If Juan writes a book.......... I'll buy it!! I don't think anyone can keep him from doing it. Baez wrote a book, Ashton wrote a book, Darden and Clark both wrote books after OJ's trial, and I hope Martinez writes one too. Jodi's camp just doesn't want all that Juan knows to come out, IMO, and they don't want him to profit off of the case. Maybe they're thinking of writing a book themselves and don't want the competition.

I find it hard to feel sorry for Jodie's parents! Sandy arias and her sister displayed very improper behaviour in court towards the Alexander family .
You could see them giggling and mocking the Alexander's! I find that totally unacceptable , but dr drew or anyone on his show mention any such thing. I've seen many families of people committing such crime as JA ! Most acted with respect in the courtroom ! I was in sensed with the behaviour of her family. It was just so ghetto and so typical of someone with no class. Than they want people to feel empathy toward them! Please they aren't being victimized and if they are it's of their doing.
What about the Alexander's what about what they have suffered and still are suffering. And now the aunt and her petition to stop juan from writing a book! Please many people were upset with those ribbons the family wore in support of domestic violence. JA was no victim she was the perpetrator.

I cannot comprehend that Travis' anger in his text at the end of May had anything to do with a sex tape.  It makes sense that he would not have given Jodi more fuel for the fire.  IMO

I hope the judge won't delay the process today, and I wish it were being "live" broadcasted.  The defense is suppose to be asking for up to a year delay and it's possible that a deal will be entertained. I say, do it and get on with it! The sooner JA sits on death row, the better, in my book!

The parents of Jodi Arias would have had me in their corner as victims IF they had addressed Travis' family in the mitigation/sentencing phase and ... apologized for not heeding the waving red flags with positive action.

If William and/or Sandra Arias address the Travis' family in the upcoming trial ... I will consider their words insincere.  In other words ... too little; too late.  I will consider it all a strategy to influence jurors to vote against the death penalty.

Nevertheless ... I believe the outcome of a new trial will not differ.  Think about it.  What are the chances that 12 jurors will come down on the side of the death penalty.  Think about the testimony of the prosecution's  own expert.  Janeen DeMarte testified that Jodi had borderline personality disorder which may have caused her to "act out of desperation".  Will this be a mitigation factor presented by the defense in a new sentencing phase.

At this point ... rather than dragging out the process ... IF the sentence ruled by the judge was "life without parole" ... the scales of justice would not be balanced but ...

Janet, I don't think them addressing the Alexander's would have lessen my thoughts of them...and would probably have pizzed me off even more. SA tried to sell the forged letters to the Nat'l Enquirer, wore those stupid domestic abuse ribbons, laughed and giggled throughout the trial. Sat there and looked at the brutal slaughter pictures and never shed a tear, never looked at Travis' family with compassion.... Sorry, call me a hardazz, but I have nothing for them than disgust and disdain. ::MonkeyMad:: God forbid my child ever do something criminal....for I would continue to love him but I certainly would not support him in his lies.

Hi Blonde, there is nothing that proves he wanted to see her again. JMO I think she showed up at his house unannounced saying she had the tape and wanted him to see her erase/delete it. There are some calls to him the day before the murder, but they were short and didn't look like there was conversation.  Also remember she had his code to his phone to get messages. What happened after she got there....well we have seen the pictures....perhaps she enticed him into one last booty call?  We will never know the truth about that last day.  ::MonkeyTears:: ::MonkeyTears::

Sunny ... I believe Jodi is worthy of the death penalty and in the name of justice I hope that 12 jurors concur.  However ... I concede IF it were one of my grown kids in Jodi's place ... I do not know what I would do in my efforts to take the death penalty off the table.

Blonde, I can see this trial has been very difficult for you. But please remember the circumstances of the terrible treatment you received at the hands of your ex aren't the same as was between Travis and Jodi.  You have been a battered woman and it's sad one human being will treat another in such a manner.  No one has been able to show Travis abused Jodi, it's only her word, and she's a proven liar over and over and over.  He had no history of being an abuser and no one has come forward from his prior relationships and said he abused them.  I personally believe in this case, the expert witnesses were brought in to try to defend Jodi from the death penalty under the guise she was abused.  There was so much other evidence going against her, it's all they had to try to save her life, imo.  I believe all the time spent on talking about sex in the case was a diversion.  The same with the accusations Travis was a pedophile.  Nothing.  Nada.  No proof.  No history.  Nothing on computers, no one coming forth to offer proof he was a pedophile.

It's of course just my own humble opinion.  And I would like to add that for the horrific way Travis Alexander was murdered and he suffered, and his family and friends had to suffer at the trial because of the Jodi's lies, I have absolutely no sympathy for Jodi and no respect for those that helped in the attempt to defame him.

I have seen several cases where people with LWOP was changed to life and then paroled. As a mother I would hope for that, but as a victim I would be scared it could happen.

The feasibility of justice prevailing for Travis should be the determining factor whether the trial is ongoing ... not cost.
 
I contend when a 1st degree premeditated verdict  has been rendered ... aggravating and mitigating factors should be non-issues.  Premeditation implies no mercy was afforded the victim.

Judge in Arias case delays decision on next move

PHOENIX — A judge delayed a decision Thursday on the next step for the murder trial of Jodi Arias, who made her first court appearance since the jury was unable to reach a decision last month on punishment for killing her boyfriend.

The judge scheduled another hearing for July 18, the date a new penalty phase had been tentatively scheduled to start.

While the murder conviction will stand, a new penalty phase must occur to decide Arias' punishment. It will be a mini-trial of sorts to get a fresh jury up to speed on the case. Jury selection alone could take weeks, given the difficulty of seating an impartial panel in the high-profile case.

Prosecutors have the option of taking the death penalty off the table, and Stephens would then sentence Arias to one of two punishments: life in prison or the more unlikely life in prison with the possibility of release after 25 years.

If prosecutors do pursue death, a new panel must be seated to determine a sentence. If another deadlock occurs, the death penalty would automatically be removed, leaving the judge to sentence Arias to one of the life-in-prison options.

Maricopa County Attorney Bill Montgomery said last week his office continues to prepare for a retrial aimed at securing a death sentence. He had previously said he is confident an impartial jury can be seated to determine Arias' punishment but added that he is open to input from defense lawyers and the victim's family about possibly scrapping a new trial in favor of a life sentence for Arias.

Meanwhile, after losing motions for mistrials, appeals to higher courts and efforts to quit the case altogether, Arias' attorneys tried a new tactic this month, appealing to the court of public opinion while hoping to influence Montgomery's decision.

"It is solely for them to determine if continuing to pursue a death sentence upon Ms. Arias, who is already facing a mandatory life sentence, is a good and proper use of taxpayer resources," defense attorneys Kirk Nurmi and Jennifer Willmott wrote in a statement provided to The Arizona Republic.

Taxpayers footed the bill for Arias' court-appointed attorneys at a cost so far of nearly $1.7 million, a price tag that will only balloon if the case moves forward.

Ken Pittenger wrote a letter to his local paper Siskiyou Daily News in support of Jodi Arias’ parents after he observed the harassment he says they've been subjected to over time.

In part, Pittenger writes:

I learned that there is additional pain being brought on by people who wanted to inject vicious comments on Facebook and anomalous telephone calls, making threats and taunts: "Hope your daughter fries in hell," "hope your business dies too," etc. These calls continue, and the strain is taking its toll on Bill and Sandy.

I was so disappointed that Judge Stephens deferred ruling on the motion to continue until July 18, the date the trial was to resume. By deferring until July 18, they vacated the current trial date.

So, the defense did get a continuance. Not until the first of the year (yet) at least.

On the other hand, I was pleased to see Jodi in jail stripes and her hands cuffed and being escourted by a guard who was holding her belt in the back.

So she was staring down Tara and diane and the other jurors that attended. Didnt they mention she smiled big at some guy name Johnny ??? Anything new on that.???

She's pure evil dark eyes dark heart.

To bad the Zimmerman judge could preside of this case! Not that's one judge that takes no mess!!! She ain't no joke.

I thought she wasn't to prosper from any money once convicted? Why is she selling art?

I am disappointed too.  I misunderstood the judge's ruling and thought that that trial would resume on July 18.  I was rejoicing until Sunny posted that I had got it all wrong.  Story of my life.

Tomorrow Hubby and I are off to our church camp tomorrow for the weekend.  A Hawaiian dinner and social has been planned for Saturday evening.  We just got home from shopping at Value Village.  Hubby purchased a flowered shirt he will never wear again for $3.00.  I purchased a beautiful long  flowered nighty for $6.00.  The sales lady informed me if I wore underwear ... it is no longer a nighty ... it is called a MooMoo.  I believed her.  I hope I will not be required to a hoola dance.

PHOENIX - We're getting a closer look at the movie "Jodi Arias: Dirty Little Secrets," which is set to air this weekend.

It was a love affair made for TV. Now it's getting ready to premiere on the Lifetime Cable network.

The drama has everything, from the moment Jodi and Travis first meet in Las Vegas back in 2006, to their 2-year love affair that included breakups and makeups.

It even re-enacts the night Jodi stabbed Travis, slit his throat and then shot him in the shower.

The most watched trial in Arizona history is also featured.

And while the producers admit that some facts were fudged, this bizarre movie, ripped from the headlines, has basically written itself.

The alarm clock goes off at 2 am in order to make sure these trial divas get ready and trot down to the Maricopa County Courthouse to attend the Jodi Arias Status Conference set for today’s calendar.  It is the first time we will see Jodi since the jury was unable to come to a unanimous decision regarding life or death.  The day is built with great anticipation as every person who has been following the trial is hoping Judge Stephens will deny the defenses request for continuance and finish the retrial of sentencing phase.  We know how important it is to support our fellow trial junkies by getting updated and accurate information, so we make sure we are there extra early in order to get in.  This early arrival does not mean we fall short of caffeine as we make a pit stop at the local Starbuck’s since wine is not allowed in the courthouse.  So, off we go in our Jimmy Choo’s to take on the day and see exactly what Judge Stephens and Jodi Arias have in store for everybody eagerly watching!

Then what came next is the moment we all have talked about, waited for and felt was long overdue.  Jodi is escorted into the courtroom by guards who have her SHACKLED, yes I said shackled.  Let me reiterate that Jodi Arias was in SHACKLES, stripes and hobbling.  You could hear the clanking from the chains as she limped through the courtroom.  Now I must stop and tell you that not only was she SHACKLED, the guards escorting her were in full body armor and were hefty in size.  Even the female officer was so husky I would probably still lose if I had a stiletto as a weapon. With these large officers at the hand of Jodi Arias’s waist to guide her around, the perfect moment erupts as this woman who has controlled the media, demanded make-up and taken charge for so long is finally escorted through the plentiful pool of male attorneys as they watch this vain individual in her unflattering attire and greasy hair locked up tight shuffling past them in embarrassment.  She tried to play it nonchalant in her stride and yet if one played close enough attention, Jodi Arias was deeply mortified.  Instead of having pity it is apparent that Jodi is finally being treated like the criminal she is.  As we sat there watching this, I hear birds chirp in my head and the song Hallelujah play as if I have just discovered a magnificent sale on some Christian Loutboutin’s.

That was a rather clairvoyant statement on Jodi`s mom`s part asking about her daughter`s fate back in 2008. Today`s hearing lasted 43 seconds and ended with as much of a big question mark. Here`s a quick clip.

PINSKY: Lauren Lake and Jenny Hutt are back. Joining us as well, two of Jodi`s jurors, Tara Kelley, she was number 17, an alternate, and Diane Schwartz, juror number 7. They were both in court today.

But, first, quickly out to Shanna Hogan for the latest.

Shanna, what have you got? Is Shanna there?

Not there. OK, I`m going to you guys.

Tara, I believe when Jodi came out in all that prison garb, Jodi caught your eye, is that right?

TARA KELLEY, JUROR: That`s correct.

PINSKY: What happened?

KELLEY: Well, we actually were seated one row behind the family of Jodi. So it was her mother and two other people that were with her. Travis` aunt had went to the back with Juan Martinez, I went and sat in her seat to talk to the friends that were over there. And as Jodi started coming back in from judge`s chambers, I realized she was coming in so I stood up to walk to my seat. Halfway through when she was walking, she realized I was there and we locked eyes and she continued to stare at me until I was able to go sit down and join the other two jurors, who then she looked at them as well.

SCHACHER: Creepy.

PINSKY: Creepy, yes.

Diane, was it the usual emptiness that so many of the Travis` friends had described or something a little more hostile there?

DIANE SCHWARTZ, JUROR: I felt a little bit more hostility. But there was a real emptiness. I mentioned to Tara later, did you see how black her eyes were? Extremely black. But she definitely looked at all three jurors. It was very apparent.

PINSKY: Now, as you look at this video, when she goes around, you`re going to see how deeply -- they`ve got her in shackles, a big leather belt around her. Is that -- do we have other footage of this or do we have other footage? Under that blue bar you can see she has this huge leather bar around her waist, her hands are shackled to the bar.

I mean, does she need, Lauren, does she -- is she dangerous that way that she needs that kind of shackling?

LAUREN LAKE, ATTORNEY: Well, Dr. Drew, absolutely. And not just the danger factor. The flight risk factor as well. I mean, she could potentially plan an escape. This girl has been known to be capable of a lot of things and is not trustworthy.

Also, she`s been on suicide watch so she could potentially harm herself or someone else. She`s also one of the most-hated women in America. So this is in the interest of the public and also defendant.

PINSKY: Jenny, got something to say?

HUTT: Sorry, I`d like to say something. What happened to the woman who at her allocution was saying sorry for what she caused, was sorry for the Alexander family, that girl was angry.

PINSKY: Jenny, you may be shocked to know this Jodi Arias woman shocks and distorts things.

(CROSSTALK)

PINSKY: Very shocking I know to hear that.

HUTT: Dr. Drew?

PINSKY: Yes.

HUTT: She gave up the act I feel like. In that 43 seconds, she was angry. She was nasty. She gave up the act.

SCHACHER: Saw the true Jodi Arias.

HUTT: Yes.

SCHACHER: Yes.

PINSKY: Diane, tell us about the gesture that Travis` aunt made for you guys.

SCHWARTZ: It was very, very nice. We were -- the bailiff had seated us. Travis` aunt put her arms around me and she said, you can sit with the family, we`d love to have you over there. And then she gave a great big hug and she said, thank you for your service. That was worth being there for that.

PINSKY: That`s nice.

SCHWARTZ: That was a real heartwarming feeling.

SCHACHER: That`s nice.

PIUNSKY: That is nice. You guys I know all had a lot of ambivalence that you had let the family down.

Lauren, I want to ask you something. What do you think the defense attorneys felt when they took a look at our jurors? If you were the defense attorney how would you behave? Then we`ll hear what they saw.

LAKE: Well, you know, if I saw the jurors there and I`m sitting in the defense position, of course, you`d know that these people are very attached to this case. And you`re thinking to yourself, oh, well, this isn`t looking good for my defendant, is it going to throw my client off, is it going to some way affect the outcome?

But at the end of the day, the defense walked away today with a little more time.

PINSKY: And ladies, Tara, what did you see when Jodi`s lawyer saw you?

KELLEY: Well, we actually had seen Kirk Nurmi standing with his security female that was with him before the courtroom even opened. And as soon as he saw us, he pretty much looked disgusted seeing us there.

PINSKY: Diane, you had the same feeling?

SCHWARTZ: He -- I didn`t really look at him or try to interact with him at all. I felt that I wasn`t there to watch him and so I really didn`t interact with him at all.

PINSKY: Before we wrap this up, Sam, did you have something you wanted to say?

SCHACHER: I wanted to know when you were sitting with the Alexander family, how did they appear? How were they holding up, did you talk to them?

KELLEY: We actually went and had breakfast with his aunt and some of their friends.

SCHACHER: Wow.

KELLEY: They`re holding up, you know? It`s frustrating that it`s being delayed again for the hearing. But you know, they`re troupers, they`re hanging in there.

SCHWARTZ: I felt the same way.

PINSKY: Any word how Samantha`s doing?

KELLEY: I know that they said they were definitely keeping track of -- you know, keeping her, you know -- they`re trying to help her out as much as possible. But it seems like the family is trying to move on in their normal lives until the next hearing and everything starts again.

PINSKY: Great.

As far as I understand the system the family of Travis has to have another court make an order to stop her.
Until then, she probably has it set up for any finances to go to a family member since she can't receive
the funds in jail other then people can send her checks. Many times people do that so they can get
her autograph to sell later on for profit. People did that with Casey Anthony. They have to sign the checks
and they get deposited in some jail fund for them  to use at the jail commissary.

I have a hard time believing she would accept a plea if it was LWOP (and IMO that is the only deal the state would offer, IF they would offer) and I don't believe I have heard a plea deal has been offered. Of course we never know what goes on behind closed doors.   ::MonkeyNoNo::

Yes I believe you are correct. but Donovan is on supervised probation  SORRY but I do not have a link....the link I had seems to be broken...but this what I noted... Donovan Bering, (convicted felon-arson of an occupied structure), is finally under investigation by the Maricopa County Adult Probation Department for parole violations.

Bering is on supervised probation and presumably is forbidden to have any contact with other convicted felons, (Jodi Arias).

Donovan Bering has been posting Arias's comments on a proxy Twitter account and promoting Arias's fund-raising efforts, (artwork, T-shirts, private donations, etc..)

I think her mother/aunt are now tweeting for her....A 'friend' is running the 'art AKA tracing site' and selling her tracings, copy drawing.

since the Women's Center she CLAIMED was getting a portion of the proceeds put out a a statement that they knew NOTHING about it and had received no monies from ja, she changed her lies from abused women to abused animals.....wicked, evil murderer.  ::MonkeyMad::

Unfortunately, I watched part of the Lifetime Tv movie.
I think it was just ordinary, typical tv and did not interest me because they started embellishing the first meeting between
Jodi and Travis with Jodi coming into the mens room while Travis was reliving himself & somehow she is attracted to
him. Producers got into the sex almost immediately. I think they should have shown a more real, truthful way of telling
the story, but they used the sex which Nurmi and Wilmot sensationalized in court to tell the story. So I turned it off.

You are welcome...I hope you scrolled down the article as they were several video clips.  Michael Keifer, the reporter on this article has a bone with Juan and takes every opportunity to smear him. He loved bringing out that Juan was asked not to be so aggressive with dear old alyce laviolette.  These clipped simply reinforced my opinion that JSS severely hendered JM  not only in his court style but in what he was allowed to get on the record.  She went so far as to sustaining the def's objection to Juan saying she was being non-responsive.  JSS agreed with JM tht alv was trying to get on the record information SHE thought was important even after JSS had asked her not to. JSS requested the jw speak to her about it AGAIN during the break. JSS stated she didn't want to admonish alv in front of the jury.  What the hell!!  She alv continued saying what SHE wanted to.  I hope JSS has learned a well needed lesson, but my gut tells me she DID NOT.  JMO

that is really nice. I really don't know how his family has managed all these months financially. I have donated what I could and many more have but I am sure it wasn't enough.....I know AZ has a victim's fund and I sure hope they have been able to collect some from that.

I just can't imagine ja inspiring me to do anything but cuss and spit!!

Jodi Arias trial update: Judge moves status conference

PHOENIX - The judge in the Jodi Arias murder trial has moved a hearing back by two days, according to the Maricopa County Superior Court.

According to a Tuesday message on Twitter, the court said Judge Sherry Stephens reset the Status Conference and Motion to Continue Trial from July 18 to July 16.

Had an angio pasty spelled wrong I'm sure they thought I had blockage! Thank god not! But that night I was rolled into surjery to remove my gallbladder.  Got out today ! There's no place like home. I couldn't ACESS this site.

Their June motion appears to challenge a landmark 2002 U.S. Supreme Court ruling that found a defendant has the right to have a jury, rather than a judge, decide on the existence of an aggravating factor that makes the defendant eligible for capital punishment"

Jodi Arias made a brief courtroom appearance Tuesday morning but no new trial date was set for the sentencing phase of her murder trial.

Maricopa County Superior Court Judge Sherry Stephens said she wanted to set a trial for September but was unable to do so Tuesday. The next conference in the case will be held Aug. 26.

Judge Sherry Stephens set a meeting for 8:30 a.m. Aug. 26 with prosecution and defense attorneys for the convicted killer.

Arias, dressed in her jail uniform and wearing her hair in a bun, sat quietly and said nothing during Tuesday's proceedings, according to CBS 5 News reporter Jose Miguel.

Stephens also denied again Kirk Nurmi's request to step down as defense attorney.

Stephens called Nurmi and defense attorney Jennifer Willmott, as well as prosecutor Juan Martinez, to Tuesday's hearing.

The murder trial of Jodi Arias will stretch on until at least September, when Arias will get another chance to convince a jury not to sentence her to death, a judge ruled today.

Arias was found guilty in May of murdering her ex-boyfriend, Travis Alexander, after a five months-long trial that ended when the jury was unable to agree on whether to sentence Arias to death or life in prison.

A new jury can be seated to decide what sentence to give Arias.

Judge Sherry Stephens, who oversaw the trial, held a hearing today in which she told both the defense and prosecution to try and set a date for late September to finish the sentencing phase of Arias's trial.

The hearing was originally called so defense attorney Kirk Nurmi could make arguments for his motion to vacate the jury's finding that Alexander's murder was especially cruel - an aggravating factor that qualified the crime to be punishable by death.

Nurmi is hoping to spare Arias the death penalty by arguing that the jury was not qualified to make the ruling about whether the murder was cruel. He told Stephens today he was not yet prepared to make the argument and needed more time.

Stephens called for the next hearing to be held Aug. 26.

There is a case management conference scheduled for August 26, 2013 at 8:30 am; and
Judge Stephens prefers the re-trial begin in late September of this year.

PHOENIX -- A New York man has been indicted by a grand jury on charges of stalking and computer tampering in connection with the news coverage of the Jodi Arias trial, according to Maricopa County Sheriff Joe Arpaio.
David Lee Simpson, 48, is accused of threatening to kill two nationally known TV anchor women who were covering the Arias trial for CNN. CNN asked Arpaio not to specifically name the anchors. The anchors were in Phoenix for several months covering the trial for CNN.

Among Simpson's many tweets pertaining to the Arias trial, according to Arpaio, were threats to strap the commentators to a "tree naked and leave them to suffer all night" and then "slit their throats.

When police arrested Simpson in Bath, NY, on July 20 they found handguns, shotgun ammo, handcuffs, zip ties, binoculars, a knife and a police radio in his car. He also had newspaper clippings about the Newtown school shooting, and the shootings of four firefighters in Webster, NY. Simpson had quit his job and was driving out of Bath, NY when arrested.

I still recovering its been quite tough I've had so many chest pains, only OxyContin helps. I'd never taken it before but it sure does the job. It's a pain like I've never felt! Alot of people that get their gallbladder room suffer this pain for a long length of time! They say its cuz of the tube they insert for anaesthesia! Not everyone suffers it

In fact alyce laviolette is right under the whining, obnoxious, pervert attorneys. Having volunteered with assisting REAL abused women in their efforts to regain their dignity and self confidence, I was APPALLED that alv sat on that stand and told the jury that ja was indeed a battered woman. And of course like so many of us, I was left unfulfilled not knowing the outcome of her lying and disrespect for the court. From my limited contact with LaViolette (just what I've seen during this trial) she is willing to twist the aggressor/victim scenario at will, to accommodate portraying Jodi as the victim. This is bullshit. She questions if Travis was fearful of Jodi because of her stalking behavior, then why did he continue seeing her? Yet she uses that exact scenario to portray Jodi as a victim by claiming even though she was fearful of Travis, she continued to see him. LaViolette paints this picture of domestic violence victims as women who despite their fear, stay with abusive spouses/partners because they fear the more real consequences of trying to leave their abuser. She speaks eloquently of how fearful Jodi was, but how she was compelled to stay with him, and yet when the script is flipped and Travis is fearful and staying with her, LaViolette's distain and disgust is evident.

Defense attorneys argued that the definition of "especially cruel" is too vague for jurors to determine what makes one killing more cruel or heinous than another. Just seating a new jury could take weeks, given the trial's publicity. That process would be followed by retreading over testimony and evidence.

If the second panel failed to reach a unanimous decision, the death penalty would automatically be removed from consideration, and the judge would sentence Arias to spend her entire life behind bars or be eligible for release after 25 years.

Maricopa County Attorney Bill Montgomery has said the state is still preparing to seek the death penalty, but would consider resolving the case without another trial after consultation with the victim's family and defense lawyers, among other things.

Arias' defense by court-appointed attorneys has cost taxpayers nearly $1.7 million so far.

Montgomery has declined to publicly state the cost his office incurred prosecuting the case, citing a vague judge's order that prevents the release of some details.

PHOENIX (AP) -- Jodi Arias' attorneys want a judge to allow them to monitor the Twitter accounts of the jury seated in her murder trial to be certain jurors aren't communicating details about the case on social media.
Arias was convicted of first-degree murder May 8 in the 2008 death of boyfriend Travis Alexander in his suburban Phoenix home, but the same jury failed to reach a decision on her sentence. Her case is now in limbo as prosecutors decide whether to seat a new jury in pursuit of the death penalty.
While neither side has publicly discussed any negotiations toward a plea deal, the motion filed Wednesday indicates the parties are on a path toward a second trial as her attorneys wrote in a motion Wednesday that Arias will "endeavor to paint a complete picture" of who she is and why she deserves a sentence of life."
Attorneys Kirk Nurmi and Jennifer Willmott want the court to compel all jurors eventually seated for the second penalty phase to provide their Twitter accounts and handles if they use the site.
They note the details would serve as a "crucial tool with which Ms. Arias can work to ensure that her jury are either not communicating about the case via Twitter or considering information that was sent to them via Twitter as opposed to what is presented to them in court."
The attorneys argue that without the ability to monitor their accounts, there would be no way of knowing whether jurors are communicating or receiving information about the case.
Jurors already are warned to avoid media coverage during the proceedings, and not to discuss the case with anyone until they have been dismissed.
"If every juror were to understand and follow this warning, there would be no issue with a juror choosing to `tweet' information about the case," the attorneys wrote. "However, even a juror that follows this admonition could still receive a tweet containing extraneous information."
The Arias case prompted a frenzy of activity on Twitter since she went on trial in January. With the trial streamed live on the Internet around the world, Twitter users communicated with each other and journalists and TV personalities covering the case. Arias herself was believed to be Tweeting during the trial through a third party.

A lot a movement has happened in State v. Jodi Arias in the past couple days leading up to the status conference scheduled for Monday, August 26. It is anticipated that the firm trial date will be scheduled on Monday. Additionally, the Judge may rule on the Defense's motions regarding potential jurors and Twitter accounts, extended voir dire time and no or limited camera coverage.
 
First, a firm trial is just that, a firm date. In our circles it is the actual date that the trial is to start, not a target date but the ACTUAL date. The re-trial of the mitigation part of the penalty phase in Arias will start with the selection of a new jury of 12 persons and I predict at least 4 alternates.

In the trial, which riveted millions for five months earlier this year and spawned a TV movie, Arias was found guilty in May of murdering her ex-boyfriend, Travis Alexander. The marathon trial ended when the jury was unable to agree on whether to sentence Arias to death or life in prison.

Judge Sherry Stephens, who oversaw the murder trial, has said that she’d like to begin picking a new jury next month. The new jurors would not hear the entire case and their only task would be to decide Arias’ fate.

Attorneys for Arias are hoping the retrial will not be as high-profile and have filed a motion asking the judge to keep cameras out, or to at least forbid the trial from being broadcast live. The defense says the publicity was so intense that two witnesses, domestic violence expert Alyce Laviolette and Arias’ childhood friend Patti Womak, received death threats and are too scared to come back to testify for the retrial.

Judge Stephens may not buy the defense’s argument since it was Arias who granted jailhouse interviews as the first jury deliberated her fate.

Arias is now being held in Maricopa County jail awaiting the sentencing phase of her trial. If a second jury is seated for a new sentencing phase, both the prosecution and defense will spend weeks presenting evidence to catch the jury up on the five-month long murder trial.

If the second jury cannot reach a unanimous decision, Arias will automatically be sentenced to life in prison. Then, Judge Stephens will decide if she will get life without parole or life with eligibility for parole after 25 years.

I hope the date is set today. Let's get this show on the road!

Cookie, I used to get all kinds of pop ups. I use Firefox as my browser now (switched from IE) and it got better. I may have other programs that stop them as well..... Defense attorneys for convicted killer Jodi Arias filed a motion Tuesday asking that her retrial for sentencing be moved to another venue because of the notorious publicity surrounding the case.

Arias’ defense team said research indicates that 70 percent of the media coverage in Arizona of the first trial took place in Maricopa County. Her attorneys also want live TV coverage prohibited for the retrial.

Alyce Laviolette is back in the news. Recently she was interviewed by CNN’s Ted Rowlands. She once again took to the public airwaves to have her words presented to the millions of people. She was not forced to give this interview, just as she was not forced to testify on behalf of Jodi Arias.

Now let’s look at the issue of death threats. Did she really have any legitimate death threats? Where is the police involvement? You know that they would have investigated and brought charges if there were legitimate death threats. I can find no evidence of an investigation or charges being brought against any individual. Alyce herself, when discussing death threats, gave the example of someone writing to her and saying “I hope you choke on a chicken bone.”

Does that sound like a death threat to you?

Do you know if in the upcoming verdict phase would the Prosecutor be able to bring in new material/evidence such as the
tapes of Jodi's parents with the Detective Flores etc. That could incriminate her further?

I may be wrong, but I thought I had read in a Long Beach, CA paper that the police were investigating threats
directed at LaViolette.  I think she has an office in Long Beach. But maybe I remember incorrectly.

Oh just want to add - threats or not - LaViolette was basically impeached when she admitted to the jury that
she had gone beyond the scope of her psychological testing and befriended the accused. She is just playing
victim imo trying to get sympathy from the public when the truth is the truth and she can't weasel out of what
she said, or did no matter how many 7 Dwarfs and Snow White she wants to allude too. She's an unprofessional

Hi Kermie!  It is my understand that they can introduce new evidence IF the judge allows it. And definitely if the defense opens the door.

Kermie I have tried to find any information on death threats towards her and so far the only thing I have found come from her or the defense attorneys....they may have been investigated and nothing came of it....just sounds suspicious to me. Emails and posting on FB are easily traced. If I find anything I will let you  know.  ALV has been on my radar since day one.....she set domestic violence back years IMO

I talked to an attorney friend....he says he can only guess why Willmot subpoenaed the phone records....a couple guesses

1. want to use them to show ja contacted people to testify for her and they refused citing fear of death threats.
2. don't want any surprised and figure Juan would subpoena them and they wanted to get the jump on him and want to be able to try to get the judge to NOT allow them in.

I have not seen anything about arrests. So, I tend to agree with you that something is just kinky about her. Plus her own
