Jose Baez, attorney for Casey Anthony called defective lawyer by former client

In a motion for a new trial, a prison inmate serving 15 years for killing a toddler claims he was convicted due to the “defectiveness” of his defense attorney, Jose Baez.

Baez is currently representing Casey Anthony, who is charged with the first-degree murder of her 2-year-old daughter, Caylee.

Nilton Diaz was represented by Baez last year after he was charged in the death of 2-year-old Noeris Vazquez, the granddaughter of Puerto Rican boxer Wilfredo Vazquez.

Diaz was accused of causing a fatal head injury to Noeris, the daughter of his live-in girlfriend, Samaris Bobe Silva.  On Feb. 11, 2006, Diaz was alone with the child for 10 minutes when the injury occurred.  Diaz insists he is innocent and did not kill Noeris.

Diaz claims he lost his case and was convicted of manslaughter and child abuse because of Baez’ trial strategy and performance, including his decision not to disclose pertinent evidence to prosecutors.  Diaz insists this prevented the jurors from viewing an important defense video.

The Orlando Sentinel reports a biomechanical expert created the video, which would have shown the jury that the little girl’s skull fracture could have been accidental.

Diaz claims, “…Mr. Baez wanted to surprise the prosecution, and the surprise blew up in the defense’s face.”  Diaz also alleges, “Mr. Baez’ defectiveness affected the fairness and reliability of the trial, that confidence in the outcome was undermined.”

The motion for a new trial also alleges the presiding judge, Mark Nacke, and Assistant State Attorney Bill Gross entered into a “silent pact to inflict the most severe punishment allowable by law” on Diaz because he rejected a pre-trial plea-bargain offer.

Gross said Diaz’ motion is “…total baloney, totally bogus, nonsense.”  According to Gross, Baez provided “more than effective counsel” in the case.

Baez will defend Casey Anthony in her upcoming murder trial tentatively scheduled for Oct. 12.

Extreme Trauma Will Either Break Up A Family Or Make It Unbreakable

No family has been put through more stress over the past year than the one of Cindy and George Anthony of Orange County Florida. Last summer, the Anthony's two year old granddaughter went missing and over the next few months she was found dead. To add insult to injury for Cindy and George Anthony, their own daughter Casey was charged with the murder of their grandchild Caylee.

Over my lifetime, I have studied the way extreme stress works it's magic in both a positive and negative way on families. Some families encounter extreme situations like this one and become an almost unbreakable family unit in the future.

However, many times a family unit is completely broken when so many bad things happen to the family unit in such a short period of time. Over the next year, the marriage of Cindy and George Anthony will either become as solid as a block of concrete or it will crumble into a pile of rubble to where they find themselves back in court one last time for a divorce hearing.

Time For Another, Don't Forget Caylee Marie Anthony Blog Post

I know some of you are tried of reading my don't forget Caylee Anthony blog posts, but I believe it is important to remember what all the buzz is about surrounding the Casey Anthony murder case. Casey is awaiting trial for murder because, most likely, she killed her little two year old daughter Caylee Marie Anthony.

For years, I have watched as the mainstream news media from both print and TV have quickly moved past the fact that a person was killed and instead took up the mantra of a good criminal defense lawyer that tries to portray his/her client as a victim.

That transformation has already happened in the Casey Anthony murder case as eight attorney's are now trying to make her (Casey) seem more human and likable, so a jury will not see what this young woman is really like down deep inside. The real and only victim in this whole story is Caylee Anthony and at least every couple of weeks I am going to write something just about her so none of us forget that she was the victim here and not Casey.

I say it will crumble...

When will Casey Anthony be able to see her parents privately in jail?

WESH-Channel 2 reported tonight that "a source close to the family" says that "the wheels are now in motion for that meeting so the family can mourn Caylee together for a short time."

All sounds rather fuzzy, doesn't it?

George and Cindy Anthony could go to the jail any time they wanted. The question is: Will Casey agree to see them? And will the jail allow them to meet privately? The jail has said repeatedly that won't happen, but WESH didn't refer to the jail.

Casey is charged with the first-degree murder of her 2-year-old daughter, Caylee.

Anthony's attorney Jose Baez has depositions lined up this week. WESH said one with volunteer private eye James Hoover had been postponed. It was supposed to be tomorrow.

WKMG-Channel 6's Mike DeForest previewed the depositions. Anchor Jacqueline London asked why it matters that Hoover and another private investigator didn't see anything in November in the woods where a meter reader earlier saw something. Caylee remains were found in those woods in December.

"If the defense tries to go with the theory that maybe Caylee was not out there in November, then that meter reader, Roy Kronk, is going to pose a very serious problem," DeForest theorized. "Perhaps that's why next week Jose Baez plans to interrogate in a deposition the supervisor of that meter reader with Orange County Utilities. That supervisor did not see a body out there back in August.

I am behind, but I don't think if you are on the witness list you can sit in court until after you testify. Maybe that is for the grand jury. I'm not sure as I am no "criminal" and have never sat in front of a jury. Notice I said JURY, not judge!

I'm pretty sure you'll see  the Grunds (at least Rev Grund)  & LP throughout the trial beyond testimony & they will try to sit on Caylee's/prosecution side if they have a choice of seating.  It would be great if a group of Casey's friends (Tony, his new girlfriend, Ricardo, Amy) all sat in as Justice for Caylee, man that would get her goat!   But  I'm also wondering if they will have a daily "lotto" type drawing as to what public members will be allowed in on any given day...Im sure many will be showing up hoping to witness the trial in person.  Truthfully, I would love to be there myself, and its not totally out of the realm of possibility depending just how close it is to the holidays.


Thomas Luka is backtracking a bit on JVM,  Lee doesnt have a leg to stand on because Hoover said "low proability, maybe" it wasnt an accusation or a statement of fact...discussing what Hoover said in his dep, now he is saying "at worse he was gravely mistaken" and wait Luka said "hopefully the phone records will bare that out" well, wait you mean to tell me they dont have these phone records yet, come on!!!       I'd like to know who postponed Hoover's dep with Baez...Bozo or Hoover.

I really wish that George and Cindy would just disappear. I can't take these two much longer. They aren't going to mourn Caylee, they are going to get all their facts straight, I am going to pop a xanax and scream if this is allowed.  ::MonkeyNoNo::

I am pretty sure that Tony is going to be a witness however can you imagine the look on KC's face if she saw Tony sitting with a new squeeze?  That first phone call home the only thing she wanted was Tony's number.   Won't she be surprised that he has moved on without her.

I agree with you.  Shirley is the only one of the whole lot that I have any compassion for and believe to be telling the truth.  Shirley is also the first one of them that spoke about Caylee and her concern for her welfare in her interview. Can you imagine living your final years with all this spinning around you.   The statement that Shirley hurt Cindy last week really upset me.  Cindy was not hurt when Caylee was found dead and could scarf down a meal when she got back from LKL yet her Mom tells LE the truth and she is hurt?

I wish now I would have been allowed I loved that man dearly, then my Grandmother (his wife 20 years after he passed) I remember some , some things are shoddy in my brain. I remember the funeral director telling me to take out the Texas Ranger's teddy bear I gave her that was in her casket. I told him hell no that was hers, not mine, that little bear gave her comfort while she was passing away. I could remember the bear and that I held my head backwards so as not to cry because she wouldn't want my mascara to smear.

 She was all about wearing her makeup and lipstick.

Cindy has it on video, I just have memories.

Earlier today, someone brought up the concept that KC was Zannie in her own mind. I know this has been discussed in the past and many folks discounted the idea. The responses today seemed more receptive to the idea. Any thoughts on why that has changed. Personally, I'm not sure it's true, but I think she'd try to use it as a defence.

Klaasend -ITA!  I believe you may have hit upon KC's sliver of truth in the lie.  To KC and her family, it wouldn't be a lie because they would all know about Zanny.  I wonder if Zanny the Nanny was an alter ego, triggered by drug/alcohol abuse in conjunction with sociopathic/psychopathic tendencies.  I would like to know where Casey really was while Cindy had Caylee at the Nursing Home on June 15th.  I'd also like to know what time Casey actually got home that evening or night and her physical/mental/emotional state.  I have to believe there were incidental episodes of sociopathic/psychopathic behavior all along and the Anthonys chose to lie & cover or lie & deny (to themselves, each other, relatives, outsiders).  Sociopaths/psychopaths don't become that way overnight...it's a process, a gradual behavioral acting out. I think Casey was speaking codespeak to her family on the Zanny took Caylee statement.  That's why Cindy subsequently, suddenly, and readily told Casey via the media, "I forgive you.".  IMO, Cindy & George knew there was a problem early on in Casey's development (I'd say Lee's also) and they chose to deny & hide by creating a we-can-only-trust-each-other family environment.  Their family culture, if you will, reveals a marked and overbearing distrust of outsiders (akin to cults).  This is the only explanation I can surmise to explain their denial of Casey's ongoing outrageous behavior, their determined support for Casey, the circle-the-wagons-the-family-is-under-attack mentality, Lee's objections to LP for the family to take polygraphs, the family's utter lack of surprise at the extent of Casey's lies and their easy dismissal of same, their lack of of "normal" emotion in response to their beloved granddaughter's disappearance and demise (they clearly already knew that Casey killed Caylee IMO), and the depth of their animosity towards anyone who dares confront them (fear of exposure).

Hello,everyone!  Stopping in to get my update.  I went and looked at the first 12 pages of Casey's photobucket a few nights ago.  There was no way I could get through them all (waaayyyy to ungodly and I mean that respectfully).  The first thing that caught my attention was that there was 75 pages.  How does any parent have time to find that many icons, spend that much time partying (well-documented), take and upload that many partying pics (I'd love to know who took all the pics of Casey), plus all of the texting, as well as messaging on Facebook and MySpace pages- WHILE SHE'S WORKING! I'd like to see Cindy Anthony answer that question!  That Zanny must have been a live-in nanny!  Seriously...75 pages?!!

Did anyone else notice how many party pics/anger-revenge related icons there were in relation to how many Caylee pics?  The overwhelming theme (if you will) of the 12 pages I saw, was death, rage, contempt for authority (Police, in particular= reflecting contempt for George-easily manipulated and intimidated), sadism, and hedonism.  Just like the clothes, hairstyles, and cars you choose reflect who you are, so do your writings/choice of music & books/collections, etc.  Clearly, Casey is a disturbed individual.  I would like to know when each if the death-themed images were uploaded to her photobucket.  IMO, based on her photobucket collection, George's reported temper, the number and extent of her fantasizing/lying, her own family's admissions of her inability to get along, Lee's admissions of running interference and playing clean-up, I'd say at the very least Casey probably diagnosed with poor impulse control in her initial arrest psych eval.

Now we know what that old expression, "The truth hurts!" means - get it now, cindy?  Your mom and your brother tried to warn you - now the truth hurts.  BTW  Shirley and Rick Rock!

If you follow that "white pants" image through the rest of the clip, you can start to see that it is a reflection of something on the glass through which the video was being shot. Hoover said he shot that part of the video through a car window (in his deposition). The white thing is a reflection on the car window glass through which he was shooting.

This is unrelated, but Hoover seems like a sad man to me. I don't buy that he didn't know the Anthonys before this all went down. He has some kind of a personal connection to this case. I firmly believe that. I just can't prove it.

Hi you all. I wish I did not take these missing children cases so hard. I feel the pain in my heart as if they were my own child. Then I find myself taking some time away from the cases to regroup my focus on things I can change and positive thoughts. My time away does not mean I do not care or have forgotten their loved ones. Just imagine being a parent/grandparent in this situation. I respect and admire those of you who can stick with so many cases at once or get so completely involved in any one case. I can't do it..wish I could but I can't.

Thinking as a parent in these peoples situation, it is you all who keep these cases alive and not forgotten. Bless you.

mgoblu and A_News_Junkie_Monkey-  ITA with your last few posts on Cindy's purported hurt.  I doubt if she's hurt.  I think it's a media ploy to gain sympathy- "Oh, poor Cindy's been betrayed by her own mother."  WOW!  That sounds so familiar in the Anthony family!  I'd say more like flaming angry that her mom dared say anything negative to LE about Cindy and her ideal family.
Your comments reminded me of Shirley saying that she thinks Casey hated Cindy more than she loved Caylee.  When I first read that in the doc dump, I thought about that nugget of truth.  Conversely, Shirley could have safely said that Cindy hated Casey more than she loved Caylee.  Cindy's need to control Casey overrode her love (i use that term loosely here) and concern for Caylee.  IMO

RM - was he asked about who that person in the white pants is?  If they are not in the woods, they sure were close to the car to be picked up in the tape?!?!?!?!  I will watch it on my tv again and see if I can see what you are saying.  I know when I first noticed the person, I did see them again later in the show - so has this be asked about?  Tell me what you know!

Just an opinion, but when a 3 year old wakes up and is getting dressed under normal circumstances, the entire house knows they are awake. They need breakfast etc. How is it George is sitting watching food channel and all the sudden he sees Casey and Caylee all dressed and walking out for the day?

Right there - to the right.  White pants.  The person moves - Dom Casey looks that way too.  A tad later, Casey turns around and you see the person again.  Does anyone else besides me see this???? 

Personally, I think he's snidely snickering because he knows the game.  He's played many of them his entire life: running interference between Casey & Cindy; playing superhero Clean-Up Man for Casey; Casey's co-conspirator on the Let's-Make-Our-Parents-Look-Stupid game; Cindy's crutch; and many more.  He knows very well how the cat-and-mouse games are played and he's amused at LE's attempts to catch him, as well as John Morgan's.  He gives just enough to tease, carefully choosing his words to confuse and circumvent the actual questions.  Sound like any other Anthonys we know?  When caught with a repeated, direct, and painstakingly clarified question, he refuse to answer and pleas out (just like the rest of the A's).
I say all this because I grew up with a controlling authoritarian parent, with a nasty temper.  As children, we were unable to "fight back".  As we grew to teenagers, however, we each found subversive ways to express our contempt.  My sibling chose to take drugs and abuse alcohol, while our attention-seeking mother spearheaded the school's anti-drug campaign and bragged that her children weren't into all the partying.  I was the one who "assisted" my vomiting sibling back to bed and kept his secrets.After his increasingly violent behavior, I was the one who secretly searched his room to find his well-hidden drug stash.  I kept his secrets, both to spite our mom, and to gain a measure of control over him.  That's how I know what Lee means when he says he's a lot like his sister and he's the keeper of her secrets.  That's also why Casey knows she can't lie to Lee-he knows her and her secrets far too well.  He's got a lot on his sister...more than she has on him, I'm sure.  I was my mom's crutch too..being the "good" one in the family creates leverage and control too.  I know this family dynamic very well.

I also think Lee's initial laughter regarding the smell of the car in the garage stems from his derision of Casey.  IMO, he's both amused that she's created chaos (yet again)-how dumb she is, and he's amused watching his controlling mom and his ineffective, pathetic excuse for a dad (my interpretation of Lee's opinion of his dad) frantically trying to figure out how to spin this and protect Casey (really themselves).  I say this because I have yet to see or hear any measure of respect from Lee for his dad.  I've seen Lee repeatedly, physically comfort, defend, and "shield" Cindy.  By the same token, I've seen Cindy physically and verbally support, comfort, and defend Lee.  I have yet to see Lee show any such comfort or support for his dad whatsoever, in word or deed.  Lee "mothers" his mother because that's the role he's assumed in the family dynamics to survive (also part of the reason he feels contempt for her -re: "the keeping secrets from our parents").  In essence, he's assumed George's emotional role as the husband figure because Cindy & George's marriage has been broken for a long time (hence the physical awkwardness where he defers to her and she asserts herself by grasping him).  This is a large part of the contempt Lee feels for his father too, IMO.   

I watched the video and I see a white thing that looks like a person in white slacks. If not a person, then what could it be? There is definately something white there.

I still don't see it as a person.  There are some shadows that do some funny things to the photo but the shadows I believe are caused by a reflection in the car window because whoever is shooting the video (Hoover) is inside the vehicle.

Whatever it is, it looks to me like the person bends knee (left on screen shot above by Klaas) then turns sideways.  Watch DC - he looks that way even.  He knows someone is there.  Walks a few steps and crosses back past them.  If you have JVM recorded - it does show somewhat better on TV.  If it was a reflection it is bending two different ways.  Can't be refelection of a person, because it is behind the trees.  I think I even see an arm go up - toward face.  So that would mean if it is an arm, the person is in short sleeves or has long sleeves pushed up.
I am going to bed, will see what others say in the am and will watch it again in the am!  I sent Kathi Belish an email - I hope she answers - I am hoping she has a better quality copy of the video. 

Shell, I find it kind of hard to believe that Casey would have hung around after the purported fight (i.e. Cindy grabbing Casey by the throat et al).  She may have taken off with Caylee, only to sneak back in at some time in the early morning though.  JMO  I do not believe George that he saw Casey and Caylee. First of all, he was far too detailed one month later about what Casey AND Caylee were both wearing on a nondescript day (after none of them could even specifically remember what day they last saw the child!).  Secondly, his description lacked any emotional details.  He described them as exchanging normal pleasantries on their way out the door.  That would NOT have been the situation, given the explosive and physical confrontation of the previous night.  Caylee would have been fearful, visibly anxious, emotional, and skittish for days after such a confrontation...any child would, regardless of age.  She would have also been fearful when she & Casey encountered George.  You can bet Confrontational Casey wouldn't have been so light-hearted, as to simply wave a "Bye, Dad. I'm going to work.  See you later." either.  George's description of seeing Casey & Caylee is conspicuously absent of any of that.  I don't believe him.
You hit the nail on the head about how much hussle and bustle there is to getting children up, ready, and out the door too!  Small children (and big ones too) are anything but quiet and compliant when it comes to mornings.  I've duly noted that with friends and family.  Recently, I went on a trip with my mom, SIL, and 6 nephews.  SIL's house was overly quiet when I walked in and my first thought was "Someone's sick.", followed by "Their dad must be sleeping.".  I say this because the nephews have been taught to be quiet when their dad is home (he has a hearing issue).  They also know they can be far louder when dad's at work! ::MonkeyWink::

On my way out, I was thinking about my own family dynamics and my sibling's temper.  He's got kind of a bad temper, like my mom (he doesn't abuse SIL or nephews or anything like that though).  I was contemplating how at family functions, we all kind of walk on egg shells around him because he can be pretty contemptuous.  I just realized he controls us by is behavior and he like that measure of control.  My mom, in particular, sort of defers to him (as most of his contempt is aimed at her-surprise, surprise!).  He's learned that most of the family is afraid of confrontation, except our dad.  Hhhmmm...I can see how an in-your-face Casey could make Cindy & George dance to her tune, while Lee tried to play peacemaker and pacify her.  Gee, I'm glad my sibling doesn't do drugs anymore, he might have been a Casey (not joking).

Im reading catching up on what I missed this evening.   Casey cannot offer this as a defense successfully for several reasons here are a few off the top of my head:

1)   She made many moves to conceal which indicates that CASEY was very aware of what she did.
2)   Casey lied to LE and everyone about Zanny which means she created Zanny, not that she thinks she is Zanny.
       She calculated what to tell others about Zanny, if she was delusional or suffering MPD she wouldnt consciously know
       the difference between Casey & Zanny.   No one ever witnessed her taking on another persona and speaking as if she
       was Zanny.
3)   With all the internet & cell phone activity this girl participated in she never had a reference to a Zanny as another
       identity or password.
4)    She has absolutely no mental health treatment history.   That will bite her & her parents in the @zz hard when she gets sent
        to prison for life.
5)   Casey looked up how to make chloroform, neck breaking, household weapons well in advance of Caylee's murder, shows
      premeditation.
6)    Her comment "maybe Im just a spiteful B" and telling her brother that maybe she was an unfit mother & "this should
       have happened along time ago"" well be the final bolt hammered into her permanent cell door.

Gads, I hate it when I can't sleep!  So, does anyone think that JB wants to depose KioMarie to see if he can sell her as scorned by casey and sindy when they wouldn't let her adopt caylee?  After all, she unfortunately mentioned the crime site to police early on......thus, maybe JB is going to see if he can plant reasonable doubt via KioMarie???????

Yes, Capp, great post.  If the defense were to put up any type of mental defect defense it would not work because there is no history, even according to her mother (see video on p. 1 or 2 that Trimm posted).  In addition, if the defense were to put this type of defense up this type of defense requires a lot of time being spent with a mental health expert and nothing like this is being pursued. 

I found it interesting some of the IMs with Iassen, as well as Amy which all happened on June 27 when the car was abandoned at Amscot.  After her child has been missing for days and while Tony is on his way to pick her up, she says the following:

11:26 am Casey texts Iassen and tells him she has not been sleeping well (p. 2618)
11:29 am Casey tells Iassen she has a nanny someone she trusts and has known for over 6 years.  She pays her a lot more than most nannies make.   The nanny is her friend and between Casey and one of her co-workers that is her main source of income. (pp. 2618-2619)
11:44 am Casey texts she is very happy now, this is the first time I’ve felt this way in a long time and that she loves Tony (pp. 2619-2620)
11:34 am Casey texts Amy that “there is definitely an animal plastered to the frame of the car.”  Casey further stated that she had gotten rid of it. (p. 1041, 1147, 4965)
 

O/T sorry, Baez will be talking to Amy this week, well the week Amy was going
to PR on holidays KC was talking to Amy and told her that her car had been towed and the only way she knew that was KC was at the house and saw the
notice or CA told her. But I remember Amy saying this and thats why Amy let KC
drive her to the airport and keep the car for that week.
Also the day Caylee was born, why was GA in the delivery room to cut the cord
and CA was there for the nurse to hand the baby too.
Did the A's have a deal with KC for them to adopt the baby and then it all changed, maybe KC changed her mind and thats when the hate for CA really
began. Just my opinion. I can't imagine my father being in the delivery room at any time.

Good morning Mary -- I think KC had told Tony that her dad had the car towed to a dealership and was having it fixed for her.  What I think happened is KC went with Amy to buy a gas can at Target and when she went back to get the car it really was gone.  She did not have the money to get it out of hock so the little grain of truth is the car was towed.  MOO.  I don't know about the other question.

Could be, a few glitches in that possibility...Kio had no access to Casey's car trunk nor was driving her car.   Kio wasnt allowed in the Anthony home where stuff found at the recovery crime scene originated from nor would anyone outside a family member have included those items specifically to put with Caylee.   I think I also remember that Kio said she had little to no contact with Casey in those pertinent months.

What I do think Bozo is trying to do is find ways to discredit her testimony.   I wish she didnt sell her story to the NE, that's gonna be a blemish on her testimony that Bozo will pound on but I think the crux of what she has stated will survive the attack.

That coincides with some of what she wrote in her journal dated June 21st so I do think pages missing prove that that last page was in 2008 not 2003 as Baez is claiming.

The "animal plastered" shows consciousness that her car smelt & she was already making excuses to cover her tracks.   She was fully aware of what she did.

I can not beleive anyone still insists there was EVER a nanny/babysitter. The fact that Casey calls her a "Nanny" makes it clear she was delusional and wanted to be more than what she is. Casey nor anyone in her middle class family could afford a nanny. A nanny LIVES in your home with a room all her own. She tends to most needs of said child and usually has some sort of benefits and steady salary!!

We know Casey never paid for any sitter as the real babysitter was her friend who also thought she was working and was doing Casey a favor by NOT charging her!!

At times you can tell even George and Lee are uncomfortable with the term "Nanny" and they usually say Nan ahhh babysitter.

I know this exists as "Theme Parties" is popular with kids today. They say,"Let's do 50's night, then they go to the Salvation Army and buy cloths that fit the theme and drink their butts off. The kids I know that do this are age 24 to 29 and they are Navy Fly-boys and no drugs are ever involved but they get mighty drunk and SOMETIMES they hire professional party goers to entertain. That is what Casey and her 2 friends look like to me. Big money can be made for a few hours of shakin' your bootie!! Could be where she was getting some money.

ISpy ....another good post.  Your statement says it all - I couldn't agree more and in Cindy's quest to control KC she used Caylee therefore casting a huge shadow on any real love and concern for her.  Cindy's intentions in this from the day Caylee was born are highly questionable if you ask me.

George, Cindy, and Lee Anthony are requesting to meet with Casey in jail to mourn the loss of Caylee.

Two-year-old Caylee Anthony’s remains were discovered Dec. 11 in a wooded area near the Anthony family home.  The county coroner ruled the toddler’s death a homicide.

According to WESH 2 News in Orlando, a source close to the family said the “wheels are in motion for that meeting, so the family can mourn Caylee together for a short time.”

In Jan., Brad Conway, attorney for George and Cindy said a family reunion was being negotiated that would include a private funeral service for Caylee.  However, at that time a representative for the jail, Allen Moore said, "No such request has been received by Orange County Corrections.  It is highly unlikely such a request would be granted."  No such meeting took place.

According to the Caylee Daily, "This latest plan isn’t about Caylee at all it is all about Casey."

Casey Anthony is charged with the first-degree murder of Caylee, and is tentatively scheduled for trial Oct. 12.

Should Casey Anthony be forced to answer all the questions in the Zanieda Gonzalez civil suit? Gonzales' lawyers think so.

Up until now, Casey Anthony has not answered even one question in the defamation suit of Zenaida Gonzalez. And lawyers for Gonzalez have had enough. Gonzalez, a mother of six, accuses Anthony of slandering her when the 23-year-old mother said Zenaida was the alleged nanny who abducted her daughter, Caylee.

Yesterday a motion was filed by Gozales' lawyers to force Anthony to answer all of the questions in the deposition. When Anthony initially filled out the questionnaire, the only item she wrote on the document was her name. She failed to answer any of the 17 questions asserting her fifth amendment right to not incriminate herself.  Anthony's lawyer, Jonathan Kasen, thinks his client should be able to continue to invoke the fifth in the ongoing civil suit. Kasem believes every question in the written deposition is "inextricably intertwined" with Anthony's first degree murder case.

Robin Sax, a former Los Angeles County Deputy District Attorney, agrees with Kasen. "Statements that are taken under oath at other hearings can be used against her" says Sax.  Kasen and Jose Baez, Anthony's defense attorney, could be working in tandem, speculates Sax. Baez would certainly not want his client to answer questions like "Do you know who killed Caylee?" and "Were you involved in death of Caylee?"

Sax is surprised the Zenaida Gonzalez civil case has moved so quickly in the first place, "These things usually take years." But, says Sax, it's possible Gonzales' lawyer, John Morgan, has been bitten by the fame bug surrounding the highly publicized trial. "If he's the hero that gets her to answer the question which would essentially amount to a confession -- that's huge."

ORANGE COUNTY, Fla. -- Casey Anthony's defense team will have to wait two more days to interrogate several key players in the murder case.

Jose Baez was going to depose former Anthony family private investigator Jim Hoover and several Orange County Sheriff's Office investigators Tuesday, but those depositions have been delayed until Thursday.

Four jail officers will also be questioned. Two of those jailers witnessed Casey's reaction when she was told about the discovery of Caylee's remains.

Casey Anthony's attorney, Jose Baez, doesn't want the public to know about any defense theories that are being developed.

He filed a request for an ex-parte hearing before Orange Circuit Court Judge Stan Strickland. That means he wants to meet with the judge without prosecutors or the public present so "sensitive matters which are critical to the defense can be addressed," according to the document filed late Monday.

In the process of investigating the case, the defense claims they will need to obtain certain records, which could be used at trial. Baez doesn't want to prevent others from know about any theories.

And the items Baez is seeking cannot be obtained through normal discovery process, the legal process of prosecutors turning over investigative information about the case.

I could see what you were talking about, also.   It looks too big to be LA.   If it is a man, he looks heavy-set.  JMO.

In simple explanation, an insanity defense requires that a defendant was incapable of distinguishing the difference between right and wrong, that is the legal standard.    Additionally, in order to put forward an insanity defense, the defendant is in essence admitting they committed the crime & would be required to be evaluated by a battery of forensic psychiatric evaluations for determination, if proven usually committed to a psychiatric hospital.   There is a distinct difference between "insanity" versus mental disorder.   Mental disorders can become part of a defense to be shown as a mitigating factor in an attempt to plea for a lesser degree in charges, receiving a reduced sentence but cannot be argued as "not guilty by reason of insanity,"  at best it would show a diminished capacity but does not lift the burden of responsibility for the crime.    Note:   a more detailed legal opinion regarding the insanity defense would be best discussed with legal counsel & forensic psychiatrists that have vast experience dealing with such.

Casey has had psy evaluations but they are sealed with the court, she entered her plea as not guilty.   Apparently, her evaluations did not rise to the level of concern that she needed to be committed to a psychiatric hospital or it would have been discussed & done already.

Casey has exhibited an awareness of the crimes she has been charged with committing & has taken an active role in her defense.   Prior to arrest she went thru great lengths to conceal her crimes & there is evidence indicating that she acted premeditatedly.

Well, I should have added in my comments that he will not get his way with this.   Pooky's post explains why.    At the very least he can expect is that a judge may hear a motion in chambers with ALL parties present, meaning the defense team, the defendant, & the State.   The judge will never hold a meeting with either party in secret, no way.

I also want to add that this is a very good sign people, it shows he's desperate & stretching.   I also have a gut feeling he has been made aware of some rather damning evidence that he does NOT want made public, this is an attempt to prevent it.   NOT HAPPENING
