Casey Anthony asks judge to throw out Zenaida Gonzalez's punitive damages claim

Attorneys for Casey Anthony in a pair of new court filings continue their attempt to limit testimony in her upcoming civil defamation trial, and also to limit the amount of money Anthony could be ordered to pay if she loses.

In a new motion filed Monday, Anthony's lawyers ask the judge to throw out Zenaida Gonzalez's claim for punitive damages — essentially, an additional penalty meant to punish Anthony.

Based on the evidence and argument presented in the lawsuit so far, "there is insufficient evidence to support a claim that Ms. Anthony is personally guilty of intentional misconduct or gross negligence," Anthony's defense says.

In a separate filing, Anthony's lawyers also asked Circuit Judge Lisa Munyon to prevent Gonzalez's lawyers from arguing at trial that Anthony's actions had a negative impact on Gonzalez's children

In interviews, Gonzalez has said that being linked to the ultra-high-profile case upended her life and those of her children. But Anthony's lawyers argue the impact on Gonzalez's children is irrelevant and inadmissible.

"The 'impact' on Plaintiff's children cannot be used to bolster the frivolous claims that have been brought in this lawsuit," a new defense motion states.

The lawsuit is currently set for trial in January. Anthony, 26, was acquitted on all major criminal charges in the death of her daughter after a high-profile murder trial last year.

The woman who was acquitted in the murder of her young daughter will not have to answer the charges filed in a bizarre lawsuit.
 
A woman in Pennsylvania sued Casey Anthony for $3 billion dollars. According to Radar Online, Naomi Riches claimed Anthony caused her “emotional and mental distress” after she threatened to kill her. A judge dismissed the lawsuit.
 
Documents obtained by Radar Online show the lawsuit also accused Anthony of working with HLN host Nancy Grace to “fill the media with propaganda so that American Citizens believe there is Justice in this country.”

I am so sick of Casey, her mother and her father..add in her brother..and any other hangers on..I just don't even know why the press uses ink or any of these people.  It infuriates me that these people participated in a murder, Casey..the cover up ..her family ..and they still walk free..much less get any press space or attention.  I wish this whole money grubbing, whoring family would just not get a another word written in the press..not even an obituary..they are not deserving of anyone's attention..

Yes I am that cold hearted bitch..I think Caylee's death and the farce of a trial was enough to last a life time...no more press for the money grubbing whore Anthony's.

I agree with you.  This whole family should be pariahs of society, not media royalty.  As much as I mourn Caylee's death and lack of retribution for those who were involved directly and indirectly, I rejoice that the innocent has been spared living among the serpents called "family."   ::CowboySmiley::

Casey Anthony trial: Will judge move civil suit away from Orlando?

Casey Anthony's attorneys will try to convince a judge next week that the courthouse where she faced a murder charge is no place to try her defamation case — Central Florida, the defense argues, is simply too jaded for Anthony to find an impartial jury.

The request is unusual because it comes in a lawsuit, not a criminal prosecution, and it raises several questions:

Is Orange County, more than a year after Anthony's acquittal, still too tainted for the notorious former defendant to find a jury? Would anywhere else in the state be better? And who would pay to move the trial?

To say civil cases are very rarely moved because of pretrial publicity is an understatement: According to a court administration spokeswoman, no such motions have been granted in the Orange-Osceola circuit in the past 24 years.

Anthony's finances — already an issue in the lawsuit — could factor into her change-of-venue request: According to Bill Sheaffer, an Orlando attorney and legal analyst for WFTV-Channel 9, she could be required to foot the bill to move the trial, because she's the one who asked to relocate it.

"I think it's more than a chance," Sheaffer told the Sentinel. If the motion to change venues is granted, he said, "I think that it's a likelihood."

It's unclear what those costs would be, and Anthony, as she did in the criminal case, would almost certainly claim her indigence prevents her from paying any substantial sum. But Sheaffer said that objection carries less weight in a lawsuit, adding that "if she prevails [in the suit] … she may be entitled to reimbursement."

Appellate court sets date to hear Casey Anthony's appeal on misdemeanor convictions

An appeal court in Daytona Beach is now scheduled to hear Casey Anthony's appeal of her four convictions for lying to law enforcement early next year, after her legal team today filed the last paperwork necessary to proceed.

Oral arguments in the appeal have been scheduled for Jan. 8, just days after the trial in a defamation suit against Anthony is set to commence.

Texas EquuSearch is suing Anthony for fraud for resources the search and rescue organization spent during the hunt for her daughter. A Florida woman is also suing Anthony for defamation.  Zenaida Gonzalez says she never met Anthony, but claims Anthony damaged her reputation with statements she made during the search for Anthony’s daughter. Anthony told police a babysitter with Gonzalez’s name took her daughter.
 
During the course of these lawsuits, Anthony attorneys have argued that she shouldn’t have to answer questions about the circumstances around the disappearance of her daughter and the ensuing investigation and search for the child, because her appeal is pending

Baez says offhand remarks prosecutor Bernie de la Rionda made during a hearing last week were incorrect. The prosecutor was asking for a gag order to limit public remarks attorneys in the Zimmerman case can make.

Baez says he was never disciplined for making statements to the media. He says the only fine he received was for a discovery violation.

Attorneys for Casey Anthony on Friday filed the latest in a series of motions aimed at keeping evidence or testimony out of her upcoming civil defamation trial, currently set for early January.

This time, Anthony's team wants to bar Zenaida Gonzalez and her attorneys from presenting any testimony or argument that Anthony caused Gonzalez to lose her job or any wages.

Gonzalez, the defense says, "falsely claimed her lack of employment was the result of statements made by Casey Anthony."

"The truth is that [Gonzalez] has rarely been employed and has subsisted on food stamps and other government assistance for most of her life," the new motion by Anthony's defense states.

Anthony's attorneys go on to argue that Gonzalez has already waived her claim of lost wages, and allowing testimony on the topic "would serve only to confuse the issues and mislead the jury."

Casey Anthony can be questioned about audio tapes, judge says

Casey Anthony will have to answer questions about what happened to audio recordings she made after her murder acquittal last year, a judge in her defamation suit ruled Tuesday.

Anthony mentioned the recordings in a video diary she made which leaked online in January. Attorneys for Zenaida Gonzalez, who is suing Anthony, hope the audio may be relevant to their suit.

The judge previously conditionally granted Gonzalez's request for the audio tapes, but Anthony's lawyers responded that they don't exist.

At a hearing Tuesday, Anthony's attorney Charles Greene for the first time gave a detailed account of what came of the audio, as well as additional video diaries Anthony made.

Greene said Anthony "was spending a lot of time in isolation" while living in hiding late last year. Her lawyers told her it might be "therapeutic" to make a record of her thoughts, Greene said.

He said the advice was "consistent with the advice of psychotherapists."

The video diaries were posted on "what we thought was a secure website where communications with Ms. Anthony and her counsel were maintained," Greene said.

But when a diary leaked online in January, "We destroyed everything on the website," he said. The audio tapes, he said, were "practice" for the video diaries, and "were never preserved."

Gonzalez attorney Keith Mitnik didn't accept that explanation.

"How believable is this, coming from her?" he said of Anthony. He said the defendant, who was convicted of lying to authorities, has shifted her account of what happened to the audio repeatedly.

"She has decided she doesn't want you to look at them," Mitnik told Circuit Judge Lisa Munyon.

Munyon granted the request to depose Anthony, but said that "all the same safeguards" from her prior deposition in the suit — she answered questions remotely via video — will remain in place.

The case is set for trial in January, and court filings have been piling up from both sides. Another hearing in the case is set for Wednesday afternoon.

Casey Anthony’s civil attorneys asked a judge Monday to throw out punitive damages in a defamation lawsuit filed against their client by Zenaida Gonzalez.

Gonzalez is suing Anthony for defamation and claims she was harassed and threatened after Anthony came up with a fictitious nanny named Zenaida Fernandez-Gonzalez, also known as "Zanny the Nanny." Anthony accused the fictitious nanny of kidnapping her daughter, Caylee.

Anthony’s lawyers want the judge to rule that Gonzalez’s attorneys have failed to prove that Anthony and her mother are personally guilty of “intentional” or reckless conduct. Gonzalez must show that Anthony and her mother tried to intentionally harm her and acted “recklessly” to be awarded punitive damages.

Attorneys for Casey Anthony were back in court on Wednesday in an attempt to limit the damages she could be ordered to pay in the defamation lawsuit set for trial early next year.

After a half-hour hearing, Circuit Judge Lisa Munyon did not rule on whether Zenaida Gonzalez should be able to pursue punitive damages. The judge plans to issue a written ruling later.

Casey Anthony is required to show up in person to face allegations of defamation in Zenaida Gonzalez's civil lawsuit against her, but RadarOnline.com has exclusively learned the 'Tot Mom' plans to plead the fifth.

Casey, 26, has been fighting hard to not have to appear in the courthouse for the trial, and according to a pal of her brother, Lee Anthony, if she does have to appear she doesn't plan on testifying.

"Lee will have to testify, but Casey is hoping she'll find a way out of it," the insider said.

"She wants to just show up to court for one day, plead the fifth, and then never have to go back to the courthouse."

However, because Casey is appealing her lying convictions — which will be heard separately — the only way she will be able to plead the fifth is if those convictions get overturned, otherwise she won't have that option.

"Casey's entire family just wants all of this to be over. It's been three years of hell for them," the insider said.

When Casey Anthony takes the stand in her upcoming civil defamation trial, attorneys for the plaintiff, Zenaida Gonzalez, want to make sure she can't rely on the Fifth Amendment to avoid their questions.

Gonzalez's lawyers have asked Circuit Judge Lisa Munyon to delay the civil trial, because Anthony's appeal, which she cited in declining to answer deposition questions in the lawsuit, is set to be heard soon.

"Unlike early in the year when the date for the resolution of the appeal was unknown, it now appears that the appeal... will be concluded in early 2013," a new motion by Gonzalez's lawyers states.

Anthony's attorney, Charles Greene, told the Orlando Sentinel he plans to fight any attempt to delay the trial. Greene, echoing an earlier court filing, called the case "a publicity stunt masquerading as a lawsuit."

"As I have said many times in court, it's time for Ms. Anthony to move on with her life," he said.

Casey Anthony re-files request to throw out punitive damages

Attorneys for Casey Anthony are again seeking to limit the damages Zenaida Gonzalez can pursue in her civil defamation lawsuit.

Circuit Judge Lisa Munyon denied Anthony's previous attempt to throw out Gonzalez's claim for punitive damages, ruling that defense attorney Charles Greene hadn't filed the proper type of motion. Munyon left open the possibility of Greene refiling his pleading, and the defense did that last week.

"Based on, among other things, the fact that neither party knew the other, had a history of ill will towards the other, or was otherwise even aware of the other's existence, [Gonzalez] cannot present sufficient evidence to satisfy the specific and mandatory requirements" for pursuing punitive damages, the new motion says.

MIAMI — The lead detective in the George Zimmerman murder trial hired famed lawyer Jose Baez to represent him as he maneuvers the next steps of the contentious high-profile case, The Miami Herald has learned.

Chris Serino, a former Sanford Police major-crimes investigator, became a controversial figure when evidence revealed that the detective had quietly filed an arrest affidavit a few weeks after the shooting death of teenager Trayvon Martin, even as his chief publicly said there wasn't enough evidence to make a case.

A letter was sent last week by Baez to Dean Ringer Morton & Lawton, the law firm that sometimes represents the city of Sanford, advising that he will represent Serino in the upcoming proceedings. It is highly unusual for investigators to approach a murder trial with their own counsel.

On WS they are saying this is not due to it being Sweeps Week and that the information will be shocking.
Even if there is vital information I highly doubt that short of a video showing her murdering Caylee that the idiot jurors would have found her guilty anyway.  Even with a video they may not have found her guilty then either.  Sorry for the negativity but they were in too big of a hurry to go on vacation or were paid.  Not sure which one.

The lead prosecutor in the Casey Anthony trial said someone in the Anthony home conducted a computer search for "foolproof suffocation" on the last day 2-year-old Caylee Anthony was seen alive.

The Internet search was discussed in defense attorney Jose Baez's book, released last summer, and prosecutor Linda Drane Burdick said she wanted to confirm that detail with the Orange County Sheriff's Office.

The sheriff's office doubled-checked, Burdick said on Tuesday, and it turned out the "foolproof suffocation" search had been done on a desktop computer in the Anthony home about 2:50 p.m. on June 16, 2008.

Burdick reiterated that she and the prosecution team had no knowledge of the search during the 2011 trial, after which Anthony was acquitted of the most serious charges against her, including first-degree murder of her daughter.

Asked if the newly discovered search evidence would have made a difference with jurors, Burdick said, "How can I answer that question? That's asking me to speculate."

Asked about whether the prosecution would have used the evidence, she said, "I'm certain we would have used it."

WFTV legal analyst Bill Sheaffer said the never-before-seen-evidence is so significant it could've been all jurors needed to convict Anthony for her daughter's murder.

For weeks, Casey Anthony sat at her murder trial with her defense team anxiously waiting for prosecutors to drop a bombshell: computer evidence, the state would argue, showing Anthony researched how to kill with poison and suffocation on the same afternoon her daughter, Caylee, was killed by poison and suffocation.

But the bombshell never exploded.

"We were waiting for the state to bring it up," defense attorney Jose Baez told Local 6. "And when they didn't, we were kind of shocked."

Baez first revealed the evidence in his book, "Presumed Guilty," but blamed Anthony’s father, George Anthony, for the computer activity. Baez suggested George Anthony was considering suicide after Caylee accidentally drowned in the family swimming pool.

But a Local 6 investigation has uncovered evidence indicating it was most likely Casey doing the search.

And, in a stunning lapse, prosecutors -- relying on woefully incomplete information from the Orange County Sheriff's Office -- never even saw the potentially damning computer browser evidence, until Local 6 revealed it to them last week.

How damning is it?

Consider what they appear to show happening online the afternoon of Monday, June 16, 2008, the day Caylee died:
•At 2:49 p.m., after George Anthony said he had left for work and while Casey Anthony’s cellphone is pinging a tower nearest the home, the Anthony family's desktop computer is activated by someone using a password-protected account Casey Anthony used;

•At 2:51 p.m., on a browser primarily Casey Anthony used, a Google search for the term "fool-proof suffocation," misspelling the last word as "suffication";

•Five seconds later, the user clicks on an article that criticizes pro-suicide websites that include advice on "foolproof" ways to die. "Poison yourself and then follow it up with suffocation" by placing "a plastic bag over the head," the writer quotes others as advising;

•At 2:52 p.m., the browser records activity on MySpace, a website Casey Anthony used frequently and George Anthony did not.

"I really believed that (prosecutors) were going to sandbag us with it," said Baez.

After all, poison, suffocation and plastic bags were exactly what the state claimed Casey Anthony used to murder Caylee and dispose of her body; poisoning her with chloroform, suffocating her with duct tape, then placing her body in two plastic bags.

After Local 6 described the findings to him last week, trial prosecutor Jeff Ashton said, "It's just a shame we didn't have it. This certainly would have put the accidental death claim in serious question."

Ashton retired after the trial, wrote a book on the case and, in January, will become state attorney, unseating his former boss in this year's election.

Excellent report. Yes there were mistakes and glaring omissions. But I will never hold that against the prosecution and law enforcement. Any person with a working brain cell could see and connect the circumstantial evidence and a mother who lied to cover the murder of her only child FOR 31 DAYS. Any person with a working brain cell could see that a revolving door defense team performing for the circus trial of the century would recognize the trial strategy: if you can’t convince them, confuse them. Common sense and logic would cut right through the knee-deep bullish*t being shoveled at the jury and the public. Caylee’s murderer was acquitted on paper but the world knows who did it. Caylee’s family deserted her honor and her memory when it counted most. Jose Baez will spend the rest of his notorious life spinning lie after lie. The rest of us will continue to protest the injustice to the only victim- 2 year old Caylee Marie.

That the topic is again Casey Anthony will either excite or annoy the populace.
 
A warning: Pipitone isn’t done. He will have more on his latest Anthony expose at 11 p.m. Wednesday and possibly at 6 p.m.
 
On Wednesday morning, Pipitone said he will highlight the blame issue between the Orange County Sheriff’s Office and the State Attorney’s Office.
 
The headline on the WKMG website sums up the major development in the story: “Cops, prosecutors botched Casey Anthony evidence.” Subhed: ”Computer search for ‘foolproof suffocation’ never found.”
 
You can see Pipitone’s detailed work at the station’s website. He acknowledges his debt to two “citizen-investigators,” Phoenix attorney Isabel Humphrey and Connecticut computer expert John Goetz. They had become acquainted through Websleuths, an amateur sleuthing web community, Pipitone said.
 
I heard from several readers who complained that they saw nothing new in Pipitone’s report. But most people aren’t that familiar with these details. Questions about prosecutors and the sheriff’s office have consequences in Orange County beyond the latest gossip about Casey.
 
A spokesman for defense attorney Jose Baez dismissed websleuths.com as an anti-Casey site and said Pipitone was relying on someone who had never testified or been admitted as an expert in the court of law.
 
Pipitone countered that the Baez camp was attacking people who had objectively gathered the information.
 
In his report, Pipitone cast doubt on several points that Baez made in his book, “Presumed Guilty.” Baez accuses George Anthony, Casey’s father, of making a search for foolproof suffocation on the family computer. Legal analyst Richard Hornsby said the state would have had a better chance to convict Anthony had the evidence been discovered sooner.

That Jury had so much evidence presented to it that was damning for Casey- yet still they didn't convict her, not even of the lesser included offenses. I don't believe this information would have made them change their minds.  They had her pattern of behavior, hiding what had happened to Caylee, the BS Nanny story, the remnants of Caylee's dead body in her car, the searches for chloroform and chloroform in her trunk, the duct tape around her nose and mouth, the opinion of Dr G that it was NOT an accidental death but a homicide  - what else would it take to convince them?  They stated the reason they didn't convict was the Prosecution didn't prove HOW she died.  This information points towards the obvious, suffocation, but what did they think the purpose of the duct tape was if not death by suffocation?  Idiots on the Jury are to blame, not the prosecution..

State Attorney Lawson Lamar and legal analysts are weighing in on the evidence in the Casey Anthony case  that was uncovered by Local 6 and overlooked by Orange County Sheriff's Office and prosecutors.

Lamar announced on Wednesday he wants to meet with Sheriff Jerry Demings to review exactly what happened with evidence in the Casey Anthony case being overlooked and why.

Local 6's Tony Pipitone broke the story on Tuesday night about how investigators and prosecutors botched the computer evidence, which the state would argue, showed that Anthony researched how to kill with poison and suffocation on the same afternoon her daughter, Caylee, was killed by poison and suffocation. Local 6 uncovered evidence indicating it was most likely Casey doing the search.

Lamar, who is being replaced by prosecutor in Anthony case Jeff Ashton, said he will meet with Demings and lead prosecutor Linda Drane Burdick, who will be Ashton's assistant state attorney, to discuss the evidence.

Did Baez have inside information during Casey Anthony trial?

The lead prosecutor in the Casey Anthony trial said someone in the Anthony home conducted a computer search for "foolproof suffocation" on the last day 2-year-old Caylee Anthony was seen alive.

The Internet search was discussed in defense attorney Jose Baez's book, released last summer. Baez boasted that he found the search and was dumbfounded that prosecutors never brought it up at trial.

Channel 9's Kathi Belich learned that one reason Baez found things investigators didn't might have been that he had inside information from Anthony herself.

WFTV learned computer forensic work is so complex that unless investigators knew to look precisely for the word "suffocation" in Anthony's computer hard drive on June 16, 2008, they might never have found it.

They are, they did.

This was an analyst failure at OCSO, as well as the software they utilize for data extraction.  I don't think it is fair to say the prosecution solely relied on the info they were given by OCSO- they are also required to know the material as it relates to their case in chief.

The defense is not required to produce inculpatory evidence against a defendant to the prosecution.

Prosecutin' 101 now has a class on not sending to the jury right before a holiday.

I've never posted my thoughts about what I thought might have made a difference to the jury because the evidence was so very clear to me as it was to you guys. I have always wished one thing, though. I do wish that the prosecution would have drilled the fact that just because Mr. Baez says to them that "if there is any doubt about any thing then the whole case falls apart", is simply not true and not in accordance with their instructions. I do wish that the word "reasonable" had been clearly defined for them and that no one was required to check their common sense at the door. That exercise, just prior to going into deliberations, might have been helpful. Baez spent so much time during closing arguments on the stuff that was "Anthony Nuts" like denial of her pregnancy, denial of her not working, George having an affair, etc. Then he honed in on "something's just not right here" and that means you can't believe any of it to the degree for conviction. I think it should have been brought back to reality both with the evidence (which the prosecution did) AND with the mindset of using common sense to throw out what was peripheral and dispute the level of proof required that Baez defined. We all feared that the scientific evidence would cancel out, and it did.......... stupidly, because the prosecution had it dead to rights, but that's a common occurrence in high profile cases.

That probably wouldn't have made a difference either, but even at the time we were listening, I hoped to hear Baez's jury expectation remarks disputed. People with brains could have simply heard the Judge's instructions and interpreted them correctly without having to have them drilled in.

That the computer search was incompetent is "sickening" - just like everything else about this case!!!

ORLANDO, Fla. –  The Florida sheriff's office that investigated Caylee Anthony's death confirmed Sunday that it overlooked a computer search for suffocation methods made from the little girl's home on the day she was last seen alive.

Orange County sheriff's Capt. Angelo Nieves said the office's computer investigator missed a June 16, 2008, Google search for "fool-proof" suffocation methods. The agency's admission was first reported by Orlando television station WKMG. It's not known who performed the search. The station reported it was done on a browser primarily used by the 2-year-old's mother, Casey Anthony, who was acquitted of the girl's murder in 2011.

Anthony's attorneys argued during trial that Casey Anthony helped her father, George Anthony, cover up the girl's drowning in the family pool.

WKMG reports that sheriff's investigators pulled 17 vague entries only from the computer's Internet Explorer browser, not the Mozilla Firefox browser commonly used by Casey Anthony. More than 1,200 Firefox entries, including the suffocation search, were overlooked.

Whoever conducted the Google search looked for the term "fool-proof suffication," misspelling "suffocation," and then clicked on an article about suicide that discussed taking poison and putting a bag over one's head.

The browser then recorded activity on the social networking site MySpace, which was used by Casey Anthony but not her father.

A computer expert for Anthony's defense team found the search before the trial. Her lead attorney, Jose Baez, first mentioned the search in his book about the case but suggested it was George Anthony who conducted the search after Caylee drowned because he wanted to kill himself.

Not knowing about the computer search, prosecutors had argued Caylee was poisoned with chloroform and then suffocated by duct tape placed over her mouth and nose. The girl's body was found six months after she disappeared in a field near the family home and was too decomposed for an exact cause of death to be determined.

Many jurors apparently went into hiding amid public outrage over the verdict and refused to comment, but two have said prosecutors couldn't conclusively prove how Caylee died.

Prosecutors Linda Drane Burdick and Jeff Ashton didn't respond to emails from The Associated Press on Sunday.

But Ashton told WKMG that "it's just a shame we didn't have it. This certainly would have put the accidental death claim in serious question."

Baez didn't respond to phone or email messages Sunday from The Associated Press but told WKMG that he expected prosecutors to bring up the search at trial.

"When they didn't, we were kind of shocked," Baez, who no longer represents Anthony, told the station. Her attorney, Cheney Mason, who was also on the trial team, didn't return an email message from AP Sunday, and his office answering service refused to take a phone message.

The sheriff's office didn't consult the FBI or Florida Department of Law Enforcement for help searching the computer in the Anthony case, a mistake investigators have learned from, Nieves said.

Attorney Mark Lippman issued this statement Monday afternoon: “Recently a book was written which made libelous statements and raised baseless speculation about who performed computer searches relating to the term ‘fool-proof suffocation.’ This weekend it was discovered that this particular search term was never brought to the attention of the State Attorney’s Office. I heard on the news today (Fox) that immediately following the "fool proof suffocation" search, Casey's MySpace account was accessed from the same search engine. So, I guess a distraught George was looking for a way to kill himself, but had a moment of lightheartedness and decided to see what Happy KC had been up to on her MySpace using the log-on and password that KC had given her parents because, as we all know, she was always totally open and honest with them about everything in her life.

That scenario is typical of the tortured effort the defense exercised to explain away the obvious truth throughout the trial. I know that the law does not require the defense to supply incriminating evidence to the prosecution. PINSKY: It is Monday Madness. And truly it is so today.

First off, a new report shows someone searched the term "foolproof suffocation" on a computer mainly used by Casey Anthony.
 
Joining us now on the phone from Miami is author of the book "Presumed Guilty" and Casey Anthony`s former attorney, Jose Baez.

Jose, thank you so much for joining me here today.
 
Now, in your book, you mention this evidence. And so the question I guess everyone wants to know is how does something like this get missed in such a high-profile case? Or was it missed?
 
JOSE BAEZ, CASEY ANTHONY`S FORMER ATTORNEY (via telephone): Well, I can tell you this, Drew. First of all, thank you for having me.
 
I remember sitting right next to you while we were discussing my book before it came out, and I told you that there were things in this book that were going to shock people. It only took a few months for people to realize, but it -- you know, first of all, I don`t believe this evidence was missed at all. I think it was clearly there.

I think there are reports that in my book I lay out the reports that reference the work that was done on the computer. And why I believe it was buried as opposed to a mere oversight or overlooked as they are now claiming.

PINSKY: Jose, review that with us now. Why do you think they chose to overlook it?

BAEZ: Well, the problem with this evidence is that it completely destroys the prosecution`s timeline. If you recall, the only testimony of what occurred on June 16th, 2008, was the testimony of George Anthony that says Casey and Caylee left the house at 12:50.
 
He described exactly what they were wearing. That Caylee had a backpack and then he walked them out. He helped her get in the car and gave her a kiss and waved goodbye.

This computer activity shows someone on the computer practically all day. So if you take that and you say, well, it was Casey who did these -- who was on the computer. Then she didn`t leave at 12:50.

PINSKY: Who do you think was on the computer?

BAEZ: I`m sorry?

PINSKY: Who do you think this was that was on the computer that day? Was it mom? Dad? Casey? Who was it?

BAEZ: You know, you can never -- you can never put someone behind a computer. That`s the biggest problem with this evidence. You know, in my book, I outline a couple of different scenarios. Of course you could say Casey did it.
 
But you can`t have your cake and eat it too. If she was on the computer, then she didn`t leave the house at 12:50 and that means someone is lying about the fact that she left the house.
 
But, you know, if you argue that they left the house, then you have to say was George doing the searches? So, I mean, you know, it cuts both ways. But I think it`s much more damaging to the prosecution than it is to the defense because Casey`s cell phone records also don`t show her leaving the house until 4:16 that afternoon.

PINSKY: That`s interesting.

Jane -- Jane, you have a question for us or comment, Jane in Florida?
 
JANE, CALLER FROM FLORIDA: Yes. Thank you, Dr. Drew, for taking my call. I have both a comment and question for Jose Baez. I feel clearly and beyond a reasonable doubt that Casey Anthony is guilty of murdering Caylee with or without this new evidence of Google searches. I don`t know if the timeline is correct or not. But I believe this is only additional evidence of her guilt and the jury did not connect the dots.
 
But my question is -- in addition to these Google searches, how can you propose theories when there`s no evidence to back up or support that Caylee drowned, that her father helped cover up, and that she was sexually abused. How can you propose theories such as this and how could we believe this or how could even a jury believe this when she`s a pathological liar? And I believe also suffers from a sociopathic personality disorder.

PINSKY: OK. Let`s let Jose respond. There was a lot packed into that.

BAEZ: Sure.
 
PINSKY: So, try to focus there.
 
BAEZ: I`ll try my best. And it`s Terry, right?
 
JANE: No, it`s Jane.

PINSKY: It`s Jane.
 
BAEZ: I`m sorry, Jane.

Jane, here`s the thing. What a lot of people -- first of all, I don`t blame you for feeling the way you do. A lot of people who watched this trial on television and were -- you know, I don`t know if you sat and watched every minute of the trial, but a lot of people who watched it on TV and caught the headlines and caught the sound bytes, pretty much feel that way and were very shocked by the verdict.

Those people that watched the trial a bit more and watched the complete trial, the emotions are a little bit mixed. Some people think we`re not surprised that some people were.

As it relates to your issue about theories, the -- I kind of -- I have to disagree with you. We put forward evidence that talked about the drowning. For example, the pool ladder being left up the day before and then the next day, Cindy Anthony going to work and telling her coworkers about it.

PINSKY: Jose, I think she`s talking about -- I think she`s talking about theories that were a little more far reaching, like George`s sexual abuse of Casey, that kind of thing.
 
BAEZ: Sure. There are several ways evidence could be put forth. And one is by cross examination and one is by direct testimony. Of course, Casey could have take have a stand and could have testify to this. And, of course, also George when he took the stand and we questioned him about the abuse, he could have denied it and he could have -- or he could have admitted to it.
 
Now, he did deny it. However, that doesn`t mean that the jury has to believe a witness. That`s the same if Casey took the stand and said, I didn`t do this, and they looked her and said, you know what, you`re lying. I do think you did.

So that`s considered evidence in a case. And that evidence came forth.

Now, did we prove --

PINSKY: Let me -- Jose --

BAEZ: Did we prove these theories beyond a reasonable doubt? No. I agree with that. That`s not the defense`s burden. That`s the prosecution`s burden.

And I think what happened --

PINSKY: Let`s take another quick call, Jose. I got to take another call from Terry in Florida. Terry, go ahead. Terry?

TERRY, CALLER FROM FLORIDA: Hi, Dr. Drew. Hi, Mr. Baez. How are you folks today?

BAEZ: Hello.

TERRY: I have a question, Mr. Baez, if you don`t mind. Casey`s acquitted of murder, and, you know, I blame someone else for Caylee`s murder I believe. And my question is who are you going to blame now or point to now with the newfound evidence? You know, the Google search for the foolproof suffocation. And the investigator said the person at home at the time was Casey.
 
PINSKY: Terry, was there a question? I didn`t hear a question --

BAEZ: I`m sorry. I didn`t understand.

PINSKY: Terry, what`s the question?
 
TERRY: Mr. Baez, you acquitted Casey of murder by pointing the finger at other people. My question is who`s going to be blamed this time for the newly found evidence of the foolproof suffocation? The investigators said nobody was home except for Casey at the time of that Google search.

BAEZ: That`s actually incorrect, Terry. The searches were done at 1:50 p.m. That would mean that both Casey and -- by the testimony both Casey and George were home at that time. So if you believe that it was Casey on the computer, she had to be home and the testimony that she left at 12:50 is completely contradicted.

If you believe she left, then she`s not the one working on the computer. So it --

PINSKY: You can`t have it both ways.
 
BAEZ: You can`t have your cake and eat it too.
 
PINSKY: Yes, you can`t have it both ways.
 
And, Jose, let me ask one more last thing before I let you go. Do you think it`s possible that Casey was searching ways to hurt herself, however Caylee died, after coming to understand the child was dead that she could have been one of the people searching for ways to hurt herself? Does that fit with your understanding of Casey?
 
BAEZ: That -- well, that could be an interpretation. Now --

PINSKY: I`m asking you. You`re the one that sat in the room with her all the time. Is she someone that however the child died would have gone - - I need a way out, I`m going to kill myself?
 
BAEZ: OK. Casey -- there`s no evidence that Casey ever contemplated or attempted suicide, which the searches show. However, there was an attempt -- that George attempted suicide in January of 2009. So, you know, the worst, most difficult thing that you can do is put somebody behind a computer.
 
So you have the situation where I think it`s my opinion if you look at these facts and the timeline of the case, that these searches are much more damaging to the prosecution`s case than they ever were for the defense, which is why I believe they were never brought up.

Casey Anthony's lead attorney Jose Baez says newly discovered Google searches found on the Anthony family computer, including for "fool-proof" suffocation methods on the day her daughter Caylee was last seen alive, were suicide related.
 
"What's being reported about these searches is completely false," Baez said in an interview on Fox & Friends Tuesday morning. "These were suicide related searches."
 
Baez said there was "no indication" that Casey had run the searches and suggested it was her father, George Anthony, who conducted the search. Anthony's attorneys argued during trial that Casey Anthony helped her father, George, cover up the girl's drowning in the family pool.
 
"He actually attempted suicide several months later," he said. "Casey Anthony never contemplated or attempted suicide."
 
Baez, who was brought into the national spotlight for representing Anthony during the trial, said he doesn't get into "what if's," and that the case still is marred "in a lot speculation."

This is just Baez trying to extract his foot from his mouth.  It's poetic justice that his own comments revealed this evidence..  I am not sure the Jury would have paid any attention to this, if all the other evidence didn't convince them..
Casey was online in her own password protected AIM account. Once she finished with her search of fool-proof suffication she spent some time on her MySpace account, then her browsing was interrupted by a phone call from Jesse Grund, which she took.   At that time of day George was on his way to work, for a 3pm shift.

In trying to zero in on what's most enraging about old Jose, I think it can be summed up as his being the Intelligence Insulter Extraordinaire of all time.

I believe that she drugged caylee and she didn't wake up...I am thinking that she was planning to leave Caylee drugged somewhere while she was in her very important meeting with a very important person for her. This time next week, there will be a new state attorney in Orange and Oceola County for the first time in a quarter-century.

Jeff Ashton beat his former boss, Lawson LaMar, in November and will take over Jan. 8.

Ashton is trying to move on from the Casey Anthony case and didn't want to talk about a so-called "foolproof suffocation" search done on the Anthony home computer that was not given to him by the Sheriff's Office.

"Honestly, I don't know all the information on exactly how this was missed and I don't want to make comments and lay blame without complete information," he said.

Ashton said he learned a lot from the Anthony case but doesn't dwell on the case or the defendant.

"I was asked last night, 'Where is Casey Anthony?' and my answer is always the same: I don't know and I don't care, and honestly, I don't," said Ashton.

In Session will provide the feed to outlets when Anthony’s convictions of lying to law enforcement are appealed at 1:30 p.m. Tuesday. The case will be heard in the Fifth District Court of Appeal in Daytona Beach. It could be a chance to see defense attorney Cheney Mason in action.

Attorneys for Casey Anthony returned to court this afternoon, to try to convince a three-judge appellate panel to throw out her four convictions for lying to law enforcement during the search for her daughter.

Anthony did not attend the 1:30 p.m. hearing, which was completed with an half hour. The outcome of Anthony's appeal is notable in part because it will likely impact her testimony in several pending lawsuits.

The only issue that was discussed in the hearing was whether Casey Anthony was in custody when she lied to police in the Summer of 2008 just after her daughter Caylee Marie was reported missing.

Winter Park defense attorney Lisabeth Fryer made arguments on behalf of Anthony; Assistant Attorney General Wesley Heidt made arguments on behalf of the state.

The Daytona Beach appellate panel in is not making a ruling Tuesday. The misdemeanor convictions Anthony is appealing stem from her initial claims to law enforcement after her daughter disappeared.

Anthony told detectives that the girl had been kidnapped by a nanny. In reality, authorities said, Caylee was dead. Anthony was charged with killing her daughter but was acquitted of all major charges in July 2011.

Anthony has cited the pending appeal to avoid questioning in lawsuits she faces, including the civil defamation case brought by Zenaida Gonzalez, a woman whose name is similar to the fictional nanny's.

Mark NeJame, legal analyst for Central Florida News 13, provided memorable commentary after the Casey Anthony appeal ended Tuesday afternoon.
 
One NeJame line stood out. News 13 anchor Jackie Brockington wanted to know how the appeal would affect the civil case -- Zenaida Gonzalez's defamation suit -- against Anthony.
 
The appeal won't matter, NeJame said, "except for the liberation of Casey Anthony's mouth. She is going to have to talk at some point in the civil case, once this case is over, whichever direction it goes in."

"Basically, the defense is trying to throw out all the convictions by saying that Casey Anthony was in custody at all times she was questioned ... and was never read her Miranda rights," NeJame said. "The issue becomes was she in custody and did the police have an obligation to have read her her Miranda warnings."
 
NeJame predicted it would be several weeks before the three-judge panel rules in the appeal. He noted the matter-of-fact way the judges treated the Anthony appeal. "Just because this garnered a lot of press attention, they're going to make it a point to treat it like every other case," NeJame said.
 
On the defamation suit, NeJame explained that the civil case had stalled because Anthony has Fifth Amendment privileges in the appeal. Once the appeal is over, Anthony won't have any Fifth Amendment protections, NeJame added.

It has been my experience that Aphrodite tends to mold information to fit the story she wishes to tell.  I can't imagine it would be any different this time around, especially with the inclusion of Bozo.  Hopefully I am completely wrong this time, Caylee deserves so much more than a puff piece full of lies and support for her killer.

I'm watching it I hope those inept jurors feel like the jerks they are.

O/T kind of  Heard tonight on TV that Bozo is busy representing some families in the Aurora CO theater shooting. This make me sick.

I did watch the Casey Anthony story and it was alot of the behind the scenes, between Ashston and Linda, which I found interesting.  I think they did a good job of jamming the whole story in to a two hour movie.  Rob Lowe did a great job of playing Ashton.  I also watched the after show, with Jeff Ashton and it was also interesting.  The movie did not have Casey say much at all, mostly videos of her lies, to make the movie pro-DA and Bozo the ass that he is. Mason, aslo had a meeting with the prosecuter stating he tried talking Casey to take a plea, but she adamantly refused. (that was new to me) Overall, it was good.

I could not watch it. I tried, but I just coudn't stand it.

I am waiting to find out if her appeal is denied or not.

It happened during the trial....When she refused to listen to Mason as to taking a plea ( he KNEW she was guilty even before he signed on- remember the interview he gave before she hired him, where he advised Bozo to negotiate a plea  ) Mason asked Judge Perry to order a competency hearing. He was obviously expecting the Jury to give her the Death Penalty.
She was examined and found competent...    those reports were sealed by the Judge.

I agree the movie was pretty good! Rob Lowe did well. The after the movie discussion was interesting! During the movie I muted anytime Baez spoke! His opening and closing arrogance. I like how Baez was referred to as a nobody 3 year rookie more or less. I did alot of muting of him and mason.

Hi Di, just thought I would respond with my 1 cent here, lol. Remember when Mason and Bozo called in psychiatrists real late in trial and we did not know why till after? Well CA's team wanted her to take a plea deal and she definitely wasn't having it so Bozo and Mason thought that CA wasn't thinking properly and maybe she WAS having trouble mentally understanding that the plea was the right thing to do.  We ALL knew she was guilty and so SURE she would be convicted even her team thought so. But that's what all that hoopla was for. You know, it's almost like she and her fam knew she was getting off but the whole world thought she would pay for what she did! It's still sickening.

I watched it too & thought it was awful. As much as i like rob lowe, i thought the movie was almost unwatchable. The documentary after just made me angry all over again. Didnt enjoy seeing baez ugly smarmy fat faced smugness again. I also desperately wanted to punch jennifer ford in her face again. I will never get over that verdict. Pathetic excuse for a jury!

Casey Anthony: Appeal court tosses two of four charges

The appeal court found that Anthony could properly be convicted of two counts of providing false information to a law-enforcement officer.

The appeal court said the four false statements were made by Anthony during her interview with Orange County Sheriff's Detective Yuri Melich at her family's home.

Two of the lies were repeated to Melich in a later interview at Universal Studios, where Anthony claimed she worked and took detectives.

"In light of the significant temporal break between Appellant's two interviews with Detective Melich, we determine that each interview in which false information was given (or repeated) constituted a separate criminal episode," the appeal court ruled.

But of the Anthony defense's two main arguments, the appeal court rejected one: That Anthony was under arrest when she lied to authorities searching for her daughter in 2008.

Though she had briefly been handcuffed and put into a Sheriff's Office vehicle, "we conclude that a reasonable person in [Anthony]'s position would not believe 'that his or her freedom was curtailed to a degree associated with actual arrest,'" the panel ruled.

I knew one of the " jurors ". Had a good laff with her yesterday about the verdict.

Yes kcrn, I agree it really IS sickening to me too Casey got away with killing Caylee.  I'm not sure she'll ever see the misery she deserves either, but in the meantime, I hope something starts sticking to teflon Casey.  Sometimes all it takes it a tiny bit here and a tiny bit there and perhaps there will be something unraveled.  I can hope.  You've an interesting point, and I don't know the answer to that.  (see my bold)  Maybe we'll be hearing something about that soon.

Bankruptcy motive questioned
Anthony sought Chapter 7 protection in a federal court in Tampa on Friday, soon after the appeals court ruling.
Such a filing is meant to allow one to do away with most existing debts and make a fresh start financially.
In the documents, Anthony says she owes almost $800,000 to about 80 creditors, and she has no income.
She is also defending herself against several civil lawsuits, including a defamation suit from Zenaida Fernandez-Gonzalez, who claims Anthony ruined her reputation.

Gonzalez's attorney, Matt Morgan, told CNN affiliate Central Florida News 13 he believes the bankruptcy filing is an attempt to postpone the case.
"This most recent filing appears to be yet another calculated delay tactic," Morgan said. "We are not deterred and will stay the course."
But an attorney for Anthony told the affiliate his client is distraught that she can't pay her legal fees.
"To some extent she feels, she feels bad that she's having to have all these legal services provided to her and she is unable to compensate anyone," Andy Chmelir said. "So she wants closure more than anything else."

Anthony listed about $1,000 in personal property, according to court documents obtained by News 13. The listed property values include:

Was there ever a full accounting of how much money the state of Florida provided her for her defense?  IIRC, that money was supposed to mostly pay for her defense, both attorneys and experts.  They are doing nothing more now than they have been doing all along, they're just a bit more brazen about it,  they will never stop scamming the system.  Or the people of Florida.  The claim that "to some extent she feels bad", that's the best her professional liar personal lawyer can say?  To no extent does she feel anything for anyone other than herself.  Somebody needs to step up and hold her and her entire illegal team responsible for something.

Her parents' address is listed as her home address, though Greene says that she is not living with them. He says that address was listed because it was her most recent permanent address.

Attorneys set to move forward in Casey Anthony civil cases despite bankruptcy

It could be a delay tactic for one of her civil cases, namely the Zenaida Gonzalez suit, which was to start in the near future.
 
Mark NeJame is an attorney who thinks that might be the case.
 
He was quite surprised when we told him he is listed as one of the creditor in her bankruptcy filing.
 
“It’s definitely a strategy and a commonly used one," NeJame said. "You see many people filing for bankruptcy to avoid litigation, which could in fact wipe them out or keep them tied up for years.”
 
NeJame said he's never even spoken to Anthony, although he did briefly represent her parents in the early stages of the murder case.
 
How will this impact Anthony's civil cases?
Attorneys could continue seeking litigation in bankruptcy court or ask the bankruptcy judge to allow the civil cases to proceed in state court.
 
Matt Morgan, who represents Gonzalez, said although Anthony has no money, the recent filing will not affect their defamation case.
 
"We believe that at some point in the future, Casey Anthony will profit from a book, movie, or other related deal,” Morgan said. “It makes logical sense for her to have all of her liabilities discharged before she profits."
 
Kronk, the meter reader who found Caylee’s remains, is also suing for defamation.
 
"The lawsuit on behalf of Mr. Kronk always realized that collecting money would be difficult or impossible, but it didn't stop (us) from filing suit to prove that Mr. Kronk had nothing to do with the murder of Caylee Anthony," said Kronk’s attorney Howard Marks.
 
Only certain debts are discharged in bankruptcy court.
 
However, the attorneys said they are trying to collect damages they hope are not dischargeable in bankruptcy court.
 
When Gonzalez and Kronk’s defamation cases go to trial, a jury will determine the exact amount of money they would be awarded.
 
Even if Anthony does not have the amount at that time, but does sign a movie or book deal within 20 years of the judgment, Gonzalez and Kronk will still collect their sums before Anthony.

Anthony – one of the most reviled criminal defendants in recent memory – has been living in a condo in Cape Canaveral, Fla., since late last year. In addition to regular contact with her mother, she has also reconciled with her father, George, who she previously accused of molesting her. (The condo was actually leased by George Anthony for his daughter to live in. The family attorney, Mark Lippman, had no comment.)
 
Creditors of Anthony – including her lawyers, the police, and the IRS – have 30 days to file a claim against her, or her debts to them will be wiped clean.

Anthony, the Florida mother infamously accused and acquitted of killing her daughter Caylee in a sensational trial, has filed for bankruptcy protection. Her petition claims she owes almost $800,000 to about 80 creditors, with about $500,000 of it owed to her lead defense attorney.
But the bankruptcy filing in federal court also basically freezes all lawsuits filed against her in state courts, including a suit filed by Texas Equusearch, a non-profit group that helps law enforcement authorities hunt for missing people.
“We did a massive search for little Caylee,” said Tim Miller, the Santa Fe man who founded the group. “And we had over 4200 volunteers come in from all over the country.  Equusearch itself spent a little over $119,000 on that search.”
Anthony’s defense attorney claimed in court that Caylee drowned in the family swimming pool a month before she was reported missing and that her parents merely covered up her death.
Prosecutors claimed Anthony killed her daughter with chloroform, covered her nose and mouth with duct tape, then dumped her body in some woods near her home.
Under either scenario, Anthony would have known her daughter was dead while thousands of volunteers wasted their time searching for her. So Equusearch sued Anthony, hoping to recover the money it spent on the fruitless search.
Anthony claims in her bankruptcy petition that she has no income, but she could collect a bonanza from a book or movie deal. Indeed, some legal analysts believe she’s asked for Chapter 7 protection to wipe out her debts before banking a windfall.
Bankruptcy filings are also routinely used as a legal tactic employed by attorneys trying to delay trials of lawsuits filed in state courts. In this case it will become difficult, perhaps impossible, for Equusearch to ever collect any money from Anthony.
“I don’t know what my next option is, but it’s not over,” Miller said.  “And it’s not over for Casey.”

Makes me ill as well.  Having a bodyguard not only is expensive, but it feeds into her narcissism.  No doubt we are seeing the effects of a public relations team...either private or one hired by whatever studio/publisher is waiting in the wings for the bankruptcy to proceed.  I still can't figure out how Bozo thinks he is owed that money when the state paid and he also has said he was pro bono.  IMO, they are also scamming the court over the bankruptcy. 

JAC did not pay Bozo, he and Casey made a private agreement at the beginning. ABC paid her $200K for photos of Caylee and Bozo took that for his fees ( did not provide an itemized bill, just took it and did not withold money for her taxes - she still owes $68K  tax on it).
Then she was declared indigent and JAC paid her court expenses, witness fees etc and he states now that the rest of his bill is $500K.  I'd say she was over charged,eh?  ::MonkeyHaHa::

A paralegal has access to clients most personal information- SS numbers, bank accounts, legal documents- and they think anyone could trust Casey with that? I hope whichever lawyer hires her carries plenty of malpractice and liability insurance, he will need it.

I`m going to talk to one reporter who spoke exclusively with Casey right after she filed for bankruptcy. But first, to my legal panel -- yes or no: should Casey be able to simply file for bankruptcy and wash her hands of all the money she owes, including upwards of $70,000 to taxpayers?

All right. Brian Silber, start it off.

BRIAN SILBER, CRIMINAL DEFENSE ATTORNEY: Who gets to jump in?

VELEZ-MITCHELL: Brian Silber.

SILBER: Jane, I`ve got to tell you, if you are somebody who is offended by the fact that this woman was found not guilty of murder, this should make your head explode. I mean on top of walking away from that charge, she`s now going to have absolutely no financial responsibility.

Let me tell you something. As a criminal defense attorney, that offends me. And I`m going to tell you why. She should be kissing the butt of that Jose Baez for saving her life. She should work triple jobs, double jobs, whatever it takes to pay back her debts.

To tell me that now she`s going to walk away with a clean slate? Guess what, she already got her new start. She`s not facing the death penalty or life in prison.

KAVINOKY: Time-out. Maybe she should be paying back Jose Baez, but this is still America. She has an absolute right to file bankruptcy. She`s filed bankruptcy. And actually Jose Baez should also be kissing her feet. Frankly, Jose Baez who apparently is going to be out about half a million dollars in legal fees, his name is part of the national/international lexicon now.

He`s now considered to be more than a lawyer. He`s a freaking magician for getting this woman out of this mess when she`d already been tried and convicted in the court of public opinion. She`s legally entitled to it. She gets it. It should be a nonissue. Of course she can file bankruptcy.

He made a lot of money off the case in the sense that he is the most famous lawyer practically in America right now. But what about the Orange County Sheriff`s Office --- $146,000?

Here is all the money she owes: $145,000 to the Orange County Sheriff`s Office. Remember, they searched for a little girl who they thought was alive when Casey knew that she was dead all along. And then the IRS almost $70,000. Why is it that we all have to pay our taxes and she doesn`t?

And I want to go to Michelle --

KAVINOKY: Those are the rules of the game, Jane.

VELEZ-MITCHELL: Hold on. President and co-founder of the National Women`s Coalition against Violence and Exploitation -- you used to do PR for Cindy and George. You flew down to Orlando and spent a lot of time looking for little Caylee on the assumption that she was alive and kidnapped because that`s what that woman right there, Casey Anthony told you. How do you feel about her filing for bankruptcy and trying to wash away all of her debt?

MICHELLE BART, NATIONAL WOMEN`S COALITION AGAINST VIOLENCE AND EXPLOITATION: Well, you know I don`t know how to follow those attorneys, but I guess there is law that allows her to do so. Whether or not she should is another question.

VELEZ-MITCHELL: How do you feel, Michelle? I`m asking you how you feel. I asked you how you feel about it.

BART: Well, I feel that, you know, a lot of people looked for her daughter and she owes us the money.

VELEZ-MITCHELL: On the other side of the break, we`re going to talk to Sharlene Martin, who happens to be my book agent and has helped me publish a couple of books; and a great friend, as well. VELEZ-MITCHELL: Adam Longo, reporter to our affiliate KPHO, you interviewed Casey Anthony in an exclusive interview right after she filed these bankruptcy papers. What did she tell you? How did she sound?

ADAM LONGO, REPORTER, KPHO: She sounded eager, Jane -- eager to move on with her life. She sees this as just one chapter she wants to be able to put behind her, and being able to go through this bankruptcy process. She`s hoping that will do that for her.

I want to pick up on a point though that you were talking about with your legal analysts just a moment ago about Jose Baez and the $500,000 that`s listed in those bankruptcy documents. What isn`t clear at this point is if there`s any sort of signed document that exists or any financial agreement on paper between Jose Baez and Casey Anthony as it was explained to me, the 80 or 90 some debtors that are listed on those bankruptcy documents are people who could potentially come after her and potentially make claims against her, so we don`t know if that`s where the legal fees were capped off at.

We do know this. Jose Baez would have to make a claim in bankruptcy court, and if he did that, he would be doing something he`s never done before which is sit across the table from Casey Anthony instead of next to her.

VELEZ-MITCHELL: Yes. We`re not so worried about him. Sharlene Martin, my literary agent, do you think she`s going to make a book or movie deal?

SHARLENE MARTIN, LITERARY AGENT: I don`t think there`s a buyer out there for a book or movie deal for Casey Anthony. You know, a quick scan Jane at Amazon today shows there are no less than 17 books already out there about this particular case including Jose Baez`s book and Jeffrey Ashton`s book, which, as you know, was just made into a Lifetime movie that aired just a week or so ago.

I don`t see that there`s any room left for her. I don`t see anybody stepping up for her. I don`t think that anyone wants to pay her what would be considered blood money in the publishing world.

LONGO: You know I`ve talked to her more times than just this once, Jane. This was the only time that was on the record and I have to tell you frankly the sense that I get from her and from her legal team is that she`s not out to make money. Everyone has this misconception that that`s the next logical step in her life. And all the indications are, the impression I get from her and her legal team, they have no intention of doing that. They`ve said so much on the record here in the past couple of days.

VELEZ-MITCHELL: I guess the reason people ask that, is that how is she going to survive? She can`t just get a job at a dry cleaner`s or something because we all know her and don`t love her.

PINSKY: Welcome back. Co-host this week, Laura Baron, also back with our exclusive interview with, Jose Diaz. OK. Jose, people were shocked by this portion of your opening statement in the Casey Anthony murder trial. Take a look at this.

JOSE BAEZ, CLAIMED CASEY WAS ABUSED BY HER FATHER: This child, at eight years old, learned to lie immediately. She could be 13 years old, have her father (EXPLETIVE DELETED) in her mouth and then go to school and play with the other kids as if nothing ever happened.

PINSKY: is this -- was that part of your sort of go to the math strategy? And is that what Jodi should be using as well?

BAEZ: Well, I don`t know if you can characterize it as go to the math, but I will tell you this. When you`re defending someone for their life, and when you`re defending your life, the gloves come off, and you have to bring it. And you have to basically not hold anything back, and if there are -- if you have ammunition, now is the time to use it.

So, I think in the defense case with Jodi Arias, you may see a lot of that. And, you may se and hear specific types of evidence that just haven`t come out yet. The defense doesn`t have a burden, but from what I`m hearing, they may have one or two things that basically have not been made public yet, so, we`ll just wait and see.

It could be nothing or it could actually be something, but what bothers me greatly is that a lot of people are already placing some type of a burden on women who are victims of abuse. Now, whether Jodi Arias is one or not, that remains to be seen, however, as we were talking about in the last segment, to kind of start placing requirements -- to place a requirement or a burden on a woman to document the times she`s been abused, I think that`s asking a bit much.

LAURA BARON, RELATIONSHIP COACH: I don`t know that -- Jose, just let me speak as a woman, but let -- let me just speak as a woman to say that it is very, very difficult to hear a woman constantly lying about what happened, and then at the end of the day, come out with, by the way, I was abused. We all know women that were violently abused.

And it is almost coming as a gut response, as a protection to our sisters. It just sounds like another excuse, which actually leads me to, as a defense attorney, do you think it`s easier for them because they`re dealing with a dead guy? I mean, he can`t defend himself. Does it make their case a little bit easier that they can say he`s an abuser?

BAEZ: Well, I wouldn`t say it`s easier, because you have the force of the state or the government fighting against you. It`s not necessarily easier. And I can understand that. I agree with you that there are a lot of women who probably are legitimate victims of some type of abuse that might be angered by looking at this situation.

But until we`ve heard her full say, how can we go off and say, well, she didn`t document it, there`s no witnesses. These things don`t happen in public. They happen in private situations. And many of these women are thinking about surviving, not necessarily documenting it.

PINSKY: Everybody, I got to stop. Here`s the deal.

PINSKY: If anybody is involved in an abusive situation and they think there`s a possibility that the abusive circumstance could end like this, the number one, two, three, four, and five things you have to do is get away from your abuser. That`s what everyone needs to learn from this situation if we think that has anything to do with it.

If Casey and I are intervening, Casey meaning my guest here, not Casey Anthony -- questions for you, Jose, about that in a second. If we were intervening, the first five priorities are get those two people apart. That`s what everyone needs to think about because yes, horrible things can happen. Let`s learn that.

Now, Jose. Bankruptcy. Casey claims -- Casey Anthony now claims she has just over $1,000. Here`s the quick breakdown. I think we got a full screen of this out, $474, $200 in furniture, family photos, DVDs, 25 bucks or 25 of them -- clothing and accessories, $100, watch and jewelry, $200, cameras and bike, 60 bucks.

So, Jose, that`s it. And I think she owes something like $700,000. Where do you fall in on this story?

BAEZ: Well, you know, Dr. Drew, you know I love you and Laura more so, but I don`t have --

BARON: Thank you.

BAEZ: -- I don`t have a waiver from Casey to discuss her finances. You know, just because I represented her doesn`t give me carte blanche to talk about her every time she`s in the news. She gave me a certain waiver at discussing her case, but as it relates to this stuff, I unfortunately, I really can`t discuss it because I`m not at liberty to.

PINSKY: OK. So, Jose, I learn one thing. You love -- wait, wait, wait. I learn one thing. You love Laura more than me. That`s all I just learned.

(LAUGHTER)

BAEZ: Guilty.

PINSKY: Yes, right. Well, that`s OK.

BAEZ: And you won`t hear that from me very often.

(LAUGHTER)

PINSKY: We know (ph) guilty from you. We`ll hear repeatedly how much you love Laura more than me, but that`s OK. I`m running out of time her. Marcia, I`ve got about less than a minute left. Answer this. It seems like defense attorneys take step on when there`s not likely to be reimbursement. Explain that to the average viewer.

MARCIA CLARK, PROSECUTED OJ SIMPSON: Well, you know, in all these high-profile cases, there is something to be gained besides money. And, well, you have Casey Anthony was obviously not a wealthy girl and the defense of her case was going to take a great deal of time and energy. And a defense attorney looks at that and says, look, I`m going to get a lot of publicity.

I`m going to get a huge client list as a result of the exposure. And so, if she can`t really pay the full rate, I`m compensated in that way. It does build up a practice enormously, and it has done for many, many lawyers.

PINSKY: Got it. We got to go now. Thank you, Marcia. Thank you. I got to go, guys. Thank you, Jose Baez. The book, Jose`s book is "Presumed Guilty." And Jose, of course, you love Laura more than me. I completely understand that. Casey Jordan, thank you.

In a blistering interview with CNN's Piers Morgan, attorney Cheney Mason has asked the media to leave Casey Anthony alone.
 
He may not need to worry: I saw only 110 views for Mason's interview on YouTube.
 
Of course, Mason's complaint came shortly after Anthony filed for bankruptcy, which renewed interest in her briefly. Her attorney Charles Greene also did a round of interviews, which resulted in wide coverage.

On CNN Thursday night, Mason complained that some people's views of Anthony cannot be changed and those people will have to die off. He blasted the media for calling Anthony "the most hated woman in the world."
 
Mason said her lawyers "are going to continue to fight for her, to protect her and help her try at some point to have some normal life. I don't know when that's going to be."

"She certainly seems to have picked up the pieces of her life and moved forward," WFTV-Channel 9 legal analyst Bill Sheaffer said Sunday on "Central Florida Spotlight." "She has a very strong support group. Surprising to me, by the way, was the fact that there's been this reconciliation with her father who she accused of sexually molesting her over a long period of time."

The suits of Zenaida Gonzalez and Roy Kronk against Anthony are "dead in the water," Sheaffer said, because bankruptcy stays all pending lawsuits.

But Sheaffer predicted that attorneys for Kronk and Gonzalez will attend a hearing that the bankruptcy court will hold.

Sheaffer predicted three possible outcomes:

1. The Kronk and Gonzalez attorneys will ask the bankruptcy judge to hear the suits to determine if their clients have been injured.

2. Or the Kronk and Gonzalez lawyers could ask the bankruptcy judge let the state court handle the suits.

3. Or the judge could grant bankruptcy but let the Kronk and Gonzalez suits proceed.

"She's not home-free," Sheaffer said. And he dismissed Anthony's attorneys statement that the bankruptcy filing was just a coincidence after an appeals court let stand two misdemeanor convictions against her for lying to law enforcement during the hunt for her daughter, Caylee.

The bankruptcy looks like an attempt to defeat the Kronk and Gonzalez suits, Sheaffer said, "to keep Casey Anthony from finally being put under oath and having to answer some very pointed questions."

What to expect when Dr. Phil McGraw interviews Jose Baez?
 
"The question that I have is did he knowingly misrepresent facts and present scenarios to the court that he knew to be untrue?" McGraw says in a release.
 
McGraw interviews Casey Anthony's former defense attorney at 3 p.m. Friday on WOFL-Channel 35.

A clip shows McGraw lecturing Baez on candor in the court. "From a psychological standpoint, you gave very flimsy reasons" for the sexual-abuse allegations, McGraw tells Baez.
 
The nationally syndicated program says that Baez is "opening up about the case in a way viewers haven't seen before."

The show shared a quote from Baez: "The day I got the call to represent Casey Anthony was the day that changed my life forever."
 
The show says the many questions remain since Anthony was acquitted of murder in the death of her daughter, Caylee.

In an interview Friday on “Dr. Phil,” defense attorney Jose Baez said he never felt bad about accusing George Anthony of molesting Casey Anthony.
 
“Everyone has the right to a defense,” Baez told Dr. Phil McGraw. “I presented this at trial because the prosecution decided to make post-death behavior a relevant fact. The fact that she went out to a bar is not relevant. The fact that she behaved a certain way is not relevant unless it’s consciousness of guilt. That was made all relevant by the prosecution. The sexual abuse was brought in to explain that behavior.”
 
Baez successfully defended Casey Anthony, who was acquitted of murder in the death of her daughter, Caylee. These days, Baez said he has minimal contact with his former client.
 
The Anthony case produced a lot of theatrics, and “Dr. Phil” was no different. McGraw and Baez had some contentious moments on the nationally syndicated show. McGraw said he understood that Baez had to zealously represent his client, but questioned Baez’s candor and dismissed the attorney’s theories as “flimsy.”
 
Baez disagreed with the flimsy criticism and stressed that the defense had no burden of proof at trial. Baez said Casey had a unique ability to hide her pain and cited mental health professionals who told him that compartmentalization is a symptom of someone who has been sexually abused.
 
McGraw scoffed at Baez’s comments.
 
“I have never seen such loose and broad application of psychological disorders,” the TV host told Baez. McGraw dismissed the view that Anthony had post-traumatic stress disorder. “Did they [mental health professionals] really tell you this was a sign of PTSD?” McGraw said.
 
McGraw lectured Baez on PTSD and said someone suffering it relives the event and has paralysis.
 
“Every single person is different,” Baez countered. He complained that mental health professionals try to “cookie-cut” people. “What do you do with that one person who’s different?” Baez asked.
 
McGraw shot back: “A broken leg is broken leg … It’s not like we’re all different.”

After the arguing between host and guest, McGraw praised Baez’s book, “Presumed Guilty,” as well-written and gave it to members of the studio audience. So maybe the theatrics were good for the “Dr. Phil” ratings.
 
Baez was not compensated, and he appeared to promote his book, a spokeswoman for ”Dr. Phil”  said.
 
The show reportedly made a $600,000 donation to a charity set up by George and Cindy Anthony, Casey’s parents, after they appeared on ”Dr. Phil.”

The audience should have been supplied with hip boots to go along with the book.

Chief Judge Belvin Perry Jr. says he was “totally surprised” by the number of people who were “totally fixated” by the Casey Anthony case.
 
In a revealing interview on WFTV-Channel 9’s “Central Florida Spotlight,” Perry mentioned several reasons for that fixation: Grandparents George and Cindy Anthony were “pulling out all stops” to find their granddaughter, Calyee.
 
“Then you had the face of a completely adorable little girl that probably pulled on the heartstrings of every individual that had an opportunity to view her,” Perry said of Caylee.
 
Perry, however, declined to discuss Casey Anthony because he has to vacate two of her convictions for lying to law enforcement.  Anthony was acquitted of murder in her child’s death.
 
Yet the interview went far beyond the Anthony trial to explore the interests and style of one of the most famous judges in the country. Perry said he had no concerns about security and revealed that he receives about a death threat a year. “You just can’t dwell on it, because if you dwell on it, Greg, you become paralyzed,” Perry told moderator Greg Warmoth.   
 
In the interview, Perry also said:

ORLANDO, Fla. — A man was sentenced to 145 days in jail for handing out pamphlets outside the Orange County courthouse during the Casey Anthony trial in 2011.

Chief Judge Belvin Perry designated a special area for public protesting, and he held Mark Schmidter in contempt because Schmidter didn't use the designated area.

Anthony bankruptcy lawyer: Delay hearing on transfer to Orlando

Citing unexpected personal and professional developments, Casey Anthony's bankruptcy lawyer has asked a Tampa federal bankruptcy court to delay a hearing over whether her case should be moved to Orlando, court records show.

In a motion filed last week, David L. Schrader of Tampa asked for the Feb. 26 preliminary hearing in the Anthony case to be rescheduled because he has been hit with an unanticipated workload on a corporate bankruptcy case involving Mirabilis Ventures Inc., the former private equity firm based in Orlando.



At the time the Anthony hearing was set, Schrader's co-counsel in the Mirabilis case — an unidentified Orlando-based lawyer — was scheduled to appear at the Mirabilis final evidentiary hearing this month, according to Schrader. That lawyer has now informed Schrader he will not attend the Mirabilis hearing.

As a result, Schrader said he has not had sufficient time to work on the Anthony case, including her response to a motion that her bankruptcy be transferred to the Orlando division of the U.S. Bankruptcy Court for the Middle District of Florida.

Schrader also cited the recent death of a close friend's mother, the ensuing funeral and other related events that had taken time away from work on the Anthony case.

He also asked the court to consider delaying the first creditors meeting in Anthony's bankruptcy case.

Kronk joins Gonzalez motion to relocate Casey Anthony's bankruptcy

A federal judge may rule today on a motion to delay the first hearing in Casey Anthony's bankruptcy case, which is currently set for Tuesday morning in Tampa.

Meanwhile, a witness from her murder trial, Roy Kronk, has joined a motion to get Anthony's case transferred to Orlando.

Tuesday's hearing is set to address a motion by Zenaida Gonzalez to transfer the case. Gonzalez is suing Anthony for defamation, for telling law enforcement that a nanny with a similar name kidnapped her daughter Caylee in 2008.

Investigators later determined the girl was dead, but not before interviewing Gonzalez, whose name was linked to the ultra-high-profile case in the media — upending her life, she says.

On Monday, Kronk, who is also suing Anthony for defamation, filed paperwork through his attorneys indicating he was joining Gonzalez's request to move the federal bankruptcy case to Orlando.

On the eve of the first hearing in her bankruptcy, attorneys for Casey Anthony on Monday blasted the woman suing her for defamation as a publicity seeker, in a harshly worded new court filing.

At a hearing Tuesday in Tampa, attorneys for Zenaida Gonzalez will ask a judge to move Anthony's Chapter 7 proceedings to Orlando, arguing Anthony only filed in Tampa to avoid media coverage.

Anthony's lawyer also filed statement signed by Anthony's largest creditor, defense lawyer Jose Baez, and her mother, Cindy Anthony, opposing the transfer to Orlando.

However, Gonzalez's motion was joined Monday by Roy Kronk, a meter reader who found the body of Anthony's child. He is also suing Anthony for defamation.

Anthony was acquitted of all major charges in her daughter's death at trial.

A request by her lawyer to delay Tuesday's hearing, citing personal and professional conflicts, was denied by a judge Monday.

Casey Anthony bankruptcy hearing set for Tuesday morning

TAMPA (FOX 13) -
Casey Anthony has a court hearing in Tampa Tuesday morning, but it's not clear whether she will actually be in the courtroom.
 
The hearing is connected to her bankruptcy case, and whether to keep it in Tampa, or move it to Orlando.
 
It is scheduled for 9:30 a.m. at the Sam Gibbons Courthouse in downtown Tampa.

A woman in Alabama just got some federal prison time for hiding assets during her bankruptcy case. A little bit of hope.

There's always hope. But my first thought was there are people like you, me or the woman in Alabama and then there are people like Casey Anthony.  If it were you or me alagary, we would probably be doing time in prison.  Since it's Casey, probably not.  She's like teflon.  Nothing seems to stick.   ::MonkeyNoNo::
