Just watched the episode of the Andy Griffith show that had Aunt Bea in jury duty with Jack Nicholson on trial and had to chuckle at that lady from yesterday.

Casey Anthony judge has potential jurors


 ::snipping2::   Tomorrow is the first day that there could be a jury picked in the Casey Anthony murder trail. And if so, her trial could start as early as Thursday morning.

 
It took seven days to pick 17 potential jurors, and if Chief Judge Belvin Perry has his way, he will swear in as many of them as he can.

Casey Anthony, 25, is on trial for first degree murder in the death of her 2-year-old daughter, Caylee, in 2008. Casey's mother, Cindy Anthony, called police 31 days after Caylee went missing. Caylee was found two months later a quarter mile from George and Cindy Anthony's house. If convicted, she could be sentenced to death.

She also faces six other charges, including aggravated child abuse, aggravated manslaughter of a child and four counts of misleading law enforcement.

Judge Perry said that if the prosecutor or defense does not use any of its preemptive strikes, he plans to seat the first 12 jurors, and swear them in.

"If you don't exercise preemptuaries as I have told you, then I will proceed to bring in the first 12, have them seated to be sworn in along with whatever's left as alternates," Perry said. "And then I will make a decision as we go through alternates and get down, to whether or not, we need any more alternates than we have."

Since preemptive challenges cannot be used on alternates, Judge Perry said he will give each side one challenge for removing alternates.

I don't know how to bring a post over from the old thread, but would like to thank NIKKI for bringing up Chiari and so glad her daughter is doing well.

That being said, I had an MRI of the Cspine years ago and found out I have Chiari I malformation. Would have never known, if not for the MRI. Just spoke to a radiologist I work for and asked if that could cause someone to murder their baby, he looked at me like WTF??? NO WAY he said would it cause a person to do that. So that is not a mitigating factor, sorry defence. Find something else for a mitigating factor.

Got an 86 here. (I don't like how the last question is phrased :-p )

Hey all!

I think one of the other obstacles (besides the condition of Caylee's body when found - tape and trash bags) that the defense will have a hard time overcoming if they argue accidental death will be the length of time that Casey used her zany the nanny excuse for where Caylee always was.  After Caylee went missing wasn't the first time Casey used that excuse, even her family admits to that.  I don't think it has ever been explained where Caylee was all the times she was supposed to be with the nanny.  As a juror I would really question that alone and it will probably go to the abuse/ neglect aspect but as far as an accidental death, it will be hard to explain that she panicked and then used the same excuse she had always been using if things were on the up and up.  Hope that made sense.

Great point, Cheeky, I agree that it's impossible for ICA to claim that she invented Zanny because she was scared after Caylee accidentally died. I really hope poor Caylee wasn't drugged up in the trunk of that Sunfire each and every time ICA claimed she was with Zanny.

JSM...you have Chiari too? see, I was saying this last night..it is more common than folks know..most of us have the Chiari found when looking for other things and it shows up..such as headache causes in my case, especially when I cough hard, and some other things..

I really hope they put her in a conservative suit for the trial.  I'm sick of this pastelly happy hoo-ha.

Good Morning monkeys, well I guess that answers my question.  The pj that was so sure she couldn't judge anyone and could barely understand any of the questions, is not going to be back-struck because of the color of her skin.  This is so wrong to me, I definitely see her has the hold out jury, trying to find a reason not to judge poor lil young mixed up KC.  I guess it is the Batson (sp) reason, not to use a pre-emptory challenge on race or gender but apparently it only applies to non-Caucasian races.  If this is not going back-wards, I don't know what is.  I sure hope she can understand the evidence and find justice for Caylee.  There was a lot more reasons to strike her, not one was the color of her skin.

I take offense to the cause JBP just stated, not being able to be fair and impartial.  Why is it unfair or partial to think she is guilty?  I believe she is guilty.  I believe this woman is proably fair in her every day life and impairtal, but this hoebag is clearly guilty.

It is because the fundamental right in this country is to have a jury that starts with no opinion and listens to the evidence presented then makes a decision. If you go in with an opinion you can not put aside, it is unfair.

It still does not make it right to state that a PJ is fair and partial, because she/he thinks she is guilty.  And, I do not personally believe that any of the PJs have no opinion.  Just the facts read to them by JBP alone have to give them some opinion.  I would be a lousy juror or lawyer or judge.  I guess, the law requires no common sense.

Day 8 Of Jury Selection Could Be Turning Point In Casey Trial

The defense and the prosecution both struck down potential jurors, leaving only 11 jurors. Chief Judge Belvin Perry said that he could not swear in less than 12 jurors, so they would have to bring in more people to talk to on Tuesday.

The first potential juror called in on Tuesday brought a note to the judge from her employer. The note said that it would be difficult for the woman to be gone from her position for a long period of time. The judge excused her for cause.

The second potential juror questioned said she has had the opinion that Casey is guilty for a while now. The judge excused her for cause that she could not be fair and impartial.

Perry said if he can't get 20 jurors picked, he may settle for having fewer alternates.

She must be feeling so cocky right now, thinking the trial is going to be delayed. I think the Judge was expecting this because the minute a PJ is unchallenged, the 12 will be sworn in. I'm expecting more backstrikes before that can happen though.

I hope the State will still backstrike Farmville lady. On the other hand, they have gone through this process so many times that maybe they've encountered this particular type of person before and think they know how she'll eventually vote (guilty).

I think you're right that it's coming from Simms. At the end of yesterday's session, KC and Simms had quite a discussion and they seemed to be talking clothes, IMO.

Anti'ds and anti-anxiety (benzos) would be the normal protocol for someone suffering from chronic depression, along with OCD and PTSD.  Do we know if she has been seen by a doctor to prescribe these?

It is my belief that no matter what happens or is said, Casey will never plead out, she will never-ever admit to killing Caylee. Even if this results in the death penalty. She honestly doesn't care at this point.

This trial, in her mind, is about HER! Do you think this narcissistic animal would decline one moment of basking in the attention of the world? She wants it all to the very last second. Casey has years and years ahead of her for pleading to the court, jailhouse interviews and killer groupies. Even after this trial is over, she will do more for attention, as will her parents. This won't be over by a long shot in their eyes, as long as there is money to be made, they will continue on.

If the disapproval of their families or the nation hasn't deterred them, nothing will. Hell, they handled the death of an innocent child with wild abandon. The Anthonys will do anything to remain in the lime light.  Taking it, as George said, to the very end.

Has anyone noticed that when ICA walks into the courtroom, she leans to one side?  Kinda reminds me of the Leaning Tower of Pisa.

She certainly is animated today.  I have to remind myself she is a 25 yr old woman.  You would think she was in high school, sittin' in the food court at the mall, talking about clothes and boys with her friends Muffy and Buffy.  She seems to be stuck at around age 14.    I guess I just don't understand the ability to be so carefree under such dire circumstances.

Well, as Judge Perry says, I have a long memory and if there's a hang up in the jury with no decision reachable, then I will be asking - and who was it that wouldn't allow her to be stricken -not once but two times?  How much money is this woman going to cost the State of Florida in the end?

Something I don't understand, the prosecution wanted her of the first day - and Judge Perry said no - prosecution said they'd like to use a preemption and the Judge denied that day.  I never understood why the judge wouldn't allow the prosecution a preemption when he allowed the defense preemptions.

Can any monkey help me clear my confusion, please?

I have taken my kids to court just for the educational experience. It is a very good learning experience. I would not want them in court for the autopsy pictures or things of that nature but I really see nothing wrong with this jury selection. Most schools take their kids to at least one or more court proceedings in their History or Economics classes.

Honestly, it seems that the hat is getting hung on that others were rehabilitated after stating something originally but this woman clearly stated that she doesnt want to judge based on what others say but I sense a race issue being the real reason & at the moment Im fuming over it.  My only hope is that when she witnesses evidence such as the car, autopsy, location, etc she will speak for the victim versus her killer.

I don't think it is just race but sex the USSC ruled in the Batson case. I am very disturbed this woman was left on there because she did not sound like she had the ability to discern the evidence and I could not tell what race she was. I would have liked to see her off even if she was green.

You know it does to me too. I would hate to think the judge kept her because of reverse discrimination but from what I have seen it sure appears that way. The prosecution had very good reasons for excluding her, but the judge would not acknowledge them at all.

All I can go by is the sound of her voice.  The first day she was not interested in being on the jury.  When she was called back a few days later....that tone had changed and she did want to be on the jury.  I'm skeptical that she changed her mind and answers.

IMO with that decision, the judge has assured a hung jury, what he repeatedly claimed he didn't want to do.  When one declares that their religion would not permit their judging another, and since sitting on a jury is precisely that, they are unqualified to be on a jury.  Additionally, sitting on a jury is not a church service.  How much more clear did she make it that she will not judge Casey Anthony to be guilty?  She made it clear that she will not judge at all.  One assumes she will sit in the jury room and not participate in deliberation, since she doesn't judge and will not vote one way or another.  I believe this was an outrageous ruling on the part of Judge Perry and my admiration for his fairness has gone down considerably. I believe he will regret his making this determination.  This entire process has become an excercise in futility.

JBP had to deny this person being struck this time, because he has denied almost every single thing that Bozo has asked for, regarding jurors, evidence being allowed, etc., and he was reminded by the baby that he has denied his motions for the same exact reason, equivocation, and he had to deny the state because he has denied the duffence quite a few times already. 

If he had allowed the STATE to strike her, that would really look bias, IMO, so he had to give this one to the duffense.

This lady being on the jury is totally the fault of the State. They blew it right from the start. They should never have issued a peremptory challenge without having the additional arguments that they came up with today. That way, Bozo's objection to the pc would have been overruled. If they didn't use a pc, they could have backstruck today without any reason whatsoever. Unfortunately, you can't backstrike a pj that has already  had a pc denied by the judge.

Cappy, I am gonna worry about this woman all through trial.  She was so adamant that she does not want to judge anyone.  She said she had no friends and yet, she has face book.  She says all she does is play games on there, nothing wrong with that but who does she play them with?  She didn't seem to answer even the simplest of questions.  I think the Batson (sp) ruling should not even apply to her.  The color of her skin has nothing to do with the answers she gave and Casey isn't African-American, why is this even an issue, if it is not reverse discrimination?  We may not need a unanimous decision for the Death Penalty but we do need one for finding her guilty of any of the charges.  I am really worried about this woman and I am sure that the defense think that she is their best hope.  In Session is now doing a whole segment on her and her answers are just beyond belief.

Well, I thought today would be the day we seat a jury, so planned to stay up all day to see that; however, it does not seem that way any more.  I cannot stand watching the wench act like she is out on a picnic with her buddies any more, and I think I will go sleep.

The judge keeps allowing her to behave this way. I am not at all concerned about the Judge hurrying jury selection along.  He really has not.  They have each questioned the jurors to their hearts' contents, all day long, for 6, 7 whole days.  If left up to bozo, he would keep this going on for 6 months.  I think he is being too easy on them.  This is ridiculous.

And, regarding rushing jury selection along, imagine being a juror.  If any more questions were asked, I would seriously hate the defendent if I were them.  I am waiting for them to ask them what color underwear they wear, whether they wear boxers, briefs, or go commando.  What kind of toothpaste they use.  Do they leave the toilet set up or down.   I have never seen anything like this in my life. 

The jurors are not on trial.  They are being interrogated.  This is really getting out of hand, IMO.

Im thinking she feels that the "friends" she has on FB to play a game are not actually friends to her in life, that's my take on it.  I agree the defendant is not a minority so I do not see why it is an issue even before this lady when Bozo first argued it, much less regarding this woman.  Its stated that the jury should reflect the demographics of the community, that being said the issue isnt about her race, its about what she said & what she believes so I cannot agree with CBJP's decision here.  Now, I'm going to say something & Im not sure how some may agree or not but you know me, I dont mince words so here goes...in today's society could it not also be said that when great pain to achieve racial/religious equality to make sure there is at least one token representative of minority in a given situation such as on a jury, panel, board, staff, etc. just as disingenious as the very prejudice we attempt to avoid by doing so?   Would a person rather be a "token" just to make a point or a valued citizen based on the same exact qualities as another of different background?    I have a feeling this is one of those days for me not to be in disagreement about anything but for the very first time in 3 years I'm actually concerned what the outcome of this trial will be & I've been rather adamant up to this point, although that may diminish after the sting of a personal disagreement on this ruling subsides.    In the end, I have to have extreme faith that this jury in its totality will see what we have seen over the years & Justice For Caylee  ::MonkeyAngel:: will prevail.

I would just like to point out one thing.....Regardless if ICA did this or not ...( Which we pretty much all know she did), but she DID loose her only daughter.  I could not imagine my life without my son, and not once have I seen Casey grieve for her daughter AT ALL.  Even the mention of my son's name would bring me to hysterical tears.  She is not normal.  How can someone be so zoned out and unaffected by the loss of their child?  She does not deserve to be on any medication...the only thing that affects her and causes her anxiety is the worry about HER future.....

All of the defense knew that this woman would be perfect for them.  I am sure that is why Casey is so happy today, she is giggly and bouncy and just looks thrilled to be there.  She needed no meds today, she is on a natural high.  Her team has told her they just found the winning lottery ticket and her "Get Out of Jail Free Card".  If only the state would of cited the reasons today they did then but Baez piped in immediately and said they were doing it because she was African-American.  Casey feels like she is Queen of the Ho's again and she is acting just like her real self.  Cocky, confident and bizarre considering the circumstances.  What I thought was insurmountable evidence may now be not even really considered by this juror.  ::MonkeyMad::

I am also concerned about a hung jury.  My feelings, as of today, are that if the jury hangs ICA may take a plea.  Depending upon the count and if there were only 1 holdout, then I think the State would only offer LWOP.  If she doesn't take a plea, I foresee the DP taken off the table for the next trial and this would go much quicker the second time around.  I don't see horseface getting anything more than LWOP, either way.  ::rhino::

I think the judge should start with a more simple question.  Are you for or against having your arm cut off?  Would you consider having your arm cut off?  If circumstances warranted having your arm cut off, could you consider having your arm cut off?

Please don't think I am a heartless person, because I trully am not, but I am thrilled she is feeling poorly.  Sorry, I have no resepct for her or any of them.  They know she is guilty and they keep trying to pull the wool over everybody's eyes to protect her and allow her to walk the streets again.  Yes, that is their jobs, but they can do their jobs, protect her life, but still respect the VICTIM, and realize that society is safer with her locked up, and should be facilitating that, as well as protecting her life, but they chose not to do that.  And, she is particularly sneaky IMO.  I do not like her at all.

I'm guessing it was some impropriety in the Coast Guard.  Since he answered the "have you/family/friends been victim or party to a crime" as a no. 

I don't particularly love law enforcement.  My uncle was a cop.  My uncle did some not so nice things to me a while back.  Law enforcement sit on sides of roads with radar to give you a ticket, becuse they are bored that day, LOL.  But, I believe when they are testifying to something of this magnitude, a missing/murdered child, all of that leaves my mind.

I was wondering also if the attorney's bought her food...I worked for attorney's and they nearly always bought the client's lunch....however the defendants weren't in custody.  I can't see why they couldn't...but that is simply a guess.

my fiance is a cop in a major city with lots of crime and also lots of corruption in the police force. he is not corrupt but there is something in the paper every other day about a corrupt cop in our city so it can be a problem and i can understand why people can be skeptical, but most are good, hardworking people and when it comes to something to the magnitude of a missing/murdered child i agree that the cops want justice just as much as the next person, sometimes more so.

naturally, if someone has a bad experience with LE they can be skeptical of them, i think thats pretty normal

Within my knowledge, I'm pretty sure the only remedy is to preserve the issue during voir dire, after trial file an appeal for a new trial at which time it will be considered by the appellant court  if reversible error occurred.   I'm also pretty sure that there is a mathematical consideration between denials for cause versus challenges (PCs) & the person being objected to must be placed on the record by name during voir dire.   That is a short answer & Id have to look at Florida statutes specifically to have a more precise answer.

I am heariing  in background on WKMG a judge telling jurors if she calls their names they are a juror, if not they are exused.  I heard Mary Butler, Douglas Squires, Robert Soloft, and a bunch of other names.  Thanking the others she did not call, they are excused.  Wonder what case this is for.

Now, she is taking lunch break, it is 16 minutes till one, and she is giving them till 1:30 to come back, not to dicuss case with anybody.  May run into attorneys in lunch room.
