PHOENIX - The attorney representing Elizabeth Johnson, the mother of missing 'Baby Gabriel', is firing back at what is being said about his client.

"She wants the truth to come out," said Daniel Raynak while sitting in his central Phoenix office.  "She's not a monster, she's a young woman who cares deeply about her child."

Raynak agreed to sit down with me for an interview to answer questions about the case of missing Baby Gabriel and what he called, his  frustrations about news stories about his client.

Of course, she is scared, many people in jail are scared, many people in jail also have good qualities.  But I would not consider a person who either killer her child or handed her child off to complete strangers someone who belongs out in public.  Do normal people spray cleaner in someone's eyes?  Do normal people give their babies to strangers in parks?

Another quagmire is brewing in the case of missing Baby Gabriel Johnson, and no one seems to be closer to knowing the child’s whereabouts or well-being than they were 15 months ago when the child disappeared.

A state district court judge in San Antonio ruled on Friday that Jesus Salame, a police detective from that city, will have to testify about an interview he conducted with Elizabeth Johnson, Gabriel’s mother at a Maricopa County jail without her attorneys present.

However, the San Antonio city attorney’s office is considering an appeal to Judge Philip Kazen’s decision to require Salame to testify in Arizona, and to force the city’s police department to provide the recorded portion of the interview with Johnson, who has both said she killed her son and gave him away in late 2009.

“The tape is not relevant to the charges in Arizona,” Bernard said. “It’s part of the evidence here in Texas. It’s really a fishing expedition for the defense. The prosecution in Arizona hasn’t heard the tape, hasn’t asked for the tape and won’t be using the tape. With what is supposedly said on the tape during the interview, I wouldn’t know why the defense would want it. Be careful what you ask for.”

Bernard said the city attorney’s office would confer with the police department as to how much of the judge’s decision would be appealed, and he would know in about a week.

She most definitely is, the lengths she goes to taunt is horrifying.   At this point the judge should have her shackled and dragged in court, unlike her attorney's claims if she is so innocent she wouldnt have a problem appearing for her hearings & certainly wouldnt be writing ranting letters to her ex.

Tammi Peters Smith thought God had answered her prayers for another child when she first spied Baby Gabriel and his young mother at an Indianapolis airport in June 2009.

Gabriel Johnson was 1 month old. His mother, Elizabeth Johnson, 24, of Tempe, seemed "scared, depressed and with a baby who appeared to be underweight," Smith told Tempe police.

Smith, 39, of Scottsdale, had failed in several unconventional attempts to adopt a sibling for her adopted daughter, Hannah.


Smith had asked a pregnant woman at a local Jack in the Box for her unborn baby, offered California military wives in MySpace posts $9,000 to be her surrogate, and had a woman at her Scottsdale residence inseminated with sperm she falsely said was her husband's, according to interviews contained in a Tempe police report.

PHOENIX -- Baby Gabriel Johnson has been missing for more than a year. His mother put him in a car and drove him to Texas, but her stories as to what happened to him once they got to San Antonio are all over the map and could be the difference between life and death for the boy.

“It pisses me off to see her,” said Logan McQueary, Gabriel's father.

McQueary broke his silence Monday for several reasons. Elizabeth Johnson appeared in court for the first time in months, and kept staring at McQueary, trying to catch his gaze. But those glances were not returned.

According to investigators, Johnson has twice admitted to killing Gabriel. But she now maintains that she gave the boy away to a couple in a Texas park, a couple that Johnson says her alleged accomplice, Tammi Smith, arranged for her to meet. Sister, I'm so sad to say I don't believe Gabriel is alive either.    I would like to know what was done and where Elizabeth disposed of him and if his remains might be recoverable for a decent burial.  I wish this for him and for his Dad.  I don't think Elizabeth is going to ever tell what she did and the odds of recovering Gabriel are very, very slim, imo.   ::MonkeyNoNo::

This is a story that Yami has been working on. Ken Gamble the PI believe Gabriel is alive. He believes the phone records shows he is alive. This is only the lead up to the main story. I will try to post that when I can. I am very encouraged by this.

It`s not that I know where he is, but like I told your staff, we`ve all been talking for the past couple days, trying to brainstorm where he is. TAMMI SMITH: No.

CASAREZ: Have you heard anything of where this baby could be tonight?

TAMMI SMITH: Well, I -- since I did get to talk to the detectives and give them the information that Yami from Fox News -- I`ve become really good friends with Yami with Fox News in San Antonio, and she is our digger. She searches and searches for information. And so I was able to give them the information that she gave me. Finally, I was able to give that to them because it`s very hard to get in touch with anybody over there.

CASAREZ: And what is that information?

TAMMI SMITH: I can give you some of the information, but some I cannot. One piece of information is when Elizabeth left, she had a Garmin, which is a navigation system, hooked up in her car and turned on. And when we met up, this was a place where she told us to meet her so there was no reason to have it turned on.

And from what Yami says, her cell phone was -- had a signal in Victoria, Texas, and that was the day that she went missing. And that was the day that she actually got on the bus. So if she had to drive two hours south from San Antonio, why did she drive two hours south down to Victoria, and then drive back up to San Antonio, and then get on a bus to go to Miami? That leads us to believe that that baby is in Victoria..

An Arizona judge stopped a hearing Wednesday on a motion to dismiss the case against Elizabeth Johnson, whose baby son Gabriel was last seen here in 2009, ordering her second mental competency evaluation.

Maricopa County Superior Court Judge Paul McMurdie called for the evaluation following a psychologist's testimony for Johnson's defense team, a court spokeswoman said.

Johnson, 24, has been jailed since her Dec. 30, 2009 arrest, charged with kidnapping, child abuse and custodial interference.

Her previous defense attorneys filed the motion to dismiss the Arizona charges in October, 2010, alleging that a San Antonio Police Department homicide detective violated her constitutional rights in a May, 2010 interview.

Baby Gabriel's mother to have second competency evaluation

Baby Gabriel's mother didn't get the ticket to freedom she had hoped for Wednesday, but she got the next best thing: a second shot at being found incompetent to stand trial.

After listening to testimony about a San Antonio detective whose "over the top" tactics during a jailhouse interview deeply affected Elizabeth Johnson, a Maricopa County Superior Court judge ordered her to undergo a second competency evaluation. Johnson was seeking to dismiss the charges against her.

"A dismissal in a situation like this is a last resort," Judge Paul McMurdie said. "If she is not cooperating with her lawyers, she needs to be restored. If she can't be restored to competency, there is a civil remedy."

That remedy would be to commit her to a psychiatric facility for treatment, said Daniel Raynak, her current attorney. If it is determined Johnson cannot ever be restored to competency, Raynak said, criminal charges could be dropped.

In less than two weeks, Elizabeth Johnson will know whether she is deemed competent to stand trial in the case of her missing son Gabriel — or whether she is on her way to being committed to a state mental hospital.

On Aug. 2, Maricopa County Superior Court Judge Paul McMurdie will rule on the findings of doctors as to whether Johnson is competent to stand trial after he allowed her attorney’s motion in May to have a second psychological evaluation performed on her.

A high-profile trial involving a missing East Valley boy once again has been pushed back, as a judge ruled Friday that his mother is not competent to stand trial.

Maricopa County Superior Court Judge Paul McMurdie said he believes Elizabeth Johnson’s mental state can be restored, and doctors will need to conduct further evaluations that will help him decide whether she returns to court or heads to a state mental hospital.

McMurdie rendered his decision after prosecutors and Johnson’s defense attorney argued for four hours Friday over whether she understands what she’s doing.
Johnson, 24, has been incarcerated in Maricopa County’s Estrella jail on charges of kidnapping, child abuse, custodial interference and conspiracy to commit custodial interference since her December 2009 arrest in Florida following statements to authorities and her estranged boyfriend and child’s father Logan McQueary of Gilbert that she killed her son Gabriel and also that she gave him away in San Antonio. In mid-December 2009, Johnson took the boy to that city and stayed at a motel where she claimed to have given him to a couple she did not know.

McMurdie’s decision is another turn in the case that has gained national attention and now has spanned six attorneys who have tried to defend Johnson, all of whom have said she is not giving them information and they cannot get anywhere with her, including current defender Daniel Raynak. She also has had six evaluations by psychologists, all of whom have made different decisions involving her competency to stand trial.

“I think she’s mentally ill,” Raynak said outside the courtroom.

No further court dates are pending at this time, but doctors again will have to evaluate Johnson and submit their reports to the judge within 60 days.

“This woman is not restorable to competency. It’s never going to happen,” Raynak said. “She has no sense of reality and there is no sense of dealing.

“Not once has she talked about a single fact of the case. Never have I had anyone with a complete lack of inability to focus in on what matters. The closest person on Earth, she won’t confide in,” he said, referring to his client’s grandfather Robert Johnson. “We can’t conduct a defense when she’s going to broadcast what we say to everyone,” referring to recorded jail conversations with relatives and apparent attempts to reach out to news media.

Prosecutors argued that Johnson knows what’s going on.

“She’s very fond of her attorneys until something happens that doesn’t go her way, then she gets upset,” said Maricopa County deputy prosecutor Angela Andrews.
Tammi Smith of Scottsdale, a woman who once was interested in adopting Gabriel, will appear in court in February in charges of forgery, custodial interference and conspiracy to commit custodial interference in connection with the Gabriel case.

“The case is about Gabriel,” McQueary said. “We still don’t know where he is.”

Johnson, who was present in court on Friday wearing a striped jail uniform, stared straight ahead and left the courtroom with tears in her eyes after the judge’s ruling and brief meeting with Raynak.

McMurdie’s decision on Friday marked the second time that Johnson was deemed incompetent to stand trial.

I just got up to speed on this case.  I had almost forgotten about it.  From what I understand, they're basing her mental incompetence on her refusal to speak?  That doesn't make her mentally ill.  That makes her stubborn...and a brat.  I wonder how long she can keep this charade up.  And if her case is thrown out and she is sent to a psychiatric facility, she's still not off the hook, as she could be found competent to stand trial in the future.  Which is worse: spending hard time in prison or spending time in a slightly nicer place and constantly having to fool others into thinking you're nutso?

When the judge read the psychiatrist's diagnosis, stating that Johnson had been restored to competency, there was no argument from her attorneys.

CBS 5 learned moments later that her latest defense team, Daniel Raynak and Marcy Kratter, were withdrawing from the case. This is the third legal team to abandon the case.

Kratter told CBS 5 that they simply and ethically had no choice.

Johnson did tear up and even thanked Kratter as she was led out of the courtroom.

Mother found fit to stand trial in Baby Gabriel case
Once again, the mother of missing Baby Gabriel Johnson, who wouldn't be a baby anymore if he's still alive, has been found fit to stand trial.

And once again, a team of attorneys who were defending Elizabeth Johnson, 25, of Tempe, informed Maricopa County Superior Court Judge Paul McMurdie that they are withdrawing from the case.

In October, McMurdie ruled that Johnson was incompetent to stand trial but restorable, and her next attorney also could argue a psychologist's findings that Johnson is fit to stand trial. This week, based on that report, McMurdie declared Johnson competent.

A new trial date is nowhere in sight, but a hearing is set for Tuesday in which Johnson again will be represented by Vanessa Smith, a Maricopa County public defender.

In the year that attorneys Daniel Raynak and Marci Kratter have represented Johnson, they say she has provided no information and no assistance in her defense, and they are the third such defense team to bow out.

The National Center for Missing and Exploited Children has released a composite image of missing baby Gabriel Johnson.

The image, released early this month by the nonprofit organization, shows what the boy might look like at age 2. Gabriel was last seen in San Antonio on the day after Christmas 2009, when he was 8 months old.

Bob Lowery, a spokesman with the center, said the organization routinely releases composite images of missing children every two years until they're 21, after which it's every five years.

“We do not give up looking for children, even under the most dire circumstances,” Lowery said. “We don't give up hope.”

Gabriel's mother competent to stand trial

PHOENIX (CBS5) - The mother of missing baby Gabriel was back in court Friday morning.

Elizabeth Johnson still didn't offer up any details about where her son might be.

The judge in the case ruled Friday that as long as she gets her medication, she is competent and will stand trial in September.

Johnson hired a new attorney, named Marc Victor, who asked for more time to familiarize himself with the case.

The case could get delayed even further because the judge will soon be transferred out of criminal cases.

Trial in missing 'Baby Gabriel' case still months away

In another court maneuver and attempt to keep Elizabeth Johnson in check, a clinical liaison has been appointed to make sure the mother of missing “Baby Gabriel” stays on her medication so she remains competent to stand trial.

Yet, the beginning of that trial, which was supposed to start early last month, remains at least seven months away.

Johnson, who has been charged with kidnapping, child abuse, and custodial interference, is scheduled now to go to trial in September. Since her arrest in 2009, Johnson has remained incarcerated in a Maricopa County jail on a $1.1 million cash bond. In a case that has received national attention, Johnson has both said she killed her son and gave him to a couple she didn’t know in San Antonio.

The trial will provide Johnson, 25, the second time to answer questions as to what she did with Gabriel, who was 8 months old when she took him to San Antonio in late December 2009 while in the midst of a custody battle with Logan McQueary of Gilbert, Johnson’s estranged boyfriend and the father of the boy.

2 women about to face trial in baby Gabriel's disappearance

Now, both women are just days away from facing trial for his disappearance.

According to a memorandum filed by her attorney, Smith's psychologist said she acts impulsively without reflection where children are involved.

In Arizona, that's not allowed to be used as an excuse for a crime but her attorney believes it helps explain why she would help Johnson escape the state with her son, Gabriel.

Smith said her plan was to adopt the boy without his father's knowledge but once Johnson drove across the state lines, the boy was never seen again.

"It's in her nature to feel compelled to help, because of her religious beliefs, again because of her family background. She feels compelled to help, particularly when she perceives a woman in trouble or child in trouble," said Smith's attorney, Anne Phillips.

According to the filing, Smith is easily manipulated in stressful situations, in part to a history of abuse from her father and first three husbands. Because of that history, her psychologist said she is naively and unrealistically trusting.

"Her character in general causes her to act a certain way. Not with criminal intent but more in a misguided attempt to help," said Phillips.

Prosecutors are trying to keep Smith's psych evaluation out of court and are expected to paint her as a woman obsessed who would do anything to adopt Gabriel.

Smith's attorney predictably disagrees.

"What I think happened is that Tammi, a good citizen, a good Samaritan, a law-abiding person, got involved with the wrong person and it spiraled out of control," said Phillips.

I tend to agree with the prosecutors.  I'm of the opinion it wasn't merely a matter of being a good citizen, Tammi Smith had an agenda, and that was to adopt Gabriel.

Tammi Smith, the Scottsdale woman who wanted to adopt Baby Gabriel, is headed for trial on charges connected to the December 2009 disappearance of the 8-month-old child, whose plight remains a mystery.

Jury selection began Monday and opening arguments are scheduled for next Tuesday in the case of Smith, 40, who is charged with forgery and conspiracy to commit custodial interference in her alleged role in Gabriel's unknown fate.

Court records portray Smith as a woman desperate to adopt Gabriel from his unwed mother and to keep him from his father, Logan McQueary, 27. Smith had already adopted her husband's granddaughter and seemed on a mission to add Gabriel to the family, according to court records.

Missing Child's Father Accused of Selling Stolen Property

PHOENIX - There's new information surrounding a missing child's father. Logan McQueary is back in trouble with the law.

McQueary is the father of Gabriel Johnson, a boy who went missing in 2009.

McQueary has been arrested five times in the past eight years. The latest incident was for trying to sell a stolen Nintendo Wii at a pawn shop.

He'll be in court on Monday, just one day before the trial is set to start for Tami Smith, a valley woman accused of helping Gabriel's mother after she left the state

PHOENIX (AP) — Jurors won't get to hear a statement by the mother of a missing Arizona baby in which authorities say she told a police detective that she killed the boy in Texas, a judge ruled Monday.

Maricopa County Superior Court Judge Paul McMurdie issued the ruling regarding the upcoming trial of Elizabeth Johnson, 25, saying her constitutional rights were violated when a San Antonio detective interviewed her in a Phoenix jail without her attorneys being there or even knowing about the interview.

"It was inappropriate, and I would go so far as to say an un-American-type of thing to do," Johnson's attorney, Marc Victor, told reporters after the hearing, which Johnson chose not to attend. "This is a real slap in the face of the Constitution and our justice system."

McMurdie declined a request by the lawyer to dismiss all the charges based on the constitutional violation.

Johnson has pleaded not guilty to child abuse, kidnapping and custodial interference in the case of her missing son, 8-month-old Gabriel.

Investigators said Johnson drove the boy to San Antonio from Tempe in December 2009, stayed about a week then took a bus to Florida without him. She was arrested Dec. 30 in Florida and returned to Arizona.

Gabriel has never been found, and police still don't know if he's dead or alive.

Johnson has provided conflicting stories about what happened to Gabriel. Police say she texted the boy's father that she killed Gabriel and put his body in a trash bin. She later recanted and said that she gave him to a couple in San Antonio.

Johnson's statement to the boy's father, Logan McQueary, could be used at her trial.

McQueary, who detectives do not suspect in the boy's disappearance, also was in court Monday in a separate case. He pleaded guilty to a misdemeanor count of theft and was sentenced to a year of probation.

On Monday, Maricopa County Superior Court Judge Paul McMurdie ruled that admissions Johnson made about killing her son to a detective from San Antonio, TX, in a Phoenix jailhouse interview in May of 2010 violated her Sixth Amendment rights because she was questioned without an attorney present. Her attorneys also didn't know the interview was going to take place.

There was also some question as to whether a detective from another state has the legal right to question a suspect about a case in Arizona. The ruling means the statements Johnson made to the detective can never be introduced in court.

Also, Victor said the detective abused his power to convince Johnson that he was working for her and not the state of Arizona.

"She could even testify and say something radically different and they still couldn't use that statement to impeach her," said her attorney, Marc Victor.

Victor said the state can only now rely on physical evidence in the case.

He called the ruling a "big victory" for him and his client.

McMurdie declined Johnson's request to dismiss the case based on the constitutional violation.

McMurdie is allowing Victor to work with the jail about changing the requirements for Johnson during jailhouse interviews. 

Johnson is shackled by her hands, feet and crotch for interviews now.  Victor said he feels the confinement restricts her comfort level during their meetings.

PHOENIX (AP) — Prosecutors on Tuesday painted the would-be adoptive mother of an Arizona baby missing for more than two years as an "obsessed" woman who would stop at nothing to win custody of the boy, while defense attorneys said she was just looking out for the child and his mother.

The attorneys spoke during opening statements in Phoenix on Tuesday in the trial of 40-year-old Tammi Peters Smith, who has pleaded not guilty to charges of forgery and conspiracy to commit custodial interference in the case of missing baby Gabriel, who was 8 months old when he was last seen in December 2009 in San Antonio, Texas.

Gabriel's mother, Elizabeth Johnson, has said she killed Gabriel and dumped him in a trash bin but later recanted and said she gave the baby to a couple in San Antonio.

Gabriel has never been found and police still don't know whether he is alive.

Smith is charged in the case for her involvement with Johnson and stands accused of lying on a court document about the possible paternity of the baby and trying to keep Gabriel away from his father, Logan McQueary, who is set to testify against Smith later Tuesday.

"To the defendant, Gabriel Johnson was a thing to be desired — a prize, an object. She wanted a baby and she would go to any length to get one," prosecutor Elisa Ramunno told jurors.

She said that Smith's initial plan with Johnson was to make life so difficult for McQueary that he would eventually get fed up and agree to give the baby to Smith and her husband, Jack. When that wasn't working, Ramunno told jurors that Smith and Johnson planned to have Smith take Gabriel out of the state in an effort force McQueary to sign adoption paperwork.

Just tuned in to InSessions.  But after reading last few pages and Elizabeth's remarks to Logan about killing baby and now her confession to PD being thrown out. I have no doubt that precsious lil' guy is no longer with us.  I believe she did kill him. Especially after also reading her actions and words before and what she did with baby and Logan.

I listened to the tapes, I do not know what to think. 

Tammi was cool, calm, and collected during interviews, after GJ disappeared, puzzles me.

There are six women on the Jury, they will give TS a Pass, and not to jail, IMO. :(

Lemme tell y'all how dense I am...I didn't realize that EJ claims that Tammy Smith set up the adoption in which she handed poor lil Gabriel off to strangers in a park.  Now, I really do believe she was self centered and mean enough to have suffocated the baby and that IMO is what really happened.  I just thought Tammy was on trial for illegally trying to adopt Gabriel and forging court documents only (or some charges to that effect).  I missed that important part of the adoption set up.  Maybe Tammy is a baby broker?  Who knows what the truth is but I do know she's a real nut!  Come to think of it, I bet jail doesn't even bother EJ!  She has a home, food, probably "admirers" in and out of jail, no baby to drag around and feed, etc.!  Every photo I saw of that precious baby he looked so drugged up by something.  Millions of people would have taken and loved that baby and she has done who knows what to him.  Shame on her and I hope some day, in some way she suffers for it and actually feels the pain from it!

Am I missing something?  Prosecuter shows the evidence taken from TS house via warrant by the detective, but they don't discuss the contents (Harddrive and papers).  What is the jury supposed to gain from just knowledge of the existance or evidence, but not the substance?

Also, they just announced the name of the "anonomous tipster"in FL, including to what extent they went to to find them and their #.  What does the "anonomous" part of that means?

She seemed to really enjoy the fame once NG picked up on this back when Gabriel went missing.  Her story on NG changed many times, and she always had that smirk/sheet-eating-grin back then. 

I found it interesting how she cryed yesterday when the prosecution was asking Logan if Tammi mentioned the daughter she adopted was in fact Jack's grandchild.  She sure tore Jack's daughter apart in the one call they played.  Tammi also mentioned that Hannah's father wanted nothing to do with her/ split quick.  He was all over the boards when this story first broke about how he has been fighting to get Hannah.  Not sure what is the truth. 

They have not mentioned that the Smith's  have Jack's other granddaughter now as well - a new baby girl that was born last year.  Not sure how they could have custody of a baby when these charges are hanging over Tammi's head.

Hmmm, I wasn't aware of that. Interesting info. though.  But your right, who knows the truth, however, they do have custody.  My only opinion, I feel pretty sure about, is that EJ did kill the baby.  She was obviously unstable on those calls, then admitted it again to the police.  Why else?  Tammy is just guily of what she is accused of.  IMOO

Something else that I find somewhat disturbing.  How they "supposedly" kept Hannah's mom involved, explaining to Hannah that she is the biological mother because she is the person who's Belly she came from?  Like that's what they were going to do with Gabriel, as well.  Assume for a moment, since they were telling Logan this, that EJ disappeard and left them to have custody and he could visit anytime, how were they going to explain "how" HE was his biological father?  How is a 4 yr supposed to understand that?  I just find find it an odd way to explain something like that to a child of an age who has no comprehension of what that means.

No one in this case seems to be able to call the police.  If Tammi Smith really had concerns for Baby Gabriel, she would have called the police instead of having documents forged, etc.  If EJ really wanted Baby Gabriel to go to a good home, she would have gone through an adoption agency that was legitimate.  Who, in this day and age, texts someone that they are going to kill a baby?  Why was EJ allowed to be alone with this beautiful child to begin with?  She had rage issues that were way out there, not just little issues.  This beautiful child was used as a pawn by at least 3 adults.  If there was truly an adoptive couple that makes more than 3 and if Tammi's husband was involved, that makes another adult.  This is so very sad.

Everything is tit for tat, even the father stealing a Wii because someone stole his mountain bike.  Gabriel was nothing more than an 'item' to be used for another game of tit for tat.  I can understand why someone would want to get involved, so I don't doubt Tammi would want to get involved, but it appears, she also got involved for selfish reasons.

No, No Rose, I don't think Tammi's machine is being used double time, I think she is full of it, and it is not being used at all. 

I wish Baby Gabriel had one true advocate in the bunch, but it does not appear so, not even EJ's Grandfather.  He knew what she was like, he appears to enable her.

This is all opinion, but for all the people saying how much they want this beautiful baby, he does not appear to have anyone who truly loves him as a child, only as an object.

Poor baby.  My heart breaks for him.

Enima woman looks PO'd as prosecutor going over all instances of her trying to get pregnant or getting someone else pregnant and adopting the baby.  They are in front of judge without jury right now going over relevance of testimony of her desperately wanting a baby to the point that she wanted to do artificial insemination at her work place.

According to prosecutor, Tammi told her friend that she wanted to inseminate someone in her office and wanted to tell that person it was Jack's sperm even though Jack is shooting blanks.  So where was she going to get the sperm from?   ::MonkeyEek::

Judge will not allow testimony about inseminating in the office but will allow all the other evidence and testimony about her surfing the net looking for babies and surrogates. Will also allow testimony about Enima woman talking to a friend about get the friend's husbands sperm for insemination and then if there were twins each get one of the twins.  I can not believe I am hearing this.  WTH????

Tammi is now breaking down.  Her attorney asking to allow other lawyer to take her out of court to get her composed.  Tammi just blurted that it is hard to listen to the prosecutor who is telling total lies.  Judge told her not to make statements and to keep her yap shut.

Tammi's lawyer now telling judge she does not think Tammi will be able to get through the next witness testimony who was her friend with the husband she wanted sperm from, without having a melt down and acting out.  Judge told lawyer they had to keep their client in control and that if they think she is about to act out to let him know so he can do something before it happens for the jury to see. 

Sounds like an interesting day in court today.

A woman who almost gave her baby to Tammi Smith said she changed her mind when Smith suggested ways to adopt the baby that made her feel “uncomfortable.”

Rachel Hoover says she met Smith at a Jack in the Box when she was six months pregnant. She testified Thursday that Smith talked to her about adopting her baby. Hoover said she got uncomfortable when Smith suggested she put Smith's husband's name, Jack Smith, on the baby’s birth certificate.

Baby Gabriel's mom: Smith planned the adoption

Baby Gabriel’s mother told police that Tammi Smith orchestrated an illegal adoption of her baby. Jurors in the Smith trial watched a video of that conversation Wednesday.

In the video, Elizabeth Johnson says Smith arranged to meet in a San Antonio park, and that when she met them, they introduced themselves as “Tammi’s friends.” Johnson sounds emotional when she tells police that she strapped the child into the couple’s car seat and said goodbye.

Also on Wednesday, jurors heard testimony from an undercover detective who helped wiretap Smith’s phone during the investigation. Several recorded phone calls were played in court. In one of the calls, Smith is heard laughing about the fact that the name of her cousin, Craig Cherry, is on a paternity document for Gabriel. That document is the basis for the forgery charge, but in one of those recorded calls, Smith tells Cherry several times that Johnson is the one who wrote his name on the document.

Meanwhile, we could hear from Smith herself as early as Monday.

Defense moves for a mistrial due to what defense calls "improper testimony" from Det. Ramirez. Judge Kreamer says he'll take defense's motion for a mistrial under advisement, but he "[doesn't] think" he will make the leap for several reasons, including the fact that the defense stipulated to the admission of the recording. Kreamer also doesn't want to potentially open the door to more problems, in regards to playing the next audio recording, so the defense has this current break to look over it.

As for another audio recording, Exhibit 226, defense either wants it inadmissible or have the whole thing played. The judge says defense's request is slightly contradictory and the State has the right to play or not to play whatever they want and the defense, if they want it played, can do so in cross. PHOENIX - Tammi Smith cried in court Monday as she listened to a two-hour taped interview between her and a Tempe police detective regarding the case of missing baby Gabriel.

At one point, lead detective Patricia Ramirez seemed to catch Smith in a lie when Ramirez asked Smith if she ever forged a court document in an attempt to adopt Gabriel Johnson, the baby boy who disappeared in December of 2009.

“I didn't sign any paperwork and I didn't file any paperwork,” Smith told Ramirez during the interview.

But Ramirez then showed Smith a court document which caused Smith to change her story.

“Oh, okay, so that is my writing. Yes, right here that is mine,” Smith told Ramirez.

Today, the Defense calls it's first witness, Jack Smith. At the end of yesterday, the Judge called Jack in, stated that an attorney had been appointed to him and went over his 5th Amendment rights so that he would not incriminate himself. The judge asked Jack how he wanted to handle that, if the occasion arises....did he want the lawyer sitting next to him while on the stand or did he want him sitting in the gallery? His lawyer stated that Jack would ask for a break, rather than stating he would be taking the 5th. The Judge said okay, as long as he didn't do that often, due to the jury being led out of the courtroom for a break. He doesn't want them in and out, in and out.

I was a little surprised that an attorney had been appointed to him. I thought only those who could not afford an attorney are appointed one, and he is a witness, not the defendant.  Maybe all their money has been used on Tammi's defense, IDK.  (I keep thinking of all those young people in the CA trial that had to go out and get an attorney.)

PHOENIX -- North Scottsdale resident Tammi Smith broke down in tears Tuesday as prosecutors in her high-profile forgery and conspiracy case continued to hammer away at the woman they say broke the law in her obsessive pursuit to adopt an adorable little 8-month-old, blue-eyed boy named Gabriel Johnson.

Prosecutors played for jurors both video and audio recordings of interviews with Smith conducted in the days and weeks following the mysterious disappearance of Baby Gabriel in late 2009.

Among the recordings, and certainly the most dramatic, was a so-called "confrontation phone call" between Baby Gabriel's mother, Elizabeth Johnson, and Smith.

The call was made by Johnson to Smith under the guidance of Tempe police shortly after Johnson was locked up in a Maricopa County jail on charges that she kidnapped her child and then somehow got rid of him in San Antonio.

"You set this up," Johnson tells Smith on the recording, "and all I did was what you told me to do."

A clearly irritated Smith counters, "Elizabeth, I never told you to go to San Antonio."

At one point Johnson accuses Smith of throwing her "under a bus" to which Smith responds, "You belong under the bus."

Can anyone follow what Tammi is saying?  Everytime she is asked a simple question she talks and talks and then goes to great detail explaining stuff that has nothing to do with the question and I am having a heck of a time following her verbal diarrhea. Green smoothies, a little tipsy, a party and how is this all connected with the question of "did you go to Elizabetha's trailer?" Is there a Rosetta stone for Tammi speak?

Why is the prosecution not objecting to the story telling that Tammi is doing including her voices, hand motions and facial expressions?

No, No and No.  I have no clue what she is chatting about, I turned the TV off.

Closing arguments were made Tuesday in the case of Tammi Smith, the woman accused of forgery and custodial interference in the case of missing baby Gabriel.

This case is now in the hands of the jury.

It has been five weeks of a very complicated trial, centered around 40-year-old Scottsdale mom Tammi Smith and her desire to adopt a baby.

In closing arguments, prosecutor Angela Andrews painted Tammi Smith as a desperate woman.

"We can show the defendant wanted to have a child of her own. She was doing everything she could to make sure she found a sibling for a child she already had," said Andrews.

The question is, did Tammi Smith break the law in her efforts to adopt 8-month-old Gabriel Johnson?

She is charged with forging a court document lying about who Gabriel's father was, and interfering with parental rights.

Smith is not accused in the baby's disappearance. It's the baby's mom, Elizabeth Johnson, who is in jail awaiting trial in the baby's disappearance.

To this day, no one knows what happened to the child.

In her closing argument Tuesday, prosecutor Angela Andrews slammed Smith as a manipulative liar, saying, "The defendant wanted this child for herself. She wanted to make Gabriel Johnson her own and she was going to do that at any cost to Logan McQuery."

During her closing argument, Smith's defense attorney, Ann Phillips, told jurors that her client "was not obsessed" and that "it's not a crime to want to adopt" a child.

Phillips then laid blame on Johnson and on Tempe police, saying Johnson manipulated Smith and that Tempe cops "needed a villain."

Today is 3rd day of deliberations.  At end of day yesterday they had only actually deliberated for 4.5 hours.  I hope I am wrong but I am feeling a hung jury coming up.

Questioning his paternity. To do this, Smith forged the name of her cousin, Craig Cherry, on an official document as a possible "real" father of Gabriel.
 
Urging Johnson to go to woman's shelter and claim McQueary beat her.
 
Going to a jurisdiction where it was harder for fathers to establish rights. This had worked for Tammi and Jack Smith when they adopted Hannah, the first illegitimate child of Jack's daughter, whom they adopted in Tennessee, according to testimony.

Complaining to a judge every time McQueary was late with any payment or didn't return Gabriel on time to his mother.

My question is this;   how can these young wome ( Elizabeth, KC, etc ) just sit in jail watching their youth go by?   I have several male family members who have been , or are in, prison   They woud do anything to get  leser sentence or to get out.   

Seems to me they would make deals for time served.

The mother of an Arizona baby missing for more than two years wants a felony child abuse charge against her dropped before her trial begins in September.

Elizabeth Johnson appeared in a downtown Phoenix court on Tuesday, shackled at the wrists and ankles and wearing a black-and-white jail uniform, her long brown hair pulled back in a ponytail.

The 25-year-old's attorney, Marc Victor, is seeking to get a child abuse charge against her dismissed, saying that there's no proof of child abuse, and even if Johnson's son, baby Gabriel, was abused, it would have happened in Texas. The boy was 8 months old when he disappeared in December 2009, and he was last seen in San Antonio.

‪#TammiSmith‬ appears composed but tense. Her husband is in the first row holding a paper that could be his statement to the court.

Why would he be allowed to give a statement? I thought that only victim impact statements were read at sentencing?  What is he going to say other than she is a good woman....yada yada yada?

Here we go. First thing,  defense attorney asks to approach the bench.

Tammi looks disheveled

Turns around and is motioning to someone behind her.

Something about evidence being presented and constitutional right

Judge rules for the state.  Can present aggravating factors.

Judge has reviewed presentencing report
Also read letters from the McQuery family
Also read letters who are supporters of Enima Woman
Also read lots of letters from people all around the country about Baby Gabriel

Judge not taking letters from random people not connected to the case into account

Logan's Dad now making a statement:
Sill no idea where Gabriel is
They fear the worse
Fear they will never see him again
All because of the actions of Enima Woman
Not heard any remorse from Enima Woman
She has never been media or camera shy
No apology or sorrow heard
She set out to take Gabriel
They have no future with Gabriel
Thinks she should go to jail and be removed from her family for a while to feel a bit of the same pain they are feeling
Logan wrote a letter
Logan does not feel judge can understand what Logan has gone through
Wants her in jail
Enima Woman hides behind using God to say she should have had Gabriel

Wow, will judge be leaning towards probation due to Logan's letter??

Prosecutor now making presentation:

State did not know till last night what sentencing they were going to ask for
Presentence report recommendation set prosecutor aback
Writer of report recommended 2 years probation on each count
State did not provide sentencing comments to presentence writer
State did not receive presentence report till last night

Logan originally wanted Enima Woman on probation and for her to pay back $20K to the Center for Missing and Exploited Children

Enima woman is shaking her haed no and has a arrogant look on her face as victim impact letters are being read. 

I can't believe TS is sitting there shaking her head back and forth, when the pain of Gabriel's family is discussed.   ::MonkeyNoNo::

Every time a letter talks about the pain Logan is in she shakes her head no and has a sour puss look
She did not understand the comment read about her hiding behind her religion

Enima woman changed Gabriel's name to Jacob for the 9 days she had him.  I have never heard that before.

Enima Woman and Jack have started a charity called Stones of Grace.

The Rev. has totally lost me now.  He is making it sound like she talked to him about setting up something to help woman who have lost their children.  He is making no sense in relation to this case.

Rev Prior is makking is sound like Enima Woman should be Sainted.  Big heart, always puts others first, looks after those that society had forgotten, sacrifices herself

Enima Woman's cousin now speaking. She is guided by her heart, amazing woman, of the events of the last two years it begs the question "why me" and she has never asked herself that.

Jack's lawyer now addressing the court.  Enima Woman has a lobing heart, been to their house for dinner, she is wonderful Mom.  First time offenses she is eligible for probation and that is what Jack is asking for.  She is a Christian and has many positive attributes.

She has been falsely accused of stuff around her own children
July 4th they were driving and she told Jack to pull into a 7/11.  She got a drink and a snack.  She told Jack to turn around, made him stop and gave a homeless many something to eat and told him how much God loved him

Asking Judge to look deep in his heart and make the right decision which would be to let Enima Woman to go home with him

She stands in front of the Judge as a humble servant of God
She is sure Judge has read many letters of her that are people that do not know her and have passed judgement on her
Judge does not know her, wants him to get to know her
Mother, business woman, servant of God, giver, Christian is what defines her as a person
Christian is not someone who goes to church every Sunday or a few times a week
A Christian gives their life over to go and is Christ like
Jesus loved everyone even his enemies
Jesus forgave
Jesus was innocent yet was judged and found guilty
Please forgive them father for they know what what they do
Hard to be Christ like going through this when you know the truth
I might know what Jesus was thinking as he hung on the cross going through the last 2 years
She has been punished, her family and her business for things she has not done
What people have done has almost made them lose their company and everything they have
Attacked by people on the internet, business and websites attacked for the world to see
Not many people out there that truly know Jesus and they do not know what they are doing
She has baptised people in Africa
Her heart breaks for the people who have hurt her
She has been mocked for being a Christian and she prays for them as they know not what they do
She has closed her mouth for 2 1/2 years
Spoke to the media in the beginning as she thought she was helping
Have never been able to tell the whole story, the true story for what has happened
Her heart bleeds and it is sorry for any pain that helping this young woman has caused
She is sure her words will be twisted on the internet like they always are
She was handed Gabriel by a mother in need 2 1/2 years ago
Took good care of him for 9 days
Knew by 2nd day she did nto want to give tht baby away, held her hand through it thinking she was doing the right thing
Would love to tell the Judge what truly happened but can not as has been warned not to talk about the case
Will not stand there and beg for probation.  Can survive where ever she is.  Will never help young mothers again.  Set up a foundation to help mothers instead.  Asks judge not to take foundation away
She can help so many through her foundation
Judge will ntoice on her website she is not taking donations at this time for her foundation
God will help Judge see the truth and all the lies told about her
