Children under the age of 5 in the United States are more likely to be killed by their parents than anyone else. Contrary to popular mythology, they are rarely killed by a sex-crazed stranger. FBI crime statistics show that in 1999 parents were responsible for 57 percent of these murders, with family friends and acquaintances accounting for another 30 percent and other family members accounting for 8 percent. Crime statistics further reveal that of the children under 5 killed from 1976 to 1999, 30 percent were murdered by their mothers while 31 percent were killed by their fathers. And while the strangers, acquaintances, and other family members who kill children skew heavily toward males (as does the entire class of murderers), children are as likely to be murdered by their fathers as by their mothers.

"They can get absolutely crazy," Moyer said of people who have been driven to kill their children. "If these were her children, she could be mentally ill. They (parents who kill) can be psychopathic."

The U.S. Justice Department in 1988 found that while 61 percent of all murder defendants used a gun that year, only 20 percent of parents who killed their children used one. Children were more likely to be drowned, shaken, beaten, poisoned, stabbed or suffocated. The study said that the traits of the murdering parents include a certain "craziness," intense passion and a lack of planning.

Casey didn't have a spouse...but I wonder if retaliation against her mother was one of her motivations.

That is so sad to have those statistics.
I wanted to beat on my kids a few times but that was when they were teens and were bigger than me. LOL Actually I used to threaten to run away from home and hubby and kids would always say "Where are we going?" They did turn out ok.

 According to the A.C.L.U. only two states, Maine and Vermont, allow prisoners, parolees and probationers to vote. Thirteen states allow parolees and probationers to vote, eight states reinstate probationer voting rights, and 20 states restore voting rights to people who have completed their sentences, although each state has different processes, exceptions and limits on eligibility requirements. Kentucky and Virginia permanently disenfranchise nearly all felons.

Florida’s felony voter registration law divides applicants into three categories based on the seriousness of their crimes: nonviolent criminals, the biggest group, need not apply for restoration of voting rights and just need to re-register. Violent criminals, but not murderers or rapists, must apply to the clemency board. The board either grants those rights immediately or investigates on a case-by-case basis. The most violent criminals are subjected to a more rigorous investigation and must attend a hearing of the clemency board, which meets only four times a year, before their rights can be reinstated.

Despite the state’s liberalization of felony voter procedures, only 9,000 out of a potential 112,000 former convicts in Florida registered to vote in the last year, according to a report last month in The Orlando Sentinel. Part of the reason is that thousands of notifications sent by the state went to the wrong addresses because of poor data and former prisoners’ high mobility.

George Anthony Seen Near Woods Where Teams Searched For Caylee
Tuesday, November 4, 2008

ORANGE COUNTY, Fla. -- Caylee Anthony's grandfather is desperate to find his granddaughter. An eyewitness reportedly saw George Anthony standing and staring into the woods near Hoffner Avenue in east Orange County (see map).

Eyewitness News has learned a search team could be looking for the little girl's body in the same place George was spotted. The area has already caught the attention of investigators. It was searched in September when EquuSearch was in town last time.

Now, a WFTV viewer says she saw George Anthony at the same spot early in the evening on October 30 looking into the woods. The area is easily accessible by car, yet easy to disappear into and it's less than four miles from where Casey Anthony and Caylee lived with Casey's parents.

The WFTV viewer said she saw Caylee's grandfather George's car parked in the area around 6:15pm on October 30 and that he was staring into the woods. Then she saw him get into his car and drive away. She figured he was looking for Caylee and the information was passed on to law enforcement.

Casey's defense team's public relations representative said they were aware George was there, that it has nothing to do with what the defense is doing and that there might be certain things that involve the case that they can't talk about.

The sheriff's office says tips that fit in with the investigators' timeline of Casey's whereabouts will be investigated and searched and Casey's phone records show that it's one of the areas that she frequented.

EquuSearch is back in town, too, making plans for the next search scheduled to begin on Saturday. EquuSearch said Tuesday it's getting things organized and training the volunteers. They're expected to search for Caylee for three or four days.

One of the areas they'll return to, to finish what they started, is near Orlando International Airport, where a third of the territory they wanted to search was covered in water from Tropical Storm Fay.

Late Tuesday afternoon, Caylee's grandmother Cindy text messaged WFTV reporter Kathi Belich to say George was looking at the woods to scout out another possible location for the rolling billboard that bears Caylee's photograph and the phone number to call for information.


CASEY WON'T ATTEND HEARING

The case against Casey Anthony is headed back to an Orange County courtroom. The pre-trial hearing for check fraud charges against Casey begins Tuesday.

Casey's accused of taking checks from her friend and going on a shopping spree at an Orange County Target.

Casey is not expected to attend the hearing.

I'm in Indiana and someone convicted of a felony can't vote.  If a person is incarcerated awaiting trial (not yet convicted), they are allowed to vote.  If the prisoner requests to vote, absentee workers are sent to the jail to allow that person to vote. 

I used to work in Voters Registration and had to send workers to the jail several times to allow inmates to vote.

Lets just hope she does not request a Presidential Pardon.

They were also talking about the vandalism to the Anthony's search stuff and that there were people picketing. I'd love to know what their signs said....and what their reasoning for picketing are.  I have a feeling that the people who REALLY have missing loved ones are not fond of the Anthony's.  Anthony's are giving them a bad name...I hope that the Kesse's separate themselves from the Anthony's. 

The disappearance of Caylee has catapulted the A's into thinking that they are an important part of the missing/exploited childrens realm ( not that they EVER actually do anything toward locating) and  they have given themselves such notorierty by being obtuse and obnoxious, they must feel that they need to justufy the phone lines, the snacks, (?),the water(?) etc. Rent on on office space will somehow give them credence as bonafide childrens advocates which of course is ridiculous.

And Baez, if he's nearby or even letting them use the spot previously occupied by his #1 client, it would show that his claim to infamy is this outrageous case. He has got to be soooo hoping that this drags out because he has been transformed into a known name, good or bad, it's publicity that can't be bought.

In my opinion...Kobe is a prostitute. He sold his integrity for money. I wonder what the going rate is?? He will NEVER be taken seriously in the scientific community again. This news about George being out by the woods gives me the creeps.  It reminds me so much of Scott Peterson going to "watch" the search.  I have to agree with Colt and others, George is either in or getting in deeper and deeper. I am surprised he didn't have Lee with him as well!!!

Today we take a spin to Charleston, WV to meet Melissa Ann Taylor

 a 37-year-old mom who let her 13-year-old son drive her to the store, according to police.

Cops say they pulled the boy over because he swerved into a curb and then drove into oncoming traffic.  And Taylor allegedly told the officer she wasn't behind the wheel because she was "messed up on Xanies" which is apparently her cutesy nickname for Xanax, the prescription anti-anxiety drug.

But there's a chicken or the egg dilemma here.  Did she have her son drive because she was on Xanax or did she need to take a Xanax after letting her son drive?

We may never find out! We do know she was taken to jail and charged with felonious child neglect.

I think George was going near that area where Caylees remains will be to see if he can see her "aura". Remember how he said he saw her aura in the pics and that is how he knows she is alive. Maybe he changed his mind.

At first I was very angry that LE wasn't right there asking him what the heck he was doing there and maybe hoping they would catch him in the act and they didn't reveal themselves because he didn't go into the woods and do anything.

I thought it was a mistake to reveal the location they were going to search. Its almost like they are begging the Ants to go find the body themselves just in case it is there.

Is it possible George might have been out there to look for his grandchild? I know Ill get flamed but I think its totally possible he might be out there wondering if he might find her. IMO it shows he knows Caylee is dead and isn't playing Cindy's games like she thinks. I'm still not ready to convict him of anything other than enabling his daughter far too long.

The search begins at 8am each morning. You do not need to be a member of TES to search but you do need be at least 18 years old and be prepared to show a vaild photo ID.

There will be search teams going out throughout the day, so if you can’t make it to the search area at 8am, you can still participate.

It is advised that you come prepared as follows:

    * pack a lunch
    * wear long pants
    * a long sleeve shirt is recommended due to mosquitoes
    * sturdy walking shoes, rubber boots highly suggested
    * if you have equipment such as machetes to cut back heavy brush, bring it along bring bug repellent
    * gloves
    * a hat or scarf
    * sunscreen

It seems that everyone is involved, the way they act.  George driving the car home, like he's been in it before, recent.  Cindy's washed pants, Lee's laughing, hiding, all the lawyering up, even Tony, smirking and being with her at the crucial time.  Casey said if they don't find her somebody's going to jail for eternity.  Now, they're saying only 1 accomplice, I see several, am so confused.  If all these people don't go down, they've been talking.

Alturist - I think the statement "George, your a man who knows a lot about a lot of things", say it all. They have suspicions that George is involved or has info that he is not sharing.

It's a tight line here. They can't just charge George based on suspicions. Either there is evidence or there is not.

in my personal opinion, there is plenty of evidence that there was a very serious case of evidence tampering and obstruction.

so, why aren't haven't George and Cindy been charged? no evidence to date or not enough to make a case that will lead to a conviction. Just charging them and not being able to get the conviction is useless and Nejame will claim malicious prosecution.

The case is still were it was a month ago.

1 Find Caylee
2 Charge Casey with the hardcore charges (this has happened without the body, and that's remarkable in itself).
3 Have the trial (this is going to happen now that she has been charged).

George and Cin Cin are not suspected of killing Caylee and there is no evidence to lead anyone there.

Whatever happens with George and Cindy it will be an after effect. So it could happen down the road. It's not the most pressing area of the case. I feel it is important and they could literally be charged with a host of felonies, but only those in the State's Attorneys office and the LE know the full scope of the Anthonys involvement. Right now there is not enough to charge them with anything. If there were, they would have been charged.

Just because there is not enough to charge them today, doesn't mean they didn't commit crimes. With a 31 day head start the LE was way behind in figuring out who did what. Couple that with all the lying, and it takes time to unravel.

Even if Casey admitted she had help from a family member that's probably not enough to get someone charged. There needs to be some degree of evidence. It would be a he said / she said. I don't think that the Anthonys are getting a free ride by the LE, in fact just the opposite. The LE wants to charge them, but are lacking the evidence they need. And lacking the evidence needed is not the same as saying there is no evidence / hence no crime.

Personally, I feel that the LE has a good idea what happened with the other family members, but lack sufficient proof / evidence to charge at this time.

One more thing, lawyering up with a criminal defense attorney who says he will act as a PR guy is a fancy way of saying - we expect charges. It's a way to get ahead of the curve. Someone has told George and Cindy that they could be charged with something or there is no need to get an attorney like Nejame. Of all of the cases we have followed, do you remember any other family member lawyering up like this just because there a child missing?

I just heard on Headline News that the lead detective in this case is being reprimanded for blogging about this? Anthony's defense lawyers are complaining (what else is new)? Does this jeopardize anything in the case?

And for the posts regarding the mobile billboard, agreed, if George is going to be advertising this, you would think he would want it to be in the most populated areas (ie, human population). Am just really concerned about seeing this kind of tragedy duplicated as I have always known that it really is easy to do away with children but fear that the knowledge is now greater amongst the evil, warped increasing numbers that appear to be increasing due to our total population increase.

Agree with your position regarding the acquisition of Nejame for the A's, as if there was any doubt within OCSO, after that move all doubt should have been quelled. 

Misdirection is what they are all about, deceit & lies have a long history within that clan, long before the creation of Caylee.  Their assurances & actions taken in that backyard, including planting of items containing the decomp still lead my suspicion toward that backyard with the cell pings duplicated from M Duckett, to lead away from the real disposal area.

Our coming to our own conclusions based on the little that has been released just has me so concerned, sometimes it's hard for me to fight the reality that financial considerations can indeed impeed what really should be done.  Guess it is just the times that I have seen methodology & technology sabotaged that brings on the anxiety.

So often we are forced to see that the consequences in reality are not what they are on the books, again sadly due to financial considerations.  Let's face it if we could afford to jail all of the violent offenders, they would be receiving the harshest of sentences & not be released by parole boards.  All too often, justice is shorted which then empowers the duplication utilizing acquired knowledge to even amplify the crimes committed against the most vulnerable by those still among us.

Came home from voting yesterday to find a resident of my building who so obviously is mentally ill sitting on the backstair case grunting at me & my neighbor, like an animal.  He hadn't been around for at least a month.  When telling my sister of the occurrance she asked me if he was deaf/mute, I didn't know, but later on in the evening I heard him say thank you to a visitor leaving his unit so now I know & 1/2 an hour after his visitor left he was making incredible loud gutteral animalistic sounds, it is scarey when I realize that anything could set somebody off that has those kinds of obvious problems, never mind the monsters that loom that look just like all the rest of us & we have no idea of the horror that resides within them.  Sorry for the O/T.

God keep Caylee safe from the monsters for eternity.

It's my understanding they were handed over to the DA's and that the DA's (State Attorney's Office) then hands them over to the defense. Once they are released to defense, they can be released by DA to the public. This happens in Florida due to the open records law under the Sunshine Act.

I got to bed late last night but took a while to drift off to sleep.

I got thinking about the Caylee Marie case and ... one thought led to another and ... then my pet peeve about the fact that no official search for Caylee's remains has been organized by the Orlando Law Enforment ... especially when you consider the interpretations of those cell phone records and pings.

Why is the search effort being completely left up to TES ... a private search organization.  Why is TES in a position of having to recruit volunteers ... many who are inexperienced searchers?  Why is TES being forced to underwrite the costs with donations?  Why is Orlando Law Enforcement not involved with overseeing the TES search to some capacity?

Well ... the TES thoughts led to thoughts about the vain attempt of "pink angel" to convince Tamikosmom that the investigators had enough strong circumstantial evidence to convict Casey Anthony with out Caylee's remains.

Although I believe that Todd Black's spokesperson qualifications are a joke ... I realize that he was hired by the defence and must have an inside knowledge to what is taking place ... what is being discussed behind the scenes.

pink angel ... Todd Black brings up this topic in his last release.

I may be wrong and ... I hope I am wrong but ... I believe that the defence is going to make an issue about the lack of an official search by Law Enforcement ... especially since the prosecution maintains that Casey is deceased.

Well ... I articulated this post in my mind and ... fell asleep and ... slept like a baby.

Casey Anthony's attorney asks to put check-fraud case on hold

Casey Anthony's attorney asked a judge this morning to hold off on the check-fraud case against Anthony until after the first-degree murder trial was complete. Anthony, 22, is charged with murder in the death of her missing daughter, who would have turned 3 in August.

This morning, Attorney Jose Baez also waived Anthony's right to a speedy trial in the check-fraud case. Baez wants to deal with the murder case before the check-fraud charges.

She's accused of stealing checks from a friend and buying several items, including groceries and clothes, from local stores. The allegations surfaced during the investigation into her missing daughter.

Orange Circuit Court Judge Stan Strickland agreed to continue the check-fraud hearing until next month when another hearing is scheduled for the murder charge.

If the check fraud case is pending while she is on trial for murder, does that mean that the check fraud cannot be used against her (to speak for her lying,stealing character) in the murder case?

Today we take a spin to Charleston, WV to meet Melissa Ann Taylor (pictured), a 37-year-old mom who let her 13-year-old son drive her to the store, according to police.

Cops say they pulled the boy over because he swerved into a curb and then drove into oncoming traffic.  And Taylor allegedly told the officer she wasn't behind the wheel because she was "messed up on Xanies" which is apparently her cutesy nickname for Xanax, the prescription anti-anxiety drug.

But there's a chicken or the egg dilemma here.  Did she have her son drive because she was on Xanax or did she need to take a Xanax after letting her son drive?

ORLANDO, Fla. -- The attorney for Casey Anthony, who is accused of murdering her missing 3-year-old daughter, Caylee, has asked a judge to delay her case on check-fraud charges.

Casey Anthony was not present at the hearing Wednesday. She is scheduled to stand trial in January on first-degree murder charges. Anthony, 22, has pleaded not guilty. She is also charged with forging checks belonging to a friend.

Circuit Judge Stan Strickland has not yet ruled on the request.

Caylee disappeared in mid-June but was not reported missing until mid-July. Casey Anthony said she left Caylee with a baby sitter.

Caylee has not been found.

I understand what you are saying. I understand what you are saying and I agree in a backwards kind of way. ;)

I have no doubt that the defense will try and say that but there was an official search for Caylee Anthony.

It began on the first night when Yuri showed up and started questioning Casey. She drove them all over Orlando pointing out this place and that place. Missing person investigators can only look search where the information they are receiving from witnesses and where the evidence leads them. Casey's lack of truthful information, the smell he recognized in the car...the same smell mentioned by all members of the Anthony family all led that search to their backyard. Which cadaver dogs hit on. Which is why they dug up the backyard. 

They turned all that evidence into the body farm and FBI labs and kept searching. They interviewed friends to see if that would give them further information on where to search for Caylee. They collected evidence.....computers, cellphone, emails. They reinterviewed the Anthonys and still all points led to Caylee being dead. They followed up on any credible tips that came in. Remember the couple of look-a-likes they checked out? They followed up the airport tip. I am sure there will be more that we just don't know about.

There was some small scale LE searches because I remember seeing video of it. The dogs searching the woods being shot from the helicopter.

Sadly all evidence led them to indict Casey for the murder of Caylee.

Sheriff Beary worked with Tim on the first search and found some funds to donate towards a large scale search and Tim said himself on Nancy Grace last week that he was meeting with LE officials to go over the cell pings and stuff, so they will be involved.

LE does not normally organize large scale (hundreds and thousands) searches looking for missing people. Children or adults. They simply don't have the manpower or the resources. They do work in coordination with such searches. Just like LE is doing with TES.

Casey Anthony's Attorney Wants Trial Postponed
Wednesday, November 5, 2008 – updated: 1:26 pm EST November 5, 2008

ORLANDO, Fla. -- The case against Casey Anthony went back to court Wednesday morning, but without Casey Anthony. She did not attend the pre-trial hearing about the check fraud charges against her.

Casey's accused of taking checks from her friend and going on a shopping spree at an Orange County Target.

During the hearing Wednesday morning, the defense told the judge it wants to dedicate its time and resources to Casey's first-degree murder and aggravated child abuse case and also said it's considering asking for a delay in that trial and also possibly for the trial to be moved, but hasn't made those decisions yet.

The defense wants to put off Casey's trial for grand theft and check fraud charges until after the murder trial and seemed to suggest that if Casey's convicted on the more serious charges involving her daughter's death, that the much less serious check charges might not matter anymore.

Prosecutors want to try the check charges first, possibly because the evidence is strong, with videotapes of her using stolen checks; then she might be going into the murder case with convictions on her record.

After the hearing, Casey's defense attorneys said prosecutors are stalling in giving him all the evidence they have against her, particularly the thousands of tips that were called in about Caylee's whereabouts. He said he's gotten less than half of them so far.

"She says she gave the child to a babysitter that no one can find. Doesn't the key lie with her? Why do you need to rely on stranger's tips when she is the one who could really lead you in some direction?" WFTV reporter Kathi Belich asked attorney Jose Baez.

"Kathi, I'm not going to discuss theories of defense or anything we plan on bringing out in court. The truth is, under the rules of discovery we're entitled to it," Baez said.

Baez has received more evidence from prosecutors recently, including more cell phone records and investigator interviews. They will be released publicly as soon as Wednesday.


GEORGE SEEN AT AREA SEARCHED FOR CAYLEE

Caylee Anthony's grandfather is desperate to find his granddaughter. An eyewitness reportedly saw George Anthony standing and staring into the woods near Hoffner Avenue in east Orange County (see map).

Eyewitness News has learned a search team could be looking for the little girl's body in the same place George was spotted. The area has already caught the attention of investigators. It was searched in September when EquuSearch was in town last time.



Now, a WFTV viewer says she saw George Anthony at the same spot early in the evening on October 30 looking into the woods. The area is easily accessible by car, yet easy to disappear into and it's less than four miles from where Casey Anthony and Caylee lived with Casey's parents.

The WFTV viewer said she saw Caylee's grandfather George's car parked in the area around 6:15pm on October 30 and that he was staring into the woods. Then she saw him get into his car and drive away. She figured he was looking for Caylee and the information was passed on to law enforcement.

Casey's defense team's public relations representative said they were aware George was there, that it has nothing to do with what the defense is doing and that there might be certain things that involve the case that they can't talk about.

The sheriff's office says tips that fit in with the investigators' timeline of Casey's whereabouts will be investigated and searched and Casey's phone records show that it's one of the areas that she frequented.

EquuSearch is back in town, too, making plans for the next search scheduled to begin on Saturday. EquuSearch said Tuesday it's getting things organized and training the volunteers. They're expected to search for Caylee for three or four days.

One of the areas they'll return to, to finish what they started, is near Orlando International Airport, where a third of the territory they wanted to search was covered in water from Tropical Storm Fay.

Late Tuesday afternoon, Caylee's grandmother Cindy text messaged WFTV reporter Kathi Belich to say George was looking at the woods to scout out another possible location for the KidFinders tent that they take around town asking for donations and tips in the case.

I have doubts about Jose wanting to delay the trial so he can dedicate his time to the murder trial.

The prosecution wants to try Casey for murder with the check fraud conviction on her record, and he has to know that.

He wants her to go into her murder trial with a "clean slate" so to speak.

I hope hope hope they don't delay it.  Get it over with, it's a slam dunk case.

Now we know George was a Trumbull detective from 1974 until 1985.  And we know from the date of death of Stanley Karey that Dr. Sudimack was the coroner  in Trumbull county from at least 1974 until he resigned in 1995.  We know that the Ohio Bureau of Criminal Investigation was reviewing Dr. Sudimack's death rulings.  Is there a way to find out if George was part of the questionable cases of Dr. Sudimack?

ORANGE COUNTY, Fla. (WOFL FOX 35, Orlando) -- Wednesday morning, the State presented its case against Casey Anthony on grand theft and check fraud charges.

Casey Anthony, who did not appear in court, was represented by her defense attorney Jose Baez. He made a motion to continue the case on the theft charges and also waived his client’s right to a speedy trial.

Baez asked Judge Strickland to consider continuing the theft and fraud case before hearing her first degree murder charge case.

The judge did grant Baez’s motion to continue the case, but said this “judicial economy may be best served by hearing the murder case first,” after the State objected to trying the murder case before the check fraud case.

Strickland also asked the State if they had decided whether or not to seek the death penalty in her murder case and it said it was not; that the decision had not been made yet.

On the roadtrip with Murt this morning it looks unbelievably dense at every single spot that Casey(!@#$%) had pings. She either spent an enormous amount of time in backwoods, empty lots,and desolate areas or she was more clever than anybody has given her credit for. I hope and pray that she was as stupid as she was amoral.

IMO the hugs must have been more than just a little hug bye, I am thinking it was more like embracing. His excuse that he didn't know the rules goes to show just how inexperienced he is....he is out of his league..perhaps the prosecution needs to interview the jail employees who witness the HUGS....the jail employees who's JOB  it is to maintain the rules of the jail that apply to ALL inmates....I'd also like to hear from one of his other clients who he hugged... ::MonkeyWink::

One reason I think it's important is that if these places were normal hangout spots for her, for whatever crazy stuff she did while she was supposed to be working, or maybe she met friends to get high or something, it might be Unlikely that she would choose them as "safe" place to leave Caylee.
I am really hoping that all the super smart people figuring her movements have her pegged.

I wonder if when they tested KC for drugs, if they could tell if chloroform was in her system.

I was wondering if George's looking into the woods where TES had previously searched was indeed to look for a location to set up the billboard (as Cindy stated) ........ to form a location to "protest TES" and the searchers ... Man they would sure have their hands full if they did that!

Gee, that might be a good question for Murt to ask GA.  GA:  What did you think of Coroner Joseph Sudimack back in the day when you were a homicide detective in Ohio?  How many cases did you work that involved his participation in the determination of death?

That's my problem, I have a very difficult time thinking that she is THAT STUPID, the cell phone ping activity is just too obvious even if I take into consideration that there is a possibility that she is a meth or other type of drug user cuz when a drug user doesn't have a safe place to use they will go out into the boonies to use, like kids do who live with their parents to drink & smoke pot in my day anyway.  But it is happening all too frequently.  I want to be wrong but it just seems to me that she has copied M Duckett's playbook & I don't doubt for a NY second that it was probably even suggested to her by someone with former LE employment.

I had similiar thoughts Sunny when the topic came up about the hugging.  The visual that automatically came to my mind was they were probably dry humping like dogs do, that I can see as being reported as hugging by jail guards, exempting our male monkeys I have met too many men that would feel they would have to report that activity with an attorney being embarassed of going into the detail,  a normal "hello" hug of 3 seconds would surprise me if a jail guard would feel the need to report that type of activity, so I think you are onto something in your intuition.  Of course there is no way to KNOW but I think, also I think it odd that the reporting officer felt that he should leave when his superiors were having their meeting with BJ JB, don't you find that odd?  In my world the reporting officer would be asked to stay to hear that his directives to BJ JB were in fact policy & were to be followed.

It's not like she was from a sheltered, quiet,God fearing family or anything, when they did talk ,probably being as computer savvy  as they seem to be, she HAD to know that she could be tracked by her cell use. Now, if she panicked and forgot all that in the midst of the murder and the following days...... or possibly all the crazy gobbledigoop about the sim card and the blackjack was her screwup and she meant only for that one to show. She's tricky and evil.

The other thing that bothers me is the ever smug attitude that makes me wonder if she is very confident about her disposal site. 

I have a "gut feeling" (can't believe I used that phrase..) that the A's have made sure, with Casey's help, that the body will not be found.

This wannabe detective had it figured out that Judge Strickland and the Jose Baez had an understanding way back when when bail was not revoked when the securers of Casey's bail bond ... her parents ... did not conform with the agreed conditions ... when a concealed weapon was located inside the trunk of George Anthony's vehicle.

Then there were the eleven motions put forward by Jose Baez ... eleven motions and ... not ONE was denied.

Now the extention of the the hearing relating to the cheque fraud charged brought again Casey.

ORANGE COUNTY, Fla. (WOFL FOX 35, Orlando) -- Casey Anthony chose not to attend court Friday for a motion hearing. In court Ninth Judicial Circuit Court Judge Stan Strickland ruled that her attorney, Jose Baez, can have access to her car and forensic tests.

The hearing got underway at 10:30 a.m.   Casey parents, George and Cindy Anthony and her brother Lee Anthony, were not in the courtroom. 

In court Ninth Judicial Circuit Court Judge Stan Strickland disagreed with an argument by Orange County prosecutors that the evidence did not pertain to the child neglect charges that Anthony faces in the disappearance of her 3-year-old daughter, Caylee.

Strickland allowed motions that the defense be given access to forensic tests involving chloroform, DNA air samples and hair strands within 10 days. He denied access to evidence collected by cadaver dogs.

Defense attorney Jose Baez had sought the car and other items available so he can conduct his own tests.

There were 11 motions filed.  Here is where they stand:

Orange County Corrections contacted the duty judge, Circuit Judge Daniel Dawson. According to Moore, Dawson said that he would take no action until he spoke with the judge who issued the bail order. Dawson spoke with Circuit Judge Stan Strickland early Saturday, who said that because there is no indication that Casey knew the gun was in the trunk, the judge did not plan to return Casey to jail, Moore said.

Attorney seeks to spare Casey Anthony from death penalty

A Miami lawyer hired by Casey Anthony's defense team gave prosecutors Wednesday a report that outlined why the single mother accused of killing her child should not get the death penalty.

The 30-page packet highlights problems with some of the evidence, defines how details in Anthony's case does not fit the state criteria needed for the death penalty -- a penalty reserved for the worst of the worst homicides.

It touches on Anthony's erratic behavior after her daughter's birth that suggests signs of emotional or mental distress. The report ended with pictures of Anthony during happier times as a child surrounded by her parents and her brother.

"Casey Anthony is a unique individual. A close inspection of her case clearly supports not filing a notice seeking death," attorney Terence Lenamon wrote in a report obtained by the Orlando Sentinel.

The State Attorney's Office would not confirm whether it received the report, which is not public record. Anthony is charged with first-degree murder in the death of her daughter, Caylee Marie, who was reported missing on July 15. The body of Caylee – who would have turned 3 in August – has not been found.

Anthony told investigators that she left Caylee with a baby sitter in mid-June. When she returned later that day, both the baby sitter and Caylee were gone. Detectives have not been able to locate the baby sitter and question whether she exists.

Prosecutors have not decided yet whether the state will pursue the death penalty. If they do seek death, the trial will be divided into two sections: the guilt/innocent phase and the sentence phase.

Lenamon's report addresses the sentence phase when the jury hears both why she should and should not get the death penalty.

Some of the reasons outlined against death include: Lenamon pointed out the analysis techniques used on hair and air samples from her trunk to prove decomposition are "novel, experimental, in the early stages of development, inconclusive and high susceptible to mishandling," he wrote. Even if the evidence is enough for a guilty verdict, it would not be enough to support the death penalty, Lenamon wrote.

Details of the Anthony case to do not rise to the level required for the death penalty, he wrote. She doesn't have a criminal record. There is no history of abuse. The crime was not cold, calculated and premeditated. In the months leading up to Caylee's disappearance, Anthony's behavior was described by friends and family as "erratic and not entirely rational."

He wrote that filicide – the act of a parent killing a child – is different than other homicides. The underlying reasons why mothers kill are complex and can be divided into various categories. For example, one type is a parent who kills under influence of mental illness. Another type suggests a parent's motive may be to save the child from real or imagined harm.

Juries are more likely to show mothers mercy. He mentioned Andrea Yates – a Texas mother who drowned all five children – was sentenced to life in prison. Susan Smith, the Arkansas mother who pushed her car with her two children inside in a lake, got life in prison.

Lenamon wrote that experts will likely agree that Anthony as "suffering from episodes of extreme emotional distress and disturbance since her daughter's birth." Even the lack of emotion after her child's disappearance and arrest "is not normal," he wrote.

Lenamon also refers to other Orange County cases involving the death of a child. For example, Anita Simmons, who beat her 8-year-old daughter to death, got 42 years in prison.

"A careful consideration of the totality of the circumstances in this case leads to a clear conclusion that a filing a notice of the death penalty is no the right thing to do," he wrote.

Wouldn't a civil case come to "trial" before a criminal case?  Is there any word that they are going to pursue this case?  If so .. why haven't we heard anything about it lately?

It bugs me that even if they convict Casey...we will never know the whole blow by blow story....much of the day to day truths will never come out, because Casey will never admit anything.  All the theories we have speculated on and  all the efforts made in digging for truths over the past few months.  Do you think we will ever know the REAL story?

I think this is one of those judges that is going to give everything to the defense possible...judges don't like to be reversed on any decision...hurrrrump!  it looks bad on their record...and now I don't think the prosecution will be able to bring up the fraud charges in the murder trial......

Janet, I'm starting to lean in your direction on this...no relation to these two cases so why hold off ?

Evidence on theft charges can't be used in murder case to paint a picture of KC or it will be double jeopardy if used later ? ...of course if found guilty and sentenced to life..

The way I would think it "should" work is .... She was "charged with fraud 1st" that trial should be first and that "evidence" should be allowed to be entered (criminal history) into the following (murder case)

She cashed Amy's checks BEFORE she reported Caylee missing ... that to me speaks VOLUMES to her character and should be considered as VITAL evidence into in the murder case!

It was not Judge Stricklands ruling that afforded to Casey relaxed conditions of the home confinement agreement but nevertheless ...

As soon as the brother and sister got through the path between reporters, they high-fived each other as if they were celebrating some sort of victory. According to the Orange County Corrections Department, Casey met with her home confinement case manager Monday afternoon for approximately 20 minutes. During the meeting, her case manager set her out-of-the-home schedule for the remainder of the week.

Officials also said Casey scheduled a meeting with her attorney every day this week. She can leave at 10:00am and must be home by 4:00pm. There is no schedule for her to be out-of-the-home over the weekend.

Meanwhile, Casey Anthony will meet with her attorney, Jose Baez, every day this week. She's allowed six hours a day outside her parents' home and will spend all that time with Baez, Local 6 News reported.

Baez told Local 6 News that he and his client would be going over the timetable surrounding Caylee's disappearance in a methodical way, targeting the time from June 16 -- when Caylee was last seen -- until Casey Anthony was arrested in mid-July
