46 year old Dawna Natzka has been missing since December 21, 2011. She was last seen leaving a Christmas party in Hot Springs Village, Arkansas where she worked as a police dispatcher. Dawna is described as 5’6″ with brown hair with blonde highlights and brown eyes.

Her vehicle, a 1997 teal green Ford Escort Wagon, was found burned  abandoned in the Ouachita National Forest off Ark. Highway 298. However, the mother of three is still missing. The fact that her vehicle was found burned cannot be a good sign. Usually this is done as an effort to hide evidence.

It's a good 20 minute drive from Hot Springs Village, six miles down Highway 298 and onto a rough patch of puddles and ruts before you reach the tree canopy-covered road where Dawna Natzke's charred car was discovered Sunday. Since then, people across Garland County gathered together to search the Ouachita National Forest, the area surrounding the vehicle burn site. "There's a lot of people out there who want to help her," said Natzke's best friend Patty Hathaway. Hathaway last saw her best friend for the last time as Natzke left a Village Chirstmas party around 10:30 p.m. on December 21, 2011. "She doesn't leave without giving hugs. She loves people," Hathaway said. But Natzke did that night, with her boyfriend. We spoke with him, but he declined to go on camera, only saying Natzke dropped him off at home, saying she planned to return to the party. But she never arrived. "There's no way she would just go off to get away," Hathaway said. "I know that. There's no way she would have left her mother there without a ride home." For those who know 46-year-old Dawna Natzke, it all just doesn't fit. She's a mother to three boys. "She has three wonderful grown boys. They're football players. And they worship her," Dawna's mother Doris Smith said. "It's so unlike her to leave them, over Christmas. I mean, she wouldn't do that." She worked as a dispatcher for the Hot Springs Village Police Department. "She was very dedicated to her job. She wouldn't just not show up, unless she had called ahead for vacation days, which she rarely did," Smith added. She was not the type of person to make plans but fail to follow through. "She would drive 20 minutes clear across the Village to make sure I was all right," Smith said. "I talked to her nearly every day, saw her just about every other." "She would just call, text, and drop by my work all the time. She worried about me," Hathaway said. "I miss her already, and I can't imagine life without her." "When she turned up missing it was just amazing because it was so unlike her. She's so dependable," Smith said. It's been about 144 hours, six days, and questions continue to torment those closest to her. Why did this happen? Where has she been? What's her condition? "We want her home. I want her home with her boys. I want to quit imagining where she is," Smith said. There are questions KARK continues to have for Village police as well. For two straight days, the point of contact for media at the department has failed to return our calls. So, here are the questions we have still unanswered: 1. Is this still a missing person's investigation or is it a criminal investigation? 2. Has there been any activity on Natzke's cell phone or credit cards?

Today's THV spoke with a family member who tells us police are asking them not to speak about the case at this point.

HSVP says they will be releasing more Wednesday and we will keep you updated as information becomes available.

Someone found Natzke's 1997 Ford Escort found burned in the Ouachita National Forest on Christmas day.  There was no one found inside the vehicle.  Her boyfriend, who was the last person seen with Natzke, says he has no idea how she went missing or why her car was found burned. 

Authorities suspended their search for the missing mother of three on Friday so officers could spend the holidays with their families. 

According to Patty Hathaway, a friend of Natzke's, authorities told her there has been no activity on Nazke's cell phone or credit cards in the last week.

Calls to speak to someone at the Hot Springs Village police department about Natzke's disappearance were not returned.  A spokeswoman for the department said,  "We expect to have a news release out tomorrow (12-28-11) about 2 p.m."

I agree.

I think whatever happened may have started before she left the party to take him home.

From what Patty said about her never leaving without giving hugs goodbye?  Or maybe that was because she knew she was coming back...since she was supposed to give her mother a ride home as well.

But why did she leave to take him home?  Maybe he was jealous or something?

Just my thoughts...

A friend of Natzke received a “strange text message” at 8:30 p.m. last Thursday, then called Natzke’s  neighbor. Cornett said. The neighbor went next door, spoke to a family member, and found no sense of alarm at that time.

Cornett said the text message was “out of character" for Natzke.

Natzke didn’t report for duty at 6 a.m. last Friday.  At almost the same time, her son called and told police his mother hadn’t returned home. An investigation began immediately.

LITTLE ROCK, Ark. (AP) — Dawna Natzke planned to have her family over for Christmas to open gifts and feast on steaks.

Yet, five days after the holiday, the presents in Natzke's home remain untouched.

Her family and friends haven't been able to embrace the holidays since Natzke, a police dispatcher in a gated community in central Arkansas, vanished last week. Instead, they fear that the mother of three is dead after someone found her station wagon burned in a forest not far from her Hot Springs Village home.

"It's been too long and no word, no clues, no anything," Natzke's mother, Doris Smith, told The Associated Press.

Natzke, 46, was last seen the night of a holiday party on Dec. 21. Searchers on horses and in a helicopter weren't able to find her by Friday. More planned to scour the tree-studded hills in four-wheelers during the weekend.

"Still, investigators have been hesitant to describe Natzke as a victim of foul play, even though her torched car turned up miles from her home in a remote part of the Ouachita National Forest that abuts the community.

Natzke's boyfriend, Kevin Duck of Jessieville, told police the couple returned to her house following the party and that she was gone by the next morning, according to the timeline. Although there are security gates at each of the town's entrances, there are no video cameras that would have recorded her leaving the community of 13,000 that caters to retirees. The west entrance, which is closer to the spot where Natzke's car was found, always has someone at the gate. The east entrance is not manned between 10 p.m. and 6 a.m.

By all accounts, Natzke is a loyal and giving woman: to her three sons, to her parents, to her family at the police station. She gave a kidney to her ill father, who likely would have died without the transplant. She built her life around her sons. The younger two — a junior and senior in high school — live with her; her oldest boy lives nearby. She had recently separated from her husband, who also didn't return calls Friday.

"She was a very loving person," Smith told the AP. The mother then paused and corrected herself: "She is a very loving person."

UPDATE I: Body Found During Search for Missing Arkansas Woman Dawna Natzke.

Although there has been no positive identification, it is hard to believe that the body found is not that of missing Dawna Natzke. How many woman are missing, especially in such close proximity to her home.

Debbie Shingler, whose 46-year-old sister Dawna Natzke was last seen leaving a Dec. 21 Christmas party with her boyfriend, told The Associated Press that police notified her family that searchers found a body in a wilderness area about five miles from her home in Hot Springs Village and about five miles from where her burned-out car was found.

"They told us yes, they found a body, but it's not confirmed to be Dawna, but we all know," Shingler said.

I think its only a matter of time before the positive ID is made and the boyfriend is arrested.

His story makes no sense, especially when the vehicle found burned and body found close to home. She just wasn't there when he woke up in the morning. Really, is that the best he could do?

The Garland County Sheriff's Office is reporting that a body of a female has been found on West Haul Road, off Highway 298. Investigators from Garland County and the Arkansas State Police are on the scene but say it's too early to identify the body.

Hazel Purvis Williams Everyone had to sign in at the school and go out in groups from there. Approx. 45 minutes later we were all called and told to return to the school that she had been found. Her family was notified at that time. My thoughts and prayers are of course with our friends family but also to the people on the scene that found her that is a time they will never forget. Hazel Purvis Williams That is very true. With every step we took and every thing we saw it was just like could this be something. Our hearts are so heavy but yet thankful that she was found to be brought home where she belonged. Everyone of us had the feeling of that we wanted her found but yet in our minds we didn't want to be the one to make the discovery. There were people there searching that didn't even know her, friends of friends, young and old, some who had trouble walking themselves. One of her best friends for many years making sure everyone signed in and then making sure everyone returned safely sitting and crying. Yet, five days after the holiday, the presents in Natzke's home remain untouched.

Her family and friends haven't been able to embrace the holidays since Natzke, a police dispatcher in a gated community in central Arkansas, vanished last week. Instead, they fear that the mother of three is dead after someone found her station wagon burned in a forest not far from her Hot Springs Village home.

"It's been too long and no word, no clues, no anything," Natzke's mother, Doris Smith, told The Associated Press.

Natzke, 46, was last seen the night of a holiday party on Dec. 21. Searchers on horses and in a helicopter weren't able to find her by Friday. More planned to scour the tree-studded hills in four-wheelers during the weekend.

"Still, investigators have been hesitant to describe Natzke as a victim of foul play, even though her torched car turned up miles from her home in a remote part of the Ouachita National Forest that abuts the community.

Natzke's boyfriend, Kevin Duck of Jessieville, told police the couple returned to her house following the party and that she was gone by the next morning, according to the timeline. Although there are security gates at each of the town's entrances, there are no video cameras that would have recorded her leaving the community of 13,000 that caters to retirees. The west entrance, which is closer to the spot where Natzke's car was found, always has someone at the gate. The east entrance is not manned between 10 p.m. and 6 a.m.

By all accounts, Natzke is a loyal and giving woman: to her three sons, to her parents, to her family at the police station. She gave a kidney to her ill father, who likely would have died without the transplant. She built her life around her sons. The younger two — a junior and senior in high school — live with her; her oldest boy lives nearby. She had recently separated from her husband, who also didn't return calls Friday.

"She was a very loving person," Smith told the AP. The mother then paused and corrected herself: "She is a very loving person."

The State Crime Lab has identified the remains found Saturday as the body of Dawna Natzke.

No other information; such as cause of death, time of death, etc. has been determined yet. More information will be given once an autopsy is completed.

Natzke, a police dispatcher for Hot Springs Village Police, was reported missing on Dec. 23 when she failed to show up at work. On Dec 21, Natzke was seen leaving a Christmas party with her boyfriend, 28-year-old Kevin Duck. Police say that Duck told them that he and Natzke returned to her home and that she was gone when he woke up the next morning.

Earlier, just before the call came in that a female body had been found, this reporter spoke with Luther Duck, father of Natkze’s boyfriend, Kevin Duck. Asked if he had spoken to son, Kevin, he said, “No, and I really don’t want to.”

Kevin was seen SHOVING Dawna out the door, possibly causing her to fall down as they exited the house the Christmas party was at. The friend, the next morning, sent a text asking if Dawna was okay and expressing concern over what they had witnessed.

The text message from Dawna's phone (which I do not believe was from Dawna...I have no grounds other than gut feeling and timeline analysis at this point) was a response to that concern. I won't share what that response said...I'll just say I do not believe Dawna was even alive by the time it was sent.

Vicki Hegyi (Dawna's sister) said Dawna had been seeing Kevin Duck since about February 2011.

Dawna had not said anything to Vicki about Kevin Duck's criminal past, Vicki said that's how Dawna was; she always gave everyone the benefit of the doubt.

Alexis Weed, Nancy Grace Producer talks about the details of the party.

A friend of Dawna's told her that Kevin Duck was being aggressive with Dawna at the party, was seen grabbing her arm at one time; and even burst into the bathroom when Dawna and her friend were both in the bathroom.

(I'm summarizing here because I've had some other things going on...)

Vicki Hegyi had only positive things to say about the local police, that they had come to the family several times to report on the investigation and that they were all very upset about Dawna's disappearance.

She also said that she found out about Dawna's burned car being found on Facebook.

When she called and asked the police about it, apparently they hadn't been notified at that time by the Forest Service that Dawna's car had been found.  If I understood correctly, the car was found on Friday but the police weren't notified until Saturday.

I'm watching again to see what I missed and will add details here:

(Vicki Heygi did not say, but I believe she actually lives in Indiana and arrived in Arkansas the day Dawna's body was found...this is from information I've read on facebook and possibly other articles)

Vicki Heygi said she knew nothing about Dawna's boyfriend Kevin Duck.

Kevin Duck's Criminal History (per visuals on NG):

2010:  Harassing Communication - Not Guilty Pleas - Dismissed

2009:  Aggravated Assault Conviction

Currently on probation (3 yr probation)

2008:  Domestic Battery 3rd Degree

CORRECTION:  Vicki Heygi stated that she believed the burned car was found on Thursday (Dec 22nd), and then the BOLO (Be On the Look Out) wasn't issued until Friday (Dec 23rd) at 6:38am when Dawna was determined to be a missing person.

She also states that the police did not botch this, they were looking for her, they love her, and that's what is so aggravating...(I think she means about the reports to the contrary such as on FB...jmo)

Vicki didn't find out about Dawna being missing until Friday morning (she states she was in Indiana) and that's when she got on the internet looking for any information she could find.  She started looking at Dawna's FB friends that had public pages, and that's where she found the rumors of the burned car being found.  Vicki is the one that told the family about the car.  Her mother immediately called the police and asked if the car had been found.  The police came to their house that night, but she thinks they were not officially notified about the burned car until Saturday.

NANCY GRACE, HOST: Breaking news tonight. Live, Hot Springs. A young mom last seen at a Christmas party. Bombshell tonight. At this hour, we get confirmation the body of missing mom Dawna Natzke has been identified, the young mom`s body found partially submerged in water there in a remote part of a forest about five miles from where Dawna`s station wagon discovered completely burned out. Tonight, yellow crime tape stretched around tall pine trees, blocking access to the area, including a pond, Dawna`s family hearing some of the news off FaceBook rumors.

As we go to air, Dawna`s autopsy still ongoing. Tonight, what happened to young mom of three and police dispatcher Dawna Natzke?

GRACE: Good evening. I`m Nancy Grace. I want to thank you for being with us. Bombshell tonight. At this hour, confirmation the body of missing mom Dawna Natzke has been identified, the young mom`s body partially submerged in water in a remote part of a forest about five miles from where Dawna`s station wagon discovered completely burned out.

Tonight, crime scene tape stretched around tall pine trees, blocking access to the area, including a pond, her family hearing some of the news from rumors off FaceBook. As we go to air, the autopsy still ongoing.

We are taking your calls. Straight out to Olivia Deas, KARN. Olivia, what can you tell us?

OLIVIA DEAS, KARN NEWS RADIO (via telephone): I can tell you that she was found -- her car was burned in the Ouachita National Forest about five miles from her home, and the body`s partially submerged. And they are questioning people and they have no suspects at this time.

GRACE: OK, that much I know, Olivia. Why don`t we try taking it from the very beginning. Where was she last seen? What do you know, Ms. Deas?

DEAS: She was last seen at a Christmas party. One of her friends we had talked to that she was not doing very well that night, had been upset about something. We were told she left with her boyfriend, and he was the last one to see her. There`s some allegations that she had dropped him off at his house. And police were contacted on the 23rd. When she didn`t show up to work, her son contacted police.

GRACE: We are taking your calls now, live in Hot Springs. The body of a young mom and police dispatcher confirmed to have been found tonight partially submerged in water, last seen at a Christmas party.

There you`re seeing shots of the young mom, Dawna Natzke. No one knew her whereabouts. And stunningly, her family finds out details regarding her disappearance on FaceBook rumors.

Now, how did that happen, Alexis Weed?

ALEXIS WEED, NANCY GRACE PRODUCER: Nancy, yes, the family is getting a lot of their information, so they`re telling us, through the media, unfortunately. For example, they were told that Dawna`s car was found in this remote forest about 10 miles away from her home. Her car was found, Nancy, completely charred. The family found that out on Christmas Eve through the news.

GRACE: You know, it`s stunning to me that the family is finding things out from rumors on FaceBook. So Joe Gomez, senior investigative reporter, KTRH, how is the information being leaked onto FaceBook? It`s hard enough to get information on this case, from police, but yet it`s making its way to FaceBook?

JOE GOMEZ, KTRH: Well, you know, Nancy, they had 400 volunteers out there searching for young Dawna Natzke. It`s possible that one of these volunteers, you know, might have leaked some information onto the Internet.

You know, police have also been coming under a lot of criticism because they were dragging their feet, Nancy, and using search dogs to look for Dawna Natzke. So this whole search operation to try to find this beautiful mother has somewhat been botched.

GRACE: Well, what do you mean by botched?

GOMEZ: Well, I mean, they didn`t issue search dogs as soon as they should have, Nancy. It took them a couple of days after they discovered Dawna Natzke`s charred car. Now, when they found this car burned, they probably should have known something was wrong. They could have sent the dogs to look for Dawna earlier. They could have sent out crews to this...

GRACE: Well, wait a minute! Wait a minute! Wait a minute! Whoa, whoa! Gomez, isn`t it true that forest rangers were the ones that found the car burned out? It`s a station wagon, right?

GOMEZ: That`s right. Yes.

GRACE: So forest rangers find it. It sounds to me like they did not communicate with local police. Did they consider this, I guess, just their forest jurisdiction? What is it, a national park?

GOMEZ: It`s a national park, that`s right, Nancy. Yes.

GRACE: What park is that?

GOMEZ: Ouachita National Forest, Nancy. It`s one of the biggest parks in Arkansas.

GRACE: So the Ouachita forest rangers find a burned-out car and don`t report it to anybody? OK. I`ll scratch my head about that for a little while.

All the while, about five miles later (SIC) is a body submerged in water, we`re hearing tonight. And nobody thought to send a search team out at that point, when you find a burned-out car? Another thing, Gomez, do you know if they brought in an accelerant dog to determine was the car a victim of arson?

GOMEZ: I`m not clear. (INAUDIBLE) yes, Nancy. No, I`m not sure. But that`s a good question. If the car was burned...

GRACE: All right, Gomez -- put him up, please! Gomez, I don`t get what`s going on. She goes to a Christmas party. Nobody sees her after that. She`s not reported missing. Her car is found by rangers completely burned to a crisp. Nobody thinks, Gee was somebody in the car? Is there a human victim somewhere, not just a burned-out car? And now I`m hearing you say they put out a BOLO -- "be on the lookout" -- instead of a missing person? Do I have these facts wrong? Help me out here, Gomez.

GOMEZ: No, you`re absolutely right, Nancy. No, you`re right. I mean, Dawna went missing, and her boyfriend didn`t call police. Nancy, it was her son that had to call police two days afterwards to report that his mother was missing. Then they discovered this burned, charred vehicle. Then we find Dawna`s body not five miles away. I don`t know, Nancy. Can you connect the dots here? Because something isn`t sitting right (INAUDIBLE)

GRACE: Well, this is what I know. This is what I know. We don`t have a suspect tonight. We don`t even have a person of interest. But I know that Dawna`s having problems with the boyfriend. I know that she is separated from her husband. They`re in the midst of that ongoing drama. I know that that night at a Christmas party, was having problems with the boyfriend, according to one of her friends, one of her girlfriends.

You`re seeing shots right now of Dawna Natzke. She`s a gorgeous young girl, mother of three, a police dispatcher, last seen at a Christmas party, never seen alive again, her burned-out station wagon found in a remote area of a national forest.

GRACE: Hi, dear. What`s your question?

UNIDENTIFIED FEMALE: Hi. Hi. Absolutely love those kids of yours, Nancy. Thank you so much for (INAUDIBLE)

UNIDENTIFIED FEMALE: The vehicle -- typically, when anyone is found in a vehicle, a burned vehicle, that`s somebody trying to cover up forensic evidence.

And you know, my -- you know, dealing with, you know, guys and girls and all those relationships, you know, I kind of can see a little thing going on here where she`s maybe having some trouble with this boyfriend, as was indicated, but then this husband maybe that she`s trying to leave -- maybe they`re trying to work it out, the boyfriend gets jealous, upset, enraged, and then all this stuff happens.

That is -- I mean, I`m just speculating, but you know what? I can`t believe that the police wouldn`t subpoena or get a warrant for both men involved because it -- it has to stem from them. I mean, that`s just the odds. And the warrants...

GRACE: Stephanie in Washington, are your a cop or an investigator?

UNIDENTIFIED FEMALE: No, but I -- I -- no, I just...

GRACE: Because you`re absolutely right on every single thing you said. And just to put the icing on the cake, Stephanie in Washington -- back to you Alexis Weed. In a nutshell, what do you know about this boyfriend?

WEED: Nancy, his name is Kevin Duck. He`s 28 years old. He does have a criminal history. It includes no contest plea to domestic battery. That`s in 2008 and 2009. He was convicted, Nancy, of aggravated assault. He was sentenced to three years probation in 2010. A not guilty plea dismissed for harassing communication.

And most notably, Nancy, in 2010, his former wife, who he`s now divorced from, alleged in divorce documents that he had abused one of the couple`s minor children.

GRACE: All right, let`s back it up to the aggravated assault. That`s a conviction in 2010. What happened in that case?

WEED: Right. That was -- his then wife -- the boyfriend of the wife at that time, Nancy, alleged that her boyfriend...

GRACE: Why do you keep saying "alleged"? It`s a conviction, Alexis!

WEED: Right. Right. We don`t have the details of what -- whether or not the allegations were all proven up in that case, Nancy.

GRACE: OK, wait! Wa-wait! Wa-wait! Stop a minute! Unleash the lawyers, John Manuelian, Lorna Owens, Lorna Miami, Manuelian LA. OK, neither one of you -- don`t launch into a manifesto. But Lorna, when you have a guilty plea, it`s not an allegation anymore. The person -- it`s either a guilty conviction, which means they went to trial or a bench trial, or it`s a guilty plea. You pled guilty to it. There`s not a question as to whether it happened anymore. Is that right, Lorna?

LORNA OWENS, DEFENSE ATTORNEY: Yes, that is correct. I`ll concede that, Nancy, as it relates to that case in...

GRACE: 2010.

OWENS: ... 2010. It`s not an allegation anymore, it is conceded by the defendant.

GRACE: And you made a good point in the way you answered that, Lorna. John Manuelian, that was the 2010 case, not the current case. But what`s interesting, John Manuelian, is that in the 2010 aggravated assault conviction, it was domestic-related. It was his ex-wife`s boyfriend that was the victim, Manuelian.

JOHN MANUELIAN, DEFENSE ATTORNEY: Yes. It looks like that`s the case, and that may be used for the investigators as a part of this investigation.

GRACE: Tonight, this woman`s family hearing details of her disappearance on FaceBook, her body discovered, we believe, partially submerged in a remote area of a forest, her car five miles away completely burned out, leaving behind three children.

UNIDENTIFIED FEMALE: Authorities are not saying it`s the body of Dawna Natzke, but they do say the body is female.

GRACE: We are taking your calls. The body of this woman we believe to have been found partially submerged in a pond, in a remote area of a national forest there near Hot Springs. What`s amazing is that authorities, the park rangers, found her burned-out car, her station wagon, days before the body was found. They didn`t even bother to call cops. Was she still alive at the time her body (SIC) was found? This mom and police dispatcher last seen at a Christmas party, never seen again. Even after finding her cremated car, forest police not calling local authorities. Could it have saved the life of mom of three Dawna Natzke?

UNIDENTIFIED MALE: Hi, Nancy. You know, it`s so obvious that the last person that she saw was her boyfriend, so-called. And I don`t mean to blame the victim, but do you think she had any idea of his history, his police record?

GRACE: You know, Joe in Florida, stay right there. I`ve got a feeling she didn`t know anything about it. But let`s go to Hot Springs now. Joining me is Vicki Hegyi. This is Dawna`s sister. Vicki, thank you for being with us.

VICKI HEGYI, SISTER (via telephone): Thank you, Nancy.

GRACE: I know that you guys must be on pins and needles now, waiting to hear the next discovery in the case of your sister. Did she have any idea about this boyfriend`s rap sheet?

HEGYI: You know, I don`t know nothing about her boyfriend. And she did not relay any negative information about her boyfriend. And that is just Dawna`s way. You never hear a negative word out of her. And she always gives people the benefit of the doubt.

GRACE: You know, Vicki, it`s my understanding this was a new boyfriend?

HEGYI: Yes.

GRACE: How long had she been dating him.

HEGYI: I believe just as of February of this year -- of last year, rather.

GRACE: So you know, almost a year. Almost a year.

HEGYI: Yes.

GRACE: You`re seeing shots right now of Dawna Natzke, young mom of three, also a police dispatcher. Vicki, when exactly did the forest police find her burned-out station wagon?

HEGYI: They found it Thursday. And see, the BOLO wasn`t issued until Friday at 6:38 AM, when she was determined a missing person. So they issued it right away. The police did not botch this. They were looking for her. They love her. That`s what is so aggravating in all this. We -- this police department come to our house and give us reports all the time.

GRACE: You know what? I`m glad to hear that, Vicki. I am really glad to hear that the local police are all over it.

HEGYI: They have been from the get-go.

GRACE: I hate that the hours were missed from the discovery of the vehicle...

HEGYI: No.

GRACE: ... until the search began for her. But that`s not the local police`s fault.

HEGYI: No.

GRACE: How did you guys find out about the car being burned out, discovery?

HEGYI: It was rumors that -- because I was so -- I was in Indiana. I didn`t find out she was even missing until Friday morning and...

GRACE: How did your family find out about the car being burned?

HEGYI: Through me, through me because I was searching, searching, searching for any information. I was clicking on Dawna`s FaceBook because we -- she recently friended me. I`m the only family member she had that was -- because she...

GRACE: So did you find out about the car on FaceBook?

HEGYI: Yes. Yes.

UNIDENTIFIED FEMALE: The body was about 200 yards off of West Hall Road nearly Highway 298 in Jesseville (ph). Garland County officials say the body will be sent to a state crime lab to be identified.

GRACE: We are taking your calls. Take a look at this woman, Dawna Natzke, a young mother of three. Also, she`s a police dispatcher. Her family learning news of her car, her station wagon, found completely charred, on FaceBook.

You know, I don`t understand that. Back to her sister. Vicki Hegyi is with us. What was it on FaceBook that alerted you to the condition of her car?

HEGYI: What I was doing, I was clicking on various friends in her FaceBook account, just clicking on every profile I could find that was still public -- and because you can be private or public -- and I would find comments -- I heard they found her car, and this, I will try and find out information, I will get back to you.

And I`m -- so I called my mom, you know, saying, Mom, did you hear anything about them finding her car? And she was very, very upset. She goes, No. How did you find out? And I said, Well, Mom, it`s just a rumor right now, you know? But -- so Mom went to the police, you know, and asked them, did they find her car. And then that night, that`s when it hit the local news that her car was found.

GRACE: Well, did the police know at that juncture that her car had been found?

HEGYI: Well, from what I gather, they didn`t find out until Saturday.

GRACE: So that would be, I think, a no.

HEGYI: Yes.

GRACE: So the forest police had not told local authorities her burned-out car had been found. That`s hours and hours lost...

HEGYI: Right.

GRACE: ... in the search of -- for Dawna Natzke.

LISA LOCKWOOD, FORMER POLICE DETECTIVE: Well, where there`s smoke, there`s fire. Bottom line is that. You`ve got a man who`s got a criminal history with domestic violence. He was the last person seen with her. And that needs to be investigated very deeply.

NANCY GRACE, HLN HOST: Welcome back. For those of you just joining us we can confirm tonight the body of this young mom of three, also a police dispatcher, has been found about five miles from where her burned out station wagon was discovered in a national park there in Arkansas.

But for some reason the Forest Police didn`t bother to call local police. We don`t know. We can`t estimate how many hours were lost in the search for Dawna or whether her life could have been saved.

Joining us taking your calls, her sister.

To Joe Gomez, KTRH, I want to go back to the night she was last seen alive, the night of the Christmas party. Give me the details of what happened that night, Joe.

JOE GOMEZ, REPORTER, KTRH RADIO: Well, apparently Dawna and her boyfriend had returned back home. She was watching TV so her boyfriend says. And when her boyfriend woke up the next morning she was gone without a trace. He thought she went to go to work but apparently she had the day scheduled off.

GRACE: Put Gomez up, please.

GOMEZ: And then the next --

GRACE: Gomez.

GOMEZ: Yes.

GRACE: I just wanted to make sure that you`re reporting that with a straight face. I repeat. I want to look at Gomez.

So, Gomez, once again we have the story that hey, we went to sleep and the next morning she just vanished from the bed, right? That`s what you`re telling me.

GOMEZ: That`s --

GRACE: Yes. All right. Obviously I need to go back a little bit further.

OK, Alexis Weed, what happened at the Christmas party itself?

ALEXIS WEED, NANCY GRACE PRODUCER: Nancy, they go to this Christmas party around 7:00 in the evening. They go together and as far as we`re hearing from the family they also brought Dawna`s mother to the party but didn`t leave with her. They then leave the party all alone at about 11:00.

GRACE: OK, you know what? I -- let me repeat to everybody on the panel. I`m just a JD. I`m not a DDS. I don`t know how to pull teeth.

WEEDS: So, Nancy, a friend of Dawna`s tells us that she was at this Christmas party with the couple and she saw that this Kevin Duck was being aggressive with Dawna, that he had grabbed her by the arm at some point. She also says that at one point he barged in on the two women while they were using the bathroom at the same time.

GRACE: To Wendy Walsh, psychologist, co-host of "The Doctors." Wendy, thanks for being with us. What is -- what do you make of that?

Here we`re talking about a guy who has a history of sort of -- they call it harassing communication, what is that? Like stalking? So you know he has sort of an anxious attachment disorder. OK, that just means, he thinks his love is his love line and if she`s not going to be loving him back it`s going to be a problem.

So now we`re seeing violence exhibited in public? Well, if he does this public imagine what does in private, Nancy?

GRACE: And another thing, Wendy, of course, he`s not a suspect, not even a person of interest, but you and I both know, all right, and I don`t know if this is the advice you give your clients, but as my mom says to me, it`s not going to get better, OK. They start -- men start off -- don`t take any offense because women are the same way, we`re all the same.

You start off putting your best foot forward. You know? At the beginning in a relationship, women fix their hair, they put on hair makeup, they dress up, you know, they cook dinner, blah, blah, blah. After a year or two that`s out the window, OK. That`s not going to happen anymore, right?

WALSH: Nancy, so true.

GRACE: And here, if all this is happening in the first year of the relationship what`s going happen next? So, of course, that`s not a crime, that`s just an anecdotal reality.

Back to Joe in Florida. What was your second question, Joe?

JOE, CALLER FROM FLORIDA: Questioning this guy, obviously they`ve questioned him already, but how can they get him back as developments proceed to question him again? Can he refuse? I mean --

GRACE: Good question. Good question, Joe in Florida.

John Manuelian, L.A., Lorna Owens, Miami. You know, at this point you really think this guy is going to answer questions? To you, Manuelian?

JOHN MANUELIAN, CRIMINAL DEFENSE ATTORNEY: I would advise him highly not to speak to the police because obviously he may be connected somehow indirectly or directly and even if he wasn`t the police officers could interpret his version of the story differently or he could actually give inconsistent statements. So it`s not in his interest to speak to the police in my opinion.

GRACE: What about it, Lorna?

LORNA OWENS, DEFENSE ATTORNEY: I would advise him to get a lawyer and not speak to the police. We already know of his background. We already know that there was some argument that evening. And we know that the police is going to come to this investigation with that kind of baggage, that kind of background. It behooves him to speak to an attorney and then work through this with his attorney.

GRACE: I think at this juncture no way is this guy going to cooperate.

To Dr. Vincent Dimaio, former chief medical examiner, Bexar County, forensic pathologist, joining us tonight.

Dr. Dimaio, thanks so much for being with us. This body partially submerged in water from what we are being told. What will cops be looking for and what will the medical examiner be looking for? The autopsy still ongoing. What will they be looking for? Why is the autopsy taking so long? How does water complicate that?

DR. VINCENT DIMAIO, M.D., FORMER CHIEF MEDICAL EXAMINER, BEXAR COUNTY, FORENSIC PATHOLOGIST: That`s a lot of questions. Water actually will cool the body quick or is it will preserve it. It looks like that the crime lab there doesn`t work weekends and they just put off the whole handling of the body for -- you know, for a couple of days until they got around to it.

GRACE: And so you think that it didn`t have anything to do with the condition of the body that had to do with being off?

DIMAIO: Oh, no. I mean you can get a markedly decomposed body in autopsy immediately if you want. There`s no problem about doing the autopsies, just having somebody there to do the autopsy. They probably were off for the weekend.

GRACE: You think so?

DIMAIO: Yes.

(LAUGHTER)

GRACE: And another thing, Dr. Dimaio, what do you think about the car? What can we learn from the car?

DIMAIO: Well, actually it`s a good -- if you want to destroy trace evidence you burn it. It actually was in that picture about bank robbers in Boston. If you have a vehicle where you committed a crime in or transported a body and you wanted to break the chain of evidence, burn it up. Because, you know, maybe she had been murdered in the car. Maybe the car was a transport mechanism. Maybe there`s trace evidence of the perpetrator in the car. Burn it. It`s gone.

GRACE: We are taking your calls. To Jared in North Dakota. Hi, dear, what`s your question?

JARED, CALLER FROM NORTH DAKOTA: Yes, I`m confused why you all are saying crime of passion or the boyfriend did it. How do we know she just didn`t run away and she just wanted to be alone and she burnt her own car?

GARLAND COUNTY, Ark. (KTHV) - Police say they have enough evidence to investigate Dawna Natzke's death as a homicide.

Lt. James "Corky" Martin with Garland County Sheriff's Department says they have a person of interest as well but are not releasing any names.

They are still waiting for autopsy results from the Arkansas Crime Lab but Martin says "for reasons detrimental to the case" they won't be releasing the results.

Natzke, a 46-year-old mother of three, opted for phone calls, too, instead of text messages.

“She only texts me if she was at work,” Hathaway said. “Otherwise, she’d always, always call me.”

Natzke had the day after the party off, but Hathaway said she didn’t know that at the time. When she found out later, she said it didn’t make sense that Natzke hadn’t called her on Dec. 22.

“She called me every day at approximately 10 o’clock cause she knows I don’t like sleeping in,” said Hathaway who works at a local bar.

Hathaway, who last saw Natzke at the holiday party, said her friend wasn’t acting like herself that night. So, she pulled Natzke aside and the two friends were talking until she said Duck “came barging in on us.” Natzke and Duck left together sometime between 10:30 p.m. and 11. Hathaway left a short time later.

“I kind of knew something wasn’t right,” Hathaway said. “That’s the reason I text her the very next morning, that I wasn’t pleased with what I had seen.”

Hathaway tried calling Natzke a couple times after she received the message from Natzke’s phone, but no one answered.

She said also she sent text messages to Duck, asking if he’d heard anything about Natzke. Hathaway said he told her the police said someone had found her vehicle and that he would let her know if he found out more.

Duck didn’t return a phone message left by the AP Thursday at his mother’s home. His cellphone number has been disconnected.

Dawna worked as a dispatcher with Hot Springs Village Police Department. She was fun loving, outgoing and never met a stranger. She enjoyed singing and dancing with friends, but her boys were the first priority in her life. Dawna had an infectious laugh and a smile that would light up a room. She was dearly loved and will be deeply missed.

HOT SPRINGS VILLIAGE, AR - Friends and family arrived at the Village Church of Christ in Hot Springs Village Saturday morning to pay their respects to mother of three and police dispatcher Dawna Natzke.

"It was such a beautiful service and so respectful of Dawna and of the family," said family friend Jill Tyler.

Added friend Lyndsie Davis, "you can tell that God is in this community."

Natzke's death remains a mystery. She disappeared after attending a Christmas party December 21st. About a week later, the U.S. Forest Service found her burned car in the woods in Garland County off of Highway 298. Then on New Year's Eve, a search team found Natzke's body in another heavily wooded area, not far from where her car had been found. Investigators say someone killed Natzke, and they do have a person of interest, but no arrests have been made.

A lot of information has been learned in the past few days about the particulars of what happened (and maybe more importantly didn’t happen) in the first two weeks after Dawna went missing (and was murdered).  The gates of Hot Springs Village keep a lot of secrets contained within the community, apparently when it benefits the image of the community, but apparently they keep a lot of information out.  In this case, the information that we are being led to believe didn’t make it past the gates of the largest gated community in the United States, would have led to Dawna being found sooner, evidence being preserved, and possibly a perpetrator already sitting behind bars.

First, I’ll point out that we have started a timeline on Dawna’s case.  It is a living document and more and more information is being refined and added as we learn more.  Please note we have the “official” timeline from HSVPD contained in it, along with the other accounts that contradict, or at least do not agree, with HSVPD’s version.

Let’s start where it appears to have all began….with the party.  There are lots of unanswered questions about the party, and I’m coming to believe the confusion is intentional.  Most sources, including the “official” statements released in interviews and to local media, have stated that the party was a pre-planned Christmas party by Scott Randall.  Others, such as Patty Hathaway, have described it as a quiet “house warming/Christmas” type of party.  Some of the original statements even went so far as to say it was a “POA employee Christmas party” that has since been ditched.  However, there are multiple sources who point out that if it was a pre-planned party, then Scott Randall’s got an odd way of behaving when he’s expecting employees of the community he is General Manager over, to come to his house.

According to the Garland County Sheriff's Department, Kevin Duck was arrested in Louisiana on February 1st by the Calcasieu Parish Sheriff's Office. He is being held on a no bond Arkansas warrant for probation violation.

Anderson, in the full letter you can read here, describes the police department as a hostile work environment, telling KARK over the phone he had concerns about a culture of arrogance which kept information within the confines of commanding officers' knowledge.

He wrote in his letter, " A recent incident and subsequent Dawna Natzke investigation have caused ... residents to question their police department's leadership [...] Based on my experience and training, these concerns certainly appear justified."

Chief Cornett disagrees, arguing his office handled the investigation by the book.

"I would refute that. I think we are up to date, I think we do our work well," Cornett said.

But Anderson pointed out that patrol officers, to this day, have not been briefed on what the department knew about Dawna Natzke's missing person's case. But Cornett points to police reports to serve as their briefing, declining to be more specific.

"All of the reports were entered into the system. All the officers have access to those reports. They can pull them up and read them as it went," Cornett said.

But according to officers who know the system, reports only include details as recorded by the officer who took the information from the person making the police report. There's no designation of timelines, what information has been verified as correct or rumor, and that keeps officers working in the field from having the same knowledge as commanding officers in the loop in administration.

That, Anderson said on the phone, is an example of the  "culture of arrogance" among commanding officers that resulted in Natzke's investigation being mishandled.

Natzke went missing after a Christmas party on December 21st. The charred remains of her car were discovered by a State Forester in Ouachita National Forest. Hot Springs Village Investigators did not arrive on the scene of the car until Sunday, December 25th. A canine search crew went out into the forest on December 26th. But Natzke's body wasn't discovered until New Year's Eve by volunteer searchers.

GARLAND COUNTY (KATV) -

An arrest warrant for first degree murder has been issued for the boyfriend of a Hot Spring Village police dispatcher killed almost two years ago.

Dawna Natzke was killed in December 2011.

Kevin Duck was arrested several weeks after Dawna's death for violating probation, according to arrest reports, but he was later released. He was only named as a person of interest.

Garland County Prosecutor Steve Oliver said the warrant was issued Monday on a first-degree murder charge for Kevin Duck in Dawna Natzke's death.

Natzke was last seen December 21, 2011, leaving a holiday party with Duck. Her body was found New Year's Eve in a remote area in the Ouachita National Forest.

Duck told detectives in 2011 that the couple returned to Natzke's home after the party and that she was gone when he awoke the next morning.

The arrest affidavit for Duck mentioned that Duck had called in to his employer saying that he would be late for work the day after Natzke went missing.  His employer, Lester Woodson, mentioned to authorities that Duck had said he was looking for Natzke that morning but never asked for time off to do it again.

Duck's arrest affidavit also mentioned one of Natzke's friends, Patty Hathaway, witnessing Duck and Natzke leave the Christmas party together and in the process saw Duck push Natzke out the front door.  Hathaway had sent Natzke a text the night before saying she didn't like what she had seen and the next day a response from Natzke's phone read, "He did not push me.  I fell and he caught me.  I had taken a pain pill and was tour up." 

Hathaway didn't believe that text was from Natzke since it was not her style of texting and mentioned that she would have called instead of texting back.

Cell phone records are what eventually linked Duck to the crime.  At 9:02 AM on the day Natzke disappeared, a call was made from Duck's cellphone that originated 6/10ths of a miles from the locations where Dawn's car was found burning.

An autopsy on Natzke's body showed she had died within three to four hours after leaving that party since her blood alcohol content level of .07 - according to medical examiner Dr. Charles Kokes.  Kokes mentioned that most likely represented antemortem alcohol consumption.  Kokes determined Natzke's cause of death to be from blunt force trauma and drowning.

According to the Garland County Sheriff's Office (GCSO), investigators received information indicating that Duck, Natzke's boyfriend at the time, was in or near Burlington, Colo.

Investigators then relayed that information to the Kit Carson County Sheriff's Office in Colorado, who confirmed that Duck was in the area, according to GCSO.

GCSO says Duck was taken into custody Tuesday evening without incident.

Kevin Duck is accused of killing Dawna Natzke, a Hot Springs Village police dispatcher who was last seen leaving a holiday party with Duck around 11 p.m. on Dec. 21, 2011. Volunteer searchers found her body on New Year's Eve in a remote area of the Ouachita National Forest, about 5 miles from where her burned-out station wagon had been found days earlier.

Duck's cellphone number has been disconnected and calls to his family rang unanswered. Oliver said he does not know if Duck has an attorney.

Natzke, 46, had worked at the police station seven years. At age 35, she donated a kidney to her father, prolonging his life by 10 years, according to the preacher at her funeral. Friends said she built her life around her sons: two who played football at Jessieville High School at the time of her death and an older son who lived nearly.

Duck told detectives in 2011 that the couple returned to Natzke's home after the holiday party and that she was gone when he awoke the next morning.

The cause of her death has not been released, but Oliver said it appeared Natzke, 46, died within three to four hours of leaving the party with Duck.

"The best we know, he was just angry with her, when they left the party he was just angry," Oliver said.

The two had arrived at the party together, along with Natzke's mother, in Natzke's car, according to Oliver.

"She was seen leaving with Mr. Duck. He was kind of leading her out. He wasn't pushing her, just kind of leading her out" he said. "She left her mother behind and her purse."

A friend, Patty Hathaway, told The Associated Press in early 2012 that, shortly after Natzke's disappearance, she had received an odd text message from the woman's phone. Hathaway said she had texted Natzke the day after the party to say she wasn't pleased with how Natzke's boyfriend had "pushed" her out the door.

Nearly two hours later, Hathaway received a text from Natzke's phone, saying: "He didn't push me i fell and he caught me. I had taken a pain pill and was tour up"

Hathaway said she didn't believe Natzke wrote the message. "I know she knows how to spell," she said then.

A probable cause affidavit says cellphone records obtained from the FBI in Washington, D.C. place Kevin Duck approximately half a mile away from the sites where Dawna Natzke’s car and body were found.

According to KARK News,content partners with Hot Springs Daily, Dawna Natzke was reported missing on Dec. 22, 2011 by her boyfriend, Kevin Duck, the night after a Christmas party in which he was seen leaving with her, even forcibly pushing her out the door, according to witnesses.

According to the affidavit, a toxicology report indicated that Natzke likely died within 3-4 hours of leaving the party.

Her car was discovered burned in the woods around 11 a.m. on Dec. 22, flames still emanating from the engine area.

It was later determined that the car belonged to Natzke, and was the one she and Duck had driven to the party the night before. Her body was discovered on New Year’s Eve 2011 on Maun Haul Road in Garland County outside Hot Springs Village.

Duck’s cellphone records were sent to the FBI for triangulation, which shows the date and time of a call, the tower the call hit and the approximate location of the cellphone at the time the call was made.

Results showed calls coming from Kevin Duck’s cellphone at 8:34 a.m. on Dec. 22, 2011, from a location within six-tenths of a mile of where Natzke’s body was ultimately found, according to the report.

The affidavit states that just 28 minutes later, at 9:02 that same morning, a call originating from Duck’s cellphone was made within six-tenths of a mile of where Natzke’s car was found burning, a mere 2 hours before the car was discovered.

Later that same morning, a friend texted Dawna to tell her she didn’t like seeing Kevin push her around. The friend received a reply from Dawna’s cellphone at 9:37 a.m. on Dec. 22, saying, “He did not push me. I fell and he caught me. I had taken a pain pill and was tour up.” The friend told authorities she didn’t believe the text came from Dawna, saying she didn’t use those kinds of words or punctuation in her texts, according to the affidavit.

Dawna’s cellphone has never been recovered.

On Monday, Investigators and the prosecuting attorney’s office completed an arrest warrant for Kevin Conway Duck on the charge of first-degree murder in connection to Natzke’s disappearance and death.

The Garland County Sheriff’s Office says the arrest warrant was signed Monday afternoon in Garland County Circuit Court, and bond has been set at $250,000.

UPDATE:  GARLAND COUNTY (KATV) - According to Garland County Authorities the man suspected in the death of Dawna Natzke, Kevin Duck, has been arrested in Colorado.  The sheriff's department says one of their investigators was informed that Duck was in the area of Burlington, CO.  That information was sent to authorities there and Duck was taken into custody, without incident, on Tuesday evening.  He was arrested on a 1st degree murder warrant.

The boyfriend of a Hot Springs Village woman killed in 2011 remains behind bars.

Kevin Duck was taken into custody in Colorado Tuesday for the murder of Dawna Natzke in 2011.

Doris Smith, Dawna Natzke's mother, said the arrest is a relief.

Doris spent the last two years consumed with her daughter's death and who is responsible and believes police have arrested the right person.

Holidays are a tough time. Doris last saw Dawna at a Christmas party in 2011.

Nearly two years later, Duck, was arrested on a charge of first degree Murder.

After countless sleepless nights and lonely days, the news of Ducks's arrest leaves Doris suddenly overwhelmed.

She was devastated by autopsy results released this week stating Dawna was killed by blunt force trauma and drowning.

"I was hoping it was quick and over and done with," Doris said.

But with Duck's arrest, she said she is now looking forward to justice for her daughter.

"I've already lived through the fact that she's gone," Doris said. "It doesn't bring her back but I know she's with her dad and no one was loved any more than she was."

Duck is scheduled for an extradition hearing Friday morning in Kit Carson County, Colorado, where he is being held.

His bond is set at $250,000.

The former boyfriend of a murdered Arkansas police dispatcherhas been arrested just one day after a warrant was issued naming him as the suspect in the 2011 murder.

Kevin Duck, 30, was arrested Tuesday in Burlington, Colo., and charged with first-degree murder after authorities received information he was in the area. His bond has been set for $250,000. Duck has not yet been arraigned and he does not have a lawyer.

Duck is accused of killing Dawna Natzke, 46, a Hot Springs Village police dispatcher who was last seen leaving a holiday party with Duck on Dec. 21, 2011. A witness told police that Duck was seen forcibly pushing Natzke out the door, according to the arrest warrant issued Monday.

Natzke's burned car was found the day after the party by police. Police found her body in a remote area of the Ouachita National Forest on New Year's Eve, about 5 miles from where her burned-out car had been found.

Duck initially told investigators that they left the party around 10 p.m. and returned to Natzke's home, according to the arrest warrant. When he awoke the next morning, Natzke was gone, he told police.

A toxicology report indicates that Natzke, a mother of three, likely died from blunt force trauma and drowning within three to four hours after leaving the party, the arrest warrant says.

The arrest warrant notes that Duck was late to work the day after Natzke disappeared. Duck's boss at Lester's Quality Auto Service told police Duck seemed disinterested in the search for Natzke and never asked for days off to search for her before the body was found.

Although Duck wasn't considered a suspect at the time, his father says he knew police would eventually zero in on his son.

"Kevin is the person of interest, the only person of interest," Duck's father, Luther, told ABC News affiliate KATV last February.

The FBI used Duck's cellphone records to link him to the area on the same day Natzke's car was found, the arrest warrant states.

Thank you for posting the articles and updating us on the history of the case and the arrest of Kevin Duck, texasmom.   It looks like it took a couple of years to make the case.   After so much time passing since her murder, I wonder if Kevin thought he was home free?  Or did he wonder and worry about being apprehended?  Hoping and praying there will be justice for Dawna Natzke.   ::justice2nj2::

HOT SPRINGS, Ark. (AP) - A judge has reduced the bond for a man charged in the 2011 death of an Arkansas police dispatcher - although not by as much as the suspect wanted.

Prosecutor Steve Oliver says the judge on Monday reduced Kevin Duck's bond from $250,000 to $150,000. Duck had asked that bond be reduced to $50,000.

Duck has pleaded not guilty to first-degree murder in the death of his girlfriend - Dawna Natzke - who was a police dispatcher in Hot Springs Village. Duck's attorney did not immediately return a phone call seeking comment.

In the video at the link above, Dawna's mother talks about how she'd lost hope that they'd arrest Kevin while she was still alive.  I hope the fact that he has been arrested and charged with Dawna's murder brings her some peace; and I hope he won't be able to bond out of jail so that she will know exactly where he is at all times.

I am sure this Christmas has been filled with such heartache for this family.
I pray justice will provide them with some peace.  It won't be closure -- for there is never closure for loved ones lost in this manner.

I am confused as why the POS's lawyer wanted the bond reduced so they could work more closely with their client.  Wonder what the h@ll that means?  It really bothers me when the bond is reduced for no apparent reason.  All just game playing in my opinion, but what do I know?

Additional thoughts about a lower bond...Dawna's family won't feel safe with him out of jail, and I wouldn't put it past him to try to intimidate witnesses either.

Here's the link and a snip texasmom posted earlier in this thread as part of the discussion of a possible bond reduction for Kevin Duck.  I hope he stays behind bars too, (especially for Dawna's family's sake) but keep in mind, bail is not supposed to be punitive, but is to be a means to ensure the defendant returns for hearings, trials etc.  He is still innocent until proven guilty by a court of law, etc.    I hope the article I posted below will give some understanding how it's supposed to work.  Kevin Duck's attorney is using the basis of lowering the bond amount that is keeping him in jail and in his opinion, keeping him from working with him on his defense.  Jails have rules on hours etc., even for attorneys, and there may not be much if any way to have private discussion between client and attorney.  I'm not taking one side over another, just wanted folks to understand the purpose of bail and how it can be misused.  We don't want Kevin Duck getting off the hook sometime down the line because he was denied the opportunity to make a defense etc.

Kevin Duck, 30, appeared in court Monday morning and entered a not guilty plea. He also asked the judge to reduce his $250,000 bond. That hearing will take place Dec. 30.

The Process of Setting Bail

If you have been arrested, you will probably want to know how much your bail will be as soon as possible. If you are required to see a judge before your bail amount is set, you are probably going to spend some time in jail, often a weekend in jail (this is sometimes a tactic used by the police -- they arrest you on Friday, meaning that the earliest you will see a judge to set bail is Monday), and even up to five days. However, if you were arrested for a common type of crime, jails often have a chart that can be used to set standard bail amounts which means getting out is a simple matter of paying the standard amount.

The Eighth Amendment of the United States Constitution establishes that no person can have an excessive bail amount set against them. This has been held to mean that bail cannot be used as a way for the government to raise money for itself or punish a person for being arrested. The Eight Amendment is there to ensure that bail is not used for a purpose other than to guarantee that an arrested person comes back to court at the appointed time. The bail cannot be more than is reasonable to accomplish that.

Despite the theory behind the Eighth Amendment, judges often use excessively high bail amounts to prohibit an arrested individual from getting out of jail. This type of excessive bail is often used for people that have been arrested on suspicion of dealing drugs, murder or other crimes where flight is a real possibility. Many people have argued that this type of high bail violates the Eighth Amendment, but almost all have been unsuccessful.

There are also situations in which bail is set at a reasonable amount, but the arrestee still cannot afford to pay the bail. When this happens, the arrested individual must wait to ask the judge to lower the bail amount at a special bail hearing or during the defendant's first court appearance. Depending upon your financial situation, the judge may decide to lower your bail amount, which could making getting out of jail easier.

Another delay has come in the murder trial of a Jessieville man.

In response to a defense motion, Garland County Circuit Judge John Homer Wright re-set the pretrial hearing for Kevin Duck to March 28, 2016. The trial is now set for March 29-April 1.

Duck, 32, is charged with first-degree murder in the December 2011 death of Dawna Natzke of Hot Springs Village. Natzke, a dispatcher for the HSV police department, was last seen leaving a party, allegedly with Duck, around 11 p.m. Dec. 21. The party was at the Village home of Scott Randall, who at the time was the Property Owners’ Association general manager.

A pre-trial hearing had been set for yesterday, with a four-day trial to have started today.

Previously, a pre-trial hearing had been set for last Feb. 9, then for June 1, with a jury trial to start the next day.

The murder charge carries a possible prison sentence of 10 to 40 years, or life imprisonment.

Duck has been held by the state Department of Correction since Feb. 25, 2014, when his probation on a Hot Spring County aggravated assault charge was revoked. Serving a six year term, he became eligible for parole on that charge in March.

The latest delay, similar to a delay granted in May, is related to Duck’s status as an indigent inmate.

Last May, Wright approved a defense motion declaring Duck an indigent for costs other than attorney fees.

The state Supreme Court in 2010 ruled that the state must pay reasonable expenses for defense of indigent defendants, even those with retained counsel.

Duck’s attorney Clay Janske told Wright the defendant’s mother is paying for the attorney, but Duck lacks funds for hiring an expert witness. Janske’s motion said obtaining a cellular telephone expert is essential to Duck’s defense.

Duck’s attorneys, Janske and Brian Johnson, initially asked for a delay because the state Public Defenders Commission had not approved Wright’s order for funds to assist in Duck’s defense.

Before Wright acted on the motion, the commission approved the funds.

But the attorneys amended their request, as the defendant is required to sign the commission’s paperwork, and the defense counsel had not received the paperwork back. Then the papers would have to be returned to the commission to receive the assistance.

Hot Spring County Circuit Court Judge Chris Williams on Feb. 25, 2014, ruled Duck had violated three conditions of probation, including allegedly committing the crime of murder, failing to report an address change and working out of state without proper authorization.

Duck was on probation for a November 2009 conviction of aggravated assault, a class-D felony.

He was convicted that year of brandishing a weapon on a man in the Bismarck area, in Hot Spring County.


Williams told the court that receiving a criminal indictment is sufficient grounds to revoke probation. Some people have the mistaken idea that one must be convicted of a crime to violate probation’s first condition, he said.

“It is interpreted wrong even by some judges,” Williams said. “Receiving a criminal charge alone is a violation of probation.”

The intent of the law is for probationers to avoid associating with people who are liable to commit crimes, the judge told Duck.

Williams said while a criminal defendant carries the presumption of innocence until conviction, a judge’s determination of sufficient “probable cause” to file a criminal charge is enough to revoke probation.

Thus, the murder charge alone was sufficient cause to revoke probation, Williams said.

Duck’s 2009 probation order allowed him to work out of state, as long as he obtained permission each time he traveled to work and provided a valid address.

He is currently serving in the Wrightsville Unit.
