Natalee Holloway's mother settles lawsuit with National Enquirer

BIRMINGHAM, Alabama - The mother of Natalee Holloway, the Mountain Brook teen whose disappearance on a 2005 trip to Aruba triggered years of international headlines, has reached a settlement in a lawsuit against the National Enquirer, according to an order filed by a federal magistrate judge in Birmingham.

U.S. Magistrate Judge T. Michael Putnam issued an order of dismissal in the case last week. In that order the judge states that both sides had notified him that they had reached a settlement on all claims and they are awaiting the completion of the settlement agreement.

Putnam, however, states in his order that either side can re-open the case within 30 days if that becomes necessary.

Harlan Prater, one of the attorneys representing the National Enquirer, declined comment on the proposed settlement. Efforts to reach one of Holloway's attorneys were unsuccessful this afternoon.

The National Enquirer had recently asked Putnam to dismiss the lawsuit filed last year by Natalee's mother, Beth Holloway, against the tabloid.

Putnam on May 22 had dismissed invasion of privacy claims against the National Enquirer in Holloway's lawsuit but denied dismissal of the remainder of the lawsuit for the tort of outrage and intentional infliction of emotional distress. But attorneys for the National Enquirer and its parent company, American Media, on July 8 filed a motion seeking summary judgment to dismiss the remaining claims.

Beth Holloway filed the lawsuit on June 20, 2012 claiming the National Enquirer had published false and horrific headlines, statements, photographs and articles regarding the search for Natalee Holloway. The lawsuit seeks damages for three publications, on June 28, 2010, December 6, 2010, and April 25, 2011, which purport to describe treatment of Natalee Holloway's corpse.

The Gingerbread House Bossier/Caddo Children’s Advocacy Center is a community-based, 501(c)(3) non-profit organization that began serving abused children in 1998.  The Center works in close collaboration with local law enforcement, child protective services, the district attorney’s offices, and medical and mental health professionals to provide the best possible services for abused children and their families.

The Gingerbread House coordinates interviews and investigations with the referring agencies and other professionals from the initial screening to the final disposition of the case.  The Center assists in gathering evidence and documenting the victim’s verbal testimony, which is necessary for criminal prosecution and related proceedings.  Through the Center’s advocacy program, child victims and their families are prepared for the criminal justice process in such a way that prevents further victimization.  The Gingerbread House provides mental health interventions for child victims and their non-offending family members, so that the healing process can begin.  All services are provided at no cost to the victim’s family or referring agency.

In addition to the services provided for child abuse victims, the Gingerbread House provides training opportunities for professionals working in the field of child abuse, as well as community education regarding child abuse and its prevention.  The mission of the Gingerbread House is to lessen the trauma experienced by child abuse victims as allegations are investigated and to provide support for the child victim in any resulting proceedings within the criminal justice system.

Hi everyone-we wanted to let everyone know that as of late do good has decided to close its doors. After a tiring but successful run in doing what we set out to do-upcycle as many bottles as we could set our hands on and also do some further social good, we have had to decide to move on. Regretfully we were not able to sustain the business as we would have liked but we are forever grateful for the businesses and individuals that believed in this effort and continued to purchase our glasses. We will maintain this Facebook for now and use it to post some great eco-friendly ideas in recycling and upcycling and hope that we all continue in our own efforts to do good. Danki!

SAN NICOLAS — Baby Beach is to become a worldwide attraction with Blue Flag certification, for which the government will appropriate 1.7 million florins and Thiel Corporation will set to work in the next six months. Among other things this amount will be used to renovate the parking lot, for more green space, illumination, infrastructure for kiosks, and restrooms. Contractor Thiel Corporation won the public contract last Friday for the facelift of Baby Beach. Expectations are that the work will begin within three weeks and the project will be completed within six months. In addition to aforementioned facilities the company will also put up a partition between the beach and the new parking spots. The floor plan of the area also includes parking spots for tour busses. The existing low walls around the beach will be lengthened to prevent damage to the beach with downpours. Finally, Thiel will ramps adapted for the disabled and build an irrigation well.

Blue Flag

Minister of Tourism, Otmar Oduber (AVP), hopes that with the facelift Baby Beach will be the first beach of Aruba to be certified with the eco-label Blue Flag. At the moment there are only five islands in the Caribbean Sea that have one or more beaches with the certificate, namely St. Maarten (1), Martinique (1), Puerto Rico (7), Dominican Republic (18) and the American Virgin Islands (5).

The plans to have Aruban beaches certified by Blue Flag go all the way back to seven years. In 2011 the government announced that Baby Beach, Mangel Halto and Arashi were to the first to qualify. The Foundation for Environmental Education (FEE), to which Blue Flag belong, supposedly made agreements with the Marine Park Foundation to certify these beaches. Once these beaches have the eco-label they are to serve as model for certification of other beaches in the future. Certification with the eco-label could mean a boost to tourism. Europeans in particular are environment-minded and often choose a holiday destination with this international eco-certification, ATA reported in 2011.

To obtain a certification the beaches are to meet 32 criterions in the following themes: (environment) education, water quality, conservation of nature, and safety & facilities. The criterion includes education and awareness on the flora fauna on the beach and in the sea. The quality of the water must be excellent and be tested on a regular basis. It’s also important that the beaches have restrooms, trash cans, access for handicapped persons, rescue material and beach guards.

Dangers

Warning signs and buoys were already placed at Baby Beach in August 2012 to warn swimmers of the undercurrent and to explain the beach rules. Despite earlier plans the immediate reason to put up the signs was the umpteenth death by drowning. Professional basket ball player Dan Roundfield had namely drowned at Baby Beach earlier that month.

Law360, Los Angeles (September 10, 2013, 4:44 PM ET) -- A California state judge indicated Tuesday he will deny television personality Dr. Phil McGraw's bid to escape a publicity rights claim brought by two brothers suspected in the high-profile disappearance of Natalee Holloway, saying First Amendment protections for newsworthy content don't apply to images of the brothers he broadcast.

Los Angeles Superior Court Judge William A. McLaughlin tentatively sided with Deepak and Satish Kalpoe on one of their many claims arising from a Sept. 15, 2005, episode of “The Dr. Phil Show” that was devoted to the Holloway case. Deepak was shown in a hidden-camera interview with a private investigator working for the show. Footage of both brothers being released from custody in Aruba was also aired.

When a broadcast “includes recklessly false statements, does the newsworthiness exemption exempt the entire matter? My tentative is that it doesn't,” Judge McLaughlin said at a hearing on Dr. Phil's motion for judgment on the pleadings.

McGraw and co-defendants CBS Television Distribution Group and Peteski Productions Inc. had argued that the footage of the Kalpoes could not be carved out as actionable when the brothers were not alleging the entire broadcast was false.

"If [the Kalpoes'] argument were to be true, the newsworthiness exception to a misappropriation [of likeness] claim would be totally vitiated, it just wouldn't exist,” McGraw's attorney Nancy Hamilton said

“In every single instance, every single defamation case, any time anyone is represented in the press, on television or otherwise, they would likewise have a misappropriation claim," she continued. "That's just not the law."

On another of the Kalpoes' claims, Judge McLaughlin tentatively ruled they could not hold the defendants liable for misrepresentations that the private investigator, Jamie Skeeters, allegedly made to Deepak Kalpoe to secure the interview with him. Another judge had previously dismissed Deepak Kalpoe's claims against Skeeters, who died in 2007.

“The Dr. Phil Show” billed the Sept. 15, 2005, episode as an exclusive featuring “new evidence in the Natalee Holloway mystery.” The Kalpoes filed their suit in December 2006, alleging multiple claims including libel, slander, fraudulent misrepresentation and violation of their “right to exclusive ownership and control of their likeness and story regarding Natalee Holloway's disappearance.”

In court papers, the defendants said the publicity rights claim should be tossed under the exception for publication of matters of public interest because the Kalpoes had not alleged “the subject broadcast was 'entirely false' ... or that Deepak never met with Skeeters.”

“Indeed, the [first amended complaint] states that Natalee Holloway's disappearance received extensive media attention throughout the summer of 2005 and that plaintiffs along with Joran van der Sloot were targeted as persons of interest,” they added.

But Judge McLaughlin said at Tuesday's hearing that he had not found any conclusive case law and he thought the defendants should not be excused from liability "just because the broadcast also includes newsworthy items.”

What does this mean?  Is it that what Dr. Phil is trying to do is not okay because of something in general that should pertain to everyone or what Dr. Phil is trying to do is not okay because of something pertaining to what was actually happened on his show with the Kalpoes in particular?

I know that isn't clear, but I am not sure how to clear it up.  What I am trying to ask is did the judge look at the evidence and say Dr. Phil should not have done x to the Kalpoes in particular or is the judge saying no one, generally speaking, should ever get out of a lawsuit using this reasoning?

Does this mean that Dr. Phil would be better off settling with Kalpoes or is the judge saying by restricting their claims, it sets a bad precedence in general, but it has nothing to do with the way he is going to rule in the case?

I have tried  three different ways above to ask the same question and it still sounds unclear.  I know what I am asking, I just don't know how to ask it.  Can anyone help me out here or is my question still as clear as mud?

One more time, is he saying:

Stop trying to wiggle out of it using that reasoning and fight like a man or what you actually did to the Kalpoes was wrong?

The judge is only speaking as to the law in general -- not the specifics of this case.

You're welcome, MuffyBee!  He might be released in 6 years (serve 9 years of his sentence if he shows good behavior in prison).  You're right--it seems to be worrying him of the possibility of being extradited to the U.S.  I think that he is continuing his strategy of manipulating the Peruvian legal system even if he has to use a Peruvian woman in his "get married" tactic to avoid extradition.  Sad.  imo

Here is a comparison shot of the Tennis Shoes Joran was wearing and said to Greta the shoes he lost were exactly like the ones he was wearing. He also said in his statement that he lost his tennis shoes. The other pair of shoes was from his trip to Miami Florida. I put a copy of those tennis shoes in because Joran said in his statement the shoes he lost were the ones he bought in the U.S.




We know the K2s know that the shoes are important to the case because that's the first thing they used to threaten Joran with after he implicatedDeepak on the 10th that something bad happened

After that according to Joran the girl had fallen asleep on the beach. He said he had left her there. He did not say to me where this took place. At that point I got angry at Joran and asked him, why he left that girl on the beach. After that he said that he was walking home barefoot. I then said, what do you mean, you are walking home barefoot and I asked him where his sneakers/sport shoes were. He answered that he had left his sneakers/sport shoes at the beach. I had told him that at that moment I didn't understand what he was talking about, but that if he got home he should call me.

Today is the day after my son's birthday.  All of the missing were in my heart yesterday as we celebrated another year of life. 

Natalee, if the love in a heart could bring a person back to life, surely you would be with us today.  Unfortunately, it was hate, not love that took you away.  It will be love that brings you back.  It will happen, I am sure, for love conquers hate, and there is no mother that loves her daughter more than your mother loves you.  Beth, you were on my mind today.  I cannot feel your pain, but the pain I felt at your loss was tremendous, the pain you must feel has to knock you off your feet every day.  That you get up every day and put one foot in front of the other is a miracle.  Our Lord must place his hands in yours to help you arise each morning.  I am glad to know you have someone with you each and every minute, even the ones you feel more alone than anyone should ever feel.

Let's hope 27 is the magic number.  It seems to some without faith, or some who have temporarily forgotten people are working night and day somewhere to help bring our Natalee home, it will never happen.  Beth, I hope I was not too bold in claiming her as my own, along with countless others who have gone to bed every night with her on our minds and woken up each morning to go confidently through the day, thinking there has been enough suffering, and surely today is the day we will bring Natalee home.

We are here with you, Beth, waiting for the day Natalee comes home and each, in our own way, doing what we can to make that happen.  Maybe we have prayed, attended a book signing, contributed to a search, read your book, or stopped someone from going to the island which will remain nameless, because this is not about them, it is not about fear, it is not about despair.  This is about Natalee and her birthday.  It is a celebration of the anniversary she was born into this world.  We are so grateful she was here.  She has left her footprints in the sand and on our hearts, we will find where her earthly footprints ended and her heavenly ones began.  She will come home.

Beth, I see you in the promos for your various speaking engagements, and for the new projects you embark on to make sure each and every daughter and son of ours comes home safely from a trip that should bring fond memories, even silly teenage memories.  You look so much like Natalee, you are blended as one and I realize she is here with us, and you carry with you her legacy.  You want love, faith, and happiness, just like Natalee, and you want our children and all of us to be able to go on vacation and let our hair down, and let us do it without fear.  We can bring home any kind of memory we want because, when we are safe, we have a choice, a choice to have happy memories, crazy memories, and even outrageous ones, but the memories and the events are our choice and not the choice of someone who would dare bring harm for their 'pleasure.' 

I cannot imagine what they do is pleasure for them, if it was, those memories would last longer and they would not need to repeat their heinous acts over and over again, making things worse and more dangerous with each act.  When will they wake up to the reality of it all?  Thanks for helping all those you have touched remain safe, no matter what they have chosen to do on their trips, as long as they are cognitively aware of what is going on.  With your help, these girls and boys will bring only the happiest of memories back from their safe travels.  I hope these practices become so engrained in our lives, the criminals are thwarted by their practice and the people who are on vacation, know exactly what to do as these practices become innate.

God bless you, Beth for taking what is surely the worst moment of your life and turning it into years of hard work to make sure no one else ever experiences your pain.

Happy Birthday, Natalee!  Beth and Dave, you are forever linked by this ray of sunshine named Natalee.   We celebrate the happy memories of picking her special name, the preparation of the room that would be hers, the many plans you made for her until she was old enough to do them for herself, and the hope you had she would be born healthy, and live a long, happy and fruitful life.  Remember and celebrate those memories, they were real, and cannot be taken from you.  From the moment you looked into her beautiful eyes, she brought happiness and pride to you both.  Beth and Dave made beautiful children, best of all, their beauty started from within.  They must have been outstanding parents.  I can't forget Natalee's sister, a beauty herself, who has missed the guidance of a big sister for too many years.  May God be with you, and all Nat's loving friends and relatives, as we celebrate the 27th anniversary of the birth of our heart, Natalee Holloway.

With the many witnesses that claim to have seen or heard about the blonde phantom woman of the Aruba beaches, I do believe they are seeing something that may be paranormal. With the two EVPs that I received, there is a strong indication that there is paranormal activity. I gathered no positive proof that the EVPs are from Natalee Holloway, nor did I ever see a blonde phantom woman on the beaches of Aruba. Many people believe Joran spiked Natalee’s drinks with drugs. Many people believe that Joran’s father took Natalee on his boat and dumped her body in the ocean. One person I interviewed that calls herself Sasha, says he received this information from the circle of friends that were associated with Joran. My thoughts, when rumors are this strong, there appears there may be some type of foundation of truth and this matter should continue being investigated by the police. As long as Natalee’s death is not confirmed, Aruba cannot truly be ‘one happy island’. There must be a conclusion to this and justice must be served! Natalee will always be in the hearts of millions. She is an innocent girl that confronted evil and paid a terrible price. God bless Natalee.

I have looked at this post over and over because something did not feel right.  I skimmed over names like I usually do, which is why everyone else remembers all of the characters much better than I.  Tonight I read it again, typed a message, with emoticons out my ear, and a very heartfelt apology.  I could hear the little men on the top of my IE tool bar weeping from my pleas of forgiveness.  Then it happened.  I hit Refresh instead of Preview.  The little men were flung from my task bar into oblivion.  I think thy now work for Firefox.  When I was using Firefox, this would not have been a problem, I could hit edit and get every word back and all was right with the world.  With IE, there is no such feature that I know about or can find, and therefore, my apology is known only to the little men on top of my toolbar, may they have had a soft landing.  San would have hated it anyway, maybe it was kismet.

San, a woman with a small name and a big heart, your dedication to Natalee has not gone unnoticed.  You are deeply admired for your ability to pull the right words out of the air at the right moment, and your ability to retrieve the information stored in your memory.  You have, not only the ability to remember what happened years ago, but to remember how that story has changed over the years.  If we only remembered the beginning and not how things changed, we may still be blaming a security guard for her disappearance.  You are not one to live in the past.  Thank you for your dedication to Natalee, San, my fellow mod and fur baby lover.  Your championing of this sweet woman who was taken from us too soon is inspiring.

Few know the fleeting moments of hope -- and anguish -- associated with the search for a missing child like Dave Holloway, the father of Natalee Holloway, the Alabama teen who went missing on a trip to Aruba in 2005. In addition to all of the grief he has felt and witnessed, another emotion surfaces, as well: Guilt. When a child is lost, it at first seems as if the options are inexhaustible. As time passes, the leads become fewer, the attention dies down and Holloway said, some parents he has met are left grasping at straws.

"There's a lot of guilt," he said. "I ran into individuals that felt like they maybe could have done more, keep pushing and pushing, and maybe something will get done."

Natalee Holloway was declared dead in 2012. It was her father who filed the petition. It wasn't, he said, for emotional closure. "At some point in time, you've got to take care of some legal issues. She was still listed as a beneficiary -- there's insurance, savings accounts."

Dave Holloway had started a college fund for Natalee that had to be used by the time she turned 21. Her 21st birthday came and went in 2007, and she wasn't there to collect it.

I've read about two fatal shootings in the Tanki Leendert area in the past few months, so I'm not sure which one they're referring to.  IIRC both fatalities were shot in the head, and in one of the incidents another person was also injured, shot in the leg.  One of the incidents was outside of Club 21.  In one of the recent murders, the shots were fired from a scooter iirc.  From the other articles about this incident I don't think anyone was injured, the car just drove by and shot several times toward a home and car.

ORANJESTAD, Aruba:--- A female tourist was crushed to death on Monday by a police motorcycle. According to 24 Hours News in Aruba, the accident occurred just in front of the Customs Office on L.G. Smith Boulevard. 24 Hours News also has a large number of photos of the accident scene on their website. The officer that crushed the female tourist to death while she was crossing the street was removed from the scene by ambulance personnel. It appears as though the victim's brother was also on the scene as an older male tourist was seen sitting on the sidewalk as persons at the scene tried to comfort him while police officers were taking information from him. Other tourists that were in the immediate area seemed devastated by the deadly accident. The officer is also said to be in serious medical condition.

Also in Aruba the prisoners at the prison in Aruba managed to take over the prison operations in Aruba for about one hour on Monday. According to information SMN News received, the prisoners took over when the prison guards held a walk out protesting against certain working conditions. SMN News further learnt that a fight broke out inside the Aruba prison when the prisoners took over. Up to press time it was not clear how many prisoners and or other persons were hurt at the prison in Aruba.

ORANJESTAD, Aruba - Media reports in Aruba say a German tourist died from being hit by a police officer on a motorcycle responding to an emergency.

Local media on Tuesday say police identified the woman as 48-year-old Stephanie Schofer. No hometown has been released, but authorities say she was a passenger aboard the Carnival Corp.-owned AIDAluna cruise ship.

Phone calls made by The Associated Press to Aruba's media relations office were not answered.

Monday afternoon, around 1:45 p.m. a fatal accident occurred in front of the Customs Office on L.G. Smith Boulevard in Oranjestad. A police officer on motorcycle was traveling east at a very high speed, responding to a call, running his siren on the way to an emergency at Aruba’s prison, to warn motorists and pedestrians to clear the road. Unfortunately, a female tourist crossed in front of him, resulting in her immediate death and serious injury to the officer.

It was in the midday hours and the guards at Aruba’s prison in San Nicolas, the KIA, were staging a walkout. The police received information that prisoners were lighting fires and standing on the roof. Patrols were radioed and told to respond with urgency to the KIA to assist the other officers at the site. The traffic was very congested in Oranjestad, which is why the officer choose to use his siren to clear the road and make it possible to reach the site faster.

“I am sorry from the bottom of my heart for the accident that occurred yesterday. It is a proof of how great danger is to police officers when doing their job, not only for themselves but also for others. Our colleague was going in a very high speed with his siren on to fulfill his duties, and found himself involved in an accident which he surely was not prepared for, nor intended,” said Police Commissioner Dolfi Richardson. “To the families of the deceased, our most profound condolences and we ask our good Lord to console them in these difficult moments. She was accompanied by her partner, who was in shock regarding the horrific accident and received assistance from experts of the Victims Assistance Department of the Police Force.

The case is under investigation by the concerned departments. Witnesses are being interviewed, but no conclusions are being issued until a full inspection of the incident. Authorities feel it is important to find out exactly how this accident occurred before making any decisions or issuing further statements.

Aruba: German Tourist, 48, Hit, Killed By a Motorcycle Officer Enroute to an Emergency

With the pro forma discussion of the case last May the judge released the suspects under certain conditions. Considering that the discussion of the case will not be held in the near future because some of the witnesses to be heard are nowhere to be found, the lawyers requested the judge to drop these conditions. The judge agreed and the suspects were given back their passports.

The witnesses to be heard are abroad but nowhere to be found. Apparently the judge thinks it’s important to hear these witnesses and has adjourned the case again. The Public Prosecutor is to receive support from colleagues from St. Maarten, Columbia and the Dominican Republic to hear these witnesses.

The suspects were arrested for their involvement with human trafficking just like the brains – the 30-year old Columbian female Lida Marcela Muñoz Cuadros, who is wanted by Interpol. The investigation into the human trafficking began in 2009 in the Columbian city Cali where the Columbian police (DIJIN) arrested four suspects of human trafficking two years later. After these arrests the Columbian police contacted the Dutch embassy which requested the local special police team to arrest the members of the network on the island. A trace of e-mails to Cuadros revealed they were on Curaçao.

After the members of the network were identified the local police informed the Columbian authorities in January on the progress of the investigation.

The investigation reveals that Cuadros had fetched women from the Columbian Valle del Cauca to Curaçao to work in the erotic branch. According to the parliamentarian, the motion should have requested conducting an investigation into human trafficking in the entire Kingdom. No Punitives Over Dr Phil's Tabloid Tactics

LOS ANGELES (CN) - Two brothers' failure to demand a correction from Dr. Phil over secretly videotaped admissions in the Natalee Holloway disappearance doomed their chances of collecting punitive damages, a California appeals court ruled Tuesday.
     Surinam nationals Deepak and Satish Kalpoe sued Dr. Phil McGraw, Peteski Productions and CBS Paramount, who hired private investigator Jamie Skeeters to investigate Holloway's 2005 disappearance in Aruba. Skeeters met with Deepak on the pretense of exonerating him, and secretly recorded their meeting.
     The show aired in September 2005, and the illicit video showed Deepak confirming that he and his brother had had sex with Holloway the night she disappeared. But after the broadcast, Deepak claimed he had not consented to Skeeters recording their meeting, denied that he and his brother had sex with Holloway and accused the producers of manipulating the video to say otherwise.
     Deepak and Satish sued in 2006 for defamation, invasion of privacy, emotional distress and conspiracy. Years later, Dr. Phil and his producers filed a request to bar the brothers from presenting any evidence relating to general or punitive damages, citing a state law that requires parties seeking damages for defamation from news sources to first demand a correction or be limited to recovering only special damages.
     The brothers admitted they never demanded a correction from Dr. Phil or the producers, and the trial court granted the request in 2012.
     On appeal, the Kalpoes claim that the 1931 law - which was amended in 1949 to include visual broadcasts - only applies to media in the business of breaking news broadcasts, not tabloid exposes of months-old disappearances.
     Writing for a three-judge panel of Second Appellate District, Judge Fred Woods noted that on its face the law in question contains nothing that limits its application to breaking news sources only. And while case-law on the issue draws a distinction between newspapers and magazines, the same cannot be said for radio and television broadcasting.

After reading the article, some of our puzzlement is a bit clearer. In 2012, we read here that even if the trial was to be actually heard in 2014 -- the Kalpoes could not present any evidence. Apparently, that is what has been on appeal by the Kalpoes. It would be my bet that the trial theoretically could still go on, but what is the point?!?

A state law barring recovery of non-economic damages in a defamation suit against a or broadcaster if the plaintiff fails to make a timely retraction demand is not limited to defendants engaged in the immediate dissemination of news, the Court of Appeal for this district ruled yesterday

Div. Seven denied a writ of mandate sought by Derek and Satish Kalpoe, who filed suit in 2006 against television host Phillip McGraw—better known as “Dr. Phil”—as well as CBS Paramount and Peteski Productions Inc., which air and produce McGraw’s daytime afternoon talk program. The Kalpoes, who live in Aruba, have been longtime suspects in the disappearance of teenaged American tourist Natalee Holloway on the Caribbean island in 2005.

The brothers claim that a private investigator working for the defendants gained their cooperation by pretending to be seeking information demonstrating their innocence, and that the show then broadcast an edited videotape that portrayed them in a false light. It showed Deepak Kalpoe indicating that Holloway had sex with him and his brother.

Deepak Kalpoe subsequently claimed that he had no knowledge of the videotaping, and that when the investigator—Jamie Skeeters, who died in 2007—asked if Holloway and had sex with him and his brother, Kalpoe shook his head and answered in the negative, and that the tape was manipulated for purposes of the broadcast.

Motion in Limine

The brothers brought their writ petition earlier this year after Los Angeles Superior Court Judge William MacLaughlin granted a motion in limine that bars them from recovering general or exemplary damages, pursuant to Civil Code §§ 48a and 48.5.

The story of Natalee Holloway may seem a tabloid relic by now, but Phillip McGraw, CBS Paramount Domestic Television and Peteski Productions are still mired in a 7-year-old lawsuit over a 2005 Dr. Phil episode devoted to the disappearance of the American teenager. The defendants at very least won't face the possibility of punitive damages after a ruling by a California appeals court on Tuesday.

The case is ongoing in a Los Angeles Superior Court and pending at the moment is the defendants' motion for summary judgment. In the meantime, an appeal was pursued regarding to the judge's ruling that barred the Kalpoe brothers from introducing evidence regarding general or punitive damages for failure to demand a correction.

The basis for limiting damages in the absence of a demand for correction is California Civil Code section 48a, enacted in 1931 and amended in 1945. Plaintiffs in libel cases can only collect "special damages" (quantifiable monetary losses) without a correction demand made within 20 days.

I think a material fact is wrong -- or I misunderstood what happened all this time! The court document says Dr. Phil HIRED Jamie Skeeters to go to Aruba and tape the Kalpoes. It was my impression that Skeeters acted on his own and THEN collaborated with Dr. Phil.  Anyone????

I believe Dr. Phil hired Skeeters.  I don't think Skeeters acted on his own but I could be wrong too.

Remember, this was early in the investigation, September 2005.  Dr. Phil was planning a big show on the Natalee Holloway case.  He sends Jamie Skeeters, Harold Copus and John Weeks (I think that was his name) to Aruba to interview and film the suspects and anyone close including Nadira.  All for his show.  So I'm pretty sure it was Dr. Phil who hired Jamie.

Nevertheless...those dirtbag Kalpoe's admitted having sex with Natalee, according to the Kalpoe's early in the investigation they said all three had sex with Natalee - the only way that would happen is by force. 

They don't deserve anything, they should be in jail just like Sloot.

We all give an AMEN to that!  If I understand the clippings and comments, the case is ongoing and the outcome will determine who pays the lawyers. I'd love it if any future earnings by the Kalpoes could be attached to pay the bill, because I'm sure they don't have the money to pay if the ruling goes against them. I think I'm right in saying that you can't bankrupt out of a court ordered payment.

During his investigation, Skeeters interviewed suspect Deepak Kalpoe, an interview which he recorded. In the conversation, Kalpoe admits to having sex with Natalee, something he had never admitted in any his multiple meetings with police.

A California appeals court has ruled in favor of talk show host Dr. Phil McGraw, in a defamation lawsuit over his coverage of the Natalee Holloway case.

The suit was filed about seven years ago by two Surinamese brothers who claim the television psychologist aired a segment on his show that depicted them as "guilty of committing criminal acts against Holloway."

Judge Fred Woods, writing for a three-judge panel of the Second Appellate District on Dec. 17, cited a California statute in their ruling. The code, the judge wrote, requires parties seeking damages for defamation from news sources to first "demand a correction" or "[be] limited only to recovering special damages."

The statute was important to the ruling because the plaintiffs did not dispute claims by Dr. Phil's attorneys that they never demanded a correction from Dr. Phil or the producers of his show.

Los Angeles Superior Court Judge William MacLaughlin had cited the same code in his December 2012 ruling that the plaintiffs could not seek punitive or general damages. However, the defense then asked the court to reconsider the ruling. They maintained the retraction rule only applied to media outlets engaged in the "immediate and rapid dissemination of news."

In Tuesday’s written ruling, Woods said the three-judge panel could not conclude that the statute only applies to outlets that engage in covering breaking news.

"The petition is denied [and] each party is to bear its own costs," Woods wrote in his ruling.

ORANJESTAD — An estimated 25 billion dollars on black money has been channeled via Aruba from 2002 up to and including 2011. In 2011 it regards 3.6 billion dollars, according to the report ‘Illicit Financial Flows from Development Countries’ published by Global Financial Integrity (GFI) last week. It regards proceeds from crime, corruption or tax evasion.With this, Aruba is 31st on a list of 144 development countries mostly dealing with illicit financial flows. China, Russia and Mexico lead the list. Of the Caribbean islands only Trinidad and Tobago (28th place) is higher than Aruba. Also the Bahamas score high with a 49th place and approx. 15 billion on black money in a period of ten years. In total these illicit financial flows amounted to almost 950 billion dollars in 2011. A substantial increase compared to 2010 (832 billion dollars). It’s money that doesn’t go to the economy due to tax evasion and white-collar crime.

Economist Dev Kar, author of the report, puts the Aruba figure into perspective slightly. On the site of the Caribisch Netwer, he’s quoted as follows: “The data from tax paradises such as Aruba is estimation. We’re always non-committal because they’re not liberal when it comes to providing information.”

The Amigoe contacted Minister of Finance, Juan David Yrausquin (AVP) for a reaction. However, he prefers to comment later on. Evelyn Wever-Croes, leader of opposition party MEP is somewhat shocked by the amounts mentioned in the report. “But not about the fact itself. It’s evident that this happens. We saw this recently with the millionaire election campaign of AVP.” Croes was head of Tax Inspection until the end of 2001.

“Tax evasion was always at the top of Siad’s agenda but Siad lacked the means and personnel to take action.” With this Croes referred to more staff in the control dept., more trained and experienced inspectors to arrange assessments. “And no interference of ministers in their work. In the past year the government interfered with the functioning of Siad and demanded that steep discounts be given on tax arrears of people who campaigned for them. To do this they even dismissed senior officials who refused to give these discounts. All of this clears the way for tax evasion”, Croes said.

 Long before spearheading Alex Rodriguez’s cutthroat campaign to beat a steroid rap, attorney Joe Tacopina stood on the Bronx courthouse steps beside another fallen New York star — ex-NYPD Commissioner Bernard Kerik.

It was June 30, 2006, and Kerik had just pleaded guilty to two misdemeanor charges. The former top cop admitted accepting a $165,000 gift of apartment renovations seven years before from an allegedly mob-tied company seeking to do business with the city.

Tacopina assured his client that his legal troubles were over and he was free to focus on his security consulting business in the Middle East.

Privately, Kerik’s friends say, Tacopina described the violations this way: “Like pissing on the sidewalk.”
Two years later, Kerik was federal inmate No. 84888-054, sitting in a Maryland cell and wondering if the slick defense attorney helped the feds put him behind bars.

Kerik, a 9/11 hero and one of the most decorated police commissioners in New York City history, is now a free man looking for answers.

Kerik, in a bar complaint filed Friday, accused Tacopina of engaging in “conduct involving dishonesty, fraud, deceit, and/or misrepresentation” — along with a list of explosive legal abuses:

Cooperating with federal prosecutors and revealing information crucial to Kerik’s defense to the government without informing or receiving consent from his client.

Watching that video brings so much back. Knowing what we do now, and what was to come in Peru, it's just hard to watch and listen to Cohen and Tacky. Cohen, with his slick "face of the investigation" to try to make the case more palatable for tourists, and JT stating matter of factly that if there were evidence, it's almost certainly gone now, seems to come from a confident lawyer representing his guilty client. Aruba's sands will always be tinged with Natalee's blood. The Aruban authorities in power are guilty of obstructing justice for Natalee and guilty of accessory to murder of Stephany! What a slime ball JT is!

Isn't this rather interesting though that tourism from the United States for 2012 in Aruba is still not back to 2005 and pre-Natalee Holloway disappearance levels of 2004.

They said their were a lot  Attractions, Activities ...to keep them out of the water and the weather was beautiful food was good and drinks were free they stayed in a 5 star motel no one bothered them at all and the natives were nice but the Dutch were mean to everyone

Natalee was in my son's class at Alabama and he is living life to the fullest ..........just so poignant it brings me to tears all over again for Beth. How any of Aruba could have attacked and slandered Beth or Natalee as they did, such a loving mother & daughter and kind person - is beyond me.
