 LAYTON, Utah — The body a missing 4-year-old child has been found in a Utah canyon and his mother and stepfather are in custody, police said Tuesday.

Layton police said Ethan Stacy's stepfather, Nathan Sloop, 31, was being charged with aggravated homicide. Both he and the boy's mother, Stephanie Sloop, 27, also will be charged with felony child abuse, obstruction of justice and desecration of a corpse, police said.

The search for Ethan started Tuesday after police said the boy's mother reported that he had left his bed and wandered from their apartment complex. Officials said she told them that the boy had walked away five of the last 10 nights.

"That appears to have been a ruse by the mother, something to cover the tracks," said Layton police Lt. Garret Atkin.

Later Tuesday police said they had a credible lead and no longer needed volunteer searchers. The search at that point shifted to Wolf Canyon, about 40 miles northeast of Salt Lake City.

It's unclear when Ethan was killed or how, police said Tuesday. Atkin said either the mother, stepfather or both revealed the location of Ethan's body and that searchers dug up his remains. Five officers were seen carrying a blue bag out of the woods late Tuesday afternoon.

Atkin refused to describe the condition of the boy's body.

Ethan arrived in Utah 10 days ago to spend the summer with his mother, police said. His biological father is in Virginia. His name was not released.

Investigators spent the early morning hours combing through cupboards, closets, Dumpsters and the area near the apartment complex looking for the boy. Sex offenders in the area were also interviewed and had their homes searched, Atkin said.

The Sloops' story changed throughout the day, Atkin said.

The body was taken from Wolf Canyon, about 17 miles from the boy's apartment.

A Utah State Courts records check found that Nathan Sloop has a string of criminal convictions for misdemeanor and felony crimes including criminal mischief, disorderly conduct and drug possession dating back to 2000.

In 2003, Nathan Sloop was convicted of third-degree felony drug possession with the intent to manufacture and given a suspended sentence of up to five years in the Utah State Prison. He served 30 days in the Weber County Jail and probation. The charge was later amended to a misdemeanor.

No criminal record could be found for Stephanie Sloop.

A Layton phone listing for the Sloops could not be found. An after-hours message left for the Davis County attorney's office was not immediately returned Tuesday.

It wasn't clear when charges would be filed or when the Sloops would make a court appearance.

LAYTON, Utah, May 12 (UPI) -- Authorities in Utah say they have arrested a Layton couple in the death of the wife's 4-year-old son, who had disappeared while on a visit from Virginia.

The body of Ethan Stacy was found Tuesday buried near a trail in the vicinity of the Powder Mountain ski resort, The Salt Lake Tribune reported.

Layton police say the boy's stepfather, Nathan Sloop, was arrested on suspicion of homicide. Sloop and the boy's mother, Stephanie Sloop, both were arrested on suspicion of child abuse, obstruction of justice and desecration of a corpse, police said.

A cause of death wasn't disclosed.

Layton Police Lt. Garret Atkin said the Sloops married May 1 and Ethan arrived about two weeks ago to spend the summer. His biological father, whose name wasn't released, was notified of his disappearance and death.

Stephanie Sloop called authorities Monday night to report the boy had vanished after she put him to bed about 9 p.m. She told police he had wandered off several times previously but had come back, the newspaper said.

Investigators would not say what caused them to zero in on the Sloops as suspects other than their stories had changed over time.

"They were trying to cover their tracks," Atkin said.

The Tribune said Nathan Sloop has a history of drug convictions and other crimes dating back to 2000, most recently in 2003 for misdemeanor possession of a controlled substance.

LAYTON, Utah (ABC 4 News) - Police say 31 year old Nathan Sloop has been in and out of jail mainly for drug related convictions. Stephanie Sloop has no criminal history that police are aware of.

The Sloops moved into the Layton apartment building two weeks ago. They were married last Thursday, just days after Stephanie's son Ethan Stacy moved in with them for the summer.

Neighbors are saddened to hear about Ethan's murder.

"It's amazing how something like that could happen, and no one around here knew anything that was going on," says Gary McPhie, a neighbor.

McPhie says he saw Ethan a couple of times with his mother.

"He was quiet. You had to talk to him. He wouldn't talk to you," says McPhie.

While mothers in their apartment complex are disturbed about the child's murder. Police say it was at the hands of his stepfather, with the help of his mother.

"I don't know how any mom could do that. You give birth to them, and love them. How could someone do that to their child?" says Dawn Smith, a neighbor.

"I have a four year old. Kids look up to you for protection. Kids trust you, and you do that to your baby. It's absolutely sickening," says Savannah Jeffers, a neighbor.

Police say the couple did not have any other children living with them besides Ethan. They know of no reason why his stepfather may have killed him. His biological father who lives in Virginia has been notified of his murder, and the District Attorney plans to file formal charges against his mother and stepfather on Wednesday.

The announcement of the arrests capped a long and heartbreaking day for police officers who had searched throughout the night for the blond-haired, blue-eyed boy with glasses, allegedly last seen wearing Spider-Man pajamas. "Anytime you get a case involving a child like this, it makes you wonder how that happens," Layton Police Lt. Garret Atkin said. Investigators did not say Tuesday how, when or why Ethan was killed, but Atkin noted they do not believe his death was premeditated. Police believe that after Ethan was killed, his body was driven to a remote area about 11 miles up Ogden Canyon near Wolf Creek Resort and Powder Mountain, past Pine?view Reservoir, about 200 yards off the main canyon road in a heavily wooded area close to a dirt access road owned by Powder Mountain Ski Resort. Investigators wearing yellow raincoats and carrying evidence bags and shovels focused on the specific area Tuesday afternoon. "Due to the weather and terrain, it (was) a very difficult crime scene to process," Atkin said. Police were originally contacted by the boy's parents at 11:55 p.m. Monday. They said Ethan had gotten out of bed and wandered off again without them noticing. Officers went door-to-door in the apartment complex asking if tenants had seen anything, checked trash bins, vehicles, storage sheds and area businesses. Police dogs aided in the search, and night vision equipment was used to help search for the boy. Reverse 911 calls were made in the area, and known sex offenders in the area were also questioned, Atkin said. About 3 a.m., tenants said police knocked on all the apartment doors again, this time asking to conduct a thorough search of each unit. Residents said the Sloops had just recently moved into the apartment complex. "They checked the washer, the dryer, lower cupboards, the bathroom ? that's good though," said neighbor Steve Haynes. One neighbor who lives in an apartment adjacent to the Sloops said she was painting inside her house and saw police arrive, searching through her apartment. "I didn't sleep all night long thinking about that poor boy," said Tracy, who asked to be identified by her first name only. "I saw the stepdad walking around (Tuesday). He looked upset." Another neighbor, Janet Hope, said she was coming home from work around 6 p.m. either Thursday or Friday and saw Stephanie Sloop come down the steps of her apartment and walk along the sidewalk onto the grass. "She seemed agitated, kept stopping and looking back," Hope said. Hope said Nathan Sloop then followed her and "put his hands around her face, like a 'you gotta listen to me' kind of thing. I didn't think about it until all this happened." Although Hope never saw Ethan, other neighbors, including the Sloops' downstairs neighbor Gary McPhee, said he'd occasionally seen the little boy wandering around by himself. Police aren't sure when the boy was killed, but McPhee said he last saw Ethan on either Saturday or Sunday. "It's scary to live anywhere, if anybody could do this to a little boy," McPhee said. Chaunie Kimbro, who has a 15-month-old girl, said she had often seen Nathan and Stephanie Sloop smoking on the steps outside their apartment door, but she never saw a little boy. "It kinda sounded funny to me that a little boy would be walking out at night in the pouring rain," Kimbro said. Even before the discovery of Ethan's body, many tenants questioned how the boy could have sneaked out of the apartment without the parents hearing the door. By 11 a.m., after conducting several interviews with the Sloops, detectives got a break in the case and learned of a possible burial site near Powder Mountain. "Their stories changed during the process. ? They were trying to cover some tracks," Atkin said of the parents. "Parents are always the ones (investigators) want to start with first in a missing person case. They are typically the last ones who have seen (the child)," Atkin said. "You have to do very, very thorough interviews with the parents." About two hours later, Layton police announced they no longer needed volunteers to help search for Ethan. By 5 p.m., Ethan's body was recovered. Atkin did not have much information about the newly married Nathan and Stephanie Sloop. An Internet search of Nathan Sloop showed he has family ties to Davis County and possibly lived in Florida at one time. Utah court records show Nathan Sloop also has a criminal history in Utah. In 2003, he pleaded guilty to drug possession with intent to distribute, a charge that was amended from a felony to a misdemeanor. He was sentenced to 30 days at the Weber County Jail and put on probation. He was off probation at the time of his arrest Tuesday. He was also found guilty of a separate misdemeanor drug possession charge about that same time. In 2001, Nathan Sloop was convicted of disorderly conduct and criminal mischief, and a few months later in a separate case he was convicted again of disorderly conduct and failure to obey a peace officer, according to court records. SALT LAKE CITY (AP) - A custody fight in Virginia led to a judge's order that a 4-year-old boy spend the summer in Utah with his mother, who will be charged as an accomplice to the youngster's killing, police and a family member said Wednesday.

The biological father of Ethan Stacy received a full briefing on the slaying Wednesday, he told The Associated Press.

"I can't talk right now. I just got the horrible news, talking to prosecutors," said Joe G. Stacy of Tazewell, Va. "Right now is not the time."

The boy's body was desecrated and buried in a northern Utah canyon, where it was recovered Tuesday, police said.

The stepfather, Nathanael W. Sloop, 31, of Layton, is being held on suspicion of aggravated murder.

Sloop and the boy's mother, Stephanie Sloop, 27, face additional charges of desecration of a corpse, along with felony child abuse and obstruction of justice, police said.

The Deseret News of Salt Lake City quoted Joe Stacy's stepmother saying he was forced by a judge to give up the boy to his mother for a summer visit. Layton police provided a similar account, saying Ethan arrived in Utah May 1 "after divorce and custody issues were finalized."

Joe Stacy's stepmother, Freida Stacy, called Stephanie Sloop a "spiteful" woman intent on hurting her ex-husband. The AP has not been able to reach family members of Stephanie Sloop.

"She was just an evil person. There is evil in the world, and she is that," Freida Stacy told the Salt Lake City newspaper. She did not immediately return a message from the AP.

"I don't think she cared anything for that little boy. I think she did anything she could to irritate" Joe Stacy, his stepmother said.

Prosecutors said they would file charges Friday against Nathanael and Stephanie Sloop. They have said that Nathanael Sloop was responsible for the boy's killing, but they didn't say how. Stephanie Sloop was involved in trying to cover up the crime, police said.

The Sloops are being held at the Davis County jail.

Chief Deputy Davis County Attorney David Cole said prosecutors are awaiting the results of an autopsy of the boy's body that was under way Wednesday.

The mother initially told officers that Ethan wandered away late Monday from his apartment complex in Layton, police said.

"That appears to have been a ruse by the mother, something to cover the tracks," Layton police Lt. Garret Atkin said Tuesday.

The Sloops' story of a barefoot boy wandering outside in his pajamas changed throughout the day, Atkin said.

Police searched overnight and said that by midday Tuesday, the couple had revealed the location of Ethan's body. The search then shifted 20 miles away to a spot off a wooded trail in Wolf Canyon, which borders the Powder Mountain ski resort, about 40 miles northeast of Salt Lake City.

The remains of the boy were dug up late Tuesday and carried from the woods inside a blue tarp.

Atkin and prosecutors refused to describe the condition of the body.

The couple was married May 6, nearly a week after his mother escorted her son from a former marriage to Utah, police said.

No criminal history was found for Stephanie Sloop, and records show no criminal activity for Nathanael Sloop after 2003.

Attorney Richard Gallegos, who has represented Nathanael Sloop in previous criminal cases, did not return a message Wednesday.

Oh Cookie, I know.  I realize no one has a crystal ball . . . but for goodness sake, it is hard for me to believe there wasn't a clue . . . God bless Ethan's soul as he is now with the Lord!  My heart is aching for his daddy.

SALT LAKE CITY – The Utah man held in the slaying of his 4-year-old stepson beat him for days before the boy died, then used a hammer to disfigure his face and teeth before burying his body in the mountains, according to police records released late Wednesday.

The body of Ethan Stacy, wrapped in plastic, was unearthed by police Tuesday.

Interview summaries filed by Layton police detectives documented increasingly harsh treatment of the boy during his short time in Utah. A Virginia judge had sent the boy to Layton for a summer visit with his mother just 10 days before his death, police said.

Investigators said they obtained photographs and video images of Ethan's worsening condition from his mother's cell phone, starting more than a week ago.

The injuries resulted from the stepfather, Nathanael Sloop, "engaging in a systematic and progressively more violent pattern of abuse toward Ethan," detectives wrote in interview summaries. The documents say Sloop was angry with the child and "tried everything" to discipline him; however, they don't say why the boy was being disciplined.

Sloop, 31, acknowledged hitting the boy, which caused his face to swell, and leaving him in a locked bedroom May 6 while the couple went to get married in Farmington, about 10 miles away, according to the probable cause statements used to support arrest warrants and detention in jail.

Sloop and the boy's mother, Stephanie Sloop, 27, feared his injuries would alert authorities if they took him along to the courthouse wedding, the documents state.

"This pattern of behavior and abuse was done in a manner that was recklessly indifferent to the child's welfare," police wrote.

Stephanie Sloop told police she did not seek medical help for Ethan because she was afraid Nathanael Sloop "would harm her," Detective Brooke Plotnick wrote.

The couple told police they found Ethan dead in his bed Sunday morning, and that Nathanael Sloop buried him later that day.

Stephanie Sloop told investigators she bought two cans of lighter fluid for Nathanael Sloop to burn the body before it was buried. The reports didn't say whether that was actually done.

The stepfather disfigured the boy's face and teeth "in an effort to defeat or delay identification," detectives concluded in their reports.

Prosecutors said they expect to file charges against the couple Friday. Nathanael Sloop was arrested on suspicion of aggravated murder. He and the mother face additional charges of desecration of a corpse, along with felony child abuse and obstruction of justice, police said.

Chief Deputy Davis County Attorney David Cole said prosecutors are awaiting the results of an autopsy conducted Wednesday.

Stephanie Sloop told police Ethan was vomiting, lethargic and refusing to eat for three days before his death. She also said that on Friday, she found Ethan badly burned from his feet to his buttocks from hot bath water, and that she suspected Nathanael Sloop was responsible.

At another point, the couple forced the child to drink two 16-ounce bottles of water, a 16-ounce bottle of Kool-Aid and a glass of orange juice over two hours, police said. They also gave him Motrin and Benadryl to ease his facial swelling and pain.

Utah State Courts records show that between 2000 and 2003, Nathanael Sloop had several convictions, including for criminal mischief, disorderly conduct and drug possession. In 2003, he served 30 days in jail for one drug possession charge and received a six-month suspended sentence for another.

That judge has lots to answer for....why would they send that little boy to his Mother for the summer knowing what she was like?  I hope the judge faces consequences for making a bad decision, after all thats what they are paid to do,  make decisions based on the history of their cases...... ::MonkeyMad:: ::MonkeyNoNo::

I am horrified to learn the details of the abuse that this little child suffered.
Who could do this to a small child? this is beyond cruel.
I don't even know what to say right now.  ::MonkeyTears:: ::MonkeyTears::  death by torture is way too good for these 2 idiots who did this to Ethan.  I say an eye for an eye.. and I mean that with all my heart!

SALT LAKE CITY (AP) - The father of a 4-year-old child killed in Utah wrote in divorce papers that the boy's mother was unstable and had abandoned him.

Divorce papers obtained by The Associated Press show that Joe G. Stacy feared Ethan Stacy's mother would take their child to Utah and never return him.

Police dug up Ethan's badly beaten body from a Utah canyon Tuesday, nearly two weeks after a Florida judge finalized a divorce that required the father to share custody.

The mother, Stephanie Sloop, is scheduled to appear in a Utah court Friday along with her new husband, Nathanael Sloop.

Police interview statements say he acknowledged beating the boy for days before his death, and that Stephanie Sloop did nothing to stop the abuse.

Charges in the case also are expected Friday.

I agree. These are savages. I'm so disgusted by the level of depravity, case after case, after case.
It should become law that whatever barbarism you perpetrate on someone, after you're found guilty, you can expect the exact same savagery in return.

I agree Tracygirl - there is no punishment severe enough for these animals - this so reminds me of the Dominick Calhoun here in Michigan. When will women that gave birth going to learn that men are replaceable - children are not.

How can someone do this to a poor defenseless baby? And leave him to suffer for days. I would love the honor of doing away with these two myself. It seems like everyday a case comes up that is even worse than the one the day before. Until our system of law starts metting out punishment to fit the crime, it just goes on and on and on.

Mother of Slain Utah Boy May Face Murder Charge

FARMINGTON, Utah (May 14) - Prosecutors in Utah said Friday they may file murder charges against the mother of a 4-year-old boy whose body was found in a canyon earlier this week.

Searchers dug up Ethan Stacy's badly beaten and disfigured body Tuesday, about 10 days after he arrived in Utah for a summer visit with his mother, Stephanie Sloop, 27.

Davis County Attorney Troy Rawlings said Sloop and her husband, 31, will likely be charged with aggravated murder in the boy's death. Before Friday, the possibility of murder charges had only been discussed for Nathanael Sloop.

"We're looking at aggravated murder - both defendants are suspects at this point," Rawlings said.

Police said Stephanie Sloop initially told officers her son had wandered away from her Layton apartment.

But probable cause statements said Nathanael Sloop acknowledged beating the boy for days before his death on Sunday and Stephanie Sloop did nothing to stop it. After the boy died, Nathanael Stoop used a hammer to disfigure the boy's face and teeth to keep him from being identified, then buried the body in a canyon, according to the documents.

The Sloops may also be charged with felony child abuse, obstruction of justice and desecration of a corpse, Rawlings said.

At a court hearing Friday, both separately agreed to waive their right to be bailed out of jail until at least their next court appearance on May 28.

Nathanael Sloop kept his head low and wept softly during his court appearance. Stephanie Sloop appeared withdrawn and showed no visible emotion during the twin hearings that together lasted less than 15 minutes.

Earlier, Nathanael Sloop's court-appointed attorney, Todd Utzinger, would not discuss specifics of the case or possible charges. He said he met with both Sloops Friday morning at the Davis County Jail and advised them to stop talking to detectives.

Attorney Julie George, who was appointed to represent Stephanie Sloop, said her client "is very emotional and having a difficult time."

Prosecutors are waiting to file charges because there is the potential for the death penalty.

"We're not going to file charges before all of our ducks are in a row and we're ready to go, but we intend to get there," Rawlings said.

The 2nd District Court hearing in Farmington drew about two dozen members of the advocacy group Bikers Against Child Abuse and many other people unconnected to the case.

"That boy didn't get mercy. They shouldn't get mercy," said August Teuscher, 32, a mother of four from Clinton, who stood in the courthouse holding a hand-drawn sign condemning the Sloops. "They should be tortured."

Public defenders for the Sloops said the couple had received hundreds of requests for visits from reporters and strangers while in jail. Judge David M. Connors signed an order prohibiting anyone from trying to visit the Sloops.

Utah State Courts records show that between 2000 and 2003, Nathanael Sloop had several convictions, including for criminal mischief, disorderly conduct and drug possession. No criminal history was found for Stephanie Sloop.

Ethan's biological father, Joe G. Stacy of Tazewell, Va., agreed to share custody of the boy on April 28 so he would spend the school year with his father and summers with his mother.

On Friday, Ethan Stacy’s mother Stephanie Sloop, and stepfather Nathan Sloop appeared in court in handcuffs and shackles. According to the district attorney, there is not yet enough evidence to charge the Utah couple with murder.

Ethan’s body was found Tuesday evening in Ogden Canyon near Powder Mountain wrapped in plastic. According to official documents released by the Davis County Sheriff’s Office, the 4-year-old’s face and teeth were disfigured by his stepfather with a hammer to delay identification of his body.

In addition, the documents indicate that Ethan was abused and tortured prior to his death.

On May 5, Nathan took Ethan into a bedroom, and slapped and beat him about the head and face. His mother entered the room and noticed his face was swelling, but did not seek medical attention for the boy.

The next day, the couple locked Ethan in a bedroom, leaving him alone so they could wed at the courthouse. Stephanie noted they did not bring the boy with them to avoid being questioned about his obvious injuries.

Stephanie said that over the next few days, Ethan was lethargic, would not eat, had a fever, and was vomiting. The couple made him drink water, orange juice, and Kool-Aid and gave him Motrin and Benadryl to reduce swelling.

After returning home from a shopping trip on Friday, Stephanie found the boy was burned on his legs and feet from a scalding bath. Reports also indicate she believed Ethan had feces in his mouth. Nathan claimed the burns were an accident, but she claims she didn’t believe him -- yet she didn’t seek help for Ethan for fear Nathan would hurt her.

Around 3 a.m. on Sunday -- Mother‘s Day-- she checked on Ethan, then left for the pharmacy to pick up a prescription for Nathan. When she returned around 5:30 a.m., her husband informed her that Ethan was dead.

She did not call authorities because Nathan feared going to prison because of bruises on Ethan’s body. Instead, the couple disfigured Ethan and disposed of his body.

Davis County District Attorney Troy Rawlings announced that prosecutors need additional evidence prior to filing charges in the case, including Ethan’s cause of death from the coroner.

“Make no mistake, we plan to file charges,” said Rawlings. “We don’t want to make any mistakes in our charging decision.” He also noted that if his office is unable to obtain the evidence needed for charges of aggravated murder, prosecutors will seek lesser charges.

Sister, I agree. I know Nut posted almost the same article a few posts up but I wanted to link back to the pictures. I wish they hadn't titled it this way.

LAYTON — Divorce documents and protective orders from the newlywed Layton couple accused in the death of 4-year-old Ethan Stacy show a disturbing history of abuse and fear.

Both of the former spouses of Nathan and Stephanie Sloop were also fearful for the safety of their children because of the unstable behavior of their exes.

The biological father of Ethan Stacy described his ex-wife, Stephanie Sloop, as "unstable" and said he feared she would take their son and he'd never see him again.

The former wife of Nathan Sloop described him as mentally unstable, violent and having multiple personalities — including one personality who becomes extremely angry when criticized. She said she feared for her life and for her daughter's life.

The documents include transcripts of profanity-laced tirades that Nathan Sloop — who prosecutors plan to charge today with the murder of his stepson — left in a series of voice mail messages for his former wife, Jennifer Freeman, one day in September.
"I only wish now that I could (expletive) take you out of (their daughter's) life. I am going to do every (expletive) thing possible within my power to take you the (expletive) out of her life (expletive). I don't give a (expletive) if I gotta spend the rest of my (expletive) life in prison. (Expletive) you. I'm coming after your (expletive) throat," he said in one voice mail message.

In another, Nathan Sloop threatened to kill Freeman's boyfriend, "Mike," and then added, "You'll be next in line," according to the transcripts.

Nathan Sloop left five voice mail messages in less than 20 minutes and six within 90 minutes, according to the court documents.

"He hugs my (expletive) daughter, he comes near my (expletive) daughter, he is (expletive) done. Over," one message said.

Nathan Sloop and Freeman had one daughter together. She turns 6 later this month. The daughter, who was born in Utah when the couple lived in Roy, now lives in Florida, where Freeman moved after her divorce.

In November, Freeman asked the court to ban Nathan Sloop from having any electronic contact with her.

"I am deathly afraid (Nathan Sloop) will harm me or my family," Freeman wrote in court documents.

As recently as March, Freeman sought to have a permanent restraining order against him. The couple's divorce was finalized in August 2008.

"The wife has been the victim of domestic violence," her attorneys wrote in court documents. "The husband has a felony criminal history for drug-related criminal activity and has for years been diagnosed and treated for multiple personality disorders."
In court documents, Freeman describes Nathan Sloop as having a "history of instability and mental illness," including being diagnosed with multiple personality disorder. His other personalities go by the names "Ghost" and "New York," she wrote. "Ghost," she wrote, "becomes enraged at any perceived slight or criticism."

Freeman feared Sloop would hurt their daughter as a way to get back at her.

Similarly, Joe Stacy feared his ex-wife Stephanie Sloop would use their son Ethan to get back at him.

Joe Stacy filed for divorce from Stephanie Stacy, as she was then known, in October, according to records from the Florida court. Both were required to undergo parenting classes, which is required under Florida law for divorcing parents with minor children. The Uniform Child Custody Act was also invoked, which deals with children of divorced parents who live in different states.

In November, Joe Stacy filed an emergency motion for custody.

"The mother is unstable, and I'm afraid she will come to Florida and take him," he wrote in his motion.

Joe Stacy was particularly concerned about sending Ethan to Utah with the boy's mother for the summer, as the terms of his divorce required. He spelled out his concerns in court documents filed six months before Ethan left for Utah.
"The mother has abandoned the child, and I'm afraid the mother will come and take him and I'll never see him again," Joe Stacy, who then lived in Apopka, Fla., wrote in the November 2009 custody petition filed in the Circuit Court of the 9th Judicial Court of Orange County, Fla.

Judge Maura T. Smith handled the Stacys' divorce. She told the Deseret News Thursday, however, that the couple had already reached a marital agreement settlement on their own, which was signed in front of a mediator, by the time the divorce was finalized in her courtroom.

The divorce was uncontested by both parties, she said. During a brief 10-minute hearing to finalize the divorce, she said only Joe Stacy was present.

Because the case was still active, meaning the court has jurisdiction over the divorce to make sure all stipulations were being met, the judge said she could not talk about specific details regarding the case. She said she heard the news about Ethan's death but could not comment on the matter.

She noted that the Orange County courthouse sees hundreds of cases similar to the Stacys' divorce every few days.

In their marital settlement agreement, the court prohibited Ethan's maternal grandmother and her husband from having any contacting with Ethan, Stephanie or Joe Stacy, but the documents did not indicate why.

The agreement was signed Feb. 3, 2010.

Despite the repeated warnings, Ethan was sent to Utah and was killed less than two weeks later, and his body buried in a remote area near Powder Mountain.
Police say that while interviewing Stephanie Sloop — who initially called police Monday to say Ethan had wandered away from home and was missing — they noticed photos of Ethan on her cell phone that "showed a progression of injuries." In a photo with a time stamp of May 4, "Ethan has a large and very noticeable area of swelling to the jaw and face," detectives wrote in a probable cause affidavit when jailing the couple.

In subsequent interviews, the couple told police the injuries were caused by Nathan Sloop "in a systematic and progressively more violent pattern of abuse toward Ethan."

Police say the boy continued to be abused, yet the Sloops did not seek medical attention despite serious signs of illness. Ethan was discovered dead in his bed on May 9, the affidavit states, and the Sloops say they put his body in a plastic bin and buried him.

Nathan Sloop was booked Tuesday into the Davis County Jail for investigation of aggravated murder. He and Stephanie Sloop were both booked for investigation of child abuse, obstruction of justice and desecration of a corpse.

The Sloops' alleged crime has shocked the nation.

At the Sloops' Layton apartment Thursday, the sunny spring day did little to lighten the mood.

A steady stream of friends, neighbors and strangers continued to visit the site Thursday as a small makeshift memorial to Ethan continued to grow.

The pile of gifts included stuffed animals, flowers, candles, balloons and even a Happy Meal signed by the "Layton McDonalds staff."
Many messages bore the telltale signatures and pictures of neighborhood children.

"I'm sorry your (sic) gone," read one message, scrawled in a child's handwriting.

Other letters and cards offered messages of hope.

"God is watching and waiting. … You'll know you're in a much better place," read another letter addressed to Ethan.

A Facebook page called "In Remembrance of Ethan Stacy" had more than 6,000 fans just two days after its creation on Tuesday. Two other Facebook pages, "In Memory of Ethan Stacy" and "Justice for Ethan Stacy," have also been created.

As prosecutors prepared Thursday for a Friday news conference, at which time official charges were expected to be announced, Davis County Attorney Troy Rawlings said his office had received numerous calls from members of the public.

His staff was sorting through an extensive amount of evidence, and he promised, "We will seek the maximum penalty allowed by law for the crimes we can prove."

The Sloops are expected to make an initial appearance in 2nd District Court at 1 p.m. Friday.


In other court documents obtained by the Deseret News Thursday, Joe Stacy filed for a protective order in 2007 against another spouse, Michelle Rodriguez, whom he also feared would take his children and flee to London while he was away on military duty.

Joe Stacy claimed in court documents that Rodriguez pulled a knife on him, slapped their kids, left them alone in a room while she went to a bar and then brought men back to the apartment to have sexual relations while the children were still there.

That judge in FL she shouldn't be allowed to say she cannot comment, she needs to comment and face the poor decision she made and why she should still be awarded the robe she is wearing. To send a child to another state for 3 months with a person he hardly knows is negligent at best. Kids don't want to leave their homes to visit parents out of state for months on end, they don't want to do that! Not at 4 years old anyway. This practice needs to stop.
Ethans death could have been avoided by once again our laws protecting us and our children from violent people. This child suffered a horrific death, no reason on earth could explain why.

you are right..this does need to stop..the out of state parent should have to travel to the child and stay where the child lives imo...why should little children be uprooted from the home and family and friends and everything familiar around them because it is more convenient for the parent???

You know cookie the judge said it was decided in mediation. Well I have been through mediation and it is a crime in itself. There are the 2 parties with lawyers if there are any and the mediator. All the time the mediator is telling the parents the worse case senario such as if you can't decide the judge will decide for you and it could be blah, blah, blah...it is just short of blackmail! You are forced to compromise! However, the judge still signs and she/he must read the file. In this fathers file he stated some pretty strong things, the judge had a responsibility to look into this further and order evaluations for mental states. NOt every parent is just trying to get back at the other. Sometimes they are just trying to protect their child. Geez if this case doesn't prove that then nothing will!

Shelby’s Law may be used in Ethan Stacy’s death case in order for prosecutors to seek the death penalty, in which child abuse that leads to a death could become a capital case, according to Fox News 13 in Salt Lake City.

As part of 4-year-old Ethan Stacy’s death investigation, the FBI is investigating a cell phone that has abused pictures of a little boy. The medical examiner continues to take tissue samples from Ethan Stacy’s body. Files are expected to be filed by May 28.

In 2006, 10-year-old Shelby Andrews was abused by her father and stepmother and died in their home. Prosecutors were able to get a murder conviction, but frustrated that they could not seek the death penalty in the case, and Shelby’s Law was created so that the death penalty could be sought in a child abuse case that led to a death in Utah. This would be the first case that prosecutors would be able to use Shelby’s Law.

Kim Hale, Shelby's mother said she was tortured. The Fox News 13 interview with Hale can be seen below.

"What could a 4-year-old, or even a 10-year-old, do to deserve anything like this?" Hale said Monday.

"We knew that Shelby was put on this earth for a purpose," Kim Hale said. "We just didn't realize that her death was going to be the purpose for everything."

LAYTON -- The defense team for the man accused of killing 4-year-old Ethan Stacy and burying his body in the mountains is at least checking into a claim the suspect may have a multiple personality disorder.

At the same time, domestic violence counselors are questioning whether Stephanie Sloop was abused as well.

The question of mental illness

Nathan Sloop's attorney, Todd Utzinger, is urging patience in the case.
It's too early to know how claims of a multiple personality disorder might play into any defense, such as an insanity plea, according to attorney Todd Utzinger.

"The prosecutor in the case, Troy Rawlings, is trying to do his job carefully, and we also are trying to do our job carefully," Utzinger told KSL Newsradio on Tuesday.

Part of that job will be to check out claims that Sloop has a multiple personality disorder. Utzinger said he's obligated to check out the claims that, so far, he's only heard in media reports. He said it's too early to know how that might play into any defense, such as an insanity plea.

"It's not a common defense in Utah. The Utah law is very strict on those sorts of mental health issues," he said. "But regardless of what the law is, I need to at least investigate the allegations that have been made out there in the public."

Sloop and his wife, Stephanie, are accused of abusing Ethan over a number of days and not seeking medical help for the boy, who eventually died.

Utzinger won't comment on Sloop's demeanor in jail, except to say he's now off suicide watch and has been for several days.

Friend: Mother made frantic phone calls days before boy died

SALT LAKE CITY -- A former close friend of Stephanie Sloop's, who lives in Florida, says their friendship fell apart when Sloop split from Ethan's father. But in the emotional crisis surrounding Ethan's death, Sloop apparently reached out to her former friend for help, in hysteria.

Carla Jones says she's turned over recordings of Stephanie Sloop's voice messages as potential evidence. She blames herself for not reacting in time to save the little boy she calls "Pumpkin."

Photos document years of friendship between Carla Jones, Ethan Stacy and his parents, Joe and Stephanie.

"We were very, very close. We did a lot of things as families and as couples -- double dates, whatnot, parties at our house," Jones said.

Speaking to us from our affiliate station in Orlando, Jones said when the Stacys marriage fell apart, Stephanie forced her to choose: Joe or Stephanie.

"I love Joe and Ethan. They are extended family to us," Jones said.

Jones is infuriated by claims Stephanie was a nurturing mother. She said her former friend was wicked, twisted, with no patience for children.

"Stephanie is a very conniving, manipulating and deceiving person," Jones said. "She would sell her own mother if it was going to get her something."

"She was not a fit mother," Jones continued. "She was not a fit wife. She had a personality disorder. She had anger issues. She should have never had that child."

Jones believes Stephanie took custody of Ethan for the summer and brought him to Utah as an act, not of love, but of hate.

"So she could hurt Joe," Jones explained. "She knew the only way she could hurt Joe was by getting Ethan."

Jones said Stephanie recently tired to restart the friendship. Then three nights before Stephanie and her new husband, Nathan Sloop, reported Ethan missing, Jones said Stephanie left a series of frantic voice messages.

"She left crying, messages while she was crying, 'Ethan, he's crying. He won't stop crying. He just wants mommy. I don't know what to do. Please, please, call me. I don't know how to handle it. I don't know what to do,'" Jones said.

The final message, she now believes, may have come after Ethan died.

"It was absolutely hysterical, sobbing to where I couldn't understand what she was saying," Jones said. "if I had to look deep into my heart, yeah, I would probably have to say that Ethan probably was dead, if not close to being dead at that point. And it was her grief reaching out."

Now, Jones wishes she'd called Ethan's dad or the police.

"I actually feel terrible, and I have tremendous guilt," she said.

Jones said the death penalty would be too good for her former friend and her new husband. She'd like to see Nathan and Stephanie Sloop locked up for life, surrounded by pictures to remind them of what they did.

Hometown mourns during service


GRUNDY, Va. — A town in mourning turned out Tuesday night to pay their respects to Ethan Stacy.

"It's a hard time. We loved little Ethan," said Marshall Osborne, a longtime friend of Ethan's father, Joe Stacy, and one of the pallbearers for Ethan's funeral.

A funeral service will be held this afternoon for Ethan, followed by a procession from the funeral home in Grundy, Va., to the Clinch Valley Memorial Cemetery in Richlands, Va., about 30 miles away.

Stacy was a man who looked in deep despair Tuesday over the tragic loss of his son. As he recalled fond memories of Ethan while wiping back tears, he also called for justice to be served.

"They need to pay for taking my son away," he said.

A church service was held Tuesday night for 4-year-old Ethan on the eve of his funeral. While hardly anyone in Utah knew Ethan in life, he has touched the lives of people in Utah and across the nation following his brutal death, allegedly at the hands of his mother, Stephanie Sloop, and her newlywed husband, Nathan Sloop.

The Sloops remained in the Davis County Jail on Tuesday, pending possible aggravated murder charges.

Stacy, who has been in constant contact with both Davis County prosecutors and victim advocates in Utah, said if they can file aggravated murder charges, he expects they will seek the death penalty against his ex-wife and her husband.

He said he is OK with prosecutors needing additional time before filing official charges.

"I don't want any mistakes made at all. Nothing. I don't want them coming out of this in any type of way," he said.

The focus Tuesday, however, was on Ethan and not the couple accused in his death.

Stacy recalled how his son was a quick learner.

"I could show him how to do something, he'd pick it up just like that," he told the Deseret News Tuesday. "He's just a very intelligent boy."

Stacy recalled how his son was "a great boy," how he loved to go to the playground and how most recently he had developed a strong liking for PlayStation video games.

"He'd stay glued to it all day if I let him," Stacy said.

The father fought back tears and sometimes just let them flow as he recalled happy moments with his son. He recounted these stories while standing in the Grundy Funeral Home's chapel. As he spoke of Ethan's short life, just 20 yards behind him rested a small, dark gray coffin surrounded by flowers and teddy bears.

Ethan Jonathan David Stacy's obituary listed May 11 as his day of death. That was the day Layton police and the Weber County Sheriff's Office found his body buried in a remote area near Powder Mountain.

SALT LAKE CITY — The FBI has now entered the investigation into the death of Ethan Stacy, partly because of its expertise in examining electronic evidence, which could provide valuable clues in the timeline of violence that led to the boy's death.

One of the photos the FBI is investigating is one that was posted on Stephanie Sloop's Facebook page.

The Layton Police Department says it is aware of a Facebook photo that has created a lot of buzz in the case. The lieutenant who KSL News spoke to would not go into details, but he said it's definitely part of the investigation.

The photo is a picture of 4-year-old Ethan playing video games like any other child. However, in this photo, his face is swollen and bruised, and he's sitting with the man accused of killing him: his stepfather, Nathan Sloop.

"A picture says a thousand words. And if we can have a picture of something that someone did, a crime that someone committed, then it becomes a lot easier for us to understand the elements of that crime," says Dr. Brent Horn, assistant professor of criminal justice at Weber State University.

Horn says electronic data, like that picture, can be important in any case, especially when trying to figure out a timeline. But he says detectives and prosecutors must be careful how much weight they give the photo.

"To have just one very specific piece of evidence that you're relying your whole case on is kind of very dangerous ground to be on," Horn says.

To be fair, prosecutors are looking at the bigger picture by processing physical data from the burial site at Powder Mountain and forensic evidence at the Sloops' apartment in Layton. But since there is so much electronic data in this case, the FBI was called in because of its specialized laboratory.

The agency only has 16 of these labs across the country, and one happens to be in Salt Lake City.

"In any case where you might have audio, video or other kinds of digital evidence, the regional computer forensic lab would be a great resource," Horn says.

Horn says there is always a possibility that people will manipulate electronic data by using programs like Photoshop. However, he says, these forensic scientists are highly trained to tell the difference between what's real and what's fake.

DAVIS COUNTY, Utah - (ABC 4 News) - Public support for a 4-year-old boy beaten to death is growing.  Organizers expected 400 marchers to walk for Ethan Stacy in Davis County. The crowd was much larger. Some estimates put the crowd at between 500 and 800.

The march started outside the Layton apartment he called home at 1425 North 586 West.  It twisted for more than 10 miles to the Davis County Jail.

Reaction to Ethan's murder during the march was explosive because of the way he died.  The State of Utah released confessions from Ethan's mother Stephanie Sloop and stepfather Nate Sloop.  They told police about their roll in Ethan's death.  Stephanie said she decided not to get Ethan medical help because she did not want to get in trouble.

Most of the people at the march were mothers.  "I've got little kids of my own and I don't know how any mother could ever let anything like this happen to any of their children, just to stand-by and watch," said Helena Jones from Ogden.

"It happened in out back yard.  It just kind of shows you it can happen anywhere," said Clearfield man Tyler Mace.

April Hasna is also marching.  She is from Grundy, Virginia where Ethan was buried earlier this week.  She is walking to support her friends grieving in her hometown.  "It's felt at the heart of Grundy, but I think it's felt all over the country.  I think everybody is coming together not only in Grundy, but everywhere," she said.

Many of the marchers are mourning as if Ethan was their own.  As they hiked they though about how his life will change their own.  "Maybe spend a little more time together. Not get so angry so easy.  Try to let things slid a little more.  Just try to be a better family," said Jones.

The state of Utah is expected to charge Stephanie and Nate May 29.

More than 13,000 people have joined the Facebook page "Justice For Ethan."  Ethan Stacy's supporters are organizers more marches on Facebook.

this little boy, being beaten up by a grown man. just disgusting and cruel.  I can't wrap my brain around something like this.

I hope that other parents who have to give their children to an ex that they feel is unstable or otherwise,  will call the police for a welfare check if the ex won't let the custodial parent speak with their child on the phone.  If the police would have been called, perhaps they would have gone over there and seen the abuse on little one's face and taken him out of that home before he died.. Not bashing the father in this case, just letting this be another thing to watch for in case another parent has to share custody with an unstable other parent..Or even an unstable custodial parent! Danger signs if the child can not be reached..jmo...
My heart goes out to this father ...it seems that he tried to do everything right in protecting his little son from his egg donor.  The "law" needs to answer for letting this child go from a loving home to the hell that he was sent to! I am angry... ::MonkeyMad::

LAYTON, Utah (ABC 4 News) - Davis County prosecutors are expected to file charges Friday against Ethan Stacy's mother and step-father, the two are believed to be responsible for the little boy’s death.

According to the latest reports, prosecutors are likely to charge both Ethan's mother Stephanie Sloop and Ethan's step-father Nathan Sloop with aggravated murder. They're still waiting for the medical examiner to determine an official cause of death but, right now authorities claim Nathan Sloop beat Ethan for days then used a hammer to disfigure his face.

Meanwhile over the weekend, hundreds of people in Davis County marched over 10 miles to show their support for young Ethan, and to persuade prosecutors to seek justice against the sloops.

“I've got little kids of my own and I don't know how any mother could ever let anything like this happen,” said Helena Jones, Ogden resident.

Supporters marched from the apartment complex where Ethan is believed to have died to the Davis County jail where his mother is being held.

Over 400 people participated in the march. More than 13,000 have joined the Facebook page “Justice for Ethan.” Organizers of the page are planning more marches for Ethan in the future.

Thursday, ABC 4 news reported that they received a response from their letter to Stephanie Sloop, Ethan Stacy’s mother who is accused of being responsible for murdering her own son. Stephanie Sloop has been sitting in the Davis County Jail in Layton, Utah awaiting murder charges. On the back of the letter from ABC4 Stephanie Sloop wrote:

"HA, HA, HA, I've invoked my right to remain silent or didn't my attorney already say that?"

She wrote the sentence in pencil in large letters and returned it in the self addressed envelope that ABC4 included. The short note is sarcastic and not at all remorseful.

Amazingly, this right to remain silent comes less than two weeks after either her or husband, Nathan Sloop told the police where they could find 4-year-old Ethan’s body.

4-year-old Ethan Stacy’s body was found last week after his mother and stepfather confessed to where the body could be found. His body was found about 40 miles from Salt Lake City, Utah near the Powder Mountain ski resort. Authorities reported that Ethan was severely abused for four days before he died.

Sloops formally charged with aggravated murder

FARMINGTON -- The Davis County Attorney's Office has formally filed aggravated murder charges against Nathan and Stephanie Sloop in the death of 4-year-old Ethan Stacy.

Ethan's mother and stepfather have also been charged with second-degree felony child abuse, obstruction of justice and abuse or desecration of a body.

Charging documents reveal both Sloops abused Ethan for days, inflicting serious injuries. The documents state that abuse included "beatings, burning, drugging, isolating, malnourishing, leaving the child alone and unattended while suffering and refusing to seek vital life-sustaining medical attention."

Prosecutors claim it was that abuse that ultimately led to Ethan's death.

Nathan Sloop faces an additional charge stemming from damage done to a jail cell during his incarceration.

If convicted of the aggravated murder charges, the Sloops could face the death penalty or life in prison without parole.

The Sloops are scheduled to appear in court in Farmington Friday afternoon to hear the charges against them.

It took nearly 2 weeks for prosecutors to get the returns they were seeking from the medical examiner, after Davis County Attorney Troy Rawlings said May 14 he would "file the most serious charges and seek the maximum penalties."

Prosecutors are looking into the possibility of asking for the death penalty for Ethan Stacy's death under Shelby's Law. Passed in 2007, it makes child abuse deaths involving reckless indifference a capital offense.

However, the county attorney's office did not on Friday announce whether it will seek the death penalty in the case against either of the Sloops and said it will take up to 60 days allowed by law to decide.

Ethan's body was uncovered May 11 near Powder Mountain after Layton police say the Sloops reported him missing the night before. He had just been in Utah for 10 days with his mom, who had summer visitation.

Ethan's body was returned to his father, Joe Stacy, and buried last week in Virgina.

Friday, at a court hearing for Nathan and Stephanie Sloop, the current lawyers told 2nd District Judge David Connors that court officials have not found suitable lawyers to defend the Sloops. Davis County Attorney Troy Rawlings said that asking for the death penalty in this case is likely, but the motion hasn’t been filed yet.

Court officials have a list of attorneys to call that must meet the Rule 8 attorney selection process and they are having a difficult time finding suitable attorney’s for the Sloops. The lawyers must have the experience and qualifications to defend someone in a capital case, and they have to want to take the case, as explained by Fox News 13 in the video below.

"[It is] very difficult to find defense attorneys who are both capable and willing to take on these cases. There are many lawyers, actually who are able and willing, in theory, to take on the cases. But, because of the caps on fees and the nature in which fees are provided, it is incredibly costly for lawyers to take on these cases," said Daniel Medwed, a University of Utah law professor (see Fox News 13 video below).

Nathan and Stephanie Sloop have been charged with the murder of 4-year-old Ethan Stacy. Stacy arrived in Utah around May 1 to spend the summer with his mother and stepfather, Nathan and Stephanie Sloop.

Friday, the Sloops appeared in court briefly for the hearing and then left. Nathan mouthed the words I love you to his mother who was in the courtroom.  The court date was rescheduled for June 11 at 1 p.m.

The new hearing dates will be held on June 14 for Nathan Sloop. Stephanie's hearing was scheduled for June 18.
 
Judge Thomas Kay appointed attorney Richard P. Mauro as counsel for Nathan Sloop and attorney Mary Corporon as counsel for Stephanie Sloop.

Both have been charged with capital murder and abuse in the death of 5-year-old Ethan Stacy.

Davis County Attorney Troy Rawlings, lead prosecutor in the Ethan Stacy murder case, received a national award in Washington, D.C., this week, honoring his service and commitment to helping child abuse victims.

The National Children's Alliance (NCA) presented the 2010 Bud Cramer Award to Rawlings for his work advancing the Children's Justice Center (CJC) model.

Tracey Tabet, Utah's CJC Program Administrator, said Rawlings has been instrumental on a state level, not just in Davis County.

"Certainly Troy helped the Davis CJC realize its potential," she said. "But by strengthening Utah's laws, promoting the CJC model with his peers, and supporting our program generally, Troy has made a difference statewide. He is truly a champion for Utah's child abuse victims--and for the many professionals who work with them."

Nearly a month ago, the body of 4-year-old Ethan Stacy was found near Powder Mountain Ski Resort. "Not a day has gone by since Ethan Stacy's body was found that we do not actively work on the case or think about it," Rawlings said.

Rawlings leads the case against Stephanie and Nathan Sloop, Ethan's mother and stepfather, who have been charged with murder in the little boy's death. "It's the intent of the Davis County Attorney's Office to file the most serious charges and seek the maximum penalties that the facts and law will allow us to do, against Nathan and Stephanie Sloop for the death of 4-year-old Ethan Stacy," Rawlings said in a news conference.

Utah Attorney General Mark Shurtleff nominated Rawlings for the NCA award and offered his congratulations. "Nothing is more critical than providing the best help possible for child abuse victims," Shurtleff said. "Troy Rawlings well deserves this honor for being such a great advocate for children and the Children's Justice Centers."

"I cannot think of any professional award I would rather receive on behalf of the state of Utah than the Bud Cramer Award from the National Children's Alliance," Rawlings said. "I am honored to accept this on behalf of many dedicated professionals who make the CJC model work."

Rawlings was elected county attorney in 2006. Since then, he has collaborated with state lawmakers, working on significant legislation including Shelby's Law. Named after Shelby Andrews, who was killed in 2006, the law states that a death sentence can be sought in the intentional murder of a child under the age of 14. Because of the enactment of Shelby's Law, the Sloops will likely face the death penalty.

Rawlings also played an important role in enacting Utah's "sexting" law which makes it illegal to send explicit photographs and text messages to children under the age of 18.

LAYTON -- Fundraising for 4-year-old abuse victim Ethan Stacy continues, as funds are sought to pay for the boy's burial and help with his Virginia-based father's travel costs to attend the legal proceedings for those charged with his son's death.

Those organizing fundraising activities -- in keeping the public's trust -- are doing what they can to limit the number of hands collections pass through before being deposited in the Ethan Stacy Memorial Fund established at Wells Fargo Bank.

To alleviate concerns someone may have about giving to any one of the many fundraising activities, those wanting to help the Stacy family do have other options available, such as personally visiting the bank and making a deposit into the Stacy account, said Mark Chapman, spokesman for Wells Fargo Banks in Utah.

Chapman said he recommends donors personally come into any one of the bank's 130 locations in the state to make their donation.

"We definitely have an account open and people can come in and make a donation," said Chapman, who would not reveal how much has been deposited in the account because it is private.

"That information has to come from someone who can speak on behalf of the Stacy family," he said.

Davis County prosecutors have charged Ethan's mother, Stephanie Sloop, 27, and her new husband, Nathanael Sloop, 31, with first degree aggravated murder in Ethan's death.

Since news of the boy's death broke, the local community has rallied around his father, Joe Stacy, of Richlands, Va., establishing a memorial account in Ethan's name, and holding a series of events to raise funds.

Joe Stacy could not be reached for comment for this story.

The Sparetime Family Fun Center in Roy from 10 a.m. to midnight hosted a fundraising event for the Ethan Stacy family, said Andrea Bliss, event organizer.

Prior to the event, Bliss said she hoped the event, which included bowling, batting cages, miniature golf and pony rides, would raise a few thousand dollars.

"It is all going to the Stacy family," said Bliss, a Davis County resident.

"They (the Stacy family) need our help and I am willing to do whatever it takes to help them out," Bliss said. "Nobody deserves it more,"

The Roy event is not the first activity held to generate support and dollars for the Stacy family.

A Walk for Justice for Ethan Stacy on May 22 drew an estimated 700 people who walked 10 miles from the Layton apartment where Ethan Stacy lived with the Sloops, to the Davis County Jail where the Sloops are being held, said Anissa Martinez, co-organizer of the walk.

There was no registration fee for the walk, Martinez said. But some walkers, aware the account for Ethan had been established, stopped at the Wells Fargo Layton branch and made a $325 donation, she said.

"We're thankful that there was a Wells Fargo there," Martinez said. "That way money isn't changing hands."

Martinez said it is safer and alleviates questions or concerns if people make their donation directly to the bank.

Donors can also mail money orders to Wachovia Bank, (a Wells Fargo company) in care of the Ethan Stacy Memorial Trust, 201 Suffolk Ave. First Floor, Richlands, Va. 24641-2436.

Donors are advised not to send cash through the mail, Chapman said, and donations made to the fund are not considered tax deductible.

"There is sometimes a lot of confusion with people about that," he said.

Other fundraisers held in Ethan Stacy's name involved the Iceberg Drive-in in Syracuse on May 29. Iceberg collected about 1,000 stuffed animals and distributed them to area emergency response agencies to use to comfort traumatized children.

The Texas Roadhouse restaurant in South Ogden also held a June 1 fundraiser for the Stacy family, collecting $1,100.

"Bottom line, I have children," said John Christensen, managing partner in the restaurant, about why he hosted the event.

The restaurant donated 10 percent of its sales for the night to the Stacy account and restaurant patrons and staff also made donations, he said.

"It was the least we could do," Christensen said.

SALT LAKE CITY, June 27 (UPI) -- A Utah woman accused of helping to abuse and kill her son says she was forced into a marriage with her co-defendant and wants the marriage annulled.

Stephanie Sloop and Nathan Sloop are charged with aggravated murder, abuse and other felonies in the death of Stephanie's 4-year-old son Ethan Stacy, The Salt Lake Tribune reported Sunday.

His body was found May 13, buried next to a trail near Utah's Powder Mountain ski resort, the newspaper said.

Ethan, who lived in Virginia with his father Joe Stacy, arrived in Layton, Utah, at the beginning of May to spend the summer with his mother as part of a divorce custodial arrangement.

Stephanie and Nathan Sloop had been engaged for several months before being married May 6.

Sloop says her taking part in the marriage ceremony "was not voluntary, and was the result or product of physical duress by" Nathan Sloop, the Tribune reported.

FARMINGTON — In a community still reeling from the killing of two Layton children Wednesday, Ethan Stacy has not been forgotten.

Not for a minute. But those involved in his murder case want the public to know justice will come in time.

"This is an extremely important matter and an extremely complicated matter and while I know the public wants to move things quickly, it's important Mr. Sloop's rights are protected as well as the rights of the victim in this case," 2nd District Judge Michael Allphin said Friday.

Stephanie and Nathan Sloop are charged with capital murder in connection with the death of Ethan, whose disfigured body was found in a rural mountain area on May 9. At Friday's hearing, there were a number of supporters who again turned out to support the 4-year-old boy, hoping to see the case move forward. Instead new dates were set for additional status hearings.

Nathan Sloop's defense attorney Scott Williams said they want to make sure any "legal issues" are resolved before a preliminary hearing is scheduled. Stephanie Sloop's attorney, Mary Corporon, asked for a similar continuance based on the large amount of evidence in the case. Davis County Attorney Troy Rawlings said there are already more than 3,200 pages of documents and 180 CDs of information.

"We have to be prudent in cases like this," Rawlings said. "You always have to worry about appellate issues, so the state is agreeable to (setting another hearing). When you look at the weight of this case, aggravated murder, the penalty could be death, it's prudent for counsel to take time."

The judge twice told the public that while he understands that this is an emotional case that has left the public hankering for a resolution, it is important that the rights of the defendants are preserved. Lucinda Martin, a Harrisville woman who attended the hearing with others who met through a "Justice for Ethan" Facebook group, said the judge's decision to delay and simply schedule additional hearings is frustrating.

"I understand why he's doing it," she said. "But everything is about protecting their rights and not protecting Ethan's. Obviously we want them to do it right and we will be here."

Anissa Martinez, of Roy, said Ethan's case — together with the deaths of two Layton children who police say were killed Wednesday by their mother — has her greatly concerned.

"It's become an epidemic," she said. "Something needs to stop. You can't describe the feeling. The feelings of terrible sadness, grief and anger."

Rawlings said he understands the public's concerns about delays in the case, but said there is a constitutional presumption of innocence that "everyone needs to keep in mind."

"This case is on a death penalty track at this time and so the defense needs time to prepare for how they're going to defend this at the preliminary stage," he said. "We want to do this right and only do it once."

Prosecutors will have 60 days after the preliminary hearing to decide whether to file a notice of intent to seek the death penalty. Rawlings said it would be "silly" to file such a notice without knowing all of the evidence, which will be presented at that preliminary hearing.

"We're not going to jump the gun and be stupid," he said. "We're going to do it right. We'd rather have the case tried in appropriate time than prematurely."

Both Stephanie and Nathan Sloop waived their rights to a speedy public trial as it applies to the preliminary stages of the proceedings. The next status conference for Nathan Sloop, 31, is Oct. 22 at 8:30 a.m. The next court appearance for Stephanie Sloop, 27, is slated for Oct. 12 at 1 p.m.

Corporon said she will ask that the preliminary hearings be held separately, a request Rawlings said his office will seriously consider.

In addition to the capital murder charges, the Sloops face charges of child abuse and obstructing justice, both second-degree felonies, and abuse or desecration of a body, a third-degree felony.

Police say Ethan died as a result of "a systematic and progressively more violent pattern of abuse." His body was found in a remote area near Powder Mountain.

According to the county attorney’s office, spousal privilege won’t be an issue in the upcoming preliminary hearings for the accused murderers of 4-year-old Ethan Stacy.

The little boy’s mother, Stephanie Sloop, 27, and his stepfather, Nathan Sloop, 31, have been charged in his death.

In May, while visiting his mother‘s Utah home, Nathan allegedly tortured and abused Ethan over the course of several days -- ultimately resulting in his death. His mother is accused of doing nothing to prevent the horrific treatment Ethan endured.

After Ethan died, Nathan allegedly disfigured the body to discourage identification, and the couple buried the boy near Powder Mountain.

According to the Standard-Examiner, Davis County Attorney Troy Rawlings said Utah law does not allow a spouse to evoke the spousal privilege when the case involves “the possible abuse of a natural child of either party.”

Both Stephanie and Nathan are charged with second-degree felony child abuse, second-degree felony obstruction of justice, third-degree felony abuse or desecration of a body, and aggravated murder in connection with Ethan’s death.

The couple was in court Friday, learning they would be tried separately regarding the case. In addition, the judge announced Nathan’s preliminary hearing will begin February 1, while Stephanie’s will start weeks later.

Rawlings also noted his office will likely seek the death penalty for both defendants.

DAVIS COUNTY, Utah (ABC 4 News) - "If I could trade places with Ethan...I would," words written to ABC4 News from a mother accused of killing her own child.

It came as a letter addressed to ABC4's Kelli O'Hara from none other than accused killer, Stephanie Sloop. For six months, Sloop has been sitting in a Davis County Jail without bond. Stephanie and her husband, Nathan, are accused of beating, torturing then killing her 4-year-old son Ethan Stacy while he visited Utah during his summer vacation.

For months, Sloop has been silent in court and silent in the press... until now. In a series of letters, Sloop reveals to ABC4 what, she says, really happened those days leading up to Ethan's death.

The story begins on the early morning hours of May 11th, Stephanie and her newlywed husband Nathan called 911 to report Ethan missing. The couple told police the child had a habit of wandering but hours later that story proved to be false.

Ethan's burnt and disfigured body was found buried in the woods near Powder Mountain, the newlyweds admitted to parts of the crime.

In her letters, Stephanie talks about Ethan's death, "I had no idea about the hammer, I wasn't there when Nate buried my son. I was in the car and Nate never told me he was burning Ethan. He said he wanted the fluid for the grill when he got home."
Stephanie also addresses the circumstances leading up to her son'sdeath, "He never showed signs of being sick but he died of pneumonia and Nate giving him Xanax. Nate already admitted to abuse when I wasn't  there."

She continues, "It's obvious that they haven't released the medical examiner's report yet but Ethan's death was ruled ACCIDENTAL, that go public with."

Stephanie also reveals in her letters what her life is like behind bars. “Sleeping…the only thing I will say is that I wake up screaming, sweating and crying." The 29-year-old woman lives in isolation, only let out for an hour a day.

She reveals she reads the bible and other books for comfort and is well away of the media attention she has garnered, "My heart is broken and because of the negative media, I am branded a horrible person."

And in all of her letters, Stephanie appears remorseful "If I could trade places with Ethan I would…I loved my son more than life, he was mommy’s little man, he was so smart and happy…the reason I woke up, the reason for breath," and Sloop finally adds that "life isn’t worth it, without him."
ABC4 reached out to Ethan's father Joe Stacy for comment and he tells a different story, "Stephanie is a bad pathological liar… If she wanted to trade place with Ethan, she should have. Stephanie knew that Ethan needed medical attention but didn’t do anything about it.”

Preliminary trials for both Nathan and Stephanie Sloop are slated for February, Joe Stacy says he plans on being there

Nathan Sloop attorneys seek to close hearing from public

BOUNTIFUL — Attorneys for a man accused of brutally beating and killing his stepson claim that items have been taken from the man's jail cell — and they are seeking to keep that information out of court.

Nathan Sloop's attorney, Richard Mauro, told 2nd District Judge Glen Dawson that there are two items of evidence he feels should not be used in any court proceeding. In addition to the items that were allegedly taken from Sloop's cell by Davis County sheriff's officials, Mauro said prosecutors are trying to subpoena records involving Sloop's interaction with a therapist.

Admitting such evidence would violate Sloop's constitutional right to reasonable search and seizure and jeopardize his privileges involving the client-attorney and patient-doctor relationships, Mauro said.
But Davis County Attorney Troy Rawlings said prosecutors aren't seeking to do anything illegal or procure information that is privileged.

"It's our intention that in both cases, with both defendants, that all the evidence that has or will be obtained will be done lawfully," he said.

David Cole, who heads up the criminal division of the Davis County Attorney's Office, said, "We're not seeking to know anything more than we know at this point."

Defense attorneys had asked the court to close the hearings to the public and press and seal all documents relating to the evidence. Nathan Sloop's attorneys filed a motion in February arguing that detailing what is in the evidence may be prejudicial to their client.

"The identification of these issues with more specificity will jeopardize Mr. Sloop's due process rights and right to a fair trial, and exposure of the issues in a public hearing will undermine the very privileges that Mr. Sloop seeks to protect," the motion states.

Dawson decided to hold a hearing on the patient-doctor privilege issue and the potential subpoena of medical records on April 21. The hearing will be public, but any specifics within the evidence in question will be heard privately by the judge.

Sadly, my thoughts were the same when I first read the article, Cookie.  Although there may be some parents that would realize they need help, the ones like the Sloops aren't interested in their child/children in the first place. The kind of abuse Ethan endured before his death wasn't from stressed out parents and etc.  It's not like the Sloops needed an (up to) three day respite. Ethan was abused day after day in horrible ways.  The resources wouldn't have helped Ethan in this case, I'm sorry to say.  Why couldn't the Sloops have returned Ethan to his daddy?  Poor little boy.  It was so hard reading this thread again.  And Ethan's Daddy has to live with knowing about what happened to his son for the rest of his life.  That's a heavy burden.   ::MonkeyNoNo::

I agree that most people are not aware of resources that are out there...although I feel that in most of these awful cases, the parents are not concerned enough about their child to seek these resources...jmo..

Sadly, my thoughts were the same when I first read the article, Cookie.  Although there may be some parents that would realize they need help, the ones like the Sloops aren't interested in their child/children in the first place. The kind of abuse Ethan endured before his death wasn't from stressed out parents and etc.  It's not like the Sloops needed an (up to) three day respite. Ethan was abused day after day in horrible ways.  The resources wouldn't have helped Ethan in this case, I'm sorry to say.  Why couldn't the Sloops have returned Ethan to his daddy?  Poor little boy.  It was so hard reading this thread again.  And Ethan's Daddy has to live with knowing about what happened to his son for the rest of his life.  That's a heavy burden.   ::MonkeyNoNo::

Farmington • Preliminary hearings for Nathan and Stephanie Sloop, originally set to begin Monday, have been continued until next spring so attorneys can wade through the case’s voluminous evidence.

During a Tuesday hearing in 2nd District Court, defense attorneys for the couple accused of killing 4-year-old Ethan Stacy said they were still examining the 16,482 written pages and 412 multimedia discs prosecutors had provided them, even as new evidence has become available.

"Some of the things have been evaluated and looked at before ... but there is some new technology available that necessitated further evaluation of some of the physical evidence," said Davis County Attorney Tory Rawlings. "The new evaluation efforts have yielded fruit."

Both Rawlings and Stephanie Sloop’s defense attorney, Mary Corporon, declined to discuss what new evidence had been discovered.

A five-day preliminary hearing for Nathan Sloop, who was Ethan Stacy’s stepfather, was scheduled to begin Monday, but instead was delayed until March 19. A preliminary hearing for the boy’s mother, Stephanie Sloop, will begin sometime after that.

Farmington •After more than three years of delays, Nathan Sloop, the man accused of contributing to his stepson’s death and disfiguring the boy’s body after filing a false missing child report, will have his day in court.
 
Sloop, 34, will be tried on March 17 of next year for the 2010 death of his 4-year-old stepson Ethan Stacy.
 
He pleaded not guilty on Tuesday to felony counts of aggravated murder, intentionally inflicting serious injury on a child, obstructing justice and abuse or desecration of a human body.
 
Shackled and dressed in a county jail jumpsuit, Sloop slowly scanned the courtroom’s gallery as he said his name aloud for the court record. When entering his plea to the charges, he loudly and emphatically pronounced each syllable of his words: "Not guilty."
 
Prosecutors, meanwhile, are arguing that Sloop should be eligible for the death penalty in Ethan’s death. While Sloop’s attorneys argue that Sloop never intended to kill the child, the Davis County Attorney’s office has invoked Shelby’s Law, which allows prosecutors to seek the death penalty without having to prove a killing was intentional when a child dies during an act of abuse. Sloop’s attorney, Richard Mauro, has argued that Shelby’s Law, a 2007 amendment to Utah’s homicide statute, is unconstitutional.
 
"We’ll continue to look at whether or not that law applies, whether its constitutional," Mauro told reporters after the hearing. "He shouldn’t get the death penalty because he didn’t commit an intentional killing."
 
Sloop’s wife and Ethan’s mother, Stephanie Sloop, 30, faces essentially the same charges in her son’s death. A preliminary hearing in her case has been set for December.

Mary Corporon filed the motion Nov. 7 in 2nd District Court.

A four-day preliminary hearing was set to run from Dec. 10 to Dec. 13.

She has requested the judge to set a status conference for Jan. 28.

Stephanie Sloop, 28, and her husband, Nathanael Warren Sloop, 32, are each charged with aggravated murder, second-degree felony child abuse, second-degree felony obstruction of justice and third-degree felony abuse or desecration of a body. The charges stem from the death of 4-year-old Ethan Stacy, Stephanie Sloop's son, on May 8, 2010. The murder charge carries a possible death sentence, for either Sloop convicted. The evidence showed the Sloops had asked their chiropractor how to treat Ethan's second- and third-degree burns, along with how to handle Ethan's behavioral issues, including several instances of biting Nathan Sloop and Ethan escaping their Layton apartment.

The chiropractor, who never examined Ethan, told them to put honey on the wounds and give the boy oregano oil to control the behavioral issues.

Stephanie Sloop ­— charged with murder in the 2010 death of her son — was in court Thursday for a brief status hearing.
 
Prosecutors told 2nd District Judge Thomas Kay they have made "significant progress," but need at least one more month before deciding where to go with the case.

Sloop, 31, is charged with first-degree felony aggravated murder, second-degree felony counts of obstructing justice and inflicting serious injury on a child, and third-degree felony abuse or desecration of a dead human body after Ethan Stacy died in 2010.
 
The woman’s husband, Nathan Sloop, 35, faced the same charges in the death of his stepson. He pleaded guilty but mentally ill in February to aggravated murder — a capital offense — while the remaining charges related to the boy’s death were dismissed. He also pleaded guilty but mentally ill to second-degree felony aggravated assault by a prisoner for attacking a Davis County jail officer.

Sloop, 31, is scheduled to return 2nd District Court on Nov. 17 for a three-day hearing. She also has a scheduling conference set for Sept. 4.

"There’s a conflict between [Stephanie Sloop’s] due process rights and Mr. Sloop’s allegations of 4th Amendment rights and right to counsel and private communication with counsel that would be implicated," Corporon said.

I hope these matters will be resolved soon, and there will be justice for Ethan and family.  The case is more than four years old.  Not only is this torturous for his family to endure, but it keeps all those that may have to witness and etc. to wait and wait.

FARMINGTON — A woman charged in the death of her 4-year-old son has struck a plea deal with prosecutors.

Stephanie Sloop pleaded guilty on Monday to aggravated murder and obstruction of justice in the murder of Ethan Stacy. In exchange, prosecutors removed the possibility and the death penalty and dropped charges of child abuse and desecration of a body.

“My selfish behavior is the reason I am standing here today pleading guilty to these charges,” Sloop sobbed as she addressed the judge.

“The fact is, I am entirely responsible because I am his mommy! I failed to take care of him properly because I couldn’t even take care of myself. My selfishness and failures as a parent cost ‘pumpkin’s’ death, and there’s no changing the fact that I am the one responsible.”

Stacy, who lives in Virginia, was in court Monday but declined to make a statement during the hearing, the Tribune reported.

He had sent Ethan to live with his mother as part of a divorce agreement. The boy died 10 days after arriving in Utah.

When he called to talk with his son, Stacy said Stephanie and Nathanael Sloop told him Ethan was asleep or playing outside.

Nathan Sloop, 35, pleaded guilty but mentally ill in February to aggravated murder. By accepting a plea deal, Sloop was spared a potential death penalty if he had been convicted by a jury. A judge instead sentenced him to 25 years to life in prison.

 The Utah Board of Pardons and Parole recently told Nathan Sloop that his first parole hearing won't be for 40 years. It was in part because of the parole board's tough stance with Nathan Sloop, as well as his desire to avoid years of legal appeals, that Joe Stacy agreed to the plea deal with Stephanie Sloop, Rawlings said.

**Update**5/13/2015: Neither Stephanie Sloop or Nathan Sloop will be walking out of prison any time soon. The Utah Parole Board has set their first parole hearing for 2055 – in 40 years. Both will be in their 70s. And they may not be released then.
