffered a heart attack in the hospital and was prematurely pulled off life support.

A second motion asks that Superior Court Judge Osmond Smith remove himself from the case, citing his involvement in the Duke lacrosse case and alleging that his rulings show bias against her.
In March 2006, Mangum claimed three white players on the lacrosse team trapped her inside a bathroom at 610 N. Buchanan Blvd., where she was performing as a stripper at a team party, and raped and sexually assaulted her.

Her story about the incident was so inconsistent that Attorney General Roy Cooper later declared the players innocent, saying there was no credible evidence against them.

A third motion is seeking to move the murder case from Durham County because the extensive coverage of the Duke lacrosse case makes it impossible to find an impartial jury.

Shella said Mangum didn't authorize the motions, and the supporter filed them on his own.

The North Carolina State Bar said its Authorized Practice Committee would look into whether the man overstepped his bounds by filing the motions on Mangum's behalf.

Agree...no wonder our youth is so messed up nowadays. Look at the parents and role models that they have to look up to..no self respect is shown by some so called parents...jmo
Kids are probably better off wherever they are, I hope anyways

DURHAM -- A judge denied a request to reduce accused murderer Crystal Mangum’s bail from $200,000 to $50,000 Tuesday.

Mangum, a 34-year-old mother of three, has been in jail for 17 months, charged with killing boyfriend Reginald Daye, 46. Police found Daye with a stab wound in the torso April 3, 2011, after a fight in the couple’s apartment.

Mangum, the woman who was at the center of the Duke University lacrosse scandal, was charged with murder after Daye died 10 days later.
Mangum’s attorney Woody Vann argued that his client’s bail was excessive because Mangum, a Durham native, isn’t a flight risk and she was defending herself against an intoxicated Daye.

Vann also said there are questions about whether Daye died as a result of his treatment at Duke Hospital.

“We contend a $50,000 bond is reasonable, is something she can make and allow her to go back to her children,” Vann said.

Assistant District Attorney Charlene Coggins-Franks, however, contended Mangum and Daye argued over two money orders she wouldn’t return to him, and that he eventually asked her to leave.

“When she would not leave, he decided to leave,” Coggins-Franks said. “As he was walking down toward the front door – that is when he gets stabbed by her.”

Coggins-Franks also argued that Mangum’s $200,000 bail is lower than Durham County’s guidelines, which recommend no bail on a murder charge and $600,000 on a second-degree murder charge.

Superior Court Judge Michael Morgan agreed, and noted that Mangum’s bond had already been reduced twice.

Meanwhile, Sidney Harr, a Mangum supporter, will once again be scrutinized by the N.C. State Bar for the unauthorized practice of law.

In July the State Bar’s Authorized Practice Committee asked the retired physician and co-founder of the Committee on Justice for Mike Nifong to refrain from drafting legal documents. Harr, who had drafted court filings for Mangum, said at the time he didn’t realize it was inappropriate and that he would stop.

DURHAM -- Crystal Mangum wants to represent herself on a 2011 charge that she murdered her boyfriend, according to documents and interviews.

Mangum attorney Woody Vann said he plans to file a motion to withdraw from the case after his client sent him a notice indicating that she wants to represent herself.

“It is never good for someone to represent themselves,” Vann said. “I hope that is something she will quickly realize, and if not me, get another attorney to take on her matter.”

Mangum, 34, is charged with murdering Reginald Daye, 46, who died at Duke University Hospital 10 days after Mangum stabbed him in April 2011. Mangum contends she stabbed Daye in self-defense.

Mangum gained national notoriety after accusing three Duke lacrosse players of rape in 2006. The charges were discredited in a high-profile saga that cost then Durham District Attorney Mike Nifong his law career.

Mangum advocate Sidney Harr said he thinks Mangum representing herself is a “wonderful idea.” Harr, who has received two letters from the N.C. State Bar warning him to refrain from practicing law, said Mangum made the decision to represent herself because Vann wouldn’t share documents with her pertaining to her case.

Vann said he doesn’t care what Harr thinks and the media should stop listening to him.

DURHAM – Crystal Mangum has informed her attorney, Woody Vann, that she wants to fire him and possibly represent herself during her first-degree murder trial.

Mangum is charged with killing Reginald Daye, 46, who was stabbed on April 3, 2011, and died 10 days later after he was removed from life support. Her supporters claim Daye died from a medical mistake when someone at Duke Hospital inserted a breathing tube incorrectly after Daye began choking on his own vomit during withdrawal from alcohol as he was recovering from the stab wound.

Mangum was in court last month with Vann when Vann argued that her bond should be reduced from $200,000 to $50,000, but the judge did not reduce Mangum’s bond.

Since then Mangum has decided she wants to fire Vann. She has been seeing Sidney Harr, who is not an attorney but has filed motions on her behalf. Harr sent Vann a letter from Mangum saying she wants to represent herself or maybe get other counsel, Vann said.

Vann said he doesn’t care one way or another if he represents her and said it is up to the court whether he will remain Mangum’s attorney. If someone receives a court-appointed lawyer, the person must get permission from the court to have the attorney removed from the case, he said.

“You can remove me or not,” he said. “I don’t care. I’m not going to lose sleep either way.”

Vann, who sounded exasperated during a telephone interview Monday, said he plans to file a motion to withdraw as Mangum’s counsel and it could be heard sometime next week.

Vann was initially appointed to be Mangum’s attorney, but then she requested that Chris Shella represent her. Shella later withdrew after she gave Harr some of the discovery that he had provided to her and Harr made it public. That’s when Vann was reappointed in June.

Each time Mangum changes attorneys, it further delays her case, Vann said.

DURHAM – After carefully questioning Crystal Mangum in Durham Superior Court Wednesday, a judge allowed her attorney to withdraw from the first-degree murder case after she said she wanted to serve as her own attorney.

After Woody Vann was removed as her attorney, she then said she would like an attorney to assist her with her case, and Superior Court Judge James Hardin appointed Vann to be that assistant.

Mangum is charged with first-degree murder, charged with killing her live-in boyfriend, Reginald Daye, 46. She allegedly stabbed him on April 3, 2011, during an argument at his apartment.

Mangum told Hardin her theory of the case and said that she and Vann disagreed on how to move forward. She wanted Vann to file a motion immediately asking for the murder charge to be dismissed based on what she called “the second autopsy.”

The second autopsy was not an autopsy at all but a review of the original autopsy report along with Daye’s medical records by a doctor hired by the defense.

Hardin said he did not want to hear about the case, only why she wanted Vann removed as her attorney, but Mangum insisted on telling him the background, saying that if everyone knows about “the second autopsy,” it would be better for the family and prosecutors and could save money for the court system by avoiding a trial.

“I would like to file a motion to dismiss the charges,” she said.

“I feel that Mr. Vann does not agree with me that all this should be addressed now rather than waiting for a trial,” Mangum said.

Mangum told Hardin she knew Vann was an experienced attorney.

With more than 30 years of experience, Hardin reminded Mangum.

“Of course he would naturally feel like he knows what he’s doing, but on this case, I disagree,” Mangum said.

Mangum also told Hardin that she had been offered a plea deal for assault with a deadly weapon in exchange for time served.

“As a result, I requested all the evidence to make an educated decision, and to this day I still haven’t received it,” Mangum said.

Assistant District Attorney Charlene Coggins-Franks later told Hardin that no one has offered Mangum a plea deal.

In deciding whether to remove Vann from his appointment as Mangum’s attorney, Hardin carefully questioned Mangum about her ability to serve as her own attorney.

She told him she had graduated from high school, college and had been in her third semester of graduate school studying clinical psychology.

Mangum assured Hardin that she knew that it would be up to her to follow proper legal procedures during court and that he wouldn’t be able to help her in any way during court proceedings.

Hardin told Mangum that what she was asking was extremely rare and in his experience when someone acted as his or her own attorney, it never turned out positively.

Mangum said she understood but said she heard that she could have a standby counsel to assist her. Hardin said he would appoint Vann if Vann was willing.

Vann said he would be willing to act as standby counsel.

“I’ve known her for several years, and our relationship is actually pretty good,” Vann said. “I have no objection in accepting that position as standby counsel.”

Mangum’s next court date is during the week of Nov. 13.

RALEIGH, N.C. — Crystal Mangum thought she was going to die when three people allegedly raped her at a March 13, 2006, party hosted by Duke lacrosse players.

"I genuinely believed I was going to die in there, but I did not want to," Mangum writes in her new book, "The Last Dance for Grace: The Crystal Mangum Story," which was released online Friday.
 ::snipping2::David Evans, Collin Finnerty and Reade Seligmann were indicted on rape and other charges on the basis of her allegations and eventually exonerated after North Carolina's attorney general dismissed the case, citing a lack of evidence.

Speaking publicly for the first time Thursday at a news conference to promote the book, Mangum said that she still believes she was attacked.

"Yes I am still claiming that a sexual assault happened," she said.

Interesting what may have been going on behind the scenes with regard to child custody in Crystal Mangum's case with the biological father of her children.  It looks there's even more dirt than originally thought in the Duke Lacrosse Case.   ::MonkeyNoNo::

DURHAM – A federal judge has given former Social Services Director Gerri Robinson a procedural victory in the civil-rights and whistleblower-protection lawsuit she filed against county officials over her ouster.

U.S. Magistrate Judge Patrick Auld turned aside a motion from county lawyers asking that he delay discovery – the trading of documents, depositions and other evidence in preparation for a trial.

County lawyers said a delay was merited because they’ve asked that the case be dismissed. But Auld said they filed the dismissal request after first signaling that they were willing to face Robinson’s allegations head-on.

Robinson headed Durham County’s Department of Social Services from the fall of 2009 to the summer of 2012, when she was abruptly fired by the DSS board.

She alleges that the move was retaliation for having reported to administrators and County Attorney Lowell Siler that former County Commissioner Joe Bowser was improperly meddling in department affairs.

Bowser’s alleged interventions targeted personnel and child-custody decisions.

She also says Bowser urged her to “intervene inappropriately” against an attempt by their biological father to gain custody of two of the children of murder suspect and Duke lacrosse accuser Crystal Mangum.

Robinson claims Bowser responded to her refusals to go along by orchestrating her dismissal from the director’s post.

Her firing came about after County Commissioners replaced a Robinson ally on the DSS board with a former DSS administrator, Gail Perry, who joined with Bowser and board Chairman Stan Holt to vote for the termination. Perry subsequently was named interim social services director.

County lawyers in asking for dismissal of the case have invoked governmental-immunity doctrine and said Robinson, in reporting Bowser, had not raised “a matter of public concern.”

DURHAM, N.C. (WTVD) -- A new trial date was set Tuesday in the Crystal Mangum murder case. The woman who once falsely accused Duke Lacrosse players of rape is charged with stabbing her boyfriend to death.

Mangum made a brief court appearance Tuesday morning. She's currently free on bond and now set to go to trial November 12.

The date was pushed back from July to give Mangum's latest attorney time to review the case. Mangum has gone through two other attorneys - who both asked to be removed from the case - and even represented herself for a time.

Mangum is charged with stabbing Reginald Daye with a kitchen knife during an argument in April 2011. Daye died ten days later. Mangum claims it was all in self defense - and that a medical error is blamed for Daye's death.

Durham attorney Scott Holmes now has four months to prepare her defense. She's charged with first-degree murder, assault with a deadly weapon, and larceny.

Killed was 46-year-old Reginald Daye, who was stabbed on April 3, 2011. He died of complications 10 days later.

Mangum claimed the stabbing was a case of self-defense, saying Daye was beating her in a jealous rage when she grabbed a knife and "poked him in the side."

Assistant District Attorney Charlene Franks told the jurors during closing arguments that the evidence did not back up Mangum's story.

34 year old Crystal Mangum was found guilty of second degree murder by a jury on Friday in the stabbing death of her boyfriend, Reginald Daye. Mangum stabbed her boyfriend, Reginald Daye on April 3, 2011, in which 10 days  later died from complications. Mangum claimed the stabbing was a case of self-defense; however, the jury did not believe her. She was sentenced to between 14 years and 18 years in prison. It is simply amazing how some people seem to just not be able to stay out of trouble.

DURHAM, N.C. — Crystal Mangum, most widely known as the woman who falsely accused three Duke University lacrosse players of rape, is appealing her conviction of second-degree murder in the stabbing death of her boyfriend.

In a Dec. 29 court filing, a lawyer for Mangum says the judge should not have allowed the jury to hear evidence about a February 2010 attack on another man, claiming it tainted the trial. Attorney Ann Petersen is asking the court to reverse the conviction and allow her client to have a new trial.

Mangum claims the April 2011 stabbing of her boyfriend, 46-year-old Reginald Daye, was a case of self-defense, saying Daye was beating her in a jealous rage when she grabbed a knife and "poked him in the side." Daye died 10 days later of complications at Duke University Hospital.

A seven-man, five-woman jury found Mangum, 34, guilty of second-degree murder on Nov. 22, 2013. Superior Court Judge Paul Ridgeway sentenced her to nearly 18 years in prison.
