When reading Q & A practically everyone sounds stupid to me.
Especially since the court reporter has to include all the uhms, and other stuff.
Following the transcipts (ie. Dominic casey, Laura Buchanan, etc) makes my head spin.

He never said, he just has some business to take care of. Remember, this is a carry over, was not originally scheduled for hearings, only a status hearing at 1:30 (I think).  But it has to be done, to they're going for it, whatever it takes.

That is why I do Medical Transcription.  We have to leave the umms out.  But, I swear if I left them in, I'd be rich.  I do not like the way real transcripts look with ums and overspeaking.  I like polished looking documents.

Imo, Baez's lack of trial experience and specifically administrative issues as they relate to complex motions and casework are to blame.


This is the reason that on his own, he could not legally represent Casey in this matter without a qualified attorney in the first place, so how it is that this flub is slowing and frankly thwarting the process from moving along without CJ Perry stepping in I have no idea.

Keeping in mind, Perry has the obligation to protect Casey's rights over all other matters going on in the court room.

He could want to chuck Baez down the elevator shaft, but he will show equity to both sides at all times to protect the rights of the accused and her right to due process.

I do opine if might change it up this afternoon and have Jeff Ashton on direct in some of the other pending issues.

IMO it was aimed at the duhfence b/c bi-azz was making comments. Prosecution objected which which sounding to be what JBP stated.  I'm never a fan at repremanding everyone. But it is probably better that JBP keeps things equal.

Judge Perry is sooo good, offering them pages on court decorum..........he had me scared and I am 3000 miles away.  I just can't imagine pushing his buttons in the same room.  I know he had to say it to both sides equally but you know he was really speaking to Bozo.  Bozo just can't keep his mouth shut and you can see his animosity for LE and the prosecution with his every word and grimace.  You would think that if he wanted to save Casey's life as much as he says he does, he would STOP grandstanding and trying to play "Hispanic Lawyer of the Century" and just do his job.  He is just frustrating to watch, I hope during the trial, Bozo gets slapped and slapped often.  I don't know who gave that blazer to Casey but it doesn't fit and if she was going for the "wise, law school student look" she has failed miserably.  It doesn't fit and makes her look like she is *shrinking*.  At least we don't have to watch her twist her hair into one curl today.......that was just exasperating.  So glad to have all of you to watch the hearing with today.  I am so honored to be part of this amazing forum.

I feel like Linda dislikes him because he is so incompetent and she is so professional. I know where I worked years ago we had a true bimbo and she was okay personally but I could not help but dislike her because she created so much chaos around her. Her lack of professionalism affected all of us because she made a lot of extra work for us. I see bozo as being just like that. He has created such chaos in the order of the hearings it has made everyone have to do a  lot of extra work.

He whines like a little kid when he does not get his way & tries to pass blame to everyone else. That is not what a real attorney does. I can understand JP wanting to take every precaution to avoid an appeal issue, but this has to stop at some point or the trial will be one complete circus.

I really think JP was wrong yesterday in warning bozo about the questions for the attorney & privilege. I feel like bozo has had way too many warnings and help in that courtroom. If he does not know the law, let him learn it from his mistakes.

My granddoggie (who in his early life had some previous trauma) didnt like the way I picked him up to clean his muddy paws & he got the right side lower lip significantly but not serious.   Well, I learned not to pick him up from behind!   He's a sweet silky terrier & very smart but I think he was kicked around by my son's ex.  She took the dog out of spite during the divorce & then returned him when she was done hurting my son by it.   My daughter was caring for him  & then they both couldnt any longer because my son went off for additional officer training with the Army which relocated my daughter since she was sharing an apt with him since she graduated college.  Originally, I was only going to care for him until she got her new apt but now it looks like "Trigger" will be permanently at grammies because she works crazy hours & he's become very attached to my 3 furbabies....omg goodness that was a bit too much O/T, slapping myself, my apologies.

The mother of accused murderer Casey Anthony took the stand this morning on the third day of crucial pretrial hearings in her daughter's murder case.

Cindy Anthony testified about what investigators said about her daughter's defense attorney, Jose Baez, shortly after her granddaughter was reported missing.

She said law enforcement "didn't like Mr. Baez. It was very clear from Day One." She said lead investigators said Baez was not interested in finding Caylee and they did not trust him.

Cindy said she shared phone messages claiming to have possible details about Caylee. She shared these with the investigators, and Detective John Allen told her, "He felt those phone calls were set up by Mr. Baez," she said. She added that Allen told her, "I wouldn't put it past him. That's just the way he is."

Casey Back In Court For Day 3 Of Case Hearings

ORLANDO, Fla. -- Casey Anthony and her attorneys were back in the courtroom Friday morning as a scheduled 2-day hearing pushed into a third day. Prosecutors and defense attorney's furthered their cases over the admissibility of conversations between Casey and her family, but not before taking up a matter concerning WFTV.
Things got heated fast with Judge Belvin Perry reprimanding Casey Anthony for arriving to the courtroom late. The hearing was scheduled for 8:45am, but Casey didn't arrive until around 8:50am.

Judge Perry explained that he would not wait for "clothes" to start the hearing and said that when he sets a hearing for 8:45am, it needs to start at that time. Apparently, Casey's clothes were late arriving for her at the courthouse.

Cookie, he was throwing himself to the court for his inappropriate accusations & disparaging remarks in his recent motion.   I get the sense that CJBP had a serious tongue lashing with him regarding it because Bozo (as we all have witnessed) would not have apologized for his behavior unless he was in some rather hot water over it.   Speculation on my part, but I doubt its too far off from exactly what happened.

Defense attorneys tried to make the case that investigators wanted to use Casey's family to go around attorney Jose Baez. Cindy told the judge that investigators asked them numerous times to go directly to Casey for information, without Baez knowing about the exchange.
Cindy tried to take that a step further and told the court that Orange County sheriff's investigators express dislike for Baez.
"Sgt. Allen made it very clear to me and my husband in the very beginning that he didn't trust Mr. Baez and didn't like him…..I"m trying to answer," Cindy said.
As that exchange continued about Baez, Casey at one point seemed to console him by patting him on the thigh. It seemed an awkward moment after Cindy said investigators thought he was, "full of it."

While we're chatting, could you please keep in mind that we have to plan to attend these hearings. There's so much to do! The collection process alone is daunting! There's hoards of food supplies to gather.... why the chokky alone takes a wheelbarrow, and then there's the liquor for when you let Baez talk for an extended period of time. Some have to buy cartons of ciggies and I'm not even going to talk about what else may be in some of those ashtrays!  ::MonkeyEek::

Therefore, when court adjourns, could you please make sure you keep Monkeys in mind and spell out what your intentions are? Also, would it be too much to ask for a split screen into the sequestration room? The defense said it will not call the witnesses at issue, so that's it for that motion.

11:48 a.m. -- Video of Casey in jail reacting the day Caylee's remains were found will not be reference at all during trial.

11:45 a.m. -- Both sides also agreed not to call someone a "liar." Judge Perry has been granting these motions rapidly.

11:44 a.m. -- Judge is not ready to rule on evidence motion yet. He wants to read depositions first.

Now discussing a number of motions concerning testimony during the guilt portion of the upcoming trial. Both sides agreed no testimony as to personal opinion.

11:38 a.m. -- Judge Perry said he wants depositions of experts.

11:33 a.m. -- The defense wants to exclude evidence concerning chloroform.

Jeff Ashton said defense expert Dr. Hall's testimony is not based on science, just his opinion based on all his experience.

Dorothy Clay-Sims argued it is not just pure opinion, and should be subject to a Frye hearing.

11:30 a.m. -- Now arguing a motion to strike the defendant's motions to exclude unreliable evidence. Assistant state Attorney Jeff Ashton and the defense's newest attorney, Dorothy Clay-Sims, are arguing.

11:22 a.m. -- The defense said it does not have any other witnesses concerning the motion to suppress statements to the Anthony family. Attorneys are in sidebar.

11:19 a.m. -- Cindy Anthony has finished testifying. She said she did not knowingly help investigators build a case against her daughter.

11:10 a.m. -- Cindy is now being cross-examined by the state. When she last testified on Wednesday, the two became argumentative, and Cindy said, "I'm not stupid."

11:02 a.m. -- Cindy is talking about Casey's cell phone, and now says investigators suggested that she talk to Casey, because they couldn't.

Of note, George Anthony is still in the courtroom. During the previous two days of testimony, one of Casey's parents had to leave while the other testified.

10:57 a.m. -- Court is back in session, with Cindy Anthony taking the stand. Casey is not showing any emotion this time, and continues writing in her legal pad.

10:18 a.m. -- Cindy Anthony was about to be called to testify, but state prosecutors said they wanted to finish cross-examination of Sgt. John Allen, who testified at end of day Thursday.

George Anthony chuckled and shook his head when the state asked Sgt. Allen if he was trying to get George or Lee to talk to Casey in jail and report information back to them.

Court is on break until 10:50 a.m., but before calling recess, Judge Perry told all attorneys he will not stand for editorial comments. He told them they are all seasoned attorneys and should know better, and he will punish them if it continues in his courtroom.

The judge's stern comments came when the state objected, saying Jose Baez was "editorializing."

9:59 a.m. -- Detective Yuri Melich admits to lying to the Anthony family during the investigation. He is done testifying.

9:52 a.m. -- Melich continues to answer "no" when asked if he asked any member of the Anthony family to talk with Casey and report back with information.

9:48 a.m. -- Casey has been writing in her legal pad and looking at the defense's iPad while Detective Melich is cross-examined.

9:34 a.m. -- Detectives told George Anthony they had "explicit" photos of his daughter, and that they would soon be released to the public. George was so upset, he ran into the bathroom and threw up.

The state is now cross-examining Detective Melich.

9:29 a.m. -- The defense says Yuri Melich and other investigators were using George Anthony as an agent of the state, and trying to get them to get information from Casey.

Melich told George he was concerned Casey may kill herself, mentioning the case of Melinda Duckett, and he feared they may never find out where Caylee is.

He also told George he was concerned for Casey's safety in jail. He told George people will prey on people who are accused of hurting a child.

The defense said Melich did this to scare George Anthony into finding out information from Casey about Caylee's whereabouts.

9:23 a.m. -- George Anthony is in the courtroom.

9:20 a.m. -- Court has now moved on to a motion to suppress statements made to family members. Thursday's hearing ended on this with Sgt. John Allen. He is expected to testify for two more hours.

But in order to accommodate another officer's schedule, they are first questioning Detective Yuri Melich.

9:17 a.m. -- Judge Perry grants a motion to subpoena, saying the defense failed to show burden. The local reporter will not be called as a witness.

8:57 a.m. -- At attorney for a local television station is arguing a motion to keep a local reporter out of the courtroom. The defense said the reporter injected herself into the story and fed information to an alleged jailhouse friend of Casey Anthony's.

8:55 a.m. -- Late start is blamed on clothing. It took time for the defense to get clothes to Casey. Judge Perry said he will not wait again.

8:53 a.m. -- Day 3 of critical hearings is now under way. Judge Belvin Perry is upset things are starting late. Hearing was scheduled to begin at 8:45.

Another annoying part about the dropping of the contempt charge was that Bozo took just a second to apologize. The rest of the time was spend on self-aggrandizement. So he got free airtime for a commercial about what a caring passionate defense attorney he is.

IMO, this ruling will be critical. I am no expert by any means, but I have been to the Body Farm twice. It is an experience like no other. They know what the hell they're doing and are professionals, even the med students. When I toured, I as well as everyone else had to follow strict protocol. They test and test and test until they get it right. You name a scenario with larvae, they've tried it...period. It is NOT opinion, it is fact bc it's been tested and tested and tested until it's brought to a conclusion...period. I wanted to work in infectious disease after college. I have regretted my decision to stay home for many years bc science has always interested me, although my boys are my everything and priorities change.

There isn't a chemical link between steroids and chloroform. Steroids are a synthetic version of a naturally occurring hormone.

The chemical structure of the natural hormone testosterone and the chemical structure of the synthetic anabolic steroid utilized to mimic testosterone differ by several chemical properties. Therefore, the first order of business would be to determine which type of testosterone existed in the syringe. Isotope ratio mass spectrometry can measure the ratio of Carbon-13 to make this determination.

Ethanol is merely a compound that is utilized to stabilize chloroform. About 1% is utilized to prevent accumulation of Phosgene which will break the chloroform down, but this usually only applies to aged, stored chloroform. Casey didn't graduate high school, therefore, I doubt she understood this process. If she mixed the recipe following every instruction, then she added ethanol to the concoction.

Synthetic testosterone is often given to post-menopausal women or women who are have not yet reached the menopause state but are experiencing premenstrual dysphoric disorder. It can also be given to men to treat erectile dysfunction.

George and Cindy could have had medical problems that required the utilization of testosterone therapy. Cindy had access to syringe kits. Casey was a liar and a thief. Therefore, she could have stolen a used syringe kit out of the trash can that contained trace levels of testosterone. Their medical records should be subpoenaed to check for prescriptions that called for the use of a syringe kit. Cindy's previous employer should be questioned as to whether or not there were supplies missing, namely, syringe kits.

Chloroform occurs naturally in a pool environment due to the use of chlorine. Casey had access to these materials and someone searched her computer for a recipe on how to concoct chloroform.

Circumstantial... yes, but tell that to Scott Peterson and his bags of cement.

So, I say this...makes ya think, huh? I do think this is a very critical motion to suppress. I wouldn;t wanna be in Judge Perry's shoes right now, especially if he doesn't know the meaning behind the science presenting such extraordinary facts.

Something else to think about: LKB had alot to do with the defense for a very long time. She brought much expertise. Her husband ran a series on the Body Farm and painted a very professional picture of them, worked hand in hand with some of those experts there. So I ask you this, how the eff does she sleep at night knowing gd well the person she was assisting to protect from the needle had something to do with her daughter's death, all the while helping to throw some of these experts under the bus, those experts coming from the Body Farm which her husband helped to bring significance to?

Pffffft!

Now we know.  When Judge Perry issues orders, he doesn't really mean it especially if you're an Hispanic attorney with the first case of this magnitude that a Hispanic attorney has ever had in the whole history of the world and maybe Mars, too. I've come to the conculsion that being a judge is a whole lot like being a parent.  You should mean what you say and say what you mean.  And follow through.  A chubby little face saying, "I'm sowwy," shouldn't get him off the hook.  Baez has consistantly failed to meet deadlines, insulted the SA office and individuals on the SA team, accused Orlando LE of lying and setting Casey up, and instead of a little jail time, he says, "I'm sowwy," and that makes it all ok.  Well, not in my book.  I am so disappointed in the judge.  I thought Strickland was bad but now I wish for the good old days.

Perry's orders mean nothing.  And I think we'll see this repeated during the trial. Perry's forgiving Baez and, I suspect, ordering Ashton to accept his apology and  drop the motion for contempt charges portends more of the same, and it ain't good for Lady Justice. Been riding the rafters late night for awhile, no time to post lately.  THANK YOU to everybody for the links, pics, and ongoing commentary! I really appreciate it!  Wow!  What a ride!  This is only the pre-game too.

The real "Dream Team" here is LDB, Jeff Ashton, and the State's Attorney's office.  The prosecution team was chosen by God for Caylee's sake and it's obvious every time they step up to bat. Baez, Mason, the Anthonys, Jeremy Lyons, and the rest of Casey's crew had better turn while they still have time.  Smackdowns from JP are going to look like a vacay compared to a second before God.  God is not mocked; whatever a man sows that will he also reap. He's got a particular soft spot for widows and children and He's very clear in His Word about defending them.

My take on George's testimony: Baez et al. are building their mitigating circumstances "defense" for the Penalty phase, based on what they will portray as George's obsession with Casey.  IMO, they'll use the molestation allegations, George's confessed willingness to do "anything immoral or illegal for Casey", George's desperate letters to Casey and his pleading to see her alone, George's affair with River, his "gambling" addiction, his anger management issues, his relationship with Cindy, etc. to throw him under the bus.  Also (IMO), they'll use Cindy's MySpace post, her letters to Casey, her testimony, and Casey's friends' testimonies to paint Cindy as obsessed with Caylee and insanely jealous of Casey.  All of which may be fine with Cindy because she's 100% vested in saving Casey to save face.  George, on the other hand, has difficulty with "saving Casey at all cost".  Hence, his choked , emotional admission that he would do anything immoral or illegal for Casey.  IMO, he teared up not because Casey means so much to him, but because he knew what agreeing to say this and saying it was going to cost him personally.  Not to trivialize this is any way, but if it was just a matter of molesting Casey (as opposed to murdering Caylee or aiding and abetting Caylee's murder), I don't think George would be going along for the ride.  The worst (public outing of info) is already over.  IMO, he's been badgered/guilted into thinking this is the only way to save Casey and himself and he owes it to her.

As far as Cindy goes, IMO Baez is setting her up for Penalty phase mitigating circumstances too.  He'll use her MySpace post, her letters to Casey, her media tours, her testimony, and Casey's friends' testimonies to paint her as obsessed with Caylee, using money and goods to manipulate/emotional abuse and physical violence to intimidate a young, poor single mother, and get her child.  He'll use the protestor confrontations and Cindy's jailhouse videos to document Cindy's explosive temper and aggressiveness. He'll tell the court Casey is a "product of her environment", compounded by years of psychological/emotional/physical/sexual abuse within the clannish family, and "acted out on learned behaviors".  It would not surprise me in the least!  It appears Cindy's competitive, narcissistic (IMO), proud, and confrontational nature will be fodder for the defense, as she goes under the bus as well. Notice today she did "better" on the stand and earned Casey's "approval" (a slight acknowledgement).  How pathetic!

Lee is interesting to say the least.  The most seemingly normal of the clan seems divided between defending the family, protecting Casey, and protecting himself. I suspect it's been a fence he's straddled most of his life.  It's clear from past interviews that Cindy relies on him emotionally to hold this volatile family together.  I say this without malice aforethought, IMO Lee likely has Asperger's (per his seeming fixation with Star Wars, inappropriate laughter and facial expressions, lack of appropriate familial boundaries, awkwardly unnatural/rigid? stance and gainliness, awkard manner of speaking in rhythm/tone/inflection, "Little Professor" attitude of superiority, seeming social awkwardness, seeming to prefer solitary situations like online gaming and parking cars, and his seeming unawareness of societal norms like dressing professionally for court and communicating with the defendant in the courtroom/laughing while holding an obviously distraught and crying Caylee in that disturbing pic/Lee's advertisements for an unpaid personal assistant slave at the beginning of this saga).  IMO, Casey intuitively recognized Lee's "weaknesses" and likely exploited them to the fullest extent. I'm slightly on the fence on the molestation allegations by Casey.  For someone who provides tons of details, her allegations noticeably lacked detail.  I'm inclined to say, "Didn't happen.".  However, I could see Lee in that socially awkward, not understanding normal boundaries way possibly attempting something.  I'm more inclined to believe Casey was the instigator though. These are strictly my opinions, not a diagnosis of any sort, merely based on observation/statement anaylsis/research.  Do I trust Lee? No.  Do I feel sorry for him somewhat?  Only to the extent I believe he may have Asperger's (diagnosed or undiagnosed) and was parented by two highly dysfunctional parents in an extremely dysfunctional and somewhat paranoid family unit.  They all have been keeping each other's secrets for a long time.  I think Lee became Casey's "keeper" long ago.  It's likely she, at some point, became his defender socially, solidifying their bond.  It's interesting how Cindy & George seem to treat Lee with kid gloves, having different expectations of him than of Casey.  For two peole who are proud of their professions (Nursing and former LE), they don't seem to have high expectations for Lee. All my opinion.

Sorry for the long post...I've been saving up!  ::MonkeyHaHa::  Got to run-Life calls!  Take good care of yourselves, we're in this for the long haul for Caylee!

O/T:  Sorry I haven't been responding or posting much guys!  It's been wild around here, as you can see I'm still in Christmas attire. Dealing with lots of family extended issues/illnesses/increased work load for the last 3 months. 

The judge should have said since this problem with getting the clothes here on time has happened twice..she now wear her prison clothes so that we do not have this problem again.

Perry is really bending over backwards to make sure KC and her lawyers don't screw up.  Personally, I would love to see and hear Baez schooled...but..I will to see Casey put away for life with no chance of appeal because she has no grounds.  I could not stand to watch this circus happen all over again simply because Baez is a jerk.

I think you can sue Loca, emotional distress and all that.  He scared you with his face, making you trip. 

I always appreciate your well thought out posts. Glad to see you back.

One parting comment, I am also disappointed in Baez' private smackdown by Judge Perry.  His very public obnoxious, rude, rebellious behavior, deserves a public correction session.  Not only as a deterrent to Mr. Baez, but also as to serve notice to any others thinking about "going over the hill".  It's called Respect For Authority and Baez doesn't have it and likely never will- if he hasn't learned it by his age. Ashton may or may not have been instructed to receive the apology (not that he needed the counsel, he's professional through and through). It's likely JP: read Baez the riot act in the presence of both the defense and prosecutions; informed Baez that he's used up his last chance; infomed both sides he will not tolerate any more personal attacks and stated this case will not be derailed or extended due to personal acrimony; warned that professional courtesy will be observed in his courtroom or their will be legal consequences; reminded Baez he's still subject to Bar inquiries; reminded Baez & Mason of civil lawyers looking for cause to sue them; and Baez would issue an immediate public apology to Ashton specifically.  Personally, I think JP has long tired of Baez throwing sand in Ashton's face, so to speak.  IMO, he didn't want to waste court time reprimanding him and thereby giving him attention (any attention to Baez= positive attention)...sort of like the class clown.  He was also severing Baez' ability to publicly whine "the Judge doesn't like me" or "they're trying to keep me down/they're picking on me because I'm Hispanic".  That's my take on it.  The proof of Baez' repentance will be in the pudding.  Let's see how long he goes before he personally attacks or twists the truth and blames LDB/Ashton/the state for his own incompetence or unwillingness to comply with court orders/motions.  We'll see.  JP is, once again, circumventing  any possible grounds for a mistrial.  I'm not worried, the State has their game on and Caylee will have the last word.  All MOO.

P.S. JP is not always going to do things the way I think they should be done.  However, his record,experience, and reputation speak for themselves.  Me, on the other hand, I've never been a judge.  LOL!

Friday afternoon, the judge announced he will hold a hearing next week on a set of key remaining pretrial motions he heard arguments on this week. While Ninth Judicial Circuit Chief Judge Belvin Perry ruled on a handful of small motions Friday that the defense and prosecution argued on over three consecutive days, he has called another hearing for 2:00pm Monday. It is then that he is expected to rule on other motions that could affect the strategies both the defense and state will employ in the upcoming trial of Casey Anthony.

Things got heated fast Friday morning with Judge Belvin Perry reprimanding Casey Anthony for arriving to the courtroom late. The hearing was scheduled for 8:45am, but Casey didn't arrive until around 8:50am.

Judge Perry explained that he would not wait for "clothes" to start the hearing and said that when he sets a hearing for 8:45am, it needs to start at that time. Apparently, Casey's clothes were late arriving for her at the courthouse.

As many of you know, the focus of the hearings over the last three days has been on whether Casey Anthony was “in custody” and, if so, at what point was she “in custody.”

And as has been discussed at  WebSleuths by AZLawyer, Judge Perry’s decision will hinge on the following four factor analysis used in Florida and outlined in Ramirez v. State, 739 So. 2d 568 (Fla. 1999):

   1. The manner in which police summon the suspect for questioning;
   2. The purpose, place, and manner of the interrogation;
   3. The extent to which the suspect is confronted with evidence of his or her guilt; and
   4. Whether the suspect is informed that he or she is free to leave the place of questioning..

I find HLN less credible than the National Inquirer anymore!

I think Byass is barking up the wrong tree on this one.  This case was about a "missing child" a "kidnapped child" and "child neglect" before it was ever about a murdering mother.  And the initial reason she was arrested was child neglect ... and if your child was either missing or kidnapped for 31 days before you called police ... I'd say that was child neglect.   ::rhino::  They could have slapped handcuffs on her the first minute after arriving and still been within the law in my mind.  31 days!?

It wasn't me as I see no problem with that trip. At the time she was volunteering to help them. From the testimony presented there was no coercion or demands made for her to go. From what was presented she willingly went and even insisted on getting on the premises by telling the guard she worked there & did not have her ID with her. They told her more than once she was free to leave the room where they were questioning her. I could have missed something but I believe it will be a part. 

Her being handcuffed @ the house appeared to be a result of Cindy wanting her arrested and expressed her fear she would leave. It is not unusual at a scene where the details are unclear for people to be cuffed until the officers sort out the particulars. If they are fishing for an appeal issue on the handcuffing, they are barking up the wrong tree unless there is something in Florida law which is different from here.

I am not sure how he will rule, but from what I can find out from my brother if it were here neither of them would meet the burden of proof the defense needed to get them excluded.

Gypsy, I couldnt agree more.   Sometimes we might not like what we think we are not seeing but the truth is the larger picture always seems to be paramount on this Chief Justice's mind.

Actually, the reason why she was initially cuffed was at her mother's insistence with the excuse it was regarding stolen property (car) & money to keep Casey at the house.   The cuffs were removed later when her mother admitted she did not want to have her daughter arrested but she was never "in custody" nor "arrested" until after she volunteered to go on her web of lies tour ending at Universal the following day.   Casey up until that point was then viewed as the mother of a missing child, albeit her actions were in question as to why she did not report her daughter missing for 31 days.  While at Universal & even at the house it was made very clear to her what her options were & asked several times if she wanted to continue volunteering to talk to police & it was recorded.  The issue of her being cuffed or in the rear seat of a patrol car, both are standard operation procedures & mainly for the safety of the officers in the patrol car in mind.  There are many reasons as a matter of fact that an individual or several could be temporarily cuffed, for example... a call of a disturbance at a teen house party or a street fight, it is not untypical in those circumstances for safety reasons or risk of flight to temporarily cuff a crowd until interviews of what happened were conducted & it was determined who if anyone broke a law & would at that point be placed under arrest.    Subsequently, Casey was arrested for lying to LE and child neglect and brought to the station at the conclusion of her voluntary statement at Universal.

  1. The manner in which police summon the suspect for questioning;   The police did not summon the suspect, the mother of the suspect requested assistance to her home were her daughter was with her but not being restrained to stay.
   2. The purpose, place, and manner of the interrogation;    The original purpose was at the bequest of the suspect's mother first reporting a stolen car & money, thirdly then reporting that she was told at that point her granddaughter was not reported missing by her daughter for 31 days.  The suspect was asked if she would be willing to make a voluntary statement.   When she was being questioned she was in an open doored room at her residence & even out freely walking with an officer outside the home.
   3. The extent to which the suspect is confronted with evidence of his or her guilt; and  At no such time did these officers say or do anything inappropriate in their questioning a) suspect of stolen property & money b) mother of a missing child
   4. Whether the suspect is informed that he or she is free to leave the place of questioning..  She was briefly in cuffs, then released from them.  Additionally, the officers left the home of the suspect leaving her to sleep in her bed & be with her family which obviously indicates she was free to come and go if she chose to.   The following day, or rather later that morning as the evening concluded in the am hours she volunteered to go with officers & she was not cuffed the entire time until it became obvious thru her own admittance of lying that she would be put under arrest & read her Miranda rights.

That's my opinion & Im sticking to it.   I do not believe the defense proved any legally sound reason which prevent Casey's statements to police 7/15-7/16 from coming into evidence for trial.

After ALL that screeching about the junk science of the scientists@Oak Ridge and their use of gas chromatography and all of a sudden bozo is not agreeing not to contest any of it?  Something is up here. Either he found out there was no way to dispute their work or he agreed to do that if the prosecution would drop the contempt charges. I knew he did not have a leg to stand on disproving the science but he has ranted on and on about it for 3 years. I did notice that was written up right after their "conference" with the judge so I am thinking it was the contempt charges.

I can't even believe what I just read.  I was on the first pdf of Dr. Bock in the new defense documents that were released.

It is already a very difficult thing to read, they are discussing the crime scene and the pictures taken.  While talking about Caylee's precious skull and the plants around it.  Jose Baez actually tried to JOKE about it.  Thankfully the wonderful Mr. Ashton put him in his place.  I can't copy and paste the pdf so this is going to be typed by hand.

I am at a loss for words, no matter what he said today in court, Baez has no sense of right or wrong.  He just wants to win and win at any cost.  We have a monster defending a monster, there isn't a doubt about it in my mind.  I felt so let down today, when he wasn't slapped about missing a deadline and then ended up treating it as if it were nothing.  Then I thought, well Judge Perry must know best, how to keep this a fair trial and if that was good enough for him, it should be good enough for me.  I am back to my original and correct feelings about it.  He should of never been able to stand there and talk so smugly about what a wonderful advocate he was and barely give Mr. Ashton a proper apology.  When they reach a guilty verdict for our beloved Caylee, I will be even happier knowing that it will once again make Baez what he really is, A LOSER.

I think this all goes back to  after Caylee's body was found and we heard all the A's, as well as all the defense call this "junk science".  I think that Simms was trying to allude to that tactic today...but I think she will fail..although I was impressed by how quickly she could write her motion and turn it over to the judge before the hearing ended.  Baez and company need to take a few notes from her effiency page.

I do not think that these experts will make the jury believe that the experts the State used are subpar in their respective fields.  I think some of them may not even end up on the stand.

ITA..Baez is a total fool..I don't think he understands, or even tries to understand, the science behind any of this..that is why Baez  acts like the class clown..to try to hide his ignorance.   

I have now read twice the depostion of Dr. Bock. I have looked her up and she has VERY THIN credentials. After two hours of deposing her Ashton asks her:

"Are you prepared to render an opinion in this case as to when the remains of Caylee Anthony were placed at the location they were found."

Dr Bock "NO"

Another big waste of time and and taxpayer's money. She knew NOTHING about sub-tropical plants and does her work in the desert. She has NEVER  testified about bones and plant growth. She has only been used as an "expert witness" in Colorado and very few times at that. It appears it was all in small towns.  She is a volunteer for a group the digs up OLD GRAVES.........

I think this is the motion that Simms wrote in court today after her discussion with the judge and Ashton.  The judge said she needed to clarify what exactly they were challenging , if not the use of the science.  She spelled it out..they are going after the interpretation of the findings..she whipped that out quickly and Baez signed it..she handed it to the judge.  Ashton now has until Tuesday to refute that..if he hasn't already done so.

Body Language and Communication Wise Jose Baez Wins Over the Prosecution Team With His Apology

Before I begin, I must say that both Jose Baez and Linda Drane Burdick have done an outstanding job in terms of presentation to the court and questioning their witnesses.

Linda Drane Burdick is truly a seasoned professional. She is a pleasure to watch as an attorney. She is articulate, well spoken, has great delivery , a well modulated and controlled voice pattern that makes her easy to listen to and presents herself with the utmost class and decorum. There is no doubt that if you were going to be represented by someone you would feel extremely confident having her as your attorney.

Simms will be handling the questioning of those witnesses..and I am thinking that the defense expert witnesses will be the ones we just got the depos on..Dr Bock, and friends.

Ashton had brought that up in court that he had not seen those depos, nor the judge and Baez said he would give them to the court later today.  So I think the defense  have a lousy set of expert witnesses in this field..just my opinion though.

Me too !! I  was so disappointed and highly pissed. I think he let him off so easy! I dont think baez learnt anything. If this case doesnt get him disbarred there will be one in the future that will. You cannot teach old dogs new tricks!  he isnt old but his tactics are. In other dealing with other cases/prosecuters he has handled himself the same as he has with the LE and prosecution.  that will never change. he will continue to bully/insult and push the issue.

when this trial is over and casey gets convicted I am going to call into the JVM show and  tactfully give her a piece of my mind!! victory is ahead.

I can't read Glass as her site freezes my old computer every time. But with her head line Wise Baez wins over prosecution with his apology is BS. IMO  the next line that he did a good in court is another.  He can't ask a straight forward question that makes any sense.  I found most of it all returned back to him and his ability as a lawyer. It was me, me, me and I, I, I.  Like how he had to clarify that Lee had been talking with Dominic Casey about becoming a PI.  had nothing to do with him.  Maybe I am naive but who even gave it a thought that  Baez was helping Lee become a PI. 

I felt the last 3 days was a waste of everyone's time and the tax payers money. I got the feeling most of it was just to grind an axe at LE and the prosecution. Nothing more.   ::MonkeyCool::

The only defense "expert" (and I use that term loosely) so far is Dr. Huntington.
The rest of them are a just like the duhfense.....argumentative, ditzy and dizzy.

Fairgrieve seems fairly likable as well as Huntington, although I think the state
will eat them for lunch if they do get to testify.

Dorothy Sims is a beeotch.

I thought it was funny that right before he grovels for forgiveness to JBP, Linda gave those motions about not allowing anybody to call anybody liers or talk about leaks, etc. 

I am going to refrain from commenting at this time, because I hate for ANYBODY TO GET CANCER, and I do not want to come off as a completely unfeeling person, but I will only say, if true, all I can think of is "what goes around comes around."

This is what I was thinking: At the point that Casey turned to them in the hall and admitted she didn't work there, IMO, it becomes difficult to say they weren't suspicious of her. I do remember the tone of the conversation in the room at Universal, and it seemed to me that LE exhibited the suspicion. I could characterize the conversation as interrogation. If viewing Casey as a suspect or questioning her as a suspect is the bar to meet that demands she be mirandized, then I think it was reached from the moment she made the admission.

That wouldn't hurt much, IMO, if everything she said prior to that came in. However, like I said, if they told her she was free to go, then........ nevermind!  ::MonkeyTongue::

Well, now I know what I look like when I accept someone's apology, and don't really mean it  ::MonkeyEek::  Don't think Jeff really had a choice, to keep things moving along, and just to shut everybody up, it IMO was better for him to bite his tongue and just accept that mess of an apology.

I love your note, CBB, with one exception.  I would not pass the valium kitty to anyone who is in the courtroom having to listen to the drone of JB or CM.  I would hate for HHJBP to fall asleep and hit the floor.  I love this judge and would appreciate it if he remained the one in charge of this case.  I think he maintains his cool rather well.  It surprises me how cool he looks on the outside, right before he admonishes an attorney or the defendant.  You just cannot tell what is going on in that smart head of his.  I would not like to be one of his children, they would never get away with a thing, but their punishments would no doubt be fair and reasonable.  How is the change of judges working for you now, Mr. Biiiiezzzz?  No doubt you are proud of your decision to get rid of JS.  I think the reason Casey sticks with JB is she feels sorry for him.  She was comforting him by rubbing his leg when he was being reminded to act appropriately in court, indeed the irony is rich.

If the defense team has not gotten it by now, I am not sure they ever will.  HHJP likes things to be ON TIME.  I am not sure how they are going to get it through to JB without drilling a hole in his head and putting the info in there and then closing it up again.  Maybe that is why Casey keeps writing, they are planning a procedure where they will drill a hole and stuff her notes inside.  She, therefore, should keep writing, there is plenty of room for her current notes and anything else she may wish put in there.  IOW there is plenty of room for improvement.

JB will continue to be disrespectful to HHJBP, the prosecution, LE, and anyone else who is considered a person of authority.  I believe this is the main thing JB and his client have in common, the disrespect for authority, including not finishing school.  He will continue to be late and he will continue to make the rules, but hopefully his punishment will become more severe as he continues this pattern.  It may not change him, but neither he nor his client have been held responsible for their actions, the result of which we are watching here.  JB had no respect for his child or his role of being a parent--he did not make child support payments, good thing he did not have custody.  His client also had no respect for her child, stealing to support herself first and foremost, then, as we saw from her purchases, stole to supply her boyfriend and his roommates second, and oops, didn't buy anything for Caylee at all.  I don't know about any of you, but buying something for a 2 year old girl has to be almost a compulsion for any mother and grandmother, their clothes and toys are so darn cute, how can you resist?  Unless, of course, your 2 year old is deceased, then she would not need any clothes or toys.  If she was missing and not deceased, I would think, she would be the only thing on your mind, and you would fill the shopping cart with things you want to shower her with on her return.  Boyfriend?  He would be the last one on my mind.  His friends?  Would not make it to my shopping list.  That's just me, but I'm a Mom and I respect the life God has entrusted me with, and I thank God every day for allowing me that privilege.

Please do not take offense to the 'finishing school' statement, it fits into their pattern of going against authority.  They were/are going to be the ones who made/make the rules.  No one is going to tell them what to do.  Casey especially did not want to do it because her Mom wanted her to.  This is just one of the things Cindy could not control, and Casey enjoyed that.  She described her mother as a troublemaker.  Yep, she wanted her to finish school and she also want her Granddaughter kept alive.  So, Casey dropped out of school and killed her Granddaughter, among many other things along the way, like repeatedly breaking into her parents tool shed.  Who does that?  I am not comparing Caylee's life to things, just trying to show Casey thought of her that way.  Most people treat their things better than Casey treated her daughter.

What a hard life for such a little girl.  She had the weight of the whole household on her shoulders.  I hope she enjoyed many happy moments also, before she was taken from this world.  God, hug her extra tight during the days of her mother's trial and pre-trial.  Let her forget any evil that happened to her during her short life.  She will experience bliss forevermore.  We love you, Caylee!

At the Court’s suggestion, we have come to a resolution on the Rule to Show Cause matter.
The 1st part of the resolution is I believe being finished by Ms. Sims, which is a, basically complies with the Order which is a proper notice, and I agree with counsel that this is sufficiently clear to comply with the Court’s Order and any concerns that I had about the lack of clarity in their Motion. So, if the Court, as long as the Court accepts it, ( Sims hands Ashton the 1/2 page scribbled note) ( --ashton to baez---“I don’t have to sign it—just you sign it”. ) then that matter is resolved . The 2nd matter, in terms of compliance, well.....( is baez's apology.)

What a great analysis...........you are so right about how a parent will always pick up even just a little something for their kids. I don't mean to do it, but I can't help but see "something" they "really need"  LOL  

I just think about how much she must have endured being the "token" child which made that family look respectable to the outside world. When this first started, I often wondered where were all their friends, but as time went on I realized their family was so screwed up they were a totally closed group to the outside world. Caylee was only exposed to KC's parties and perversions and I have often wondered if she had been molested since KC just passed out where ever she was  I can't help but believe God let her be removed from her to prevent her from anything worse happening to her. God rest her little soul.

No, he was far from happy about it but it is evident there was quite a conference regarding it.   It may have been off the record to the public, but I do believe there was a record made of the meeting.

Yes, I do believe this was dealt with to keep the trial on course but if he does something like this again, I highly doubt he will escape with merely a forcing of an on the record embarrassing apology.   At this juncture, I agree with the approach Chief Justice Belvin Perry took at this time but if Bozo continues this behavior and makes additional inappropriate attacks again I wont agree if it is dealt with in this manner solely.   I get the impression that this was his last warning of this nature.

I agree;  It has always been my opinion that Baez thumbs his nose at the Court, authority, and the tradition of our legal procedures.  Leopards don't change their spots and I doubt it will be long before his flippancy returns again to be seen by all.  Perhaps he confuses rudeness with "lawyering", if so, he's in the wrong church and the wrong pew.  His disrespect is palpable and off-putting.  Why doesn't he wake up & smell the coffee??  Doesn't he value his reputation & law license at all?????

It must have been galling for Ashton;  Baez appears so insincere, probably thinking he's pulled off a great feat.  It will be interesting to watch to see if his vanity/conceit will ultimately prove to be his undoing over time.

Just my luck I was busier than a one armed paperhanger this week and missed most of the hearing(s) being live-streamed. I did spend my evenings and nights watching the raw videos posted and catching up here at SM. Thanks for all the updates. you guys rock.

Something came up during the questioning that threw me back in time, to the age old un-answered question....WHO is Caylee's father? Well, I believe that may have come out in these court sessions, even though it was not made obvious. I hope by the end of skanky's trial, Caylee's parentage will be revealed, that her father is known, and I hope he sues the pants off skanky for either not informing him that he was a father and/ or taking Caylee's precious life, and his fatherhood from him. I wish I could recall which video, lawyer, or witness was on the stand (It may have been Lee and Bozo), but did anyone else hear mention of Mark Hawkins being wire tapped? First off, Mark is one of Casey's many ex-boyfriends, is an active duty Marine, stationed at Pendleton in CA, and someone she had reconnected with just prior to Caylee's death. There is no way, no how, that the Marine Corps would have given Mark Hawkins leave from his military responsibilities in order to return to Florida to be interviewed or wire tapped UNLESS, he is a next of kin....Next of kin (NOK). I have lived the military life even though I have never directly served. My father, brother, son and significant other have all served, some made a career out of the service and a NOK designation can only be applied to parents, siblings, spouse and children of....If Mark Hawkins was in Florida as a part of the investigation into Caylee's disappearance and death and cooperated with LE to investigate certain involved parties, I would put money on it that Mark Hawkins IS Caylee Marie Anthony's father...Wasn't Mark also in attendance at Caylee's Memorial? I'll have to see if I can find that on line and suffer through the CMA all over again. Anybody else thinking along the same lines here, or is it just me that struck a nerve with? TIA

All the evidence gathered that Baez can not motion away will be brought in..and that includes friends depos, Casey's parents statements, Dom's statements, the duct tape, the diary, etc.

When you look at it all it is so sad and so needless.  I still agree with Casey's Grandma..It seems Casey hated Cindy more then she ever loved Caylee.

I think they need to include the Universal trip and statements because that goes to show that Casey was not looking for her daughter for 31 days because she was lying and not cooperating with LE at that point.  If infact someone had taken Caylee, and if she was afraid for her own and the family's safety..she would have breathed a sigh of relief for the help in locating her child.  She of course didn't and we all know why.  She wasn't protecting anyone but herself and this was purely a vendetta against her mother.  Caylee had outlived her usefulness to Casey..she would no longer be a pawn if her parents succeeded in gaining custody..and with what we now know of Casey's life they would have prevailed. 

Such a huge waste of a tiny soul who wanted nothing more then to live and play and sing and dance and love and be loved....no wonder she was so attached to George and Cindy.

   I've always thought that was the revelation Casey was going to make tho MH that he was Caylee's father.
Seems DNA may have proved it. We shall see.

Just wanted to say I had the same thoughts as you about Mark Hawkins during that point in the hearing.

I hope that we do find out..or atleast LE knows who Caylee's Dad was..that person needs closure too.  And they could sue her in civil court I suppose..but having her do LWOP  or DP would probably suffice....though I think I would need to request being locked in a room with her alone for an hour so I could have may own personal discussion (retribution) with her.

Me too Curly, too bad Cindy went off when she did. A few more weeks may have made all the difference in the world and Caylee might still be with us and in the arms of a loving father....well, she is, but you know what I mean....

I also find it curious that none of the information provided by Mark, interviews, depos, or the wire tapping, first time I even heard anything about him being an "agent of the state" since this all began has been released through discovery.....SA's office must be savings this info for the trial, another, ummmm

Can anyone remember when it was that Amy woke up, missing a couple of hundred $$$, Casey had spent the night..and Amy was wearing different clothes then she fell asleep in?  Was that prior to June 15th?

YES! The military would have a DNA profile on Mark Hawkins. That doesn't mean it's easily accessed by any other government departments or agencies. Even the FBI would need to jump some hoops to get Mark's DNA profile for purposes such as establishing paternity. Permission would have to be through many military channels and released personally by Mark. It's possible parentage was established, and therefore Mark was granted hardship leave.

I saw linda doing a few facial calasthenics myself.  They were not happy.  I just cannot see why JBP would want the state to drop the motion.  It would take him a second to rule on.  Unless, he didn't want to go against either side on it.  Who knows.

I think the contempt was dropped so that the trial could proceed on scedule and the duhfense would not be able to use "bias" against Baez for an appeal. JMHO

PS I don't know what Mark's MOS (Military Occupational Service) is, but if he's intelligence than the FBI already has a copy of his DNA profile. It has to do with security clearances in the event of death. I imagine there would have to be some significant evidence that Caylee was his daughter before that DNA can be scattered around for establishing paternity in any event...

I have often wondered if they knew who Caylees father was and he knew she was his. Why he didn't just step in and have the right to receive Caylees remains and have a proper service for her instead of letting this family of evil have her.  The injustice and lack of respect shown this sweet little girl has been disgusting. If in the end if it is MH I hope he goes after them all when the trial is over.

Also, back on page 30, Amy says that Cindy told her about the smell of the car when they were on their way to Tony's to get Casey, that they (G & C) assumed the smell was from the bag of trash that had pizza boxes and maggots.

First, Cindy never saw the bag of trash, ever.  It's stated pizza boxes and maggots. Not food. Boxes don't cause maggots to appear.  And this is all on the 15th of July, before LE is called and after Cindy has gone through the car and trunk.  This nurse of decomposition was definitely in cover up mode.  moo

I have an extremely difficult time believing that anybody, unless they were forced or drugged, actually bed with Casey Ho on purpose long enough to make a baby, so I think the aliens somehow got human sperm and injected it into Casey Ho as an experiment of some sort, and we will never know whose sperm the Aliens used.

guess we will never know the answer to that! as all the anthonys are liars. I was impressed with Lee because he seems to be the one most sincere than his parents. I didnt think he was in the past! because of his atitude but somehow he has turn it around and made it about caylee in his eyes! at the risk of loosing his sister he said he lied.

I know.  Mine too.  This ain't nothing, what will happen to me when the trial starts, 8 full weeks of daily hearings.  I am filling the freezer up wtih BonBons now and might send the kids to boot camp for the 8 weeks, how does that sound?
