With the divorce finalized, I do note that on page 12 of the agreement it states Kaine ( petitioner) is facing pending criminal charges.  I have not received a call back or email to clarify the accuracy of that at the time of this comment,  but it is a non-standard clause.

Grace ... it has been a while.  I hope that you had a nice Christmas.

I had a busy Christmas but thankfully I did not have to do dinner this year.  It was my brother and SIL's turn.  Payback next Christmas.  Today my hubby and his sisters hosted a luncheon at a Japanese Restaurant in Vancouver and then gathered for dessert at the home of one of his sisters.  There were 51 (five tables) in attendance ... three generations. 

Son and family returned to the Island after being with us for a week.  I know it won't take long before I will start missing the grandkids (2/7) but right now the peace and quiet in my home is heaven.  I must be getting old.

Inquiring minds assume that Easter Mathews was deposed by Terri's attorney.  Why the current silence encompassing this witness who allegedly could affirm that Kyron was seen at the school following Terri's departure on the morning of June 4, 2010?  Why the current silence that could dispute LE's statement two weeks following the disappearance Kyron that Terri was the last known person person seen with her stepson.

According to the divorce document obtained by the Oregonian:

Terri Horman will pay $224 a month in child support, due the first of every month.

Meanwhile, Kaine Horman will remain responsible for Kiara's health-care and day-care costs.

Kiara will start kindergarten in the fall, and child support will be re-calculated then.

Terri Horman will maintain a $100,000 life insurance policy, with Kiara listed as the benificiary.

Terri Horman will receive 73.3% of Kaine Horman's Intel 401(k) retirement contribution plan as of Dec. 27, 2013.

Kaine Horman will keep his house on Northwest Sheltered Nook Road in Portland. Terri Horman lives in Roseburg with her parents.

PENDING CRIMINAL CHARGES!!  Could these pending charges involve steriods?

Blink ...  when all is said and done neither Terri nor Kaine had ever officially accused the other of being an unfit parent.  Could it be assumed that neither were aware of any wrongdoing that would deem the children were at risk prior to June 26, 2010.

When it is considered that on June 25, 2010 Desiree and Kaine were upholding Terri in a media interview ... inquiring minds want to know the details of what was revealed by investigators in the next 24 hours ... details that caused Kaine to immediately flee the family home with his daughter ... details that result in a restraining order against Terri two days later and has been in effect for the past 3 1/2 years.

"I believe Respondent (Terri) is involved in the disappearance of my son Kyron who has been missing since June 4, 2010," Kaine stated in the filing. "I also recently learned that Respondent (Terri) attempted to hire someone to murder me. Think about the outcome in Susan Powell case ... the outcome that ended with the death of two little boys at the hands of their father who investigators were focused on in the disappearance of their mother two years previous.

Akin to Kaine Horman ... Chuck Cox harboured the same fears for his grandsons' well being.

Chuck Cox: ‘Too many warning signs’ regarding Josh Powell

Chuck Cox said it’s clearer than ever, in his mind, that Powell was responsible for the disappearance of Susan Cox Powell – the Coxes' daughter and Powell’s wife – in Utah two years ago. He said he thought Powell was feeling pressure from the investigation into his wife’s disappearance, in which police had called Powell a person of interest.
 
“He was going to lose in his way,” Chuck Cox said. “It was cowardly.”
 
Cox said he warned police, social workers, lawyers and anyone else who would listen that he felt Powell might try something desperate.
 
“We felt that if he – Josh – felt that there was no hope -- that he was losing, or was gonna end up in jail or something – that he would do something very desperate and could possibly harm the children or take them with him in a murder-suicide thing,” Cox said. “Well, there you go.”
 
Powell, despite being the only person of interest in the case, had refused to cooperate with detectives. For that reason and many others, Chuck Cox said he thinks the deaths of his grandsons could have, and should have, been avoided.
 
“There were too many warning signs that were known, but due to legal limitations, were unable to be acted upon,” he said. “So we ended up where we ended up.”

My position remains firm.  If LE and/or Kyron's parents says it ... I believe it.  Only the revealed truth in public statements encompassing the investigation has the ability to bring this little boy home.

Somehow when all is said and done ... I suspect that through a plea deal DeDe Spicher will be the smoking gun that will blow the Kyron Horman case wide open.

I am hoping that arrests will be forthcoming that will negate the upcoming June, 2014 custody hearing.

Desiree Young's lawyer has filed a motion asking a judge to compel DeDe Spicher, a friend of Terri Moulton Horman's, to answer his questions after she declined to answer 142 questions during a deposition he took earlier this month stemming from Young's civil lawsuit against Horman.

Blink has evolved from her original speculation regarding the involvement of Terri and DeDe in the disappearance of Kyron but ... NOTHING forthcoming from LE, Desiree and/or Kaine has cause me to budge.

Could it be that DeDe was the link in a small chain of participants who was designated to dispose of untraceable phones used in the planning and engagement of a crime?

A DeDe Spicher Tip?

Over the weekend, crews set up a base near Kyron's school and searched fields along Cornell Road. FOX 12 confirmed that a tip from DeDe Spicher -- a friend of Kyron's stepmother Terri Horman -- is what sparked the search of at least one area.

Mom of missing Kyron won't 'let Terri win'

PORTLAND, Ore. (KOIN) -- The mother of a missing northwest Portland boy spoke to the press Sunday as search efforts renewed for evidence into his disappearance: "If he was here, he would say thank you very much."

Desiree Young's news conference came as the search for Kyron Horman continued up over the weekend, albeit in a less than official sense.

"I can say that it was successful," Young said of the weekend volunteer-led search. She said information gathered will be turned over to law enforcement.

Volunteers with the group Kyron Horman's World Soldiers set up a staging area in northwest Portland off Skyline Boulevard. They recruited two non-profit search agencies, and said they had an overwhelming response from volunteers.

Aided by 10 search dog teams, around 60 volunteers each day scoured the area around Skyline Boulevard and Germantown Road -- the same area searchers combed shortly after Kyron disappeared in 2010.

Why are Kyron's parents not attempting hold the school district responsible for the disappearance of their little boy?

Could it be that the on-going briefings with investigators have convinced Kaine and Desiree that Kyron left the school on the morning of June 4, 2010 with his stepmother?  In other words ... there are no reported sightings of Kyron following Terri's departure ... no reported sightings that have not been ruled out.

THE 3 1/2 YEAR INVESTIGATIVE HOLD UP

Could it be that that the silent Kyron Horman investigation is far reaching as well as layered?

Could it be that investigators are not only focused on Terri but a small chain of local participants?

Could it be that one link in the small chain of participants has a "safe haven" connection outside the borders of the United States?

Could it be that the "safe haven" link in the small chain of participants may be the smoking gun that will allow investigators to bring Kyron home?  That is my prayer.

A Multnomah County judge finalized the divorce of Kaine Horman and Terri Moulton Horman on Tuesday, days before the two were set to go to trial.

The couple married in April 2007 -- more than six years ago. Kaine Horman filed for divorce on June 28, 2010 -- 24 days after Kaine Horman's son, 7-year-old Kyron, was last seen at Skyline Elementary School in rural Northwest Portland.

Multnomah County Circuit Judge Henry Kantor signed off on the divorce. He noted, however, that the Hormans still need to work out who will get legal custody of their daughter, Kiara, who is now 5. They will also need to work out an agreement on parenting time.

Again ... I suspect that DeDe is the smoking gun who will blow this case wide open.  I contend that the 3 1/2 year investigative hold up has been focused on connecting ALL the links in the small chain of participants involved in the disappearance of Kyron Horman.

07:50 AM (Horman Residence, 15725 NW Sheltered Nook Rd, Portland, OR 97231)  Terri leaves home with Kyron and Kiara in Kaine's pick up truck.  Terri claims the pick up truck is required that day to bring Kyron's science project home from school.  Terri picks up DeDe at a location close to Skyline Elementary. DeDe's vehicle is parked out of sight.

Driving Time - 10 minutes

08:00AM - 08:20AM - (Skyline Elementary, 11536 NW Skyline Blvd, Portland, OR 97231)  Terri, Kiara, Kyron and DeDe arrive at Skyline Elementary.  Terri parks in front of the school.  DeDe remains with the vehicle.  Terri, Kiara (?) and Kyron head directly to the classroom where photos of Kyron and Kurtis are taken with their respective science projects.  Meanwhile ... DeDe moves Terri's pick up truck from the front of the school to a back exit.  Upon exiting the classroom Kyron's jacket and backpack are intentionally left behind on his desk.  Kyron is immediately taken unnoticed out of the school by Terri through a back exit to the waiting pick up truck.  Terri drives DeDe a short distance to retrieve her vehicle.

As part of Young's lawsuit, one of Terri Horman's friends, DeDe Spicher, was called in for a deposition in 2012, and she refused to answer 142 questions regarding the case. She cited her Fifth Amendment right.

However, Young's attorney on Tuesday referenced a new development in a recent grand jury meeting.

"It's my understanding that (Spicher) finally agreed to testify in front of the grand jury a week or two ago," said Elden Rosenthal, Young's attorney.

Young said she was hopeful Spicher provided good information to the grand jury, but did not speculate on what information that could be. Spicher appeared before the grand jury at least one other time, in July 2010.

"We don't know. But I think everything's a possibility," she said. "The fact that she hadn't talked up to now. We just don't know."

Why the silence from Desiree and Kaine if investigators are no longer focused on DeDe for answers in the disappearance of their son?  Think about it ... Kyron's parents receive continual briefings regarding updates and ... only info that could compromise the ongoing investigation are withheld.

Could it be that DeDe was being truthful when she revealed in the Blink interview that she passed a polygraph, received an immunity deal and testified before the grand jury?  However ... could it be that the rest of the interview was smoke and mirrors to prevent Terri and her attorneys from suspecting what dots were being connected behind the scenes ... dots derived from DeDe's grand jury testimony ... dots that would ultimately solve the Kyron Horman case?

The immunity deal cited by DeDe is what caused me to stop and consider.  I didn't buy the explanation.  Then there was the upholding of Terri ... the upholding to the e nth degree ... the upholding that went above and beyond the known truth when the "hate emails" and the "sexting" is taken into consideration.

A two-day hearing that was set to start Thursday on Terri Moulton Horman's motion for temporary custody of her daughter has been postponed, at her lawyers' request.

Her lawyers sought a delay late Monday.

Their request followed a ruling by Multnomah County Circuit Judge Henry Kantor who said he'd allow testimony from the Horman landscaper who said he was solicited by Terri Horman to kill her husband five months before her stepson Kyron Horman's disappearance from Skyline School in 2010.

The judge decided, however, that Terri Horman's lawyers could not question or cross-examine the landscaper, Rodolfo Sanchez, about his role in a later meeting with Terri Horman in which her lawyers argued he was acting on behalf of law enforcement in a failed sting operation after Kyron went missing.

Kantor Monday had asked lawyers from each side to submit additional legal briefs before the scheduled Thursday hearing on how the court should weigh Sanchez's testimony in the child custody case, since Terri Horman's lawyers would be restricted from delving fully into the landscaper's credibility.

Terri Horman hasn't seen her daughter Kiara, now 5, since shortly after her stepson disappeared, barred by a restraining order that Kaine Horman obtained against her when law enforcement informed him that Terri Horman allegedly had solicited a landscaper to kill him.

Despite the state's largest search-and-rescue operation, Kyron Horman has not been found, and no arrests have been made in the boy's disappearance or in the alleged murder-for-hire plot.

Terri Horman's lawyers said they needed more time to submit their legal briefs. Kantor has postponed Thursday's hearing. A new date has not been set.

Kaine has said there were more ups and downs in his marriage to Terri after the birth of their daughter 20 months ago. Still, Kaine says he never saw something like this coming.

KAINE HORMAN: Nothing so far one way or the other that would have even put that on my radar screen as something to worry about.

It was a pivotal moment for Kaine, the moment he stopped trusting his own wife, the woman who'd been helping raise his children. Authorities are still investigating the alleged murder-for-hire attempt, but if the allegation against Terri is true, many think it speaks volume about the mission to find Kyron.

KATE SNOW: Do you think she is capable of hurting a child?

KAINE HORMAN: If you asked me before this situation, my answer's no. Based on what I know now, I don't know. I think anything is possible based on the way things have gone over the past few weeks.

In June, a judge renewed a restraining order original filed by Kaine in June 2010 against his estranged wife that does not allow her contact with him or their now 4-year-old daughter Kiara. On July 8, the same day that Terri subpoenaed O’Donnell, Terri also filed a motion contesting the restraining order.

In its response, on July 13 Kaine’s attorney Peter Engel issued a motion for protective order. In it he wrote:

“Ms. Horman has been in seclusion for three years. She refuses to cooperate with law enforcement. She intends to exercise her privilege against self-incrimination. She has not contested the FAPA Order since it was originally issued in June of 2010. She has chosen to forego a relationship with the parties’ daughter Kiara, now four years old. Yet, she now expects to conduct one-sided discovery in a single day of depositions, and have a hearing, all while the case is stayed.”

The apparent logic is that Ms. Horman admits that if she speaks, she will incriminate herself in some as-yet-to-be-named crime related to Kyron’s disappearance, yet Mr. Horman is now supposed to trust her to care for his other child, because that’s so obviously in their daughter’s best interest.

Tamikosmom, Thank you for all of the re-hashing of old information and bringing in the new. I do feel what is most important at the moment is the new. There are pending criminal charges against Kaine. This means that regardless of old statements by LE, something drastic has changed and we will all have to wait to see exactly what that is. I am a betting woman and am betting that a new expert found evidence that disputes a prior false assumption. I have no idea what these charges will be, but it appears imminent and likely to dispute what was previously reported. If it has been found that evidence presented was fabricated that has to do with custody of Kiara being removed from Terri, then the prior restraining order will be invalidated and no real fight over custody will be needed for Terri.
Here is what is odd; Announcing pending criminal charges against the Petitioner in a written statement in a divorce decree. That is beyond odd. We can safely assume that the Petitioner and Attorney allowed this only based on a high likelihood of those charges having overwhelming evidence and thus moving forward.  Why haven't the charges been brought yet? I can surmise that 1. More evidence is needed 2. LE, going on a flawed belief brought damages to the wrong person in a case and are trying to right a wrong by at least allowing the divorce to settle so the Respondent can have some closure. If the Petitioner is sentenced to prison, the child support payments will be ceased. There is little likelihood that Kaine would allow this language in the divorce agreement unless he absolutely had to. Maybe it is just a HUGE oversight. Everything in this case is strange, so nothing would surprise me.

I've always suspected Kaine. He's been my number one suspect since I tied this entire crime together. And further, he's despicable for pinning it on his ex-wife who would be in jail and convicted except for a receipt from the Fred Meyer. Almost the perfect crime.

It's about time for the truth to come out and for the players in this plot to finally be their retribution, exposed. And it's going to be a plot that anyone wants to hear. Additionally, Kaine's buddy's in the police department deserve their retribution, but that's doubtful with the US Justice Department under Holder's control, but that wouldn't last much longer since he's under an Impeachment.

Can't wait to see Kaine get what's coming to him. And JANET - give it a rest with your allegations toward Terri.

Kaine did it to himself and his son.

Here are the possibilities -

1. Terri did it in under 9 minutes and disposed of a body. This theory gained credence by the lies of the police department.

2. And unknown pedophile did it and that was backed up by the words of Kyron's schoolmates. Others in the school, namely teachers urgently deflected and proffered this theory.

3. Kaine did it. This is the most likely scenario and backed up by the facts on the ground. Kaine gained access to the investigation and information he should have never been provided - thus the case stalled while Kaine ran interference.

It should be obvious to anyone that followed this case there is one reason why it has not been solved. Kaine and his access to the police investigation.

Apparently, Kaine is now under a formal investigation and that will lead to closure and the recovery of Kyron.

It's been right there the whole time.

Peace ... I also anticipate that something is about to break but I suspect that it has nothing to do with with any pending criminal charges against Kaine.  Could it be that 3 1/2 year worth of dots have been connected and indictments in the Kyron Horman case are imminent?   

Could it be the pending criminal charges against Kaine has nothing to do with the Kyron Horman case or the MFH case?  Could it be that these pending criminal charges have everything to do with the distribution of steroids?

The statement about Kaine carrying that much cash and making a mugging sound logical for that reason makes no sense. The mugger doesn't inform police of how much cash they took and if the victim is dead, he surely can't, so who would think that any random victim actually carries that amount of cash? Can you imagine a spouse saying " Oh, yes, my husband usually carries $10,000 in cash, so the random mugging went wrong dude just happened to hit the jackpot with my hubby." ? The logic seems to be from that of an imbecile.
If Kaine really carried $10,00 in cash, he would be a high level drug dealer.That in and of itself would take any LE down the road of dangerous liaisons. They would, in that case, expect that acquaintances in trafficking would be most likely suspects. IF it is drugs and IF he did carry that much cash on himself at all times..... that is a gun so smoking that it's red hot.

The filing alleges that Terri took the restraining order to Cook's home, where she showed him the document and allowed him to take cell phone photos of the document, which included Kaine's new address. He shared information from the restraining order with at least two other unidentified people, according to the court document.

The filing also stated that a police search of Cook's phone found that Cook had done a Google search to map Kaine's new address but that he told police he did not go to the residence.

The motion also states police told Kaine that Terri exchanged hundred of text messages with Cook and several photographs of Terri Horman "in various stages of undress and graphic sexual activity." Similarities to Murder-for-Hire plot

Monday's court filing also stated that police had told Kaine that Terri's "sexual overtures to Mr. Cook resemble those made to the man Respondent (Terri Horman) attempted to hire to murder Petitioner (Kaine)."

In the original restraining order filing, Kaine stated that police had told him Terri had tried to hire a landscaper to kill Kaine

Young and Horman say the full extent of Terri Horman's deceptions wasn't clear until after Kyron disappeared, when they and investigators began piecing the picture together in conversations with friends and acquaintances.

But Kaine Horman says he didn't fully believe his wife could be behind Kyron's disappearance until he learned about the alleged murder-for-hire plot. The Oregonian has reported Terri Horman offered to pay a landscaper to kill her husband six or seven months ago.

"Sometimes a mother's instinct can be pretty accurate, but at the same time, (my suspicion) was factual-based," she says. "I can't give you details, but some of what she was saying didn't match up with me. I'm familiar with the school, and I know how the school's set up, and some of what she's saying doesn't make sense to me."

There is a reason this went to a GJ and no arrest was made prior. The burdens on the state in a kidnapping/child endangerment/murder (unknown) case without recovering a victim, or physical evidence indicating bodily harm is very, very stringent.

I believe this was the pending decision Dan Staton was referring to weeks ago, whether to go this route.

Everyone believes TH is involved somehow, I agree to that, it is to what extent that has my brow up.

This does not make sense to me. They had enough probable cause to get a warrant to have the “sting” regarding solicitation, yet no charges are filed. They use that intel to contribute to RO’s and an emergency exparte order, which I can tell you in my jurisdiction would never have been granted without a sworn affidavit from LE, which would then have allowed it to remain sealed in an ongoing investigation.

You have Laura Rackner filing a motion seeking disclosure of $350K alleged retainer, with no evidence of same except to say “disclosed to a 3rd party”. Again, in my jurisdiction, motions are required to stand on their own merit because in most cases a tentative ruling is offered the day before the hearing is set, to expedite family court matters, which gives counsel an oppty to not have oral arguments, or be somewhat prepared to see how the court is leaning. You have a contempt motion that specifically references sexually graphic images that are similar to those (sic) that went to the landscaper.

My gut tells me there is one reason this woman has not been arrested yet, other than those I have already stated-

In her polly, regarding the question, did you arrange to have Kyron kidnapped, and do you know where he is- those answers were not deceptive. That is not a pass by any means, but it does go to intent or lack thereof.

For me, there is no question she let the vampire in the house, but then what?

Kyron did not leave with TH.

The key to this case as I have stated before, is Rudy Sanchez and his associates.

PORTLAND – Tuesday marks three years since Kyron Horman, who was seven years old at the time, vanished from Skyline Elementary school.

In an interview with KGW, Kyron's father Kaine said it was hard to believe three years had passed, but that he was still hopeful he’ll see Kyron again.

“There’s so many things I’d want to say. The last thing that I told him is that I loved him and I’d tell him the same thing,” Kaine said Monday. “I love you, man. Life’s not the same. And we miss you. And we’ve got so much to do together still.” ....

”Until we have any concrete information one way other another," he said, "we have to continue to pursue the fact that he’s still out there and that he’s going to be brought home. It's just a matter of when." ....

Meantime, Kaine Horman continues to speak out to Kyron. In his KGW interview, he urged his son to make a phone call or contact someone, and to immediately identify himself.

"We just want you back," Kaine Horman said, "so we can get back into that groove, and get you in with us to experience everything that we’re experiencing today."

(KOIN) -- Kaine Horman held a news conference Tuesday afternoon at the Wall of Hope, just hours after the mother of missing Kyron Horman said she dropped a civil suit that may have been keeping the boy's stepmother, Terri Horman, from revealing what she knows about his disappearance.

"We still have extreme confidence that they're going to drive resolution to the case," Horman said to reporters around 3:15 p.m. He said law enforcement is "again asking us to help protect the information as much as we can, so it doesn't interfere with the integrity of what they're doing. And we're doing our best in the civil arena to do that."

Court filings Monday also revealed that Terri Moulton Horman, Kyron's stepmom, was "sexting" her husband's high school friend, Michael Cook, on June 30, four days after Kaine Horman left the house with their young daughter and two days after he filed for divorce and a restraining order against his wife. .....

Terri Horman's attorney also alerted the court Monday that she would not contest her husband's restraining order or his push to force her out of their Portland home on Northwest Sheltered Nook Road. The restraining order restricts Terri Horman from any parenting time with their 20-month-old daughter Kiara. Yet, she would have the right to ask the court to reconsider at a later date.

In his brief letter to the court Monday, her attorney, criminal defense lawyer Stephen Houze, wrote that his client intends to seek a family law attorney regarding the pending divorce.

Meanwhile, Kaine Horman's lawyer, Laura Rackner, asked the court Monday to impose "remedial" sanctions against Terri Horman for disclosing Kaine's current address -- information that remains sealed in the restraining order -- to one or more unauthorized parties. She's seeking sanctions, ranging from a $500 fine to confinement for being in contempt of court.

Rackner and Houze expect to appear before Judge Keith Meisenheimer at 1:30 p.m. today  to set a date for a hearing on the contempt allegations.

Houze said Monday night he would not be making any comments on the latest allegations against Terri Horman, but added, "We will be vigorously defending her, I assure you."

In the court filings, Kaine and his attorney further allege that Terri Horman went to her husband's gym and tried to "abduct" Kiara from the gym's day care while he was working out on June 28, two days after he had moved out with the child and hours before Terri was served with a restraining order.

Law enforcement informed Kaine Horman that Terri Horman not only shared concerns about her marriage with Cook and made sexual overtures to him, but made similar overtures to the landscaper who she had attempted to hire to murder Kaine months before Kyron's disappearance, the filing says.

In an interview with law enforcement, Cook told authorities that Terri Horman let him photograph the sealed restraining order, photograph Kaine Horman's new undisclosed address, and he shared the information with at least two people.

Law enforcement found hundreds of text messages between Terri Horman and Cook, as well as photographs of Terri "in various stages of undress and graphic sexual activity" on Cook's cell phone, the filing says.

"While respondent at times, references the fact that she misses both children Kiara and Kyron, the significant majority of the material deals with social and personal matters between Mr. Cook and respondent and belies that assertion," Rackner wrote.

She added that Terri Horman asked Cook to lie to her own attorney and others about the fact that she had gone to Cook's home.

PORTLAND, Ore. – KATU now knows that friends purchased cell phones to communicate with the stepmother of missing Kyron Horman after the second grader disappeared two months ago.

Additionally, one of those friends did so using a fake name, according to multiple sources on Friday.

A friend of Terri Horman said the secret phones were intended to provide some level of privacy with their conversations, which they felt were being monitored by law enforcement.  She said they also wanted to use phones with numbers not known to the press.

The phones were purchased after Kyron's father, Kaine Horman, moved out of the family's home.

The friend, who is not DeDe Spicher, went to the Lloyd Center and bought a prepaid cell phone at an electronic store. The friend now says she regrets using a fake name and that it was “stupid” and “spur of the moment.”

She said the phone she bought was for herself to use and not for Terri Horman.

She insists the three of them – DeDe, Terri and her – only got the phones because the new AT&T service would allow them to make calls out of the Horman home at Shelter Nook Road. The home is in a remote area that does not receive Verizon service, which is what the friends had.

She insists she’s not guilty of anything besides trying to be supportive of her friend, Terri. However, the friend said the more she has worked with investigators the less support she has given Terri. She said she has turned over cell phone records, business phone records and all relevant e-mails to investigators.

It also has been confirmed that at least one of the phones was purchased by DeDe Spicher.

What remains unclear is why two additional prepaid phones were purchased at another store in downtown Portland the next day under the same fake name used at the Lloyd Center. The friend said she knows those phones were paid for in cash but she did not make the purchase.

with the timeframe TM-H is saying she saw kyron going down hall to class, i think the
time she said, is prob the time kyron was with ?, and with teacher permission, and for

It unbelievable to me that DeDe had not read the released redacted texts between Terri and Michael prior to the September, 2013 Blink interview ... released redacted texts which reveal that Terri can be untruthful to hide wrongdoing and that the definition of Terri's behaviour can be define by most as over and above "flirtatious".

The filing alleges that Terri took the restraining order to Cook's home, where she showed him the document and allowed him to take cell phone photos of the document, which included Kaine's new address. He shared information from the restraining order with at least two other unidentified people, according to the court document.

The filing also stated that a police search of Cook's phone found that Cook had done a Google search to map Kaine's new address but that he told police he did not go to the residence.

i dont understand about the awarded child support, i thought that child support was only set, when
custody was decided, so is TM-H paying support from the time of separation, until divorce, then when
custody is decided, and if kaine gets full custody she will have to pay more,and a new amount will

When the words of of Portland Public Schools spokesperson Matt Shelby are considered ... IF a member of the faculty at Skyline had observed Kyron WITHOUT Terri on the morning of June 4, 2010 ... he/she had not come forward to authorities by July 21, 2010.

Could this be the reason the depositions of school faculty by Terri's attorneys in preparation for the upcoming custody hearing have become non-issues?  Could it be that these depositions would only negate the claims of Stephen Houze that his client was not the last known person observed with Kyron on the morning of June 4, 2010?

Surveillance collected for Kyron case

PORTLAND, Ore. - Investigators have collected surveillance videos from local grocery stores in the disappearance of Kyron Horman, sources said.

The corporate offices of Fred Meyer and Albertsons both confirmed to KATU News on Friday they are cooperating with investigators in the Kyron Horman case.

Officials with Albertsons said they’ve turned over surveillance video from their store on Beaverton-Hillsdale Highway on June 4, the day the Skyline School second-grader disappeared.

PORTLAND -- Terri Moulton Horman's divorce attorneys will not be allowed to interview a lead investigator in the disappearance of her stepson, Kyron Horman, and the alleged murder-for-hire plot against her husband, Kaine Horman, a judge announced Monday.

Investigators said for years that Terri Horman was the last person to see Kyron before he disappeared from Skyline Elementary in July, 2010. But her attorneys said Friday that was not the case.

Judge Kantor Monday granted a motion filed by Kaine Horman's attorneys to stop Terri Horman's attorneys from questioning deputy O'Donnell.

However, Terri Horman's attorneys can conduct their own investigation. They will be allowed to interview witnesses, including teachers at Skyline Elementary and employees of Fred Meyer, Magic Cleaners and 24-hour Fitness. They will not be allowed to question Skyline students.

Prior to his June 4 disappearance, Kyron Horman’s stepmother, Terri Horman, informed his teacher he had a doctor’s appointment on Friday, the sources said, and it was why there was no expectation Kyron would be in class after the science fair. Once class began at 10 a.m., his teacher marked him absent.

According to sources, investigators believe Terri Horman was vague about which Friday she was referring to when she gave notice to the school Kyron would be gone and only after he was missing did she clarify that the doctor’s appointment was on June 11, the Friday after the science fair.

Could it be that it was determined by Terri's attorneys that an investigation may reveal that Terri not only had knowledge of wrongdoing but was involved to some extent?

Could it be that 2014 will bring some closure to the nightmare Kyron's parents have been forced to endure for going on 4 years?  When I stop and consider that Kaine and Desiree do not have a clue whether their little boy is dead or alive and can only pray he is in an environment where he is not at risk if he is not deceased ... I cannot comprehend how they hold it together.  Considering LE continues to brief Kaine and Desiree that there is probable cause to suspect that Terri is involved in the disappearance of Kyron. ... I believe that these two have shown unbelievable restraint.   If I was in their place I would have lost it.

Could it be that the misunderstanding regarding the date of the appointment was intentional on Terri's part?  Could it be that the teacher was misled to believe that Kyron had a doctor's appointment June 4, 2010?  Could it be that Terri realized that the intentional misunderstanding implied there would be no concern encompassing Kyron's absent following the picture taking session in the classroom?  Could it that the intention misunderstanding also implied that the premeditated plans for the morning of June 4, 2010 could proceed accordingly?

Captain Jason Gates' words in a news release 2 1/2 weeks following the disappearance imply that no credible witness had yet come forward to report that she/he had seen Kyron at the school following Terri's departure on the morning of June 4, 2010.  The words of Terri's attorney to the court on September 13, 2013 imply the contrary.

On September 16, 2013 ... the judge gave Terri's attorney the green light to depose Skyline faculty as well as employees of various business establishments.  Why has there been only silence encompassed these depositions?  Could it be that there is no credible witness who saw Kyron without Terri on the morning of June 4, 2010?

Court records indicate that Terri Horman's lawyers subpoenaed O'Donnell, as well as three Skyline School employees  Kyron's second-grade teacher Kristine Porter, kindergarten/first grade teacher Easter Mathews and school secretary Susan Hall. They subpoenaed to depose three children who attended Skyline School, and staff of Fred Meyer, Magic Cleaners and 24 Hour Fitness.

The depositions, Horman's lawyers argued in court Friday, are necessary to gather information to defend Terri Horman as a fit parent who deserves to spend time with her daughter, Kiara, a 4-year-old. Terri Horman hasn't been permitted to see her daughter in more than three years. Kiara has lived exclusively with her father.

What would Terri's attorneys glean from the court's ruling which prevents them from deposing Rudy Sanchez in regards to the sting?  Could it be that Terri's attorneys are now aware that revealed investigative evidence gathered from the sting has the ability to compromise the Kyron Horman case?  Think about it.  Peter Bunch has acknowledged that the State has his client in the cross-hairs of the investigation.

Could it be that Terri's attorneys gleaned from this ruling in favour of their motion that if deposed NOTHING would come forth from the lips of these alleged witnesses that would have the ability to compromise the Kyron Horman investigation and ... NOTHING would be revealed that had the ability to assist in the defence of their client in regards to her being deemed the last known person seen with Kyron?

Could this be the reason that silence has encompassed these depositions since the middle of September, 2013.

If depositions are forthcoming that will uphold Peter Bunch's claim ... I will eat an entire humble pie.

PORTLAND – A judge in the civil lawsuit of missing Portland boy Kyron Horman has issued his decision not to grant a stay in the civil case, and laid out rules for attorneys to gather evidence.

Last week, a judge denied the motion by Kyron's stepmother Terri Horman to delay the civil lawsuit filed against her by the boy's mother Desiree Young.

Judge Henry Kantor referred to her as a “prime suspect” in the investigation, although Terri Horman has never been formally named a suspect in any criminal case.

Judge Henry Kantor made the ruling last week following a request from Multnomah County District Attorney Michael Shrunk.

Shrunk wrote in his request that information from the civil case could jeopardize their ongoing investigation into Kyron’s disappearance.

On June 28, 2013 a restraining order preventing Terry access to her daughter was served and she was also being forced out of her home but ... Terry's attorneys did not challenge.  Why?

When all is said and done ... does Stephen Houze and Peter Bunch REALLY want to depose investigator Bobby O'Donnell in regards the "probable" cause to believe the allegations that Terri was involved in Kyron's disappearance as well as a MFH attempt against Kaine ... the allegations that formed the foundation of the restraining order?

Also could it be that Stephen Houze is also bluffing when he states that he wants to depose Rudy Sanchez in regards to what was gleaned by LE during the recorded sting?

Could it be that over three years later in June, 2013 Terri's attorneys finally made the decision to challenge the restraining order by taking full advantage of Don Rees' refusal to compromise the ongoing investigations in the releasing of investigative documents that could implicate their client in wrongdoing?

Think about it.  The judge ruled on September 17, 2013 in favour of the motions filed by Terri's attorneys ... the motions requesting permission to depose Skyline faculty as well as staff of designated businesses.  As it currently appears these depositions have yet to happen.  Could it be that Stephen Houze was bluffing when he asserted that the questioning of these alleged witnesses would further his claim that Terri was not the last known person to be seen with Kyron?  Could it be that Don Rees called his bluff because investigators were aware that NOTHING these alleged witness revealed would further the defence of Terri?

Could it be that Bunch and Houze believed that the depositions of employees from the establishments that their client entered on the morning of June 4, 2010 WITHOUT Kyron would somehow affirm that he had been left at the school as Terri claimed?  One problem!  The owner of Magic Cleaners stated to media that not only was Kyron not with Terri ... neither was Kiara.  Terri was alone!!  Where was Kiara?  Who was watching Kiara?

Somehow I doubt that a deposition from Sari Shanti ... the owner of Magic Cleaners ... will be forthcoming.

PORTLAND -- Terri Moulton Horman's divorce attorneys will not be allowed to interview a lead investigator in the disappearance of her stepson, Kyron Horman, and the alleged murder-for-hire plot against her husband, Kaine Horman, a judge announced Monday.

Investigators said for years that Terri Horman was the last person to see Kyron before he disappeared from Skyline Elementary in July, 2010. But her attorneys said Friday that was not the case.

Judge Kantor Monday granted a motion filed by Kaine Horman's attorneys to stop Terri Horman's attorneys from questioning deputy O'Donnell.

However, Terri Horman's attorneys can conduct their own investigation. They will be allowed to interview witnesses, including teachers at Skyline Elementary and employees of Fred Meyer, Magic Cleaners and 24-hour Fitness. They will not be allowed to question Skyline students.

Missed reading your posts too so had to pop in & see whats new. Hope u r doing well! Still waiting patiently to see some final justice in the jodi arias case.

Anticipating line-ups at the border ... youngest son, DIL, Hubby and I declined an invitation to a post-game dinner in Bellingham.  We drove right though the crossing flashing our passports with son waving a Seahawk's flag.  However ... it won't be long before the traffic from Seattle will be reaching the border and the nightmare will begin.  We had a great time!!

Jodi Arias?  Real justice for Travis implies Jodi is sentenced to death but I will consider it a measure of justice if she never experiences freedom again.

However ... when it comes to the Kyron Horman case and the Dylan Redwine case as well as other cases discussed on SM forums any forum justice remains elusive.  Indictments are not forthcoming despite each respective investigation having a focus.

It is my hope that investigative dots are being connected in the Kyron Horman case and arrests will happen sooner than later.

IF the "pending federal charges" against Kaine that are referenced in the divorce document pertain to the steroids revelation referenced in the DeDe/Blink interview ... somehow I suspect Terri's attorneys will be treading softly ... Terri's attorneys who have known but kept silent on the issue for over 3 1/2 years.  When did they report the "federal crime" to authorities?  Then there was Terri ... Terri who had kept silent but allegedly had prior knowledge.

Think about Kaine's words in the following interview.  Could it be IF these "pending federal charges" against Kaine are realized ... there may be some investigative fingers pointing back at Terri.

Considering Terri's attorney has been prevented by the court from allegedly "proving" his client's innocence in regards to the MFH plot against Kaine ... maybe Peter Bunch should be deposing the faculty of Skyline and staff from local establishments.  Bunch claims these alleged witnesses could prove Terri was not the last known person seen with Kyron on the morning of June 4, 2010.  These depositions were given the green light by the judge on September 16, 2013.  The silence since has been deafening.  Could it be that Terri's attorneys were mislead in regards to the ability of these alleged witnesses to further the defence of their client in her quest for custody of Kiara?

At the end of the day, past all the adult stuff, drama, accusations, lies, etc.  I look at this photo of Kyron and it brings it all home.  Where is he?  It seems like we've waded through so much over time.  Where is Kyron?  Are we any closer to knowing what happened to seven year old Kyron while he was at school?

I don't know about "we" but those involved in the Kyron Horman case have knowledge and ... in ongoing briefings that knowledge is being conveyed to Kaine and Desiree.

If Kyron's parents who are on a desperate quest for the truth imply in statements, interviews and press conferences that Terri is behind the disappearance of their son ... I have their backs.  After all ... the Kaine and Desiree is derived from an official foundation.

It may be wishful thinking but my hope is the dots are being connected in a 3 1/2 year layered and far reaching investigation; indictments are forthcoming and justice will prevail for Kyron.

Chief Deputy District Attorney Don Rees has filed a separate motion to limit Terri Horman's deposition of Kaine Horman.

Because Kaine Horman is the victim of "an apparent crime against his own child,'' he has a legal right to information about his missing son, Rees argued.

"The fact that law enforcement has necessarily conveyed this information to Kaine Horman does not waive the longstanding and well-recognized privileged and confidential nature of information relating to a pending criminal investigation,'' Rees wrote.

To maintain the integrity of the investigation ... Kaine and Desiree may not reveal the investigative details that implicate Terri in the disappearance of their son.  Nevertheless ... what they do share is not pulled out of thin air ... it is gleaned from official sources during ongoing briefings.

Unless confirmed otherwise from identified credible sources ... the foundation of my speculations encompassing the Kyron Hormon case will continue to be derived from the words/quotes of Kaine, Desiree and official sources within the judiciary and investigation.

Example:

1. If a spokesperson for the investigation states in a release that Terri is the last known person seen with Kyron ... Terri is the last known person seen with Kyron.

2.  If a member of the judiciary states that Terri can be considered the prime suspect within the Kyron Horman investigation ... Terri can be considered the prime suspect within the Kyron Horman investigation.

3.  If Kyron's parents continue to state that ongoing briefings with investigators have convinced them that Terri is behind the disappearance of their son ... then Terri is behind the disappearance of their son.

In other cases I have been accused of suspecting a conspiracy when there is none.  In the Kyron Horman case I do not suspect a conspiracy.  It is my contention that Kaine and Desiree ... who do not have a clue whether they precious son is dead or alive ... safe or at risk ... are desperately seeking the truth.  IF they were not convinced that Terri was withholding that truth ... their focus would not be on Terri ... their focus would have taken another direction long ago.

Terri Horman, the boy's stepmother and the subject of Young's suit, was the last person known to have seen Kyron. He was 7 when he disappeared June 4, 2010. The civil lawsuit accuses Horman of kidnapping Kyron, by herself or with help.

Kyron's father Kaine Horman said police have growing evidence against Terri.

Could it be the Kaine and Desiree were privy from the get go to the existence of a "secret" sealed indictment targeting Terri's as one participant in the disappearance of Kyron?

Could it be that the 3 1/2 year investigation has been all about connecting the dots in regards to other participants in the chain of events encompassing the morning of June 4, 2010 ... a chain of events that could provide the link tha could lead to the return of Kyron?

Could it be that this is the reason that Kaine and Desiree have not filed a lawsuit holding PPS accountable for the disappearance of their son on their watch?

Think about it.  3 1/2 years later those involved in the Kyron Horman case insist there is an ongoing active investigation ... an ongoing active investigation that will not permit current lawsuits to compromise.

Divorce for Kaine, Terri Horman finalized at emergency hearing

This month, the proceedings seemed to be moving forward as court documents outlined Terri Horman's desire to seek temporary custody of the couple's 5-year-old daughter, Kiara.

The girl has been with her father since June 2010.

Kaine Horman's legal team argued visitation for Terri Horman would only traumatize their daughter.

However, court documents filed by Terri Horman's attorneys cited information from a deposition of Kaine Horman, where he stated they were "average" parents and admitted Terri Horman cared for Kiara between 50 and 75 percent of the time, "at minimum."

The resolution of custody, or parenting time with Kiara was not finalized in Tuesday's divorce agreement.

Kaine Horman's lawyer tells FOX 12 that the decision regarding Kiara is being postponed until after a custody and parenting time evaluation is undertaken by a doctor. 

After that evaluation, there is a court date set in June to resolve Custody issues.

In the meantime, court documents do state that Terri Horman's is responsible for paying $224 a month in child support.

Kiara is set to start kindergarten in the fall of 2014, according to the court documents, and child support will be recalculated at that time to take into account possible new day care costs.

Another hearing is scheduled for Jan. 12.

911 calls made before missing Oregon boy's father moved out

PORTLAND, Ore. - There were not one, but two 911 calls placed from Kyron Horman's home last Saturday night, the Bureau of Emergency Communications confirmed Wednesday.

A log of the calls revealed the first report came in at 5:18 p.m. and lasted 13 minutes. Dispatchers said the caller reported threats made inside the family's home in Multnomah County.

The second 911 call was made from the home at 11:39 p.m., and was recorded by dispatchers as a child custody issue.

The calls came on the same day Kyron's father, Kaine Horman, moved out of the family's home, taking the couple's 18-month-old daughter, Kiara Horman, with him. The Bureau of Emergency Communications wouldn't disclose the identity of the caller.

Two days after the calls were made, Kaine Horman filed for divorce from his wife and the missing boy's stepmother, Terri Horman, and was granted a restraining order against her. The order bars Terri Horman from being near the couple's daughter and owning a firearm.

Judge Keith Meisenheimer sealed the restraining order out of fear its content might jeopardize the ongoing investigation into the disappearance of the boy, who vanished some time after his stepmother left him at his Portland elementary school on June 4.

PORTLAND, Ore. -- E-mails written by Terri Horman and obtained by FOX 12 give insight into her reaction the day her husband moved out of the family's northwest Portland home with their daughter.

Horman -- the stepmother of missing 7-year-old Kyron Horman -- wrote an e-mail June 26 accusing her husband of illegally taking the toddler.

"OK, I love you but this is ridiculous. What you are doing is parental child abduction and is illegal. I need to know where my daughter is and if she is safe. You were really upset with me when you left. What is it that I/we need to do to reconcile this? I don't want to call 911 but I need a resolution please. If I don't hear from you in an hour I will call 911," Terri Horman wrote to Kaine Horman.

About an hour later, Terri Horman e-mailed a friend and said she called 911 but was directed to a non-emergency dispatcher.

"Guess what? Since we are married we have joint custody and he can do that. Gee, too bad I didn't know that," she wrote.

Why did Terri not bring Kyron's project home?  If she left the school prior to the end of the science fair ... why did she not return to retrieve it prior to going home?  Why did she not pick up both Kyron and the project at the end of the school day?

For 3 years Terri's attorneys made the choice not to legally challenged the restraining order that has prevented their client from any contact with her daughter.  What changed in 2013?  Could it be that Terri's attorneys took the chance that ...  akin  to Desiree's lawsuit and Kaine's divorce petition ... investigators would continue to keep a tight rein on incriminating  investigative evidence against their client in BOTH the Kyron Horman case and the MFH case?  Could it be that Terri's attorneys made the decision to also take advantage of their client's constitutional right to plead the fifth when being deposed?  In other words ... Kaine is between a legal rock and a legal hard place in his quest to protect Kiara?

Could it be the 2013 challenge of the restraining order by Terri's attorneys will force those involved in the ongoing investigations to make hard choices on behalf of Kiara's well being?  Could it be that indictments will be handed down sooner than later?  Could the emergency divorce hearing of December 31, 2013 pave the way?

When I consider the Dylan Redwine case ... the Hailey Dunn case ... the Susan Powell case and ... other cases with an investigative focus that have been discussed on SM forums ... I sometime have moments when an underlying fear engulfs me that justice will also remain elusive for Kyron.

It is my prayer that investigative dots are being connected behind the scenes in all these cases ...  dots that imply justice will be realized and ... a measure of closure will be afforded.

One day following the disappearance of her stepson ... Terri claimed in an email that Kyron was observed in the company of two girls and a "man" following her departure from Skyline.  However ... 2 1/2 weeks following the disappearance ... in an official investigative statement ... Captain Jason Gates informs that Terri was the last known person seen with Kyron.  It would make sense that Terri's claim was investigated and it was determined that the alleged sighting did not happen.  2 - 2 1/2 weeks into the investigation ... Gates words imply that ANY alleged sighting of Kyron without Terri was investigated and ruled out.

When all is said and done it is my contention that Kaine and Desiree ... who have lived each day for over 3 1/2 year not having a clue whether their precious son is dead or alive ... safe or at risk ... are desperately seeking the truth.  IF they had not been convinced by investigators that Terri was withholding that truth ... their focus would not be on Terri ... their focus would have taken another direction long ago.

I just received an email from a contact informing me that she read/heard that Terri's attorneys filed new documents yesterday regarding the custody of Kiara.  I don't have a clue how to access these documents.  Could you please help?  Your research skills are amazing.  I did do some googling (Is that a word?) but could not come up with any article pertaining to these documents.

A two-day hearing that was set to start Thursday on Terri Moulton Horman's motion for temporary custody of her daughter has been postponed, at her lawyers' request.

Her lawyers sought a delay late Monday.

Their request followed a ruling by Multnomah County Circuit Judge Henry Kantor who said he'd allow testimony from the Horman landscaper who said he was solicited by Terri Horman to kill her husband five months before her stepson Kyron Horman's disappearance from Skyline School in 2010.

The judge decided, however, that Terri Horman's lawyers could not question or cross-examine the landscaper, Rodolfo Sanchez, about his role in a later meeting with Terri Horman in which her lawyers argued he was acting on behalf of law enforcement in a failed sting operation after Kyron went missing.

Kantor Monday had asked lawyers from each side to submit additional legal briefs before the scheduled Thursday hearing on how the court should weigh Sanchez's testimony in the child custody case, since Terri Horman's lawyers would be restricted from delving fully into the landscaper's credibility.

Terri Horman's lawyer Peter Bunch argued in his motion for a delay that Kantor's ruling "raises significant legal and constitutional issues.''

Restricting his client from cross-examining Sanchez about all relevant matters would violate Terri Horman's "constitutional rights to due process and would prejudice'' her from prevailing on her motion to reunite with her daughter, Bunch wrote.

Terri Horman hasn't seen her daughter Kiara, now 5, since shortly after her stepson disappeared, barred by a restraining order that Kaine Horman obtained against her when law enforcement informed him that Terri Horman allegedly had solicited a landscaper to kill him. A civil no-contact order is now in place, since the restraining order was dismissed earlier this year. ....

Terri Horman's lawyers said they needed more time to submit their legal briefs. Kantor has postponed Thursday's hearing. A new date has not been set.

There are two allegations documented in the restraining order against Terri ... the restraining order that has prevented a mother from contact with her daughter for over 3 1/2 years.  The allegations that must be defended by Terri's attorney are:

1.  Investigators have probable cause to believe that Terri is behind the disappearance of Kyron and ...
2.  Investigators have probable cause to believe that Terri was behind a MFH plot against Kaine.

Terri's attorney are being prevented from question Rudy Sanchez in regards to the sting which involved law enforcement.  However ... the judge's ruling has afforded these attorneys the green light in their motion/quest to "prove" that ... contrary to the claim of LE ... Terry was not the last known person to have been seen with Kyron.  To my knowledge Terri's attorney have not travelled the road taking them through the green light ... the road that could potentially blow the Kyron Horman case wide open.  Why?  Could it be akin to my grandfather's words ... "All Smoke; No Fire."

Could it be that Peter Bunch's motion to question Rudy Sanchez in regards to the sting of June 26, 2010 is all smoke and mirrors?  Don Rees has stated that the questioning of Sanchez in regards to the sting would compromise the KYRON HORMAN INVESTIGATION.  Would Bunch take a chance that Sanchez testimony would implicate his client in wrongdoing?

Think about it.  The judge gave a green light to the motion filed by Terri's attorneys in regards to the  deposing of faculty from Skyline and staff of businesses ... witnesses who allegedly  could prove that Terri was not the last known person with Kyron.  To my knowledge ... Terri's attorneys have not proceeding through that green light.  Why?

Terri Horman fights to question landscaper

PORTLAND -- Terri Horman's lawyer wants to question the family landscaper in connection with an alleged murder-for-hire plot against her estranged husband Kaine Horman.

The issue first came up during divorce proceedings, but has resurfaced as the two sides prepare for a custody battle.

Last month a judge ordered that Terri Horman's lawyers could not cross-examine Rodolfo "Rudy" Sanchez about a brief 2010 meeting with their client. Police helped set up the sting operation after Terri Horman's stepson Kyron disappeared from Skyline School on June 4, 2010.

In a recent court filing, Horman's lawyer wrote: "There is no more important decision for the court to make regarding custody and parenting time in this case than its decision regarding the scope of the Sanchez testimony and the circumstances surrounding his involvement with law enforcement."

the judge, attorneys, plaintiff, respondent and others involved with the Kyron Horman investigation were privy to the contents of the then sealed restraining order that prevented Terri from contact with her daughter.  The instructions within the restraining order were that the contents were not to be revealed by those listed.

THE STRATEGY?

Could it be that all those listed in the sealed restraining order who were privy to its contents could also be privy to the contents of existing "secret" indictments against Terri that were sealed at the get go?  Could it be that the strategy of Terri's attorneys is to have the contents of possible existing sealed indictments exposed and thus compromise both the Kyron Horman investigation and the MFH investigation?  In other words ... the custody of Kiara may not be the issue.  Coulit is be all about Terri's freedom?

Think about it.  Four days following Kaine's departure from the home on June 26, 2010 with their daughter and ... two days after being served with a restraining order on June 28, 2010 preventing Terri from any contact with Kiara ... Terri began sexting with Michael Cook.  Hundreds of texts!!!  In my world this is not a demonstration of a mother's love.  It is all about self.

When all is said and done it is my contention that Kaine and Desiree ... who have endured each day for over 3 1/2 year without any clue whether their precious son is dead or alive ... safe or at risk ... are desperately seeking the truth.  IF they had not been convinced by investigators in ongoing briefings that Terri was the last known person to be seen with Kyron ... convinced that Terri was withholding that truth ... their focus would not be on Terri ... their focus would have taken another direction long ago.

The unsealed restraining order does not provide detailed backup but could it be that Kaine has been in the know in regards to the detailed backup from early on?

Nevertheless ... it makes sense that the detailed backup would be optional to motivate any father to grab his infant daughter and flee IF investigators had informed him that there was probable cause to suspect that his significant other had disappeared his son and had attempted a MFH against him.

Details Of Horman Restraining Order Unsealed

PORTLAND, Ore. -- A Multnomah County judge unsealed a restraining order filed by Kaine Horman a day after the county's district attorney said its contents wouldn't undermine the sheriff's criminal investigation.

Citing media coverage over the past weekend, Norm Frink, the county's chief deputy district attorney, said in a letter Wednesday the restraining order no longer needed to be sealed.

In the order, filed June 28, Kaine Horman stated he believed his wife was involved in the disappearance of their 7-year-old son, Kyron.

"I believe the respondent is involved in the disappearance of my son Kyron who has been missing since June 4, 2010. I also recently learned that respondent attempted to hire someone to murder. The police have provided me with probably cause to believe the above two statements are true," according to the order.

Kaine Horman took his 19-month-old daughter and moved out of the couple's northwest Portland home after learning of the allegations involving his wife. He filed for divorce and for a restraining order against Terri Horman on June 28.

On Tuesday, an attorney for FOX 12 and other members of the media asked the Oregon Supreme Court for help getting access to the restraining order.

Judge Keith Meisenheimer sealed the restraining order last week. Meisenheimer said he was trying to protect the integrity of the investigation into Kyron's disappearance.

Sheriff's deputies said Terri Horman was the last person to see 7-year-old Kyron Horman on June 4, the day he disappeared from his northwest Portland grade school. Desiree Young, Kyron's biological mother, has since made public pleas for Terri Horman to cooperate with investigators.

Kaine Horman argued in court files today that his estranged wife, Terri Moulton Horman, is an "emotionally disturbed individual focused on her own needs rather than the needs of Kiara or my missing Kyron."

I have the backs Kaine, Desiree and those within both the Kyron Horman and MFH investigations.  In his legal briefing dated January 23, 2014 Peter Bunch alleges that both these investigations are no longer active.  He can only wish.

The compromising of the investigations!  The well-being of Kiara!  Could it be that the contesting of the restraining order by Terri after three long years ... the contesting of the restraining order that places investigators between a rock and a hard place ... implies that dots may be currently connected behind the scenes in a layered and far reaching investigation?  Could it be that indictments will be forthcoming sooner than later?

Kaine, MCSO committed to 'bringing Kyron home'

Just minutes before Kaine Horman's news conference, the Multnomah County Sheriff's Office sent out the following statement on the Kyron Horman missing person's case:

"We continue to work with our investigative partners and the Multnomah County District Attorney's Office as we maintain the case integrity, development of leads and information gathered through the course of the investigation.

"The Multnomah County Sheriff's Office remains in close contact with the parents of Kyron regarding the course of the investigation.

"In addition, Sheriff Staton has met regularly with Kaine Horman concerning the investigation and to ensure they are fully aware of the current course of action being taken by investigators.

"Sheriff Staton wants the citizens of Multnomah County to know this criminal investigation remains a high priority for the Sheriff's Office and that it will continue unimpeded. The integrity and security of the investigation remains foremost for this agency.

"The Multnomah County Sheriff's Office is unable to comment on specifics of the investigation but would like to reiterate its commitment to finding and bringing Kyron home and bringing closure to Kyron's family and the investigation.

But Terri Horman's lawyers will not be allowed to cross-examine Sanchez about his last 15-minute meeting with their client, organized as a sting operation by law enforcement after her stepson Kyron Horman's disappearance from Skyline School in June 2010, a judge ruled Monday.

The judge asked Multnomah County Chief Deputy District Attorney Don Rees what the statute of limitations is for attempted murder-for-hire. Rees said it's at least six years. State law says there's no statute of limitation for solicitation to commit murder.

"Nothing said this morning changes where we were a month ago, two months ago. Nothing has changed. The state, to the extent possible, has sought to keep in its control the details of the criminal investigation surrounding the disappearance of this little boy, Kyron Horman,'' Rees said. That would include further information from Sanchez, he said.

Terri Horman's lawyers continue to press court to allow further questioning of landscaper

Terri Moulton Horman's lawyers argue in court papers that their client would be unfairly prejudiced in her pending child custody case if they cannot further question her former landscaper about his involvement with law enforcement.

"There can be no more important decision for the court to make regarding custody and parenting time in this case than its decision regarding the scope of the (landscaper's) testimony and the circumstances surrounding his involvement with law enforcement,'' attorney Peter Bunch wrote in a legal brief filed Thursday in Multnomah County Circuit Court.

Multnomah County Judge Henry Kantor ruled that Kaine Horman's lawyer can call the landscaper, Rodolfo Sanchez, as a witness to testify about the alleged murder-for-hire plot in the custody case, but that Terri Horman's lawyers can't cross-examine Sanchez about his communications with investigators. The judge said those details are protected by "law enforcement privilege.''

But the judge has invited each side to submit legal briefs to guide him on how he should use Sanchez's testimony for the custody case. Kaine Horman's response is due by Feb. 10 and oral argument is set for Feb. 12 at 9 a.m.

It makes sense that the above quote implies that as of September 14, 2012 no witness had come forward to authorities to report a confirmed Kryon sighting following Terri's departure from the school.  Who are the witnesses that Peter Bunch is referencing?  Unless Bunch's allegation bears some fruit ... I do believe that Captain Jason Gates was citing the truth in the America's Most Wanted interview with John Walsh.
