In letters written to her mother, the woman charged in the 2002 kidnapping of Elizabeth Smart has sought forgiveness for any pain she has caused and says she expects to spend the rest of her life in prison.

Wanda Eileen Barzee, 63, however, makes just one reference to Smart in the 12 letters obtained by The Associated Press. And she doesn't provide details about the nine months the girl allegedly spent with her and her now-estranged husband Brian David Mitchell.

The couple is charged with multiple felonies in state court and last year was indicted by a federal grand jury.

"In one of these letters, Wanda is remembering the sins that she did," said Barzee's mother, 88-year-old Dora Corbett, who provided letters sent between July 2008 and August 2009 to The AP. "She doesn't talk about it, she just remembers them and says she needs to repent of them."

But Barzee writes of repentance only when discussing her desire to be re-baptized in The Church of Jesus Christ of Latter-day Saints. In a June 21 letter, she recounts talking to a local church leader about the steps necessary to regain her membership, which includes making a full confession.

"He knows that Elizabeth Smart and I were victims of Brian," wrote Barzee, who was excommunicated by the church in 2002.

Smart's father, Ed Smart, said Barzee may be making progress, but she's not a victim.

"They're trying to build a case of sympathy on Wanda and I just don't have any sympathy for it," he said. "I think she has manipulated ... maybe not just as much (as Mitchell), but I believe that she is very, very culpable."

Barzee has twice been found incompetent for trial and is undergoing forced treatment with anti-psychotic medications. Doctors have said Barzee was delusional and believed she was hearing messages from God through the television. She's scheduled to appear in state court for a competency review on Oct. 23.
 
Barzee writes of the hearing, and says she imagines her social worker "has found me competent, but won't know for sure until I have been given another evaluation."

"Needless to say how nervous I am," she writes in an Aug. 11 letter. Her missives are written in small, disciplined cursive on lined yellow note paper and most are signed "Love forever, Wanda," followed by a chain of five tiny hand-drawn hearts.

Depending on the report from doctors, Barzee's case could proceed toward trial, she could be ordered to more treatment, or prosecutors could seek to have her civilly committed.

Scott Williams, Barzee's attorney, said he could not comment on the letters but said it was Corbett's right to share communications between her and her daughter.

Privacy laws prevent state officials from commenting about any patient at the hospital, Utah Department of Human Services spokeswoman Elizabeth Solis said.

Barzee was arrested March 12, 2003, walking the streets of a Salt Lake City suburb with Mitchell and Smart. That was nine months after Mitchell allegedly cut through a window screen at the Smarts' Salt Lake City home and whisked away the then-14-year-old Smart at knifepoint.

A one-time itinerant street preacher, Mitchell is said to have wanted Smart as a polygamous wife and may have taken her to fulfill a religious prophecy he laid out in a 27-page manifesto drafted in April 2002. Mitchell, 55, has also been found incompetent to stand trial. His state case is stalled, but a federal case against him continues.

"For the seriousness of my charges, and the number of five first-degree felonies, besides being federally charged, I am expecting to receive a life sentence in prison," Barzee wrote in an Aug. 11 letter to her mother.

"Unless I can obtain the plea of not guilty by reason of insanity which will enable me to stay here" at the Utah State Hospital, Barzee wrote.

Doctors at the state hospital, where Barzee has spent most of the last six years, began administering anti-psychotic drugs after an appeal of a 2006 forced medication order was rejected by the U.S. Supreme Court in May 2008.

Barzee had long refused medication for religious reasons. She maintains those objections in a July 29, 2008 letter, saying the medication she is forced to take "has not changed anything of my thought processes" and that it is her "constitutional right to worship the Lord God in how I choose to worship."

Corbett, however, believes the medication has put Barzee on a road to recovery and said the evidence is in the tone of Barzee's letters.

In the earliest years of incarceration, Barzee would reject letters and cards from Corbett, returning them after scrawling "no such person" on the envelopes. When Barzee did respond, many of her letters were signed, "Hephzibah Eladah Isaiah," the name Mitchell had given Barzee, Corbett said.

"Sometimes, she wouldn't even address me as mother," Corbett said.

But by April 14, 2009, Barzee writes that she was working with a social worker toward becoming competent, and she apologizes for any suffering she has caused her family and denounces the religious authority she once believed Mitchell held over her.

"For all the priesthood blessings given to me by Brian's hand where I have felt edified and at peace ... it is extremely difficult to imagine or comprehend how I was deceived and lied to," she wrote. "I am so sorry, Mother ... Can you forgive me?"

Seven years since she was abducted from her Salt Lake City bedroom by knifepoint, Elizabeth Smart will be in the same room on Thursday as her alleged kidnapper, Brian David Mitchell.

Smart, now 21, wanted to testify about her nine-month ordeal before she leaves on an 18-month mission to Paris for the Mormon church in early November. Although Mitchell's latest competency hearing isn't scheduled until Nov. 30, U.S. District Dale Kimball ruled Monday that Smart could testify early about her interactions with the self-avowed prophet, who allegedly wanted her as a plural wife.

Wants Justice Served
"It's not something she's looking forward to, but she wants to see justice served," says Smart's father, Ed Smart, who plans to accompany his daughter to court on Thursday. "It's been frustrating for all of us to see it drag on for so many years. Elizabeth has said to me a number of times, 'It's amazing how justice isn't being served. It's obvious that he did what he did - there is absolute evidence that he did what he did.'"
Federal defender Robert Steele says he has no problem with Elizabeth testifying, but he argued that the court should not allow her to give her opinion about Mitchell's sanity. The judge ruled on Monday that "none of Ms. Smart's proposed testimony suggests that she will be opining on anything other than her lay observations."

Ed Smart tells PEOPLE he believes that Mitchell is competent and is simply "manipulating the courts to the nth degree." "There's been no headway – we're ready to finally proceed," he says. "Let's get this done and move on."

Mitchell, who allegedly abducted Elizabeth late on the night of June 5, 2002, from the bed she shared with her younger sister, Mary Katherine, has been in and out of court for competency hearings since his arrest with alleged accomplice Wanda Barzee. The pair were found walking with Smart in a Salt Lake City suburb after living for several months in an abandoned trailer in Lakeside, Calif.

Forced to Wear Veil
At previous competency hearings, Mitchell has been removed from the courtroom for disrupting the proceedings by humming and singing religious hymns. Ed Smart hopes the same thing happens this time "so that he won't be able to see Elizabeth," he says. "Personally, though, I think he may sit there for a change and not say anything. Whatever happens, Elizabeth is prepared. It's amazing how strong she is."

It is expected that Elizabeth, who was forced to wear a white robe and veil and wasn't allowed to bathe or eat much more than bread during her months held captive, will answer questions from prosecutors and Mitchell's defense team for several hours.

"She's ready to tell what she knows and show that Mitchell knew exactly what he was doing," says her father. "Her comments to me have always been, 'Dad, there just really isn't question that he's guilty of what he did."

SALT LAKE CITY —  Elizabeth Smart testified Thursday that she was raped repeatedly by her alleged kidnapper Brian David Mitchell, whom she called "evil" in her first testimony since he is accused of holding her captive as one of his wives seven years ago.

The two did not see each other, though both were in court. Mitchell was removed from the courtroom before Smart arrived and taken to a holding cell where he could listen to the proceedings.

Smart, now 21, said Mitchell raped her for the first time right after her June 2002 abduction — which happened while the then 14-year-old girl was sleeping in her Salt Lake City home.

She testified that the rapes continued three to four times a day during her 9-month-long abduction, and she was told she would be killed if she yelled or tried to escape.

She described Mitchell as "evil, wicked, manipulative, stinky, slimy, selfish, not spiritual, not religious, not close to God."
It was Smart's first testimony about being snatched from her bedroom and held prisoner. She was on the stand in a competency hearing for Mitchell — who has twice before been deemed not fit for trial.

Mitchell is accused of abducting Smart from her bedroom while she slept and making her a polygamous wife to fulfill a religious prophecy.

The case attracted intense national and international media attention.

A judge ruled earlier this week that testimony from Smart, now 21, is relevant to the mental competency of Mitchell.

Smart was poised and composed while testifying for just under two hours.

She was abducted at knifepoint in the middle of the night. Smart said Mitchell then took her to a mountain camp and performed a ceremony she said was intended to marry the two.
"After that, he proceeded to rape me," Smart said.

She said he held her captive with a cable attached to her leg that had a 10-foot reach. That line was attached to another cable strung between two trees.

Smart said Mitchell plied her with alcohol and drugs to lower her resistance.

"He said that he would kill anybody that would come into the camp, or kill me if I ever tried to escape or yell out," Smart testified.

Smart said Mitchell was motivated by sex and used religion to get what he wanted.

Mitchell's defense attorneys had sought to limit Smart's testimony to her experiences with Mitchell, without her opinions about his mental state.

The defense objected to the 39 so-called "lay witnesses" proposed by prosecutors, including Mitchell's family, friends or workers at Utah State Hospital, because they lacked the expertise to evaluate competency.

In a ruling Monday, U.S. District Judge Dale Kimball rejected the argument as it relates to Smart, saying her testimony may help the court settle differences in the findings of experts who have evaluated Mitchell.
Experts have split opinions over Mitchell's competency and have relied on statements from others — including Smart — and past evaluations to prepare reports for the court. Kimball's ruling said Mitchell has been uncooperative with evaluators and refused to participate in diagnostic tests.

In the state court system, Mitchell was twice found incompetent to stand trial.

Mitchell and his estranged wife were found with the girl in March 2003, nine months after she vanished from her parents' house as her younger sister watched. Smart was rescued after a motorist who recognized her spotted her walking through a suburb with Mitchell and his estranged wife, Wanda Eileen Barzee.

Last year, Mitchell was indicted by a federal grand jury on charges of kidnapping and unlawful transportation of a minor.

After arguing with her, she eventually just proceeded to wash my feet and told me to change out of my pajamas into a robe type of garment. And when I refused she said if I didn't she would have Brian Mitchell come rip my pajamas off. I put the robe on in which he came and performed a ceremony which was to marry me to him. After that he proceeded to rape me.

Elizabeth Smart story provided all-too-rare happy ending


Too often, it seems, the world is filled with bad news. We've seen that this past week with the tsunami that hit the Samoas and the earthquake that killed hundreds in Indonesia. Events such as these are shocking. They were unexpected, so they caught people off guard. That's why they are considered to be news.

But every now and then, that shocking aspect of a story has a happy ending. Such was the case in March 2003 when, to the amazement of many, a girl named Elizabeth Smart was not only found, but found alive.

Smart's story made headlines in June 2002 when, at the age of 14, she was abducted from her families home in Salt Lake City. The rumor mill ran rampant with accusations of who took Elizabeth and why. At times during those days after the abduction, it was difficult to determine what was fact and what was fiction.

Police officers and everyday citizens were shown the teenagers face and asked to keep their eyes open for any sign of her. Eventually, volunteers searched parts of the Wasatch Front in hopes of finding her body.

Then, in March 2003, a motorist in a Salt Lake City suburb spotted Elizabeth and called authorities. Soon thereafter, Brian David Mitchell and his wife Wanda Eileen Barzee, were arrested. And, almost beyond the hopes of the people who followed the story for those nine months, Elizabeth was found alive.

It was a startling revelation, so much so that people found themselves re-reading the text scrolling across television screens and headlines on newspaper Web sites just to make sure they were seeing the words correctly. Newspapers across the nation published the photograph of Elizabeth, with a smile on her face, after she had been reunited with family members.

The wheels of justice have been stalled a bit for the past six years. Questions have been asked and court hearings conducted regarding the competence of Elizabeth's two alleged kidnappers. But Thursday, Elizabeth took the stand and testified about what happened to her in yet another competency hearing for Mitchell. She told the court that Mitchell repeatedly violated her and that he threatened to kill her if she yelled or tried to escape.

The details were horrifying. The public can only hope that the courts will provide justice and that if Mitchell did these horrible things that he will pay for his crimes.

Elizabeth Smart's story appears to be headed toward a positive ending. Now 21, she intends to leave soon on a mission for The Church of Jesus Christ of Latter-day Saints. She's experienced a form of hell on Earth, but she appears to have recuperated well.

Thankfully, we aren't left to deal with the aftermath of what may have happened had she not been found. Unfortunately, not all children are as lucky. According to the National Center for Missing and Exploited Children, more than 795,000 children are reported missing each year. More than 150,000 of those children were considered to be endangered, meaning there was cause to believe they would be harmed in some way.

Ultimately, Elizabeth Smart was found because of an everyday resident staying informed, vigilant and then acting when the person thought he or she had seen a child in danger. That person my have saved Elizabeth's life. At the least he or she helped get Elizabeth away from her abductors.

You might be that same guardian angel of sorts for another child simply by paying attention. That would result in another story with a positive ending.

SALT LAKE CITY - One of two people charged in the 2002 abduction of Elizabeth Smart pleaded guilty Tuesday to federal charges.

In a deal with prosecutors, Wanda Eileen Barzee entered the pleas to charges of kidnapping and unlawful transportation of a minor in U.S. District Court in Salt Lake City.

The 64-year-old Barzee could face a life sentence for the kidnapping charge and up to 15 years for the other count. It's unclear whether Barzee may get a reduced sentence in exchange for her plea.

Smart was 14 in 2002 when she was abducted from her bedroom at knifepoint and whisked away to a campsite in the mountains above her Salt Lake City home. She was recovered nine months later after a motorist saw her walking on a suburban street with Barzee and Barzee's now-estranged husband, Brian David Mitchell.

Barzee's role in the alleged abduction has garnered less attention than Mitchell's.

Testimony of polygamy, rape
At a hearing last month, Smart said that within hours of the abduction, Mitchell took her as a polygamous wife and then raped her. Smart said Barzee washed the teen's feet and dressed her in robes before the ceremony.

Smart described Mitchell as "evil, wicked, manipulative, stinky, slimy, selfish, not spiritual, not religious, not close to God."

She said he held her captive with a cable attached to her leg that had a 10-foot reach. That line was attached to another cable strung between two trees.

State cases filed in March 2003 against Barzee and Mitchell have been stymied by rulings that both were incompetent for trial. Barzee and Mitchell were indicted by a federal grand jury in March 2008.

Barzee's plea comes a month after a Utah State Hospital report to a state judge said that 15 months of court-ordered treatments with anti-psychotic medications had restored her competency.

Mitchell had also been found incompetent for trial in state court. A judge refused to order him to undergo forced medications.

On Nov. 30, Mitchell is scheduled for a 10-day competency hearing in his federal court case.

Prosecutors claim that a psychiatrist who evaluated Mitchell contends he is exaggerating or faking psychiatric symptoms to avoid prosecution.

Defense attorneys dispute the finding.

I just saw a quick snippet of this on HLN and only caught that she pleaded guilty and was getting 15 years - nothing about the possible life sentence.

Thank God she'll be getting more than 15 years....

Brian David Mitchell hospitalized after fall in jail cell

SALT LAKE CITY — Brian David Mitchell, the man accused of kidnapping Elizabeth Smart, spent two days in the hospital this week after falling in his jail cell and hitting his head.

Mitchell, 56, fell Monday while seated at the desk in his maximum-security cell at the Salt Lake County Jail, said Salt Lake County Sheriff's Lt. Mike DeNiro. Deputies were uncertain whether Mitchell struck his head on the floor or on the toilet in his cell.

The jail's medical staff examined Mitchell and decided he should be taken to University Hospital as a precaution.

Mitchell was guarded by the U.S. Marshals Service while he was hospitalized because he is a federal prisoner, DeNiro said. He was returned to the jail Thursday.

DeNiro, who worked in maximum security for the past two years, said he was not aware of Mitchell being hospitalized for any other medical incidents during his incarceration.

Mitchell is accused of kidnapping and raping Elizabeth Smart in 2002, taking her to California and then returning to Utah where he was arrested in 2003. A 10-day hearing to determine whether Mitchell is competent to stand trial was held in early December. A ruling from that hearing is expected in February or March.

SALT LAKE CITY (AP) - A federal judge on Friday ordered a woman who pleaded guilty to kidnapping Elizabeth Smart to spend 15 years in prison, with credit for about seven years she's already served.

U.S. District Judge Dale Kimball said Wanda Barzee will serve the sentence at the Federal Medical Center, Carswell, in Fort Worth, Texas.

Barzee, 64, pleaded guilty in November to federal charges of kidnapping and unlawful transportation of a minor across state lines in Smart's abduction. She also faces sentencing Friday in state court, where in February she pleaded guilty, but mentally ill, in the attempted kidnapping of Smart's cousin, Olivia Wright, about six weeks after Smart's abduction.

Barzee has agreed to testify in pending state and federal cases against her now-estranged husband, Brian David Mitchell.

Smart was 14 in 2002 when she was kidnapped at knifepoint from her bedroom. She was found nine months later, in March 2003, walking the streets of a Salt Lake City suburb with Barzee and Mitchell.

"I know the gravity of my crimes and how serious they are," Barzee said in court Friday. "I'm just so sorry again for all the pain and suffering I caused upon the Smart family."

Kimball also ordered Barzee to serve five years' probation and register as a sex offender. Barzee will be about 70 when she's released from prison.

Elizabeth's mother, Lois Smart, spoke in court for the first time ever Friday.

"Wanda, what you did to our family and to our girl Elizabeth was wrong," Lois Smart said directly to Barzee. "It was wrong and it was evil. ... Wanda, we suffered, but more than that, Elizabeth suffered. She was tortured and tormented."

Smart, now 22, is serving a mission for The Church of Jesus Christ of Latter-day Saints in Paris.

Barzee's cases have been repeatedly delayed because she was twice deemed incompetent to stand trial.

Barzee was court-ordered by a state judge to undergo treatment with anti-psychoctic medications, and last fall doctors at the Utah State Hospital said her competency had been restored. The finding prompted plea negotiations with state and federal prosecutors.

Mitchell, 56, is scheduled for a federal court trial beginning Nov. 1. A state case has been stalled because Mitchell was also deemed incompetent for trial. A state judge declined to order forced medication in his case.

At a federal court hearing last year, Smart said she was taken from her home to a mountain campsite where she was forced into a polygamous marriage with Mitchell and endured repeated rapes and other abuse. She was held captive for nine months.

Elizabeth Smart's kidnapper gets 15 years

(CNN) -- A woman who admitted her role in Utah teen Elizabeth Smart's 2002 kidnapping was sentenced Friday to 15 years in federal prison.

Wanda Eileen Barzee, 64, was given credit for several years that she already has served, a spokeswoman for the U.S. attorney in Utah said.

Federal prosecutors asked for the 15-year sentence under a plea agreement in which Barzee will cooperate in the prosecution of her husband, Brian David Mitchell. He is awaiting trial.

Barzee will be sentenced this afternoon for an attempt to snatch Smart's cousin a month later.

Barzee pleaded guilty in November to federal charges of kidnapping and unlawful transportation of a minor in Smart's kidnapping. It is the federal case that exposes her to the most prison time.

Barzee and Mitchell were accused of abducting Smart, then 14, at knifepoint from her bedroom in her family's Salt Lake City, Utah, home in June 2002. Smart was found nine months later, walking down a street in the Salt Lake City suburb of Sandy in the company of Barzee and Mitchell, a drifter and self-described prophet who calls himself Emmanuel and had done some handyman work at the Smarts' home.

Federal prosecutors have recommended Barzee be sentenced to 15 years in prison in exchange for cooperation against Mitchell.

In state court in February, Barzee pleaded guilty but mentally ill to one count of conspiracy to commit aggravated kidnapping in the attempted kidnapping of Smart's cousin. In exchange for her plea, prosecutors dropped state charges against her in Smart's abduction, said Nancy Volmer, spokeswoman for Utah state courts.

The month after Smart was kidnapped, prosecutors alleged, Barzee and Mitchell attempted to break into the home of her cousin, but were unsuccessful. The girl was 15 years old at the time, according to CNN affiliate KSL-TV. She is not named in court documents.

"Mr. Mitchell's attempt was thwarted when the minor child awakened, which caused Mr. Mitchell to flee," the court documents say.

After her arrest in 2003, Barzee told authorities that she and Mitchell went to the home to abduct the girl, and planned to hold her, along with Smart, in the couple's camp in the mountains, according to court documents.

Although Barzee faces up to years in state sentence to run concurrently with her federal sentence if she cooperates with the case against Mitchell, said Mark Biljanic, spokesman for the Salt Lake County district attorney's office.

The federal sentencing will be held first Friday, at 10:30 a.m., followed by the state court sentencing at 1 p.m.

When she pleaded guilty to Smart's kidnapping in federal court, Barzee apologized to Smart, according to a transcript.

"I'm greatly humbled as I realize how much Elizabeth Smart has been victimized and the role I played in it," she said. "I'm so sorry, Elizabeth, for all the pain and suffering I have caused you and your family. It is my hope that you will be able to find it in your heart to forgive me one day."

Barzee had been housed at the Utah State Hospital while courts determined her competency as well as Mitchell's. After years of being declared incompetent, she recently was declared competent to stand trial, according to the Salt Lake Tribune newspaper. A state court had ruled she could be forcibly medicated, and that ruling led federal prosecutors to proceed with bringing a case against the couple, the Tribune said.

At a competency hearing for Mitchell in October, Smart, now 21, testified that she had been held captive in Utah and California. Just after her abduction, Mitchell took her to a wooded area behind her home and performed a mock marriage ceremony with her, she said. During the nine months of her captivity, Smart testified, no 24-hour period passed without her being raped by Mitchell.

In March, U.S. District Judge Dale Kimball ruled Mitchell competent to stand trial. His federal trial is set to begin November 1. State court proceedings against him are on hold pending the outcome of the federal case.

Utah’s Elizabeth Smart kidnapping trial was interrupted just after it had started when the U.S. Court of Appeals for the 10th Circuit agreed to review jury selection, says the Salt Lake Tribune. Attorneys for homeless street preacher Brian David Mitchell’s argue that the jury seated yesterday has already assumed his guilt of kidnapping then 14-year-old Smart in 2002.
“I have never heard of a case where that’s happened,” said University of Utah law professor and former federal judge Paul Cassell of the timing. “The fact that they stayed a trial shows they’re thinking about it.” Prosecutors argued that six potential jurors the defense  identified as showing “actual bias,” were “not actually seated on the jury,” and were only part of the panel of 32 from which the jury was selected. The defense says the case should be moved to a different venue if it was determined Mitchell could not receive a fair trial in Utah.

Elizabeth Smart described in court today a deranged life on the lam with a kidnapper who was an alcoholic, who loved porn, and would rape her in a tent he called the Altar of Emanuel.
During her nine month nightmare with accused kidnapper Brian David Mitchell, Smart says she was not only raped repeatedly but was fed garbage, forced to drink alcohol and do drugs, and when she got sick would be forced to sleep in her own vomit.

Smart also says that Mitchell was constantly on the lookout for other girls to kidnap and make his wives, even targeting Smart's cousin.

Smart, now 23, testified for a second day in the trial that she believes her own mention of her cousin Olivia Wright - whom she described as her "closest friend at the time" - spurred Mitchell's interest in the teen.

"I would just mostly talk about times we shared together because she was one of my closest friends at the time. He would act interesting and engaging, but I didn't think anything else about it at the time," said Smart. "Then he prepared to go down to Salt Lake and kidnap my cousin."

"I watched him pack the green bags that he had used to kidnap me," Smart told the courtroom, matter-of-factly. "I saw him pack into the green bags some change of clothing, different ropes. I saw him pack duct tape, I saw him pack a knife."

The knife believed to have been used by Mitchell was passed around members of the jury for inspection while Smart, who was just 14 at the time she was abducted, testified.

It's been eight years since Smart was snatched from her bed in Salt Lake City and forced to spend nine months on the run. After passersby reported spotting Smart in a Salt Lake City suburb, authorities arrested Mitchell and Wanda Barzee, charging them with Smart's kidnapping and sexual assault.
Now living in Paris while she works on a Latter Day Saints mission, Smart maintained her composure on the stand again today, appearing calm and collected, showing very little emotion while providing details of her nightmare, her strategy for survival, and a missed chance at being rescued.

Smart testified that Mitchell even dressed in the same clothes to go get her cousin as he had the night she was kidnapped.

"It was dark clothing. It was the same clothing he used to kidnap me," said Smart. "Stocking cap, gloves, dark shirt, sweats."

"He said that he was going to try the same way he kidnapped me and then he would take her back up into the canyon and hike over the mountains until they came to the canyon we were in," Smart.

Smart would later learn from Mitchell that his play went awry upon arriving at Wright's house. When trying to sneak into an open window, the blinds hit some objects on the ledge and he got scared.
"He came back and he said that we weren't ready to receive another wife yet," Smart said.

Mitchell failed at another kidnapping attempt when the trio moved to California, according to Smart, who remembers the bus ride from Utah as nearly 14 hours long.

Upon arrival, Mitchell set up a new camp near a lake that was also home to many homeless camps, according to Smart.

"He raped me within 24 hours of arriving in California," said Smart.

Mitchell also forced her to look at a pornography magazine, one of many he would bring into their camp.

"He said that he'd received a revelation, been instructed to look at pornography," said Smart. "He said that we all needed to look at it."

Mitchell prepared to kidnap the daughter of a family he met at a Mormon church in San Diego, making sure that there was enough bedding for her to be able to have her own place to sleep, said Smart. Mitchell took the same green bag of kidnapping tools with him, she recalled.

When he returned without the girl, Smart said Mitchell told her, "That we were not prepared enough to receive another wife and that our faith needed to be stronger."

Mitchell also told her that a person snoring in the house had moved when he opened the door and he had been scared away.
At one point, Mitchell showed Smart a newspaper clipping with her parents photo and asked her if she was surprised they hadn't given up, according to Smith.

SALT LAKE CITY — The man accused of abducting Elizabeth Smart was a crude, vulgar, self-serving person who used religion to justify his actions, including her kidnapping and rape, she told jurors on her third and final day of testimony.

Smart gave a spirited rejection of Brian David Mitchell's defense contention that he suffers from an escalating mental illness and holds extreme religious beliefs that lead him to think he is directed by God.

Smart called him a hypocrite.

"He was his number one priority, followed by sex, drugs and alcohol, but he used religion in all of those aspects to justify everything," Smart said in a clear voice, confidently expressing her own religious knowledge.

Mitchell, 57, is charged in federal court with kidnapping and unlawful transportation of a minor across state lines. If convicted, he faces a life sentence.

(Reuters) - The woman convicted of helping her husband kidnap  Elizabeth Smart broke into tears on the witness stand on Thursday as she told jurors her marriage to the homeless street preacher was "hellish."

Wanda Barzee, who is serving a 15-year sentence for her role in Smart's 2002 abduction and was brought into court in shackles and prison garb, portrayed Brian David Mitchell as controlling, possessive and dominating.

Asked by a defense attorney to characterize her first year of marriage to Mitchell, she responded: "It was hellish."

Barzee said things improved somewhat when she became more submissive and obedient to Mitchell, but that he remained prone to bouts of fury or tears, sometimes screaming into a pillow.

"He would have these anger outbursts," she said. "He would leave the house and come back and apologize saying that he was sorry he nearly destroyed me."

Mitchell, 57, is charged with kidnapping Smart, who was then 14, from her Salt Lake City home on June 5, 2002 with the intent of forcing her to live as his young bride.

Barzee, 64, pleaded guilty to kidnapping and unlawful transportation of a minor and was sentenced in May to 15 years in prison.

As part of her plea agreement she is cooperating with authorities.

Prosecutors declined to call Barzee as a witness before resting their case earlier this week, but she was put on the stand by defense attorneys -- who are expected to argue Mitchell was insane at the time of Smart's kidnapping.

As he has on most days, U.S. District Judge Dale Kimball ordered Mitchell removed from court after the defendant refused to stop loudly singing hymns and Christmas Carols.

'WEIRDER AND WEIRDER'

In often emotional testimony, Barzee said she met Mitchell in 1985 at a Mormon church, during a group counseling session while they were both going through divorce, and married him nine months later.

She described her now-estranged husband as "consumed with fear and doubt" and angry over his first marriage, saying they had trouble communicating and fought often until she became more submissive.

Barzee said Mitchell criticized her for watching television and made her throw darts at a picture of her ex-husband.

In the 1990s, she said, Mitchell decided they should no longer be affiliated with organized religion. The couple ultimately sold their belongings and began traveling across the country, pulling a cart that they built by hand, so he could spread their beliefs and she could play organ recitals, often in nearly empty halls and auditoriums.
Barzee's testimony ended for the day before she could be asked about the details of Smart's kidnapping.

During the morning court session, Mitchell's brother told jurors that five years before Smart was abducted he began worrying his sibling was becoming "increasingly emotionally disturbed."

Tim Mitchell, a 50-year-old mental health counselor, testified that after his older brother, Brian David Mitchell, began demanding his family call him "Daveed," he wrote to him encouraging him to get help.

"He's just getting weirder and weirder," Tim Mitchell recalled thinking.

Smart, now 23, has returned to Utah from Paris for the trial, where she is on a mission for the Mormon church, and has watched the proceedings from the courthouse gallery, surrounded by family members.

She testified during the prosecution case that Mitchell kidnapped her at knife-point from the bed she shared with her sister Mary Katherine, marched her several miles into the foothills above her Salt Lake City home and raped her.

Smart said her time with Mitchell and Barzee as "nine months of hell," during which she was raped nearly every day.

Smart's baffling disappearance made international headlines in 2002, and the search for the missing 14-year-old girl gripped much of America.

She was ultimately rescued after passersby spotted her walking with Mitchell and Barzee on a street in the Salt Lake City suburb of Sandy.

Brian David Mitchell collapsed as Tuesday’s session of his federal kidnapping trial got under way.

Mitchell, who is usually escorted from court after he begins singing hymns, yelled out in a strangled voice about 8:50 a.m., ending up beneath the defense table. His attorneys then shouted for EMTs, saying he appeared to have suffered a seizure.

He was conscious and alert while being taken to University Hospital, but further updates on his condition were not available.

The jury had not yet been seated. They were told simply that an issue came up and asked to return on Wednesday.

Mitchell, 57, is on trial for the 2002 kidnapping of Elizabeth Smart. Defense attorneys have been trying to convince jurors that their client is legally insane.
Mitchell entered the courtroom singing “O Holy Night.” Moments later, after U.S. Judge Dale Kimball was talking to prosecutors and defense lawyers about reading a statement to jurors that apparently would inform them about Mitchell’s 2005 mental competency proceedings in state court, Mitchell went into seizure.

As Kimball was explaining his decision, Mitchell stopped singing and dropped his head for a few moments. Defense attorney Wendy Lewis locked eyes with him and then he flailed back, making a loud bleating sound. He then fell to the left and his head came back.

At 8:40 a.m., Lewis told the judge, “He’s having a seizure your honor.”

Then Lewis and a U.S. Marshal laid the defendant onto the floor.

“You might want to take him out and see if he needs medical [assistance],” Kimball said.

A marshal called 911. There was no sound for a minute or two, and then Mitchell could be heard breathing heavily.

Elizabeth Smart, visibly upset, stormed out of the courtroom Wednesday at the trial of her accused kidnapper.

Smart left the courtroom during the testimony of Dr. Paul Whitehead, a forensic psychiatrist at the state mental hospital who treated Brian David Mitchell from 2005 to 2008. Whitehead, who is a witness for the defense, was asked about Mitchell seeking to have children with Smart.

Mitchell, 57, was back in the courtroom this morning after suffering an apparent seizure Tuesday.

The homeless street preacher is accused of kidnapping then-14-year-old Elizabeth Smart from her bedroom back in 2002. Now 23, she testified that she was held captive for nine months and raped nearly every day.

UPDATE at 12:37 p.m.: Under more cross-examination, Dr. Paul Whitehead testified about Brian David Mitchell's life at the Utah State Hospital.

"It's your opinion that his degree of conviction in his beliefs is moderate?" prosecutor Alicia Cook said.

"We saw some change, we did think it was on a moderate level," Whitehead replied.

Mitchell's beliefs were not 100-percent fixed and Whitehead acknowledged doubt in Mitchell leading up to the kidnapping, Cook noted.

Mitchell's beliefs were bizarre, Whitehead said, such as Barzee giving birth in her 60s despite having had a hysterectomy.

"I thought the majority of evidence was that it wasn't particularly bizarre," he said.

Cook asked if Mitchell has extreme religious beliefs, not necessarily mental illness.

"I think if you just say it's a guy with extreme beliefs much as people who commit terrorist acts on behalf of an organization, I would say that's not mental illness," Whitehead said.

Cook asked about Mitchell changing his appearance based upon his friendship with a fellow patient at the Utah State Hospital. He also made efforts to make amends with his family.

"It was weird. It was a change," Whitehead said.

Asked about it, Whitehead said that Mitchell believed that people could change and "prophets" are imperfect people.

"He was basically saying we can all learn and we can all change and evolve," Whitehead said.

After more questioning, the judge called for a break.

UPDATE at 11:59 a.m.: As Dr. Paul Whitehead was testifying about Mitchell's desire to bear children with Elizabeth Smart, she became visibly upset.

SALT LAKE CITY (CBS/AP) The federal jury in the Elizabeth Smart kidnapping case returned guilty verdicts on both counts against street preacher Brian David Mitchell: kidnapping and unlawful transportation of a minor across state lines for the purposes of illegal sex.
The jury rejected the defense's insanity claims less than 12 hours after beginning deliberations.

Mitchell faces a possible sentence of life in prison.

The jury started deliberating just after 5:30 p.m. Thursday and deliberated for a little over three hours before adjourning for the night. Court officials  announced jurors had reached their verdict just after 10:30 a.m. Friday.

The facts of the case were undisputed - even Mitchell's attorneys say there's no question he kidnapped Smart and raped her almost daily until she was found nine months later, walking a suburban street with Mitchell and his now-estranged wife.

At issue was whether Mitchell could be held legally responsible for his crimes.

Defense attorneys argued that Mitchell suffers from a delusional disorder that prevents him from realizing right from wrong.

Prosecutors  painted an altogether different picture of an anti-social psychopath who used the illusion of mental illness and religious fervor to get people to do what he wanted and to manipulate others' perception of him.

Salt Lake City, UT -- Elizabeth Smart is home from her LDS Mission in France enjoying time with her family. But soon she will be back in the national spotlight. On May 25th, she plans to speak during the sentencing hearing for her kidnapper Brian David Mitchell.

Her goal is to not only speak for her case, but also other victims of crime like her.

"I hope it gives others hope that they can speak out and not be scared to face their captor," said Elizabeth.

A federal judge Wednesday sentenced the man who kidnapped Elizabeth Smart to life in prison, prosecutors said.

"We believe it is an appropriate, just and long overdue result for our community, for the Smart family and of course, most importantly, Elizabeth," said Carlie Christensen, acting U.S. district attorney in Utah.

A jury found Brian David Mitchell guilty in December of kidnapping Smart in 2002 and transporting the 14-year-old girl across state lines with the intent to engage in sexual activity.

"Mitchell's heinous conduct, the evidence of his propensity to reoffend mandated such a sentence," Christensen said.

Beaming before a group of reporters gathered outside the federal courthouse, Smart, now 23, said she was "thrilled" with the sentence.

One of the two people convicted in the 2002 kidnapping of Elizabeth Smart has been denied parole and will remain in the Utah State Prison until at least 2023.

Wanda Barzee, 72, is serving up to 15 years in state prison for a plot she and her husband, Brian David Mitchell, had to kidnap Smart’s cousin in July 2002, about a month after they abducted the then-14-year-old Smart from her bedroom. According to the Salt Lake Tribune, Barzee was released from a federal prison in Texas in 2016, having completed her sentence for kidnapping Smart.

The Utah Board of Pardons & Parole determined in their decision, which was released Tuesday, that Barzee’s time in federal prison will not count as time served toward her state prison sentence, the Tribune reported. She served only eight years of a 15-year federal sentence because the judge who sentenced her in 2010 gave her credit for seven years already served.

If Barzee serves the entire 15 years of her state sentence, she will be released in 2024. Her next parole hearing is slated for a year before her sentence ends.

Last month’s parole hearing was Barzee’s first, but the inmate refused to attend, FOX13 in Salt Lake City reported. She has also refused to participate in psychological exams that are mandatory for her to achieve an early release.

“That has not been done to date,” Angela Micklos, a member of the parole board, told the news station last month.  

Psychological evaluations are required in the case because Barzee pleaded guilty but mentally ill to the attempted kidnapping charge. The Tribune reported that if mental health experts had given positive evaluations of Barzee, the Smart family would not have objected to her release.

Like Barzee, Elizabeth Smart did not attend the hearing, but her father, Ed Smart, got to the hearing after it had already concluded, FOX13 reported. He told reporters that he believes Barzee is still loyal to her husband, whom she helped abduct Elizabeth Smart so the teen could serve as a “sister wife” for Mitchell.

“I recently heard she’s still following Mitchell,” Ed Smart said. “(She) carries around his little bitty Bible and her refusal to come today seems like an indicator that she’s still of the same mindset she was at the time she took Elizabeth.”

Elizabeth Smart remained missing for nine months before a sharp-eyed witness spotted her with Mitchell and Barzee in Sandy, a city just about 20 miles from the Smart home in Salt Lake City. She later testified that she was kept tied up and was repeatedly sexually assaulted by Mitchell.

Mitchell also threatened to kill her and her family if she attempted to escape.

Mitchell was not unknown to the teen, but she knew him as Immanuel, a local homeless man who her father once hired to do work on the family’s house. Smart’s then-9-year-old sister, who witnessed the abduction, realized months after the kidnapping who her sister’s abductor was and the family alerted authorities.

Smart was found with Mitchell and Barzee a few weeks later, ABC News reported in 2005.

Mitchell was sentenced to life in federal prison in 2011 following years of delays in the case because he was found mentally unfit to stand trial. When his trial was able to proceed, he repeatedly had to be removed from the courtroom because he would break out in song, CBS News reported.  

Smart, now 30, is an author and activist for child safety, according to her website. She and her husband have two children.

The surprise move announced Tuesday comes after authorities determined they had miscalculated the time 72-year-old Wanda Barzee previously served in federal custody.


Barzee pleaded guilty to kidnapping Smart and helping keep her captive for nine months before Smart was found and rescued.

Utah Board of Pardons and Parole spokesman Greg Johnson said Barzee will be freed on Sept. 19. She will be under federal supervision for five years.

Smart, now 30, didn’t immediately have comment. The board said previously that Barzee would be released in January 2024 after it denied her an early parole following a hearing that she chose not to attend.
