Wicomico authorities question suspect about missing 11-year-old girl

SALISBURY — A suspect is in police custody for questioning about the disappearance of an 11-year-old girl missing in the Salisbury area since Tuesday.

Wicomico County Sheriff Mike Lewis said Wednesday afternoon that the male suspect lives in the Salisbury area. The suspect has not been formally charged, although Lewis said that "he is the only suspect at this time."


Meanwhile, the Wicomico Bureau of Investigation continues to search by air and ground for Sarah Haley Foxwell who was last seen Tuesday night at her house in the 31000 block of Old Ocean City Road. She is 4-foot and 8-inches tall and has brown hair that is often worn in a ponytail.

Police say she was last seen wearing red, fuzzy pajama bottoms with Christmas trees on them, and a pink John Deere T-Shirt.


Police ask anyone with information about her disappearance to contact the Sheriff's Office at 410-548-4891.

SALISBURY,Md.- The Wicomico County Bureau of Investigations says a suspect is in custody in connection with the disappearance of an 11-year-old Salisbury girl. Police are still searching for the child, identified as Sarah Haley Foxwell.

Police say Sarah was last seen at her home on the 31000 block of Old Ocean City Road on Tuesday night. She was wearing red fuzzy pajama bottoms with Christmas trees on them and a John Deere T-shirt.

According to the Wicomico County Sheriff's Office, a man who initially was considered a person of interest is now a suspect in Foxwell's disappearance. He is now in police custody. Police have not yet named him.

An Amber alert has been issued for Sarah, and a search for the child- which includes the utilization of K-9 units and a helicopter- is being conducted in the area between Zion and Zion Church roads.

Sarah is described as white, brown hair that is worn in a ponytail, blue eyes, 4-foot-8, 78 pounds. Her date of birth is May 18, 1998.

  SALISBURY, Md. – The Wicomico County (Md.) Sheriff's Office has charged a 30-year-old Salisbury man in the disappearance of an 11-year-old girl who is still missing.

Delaware State Police have joined Maryland authorities and volunteers in the search for 11-year-old Sarah Haley Foxwell.

Sheriff Mike Lewis announced Wednesday night that family acquaintance Thomas James Leggs of Salisbury, a registered sex offender, has been charged with kidnapping and burglary.

Dive teams searched a local pond Wednesday night and law enforcement agencies from across the region are continuing the search today, helping the sheriff's office search for Foxwell in several square miles of dense woods

Foxwell was last seen in Christmas-themed pajamas inside her Old Ocean City Road residence about 9:30 p.m. the day before, and by Wednesday evening her disappearance had been re-classified from a "missing person" investigation to a "non-family abduction," said Lt. Babe Wilson of the Wicomico County Sheriff's Office.

Several dozen police officers were joined by volunteers from as far as the western shore and northern Delaware, who searched in freezing nighttime temperatures Wednesday as authorities questioned Leggs at the Sheriff's Office.

Earlier Wednesday, the search focused on a radius about three miles in either direction of the girl's residence, Wilson said.

A police command center was established about noon Wednesday at a church on Zion Road at Zion Church Road, a location that is central to the residences of both the girl and Leggs, Lewis had said.

Details about Leggs' conviction for a sex crime were not immediately available, Lewis said.

A national Amber Alert about the 4-foot 8-inch tall Foxwell also was issued.

By early evening, scores of both law enforcement personnel, local Good Samaritans and professional volunteers from outside the area had either joined the search or were on standby to help. Police helicopters from both Maryland and Delaware state police agencies joined, as did the Maryland Natural Resources Police Search and Rescue, Salisbury Police Department, Worcester Sheriff's Office and Delmarva and East Coast K-9 search and rescue units.

"Everybody is offering," Wilson said outside the command center. "(Police) officers from Fruitland, Delmar, Ocean City have contacted us."

Police ask anyone with information about Foxwell's disappearance to contact the Sheriff's Office at 410-548-4891.

SALISBURY — The search for a missing Wicomico County girl continues with fervor today.

Police have moved their command center from a church on Zion Road to Arthur W. Perdue Stadium.

Three helicopters continue to canvass from the sky and divers are searching the lake behind Village at Parsons Lake neighborhood.The pond in front of the former Powerwaves building at Walston Switch Road has been completely searched with no results, police said.

Individuals from throughout the state have come to help search on foot.

Sarah Haley Foxwell, 11, was announced missing yesterday afternoon. Police said she had been last seen on Tuesday night at 10 p.m. The status shortly changed from missing to abducted and a suspect was taken into custody.

Thomas James Leggs, a 30-year-old registered sex offender who lives with his parents off Bennett Road in eastern Wicomico County, was taken into custody but has not helped police in locating the child.

Police plan to hold another news conference at the stadium at 2 p.m.

Bennett Road where the sicko lives is not far from the residence of this precious child.
There is still snow on the ground and bitterly cold, in the 20s at night.  It doesn't sound good for this child.
How can a SO be a "family" friend?  Maybe they didn't know.  I hope that is the case.

Salisbury, MD - The search has resumed for missing Sarah Foxwell. The 11-year-old was last seen Tuesday night at her home on Old Ocean City Road. Police say 300 people are actively looking in 25 locations, both on the ground and from the air. The search has expanded several miles since yesterday spreading west across Wicomico County. Police say that's because of new information they received this morning.

"We will continue to search until we find Sarah Foxwell. We will not surrender, we will not give up. We will be here as long as it takes to find her," said Wicomico County Sheriff Mike Lewis.

SALISBURY, Md. — Police in Maryland were searching Christmas Eve for a missing 11-year-old girl last seen wearing fuzzy Christmas pajamas, and they have charged a registered child sex offender in her disappearance.

Thomas J. Leggs Jr. of Salisbury, 30, is charged with burglary and with kidnapping Sarah H. Foxwell, according to court documents.

Wicomico County Sheriff Mike Lewis said Sarah was last seen Tuesday night at her home on Maryland's Eastern Shore. A relative discovered she was missing early Wednesday while checking on Sarah and her 6-year-old sister.

"She wasn't in her room," Lewis said. He said there was no evidence of forced entry to the home where the girls live with their aunt, who is their legal guardian.

Dive teams searched a local pond Wednesday night, and scores of police officers from across the region scoured several square miles of dense woods on Christmas Eve. They brought in helicopters and dogs to aid their search.

Police also released a photograph of a 2003 Dodge Ram 1500 pickup used by Leggs and they asked anyone who may have seen the champagne/tan-colored vehicle to contact authorities.

Sarah is white, 4-foot-8 and weighs 78 pounds. She has brown hair and blue eyes. When she disappeared, she was wearing red fuzzy pajama bottoms with Christmas trees on them and a pink John Deere T-shirt.

"I will tell you this: We have not given up hope and we will continue to search all day today and throughout the night," Lewis said. "We won't go home until we find this little girl."

Leggs, a former boyfriend of the aunt, is being held at the Wicomico County Detention Center without bail, Lewis said. He is being represented by the public defender's office, which did not immediately return a call seeking comment.

Leggs is listed on the Maryland and Delaware sex offender registries. The Maryland listing notes that he is a child sex offender, but does not give details about his conviction.

Lewis said Leggs has been convicted of sex offense in Wicomico County and was charged Oct. 29 with fourth-degree burglary.

"He was developed as a suspect early on in the investigation before we were aware of his criminal background, but he does have a criminal history to include third- and fourth-degree sex offenses of small young females," Lewis said.

In 2001, Leggs was convicted in Delaware of rape for having sex with a victim who was 16 or 17, according to the Delaware registry. The registry describes his risk level as "high" and notes he is unemployed.

Leggs, who has been convicted of assault several times, also is awaiting trial on charges of burglary and destruction of property in Ocean City.

I can't believe this.  Right before Christmas of all times.  My heart goes out to this little girl.  I pray and pray and pray that she is found safe.  But I don't think that's going to be the case.  I read about the perp that has been charged.  He's a hardened criminal with non conscience. I say we string him up by his toes and all take turns hitting him like a pinata.  Better yet, use his private parts instead of his toes.

SALISBURY — Despite rumors the body of a missing Wicomico County girl was found in a pond near The Centre at Salisbury, officials said nothing has been recovered.

Maryland State Police Salisbury barrack commander Ernie Leatherbury said the body has not been found.

Leroy, Pocomoke is about 20 miles south of Salisbury.
Salisbury is in Wicomico County, Pocomoke is in Worcester.
Wicomico is the hub, south is Somerset County which abuts the southernly end of Worcester county and Wicomico County abuts Worcester to the east, which is then on the Atlantic coast.
To the west of Wicomico County is Dorchester County and to the north is Delaware, ie Sussex County.  Where they are searching is about 7 miles from the Delaware line.

Salisbury, MD - Eleven year old Sarah Foxwell remains missing. More than 300 searchers have canvassed the county looking for Sarah today. At a press conference tonight Wicomico County Sheriff says 60 separate searches were conducted today. He says the man they have in custody Thomas Leggs Jr. is charged with Foxwell's kidnapping. And that Leggs Jr. Remains uncooperative and has not helped with the investigation.

"You bet this remains a search and rescue tonight. We have hope. Dive teams have been with us, they continue to do dives for us," said Wicomico County Sheriff Mike Lewis.

Earlier today a private moat-like pond off of Rum Ridge Road was the scene of a K-9 unit. Around 4 p.m. police were waiting for a diver but at that point time was once again an issue because there were only a few hours of day light left. At the same time a diver was called WMDT's crews were pushed back. The dive team arrived at five p.m.

Police are now at the point where they will accept help from the public in the search starting at 7am Christmas Day. You should go to Perdue Stadium however there are no guarantees you will be able to physically help in search through the woods. You should wear water gear and many layers of warm clothing.

wonder if they really KNOW a "reason" to dive in the ponds, or are they just doing it because the ponds are there.

what I am getting at is... if they believe she might be alive, then she could be ANYWHERE. 

I am digging for connections on this guy to see where all he might have taken her "IF" it was in fact thomas leggs who took her somewhere... being her sister said she left with him he most likely did take her and they found a toothbrush like her's in the truck he was driving...

WHERE would he take her is the question... and if she is alive... where is she now... this is what I am trying to concentrate on.... time is of essense here... if there are places this guy frequents we need to be finding those places... if he has connects/ family/ friends etc... we need to know who and where they are.. where does this guy hang out etc...

Ok, rub it in because I am freezing.  There is still snow on the ground here and hundreds of miles of back roads.  Worcester County, the county east where Ocean City is has more back roads (no line down the middle) than just about any county in the state.

    I was there as well. I was overwhelmed by something that stood out. I saw people show up with candles and no way to light them. Then I saw strangers turn toward these people and use their candles to light those of people with whom they were unfamiliar. This happened time and time again. Kind of insignificant at first but it reminded me of why we were there. We took the light from the fire of hope in our hearts and lit the fire of hope in the hearts of others we didn't know. In that instant we were kindred spirits. No darkness can put out the fire of hope because hope spreads from one heart to another. All we have to do is keep our faith.The faith of those present last night built the fire of hope and passed it along from one person to another until the darkness of despair was gone. All that remained was the hope that we will find this little girl and the faith in God to give us the strength to carry on.

SALISBURY — - More than 200 officers and volunteers scoured frozen fields and ponds Christmas Eve for an 11-year-old girl who police say was kidnapped from her bedroom by a registered sex offender.

Sarah Haley Foxwell was wearing a pink shirt and red pajamas printed with Christmas trees when she disappeared from her maternal aunt's home Tuesday night, police said. A younger sister awoke during the night to see Sarah leave the room with their aunt's former boyfriend, a registered sex offender, according to court documents obtained by The Baltimore Sun.

Thomas James Leggs Jr., 30, who lived in a building on the grounds of his parents' Salisbury home, was arrested Wednesday and charged with burglary and kidnapping in Sarah's disappearance, police said.

Leggs, who is listed on sex offender registries in Maryland and Delaware, was not cooperating with police, said Sgt. Charsten Wendlandt of the Wicomico County Sheriff's Office.

Wicomico County Sheriff Mike Lewis said Thursday night that authorities were still regarding their task as a search and rescue, and he said the effort would continue throughout the night. "We have not lost hope," he said.

As relatives and friends gathered for a Christmas Eve candlelight vigil at an elementary school, an aunt said she prayed that the girl she called "Haley Bug" would be found unharmed.

Sarah, a sixth-grade student at Wicomico Middle School, is a bright and lighthearted child, said Tracey Powell, a paternal aunt.

"She would just run the hallways laughing and giggling, and just jump into your arms," Powell said. "All we want is for her to come home safe and sound."

Standing near a shrine of teddy bears and flickering candles, Trent Molnar, who coaches Sarah's brother's baseball team, led the crowd in prayer, asking for Sarah to be returned home for Christmas.

Sarah's younger sister told police she saw the girl leave the bedroom with the man they knew as "Tommy," according to police and court documents. Leggs, who works in his family's custom cabinet business, recently dated the girl's aunt, who is the guardian for Sarah and two of her siblings, Wendlandt said. Another relative discovered Sarah missing in the morning, he said.

Leggs knew the family kept a spare key under a pot on the porch of the home, according to court documents.

Leggs "was developed as a suspect early on in the investigation before we were aware of his criminal background, but he does have a criminal history to include third- and fourth-degree sex offenses of small, young females," said Wicomico County Sheriff Mike Lewis.

The girl's aunt, Amy Fothergill, said Sarah's green toothbrush was missing from the home, and police found it along with a lollipop in Leggs' 2003 champagne-colored Dodge pickup, according to documents. Leggs, who agreed to go to the sheriff's office for questioning, was wearing an outfit similar to what the younger girl said the man in the bedroom had on, according to documents.

Leggs told deputies that he had last driven the pickup about 1 a.m. Wednesday when he left a nearby bar.

Asked whether authorities believe the girl is alive, state police Sgt. David Owens said: "The sheriff's been reporting that we're holding out hope; I'll just stick with his words. We're doing everything we can."

First Sgt. Timothy F. Robinson, a spokesman for the sheriff's office, added that the department has "nothing but the utmost hope that we are going to find her and reunite her with her family."

Officers from numerous jurisdictions, firefighters and volunteers searched for the girl throughout the day and evening Thursday in below-freezing weather. Several dozen police officers were joined by volunteers from as far as the Western Shore and northern Delaware. Dive teams searched a pond Wednesday night, and helicopters and dogs were brought in to assist in the search.

"The outcry has been sobering, the number of people who want to help," Owens said. "It's a heck of an impact, especially on Christmas."

Volunteers who wish to aid in the search are being asked to report to Arthur W. Perdue Stadium in Salisbury, home of the Delmarva Shorebirds baseball team, at 7 a.m. today for a briefing, Robinson said. He urged volunteers to work closely with authorities to preserve "any evidence."

According to charging documents, Fothergill dated Leggs "for a short period of time a month or so ago and ... Leggs just stopped contacting her." Fothergill told police that she knew that Leggs was a registered sex offender.

Reached by phone Thursday night, Fothergill passed the phone to a sheriff's deputy who said that she declined to comment. Court records indicate that she sued her sister for unpaid child support for Sarah and five other children in February 2008.

Sarah is 4 feet, 8 inches tall and has brown hair often worn in a ponytail. Police say she was last seen wearing red, fuzzy pajama bottoms with Christmas trees on them and a pink John Deere T-shirt.

Police also released a photograph of a 2003 Dodge Ram 1500 pickup used by Leggs and asked anyone who might have seen the vehicle to contact authorities.

Leggs was being held without bail at the Wicomico County Detention Center. His listing as a child sex offender in the Maryland Sex Offender Registry stems from a third-degree sex offense conviction in 1998. His status was listed as "compliant," meaning that he provided his address, employment and other information at the time of his last move in 2007.

In Delaware, he is listed as a "high-risk" sex offender in connection with the rape of a minor in 2001.

Electronic court records in Maryland show that Leggs was charged in September with fourth-degree burglary and malicious destruction of property. His divorce was finalized in April, and he was denied custody and visitation of his child.

Helen Young, who attended the Christmas Eve vigil with her young daughter, said she hoped that Sarah had been "hidden away somewhere" and would be found safe.

"I don't have a good feeling about it," she said, "but as a mother I have to have hope."

SALISBURY, Md.- The search for missing 11-year-old Salisbury girl Sarah Haley Foxwell continued on Christmas Day, this time with the assistance of volunteers.

On Friday morning, volunteers met at Arthur W. Perdue Stadium (home of the Delmarva Shorebirds) on Route 50 and Hobbs Road in Salisbury, to help police in their search for the girl, who police say was abducted Tuesday night from her home on the 31000 block of Old Ocean City Road.

According to police, Sarah was last seen wearing red fuzzy pajama bottoms with Christmas trees on them and a John Deere T-shirt. Sarah is described as white, brown hair that is worn in a ponytail, blue eyes, 4-foot-8, 78 pounds. Her date of birth is May 18, 1998.

Wicomico County Sheriff Mike Lewis said search and rescue teams are combing all of Wicomico County- including a number of bodies of water- in an effort to find Sarah. He noted that the search is particularly focused on the northern and northeastern areas of the county.

They have run out of bottled water already -- lots and lots of volunteers.

More than 1,000 volunteers lined up outside the stadium around 7 a.m., to search for 11-year-old Sarah Haley Foxwell who was reported missing earlier this week, but within a couple hours the number swelled to almost 3,000, according to officials.

By 9 a.m., Wicomico County State's Attorney Davis Ruark reported police had more than enough volunteers.

If more are needed for the search, police will alert the media later today, Ruark said.

ver 3,000 people turned out at Perdue Stadium early this morning to help search for Sarah Foxwell.  Police say they have enough people – and that they don’t need any more people to help in the search.  However if you do still want to help – what is needed is bottled water for the search teams already out and those at the command post.  Water can be dropped off at Perdue Stadium.

Police say there was no forced entry in the home.  Sarah and her sister live with their aunt, who is their legal guardian.  30 year old Thomas Leggs is a former boyfriend of hers.  Court documents show Sarah’s younger sister awoke during the night Tuesday to see Sarah leave the room with their aunt's former boyfriend.

Leggs is a registered sex offender in Maryland and Delaware, and has been arrested and charged with burglary and kidnapping.  He’s being held at the Wicomico County Detention Center with no bond.  A bond hearing will be held sometime next week.
 
The search is focused on the area north and northeast of Salisbury.  Police believe Leggs acted alone and there’s no indication that anyone else was involved.

Police have said they will keep looking until Sarah is found.

I can work on this a little more before I have to do the xmas things... I will be back on this by 5 pm pst..

in the meantime if anyone here is going to work on this, or whenever you do... you are more than welcome to use the info we gathered last night and will be gathering.  Hopefully, there is something we dig up that might "click" with someone and help locate where Sarah was taken.

    I just got back from the stadium and was told by MSP that there is new information and that they are searching in the Morris Leonard Rd area again because of this new information.

Thomas J. Leggs Jr., 30, is charged with burglary and with kidnapping Sarah H. Foxwell, according to Wicomico County Sheriff Mike Lewis.

Leggs was seen entering the girl's bedroom late Wednesday night by her 6-year-old sister, who described the kidnapper down to the color of his shoes, police said.

"Sarah's sister provided a complete description down to the color of his sneakers, jeans and jacket," Lewis told ABCNews.com. "When we apprehended Lewis in his family home, he was wearing the same exact clothing the sister described."

Local, state and federal investigators have used dive teams to scour a lake, sniffer dogs and helicopters and have lately focused their search on a 3-mile square area in Wicomico County, near the Delaware border.

Wicomico Sheriff: Search for Missing Girl a 'Rescue Mission'

SALISBURY, Md.– Wicomico County Sheriff Mike Lewis said Friday that volunteers are assisting police in a massive search for a missing Salisbury girl believed to have been abducted by a registered sex offender.

During an afternoon press conference, Lewis said a particular area of interest in the search for 11-year-old Sarah Haley Foxwell is the northern part of the county near the Delaware border, specifically in the vicinity of Melson Road and Rum Ridge Road.

The sheriff also asked all county residents, regardless of where they live, to search their own properties for Sarah. County residents are asked to tie red ribbons on their mailboxes as a way to indicate to authorities that they have searched their properties for Sarah.

Lewis also acknowledged the thousands of volunteers who have taken the time out to assist police in the search efforts. He said police now have an adequate number of volunteers at their disposal.

Lewis acknowledged that so far "we have located nothing at this time leading us to Sarah Foxwell." He did stress that the search for Sarah is "not a recovery mission."

"This is a rescue mission," Lewis said. "We have hope and we have not given up that hope. We will not give up."

Thirty-year-old Thomas J. Leggs Jr. of Bennett Road in Salisbury, is charged with burglary and with kidnapping Foxwell, according to court documents.

A charging document says Leggs was the last person seen with Sarah.

According to police, Sarah was last seen Tuesday night at her home on Old Ocean City Road in Salisbury. A relative discovered she was missing early Wednesday while checking on Sarah and her 6-year-old sister.

"She wasn't in her room," Lewis said at another press conference held Thursday. He said there was no evidence of forced entry to the home where the girls live with their aunt, who is their legal guardian. Leggs is a former boyfriend of the aunt, officials said.

A "juvenile witness" awoke during the night Tuesday and saw Sarah leave the bedroom with "Tommy," and said he was wearing blue jeans, an orange jacket and white sneakers, the charging document says.

The statement of probable cause also says Sarah's aunt, Amy Fothergill, with whom Sarah lives, noticed that Sarah's green toothbrush was missing from the home. Deputies found a green toothbrush and a lollipop in a truck Leggs admitted driving. Leggs said he had been wearing jeans and white sneakers the previous night - the same clothes he was wearing when police questioned him.

The sheriff said Leggs has been uncooperative and "of no assistance to our investigators."

Dive teams have searched several area ponds and scores of police officers from across the state and neighboring Delaware continue to search many square miles of woods in the county. Helicopters and K-9 teams have also been brought in to aid their search.

Police also released a photograph of a 2003 Dodge Ram 1500 pickup used by Leggs and they asked anyone who may have seen the champagne/tan-colored vehicle to contact authorities.

Sarah is white, 4-foot-8 and weighs 78 pounds. She has brown hair and blue eyes. When she disappeared, she was wearing red fuzzy pajama bottoms with Christmas trees on them and a pink John Deere T-shirt.

Leggs is being held at the Wicomico County Detention Center without bail.

Leggs is listed on the Maryland and Delaware sex offender registries. The Maryland listing notes that he is a child sex offender, but does not provide details about his conviction.

Lewis said Leggs has been convicted of sex offense in Wicomico County and was charged Oct. 29 with fourth-degree burglary.

Not to be redundant, but yes more than 3,000 people showed up this morning and water and food, etc. arrived by the truck loads.
People were not turned away, they were asked to come back because you cannot send people out without instructions, them completing forms, etc.  Many came back and helped in other ways, than just tracking.
It is my understanding the concentrated area is between Dagsboro Road, Rum Ridge Road, and Melson Road.

Salisbury, MD - At a press conference late on Christmas Day, the Wicomico County Sheriff's Office announced the tragic end to a 3-day search for missing 11-year-old Sarah Foxwell.

Sheriff Mike Lewis says a law enforcement search team found the 11-year old's body late Friday afternoon near Melson Road.

No word on if additional charges will be filed against the current suspect in custody, Thomas Leggs, Jr. He has already been charged with one count of assault and one count of kidnapping. Officials say they will be continuing what looks to be a long and detailed investigation.
 

The family has been notified of the tragedy.

SALISBURY, Md.- Police have announced that they have found the body of an 11-year-old Salisbury girl who had been missing since Tuesday night.

The body of Sarah Haley Foxwell was found at approximately 4 p.m. Friday in the area of Melson Road west of Hampton Court, about half a mile south of the Maryland-Delaware line, announced Wicomico County Sheriff Mike Lewis during a press conference.

I just found out about Sarah on JSM's thread. What a tragedy. She should be home enjoying what Santa brought her, but because of some evil demon she was left out in the cold for 3 days.

SALISBURY, Md., Dec. 25 (UPI) -- Searchers Friday found the body of an 11-year-old Maryland girl allegedly kidnapped from her bedroom by a registered sex offender, authorities said.

The body of Sarah Haley Foxwell was found in northern Wicomico County not far from the Maryland-Delaware state line, The Baltimore Sun reported.

Foxwell, a sixth grader, disappeared from her aunt's home in Salisbury, Md., Tuesday night, dressed in a pink shirt and red pajamas printed with Christmas trees. A younger sister told authorities she saw Sarah leave the room with their aunt's former boyfriend, registered sex offender Thomas James Leggs Jr., the newspaper said, citing court documents.

Leggs, 30, who lived in a building on the grounds of his parents' Salisbury home, was arrested Wednesday and charged with burglary and kidnapping in Sarah's disappearance. Wicomico County Sheriff Mike Lewis said at a Friday news briefing further charges had not yet been filed against Leggs.

"We have been interviewing possible additional victims," Lewis said. "There are several."

Leggs is reported listed on sex offender registries in Maryland and Delaware.

Lewis said police considered Leggs a suspect "early on in the investigation before we were aware of his criminal background, but he does have a criminal history to include third- and fourth-degree sex offenses of small, young females."

Court documents indicate Leggs knew where a spare key to the home was kept, The Sun said. Sarah's aunt, Amy Fothergill, said investigators found the girl's toothbrush in Leggs' vehicle.
An estimated 3,000 volunteers took part in the search, the report said.

The suspect posted bond two months ago and was released from the Worcester County Detention Center on two counts of malicious destruction of property over $500 and fourth-degree burglary, charges stemming from a September incident, according to court records.

SALISBURY -- After three days of nearly continuous searching, police found the body of a missing 11-year-old girl late Christmas afternoon in a rural area east of Delmar.

A team of investigators found the remains of Sarah Haley Foxwell, a sixth-grader at Wicomico Middle School, near the Melson Road and Hampton Court area at about 4
p.m.

It's unknown how long she had been there.

Wicomico County Sheriff Mike Lewis gave few details following the
announcement, stating that the investigation into Foxwell's death is
continuing.

Investigators are expected to continue collecting evidence from
the area over the next several days, and Lewis advised residents to avoid
the area in order to preserve the crime scene.

"This is to collect evidence of a murder," Lewis said.

Because the investigation is continuing, Lewis declined to give additional
details on the girl's remains.

Before the search for Foxwell ended, police confirmed there may be
additional victims linked to the man charged with the girl's disappearance.

Thomas James Leggs Jr., a 30-year-old Salisbury resident and registered sex
offender, was taken into custody by police on Wednesday following the
disappearance of Sarah Haley Foxwell on Dec. 22.

His most recent arrest occurred almost two months after he was released from
the Worcester County Detention Center on a $10,000 bond. Leggs was charged
with fourth-degree burglary and malicious destruction of property in
September and is scheduled to go to trial on in January, according to court
records.

Wicomico County State's Attorney Davis Ruark confirmed Leggs dated the
victim's aunt for a short time before the murder.

Ruark confirmed reports that the victim's aunt, Amy Fothergill, reported the
child's toothbrush was missing, and that police found a toothbrush and
lollipop in Leggs' vehicle during a search.

Leggs has remained uncooperative with investigators and did not give any information
on Foxwell's whereabouts, according to police.

Leggs had not been charged with murder as of late Friday. Police
charged him burglary and two counts of kidnapping on Thursday. He is being
held without bond at the Wicomico County Detention Center, according to
court records.

Lewis confirmed additional potential victims have been interviewed by
police, but declined to give the number interviewed during a news conference
in front of Arthur W. Perdue Stadium on Friday.

''There are several,'' Lewis said.

No additional charges against Leggs in connection with additional victims
were filed as of late Friday, according to Lewis.

In 2000, Leggs was convicted of second-degree assault and 17 charges related
to the same case, including multiple counts of third- and fourth-degree sex
offense, which were placed on the stet or inactive docket, according to court
records.

Leggs was found not guilty on assault and two counts of sex offense in 2005.

The news concerning potential victims followed the sheriff's announcement
that search for Foxwell by an estimated 1,000 volunteers from around the
Eastern Shore lined up outside the stadium on Friday morning.

The number tripled to 3,000 before 10 a.m., according to police.

There is sad but not unexpected news to report in the case of missing 11 year old Sarah H. Foxwell. Her body was found at about 4:00 pm Friday in a wooded area near the Delaware state line.

The search is over for a missing 11-year-old girl from Salisbury.
 
Kelly McPherson reports Sheriff Mike Lewis who lead the investigation said he thought they'd find the little girl alive. After three days of searching and a huge community outpour, a search team of law enforcement officials discovered her body.
 
It was a day filled with hope as thousands of volunteers and emergency service workers scoured 500 square miles of Wicomico County looking for signs of Sarah.

All hope evaporated when the announcement came that her body was found less than a mile from where she lived.

This county is next to Worcester Co, where Christine Sheddy was murdered. Her remains have not been recovered to this day.

The Lead detective on her case, Scott Mitchell, was recently the subject of the State's Attorney Office for failing to arrest someone of child rape; of a 7 year old, after 6 requests from the SA's office to do so.

This detective was just allowed to resign/ retire without facing any criminal charges with full pension. How the Hell is that possible? In this case, an officer of the Law failed to protect this baby.

We have a very serious problem. People are not protecting our children. As Jess said, I cannot stand it. It is my personal opinion that there is no such thing as a recovered pedophile. I agree with everything you said.  I especially agree that something is wrong with women who knowingly date women who harm children.

SARAH FOXWELL UPDATE: Family establishes memorial fund

SALISBURY — The family of the 11-year-old girl who was found dead by police on Christmas day, has established a memorial fund at a local bank, according to the family's pastor.

Donations to the Sarah Haley Foxwell memorial fund can be made at any Farmers Bank of Willards branch.

Foxwell was reported missing by family members on Dec. 23. After searching for three days, police located her body in a rural Delmar area.


Investigators charged Thomas James Leggs Jr. with Foxwell's disappearance a few hours after she was reported missing, according to police.

Investigation of Md. girl's death focuses on sex offender


SALISBURY -- Hunters and homeowners joined in the search for a missing 11-year-old girl, and thousands of people combed Maryland's Eastern Shore on Christmas Day with the hope she was alive.

On Friday afternoon, three days after Sarah H. Foxwell was last seen at her home, law enforcement found her body near the Delaware state line. Investigators were working today to determine how she died.

"This is not the way we wanted to find our young lady on Christmas, but at the very least we've given closure to the family," Wicomico County State's Attorney Davis R. Ruark said at a news conference.

Ruark said Saturday that an autopsy was being conducted, but he did not expect a cause of death to be released immediately. He added that any new charges would likely come after an investigation is complete.

The focus of the investigation is on Thomas J. Leggs Jr., 30, who was charged Wednesday in Sarah's kidnapping.

"There's no indication of involvement of any other individuals at this point," Ruark told The Associated Press.

No new charges had been filed as of late Friday.

Leggs is a former boyfriend of the girl's aunt, who is her legal guardian. A public defender representing him has not returned phone calls and a woman who answered the door at Leggs' parents' house declined to speak to a reporter.

Wicomico County Sheriff Mike Lewis said the body was found in the northern part of the county, where authorities had focused their search.

Volunteers met up at a stadium in Salisbury early Friday and fanned out to search for her. Lewis also asked property owners in the county to check their fields and yards for the girl and to display something red to let law enforcement know the area had been searched. He also asked hunters to be on the lookout.

Lewis said Sarah was last seen Tuesday night at her home on Maryland's Eastern Shore. A relative discovered she was missing early Wednesday while checking on Sarah and her 6-year-old sister. A charging document said Leggs was the last person seen with Sarah.

A "juvenile witness" awoke during the night Tuesday and saw Sarah leave the bedroom with "Tommy," and said he was wearing blue jeans, an orange jacket and white sneakers, the charging document said.

Sarah lived with her aunt, Amy Fothergill, who told police the child's toothbrush was missing from the home, according to the statement of probable cause.

Deputies said they found a green toothbrush and a lollipop in a truck Leggs admitted driving. Leggs said he had been wearing jeans and white sneakers the previous night -- the same clothes he was wearing when police questioned him.

The sheriff said Thursday that Leggs has been uncooperative and "of no assistance to our investigators."

Sarah was a sixth-grader at Wicomico Middle School, bright and lighthearted, Tracey Powell, a paternal aunt, told The (Baltimore) Sun at a Christmas Eve candlelight vigil for her niece on Thursday night.

"She would just run the hallways laughing and giggling, and just jump into your arms," Powell said.

Leggs is listed on the Maryland and Delaware sex offender registries. The Maryland listing notes that he is a child sex offender, but does not give details about his conviction.

Lewis said Leggs has been convicted of a sex offense in Wicomico County and was charged Oct. 29 with fourth-degree burglary.

In 2001, Leggs was convicted in Delaware of rape involving a victim who was 16 or 17, according to the Delaware registry. The registry describes his risk level as "high" and notes he is unemployed.

Leggs, who has been convicted of assault several times, is also awaiting trial on charges of burglary and destruction of property in Ocean City.

The depth of my sadness is really too much to put into words.  When we had altar call at the church, it was filled with children praying for Sarah.  One of the little girls was crying and asking "what if she is dead."  The only answer that I could summons was, "then where do you suppose she is right this minute?" to which she thought for a moment and said, "she's with Jesus."  "Assuredly," I replied, "and just think of the wonderful birthday party they are having in heaven."
Tomorrow will be another teaching day for the children.

I am so proud of the LE and the thousands of volunteers who turned out to search.  The idiots (not speaking of LE) in McCleary have much to learn about putting aside their private agendas and focusing on what is important.  When I was out, I thought about Lindsey and Christine Sheddy and remain so angry that neither of them have been found.

The location of Sarah's body was being searched only by LE as they apparently had narrowed down the general area, then narrowed it again, and then again, so I am confident the crime scene was protected.  It is said this was done by pings on the cell phone.  I have no conformation of that as unfortunately the media has put out so much misinformation it's infuriating.  Had to turn back so many lookeyloos -- are people crazy?  Have also heard, not confirmed, that a truck was burned so there may be an accomplice and also have heard, but not confirmed, there may be more victims.

The Wicomico County Sheriff Mike Lewis has the most determined look in his eyes when he speaks about this precious child and I am very confident if he has a breath in his body, this sob will never, never, never see the light of the free world again.  All the local agencies, including the State Police, acted as a team and were focused and determined to bring this child home.

I thank all of you who have worked so hard in such a brief period of time to help find her.  I know there will be other work on this case we can do, but for now, I must allow some healing to take place and use this opportunity to teach parents and children to be more safety conscience.

I had read previously the letter from the lady with her child and I have no doubt what she writes may be true.  But unfortunately, men and women use their children as pawns for revenge against one another and frequently a judge has no idea who is telling the truth without evidence.
What I believe needs to happen, in part, is that there is mandatory sentencing for child endangerment, abuse, etc. and take away any possibility of early release, good behavior, or whatever else allows these sick, unrehabitable to walk our streets.  We as human beings need to be responsible for our own behavior and demand that others are as well.

I am with all - beside myself. That another child was victimized and taken/died by a known convicted SO criminal ( I am being kind) degenerate with a record. What else has he done, that he was not recorded, that he was never caught, was never arrested for,   I am sure his previous victims will slowly speak and  leak out their stories  ..now that Sarah has paid the price with her innocent life.

If anything he had all to gain. He is now behind bars, with heat, 3 squares and a cot.

SALISBURY -- Investigators continued to search a heavily wooded area in rural Delmar on Saturday as they processed the crime scene where the body of an 11-year-old girl was found.

Sarah Haley Foxwell's remains were located on the north side of Melson Road in Delmar near Hampton Court on Christmas Day. Wicomico County Sheriff Mike Lewis declined to give further details on the cause of her death during a news conference Friday, stating the investigation is ongoing.

Foxwell, a Wicomico Middle School sixth-grader, was abducted from her Old Ocean City Road home Dec. 22. When police found her three days later, the little girl's body had been severely burned, according to sources close to investigation who could not be named because the investigation is continuing.

Foxwell's body was taken to the Office of the State Medical Examiner, and investigators hope to receive a report before the end of the week, according to Lewis. He also hopes to receive DNA test results of evidence sent to the crime lab.

Cookie, I agree with your post. There is no excuse for having children that you do not want and can't take care of. If you can't afford birth control, you can get it free at any clinic. I know that many young people think that it is the way to keep a man by having his baby. That is not the right way to go about it. He has to love you first before you bring an innocent child into the mix. I blame a lot on TV shows like soap opera where they are always scheming to keep their love interest and no parental guidance at home.

I made a commitment when I had my children that they always came first even above my husband. They did not ask to be born and it was my job to be the best parent i could be. After my divorce and when I did start dating again, No man even met my kids until I was comfortable for him to meet them. But under no circumstances did a man spend the night when my children were at home or was he ever left alone with my children for any reason. Now days women could care less about exposing their children to strange men on a nightly bases just so long as they have a man. No way would i ever tell a guy where the spare key was to my home. I think the aunt and the parents have some cupability in what happened to Sarah. They should at least be held for child endangerment. NCRG, from what I have seen most of them don't care. I never knew how bad things had gotten in the dating world til my son started dating in high school. If he ask a girl out for a date...from that day forward she owned him body and soul. He could not move without her on the phone or coming to the house. I was reading on another site and found a case that is " existing" at present. It is almost a carbon copy case of Sarah Foxwell. However a child has not died yet by the hands of this monster. The case is in Kingston, Ma. It is of a man, 26, Joseph Gardner.

He was arrested in August 2009 for "allegedly" breaking into a home and raping a 5 yr old girl.  His initial bond was set at 150k, (* for the 5 yr old) yet Judges felt that 10k was sufficient so HE WALKED .. (( Gardner's Parents Posted his Bond)) only for him to find ( I say Hunt) and befriend an old high school girlfriend ( a short time after) ...that He raped her 3 yr old daughter ,in the middle of the night,  during an overnight visit.
The overnight visit was with Gardner * at his apt, his 4 yr old son, Mother* old hs gf and her two young children 8 and 3. The eight year old brother of the 3 yr old victim was a witness. That he/Gardner awoke the 3 yr old in the middle of the night and carried her off to his bathroom. Where he raped her. (** Gardner is awaiting the Courts to charge him with the first rape of the 5 yr old 8/09.)

Community faces 'disbelief'; services Saturday for Sarah Foxwell

SALISBURY -- Life in Salisbury, and especially on Bennett Road, has not been the same since a 30-year-old man who lived there was charged in the disappearance of a little girl who found dead on Christmas day.

On Sunday, residents reported that the neighborhood doesn't feel the same anymore.

Investigators arrested Thomas James Leggs Jr. after Sarah Haley Foxwell's family reported her missing on Dec. 23. His arrest has cast a negative shadow on the quiet community where some say they used to feel safe.

"I don't feel like this is our neighborhood anymore," said a neighbor who grew up with Leggs but declined to give her name. "It's very shocking because you think you know a person."

Leggs was charged by police with burglary and two counts of kidnapping on Dec. 24, according to court records, after Foxwell was abducted from her bedroom. Police expect additional charges to follow after Foxwell's body was found badly burned in a heavily wooded area off Melson Road on Dec. 25.

Leggs is currently being held without bond at the Wicomico County Detention Center.

Another resident also said news of the charges against Leggs came as a shock.

"I couldn't believe it," said the resident, who declined to give his name.

Leggs was always protective of his nieces and nephews, he added.

Sarah was born on May 18, 1998, in Salisbury.

She is survived by her mother and father; two maternal aunts; one maternal uncle; maternal grandparents; four brothers; two sisters; one paternal aunt; two paternal uncles; paternal grandparents; and many cousins.

She was preceded in death by one sister.

Memorial services will be held Saturday at 11 a.m. at Emmanuel Wesleyan Church at 217 Beaglin Park Drive in Salisbury.

Advocate: Md. Needs Tougher Child Protection Laws

SALISBURY, Md. -- A child advocate said the death of an 11-year-old girl who police said was abducted from her Maryland home highlights the need for stiffer penalties for sex offenders.

The man charged with kidnapping the girl, 30-year-old Thomas J. Leggs Jr., is listed on the Maryland and Delaware sex offender registries. The Delaware registry describes him as "high risk."

Sarah Haley Foxwell was abducted from her home Tuesday night. Her body was found on Christmas Day after a massive search that included more than 3,000 volunteers.

Jerry Norton, head of Citizens for Jessica's Law in Maryland, told the Baltimore Sun that the case is evidence that child protection laws need to be tougher.

Delegate Mike Smigiel of Cecil County said he's "seething" over the case and said is considering everything from cracking down on plea bargains to allowing the wiretapping of sex offenders in the upcoming session.

Meanwhile, relatives of the girl will not have to pay for her funeral or burial.

John Holloway of Holloway Funeral Home in Salisbury told WBOC-TV that local donors have paid for the funeral of Sarah Haley Foxwell. Holloway said the donors want to remain anonymous.

The funeral will be held at 11 a.m. Saturday at Emmanuel Wesleyan Church in Salisbury.

A judge ordered a convicted sex offender held without bond Monday on charges he kidnapped an 11-year-old Maryland girl whose body was found on Christmas Day.

After the hearing in Salisbury, Md., Thomas J. Leggs Jr. was returned to the Wicomico County Detention Center, where he has been held since his arrest.

Sarah Haley Foxwell was taken last Tuesday from the Salisbury home where she lived with her aunt, Amy

Fothergill, who had recently dated Leggs, according to court records. The girl's body was found Christmas Day in Maryland near the Delaware line after a search that involved thousands of volunteers.

Leggs, who has convictions for sex offenses in Maryland and Delaware, will face a preliminary hearing Jan. 21 on charges of kidnapping and burglary. He has not been charged in Sarah's death. Wicomico County Sheriff Mike Lewis said Leggs will face additional charges but he did not elaborate.

A public defender representing Leggs did not immediately return telephone messages Monday.

Prosecutor Davis Ruark said details from an autopsy report likely will be withheld, but the cause of death may be disclosed. Neither he nor Lewis would confirm media reports that Foxwell's body was burned.

Since Foxwell's disappearance and killing, law enforcement officials in Maryland and Delaware have received reports that Leggs may have committed other crimes, Ruark said. He would not elaborate, but law enforcement officials scheduled a news conference Monday afternoon to ask for the public's help in investigating such reports.

A woman who answered the phone Monday at Fothergill's home said the family did not want to speak to reporters.

According to Department of Correction records, Leggs, 30, was jailed in Delaware from February 2001 to July 2001 after being charged with fourth-degree rape for having sex with a teenager who was not yet 18.

According to Maryland court records, a warrant listing Leggs as a fugitive from Delaware was issued in February 2005. Despite his status as a "high risk" offender, Leggs' information on the Delaware sex offender registry had not been verified since March 2005, a month after his arrest on the fugitive warrant.

Leggs also has a lengthy arrest record in Maryland, where he was convicted of third-degree sex offense involving a child in March 1998. He was convicted of assault in 2000 in a case that also involved several sexual offense charges and was subject to a probation violation hearing in 2006.

Leggs was acquitted of assault and sexual offense charges in 2005 but was scheduled to go on trial next month in Worcester County, Md., on charges of burglary and destruction of property.

11 Year Old's Death Could Make New Laws

Sarah Foxwell's body was found on Christmas, she'll now be buried on the second day of the New Year.
 
It is a horrific story extending through the holiday season and into strangers hearts.

"It's just tragic, but sometimes it takes tragedies like this."

State Senator Nancy Jacobs plans on introducing new bills in the upcoming legislative session in response to Foxwell's story.

She says she's working on a number of bills aimed at tougher sentences for convicted child sex offenders and eliminating good time credits in prison to earn early release; a benefit that works against mandatory minimum sentences.

"Sex offenders are usually very quiet model citizens who can't wait to get out because their audience isn’t in jail with them, it's children out in the street."

Jacobs says look no further than the prime suspect in this case.  Thomas Leggs was convicted of a sexual assault in Maryland in 1998 and then again in 2001 in Delaware where he was declared a high risk offender
 
Jacobs argues that states should share information on offenders and every crime, should follow the offender in every state.
 
Better communication matched with tougher laws the senator hopes will help prevent what happened to Sarah Foxwell.

Leggs is charged with burglary and kidnapping.  Police are waiting on the autopsy report before possibly charging Leggs with anything further.

FOXWELL MURDER: Suspect charged with breaking into another victim's home

SALISBURY — A 30-year-old Salisbury man charged in the disappearance of a missing girl found dead was also charged with breaking into a female victim's house in December.

Thomas James Leggs Jr. allegedly entered her home while the victim was sleeping, according to court records.

She told police Leggs was standing near her bed with his shirt off and his pants down to his knees when she woke up, according to charging documents.

Leggs was charged with fourth-degree burglary and malicious destruction of property in Worcester County District Court in September.


He was released from the Worcester County Detention Center on a $10,000 bond in October, according to court records. His trial is scheduled for January.


On Dec. 24, Wicomico County investigators charged Leggs with burglary and two counts of kidnapping after Sarah Haley Foxwell was abducted from her bedroom.


Leggs was denied bail on Monday during a Wicomico District Court hearing, according to prosecutors. He is currently being held at the Wicomico County Detention Center.


Prosecutors expect to charge Leggs with Foxwell's murder within the next 30 to 45 days, according to Wicomico County State's Attorney Davis Ruark.

SARAH FOXWELL MEMORIAL: Shorebirds Stadium selected as temporary memorial location

SALISBURY — The Arthur W. Perdue Stadium entrance will be used as a temporary memorial for 11-year-old Sarah Haley Foxwell, according to law enforcement officials.

Members of the public can leave flowers and other mementos starting 8 a.m. on Tuesday.

An estimated 3,000 volunteers from around the Eastern Shore reported to the stadium on Christmas day to help police search for Foxwell who was reported missing on Dec. 23.

She was last seen by family members on Dec. 22, and was abducted from her bedroom.

A team of investigators found her body in a wooded area off Melson Road around 4 p.m. on Dec. 25, according to police.

Police have charged 30-year-old Thomas James Leggs Jr. with Foxwell's disappearance. He has been charged with burglary and two counts of kidnapping.

Leggs has not been charged with murder at this time.

Thanks Sister!  It's a pretty time consuming process. I've interviewed many people for different positions in the organization. It is tremendously difficult to find the right people. Peoples' hearts are definitely in the right place.  But when you start talking about the level of commitment that is required to ensure success, most people either back away or give me the feeling that, once push comes to shove, they'll resign. So I'm taking my time because I don't want to do this twice!  I want to try to get it right the first time.

DOVER, Del. — An autopsy has found that a Maryland girl abducted from her home last week died of multiple injuries.

According to the chief medical examiner's office in Maryland, the death of 11-year-old Sarah Haley Foxwell is listed as a homicide. The office did not specify her injuries.

Thomas J. Leggs Jr., who has convictions for sex offenses in Maryland and Delaware, faces a preliminary hearing Jan. 21 on charges of kidnapping and burglary in Sarah's disappearance.

Authorities have said Leggs will face additional charges.

Funeral Plans Announced for Sarah Foxwell

SALISBURY, Md.- The family of 11-year-old Sarah Haley Foxwell, whose body was found in a wooded area of Wicomico County late Friday afternoon, will not have to pay for funeral and burial costs.

John Holloway from Holloway Funeral Home in Salisbury confirms all funeral plans have been paid for by local donors.  Holloway says the donors want to remain anonymous. Sarah's funeral will be held at 11 a.m., Saturday, Jan. 2, 2010, at Emmanuel Wesleyan Church at 217 Beaglin Park Drive in Salisbury.

On Saturday, Foxwell's family sent a message of gratitude to the community. Warren delivered the message live on WBOC and FOX 21.

In the message, he said the family wishes to express their profound appreciation to the community for their outpouring of support.

Warren talked about financial contributions.  "The contributions are needed and welcomed," Warren said.

Contributors are asked to donate to the Sarah Haley Foxwell Memorial Fund at any branch of the Farmers' Bank of Willards.

Sarah was abducted Tuesday night from her home on Old Ocean City Road.  A massive air and ground search was initiated Wednesday afternoon with more than 3,000 volunteers showing up on Christmas morning.

Her body was found Christmas day at around 4 p.m. in a wooded area off of Melson Road, about half a mile south of the Maryland-Delaware line.

Thirty-year-old Thomas Leggs Jr. of Salisbury is a registered sex offender in Maryland and Delaware.  He is charged with kidnapping and burglary in her disappearance. He is being held without bond in the Wicomico County Detention Center.

Police are investigating Sarah's death as a murder and her body was sent to the state medical examiner's office for an autopsy.

Sheriff calling for death penalty in girl's murder

DOVER, Del. - Investigators say the kidnapping and murder of a Maryland girl, whose body was found on Christmas Day, calls out for the death penalty.

"I was a believer in capital punishment before this, but I'm a stronger believer today," says Wicomico County Sheriff Michael Lewis.

The body of 11-year-old Sarah Foxwell was found two days after she was abducted from her home on Maryland's Eastern Shore. A relative discovered she was missing early Wednesday while checking on Sarah and her 6-year-old sister.

"It's gut-wrenching," Lewis says. "It's the worst I've seen in 26 years of law enforcement."

While Foxwell's death has been ruled a homicide, Thomas Leggs Jr., 30, of Salisbury, has been charged with burglary and kidnapping -- but not murder. But Lewis says he's confident sheriffs' deputies have the man responsible for Foxwell's disappearance.

"This man was and is a registered sex offender in Maryland and in Delaware. And he was out to commit this heinous crime against this innocent 11-year-old child."

A charging document says Leggs was the last person seen with Sarah.

When Lewis talks about the condition of the body, his voice drops and he can't finish the thought.

When asked about the cause of death, he didn't want to elaborate while the investigation is ongoing. However, he did suggest the case could expand.

"We've actually received a number of phone calls and emails from individuals who have been affiliated with him in the past, or have been victims of his in the past, and they wish to meet with investigators in this particular case to look at similarities in this case."

Leggs was convicted of a third-degree sex offense involving a 12-year-old girl in 1998. He is a registered sex offender in Delaware in connection with the 2001 rape of a minor.

Lewis says Leggs was uncooperative throughout the investigation.

"We actually provided counsel for him, and he still chose not to talk."

Maryland is among the toughest restrictions in death penalty cases in the nation. A videotaped confession and DNA or other 'latent evidence' like fingerprints would have to be present in order to get a death penalty. Maryland Gov. Martin O'Malley sought to abolish the death penalty in the 2009 General Assembly session.

Lewis says he's thankful that attempt failed.

"We cannot abolish the death penalty. It's got to be reserved for cases such as this."

NorthernRose, thanks for posting this.  I personally watched Sheriff Lewis speak and I can tell you, he is a man on a mission.  I always respected him, but now my feelings are so much stronger.  Thank goodness, LE is on precious Sarah's side and will make sure justice will prevail!

This case is going to be terribly gut wrenching.  This guy is the devil himself.  How anyone can do something like this is just beyond comprehension. My thoughts and prayers go out to the family.

SALISBURY - Authorities are seeking at least two other potential victims of the man charged with kidnapping an 11-year-old Salisbury girl whose body was found on Christmas Day, the Wicomico County state's attorney said.

"I have reason to believe there are other victims out there who have not come forward before," said State's Attorney Davis Ruark, adding that authorities have received information about potential adult victims.

Thomas J. Leggs Jr, 30, is being held without bond in the disappearance of Sarah Haley Foxwell, his former girlfriend's niece, who was seen leaving her bedroom with him last week, according to court documents.

Authorities have charged Leggs with kidnapping and burglary, and they say they plan to bring further charges.

Sarah's death has been ruled a homicide. An autopsy has found that she died of multiple injuries.

Leggs has a record of sexual offenses stretching back to age 18, when he was convicted of a sexual offense involving a 12-year-old. He was put on Maryland's sex offender registry for that case.

Leggs, who lives in a building on his parents' property and works for his family's custom counter business, is also listed on the Delaware sex offender registry stemming from a 2000 case involving a 16-year-old girl, according to court records. He was convicted of fourth-degree rape in that incident.

A funeral service is planned for Saturday for Sarah Foxwell, who was described by relatives as a bright, vivacious child.

More than 3,000 volunteers and police joined in a massive search for her last week. A memorial with pink balloons, stuffed animals and Barbie dolls has been set up for her outside the Arthur W. Perdue Shorebirds stadium.

Leroy, I called the church whose pastor talked about and asked for money for the fund, which is not where the funeral will take place (Emmanuel Wesleyan, where the funeral will be will hold more people).  I was told they did not know if it was a trust account, but they thought the money was going to be used for counseling for the children.  I expressed my concerns. Anyway, they did not know if the memorial fund is a trust account.  I called the Farmers Bank of Williards and was told "it will be" meaning it isn't yet.  I will keep watching for any clarification about this and lwill et you know when I know.  I can tell you the local bloggers have already addressed this issue and often in very unkind and mean-spirited ways.  I share their concerns, but being mean, hurtful, and down-right nasty places them close to the pit of this pervert IMO.

Wicomico County Sheriff: Sarah Foxwell's Aunt wasn't home at time of Sarah's abduction

We’re learning more about the events surrounding the disappearance of 11-year old Sarah Foxwell whose body was found on Christmas Day. The grandfather was home at the time she was abducted. Wicomico County Sheriff Mike Lewis also tells WGMD that the aunt was not home at that time. He adds that the entire family including the mother, the aunt and the grandfather were all extremely cooperative, and that there is no indication that they knew the abduction was about to happen.

Meanwhile the autopsy has shown that Sarah died of multiple injuries, and her death is officially being called a homicide. 30 year old Thomas Leggs Junior who is a former boyfriend of Sarah's aunt and is charged with burglary and kidnapping. So far he has not been charged in her death, but additional charges are coming within the next 30 days.

Leroy, from everything I have heard and read, this grandfather is a good man.  I had heard he was home with the children and am glad it has been confirmed.  It is also my understanding that the grandmother has a part in these children's lives, although she and the mister are divorced and live in separate places, but within the same community.
Cookie, I agree with you.  I have gotten the impression a trust will be established.  I will keep everyone informed as I know it.  I believe the account was opened because there was an outpouring of folks wanting to help, and it was just a little later that the funeral expenses were covered by several individuals. 
I can't imagine how Sarah's sister must feel knowing she is the last relative to see her alive.  I hope they get counseling for her asap.

I was actually irritated by a few of the headlines stating that aunt wasn't home...then further in the article you find that to be true but the grandfather was there.  I'm sure the Aunt is feeling horrible but to mis-lead with a headline like that is wrong. 

At first I really thought those children were home alone that night.  Glad that is not the case.

I am a contractor who does remodeling. I had used and recommended Thomas leggs Sr. (the perps dad) ,who has a countertop business, to do countertops for my clients. His son worked for him making and installing these countertops. He also did my countertops. He never told me or worned me about the background of his son. I had him and his son in houses that had girls from the ages of 9 to 18 yrs old. His father did an estimate for a house just last month that had 3 girls with the ages of 11, 15, and 18 living there and not a word. For God sakes, Tom Sr. and Tom jr. where both in my house installing my countertops with just my wife there and not a word. I feel releived that nothing happened. They did a countertop at my friends house with there 2 daughters ,ages 15 and 17, at home by themselves. I am so angry that he did not say anthing to me about his son. What happens if something did happen. Oh my God how bad I would feel for recommending him. I just want to say that Tom Sr does great work but I will not be able to recommend him to anyone now.

Online Community Mourns Death of Sarah Foxwell

SALISBURY, Md.- The death of Sarah Hayley Foxwell  has many residents on Delmarva posting their thoughts and prayers online.

They say the virtual forum is helping them cope as a community. Heather Yesko formed a group on Facebook in Sarah's honor; there are more than 1,000 members from Delmarva and beyond.

"I was very surprised it's become something much bigger than myself," the Salisbury resident said.

She said the response prompted her to organize a candlelight vigil for Friday 6 p.m. at the Salisbury City Park.

"That really shows me and makes me feel good about our community to show what we can do when we come together," Yesko added.

Many people have changed their online profile photos or phone backgrounds to Sarah's picture.

"Her memory should live on," said Lori Hastings.

"She will never be forgotten," said her sister Stacie.

The Hastings said they will also be in attendance at the vigil, as well as Sarah's funeral, which takes place Saturday 11 a.m. at the Emmanuel Wesleyan Church on Beaglin Park Drive in Salisbury.

Foxwell Kidnapping Suspect Has Criminal History

SALISBURY, Md.- WBOC has learned more information about the criminal history of Thomas James Leggs Jr.

Leggs, 30, of Salisbury, and a registered sex offender in both Maryland and Delaware, is locked up without bond on burglary and kidnapping charges in the Sarah Haley Foxwell case. Eleven-year-old Sarah's body was located on Christmas day in a wooded area of Wicomico County.

According to court documents obtained on Wednesday, Leggs was already expected to be in court next month on burglary charges after court papers say he broke into a house in Ocean City. In that case, police say the female victim woke up and found Leggs standing over her bed with his shirt off and his pants down.

Other court records show Leggs was convicted of third-degree sexual offense for an incident that occurred back in 1997. The case involved a 12-year-old girl at a park program where Leggs volunteered. He was 18 at the time.

Then in 2000, court papers show Leggs was convicted of second-degree assault after he was found guilty of inappropriately touching a girl under 14-years-old.

As of now, Leggs has not been charged with Sarah's murder but authorities say more charges will be filed against Leggs in the near future.

Candlelight vigil tonight for Sarah Foxwell in Salisbury

A private funeral and burial was held for 11 year old Sarah Foxwell of Salisbury yesterday by her family, however a candlelight vigil will be held at 6pm this evening at the Salisbury City Park.  She was kidnapped from her home last week – and thousands turned out on Christmas Day to help search for her.  Foxwell’s body was found Christmas Day – her death has been ruled a homicide.  A public memorial service will be held Saturday morning at 11 at Emmanuel Wesleyan Church on Beaglin Park Drive in Salisbury.

1,000 Pay Tribute To Kidnapped Girl

Nearly 1,000 people packed a church  in Salisbury today for the funeral of an 11-year-old girl whose body was discovered Christmas Day.

The funeral service for 11-year-old Sarah Foxwell  took place at Emmanuel Wesleyan Church.

An anonymous donor paid the funeral expenses.

"Sarah loved her friends and family,"  Foxwell's grandmother, Roberta Wechsler told The (Salisbury) Daily Times.

"She loved to laugh, sing, read and listen to music. She loved school."

The newspaper reports Wicomico County Sheriff Mike Lewis and District Attorney Davis Rurak attended the service.

Authorities say Foxwell was kidnapped from her bedroom on the night of December 23.  Thomas Leggs, Jr., who is on the sex offender registry in Maryland and Delaware has been charged in the kidnapping.  He has not been charged in the girl's killing.

Foxwell case prosecutors await DNA test results

SALISBURY -- Prosecutors and law enforcement officials continue to wait for reports and test results from state agencies before moving ahead with plans to charge a dual-state registered sex offender with the murder of Sarah Haley Foxwell.

An estimated 200 items were submitted to the Maryland State Police Crime Lab for DNA tests, according to Wicomico County State's Attorney Davis Ruark.

Foxwell's body was found by a team of investigators on Christmas Day in a rural Delmar area. Earlier that day, 3,000 volunteers reported to Arthur W. Perdue Stadium to help find the 11-year-old girl who was reported missing by family members two day earlier.

Her remains were released from the Office of the State Medical Examiner's Office last week, but an autopsy report has not been completed at this time. Preliminary reports showed Foxwell suffered multiple injuries and the state medical examiner has determined the girl's death was a homicide, according to Ruark at an earlier news conference.

It could take up to three months to get the results back, but Ruark hopes to have preliminary results within 45 days, he said.

"Ninety days is a realistic range," Ruark said. "This is a high-priority case for the state police crime lab and the State Medical Examiner's Office."

Foxwell, a Wicomico Middle School student, was reported missing Dec. 23 after her aunt and legal guardian, Amy Fothergill, realized she was missing around 8:30 a.m. and called police. The last time Foxwell was seen alive was around 9:30 p.m. when she went to bed Dec. 22, according to court charging documents.

Fothergill told police a man she had dated for about a month, Thomas James Leggs Jr., was a registered sex offender. It's unclear at this time if she knew this information while she was dating him.

By 11:34 p.m. the day she reported missing, Leggs, a Salisbury resident and registered sex offender in Maryland and Delaware, was in police custody and had been charged with burglary and two counts of kidnapping, according to court records.

Prosecutors expect the case to go before a grand jury for indictment, but it could be months before the case makes its way to a Circuit courtroom.

"Time is on our side," said Wicomico County Sheriff Mike Lewis at a Wicomico County Council meeting. "He (Leggs) is being held at the Wicomico County Detention Center without bond. Once we charge him, the clock is ticking. It's a strong case. There is no urgency to charge him with murder."

Records reveal troubles in Sarah Foxwell's family

SALISBURY -- When Sarah Haley Foxwell was reported as missing two days before Christmas, news of her disappearance spread quickly and spurred Lower Shore residents to action.

More than 3,000 mothers, fathers and children east of the Chesapeake Bay Bridge held onto hope Christmas Day as they traveled before daybreak to Arthur W. Perdue Stadium to help search for the 11-year-old Wicomico Middle School student.

Nine hours later, outside the stadium in the rain, Wicomico County Sheriff Mike Lewis announced that a search team had located Foxwell's badly burned body in rural Delmar, less than eight miles from the girl's home.

And in the midst of their tragedy -- as heart-sickened people wondered how something so tragic could be allowed to have happened -- Foxwell's parents and aunt became the subject of scrutiny and ridicule. Where were the parents, Jennifer and Thomas Foxwell?

In conversations across the community, people have also wondered about the little girl's aunt, Amy Fothergill, following the arrest of the man charged with her disappearance. Fothergill told police she dated Thomas James Leggs Jr., a 30-year-old dual-state registered sex offender, for a short period about a month before her niece was abducted from her bedroom.

While it isn't known publicly whether Fothergill knew Leggs was a registered sex offender while they were dating, the aunt has been second-guessed in her role as caretaker; questions have swirled over how she came to be the designated guardian of Sarah "Haleybugs" Foxwell and her siblings.

Family statement
Court records do not state exactly when Foxwell and her siblings moved in with their aunt, but a Wicomico Circuit Court judge on Oct. 7, 2008, ordered Jennifer Foxwell to pay Fothergill $150 a month to support the six children.

Since the time of Foxwell's disappearance, her family has declined numerous interview requests. However, Jennifer Foxwell and Fothergill released a brief jointly written statement to The Daily Times last week.

"For a variety of reasons, Amy stepped in to care for the children until Jennifer got on her feet," the statement reads. "By agreement, both Jennifer and Amy felt this was in the best interest of the children."
Foxwell's family did not offer specific reasons why Sarah and her siblings were living with their aunt. Court records, however, document a trail of events leading up to the removal of children living with Jennifer Foxwell at the time following a visit from a Department of Social Services employee.

Child care issues
More than two years before Sarah Foxwell was abducted and killed, her mother was indicted on two counts of reckless endangerment, two counts of confining an unattended child and two counts of contributing to the delinquency of child, all on Oct. 22, 2007.

The charges were placed on the stet -- or inactive -- docket on March 18, 2008.

According to a police report obtained by The Daily Times, a Department of Social Services employee visited Foxwell's home at about 10 a.m. Aug. 1, 2007, after Foxwell missed a meeting at New Transitions, an organization that provides mental health services.

As the DSS employee walked by a parked van in the driveway on her way to the door, she saw Foxwell's 4-year-old child inside the vehicle.

The windows in the van were up. The doors were locked. At the time, the temperature was 82.9 degrees with 56 percent humidity, according to the employee's report.

The DSS employee knocked on the door twice before the mother of six answered the door. After Foxwell came the door and the DSS employee asked her about the child in the van, they both walked toward the vehicle.

As they got closer, they realized Foxwell's youngest child, who was 2 years old at the time, was also in the van.

She would later tell investigators she took medication earlier that morning and feel asleep while lying on the couch.

The father of the one of the children in the van, Adam Powell, who was then 31 years old, was asleep in the bedroom.

Foxwell went back inside the house to get the keys and let the children out.

DSS removed the children from the home and placed them with relatives while the incident was under investigation, according to the police report.

Seven days later, during an interview with detectives, Foxwell said she hadn't known the children were in the van.

Emergency custody complaint
A month before the visit from the DSS employee, Foxwell's maternal grandmother, Roberta Wechsler, filed an emergency complaint for custody of Foxwell and her siblings in Circuit Court on June 8, 2007.

Wechsler withdrew the petition June 29, and the judge dismissed the case.

The six-page complaint, filed by private attorney Lenora Mihavetz on behalf of Wechsler, identifies the grandmother as the plaintiff and Jennifer Foxwell, as well the children's fathers -- Adam Powell, Thomas Foxwell III and Steven McCune -- as defendants.

At the time the complaint was filed, Thomas Foxwell III was incarcerated in the Wicomico County Detention Center. He alleged in records at the time that he was "virtually absent from the minor children's life for the last 3 1/2 years."

Court records indicate Thomas Foxwell has been incarcerated multiple times on misdemeanor charges since 2005. On the day Sarah Foxwell was reported missing, he was in the Wicomico County Detention Center on $1,000 bond, but was later released. He was incarcerated on a theft charge, according to court records.

Unsubstantiated allegations
In the civil complaint for custody, the grandmother said she is seeking sole custody of the children because she feared the children would suffer "immediate substantial and irreparable harm" while in their mother's care.

The complaint alleges Jennifer Foxwell attempted suicide Dec. 15, 2006, in front of the four oldest children, and claims she had a long history of mental illness and suicide.

While her allegations are unsubstantiated but part of court documents, the grandmother also alleged Jennifer Foxwell used drugs, "is under the influence of alcohol the majority of the time" and kept the children from going to school.

The court document accuses Thomas Foxwell of abusing some or all of the minor children, and states that reports of the alleged sexual abuse resulted in an investigation by Child Protective Services of Wicomico County in 2004 through 2005. The alleged investigation determined "that sex abuse by Thomas D. Foxwell III was indicated."

Thomas Foxwell was has not been charged in connection with the sex abuse allegations, according to a search of the state's electronic databases.

Grand Jury Indicts Foxwell Kidnapping Suspect

A Wicomico County grand jury has indicted a Salisbury man for kidnapping, child abduction and first-degree burglary in the Sarah Foxwell case, according to WBOC-TV. 

Thomas James Leggs, Jr., 30, was indicted today.  He is accused of abducting 11-year-old Sarah Haley Foxwell from her Salisbury home last month.  Her body was found in a wooded area near the Delaware-Maryland line on Christmas day.  Her death is being investigated as a homicide. 

Leggs is a registered sex offender in Maryland and Delaware.  He is being held without bond in the Wicomico County Detention Center.

Thomas Leggs Indicted for Sarah Foxwell's Murder

SALISBURY, Md.- Wicomico County prosecutors announced Tuesday that Thomas Leggs Jr. has been indicted on murder charges in connection with the death of 11-year-old Sarah Haley Foxwell of Salisbury, whose body was found in a wooded area of the county on Christmas Day.

Wicomico County State's Attorney Davis Ruark said in a press conference that a grand jury met Monday and formally handed down an indictment of first-degree murder against Leggs, 30, of Salisbury.

Ruark said the state intends to seek the death penalty against Leggs, who is also a registered sex offender in Maryland and Delaware. Ruark said that because this is a death penalty case, Maryland law requires an automatic change of venue and the case will not be tried in Wicomico County. Ruark hopes the case will be tried on the Upper Shore.

Sarah was abducted from her home the night of Dec 22. Her body was found on Christmas Day near the Delaware-Maryland border after a massive search that included more than 3,000 volunteers. An autopsy ruled Sarah's death a homicide and found that she died of multiple injuries.

Leggs, who used to date Sarah's aunt, was initially charged with kidnapping and burglary in connection with the girl's disappearance. According to Ruark, the reason it took so long for prosecutors to charge Leggs with murder was because investigators had to compile and analyze evidence.

Leggs is being held without bond in the Wicomico County Detention Center.

OCEAN CITY -- The Salisbury man accused of kidnapping an 11-year-old girl found dead Christmas Day has chosen to face a jury later this year for a trial on unrelated charges.

A scheduled District Court hearing Monday for Thomas J. Leggs Jr., 30, was scratched because Leggs invoked his right to trial by jury. The charges -- a fourth-degree burglary charge and a count of malicious destruction of property -- will go to Worcester County Circuit Court for trial.

Leggs was arrested Sept. 11, 2009, for allegedly breaking into the Ocean City home of a 24-year-old woman. The two met at Pickles Pub in the resort a week earlier. According to documents filed in Ocean City Circuit Court, on the night of Sept. 2, the victim invited Leggs back to her home in the 900 block of Philadelphia Avenue. However, after Leggs "became too sexually forward," she asked him to leave.

Eight days later, Leggs ran into the woman again, this time at the Cork Bar on Wicomico Street. He apologized for his behavior the week before, and they shared a cab leaving the bar, according to court records. When the taxi arrived at the victim's home at about 1 a.m., Leggs got out of the car with her and asked if he could stay the night. The victim declined, went inside, locked the door and went to bed.

At about 4 a.m., she awoke and found Leggs standing next to her bed, shirtless and with his pants pulled down, according to court documents. She told him to leave and called the police.

A date has not been set for his case in Circuit Court.

In May, Leggs is set to face a Wicomico County jury for allegedly kidnapping Sarah Foxwell, an 11-year-old Salisbury girl whose badly burned remains were found in a rural area east of Delmar three days after she was reported missing. Prosecutors have said they expect to bring murder charges against Leggs later this month in Foxwell's death, but to date he has been charged only with her kidnapping.

Leggs indicted on murder charges – state to seek death penalty

The State of Maryland will seek the death penalty and life without parole for 30 year old Thomas Leggs of Salisbury – who has been in prison since his arrest in the kidnapping of 11 year old Sarah Foxwell of Salisbury, whose body was found on Christmas Day.   Leggs has been indicted on charges including first degree murder and kidnapping.  No trial date has been set.

All of these horrible cases are so difficult to read.  This sweet little girl, Sarah should have been protected.  She should have had a chance at a happy life.  What can we do to stop this?  I am so tired of reading stories of the horrible things that happens to these children.  If laws are made why can't they be followed?  Why don't we have enough money?  Why are the glamorous things in life more important than a child's life?  Why are actors/actresses and athletes paid so much, why can't some of that money be used for the states to ensure that there is enough money to keep these sick pedophiles locked up?  Why don't we ask more questions?  Why aren't more people held responsible?  The parents (they are the two that brought this child into the world)?  The caregiver (they signed off on taking care of this child)?  The caseworker?  Those that knew this evil man...did he break the law...was his address correct?  The judge that released him?  And so on...maybe, if we started holding one another accountable then we would all start paying more attention.  Maybe we would start asking more questions.  Maybe we would be more observant.  Since hanging is legal anymore...these people need to be locked up with no television, no cards, basic food (beans and rice), no weights, no visits or phone calls, no mail, they can sleep five to a cell...no windows, no sunlight...give them their basic needs.  They lost their rights to everything else.  Now, I am talking about pedophiles like this guy here...if the person has a proven mental illness then they still need to be locked away...but, they need to go to a state psych facility.  But, those that are evil...then why give them anything...they need to have a way to be able to release a kind of medication that will knock them out if they get out of hand.  I am so sad about this little girl...if I had known about her...I would have loved to taken her in and given her the life that she deserved to have. :sad:

Md. lawmakers consider tougher laws prosecuting sex offenders

WASHINGTON - Maryland lawmakers will consider two dozen bills on Tuesday cracking down on sex offenders.
Law makers will discuss eliminating good time credits for the most serious sex offenders, which will lengthen prison sentences. In addition, another bill will require stricter provisions monitoring sex offenders.

People who commit any other crimes will now have to go before a judge and not a court commissioner before being released.

Maryland is considering the tougher laws in the wake of the kidnapping and murder of 11-year-old Sarah Foxwell.

Foxwell was taken from her Eastern Shore home and her body was found last Christmas Day. A registered sex offender in the state and in Delaware has been accused in the case.

Michael Busch, speaker of Maryland's of House of Delegates, said lawmakers from both parties support the bill.

"I was profoundly affected by what happened on the Eastern Shore and I don't want to ever see another family have to go through that again. I think this is one of the best packages of bills in the protection of families that we've ever passed," he said.

The bills still have to be discussed in the Maryland Senate.

FOXWELL MURDER: Trial date scheduled for murder suspect

ANNAPOLIS — A package of bills aimed at strengthening the state's sex offender statutes is on a glide path to Gov. Martin O'Malley's desk.

But as lawmakers move to crack down on predators, the chairman of one of the General Assembly's law-and-order committees questioned whether so many proposals would counteract each other.

"When you're trying to do 16 things on one subject you run the risk of screwing it up," said Senate Judicial Proceedings Chairman Brian E. Frosh. "Because one thing conflicts with another or makes it unclear. So there is that danger."

The raft of bills, including legislation backed by Gov. Martin O'Malley, has garnered a renewed awareness among lawmakers since the Christmastime murder of 11-year-old Sarah Foxwell on the Eastern Shore.

Foxwell's body was found on Christmas Day in Salisbury. Police believe she was abducted and murdered by a registered sex offender.

The House of Delegates has passed eight bills that encompass an array of tighter sex offender laws, including legislation that eliminates good behavior credits and establishes lifetime supervision for violent and repeat predators. Another bill increases the mandatory minimum penalty from five years to 20 years for a second degree sexual offense against a child under the age of 13.

"We want to make sure that whatever the Foxwell family went through will never take place again," said House Speaker Michael E. Busch (D-Anne Arundel), who called the package of legislation "one of the most stringent protection plans for children and their families in the United States."

Frosh (D-Montgomery) said the Senate would pass at least some of the more than 30 bills introduced by lawmakers this year to reform sex offender laws.

"I'm guessing it's going to be quite far-reaching," he said.

But with so many bills under consideration, Frosh and others worry about acting in haste and possibly complicating the statutes.

"I think there are too many bills," said Sen. Lisa A. Gladden after the panel held hearings on more than 20 bills over two days last week.

"I think that we have got to manage, and we've got to deal with sex offenders," said Gladden (D-Baltimore), who serves as Frosh's vice chairwoman. "I just don't think we have the right answers quite yet."

Gladden, an assistant public defender in Baltimore, plans to vote against the measures.

"None of them necessarily deal with protection and prevention," she said. "And that's what bothers me about the bills."

O'Malley (D) has proposed bills to increase the types of crimes that would require convicts to register as sex offenders, mandate lifetime supervision of serious and repeat offenders and reconstitute the state's Sex Offender Advisory Board.

The legislature needs to pass laws that have teeth to them, said Del. Michael D. Smigiel Sr. (R-Upper Shore).

"It's important to actually do something and not just give the impression that we did something," he said.

He cited legislation passed in recent years that the state has failed to fully implement, including the law mandating the advisory board which was created in 2006, but has never met.

"The Republican legislators have been putting in these bills for years and years and years," said House Minority Leader Anthony J. O'Donnell (R-Calvert, St. Mary's).

"We've always been the leader on this issue. The fact that the governor comes to the table in an election year — people can make their own decision on what that means. But I can tell you, he wasn't there in previous years."

Meanwhile, the bipartisan Eastern Shore delegation has crafted an omnibus bill that combines a number of proposals used around the country in a single bill, which was heard Tuesday in the House Judiciary Committee.

Del. James N. Mathias Jr. (D-Lower Shore), who represents the district where Foxwell lived, said he feels "a moral responsibility" to move the legislation forward.

Frosh fears the bills, passed as a whole, could have unintended consequences.

"Many of the bills sweep what could be less serious offenses into the big net," he said.

For example, under proposed legislation, indecent exposure is an offense that could require years of supervision.

While some people indecently exposing themselves could be seen as a threat as sexual predators, others, such as people relieving themselves in public, might not be, Frosh said.

Gladden said she worries that the legislature could act impulsively and pass bills with unforeseen consequences that will take years to undo.

"I think it's unfair to the system to do something because you have to for political reasons," she said.

So why is this the year for such comprehensive legislation?

"Because we've got all these bills before us," Frosh said.

"Because Sarah Foxwell was murdered in December and because it's an election year. There's just a confluence of circumstances that put it on the front burner."

SALISBURY, MD. — A judge has granted an automatic change of venue to a man accused of kidnapping and killing an ll-year-old girl last year.

Lawyers for 30-year-old Thomas J. Leggs Jr. of Salisbury made the request to move his trial in Wicomico County Circuit Court on Thursday. The request was automatically granted because prosecutors have said they will seek the death penalty.

Leggs, a registered sex offender, is charged with first-degree murder and numerous other offenses in the death of Sarah Haley Foxwell. She was kidnapped from her Salisbury home on Dec. 22; her body was found Christmas Day.

The location and date of Leggs' trial have not been determined.

SALISBURY -- Less than two weeks before going on trial for murder, the Salisbury man charged with the kidnapping, sexual assault and death of 11-year-old Sarah Haley Foxwell has moved for a jury outside Wicomico County to hear the highly publicized case.

Thomas James Leggs Jr., 30, on Thursday filed for a suggestion of removal from Wicomico County Circuit Court, or a change of location of the case, on the grounds he cannot receive a fair and impartial trial in the local jurisdiction, according to court records.

Leggs was indicted March 5 in Wicomico County and charged with first-degree murder, burglary and sexual offense, kidnapping and unlawfully taking a child under age 16 after Foxwell's badly burned body was found Christmas Day in a wooded area near Delmar.

Foxwell was reported missing Dec. 23, drawing media attention and throngs of volunteers who reported to Wicomico County Sheriff's Office command stations at Arthur W. Perdue Stadium in Salisbury, where teams formed and scoured the region in search of the girl.

The state in March filed a notice of intention to seek the death penalty, a move that by law automatically grants the defendant's request for a change of venue, Wicomico State's Attorney Davis Ruark confirmed Thursday, but would not comment further.

"This is the type of case that I would have no comment," Ruark said.

Asked whether the state would have sought a lesser penalty knowing the defendant would seek to relocate the trial, Ruark said, "no."

"We filed a death penalty notice and we intend to pursue the death penalty," he said.

Leggs' attorneys are Katy C. O'Donnell and Kay Beehler, an assistant public defender, both of Baltimore, court records state.

A new location of the trial-- originally set to begin May 24 -- will be determined by 1st Judicial Circuit Administrative Judge Daniel Long of Somerset County Circuit Court, the state's attorney said.

SALISBURY -- Vandals overnight Thursday damaged the grave of 11-year-old murder victim Sarah Haley Foxwell, a confidential resting place with a location unknown to most.

Repairs came in less than a day after the vandalism, said Wicomico County Sheriff's Office Chief Deputy Gary Baker.

Finding the culprit responsible for removing a granite vase attached to a matching stone at the undisclosed grave isn't expected to be as swift, and police are asking for the public's help.

"We are looking for information; it's going to be tough," Baker said Friday. "There is not a lot of evidence. If anybody saw anything, we'd be interested."

Authorities are not convinced that the vandal randomly picked the Foxwell grave over scores of others, some dating back a century, the chief deputy also said. There have been no recent reports of damage to other graves at the cemetery, he said.

"The vase was attached to a flat part of the stone, and somebody kicked it off its stand," Baker said, adding that no other graves were reported damaged. "It appears to have been singled out."

By midday Friday, Salisbury Monument Co. had sent a repair person to re-mount the vase, said Wanda Disharoon, whose family business donated the granite monument as a tribute to Foxwell.

After a public memorial service in late December, burial was a subdued affair at an area cemetery that Disharoon was asked by authorities to not disclose, she said.

Foxwell's badly burned body was discovered in a wooded area north of Salisbury this past Christmas Day, two days after her alleged kidnapping. A family acquaintance, 30-year-old Thomas James Leggs Jr. of Salisbury, has been charged with Foxwell's kidnapping and murder, charges for which the state has decided to seek the death penalty.

Jennifer Foxwell contacted the Sheriff's Office on Friday about the vandalism. She had visited her child's grave Thursday and discovered the damage when she returned Friday morning, Baker said.

Disharoon has seen cemetery vandalism in her years, but not quite like what happened at the Foxwell site.

"There are other vases out, but none of them were bothered," Disharoon said.

A church owns the cemetery, but Disharoon's company routinely checks on it as a courtesy to its many clients with loved ones there, she said.

"Usually kids who vandalize, vandalize (several) graves. It is uncommon to vandalize one stone."

SALISBURY, Md.- Thomas J. Leggs Jr. will stand trial next spring for last December's kidnapping and murder of 11-year-old Sarah Haley Foxwell of Salisbury, authorities announced Tuesday.

The trial will begin April 18, 2011 in Cecil County, according to Wicomico County State's Attorney Davis R. Ruark. Retired Kent County (Md.) Circuit Court Judge J. Fred Price will preside.

Leggs, 30, of Salisbury, was granted an automatic change of venue for his trial back in May because it is a death penalty case. That meant that his case would have to be moved out of Wicomico County and to another jurisdiction in Maryland. Cecil County, located on the upper Eastern Shore, was the chosen venue.

Leggs, a registered sex offender in Maryland and Delaware, is charged with first-degree murder, first- and second-degree burglary, kidnapping, kidnap-child under 16 and first- and second-degree sex offenses in Sarah's death.

Sarah was abducted from her home the night of Dec 22, 2009. Her body was found on Christmas Day in a wooded area of Wicomico County near the Maryland-Delaware line after a massive search. The State Medical Examiner's Office ruled Sarah's death a homicide and found that she died of multiple injuries.

Leggs, who has been in jail since the day Sarah went missing, continues to be held without bond in the Wicomico County Detention Center.

SALISBURY, Md. - Hundreds of people said goodbye to a friendly and familiar face in Salisbury, as funeral services for Wicomico County Deputy State's Attorney Sam Vincent were held at the Trinity United Methodist Church.

Many people knew Sam Vincent as a skillful prosecutor. He served the State's Attorneys office for more than two decades.

A motorcade rode through Salisbury in honor of the life and legacy of Sam Vincent.

"Sam was one of those people that exemplifies honesty and integrity," said Craig Scott, Wicomico Masonic Lodge No. 91. "Sam always put himself last and put other people first. He was kind there just aren't enough accolades that I can say to adequately describe Sam."

Sam Vincent was a past master of the Freemasons in Salisbury. Colleagues say Sam often served as a mentor to others in the community.

Outside the funeral, Joel Todd, Worcester County State's Attorney, played the bagpipes in honor of his departed colleague. The two lawyers served separate communities but always remained close friends.

 People who knew Sam Vincent say he was dedicated and well loved.

"Sam was one of those people who works in the background; he wasn't always up front," Scott said. "But he was always there supporting anytime anyone needed him. He will be sorely missed."

Sam Vincent was killed in a car crash on Route 50 last week. He was 52 years old.

Dear God please bless and watch after those involved in this case.  A child missing and murdered on Christmas, an evil family acquaintance guilty, and a hard working prosecutor passing as result of car crash and this poor baby's grave stone damaged by someone.  First time I am seeing this case and it is so, so sad and maddening.  You are safe now Sarah, Christmas everyday!

Yes, she has the best birthday party with Jesus on Christmas. 
This is one where I went and helped search.  It was an experience I will never forget.

SARAH FOXWELL’S ALLEGED KILLER CONVICTED OF MD CRIME

Thomas J. Leggs Jr. was convicted Thursday for fourth-degree burglary stemming from a September 11, 2009 incident where he allegedly broke into a woman’s home in Ocean City, Maryland.  The victim claims she never gave the convicted sex offender permission to enter her house and she woke up in the middle of the night to find a naked Leggs standing at the end of her bed masturbating.  He was given a three year maximum sentence from the judge.  ::MonkeyEek::

On April 18, 2011 Leggs will be on trial for the kidnapping, rape and murder of 11-year-old Sarah Foxwell. Sarah’s body was found on Christmas morning and he is facing the death penalty in that case.  If Leggs is, in fact guilty and responsible for Sarah’s death, there is an obvious escalation in sexual attacks between the alleged September 11, 2009 incident and the abduction of Sarah. Either before, or in the interim, police fear there may be other victims who have not yet come forward.  Leggs was given a three year sentence from the judge on Thursday.

The 11-year-old child was allegedly abducted from the bedroom she shared with her 6-year-old sister in the middle of the night. Police say Leggs knew the family because he dated Sarah’s aunt, who is Sarah’s legal guardian.  Police believe Sarah was snatched around 1 a.m. on December 22, 2009.  Her 6-year-old sister told police she woke up to “Mr. Tommy” in their bedroom talking to Sarah. Investigators were called at 10:02 a.m. and, based on the information they compiled, police were able to arrest Leggs and charge him with abduction and burglary within two hours.  Sarah’s aunt told investigators that she had not seen Leggs since 32 days before the abduction. On Christmas morning, thousands of volunteers, including parents and children, gave up opening gifts to search for Sarah. Sheriff Lewis of the Wicomico County Sheriff’s office told me that one little boy even emptied his piggy bank, put it in a baggie and handed it to the Sheriff to donate to the fund to find Sarah.

Sarah’s autopsy is complete, and the Sheriff told me Sarah had many causes of death, all related to the homicide, but he is not ready to release details about the struggle at this point.

To me, the most interesting part of this case is that out of the 171 convicted sex offenders living in Wicomico County, Sheriff Lewis says high risk offender Leggs was one of the few offenders they checked on regularly, though they didn’t have to.  According to the law, Leggs only had to register two times a year with the Wicomico County Sheriff’s office, and the Sheriff’s office wasn’t required to check on him – but they did.  Sheriff Lewis says in 2009 alone they visited the residence Leggs shared with his parents seven times.  They found Leggs living in an 8×14 portable shed in the backyard, and doing cabinetry work for his family’s business. Investigators also found Leggs’ sister and her three children living on the same property.  This information has launched a new investigation to see if those children are victims as well. On a side note, Sheriff Lewis says he frequently visits the school that Sarah’s younger sister, Emma, attends, to have lunch with her. He says the child is doing well.

Public defense attorneys Katy C. O'Donnell, division chief of the Aggravated Homicide Division of the public defender's office, and Kay Beehler, an assistant public defender, argued that cell phone tower data and information related to the location of the suspect, Thomas James Leggs Jr., 31, around the time of the child's disappearance should be excluded.

A report compiled by a Verizon employee for a cell phone that was allegedly in Leggs' possession includes data for specific times and appeared incomplete, O'Donnell said in court.

"We're talking about cherry-picked times," she said.

Judge J. Frederick Price ruled that cell phone information could be used because the Verizon employee listed as a state witness is a qualified expert and he can rely on information from police.

Leggs was present for the hearing on Wednesday. He shuffled into the courtroom in handcuffs, wearing a county-issued navy blue shirt and pants. The handcuffs were removed minutes before proceedings started when the judge granted the request by his attorneys. A Cecil County deputy stood nearby.

The judge also ruled against a request by the defense to exclude DNA evidence. Public defense attorney Stephen Mercer, a third member of Leggs' defense team, asked the court to exclude the evidence because the state did not send the defense records and reports related to the evidence by the court-imposed deadline.

ELKTON, Md. -- A Circuit Court judge is expected to decide today if cell phone data and verbal statements made during an interview with police can be used as evidence during a trial for the man charged in the murder of Sarah Foxwell.

Defense attorneys for Thomas James Leggs Jr., 31, argued cell phone records and data obtained by the police violate Leggs' constitutional right to privacy.

"The fact that the state can pick up the phone, call Verizon and say 'give us what you got' is absurd at best," said public defense attorney Kay Beehler during a hearing in Cecil County Circuit Court on Thursday.

Beehler said data collected from Leggs' cell phone provider and information collected from the physical phone should not be allowed into evidence because the authorities did not have a search warrant when the information was collected. Law enforcement officers should not be permitted to obtain that information without authorization from a judge, she added.

"They could not verify his whereabouts anytime after 1 a.m.," she said.

In addition to cell phone information, defense counsel requested a statement Leggs made to police during a Dec. 23 interview also be withheld from evidence.

ELKTON, Md. — Thomas Leggs Jr. today agreed to plead guilty to all charges in the murder of Sarah Foxwell in exchange for prosecutors removing the possibility of the death sentence.

Leggs, 31, was sentenced in Cecil County Circuit Court to life in prison without the possibility of parole for the murder of the 11-year-old Salisbury girl. He also pleaded guilty to kidnapping and sex offense charges.

Leggs addressed the family in the hearing today, and said he was surprised they had agreed to allow the removal of the death penalty option.

ELKTON, Md. — The grandmother of murder victim Sarah Foxwell took local blogger Joe Albero to task today outside the courthouse where Thomas Leggs Jr. had just pleaded guilty to her granddaughter's murder.

Roberta Wexler accused Albero of trying to profit from the girl's death, using it as his "ticket to fame." She said he claimed that he was going to write a book about the case, and she said Albero had lied when he claimed that he had paid for Foxwell's funeral.

Wexler said Albero and his "cult" of followers had launched personal attacks on her family members.

Don't really know where to post this . . . my thoughts . . . Sarah Foxwell's killer has pled guilty and received life without parole.
I remember vividly the day she was found . . . her little 11-year old body burned and ravaged by someone evil.  I was searching with others down the road, about 6 miles, when the call came to quit looking.  I was up to my knees in snow and muck around a pond and sat right down and cried.  They didn't say then they had found her . . . of course not.  But you knew just as sure as the cold was seeping through my pants, she was found and she was dead.  Go home they said . . . and I did . . . never, ever to be the same.  There are many things in life I will never understand, this is one of them.  I trust God and believe with every fiber of my being that long before the evil destroyed her, her precious, innocent spirit was long gone.  A body may have cried out, but it wasn't Sarah . . . she had mercifully been removed to a wonderous place with no pain, no sorrow, no suffering and assuredly no evil.  Believing that is what keeps me sane.  Thank you Sarah for teaching me so many things about life, including what it means to die.  I look forward to seeing you in all your splendor.

CUMBERLAND, Md.- Authorities say a man serving two life sentences in prison for the  kidnapping and murder of an 11-year-old Salisbury girl has been slashed by another inmate.

Thomas J. Leggs Jr., 31, of Salisbury, is being held in Western Correctional Institution, a maximum security prison in Cumberland. According to the Maryland Department of Corrections, Leggs was slashed three times in the head, neck and hand with a homemade weapon.  They say the fight happened in the dining area of the prison.  Police recovered the weapon, but do not know who attacked Leggs.
