Bob Ingle, is charged with raping and sodomizing the eleven year old. Ingle was a Chickasaw police officer when he was arrested in 2006.  It is reported there are 20+ sexual assault victims just in Mobile, and there maybe many more.

This man has only spent 6 hrs in jail. No child is safe while he roams the streets.

I did send out a couple more e-mails -- I sent your NBC 15 online article to MSNBC :-)  I also sent some of the articles to some e-mail pals.  Hopefully other monkeys and others in Dana's audience are writing and calling.  We can't just shake our heads when we hear this crazy stuff in the news.  We need to do all we can to stop these monsters.

We can't forget the other little girl from Lucedale, MS. Different accused sexual abuser. But she died also and he may walk because of this crazy law.

Everyone's been sending emails and trying to call. Her Aunt Rhonda finally got a live person at CNN. They haven't had any interest outside (national) of the 2 local TV reporters.

The more emails sent the better. It's one of the reasons we're asking for help.

Dana did a wonderful job. He gave them hope on a day they felt non from the system.

After reading the law Crawford vs Washington I can't believe they haven't had more cases like these.

The more helpless the more they prey upon them!

Most of these News people have blogs,we could bombard their blogs with these cases.Does this pervert have a history of this?Is he being protected by the police where he works?It would be great if you or someone who knows Becca's family well could do one big post here at scaredmonkeys outlining this whole case.That would be something to copy and paste constantly on the media's blogs.I'll be back tomorrow...tell Becca's family that I am praying for their little sweet Angel and that she may have justice.

Yes this man has 20+ victims just in Mobile, AL area. They can't get any of them to come forward or the cases are too old. One of the reasons they want national coverage is he was a child photographer up and down the eastern seaboard prior to his becoming a policeman. They believe if it gets air time someone will remember him.

Supposedly his family has money and is paying for a top-notch atty. Sound familiar? I am so tired of this who you know stuff.

How many more Shasta Groene and Jessica Lunsfords have to happen?

I tried to call America's Most Wanted. You have to send a written letter outlining a story. Becca's family has written many letters. Becca's sister has been working with legislatures about changing the law.

It's just been so long. This poor little girl was on her way to testify the 3rd time when she and her father were in the car accident. The family has endured so much.

What I don't understand is how does an infant face his accuser and get cross examined? Or a mentally handicap person or a senile person? Are they all easy prey and can't be protected under the law?

This thing just doesn't sit right. It's like it's more about the process than protecting children and stopping pedophile.

Popped in to see if there was any news.  I sent another e-mail, this time to Nancy Grace rather than CNN in general.  I copied one of the articles from your links and also gave the SM Radio link.  I've turned off cable news because of the almost constant coverage of Obama and Clinton and McCain, so I might miss any reports if they put the story on.  Will check back later and send a few more e-mails.

This was found on the Alabama Dept of Public Safety search for Sexual Predators. This man is suppose to be Bob's brother. He raped an 11 yr old girl.

Is there no law to keep indicted suspected pedophiles away from children while they await trial?

I find this so very difficult to grasp. This info is hearsay. But I’d like to know an answer to the question. We just don’t protect children? The accused has more rights than innocent little children?

Great question.  This is the kind of thing they discuss on shows like O'Reilly, Nancy Grace and Greta's show.  They reach such a large audience and O'Reilly would probably call someone down in 'Bama himself.  He was adamant about Jessica's law.  Nancy Grace is another media pitbull.  Red's front page article should generate some interest and remind people who heard Dana's show.  I'm a staunch animal rights person because it sickens me that people will harm or neglect the innocent, those who can't fight back or even speak for themselves.  I got interested in the Holloway case oh so long ago just by chance -- I heard a Dutch man was involved and I'm 3rd generation Dutch.  So here I am and while I listen and read and pray and care about so many, it's the little ones that really make my blood boil.  What kind of coward harms someone who really can't fight back.  Like Red says, there's a special place in hell...........

While pickets carrying signs such as "How many children have to suffer from pedophiles?" strolled Wednesday in front of Mobile Government Plaza, attorneys inside grappled over whether the sexual assault claims of a child who is now dead will be allowed to air in a trial.

The defendant, former Chickasaw Police Cpl. Bob Ingle, was accused of raping, sodomizing and sexually abusing a 10-year-old girl in December 2006.

But the girl died in a car crash before a trial could take place.



On Wednesday, defense attorney Michael Harbin argued before Mobile County Circuit Judge Michael Youngpeter that it's impossible for Ingle to confront his accuser, as is his constitutional right.

Assistant District Attorney Steve Giardini has been attempting to proceed with the prosecution by using statements the girl gave to police investigators.

Wednesday's hearing had been set to determine the reliability of the girl's claims and other pertinent aspects of the state's case, but questions quickly segued into the most basic of constitutional rights.

Youngpeter, Giardini and Harbin never got to the veracity of the child's statements.

"My client has a right to face his accuser," Harbin told Youngpeter, emphasizing that constitutional law does not permit the prosecution of a defendant to continue without the opportunity for cross-examination.

Giardini argued that state law allows the introduction of statements into evidence when a child under the age of 12 is unable to testify or too traumatized to testify. Harbin countered that in such situations, the child would still be available for cross-examination, a privilege unavailable to Ingle in this case.  
Youngpeter made no decisions and reset the case for another hearing later this month, provided Giardini by then had not already conceded the argument.

Following the hearing, Giardini was circumspect and warned the child's family members and supporters that there were "obstacles" involved in pursuing the prosecution under Harbin's citations.

"We are going to follow the law," Giardini said later outside court. He added that if the defense is correct, "I will dismiss the matter. And if they are wrong, I will try the case as hard as I can."

The family of a little girl who they say was raped by her stepfather is faced with another setback in court.

A judge was supposed to decide Wednesday whether there is enough evidence without 11-year-old Rebecca McEvoy's testimony to proceed with her rape case.

Rebecca was killed in a car crash in January, while she was waiting for her trial to begin.

Prosecutors were hoping to rely on Alabama law, which would allow statements she gave to investigators and counselors to be admitted as evidence in place of her testimony, but the attorney for the defendant says a 2004 Supreme Court ruling, Crawford vs. Washington, established a constitutional right for a defendant to confront his accuser.

"If they're correct about that it will be fatal," said Assistant District Attorney Steve Giardini.

The judge, who said he needed time to review the ruling, rescheduled the hearing for Rebecca's case for April 22nd.

Rebecca's step-father, Bob Ingle, is charged with raping and sodomizing the eleven year old. Ingle was a Chickasaw police officer when he was arrested in 2006.

Two child rape cases hinge on a judge's decision

News organizations usually won't reveal the identity of victims of sex crimes, but there are two families who have asked NBC15 News to do so. They say it could help them get justice for their girls who were raped.

(MOBILE, Ala.) March 14 -- News organizations usually won't reveal the identity of victims of sex crimes, but there are two families who have asked NBC15 News to do so. On Wednesday, we told you about Becca McEvoy. Bill Ingle, a former Chickasaw police officer who was also Becca's stepfather has been charged with her rape.

Two months ago, Becca died in a car crash. Now, it is up to a judge to decide whether the statement she gave before her death concerning the rape can be used to prosecute Ingle during a trial.

When the judge makes that decision, it's going to affect another similar case and the family of another little girl.

It's somewhat ironic that both of these girls who did not even know each other died exactly one month apart at the USA Children's and Women's Hospital. Both of them were killed in tragic accidents. Both died on the 14th of the month.
Becca McEvoy died 2 months ago, while Kristen Howard's family has been struggling with her death for the past 3 months. Both of the families still have another struggle ahead. They say they are fighting for justice for their girls.

Her family says from the moment Kristen Howard learned to smile, she never stopped. even when she lost all her teeth. Even, prosecutors say, when she started being molested.

That began at the age of 6. Her mother, Connie Woodard says the alleged abuse was at the hands of Kristen's cousin. "Told her to take off her pants and her panties, that there's things little boys and little girls do, but they don't ever tell grownups about it."

David McKinney, Kristen's cousin, is the person who has been charged with sexual abuse. He wasn't home when NBC15 News tried to talk to him.

Connie says Kristen first told family members about the abuse when she was 11. "She had parts of her that was just dying inside and even with counseling and talking, she was still hurting,"

A few months before Kristen would have told a jury about the years of abuse, she stopped talking, she stopped smiling. Everything stopped when Kristen was thrown from a horse and died 3 months ago. "That was the worst day of my life," her mother says.

Connie and her family are worried about the days ahead. They're worried about the other child rape case where the alleged victim, Becca McEvoy, died. That case is making its way through the courts first.

Meanwhile, the family of Becca McEvoy has set up a special website where they are asking you to "sign" a petition to help them get justice, and to honor Becca's memory. It seeks the passage of a law for trials dealing with child sexual abuse where the victim has deceased while awaiting the trial, that any taped testimonies to previous courts or counselors and medical evidence must be accepted by the courts then used to hear the cases so justice can be served.

If Bob was a photographer and a pedophile I bet he was on the internet and I bet he has pedophile photographs on his hard drive. He didn't just do this in person. He fed his sick appetite daily. Bet he still is.

Does anybody know anything about catching pedophiles via computer?

Can the investigator for the case subpoena his hard drive? His email account? The server?

Listening to Dana's show last night and hearing Aden talk about special processes for children in court made me think, surely there is some.

I began to wonder if there should be a court appointed special advocate for Becca especially because she can't speak for herself?

If justice was served in this case, Becca would be alive today.  He would not have been free to roam the streets looking for another child to molest and she would not have been on her way to testify against him.

When are we going to stop protecting the criminals and start protecting our children?  They are so innocent and should remain that way.  No one should take the childhood away from a child.

This animal should be put away forever.

My heart hurts for Becca and her family.  Her sister has really stepped up to the plate.  She is doing something no family member should ever have to do.  She is doing what the justice system should have done years ago.  I can't imagine the pain Becca went through and her family continues to go through at the hands of this disgusting excuse for a human.

God bless Becca's family.  I will do all I can to help and to get her message out there.

Is there a one page summary of this somewhere that I can hand out.  I talked to several people about Becca today and passed the message around.  It would help if I had something to give out to remind the person later to act on what we talked about.

I am talking about just facts--are there really 20 girls this man has molested and how do we know that--none of them is willing to testify?

The information about the 20+ victims has come to light during the investigation. They've been all the way to Pennsylvania. Some victims have come forward but are either unwilling to testify because of the stigma it'll bring them. Or the cases are too old and the statute of limitations has run out. They're still actively working the case. They will do that until it is done, either trial or plea bargain. Depending on what the judge decides.

It's difficult to think he may walk.

The reason many of the other victim's didn't come forward is the same reason most child rape victims don't come forward. They want to keep it quiet. It was a family member, they don't want others to judge them. Don't think they don't! After my daughter was raped I heard over and over, "What did she do to deserve it." or "She chose to be in that situation." NO one choses to be raped and they'd never ask what a dog did to deserve it. We have to educate people so they stop re-victimizing these poor souls.

Becca's family are fighters. Bob Ingle's family has money. They hired big Atty. They know people. Sound familiar?

Aden (Becca's real Dad)  had hip replacement and is partially paralyzed on his face. It's an amazing story. I'd buy the book for sure! They had to sedate Becca's dad something like 3 or 4 x's. He wouldn't go under for surgery. It was her Dad who helped her all the way through this, the right way. He's a real protector, a wonderful parent.

Most people are ashamed of the stigma. Took me 2 yrs. to talk about my daughters rape.

I have a strange connection to all this, Beth Holloway and Becca. I wrote Beth about having "Fearless Faith" (she wrote me back!) then 1 yr later to the day my daughter was raped and almost killed by my son-in-law. It's been a long 2 yrs and it's still going on. Then the woman came to my door about Becca. I remembered the case and the pain on the families faces was what I had felt in my heart.

Funny how God can bring good from all that evil.

It's victim awareness month. We should all try to help others who have gone through such pain. I know it's what has helped me. I learned that from Beth Holloway. She is a roll model for all mother's of victims. I thank God for her.

I am convinced Joran had done that kind of thing before. Preying on girls who are gone the next day back to US. They go and are foggy from the drugs they slipped her, they go home, they don't want to tell anyone what happened because it'll reflect badly on them. They're out there carrying the weight of what happened to them.

Keeping quiet about sexual abuse is never good for the victim's. It only helps the rapists. We need a better system to help these victims do the right thing. I don't know exactly what that is. But reaching out and trying to help a victim is a start and one person can make a difference. But when you join together watch out! Scaredmonkeys is a great example. They are changing the face of news reporting!

• Becca told little friend and mother who are willing to testify. Will they let it in? Or  dismiss as hearsay?

• Bob Ingle has more than 1 brother who are also pedophiles.

• Bob Ingles' own two daughters gave graphic testimony of the molestation they suffered for years by their father. They recently lawyered up and then recanted.

• Bob Ingle was allowed to move out of state and is living in a home with small children in MS.

• Investigation has gone all over south and as north as Pennsylvania, taking testimony from victims. Not one yet willing to come forward and testify.

• If Bob Ingle is acquitted he can apply for his old job back as a policeman.

• Still no national news attention. I don't understand why not.

The media can't stop talking about Obama/Clinton/McCain.  I find it hard to get other news from the cable networks.  I'm going to change the "Re:" in my e-mails to Child Abuse and Crawford v. Washington.  I want to emphasize that this is much bigger than one case.  We have to be persistent.

DA was heard to say it maybe too costly to transcribe illegible medical notes. Aden and family offered to pay for it. Dr has said he wants to testify. Medical reports state serious internal lacerations.

Family was also told the courts had to accommodate the families of live victims before dead ones. This being the reason the pretrial has been so long in coming.  Ingle was arraigned 01/03/2007 - So much for a speedy trial.

Bob Ingle's bond was orig. set @ $35,000 then lowered to $15,000. It's reported Bob Ingle is now living in Mississippi (would have thought on this kind of a case, class A felony punishable with life) there should have been a residency requirement.

I know I am posting this in the wrong place but I want you all to know why it is I have tried to help Becca's family. This is what has been happening to my daughter for the last 2 yrs. The justice system is broken. I too am desperate for help.

My daughter Regan was brutally raped and beaten by her husband. He confessed to the crime, there were medical records (showing he had handcuffed her, dislocated her shoulder and put his fist into her rectum.)

For 5 months after the rape he ignored the OP and stalked my daughter. She reported the violations 2 times. The last violation he had burnned my daughter with a propane torch. His bond was $2,000 1st time and $5,000 the second time.

He was allowed to plea-bargain from rape, aggravated battery, unlawful restraint to aggravated domestic battery. He received 3 yrs. and 9 months on Jan 1, 2007. The judge forgot to stamp TIS on deposition papers sent to IDOC so they cut his sentence in half.

From jail he continued to break the law by sending letters to my daughter directly as well as from other prisoners. He called her home for 3 months repeatedly. My daughter again reported these violations turning over all documentation to the DA last March. He was indicted last May and there was a$10,000 bond at that time it has recently been reduced to $1,000. We do not understand why the bond is going down instead of up.

My daughter divorced him in Oct and received custody of their 2 children. He managed to be in the courtroom with her as he had to appear in court for the violation. He stood and spoke to my daughter once again breaking the OP. No one stopped him. They just remarked he was crazy and obsessed with her.

The Da has not communicated with my daughter throughout this last breaking of the OP. He has been allowed to continue the case until after he is released May 24, 2008. (Not the 3 yrs. 9 months we were told.)

My daughter has received a letter stating she is to be in the courtroom with him in May. She doesn't want to be anywhere near him once he is released. She was told they will likely do nothing to him.

The DA originally told my daughter if he violated one condition of his sentence he would have to serve it all. He was allowed a lesser sentence (50%) because the judge forgot to stamp the paperwork TIS (85%).

He was only charged with breaking OP when he has been stalking and harassing her as well as contempt for the conditions of the plea-bargain.

We are going to get the children move them to Mobile with us.

Does anyone know anything which maybe helpful to her? My daughter is going to complain to the DA supervisor. She found out there is a law in effect in IL that allows prisoners who break the law while incarcerated to postpone criminal court hearings until they are released.

Any help or suggestions would be very much appreciated. I should also mention this is all taking place in the same jurisdiction as Drew Peterson's case, Joliet, a rural part of IL.

Cherry, I e-mailed someone and asked if they knew of any Domestic Abuse Advocacy programs in the Joliet area.  I doubt they'll know, but they've done legal work in the Chicago and suburbs, so I thought I'd ask.  They haven't been online tonight, but I'll let you know if they know of anything.   I also did a quick google search for battered women's advocacy groups.  Didn't come up with anything, but there is one in the south suburban area.  I found it on the Illinois Bar Association website that lists grants they've given to various programs.  This is what it says they do:

$5,000 for its Court Advocacy Program. This program assists victims of domestic violence in the process of obtaining orders of protection. This is for Cook County and I think Joliet is Will County.  I know it's not Cook.  But this is the kind of thing that I think would help if you can find one in your daughter's area.

What's happening to my daughter's case is similar to what's happening in Becca's. Wendy Murphy spelled it out last night on Dana's show. It's called: "Victory by Delay"

No perpetrator should profit from the death of a victim! A definite abuse of process! This is how the defense lawyers work now a days.

Joliet is Will County.  The response I got to my e-mail inquiry is that the Will County Bar has a woman's advocacy committee.  You or your daughter could look them up and give them a call. 

I think one of the most difficult things for any of us who find ourselves involved in criminal proceedings is that we don't quite understand what's happening and what it means.  An advocacy group could at the very least help explain things so you can make informed decisions.  Good example is reading the articles about Becca's case only gives me part of the story.  Listening to Robin, reading her blog, listening to Wendy, even Jessica (reporter) helped me understand the problem.

I live in Michigan and was watching the news last week.They had this section on about an ex guard who stated a body guard service for women who suffered domestic abuse.They did not charge these women anything.The guards would go with the women everywhere they went,in one case(ex was hunting the woman down,breaking into her house at night)they even had a guard stay overnight at the woman's house.I'll check into the exact name of this company and post it for you Cherry.Maybe they have something like that where you live.

When she could speak, police say Becca told her best friend a secret. That secret led to an investigation and rape charges being brought against Bob Ingle. Ingle used to be a Chickasaw cop. Nina Tucker says he used to be Becca's step-dad. "It took guts for her to say as much as she did." Tucker says she stood beside her little sister as the 10 year-old went into graphic detail in front of police, in front of doctors, just not in front of a jury. That's because Becca died in a car accident .

"If we can't use what she said, the case is over," said Steve Giardini who prosecutes child sex crimes for the Mobile County District Attorney's office. He says there will be a hearing to determine if what Becca said before her death can be used in a trial.

That hearing was supposed to be held on March 13th. It has been pushed back for a third time in order to accommodate cases where the victims are alive. Giardini says he wants to prosecute the case. Whether he can will be up to a judge." She's not here and her case might not be seen and if its not, I feel like I failed her."

Even though Becca's voice is silent, Jordan says she can still hear her. "We lay awake at night and toss and turn and we hear the things she said to us and her voice is in our ear."

The last thing Tucker says she wants is to fail a little girl whose smile lit up her life.

We are expecting an answer by May 20, 2008.  Now Monday they're going to try to put a gag order on the case! Please get this story out.

Mobile County Circuit Judge Michael Youngpeter said, "That's like having a bell already rung & then saying lets go back & un-ring bell. You can't un-ring the bell. The media has already done the stories and now we cant undo that!" (A gag law is intended to limit freedom of the press, as by instituting censorship or restricting access to information. In the United States, a court can only order parties to a case not to comment on it; a court has no authority to stop unrelated reporters from reporting on a case. Most statutes which restrict what may be reported have generally been found unconstitutional and void. )

Defense Attorney Michael Harbin submitted papers of the stories covered by WKRG and a packet that he said was the petition circulated by the family, which requests justice for Becca. Defense Attorney Michael Harbin asked the Judge Youngpeter to look at the materials and after reviewing he should be able to see why his client needs a gag order. Defense attorney Harbin complained his client, accused rapist and pedophile Bob Ingle is being tried in the media & cant get a fair trial. He also requested a change of venue.

Defense Attorney Michael Harbin also questioned the professional credentials of the doctor who did the rape examination of Becca. The doctor report allegedly states "severe internal lacerations" were found on little Becca, consistent with long term sexual abuse of a minor. Defense Attorney Michael Harbin is asking for the rape examination doctor's curriculum vitae CV (a document that contains a summary or listing of relevant job experience and education.)

Defense Attorney Michael Harbin stated Becca's father Aden McEvoy had stated in an interview, "I don't know how he sleeps at night?" calling Harbin by name, as the Attorney who is representing accused Rapist Bob Ingle. Defense Attorney Michael Harbin stated his client is innocent until proven guilty (Contrary to common belief, the presumption of innocence applies only inside a courtroom. It has no applicability elsewhere, although the media do not seem to be aware of this. Even the editorial sections of major American newspapers frequently express the view, in references to a pending case, that "we" -- meaning the editors and their readers -- have to presume that so-and-so is innocent. To illustrate that the presumption does not apply outside the courtroom, let's say an employer has evidence that an employee has committed theft. If the employer had to presume the person were innocent, he obviously couldn't fire the employee or do anything at all. But of course he not only can fire or demote the employee, he can report him to the authorities...)

Defense Attorney Michael Harbin complained his client, Bob Ingle, is being called a "rapist" (this is one of the crimes Ingle was arrested for in Dec 2006 and indicted for in Jan 2007) the others are sodomy (anal or oral copulation with a member of the same or opposite sex) and sexual abuse of a child under the age of 11. He has been removed as a police officer pending his criminal investigation and trial.

Assistant District Attorney, Steven Giardini said he opposed the request for a gag order stating the little coverage produced two additional alleged rape victims of Bob Ingle have come forward and spoken to the investigators.

Defense Attorney Michael Harbin said his client the accused rapist and pedophile, Bob Ingle, can't get fair trial due to the publicity.

Mobile County Assistant District Attorney, Steven Giardini, who specializes in prosecuting sex crimes against minors, said he has tried cases that were on the front of NY Times and we still got a fair jury. He doesn't believe it should be a problem.

Defense Attorney Michael Harbin asked the gag order to include how much the term sexual abuse, and rapist can be used in the media. This is the crime Bob Ingle is charged with including rape, sodomy (anal or oral copulation with a member of the same or opposite sex) and sexual abuse of a child under the age of 11.

Rebecca's Father Aden McEvoy is worried statements his daughter made before her death won't be allowed as evidence in the trial, because of a law that guarantees the defendant’s right to cross examine a witness.

Defense requested postponement so they could sit down with medical exam doctor & discuss his findings. Request was originally made on april 2nd then rescheduled 2 more times, to give them the time they need to get med exam squared away. A month and a half isnt long enough?

Thank you for your concern. She is in a safe location. She's in hiding right now until they finish prosecuting him. They go back to court on the 25th. He has a global positioning bracelet on which is comforting. We're not sure if it's on for the duration or if they'll let him off early. He's also contesting transport of the kids. She has full custody and there's an OP but he still has parental rights. It's goofy. The courts take way too long!

Becca's case went to court today and Becca's trial is set for Sept 22, 2008. They wont allow police statements Becca made. And we have another hearing to be scheduled for the doctor and nurse that attended Becca's rape medical exam. They are to come and tell what statements Becca made during exam. I don’t know if the actual rape medical report will be allowed in or not, They’re shooting for June 25th if doctor and nurse can come then but nothing is set for sure, as of yet. They told us they’d let us know.

It comes down to deciding what’s testimonial and what’s not. Statements she made to friend will be allowed! We are so very happy that Becca’s voice will at least have a chance to be heard thru others! We’re upset that the Police Report & DHR Reports will not be allowed but grateful that we do at least get some answers and not another delay!
 
We do get to go to trial on Sept 22! Pray for the well being of all the other children and that justice will come forth on Becca’s behalf. Pray that Medical Exam will be allowed. In my opinion it should be allowed because the jury should be able to see all the evidence. I don't what the big problem is? If Bob Ingle is as innocent as they propose then why not allow the evidence to come into play if he’s not guilty the evidence will show that! Let the evidence speak for itself!
 
The defense went to court with WKRG Channel 5 about the reports Jessica Taloney did on Becca's case. They want transcripts of everything that Jessica did with the family on Beccas case, on air and off air what was said. So I think they want to subpoena transcripts and WKRG has taken Jessica off the story. We have a new reporter, Keeshia Peyton; she said "It looks like I’ll be the one covering from now on because they want Jessica off the story.“ Right before our court today was court between Bob Ingle's defense & WKRG News.

this ruling has nothing to do with the reasons the court allowed hearsay statements in becca's case

it has to do with the "forfeiture by wrongdoing" rule -- which means - IF you wanted becca's hearsay to be admitted on the theory the rapist caused her to become unavailable for trial - you would have to prove that he rendered her unavailable INTENTIONALLY.  Given that nobody is claiming the perp CAUSED becca's unavailability, you have nothing to worry about.

In this situation, the crime had not been committed yet.  Was there corroborating evidence to say he killed her?

On one hand, things that are said in anger are not always the truth, on the other hand, the victim should be able to say she was in danger and by whom.

What if person A overheard person B say he was going to kill person C.  Person C says that person B was going to kill her.  Then person A actually does the killing.  Is it fair to person B if he was only shooting his mouth off and had no intention of killing person C?  Would person B then be convicted of killing person C even if person A was the killer?

When Becca spoke with the police, the crime had already been committed.  Her voice should not have been silenced.  She was brave enough to stand up against that pos, her voice should be heard.

Two completely different circumstances.  I hope that made sense.

I am writing concerning a case here in Mobile, Al. that involves my recently deceased baby cousin Becca. Becca died this past Jan. 14, 2008 as a result of a car wreck. She was seriously injured and stayed on life support for 10 days from which she never recovered. Unfortunately her death came while awaiting Grand Jury in Mobile, Al.

Before her death Rebecca suffered over a year of rape & sodomy and other unspeakable acts from Bob Ingle. He was her step-father/cop at the time of the abuse.

The reason for my concern now, is that an even greater injustice may occur due to her untimely death. Due to" Crawford V' Washington "a law that not only supports the right to cross examine the victim but, also stops a lot of testimonial evidence. In cases such as Becca's this law stands in the way of justice. Under Crawford statements made to friends or anybody as a cry for help is acceptable.

However, this law works backwards for the victims of sexual abuse. It stops police reports, counselor’s statements, and often-medical personnel from being used in these cases. Everybody has a 6th amendment right under our constitution but under Crawford they have taken away almost all the victims rights.

Certainly, in a case such as Becca's where the victim is no longer available for cross-examination due to death. I find it quite disturbing that our system puts these children through the whole process of exam, counseling, and police statements and then does not even accept it in the court of law.

I would like to see Crawford amended and a law enforced for victims like precious little Becca. At age 9 she had no rights because, he took them from her and still he has more rights under our backwards justice system that works in the favor of the perpetrator.

I want National media attention to this case because; already the police statements and counselors have been thrown out due to Crawford. My family has suffered enough and now we are suffering even more due to this flawed judicial system.

We need a "Becca's law" stating that in cases where the victim becomes deceased the testimonial evidence has to be accepted - an exception to the Crawford rule. This needs to be one so, we don't invite perpetrators to kill their victim's in order for Crawford to work in their favor.

I can't believe a law that promotes so much more crime could have been passed. If Crawford goes uncorrected then there will definitely be more killings when our justice system fails these children.

People will take the laws in their own hands because; the current ones do not protect our children. Perpetrators will be encouraged to kill the victims!

Becca McEvoy suffered and many others have as well at this mans hands but none willing to testify due to the fact they are all his family. They previously gave statements and then later recanted after Becca's death. It’s a shame my 9 yr. old cousin was the bravest of all and treated the worst.

Now, we Rebecca's family will fight until there is justice and corrections made for her. We want her last wish fulfilled and him and other pedophiles punished for such horrific crimes of children under 12. Please, help us with this very important matter before it's too late.

Lil Puma it's good you ask these questions. There are things we can do. Get laws past. For example my daughters rapist was allowed to plea bargain to a lessor crime of aggravated domestic violence. WHY? They had his confession and medical evidence and victim compliance. Why It made the DA's job easier. So they are trying to take that choice away from the DA's if you're charged with a crime you can't offer a plea bargain to a lessor crime if it's a sexual assault. Hard to believe we need a law to stop this but we do and Jennifer Jennkins of www.illinoisvictms.com is currently working with Illinois lawmakers to try to make it happen. They did a similar law about gun crimes.
We need laws. We need to look at these crimes. Hang in there and keep looking at what we can you. You're helping others. And it's always better ti give than to receive.

Cherry, it makes me angry that as a society, we're doing such a bad job of looking out for victims.  We keep have to pass laws and tweak laws because prosecutors and judges screw it up.  Granted, there are some laws that need to be added to the books.   Some need to be changed.  But when we have to change laws in order to force the people charged with protecting the public from criminals to do so, we need to look past the laws and see what the heck we're doing wrong.  It's like re-training police and prosecutors that a woman's clothes or drinking habits are not what causes rape.  It's the predator, stupid.  The predator rapes.  It's about power, control, not sex.  By the same token, putting a 17 year old boy in jail for having consentual sex with his 16 year old girlfriend is absurd.  We can't trust our public officials to make wise decisions.  Then again, we can't trust our own juries to make wise decisions, as one of Dana's guests discussed (the police officer who was murdered.)  Anyway, keep us posted about any developments with both Becca's case and your daughter's.   These are definitely issues that women and parents should be aware of.  Unfortunate the MSM isn't picking up the ball and running with it.

I am the cousin of Becca McEvoy and was hoping you might do a story on her case.We are hoping to bring attention back to the case of Rebecca McEvoy. In hopes that we might get some help in improving the laws and the current errors in the system as we fight for justice in her case.

Becca died while awaiting trial for being sexually assaulted by her x stepfather/cop Bob Ingle.In Jan.2008, Rebecca passed away due to the result of a car accident she was in on Jan.4,2008 with her biological father Aden McEvoy also, a Chickasaw, Al. cop.

Her case goes to trial on Sept. 22, 2008 and although it is going forward due to the Crawford V' Washington a lot of the crucial evidence is being thrown out due to her death. Rebecca had police statements & DHR counseling & evidence that has already been thrown out due to this right to cross examine.

I just heard from Rhonda last night she said there's court on Sept 22 @ 9am.

She and Theresa have been busy.  Writing to the Senator's Congressmen and legal activist's trying to get some help on the case and help pass possible laws which could ensure a speedy trial for victims of crime, especially children. As well as investigate the Crawford vs. Washington problems. It does look like the court maybe throwing out much of the evidence and the accused pedophile is still walking around free.

They persevere and are an inspiration to many (including me!). I'll try to update everything soon!

I'm going to add that I think we need to somehow, someway, come up with a One Strike law for those who hurt children.  I think about Caylee and Madeleine McCann and Jessica and so many others that don't make national  headlines and it sickens me.  This is what got me involved with animal rights issues, as I've mentioned before.  Someone needs to protect and speak for those who cannot do it for themselves.  Those who hurt the smaller and weaker because of their own self-interests or psychological messes should be punished severely and not allowed to live in our society.  No excuses, no rationalizations, no parole.

Becca died while awaiting trial for being sexually assaulted by her ex-step-father/cop Bob Ingle.  Becca was 8 when the abuse started, she died at age 11. The crime was reported in 2006.  She went before the Grand Jury twice. The case against the alleged sex criminal may be in jeopardy because a little girl died in a traffic crash.

IMHO The defense is using legal loop holes, tricks and victory by delay. Siting the Crawford vs. Washington law, http://www.law.cornell.edu/supct/html/02-9410.ZO.html (http://www.law.cornell.edu/supct/html/02-9410.ZO.html) which states the perpetrator has the right to cross examine the victim. In Becca's case this isn't possible because she died. Please note this law has only been in effect for a few years and is wreaking havoc through the justice system. Prior to it this prior testimony and records were allowed.

Her case goes to trial on Mon. Sept. 22, 2008 at  9am at the Mobile County Courthouse, 205 Government St, Mobile, AL 36602 (gov't plaza) on 8th floor. Judge Youngpeter is presiding over the case.

• We believe the medical report and doctor's testimony will be allowed.

• The Police Reports & DHR Reports will not be allowed.

• Statements Becca made to a friend will be allowed.

• Judge never ruled on the gag order from May 2008.

Becca's cousin Theresa has been busy calling on Alabama Senator's and Congressmen asking them to pass a law that states in cases of child victims of sexual abuse they must be heard within a two year period.

The wording which is applicable to victims is "a right to a trial free from unreasonable delay", this is at issue for many people across the county. Becca's family would like the law to be named in honor of Becca.

Another Delay - Evidence is being sent to AL capitol, Montgomery

D.A. Giardini told us that the defense is challenging the information that was going to be allowed in the case. The information is going to be sent to the Alabama capitol, Montgomery, to decide if the information can or can not be allowed

Since Becca is not here anymore for him to cross examine this gives our family great concern. I am truely worried that the defense is doing all this as the tactic known as Victory by Delay!! The accused pedophile Bob Ingle has only served 6 hours in jail for this, he was released the same day back in December of 2006.

What happened to the victims rights? What to a speedy trial for Becca?? What about the fact that this man has served only 6 HOURS for what Beca had to endure at his hands for over a year of her short life!

Could someone Please help us & tell us exactly why this is being sent to Montgomery and our family has to face another delay?

Now we are forced to wait til Montgomery reviews the evidence and decides whether or not it will or won't be allowed before the case can go to trial.

Please someone, anyone tell our family what is goin on & why? Why are the victims force to endure such heartache while the perps walk free, when they are the cause of all this?

Our family will be protesting on Monday morning @ 9a.m. Sept.22 this was suppose to be the time of the trial until now! We need supporters and if you see that you can come out and help us, please be at the government plaza @ 9am on Monday morning.

We are Inviting the media to come out then too.

We protested at Government Plaza in Mobile, AL this morning. 2 local TV stations were there and a local paper. Baca Nation offered security and there were 6 protesters carrying signs.

It was heart breaking. A man came up and asked what we were protesting about. We told him about Becca and he softly wispered, "I was raped when I was a little boy. I never told anyone until after I was out of the service." I told him Becca was a very special and brave little girl to have come forward. He asked what he could do to help. I told him, Pray for justice for Becca and write and call our elected officials. It's the good God can bring from this evil. Victim's helping other victims.

To Whom It May Concern,

I am writing to ask you for help. In 2006 8 yr. old Rebecca McEvoy reported being brutally raped and sodomized by her then step-father, Bob Ingle, for over a year of her life.

During the long legal process and many delays Becca tragically died in an unrelated auto accident in Jan 2008. Becca gave testimony twice before a grand jury, she told family and friends, doctors, nurses, counselors, detectives and DHR.

The defense has no defense for their client other than legal wrangling, endless postponements and asking the case be dismissed based on Crawford vs Washington law which states the pedophile has the right to cross examine his accuser (impossible due to her death).  The court has thrown out much important evidence (police statements and the DHR statements & video of Rebecca) due to Crawford vs Washington labeling it hearsay.

The scheduled trial date of 9/22/2008 was delayed, once again, sending all evidence to the Capital for review. The defense has postponed this case for too long. Becca has a right to a trial free from unreasonable delay.

We feel Becca's rights as a victim and citizen are not being duly protected and we would like to respectfully ask that she be given legal counsel, protecting her rights, even though she is not with us anymore. Any help or advice would be greatly appreciated.

Please consider hosting a bill which would protect the rights of children protecting their right to a trial free from unreasonable delay.

WKRG Reporter Jessica Taloney told Rhonda the defense had appealed the judges ruling on what is admissible (Becca's friend, Dr's Report and video of Becca) and it has gone to the circuit court of criminal appeals in Montgomery. The family wasn't notified of the appeal they found out through the reporter. No date for trial has been rescheduled. Family was told it could sit in Montgomery for a month or more.

Another last minute stall tactic!

  they must officially request the court for a designated representative in order
  to even be notified on any court pleas. Family is in process of having official
  forms sent to them from Montgomery and then sent to the detective and the DA

This is where our court system, judges, district attorneys, legislators, need to get it together.  Our legal system is just as broken in many respects as our economy and it's up to our elected officials as well as those who are hired or appointed to uphold the law to start upholding the law and modifying it if needed to unclog the system and make sure that victims and society are protected, not just the accused.  Somethings terribly wrong with a system that says if the victim dies, evidence against the accused cannot be used.  As mentioned earlier this year, it sends a very dangerous message to pedophiles, a message that's dangerous to children everywhere.

I haven't spent much time in the forum in the last few months -- car accident (mom, not me), brain surgery (mom,  not me), holidays -- and something made me think about the Becca McEvoy case.  No updates here, so I'll google and see what comes up.  But what's striking is that there are four pages of threads in front of this one.  What on earth are we doing to our children and why can't we stop it?

Former Police Officer And Convicted Rapist Committs Suicide

MOBILE, Alabama - Sources tell News 5, the former Chickasaw Police Officer facing life in prison for raping his young step-daughter has committed suicide.

Bob Ingle was supposed to be sentenced tomorrow.

Ingle's step-daughter, Rebecca McEvoy was killed in an unrelated car crash one year after she told her best friend about the alleged abuse.

Ingle was arrested in December 2006. He fought to get the charges dropped based on what his attorneys argued was his constitutional right to confront his accuser.

The case faced six delays as the judge and attorneys sorted out what evidence would be allowed.

He was finally convicted last month.

Suicide -- not enough.  I'm letting God take care of this one!
